ARE YOU READY FOR A ROBBERY?

A post on a forum from someone who, unfortunately, has just had a bag containing lots of important documents and cards etc stolen, prompted this reminder. It's important for each of us to force ourselves to go through a detailed 'what if' process, to figure out the numbers/things you would need to do, and how you can make such a horrible event at least a bit less painful if it happened to you. If you ask yourself seriously, 'what exactly would I do if I lost my handbag or wallet with all it's contents' its a very worthwhile exercise? Take time to look through your wallet/handbag in detail, and list all the documents and cards you'd need to act upon if lost. Then figure out exactly

what you would need to do for each. Who do you call? What are the lost/stolen cards’ phone numbers? Bank numbers? Lost passport/driving licence etc reporting numbers? Are they the same phone numbers to call from within Spain as from the UK, or in any other country? How will you find them to phone them if away from home? It's not a nice exercise and it'll take a bit of effort and time. But finding them all out, and recording this information now, in a place/with someone else perhaps, that you can access at any time, from anywhere, if needed, is really well worth doing. Do please invest a couple of hours and do it today. Just in case. from Bruce Dowding

Jávea Councillors’ March Meeting

Jávea Councillors stood in a Minute’s silence before starting their meeting on Thursday 26th March to mark solidarity with the friends and family of those who’d lost their lives in the French Alps plane crash the previous day.

The Agenda for the meeting had been authorised for distribution by the Mayor electronically and included a lengthy Barcode that probably allows individual copies to be “tracked”. Point 1 traditionally approves Minutes of previous meetings, but not this month when, instead, it ratified decisions taken by the Mayor under his delegated powers, since 24th February. Point 2 approved the proposal of the Mayor that Councillor Juan Ortola be responsible for communication using the ‘Red Comdes’ Emergency service. Point 3 approved proposals for municipal departments to be relocated. Point 4 approved the list of payments that had been rejected by the Municipal Treasurer, because they had not met the exacting submission standard demanded by the new “paperless” payment policy. Point 5 approved payment of invoices that HAD met the new criteria and were listed under reference F/2015/13. Point 6 approved a change in the Townhall credit requirements in respect of unforeseeable expenditure. Vicent Chorro (Compromis) said he did not approve and believed that additional monies should have been provided for Sport and other projects that have wide

Point 7 approved payment of 511,48€ to Autobuses Denia S.L. in respect of late payment of invoices between 2009 and 2013. Point 8. Councillors approved payment to Biomasa del Guadalquiver S.A. in respect of garden waste for the Ramblars site in December 2014. No amount was mentioned. Grupo Municipal Popular abstained from voting. Point 9 approved a claim by Jose Dario Puig Santacreu for 497€ damages to his trailer. The first 150€ will be paid by the Townhall and the balance by Allianz insurance. Point 10 ratified Statutes relating to a new regional consortium to prevent and extinguish forest fires. Point 11 acknowledged the “WHITE AWARD” being given to various members of Jávea Municipal Police. Point 12 acknowledged the announcement by Construccions la Torre del Portitxol as promoter to become the promotion agent. Approved. Point 13 accepted a report and definitive payment of 11.307€ in respect of Urb ADN 3A project and removed Juan Antonio Armiñana as

promoter and guarantor. Point 14 approved a request to Alicante Diputacion for a grant to provide rain water drainage in Avenida Jaime 1. Point 15 was another request to Alicante Diputacion for a grant of 50% towards the cost of repairs to Cami la Senia/Cami les Sorts that are estimated to cost 59.948€ and will make it safer for vehicles. Approved. Point 16 ratified resolution 0267/2015 of 17th March, against the proposal by “Meson Puerto” (owned by Costas) to build a terrace and platform that would protrude into La Grava beach in the Port. Point 17 approved the regulations with respect to water used at the Townhall. Approved. Point 18 approved the Statutes for the new Water Observatory.

Four out of five Spaniards feel economy is “same” or “worse”

The Ebro overflows while the Valencian Community suffers from water shortage

Recent massive flooding in the Ebro valley has affected 2000 farmers and 19,200 hectares of farmland in Aragon, and at present the water in just one reservoir on the Ebro contains four times the amount of water needed per year for irrigation by farmers in the Valencian Community. This has revived discussion about a water transfer scheme between the two river basins which was mooted some years ago.

Spain outstrips France and Italy in wine exports

Spain is a relative newcomer on the international circuit, compared to the French and Italians, yet it has beaten records to become the biggest wine exporter in the world. According to data published on February 23rd by Spanish wine market observatory (Obervatorio Español de los Mercados del Vino – OEM) Spanish wine exports reached 22.8 million hectoliters in 2014, a 22.3 percent rise on 2013. But while the volume of sales has increased, profits have fallen 2.2 percent since 2013,

Free WiFi in the Old Town

The Business Association Centro Histórico de Xàbia, in collaboration with the Ayuntamiento de Jávea, has announced details of the new free Wi-Fi network in the historic centre of the town that will be available to residents and tourists. The system uses the existing guifi.net network which has been installed for online radio and the sponsored wi-fi zones already operating in SSID proox-infoxabia. Users will have to register first (email, age and sex) after which they will be able to use the zone without any time limit.

Jávea proposes use of municipal land near the canal de la Fontana as a dry dock

Jávea's Town Planning department is currently studying the proposals put forward by the "Marina Nou Fontana" company for the management of the Canal de la Fontana and its moorings. In this context, the town has mooted the possibility of letting the company lease a 3,500m municipal plot of land next to the canal for some of its buildings, and provide space for the creation of dry docks. The rent for this land would go to Xàbia's coffers, not the regional Government, and the facility could help reduce prices for users through the economy of scale. Continued on page 6

Xàbia restores Montgó lime kilns

The summer forest fire on the Montgó uncovered several old rural lime kilns, which were used up until the ‘60’s to make the lime and mortar used for building. These kilns are now being restored by a team supervised by the municipal archaeologist, Ximo Bolufer, and various information boards about their uses and history will be installed. As explained Bolufer there are several of these buildings throughout the municipality, but "almost always away from the urban centres" e.g. in Las Planas or Granadella, the ovens needed to be near wood and limestone.

'Expat networks worsen Spain's brain drain'

Spain's central bank has warned that more and more Spanish talent is being steered abroad by the success of their expat counterparts and the reassurance they're giving them on online platforms, “a potential threat to Spain’s economic production”. Online comments and conversations with Spanish expats working abroad are instigating many more qualified but unemployed Spaniards to take the leap of faith. According to The Bank of Spain, Spanish work migrants “are younger and more educated than those who stay”. “A dramatic increase in Spain’s brain drain could exacerbate the effects of the crisis,” the document states.

Spain: a nation of sun, soccer, bullfights — and the crisis

The economic crisis has officially joined bulls, soccer and sunny weather as one of the most common images of Spain in the minds of foreigners. The finding is part of the Image Barometer survey conducted by the Real Instituto Elcano think tank thst was recently released. The poll asked people in 10 countries in Europe, the Americas, Asia and the Maghreb region of Africa what they thought about Spain. European countries – particularly Germany, France and Britain – view Spain as a poor country and, along with South Korea, expressed the least optimism about its economic progress.

Britain seeks scientific collaboration with Spain

A new initiative launched by the British Embassy in Madrid aims to capitalize on the so-called "brain drain" by linking up scientists that have moved abroad. The new British Scientists in Spain (BSS) Network establishes a communications platform between the British and Spanish scientific communities…." Spain has made huge leaps in areas such as renewable energy, agritechnology and in the 'new materials'

Telefónica to triple ’ broadband speeds before summer

Telecom operator Telefónica/Movistar has announced it will triple the connection speed for all its internet customers before the summer. The communications provider will also switch all its ADSL clients to its new fiber-optic network as soon as the service is available in their location at no extra charge. The unprecedented move rests on the fact that Telefónica knows its customers require a quality broadband connection in order to subscribe to its new services, such as streaming video or pay TV.

CLEARING HOUSE FOR THOSE WHO WANT TO HELP THE HELPLESS and HOMELESS

Every day at the Oasis Help Centre presents a new range of opportunities and possibilities. People and their (usually small, but LARGE to them) problems are part of every day, but sometimes we are faced with NEW problems, and need to think ‘outside of the box’. Recently a Jávea lady came to the Help Centre and asked if we could ‘recycle’ cabbages produced on an allotment garden by children from EMAUS. If there were 20,000 or even 2,000 a supermarket MIGHT have been interested, but there were only about 20, and could we help? We didn’t need to even think about the problem, before a solution was at hand. The cabbages were HUGE and SOLID, so we took them in and phoned Marcos and Xielo at Casa de Oracion in Av. Juan Carlos who feed the homeless each day at 1.30pm. They called the same day and took the cabbages to feed needy people. “What goes around - comes around” is not just a ‘saying’ but demonstrates surplus food grown by youngsters at EMAUS can be used to sustain jobless or homeless people in Jávea. It’s called ‘God’s economy’. Consciencious English lady (speaks Spanish) seeks work, caring for the elderly, frail or vulnerable. Qualified & Experienced.

The Camera Never Lies

Nobody really believes that the world portrayed in the cinema is the real world, even when the film in question claims to be based on ‘real events’ or a ‘true story’. Even so, it’s always a bit disappointing to discover that when you sing along with the chorus of ‘Oklahoma’ beneath your ten gallon hat and with your spurs twinkling down at your heels, that you are in fact in Arizona. Or that Casablanca’s Moorish streets and Arabian interiors are not sprinkled with Saharan sands, but with sands from the beaches and parking lots of Los Angeles. The glorious Alpine scenery of Ken Russell’s Mahler makes you want to rush to the travel agency and book a long weekend in the vertical meadows of the Dolomites, and yet the truth is that you’d be better off in a B&B in the drizzly Lake District where the film was actually made between showers. Sean Connery’s magnificent performance in ‘The Man Who Would Be King’ takes us to the farthest corners of India and Afghanistan, although both Russian and American armies might have had fewer logistic problems had they invaded Morocco, where the film was shot. Mind you, at least he was on the African continent, unlike Cary Grant in ‘Gunga Din’, who never left California. It isn’t often that you see

cowboys in Oxford (unless you’re having some building work done) but when Harvard University refused permission to Michael Cimino to film the opening scenes of his mega-flop ‘Heaven’s Gate’ in situ, he went to Oxford University to shoot (in the cinematic sense) his scenes instead, using Christ’s Church, the Bridge of Sighs on New College Lane and the Sheldonian Theatre among others. ‘Apocalypse Now’ was filmed in the Philippines not Vietnam, ‘Good Morning Vietnam’ should read ‘Good Morning Thailand’, but close enough I suppose. Stanley Kubrick went even further (away), filming the Vietnam scenes of ‘Full Metal Jacket’ in an abandoned gasworks at Becton on the north bank of the Thames, where parts of ‘For Your Eyes Only’ and ‘Empire of the Sun’ were also filmed. The Mekong Delta scenes were filmed among the equally lush tropical foliage of the Norfolk Broads. Kubrick’s set designer was Anton Furst, who also did the sets for the first ‘Batman’ film starring Michael Keaton and filmed wholly in England at Knebworth House, Hatfield House and a power station at Acton Lane, West London and Little Barford in Bedfordshire. If Batman can be made in England; why not ‘Superman’? ‘Superman IV’ gave us the best ever Metropolis: Milton Keynes, with the railway station making a convincing United Nations building and the HQ of Argos easily imitating the ‘downtown’ hotel where Mariel Hemingway was lodged. Kubrick was a master of disguise, and nowhere more so than in ‘Eyes Wide Shut’, which was in fact filmed almost exclusively in London, either on the streets of London or in Pinewood Studios. The mansion where Tom Cruise discovers the sect with the tedious soundtrack is Luton Hoo stately home, which has also been a location for ‘Four Weddings and a Funeral’, ‘Wilde’ and ‘Never Say Never Again’. ‘Gladiator’ on the other hand never managed it as far as Italy; Malta was as Mediterranean as it got, and the opening battle scene in the wild, barbarian forests of untamed Germania were in fact filmed in sedate Farnham, Surrey, where environmentalists were most annoyed by the swathes of forest cut down for authenticity’s sake. album ‘Bridge Over Troubled water’, Paul Simon sings: “Tom get your plane right on time…….fly down to Mexico”. ‘Tom’ is Art Garfunkel (the duo’s original name was Tom and Jerry) and he flew down to Mexico to film ‘Catch 22’, where the fishing village of Guayamos became North Africa for this surrealistic film about World War Two and entrepreneurial values. ‘Carry On Up the Khyber’ only rose as far as Snowdonia, whereas Amadeus’s native Austria is the Czech Republic, with impressive Vienna substituted by equally fascinating Prague. ‘All Quiet on the Western Front’ couldn’t have been much more western, being filmed exclusively in California, with all mod con trenches at Santa Ana and Balboa. The brief visits to the alien planet surface in ‘Alien 3’ involved landing at Blast Beach near Dawdon Colliery in Northumberland and at the Blyth Power Station in Bedlington. Mind you, the second part (‘Aliens’) used Acton Lane Power Station and the original (‘Alien’) was shot entirely in studios in Berkshire and Surrey. The 1938 version of ‘The Adventures of Robin Hood’ starring Errol Flynn was actually filmed in Sherwood Forest. However, it was the Sherwood Forest 15 miles west of Los Angeles, named so because the 1922 Douglas Fairbanks version had been made there. London also doubles as Los Angeles in ‘Who Framed Roger Rabbit?’, where the Acme factory is in reality (if you’ll forgive the expression) an empty electrical testing station in Shepherd’s Bush, while the cinema was the Gray’s State Theatre in Grays, Essex, now closed, but which used to be the largest single screen auditorium in Europe. Rod Steiger, for me, will always be ‘Napoleon’, and Christopher Plummer is convincingly arrogant enough to play the commander who described his own men as “the scum of the earth”; the Duke of Wellington. The cockpit of Europe, Belgium, however, was jetted out to the Ukraine for the battle scenes, and Louis Continued on page 15

Weather conditions in Jávea have not been very kind during March. We have suffered very heavy rain and some rather high winds, the result has been an increase in service requests to visit, identify the problem and of course effect a cure. At times like this it is quite sensible for the engineer to check his stock levels, based on his experience of possible problems. It's best to ensure that items like quality coaxial cable and associated clips and connectors are available, along with various LNBs. These are the devices that collect the reflected signals from your satellite dish and feed it to your TV. Along with these items it's best to carry a variety of wall fixing bolts, these can be sub-divided into expansion type along with your typical type that rely on a plastic insert. As always a check of the test equipment: on board batteries should have been checked and charged accordingly. Here it should be mentioned that it's only fair to the client that quality high performance test

equipment is used, after all the final results rely completely on the readings delivered by the equipment! I have been very fortunate in being involved in the communications industry for more years than I care to mention, having first worked in the U.K. a few European countries and also the Middle East, but the check drill is always the same, starting with a site survey involving every facet of the installation. These things never change! This visual inspection is very important. First note the direction and fixing of the satellite dish and direction, then pop inside, switch on the TV and associated satellite receiver and note the results. Assuming that all connections are firm and in the correct settings, this is the first call on the test equipment and the resulting loss of signal and picture quality which occur after heavy rain and heavy wind. Then it is time to take the miniature portable test equipment and examine the satellite dish, which usually involves a set of teps or adders and of course some hand tools and a short coaxial lead. My first check is to ensure the support holding the satellite dish is very firm and there is no movement, rock steady in fact. High winds can work the wall fixings loose over a period of time and the latest high winds have altered many settings. If that is the case, first it may be possible to simply tighten them, but more often than not a more heavy duty type is needed as a replacement. This can involve somehow securing the satellite dish whilst completing the manoeuvre. If your check proves the mounting bracket, bolts etc are rock steady, it is time to disconnect the client’s coaxial cable and substitute it with your test cable and test equipment. More often than not, the strength of the wind has forced the satellite dish to move on its horizontal axis, perhaps only a couple of millimetres, but sufficient to reduce the signal quality to produce at best a picture that breaks up, accompanied by blips in the sound. A centimetre or so can result in no station at all, yes, the alignment is so critical! The DIY man who has purchased an ' alignment meter for 25 or 30€ becomes very dissatisfied with the results, often zeroing in on the wrong satellite transponders! The professional has to spend many hundreds of pounds, even

well over several thousand pounds if it includes a screen display and spectrum analyser, very important in areas of low signal, as I know! If your test equipment indicates a zero reading, it is time to check with your compass the known compass bearing and match the position of your satellite dish to it. In 99 out of a hundred occurrences this cures the problem. If the results are low readings and assuming you have also run through the vertical setting (very rare for this also to be out of true), then it's time to replace the LNB (Low Noise Block) situated in front of the satellite dish, usually supported by a single arm or often by three rods, the length of the rods or the single arm is critical and must match the Manufacturer’s design and test for maximum performance. Three Envelopes

Mr. Frobisher had just been hired as the new CEO of a large high tech corporation. The CEO who was stepping down met with him privately and presented him with three numbered envelopes. "Open these if you run up against a problem you don't think you can solve," he said. Well, things went along pretty smoothly, but six months later, sales took a downturn and he was really catching a lot of heat. About at his wit's end, he remembered the envelopes. He went to his drawer and took out the first envelope. The message read, "Blame your predecessor". The new CEO called a press conference and tactfully laid the blame at the feet of the previous CEO. Satisfied with his comments, the press and Wall Street - responded positively, sales began to pick up and the problem was soon behind him. About a year later, the company was again experiencing a slight dip in sales, combined with serious product problems. Having learned from his previous experience, the CEO quickly opened the second envelope. The message read, "Reorganise". This he did, and the company quickly rebounded. After several consecutive profitable quarters, the company once again fell on difficult times. The CEO went to his office, closed the door and opened the third envelope. The message said, "Prepare three envelopes".

After a week of rain and cloud, the sun shone brightly on Saturday 26th March, and everything was on schedule for an event that would announce the coalition by Oscar Anton of Xabia Democratica with Ciudadanos por Jávea with Juan Ortola. Many local political celebrities were present, and as dusk fell the wind blew reminding many of us why we had relocated from Northern Europe. The weather spoiled the evening but could not dampen Oscar’s enthusiasm to lead the combined troops into battle on 24th May. The event was hosted at the garden centre and metal sculpture park established by Toni Mari on Camino Cabañes. The Spanish cuisine and entertainment were outstanding and by the time most people had been

eating for an hour, even more food was arriving. Oscar said coalition was not something ‘fresh’ for XD and CdP, who had cooperated for four years to ensure that the quality of life for all Jávea residents was improved. “We will build on that foundation to further improve life for everyone. “In 2011 we inherited a shattered town in deep economic crisis, where political leaders lacked public respect” Oscar told listeners “but now our pride in Jávea is shared

Finally from this overview you will realise the importance of not only using quality test equipment but being able to translate the various readings into meaningful observations. Over the years I have trained many engineers in being able to maximise the performance and resulting image quality. I can confirm that the satellite transponders of Astra 2 A have now been switched off and are no longer in use! Now depending on individual areas, it is possible to use 1.2 metre dishes of good quality, however my favourite is the 1.4 metre size, again of good quality. Using the 1.4 metre size means you can view all the channels transmitted for the UK that can be viewed in Spain, including the range offered by BBC, ITV, Channel 4, Five and of course all the Sky offerings. Some Channels are scrambled and require a suitable card and a satellite receiver compatible with this form of reception. These can be provided here in Spain! There was a young woman who had been diagnosed with a terminal illness and had been given three months to live. So as she was getting her things 'in order,' she contacted her Pastor and had him come to her house to discuss certain aspects of her final wishes. She told him which songs she wanted sung at the service, what scriptures she would like read, and what outfit she wanted to be buried in. Everything was in order and the Pastor was preparing to leave when the young woman suddenly remembered something very important to her. 'There's one more thing,' she said excitedly. 'What's that?' came the Pastor's reply? 'This is very important,' the young woman continued. 'I want to be buried with a fork in my Right hand.' The Pastor stood looking at the young woman, not knowing quite what to say. That surprises you, doesn't it?' the young woman asked. 'Well, to be honest, I'm puzzled by the request,' said the Pastor. The young woman explained. 'My grandmother once told me this story, and from that time on I have always tried to pass along its message to those I love and those who are in need of encouragement. In all my years of attending socials and dinners, I always remember that when the dishes of the main course were being cleared, someone would inevitably lean over and say, 'Keep your fork.' It was my favourite part because I knew that something better was coming...like velvety chocolate cake or deep-dish apple pie. Something wonderful, and with substance! ‘So, I just want people to see me there in that casket with a fork in my hand and I want them to wonder 'What's with the fork?' Then I want you to tell them: 'Keep your fork ..the best is yet to come.' The Pastor's eyes welled up with tears of joy as he hugged the young woman good-bye. He knew this would be one of the last times he would see her before her death. But he also knew that the young woman had a better grasp of heaven than he did. She had a better grasp of what heaven would be like than many people twice her age, with twice as much experience and knowledge. She KNEW that something better was coming. At the funeral people were walking by the young woman's casket and they saw the cloak she was wearing and the fork placed in her right hand. Over and over, the Pastor heard the question, 'What's with the fork?' And over and over he smiled.

During his message, the Pastor told the people of the conversation he had with the young woman shortly before she died. He also told them about the fork and about what it symbolised to her. He told the people how he could not stop thinking about the fork and told them that they probably would not be able to stop thinking about it either. He was right. So the next time you reach down for your fork let it remind you, ever so gently, that the best is yet to come. Friends are a very rare jewel, indeed. They make you smile and encourage you to succeed. Cherish the time you have, and the memories you share. Being friends with someone is not an opportunity, but a sweet responsibility. And just remember ... keep your fork! The BEST is yet to come!

Rumours have suggested that part of the land become a dry-dock and repair facilities for boats that can use the Canal, but it will require planning changes, neighbour consultation and a tender to get the best value for land reaching out towards Ctra. del Pla. Cinema. The previous ideas proposed and approved to preserve some Jávea historical buildings have been slightly altered, and could make a big difference, but are still the subject of negotiation. Jávea Councillors want to preserve history for future generations, but Alicante express the view that it will often prove cheaper to demolish the existing and build afresh, than to repair what has been neglected.

No one would doubt that Mayor José Chulvi is an excellent hand to have at the helm of the good ship “Jávea” as she avoids the choppy seas associated with the area around San Antonio lighthouse. He has always made those not born in Jávea to feel “very special” by convening meetings in English, a language which he has been exploring and learning for many years. PSOE Branch President George Brooks introduced the morning’s speakers Councillor Doris Courselles and Mayor José Chulvi. Doris - it’s her trade-mark - was brief and to the point, in explaining why she had afain decided to support José. Other members of the PSOE team were present and it soon materialisedthat the common denominator was our love for this area and the unanimous decision that it should have no more than minimal change to the building code. Mayor José Chulvi wore a lapel microphone and thanked everyone who voted - regardless of the way they cast their vote - and voting was a hard-earned right and should be exercised by everyone who had registered to do so. More than anything in Jávea we have made it easier for citizen and tourist alike to feel ‘closer’ to the Townhall, as we all concentrate on improving the quality of life. The Citizen’s office had narrowed the distance between the Townhall and the people. There was a new Library and Social Centre in the Port, and the pueblo Riu Rau now has a roof and lighting, making it an ideal functions area and museum of raisin history. José made a passing reminder of his initial decision NOT to draw the 50,000€ a year salary as Mayor of Javea - like Mayors of other similar sized were receiving - and let us never forget those without work who must daily question their self-worth - it was one of my pre-election promises that I would donate my Jávea salary to a fund to support the less fortunate in this village, and during my four years as your

What Every Bride Deserves

It is every girl's dream to have a fairytale wedding, but when planning a wedding, the first thing to take into consideration is how much is it going to cost. In the UK a wedding can cost from about £11,000 to well over £20,000 depending on the number of guests and venue chosen for the reception. A couple of years ago I remember watching a programme on the TV about weddings. The presenters of the programme which was called "The Big Day", helped the family and friends of a couple that wanted to be married, to arrange a wedding in a week, but to keep to the family budget. Emma and Steve, who had been engaged for two years, told their family that they would love to get married but couldn't afford it. So their family and closest friends got

A meeting was arranged between the family, close friends, Emma and Steve, and at that initial meeting, the presenters encouraged the couple to say what they would like included in the big day. Both Emma and Steve were great lovers of chocolate and Emma said she would like a white or cream dress. The couple then left the room to give the family and friends a chance to suggest ways and means of keeping the cost down but giving them a wedding they would never forget, bearing in mind that it all had to be arranged in a week. It was agreed that with a budget of £9,000 they would try to make savings and some of the family and friends said they could help. One friend was a photographer and would be prepared to take the photographs as a gift. Another

friend said she was willing to bake the wedding cake and suggested that as Emma and Steve were so fond of chocolate, it just had to be a chocolate cake. One of the family had a boyfriend that had a classic car who would be prepared to drive them to the various venues. One of the friends said she was a hairdresser, and her colleague was a makeup artist and as a gift, they would look after all the beauty arrangements on the day for the bride, her bridesmaids, and the mothers of the bride and groom. The bride's father said he would look for a venue and the bride's mother and Emma's best friend could choose the dress. £1,500 was earmarked for the bridesmaid's dresses, rings and wedding dress. They looked at three venues, one was too expensive, a scout hut just wasn't acceptable, but they finally decided to hold the wedding in a conference centre. The problem was that the room they were offered was in fact a wide corridor with several doors down each side. The good news was that it would only cost £400 to hire and they were free to decorate it any way they wanted. The only problem was that the work couldn't be commenced until the day before the wedding as the conference centre was being used by accountants on a training programme. ITV Stickers on Motorbikes /Quads

If you have a sticker coloured; Yellow (your ITV expires in 2014) Red (your Itv expires in 2015), Green (your Itv expires in 2016)..... Do I have to display the sticker in my vehicle?

Yes, of course. The sticker is placed on the windscreen of cars and is regulated by Royal Decree, which states that “vehicles that have favourably passed the periodic test shall display in a conspicuous place a distinctive, which indicates the date on which they must pass the next inspection”. Anybody who has been for one of these inspections will know that it is much like the equivalent of the MOT in the UK, albeit with different qualifying criteria, but on passing the test the vehicle’s documents are updated, and the sticker given to be displayed on the windscreen.

Where do I have to display the sticker?

As for where the sticker is displayed, that too is dictated by law, and it is mandatory to place it in the upper right corner of the windscreen as you are looking out, affixed to the inside, so that the sticker can be clearly observed from the outside of the vehicle, where it will subsequently be displayed in the upper left hand side.

V-13 – The Green L-Plate

A common question that often emerges when driving in Spain relates to signs, both on the roadside, and on vehicles. One such sign which is frequently seen is a green-backed L-plate, which is indicative of a novice driver, although now qualified, and is designed to advise other road users of that fact.

ONE L OF A SIGN

Officially known as the V-13, the Lplate must be displayed on the vehicle for a year after obtaining their permit to drive. There are one or two exceptions, but for the purpose of this article we are discussing why it would be displayed. The laws regarding the V-13 state that the “L” plate must be displayed on the left rear side of the vehicle, in a conspicuous place, except on motorcycles, vehicles for disabled persons and tricycles, where there are allowances for the location, other than it must be on the rear of the vehicle. Previously restricted to a slower speed than other drivers, a change in the law in 2011 meant that this no longer applied, and that vehicles displaying the sign can travel at the same speed as other road users, subject to obvious restrictions. One element which is more restrictive for novice drivers is alcohol. We already know that the alcohol limit in Spain is considerably lower than the UK at 0.25 milligrams per litre, but for novice drivers, the limit is 0.15 milligrams of alcohol per litre of exhaled air. The other restriction relates to traffic violations, whereas a novice driver is given 8 points instead of 12 for a fully experienced motorist, which are

deducted should the driver be found guilty of offences relating to road traffic laws. The overall aim of the sign is to serve as a warning to other drivers that the person in charge of this particular vehicle is a novice, and has still to build on the experiences that a future behind the wheel will bring. Caution, patience and understanding are all that is requested by those who have gained the knowledge, as well as allowing more distance and time for the driver to carry out the moves that may seem second nature to others. Finally, in the event that a novice driver chooses not to display the mandatory sign, then the prospect of a fine is waiting for you, should you get caught out.

If I loan my car to another driver?

When driving in Spain, if you are not the owner of the car, do you need written permission from the owner to prove you are allowed to drive the car? There is no law that forces you to prove you are driving a friend's car. If the car has up-to-date documents, the Insurance will itemise who can drive and the range of ages and driving experience, you will not have problems with the police. If you are going to drive your friend’s car for a long time, it is advisable to carry a document where the police can check that the owner gave authorisation to the driver to use his car. There is no official format, only you need to include your details and the driver details, write that you give him permission and your signature. If you can include a photocopy of both (owner and driver) ID documents at the bottom of the paper it would be perfect. Many people buy a car and promise the seller they are going to fix all the paperwork and transfer the car in a couple of weeks, and they never do it, so in order to avoid this situation and help the police in its task of identifying these drivers, it would be better to carry this document to prove the car has not been bought (but not transferred into their name) by the person who is driving it.

How to deregister a vehicle with foreign licence plates?

In order to deregister a vehicle that was originally registered abroad, and to do so while in Spain, you must follow these steps: 1. Take it to an Authorised Treatment Facility (Centro Autorizado de Tratamiento - CAT) in Spain. 2. Get the “Certificate of Destruction”. 3. Contact the corresponding driving authorities where the vehicle was originally registered. Deliver the Spanish “Certificate of Destruction” along with the vehicle logbook, and request the official deregistration. This procedure must be carried out this way because the vehicle is not registered in the records of the Spanish “General Direction of Traffic” (Dirección General de Tráfico – DGT).

However, since Spanish vehicle scrapping facilities meet with the European regulations with regards to the recycling of a vehicle at the end of its life, which is stated by the Certificate of Destruction, the owner will not have any issues when they come to deregister the vehicle permanently in the foreign country where the car was registered for the last time. In DGTbajas.es, you can arrange the removal of your vehicle by a Spanish “Authorised Treatment Facility” (Centro Autorizado de Tratamiento - CAT), so you can obtain the “Certificate of Destruction”, which will allow you to process the permanent deregistration in the country of origin.

Carrying Gas Canisters in the Car. Although the winter months are coming to an end, there is still a chill in the air, and many people in Spain still rely on bottled gas to heat their homes, and many more rely on bottled gas for cooking.

Although gas supply companies will deliver the bottles to your home, many people find it more convenient to pick up their own supply at many of the outlets across the country, exchanging the empty bottles for full ones, but in order to do this, we have to think about the safety and security implications of carrying a potentially lethal canister. Depending on their size and weight, the canisters can be very heavy as they are filled with pressurised gas. At home, care should be taken as to where they are stored, in well ventilated places, away from heat and ignition sources, far away from toxic materials and always in an upright position. In the car, it is equally crucial to take the necessary steps to ensure your safety and the safety of other road users. Spanish law states that you can carry 2 gas bottles in the car, and they must be carried in an upright, vertical position. You must also take necessary measure to ensure that the canisters are secured in the vehicle and cannot move during the journey. The law also states that when you are carrying gas canisters, it is forbidden to park the vehicle in an underground car park. You should also check with your local supply company for their recommendations for storage and carriage, as gas canisters can pose a major threat if not handled correctly, but are perfectly safe if the advice is followed. Here is the Royal Decree which relates to carrying bottled gas in the car:

I’ve read about ‘Pegasus’ - the new aerial radar

The helicopter is positioned above the vehicle to maintain visual contact. The pilot and cameraman operate in coordination. It is equipped with two cameras: one, panoramic, follows the vehicle and captures its speed; the other, with telephoto lens, reads the registration number.

How Pegasus Works The new aerial radar has an advantage: it's more selective and allows observation of drivers' conduct, identifying risky behaviours. Pegasus can operate from a height of 300 metres and from a distance of one kilometre away from its target. The purpose of the system is to recognise the geographical co-ordinates (latitude and longitude) of the vehicle it is checking in order to calculate its speed. Firstly, the helicopter is positioned with extraordinary precision, by way of various mechanisms (gyroscopes and speedometers) and a computer programme added to the surveillance cameras. Next, a laser measures the distance between the helicopter and the vehicle every three seconds. With these data, the successive movements of the vehicle and its speed can be determined to record the offence. With the offence confirmed, a frame from the video recording is sent as evidence telematically to the Centre for Automated Complaints Processing (ESTRADA), where the incident will be handled. This also includes anticipated criminal offences, for which a Guardia Civil patrol can be contacted immediately from the helicopter.

exact distance between the helicopter and the vehicle. 3. The speed is determined from the successive positions. The system measures every three seconds and calculates the average. Speeds between 80 and 360kph can be detected. 4. The offence is recorded and handled telematically.

Emergency travel documents

An emergency travel document lets you leave another country if you can’t get a new or replacement British passport in time to travel. You can apply for an emergency travel document (sometimes known as an ‘emergency passport’) if you are a British national outside the UK and your passport has been lost, stolen, damaged or has expired. You should first try to renew or replace your passport if it has expired or is damaged. Only apply for an emergency travel document if you need to travel before you can get a replacement.

What an emergency travel document does

An emergency travel document allows you to leave the country you’re in and travel to your destination via a maximum of 5 countries. The emergency travel document can also cover a return journey if you’re resident in the country you’re applying from. An emergency travel document doesn’t guarantee entry to every country. You may also need a visa. Check with the embassy or consulate of the country or countries you’re intending to travel to or through.

How to apply

You need to apply in person. Contact your nearest British embassy, high commission or consulate to check if you need to make an appointment. You must bring with you: a completed emergency travel document application form

a recent photograph of yourself proof of your travel plans - eg, booking confirmations (or detailed written travel plans if you can’t book ahead) a police report if your passport has been stolen. You will have to pay a fee in local currency, equivalent to £95.

Getting your emergency travel document

The embassy or consulate staff will check that you’re eligible for an emergency travel document. If you’re not, they will tell you why. You may get the document on the day you apply if your circumstances are straightforward. It can take longer if your circumstances are more complex. You may need to change your travel plans.

Using your emergency travel document

The emergency travel document will only be valid for the journey that you specified when you applied and for a specific period of time. This will be shown on the document. Your existing British passport will be cancelled in most cases. Immigration authorities may keep your emergency travel document when you arrive at your destination. If you are travelling within the next 48 hours, please call 902 109 356 or +34 917 146 300 to arrange an ETD. When you pay for a Vado you are paying for free access to your garage or off-street parking, not for a parking space on the street. So if you park your car on the street in front of your Vado, the local police could still remove your car and give you a fine.

Using Headlights During the Day

What are the rules regarding having your lights on during daytime when driving through road works?

These days we see a lot of cars travelling during the day with their lights on already, but these lights are usually very different to the ones referred to as “headlights”. Since 2011, all new cars and trucks sold in EU were required to have Daytime Running Lights (DLR)

installed, which turn on automatically with the engine, in accordance with a new European directive designed to improve road safety. The rule also became mandatory for trucks and buses from August 2012. The DLR is a new method of illumination, with low energy consumption, but is not designed to provide additional lighting for the driver, but rather to improve “significantly” the vehicle’s visibility to other road users. Studies on the use of this lighting show, according to the EU executive, road users including pedestrians and cyclists, more clearly detect vehicles equipped with daytime running lights than those who do not have this device. However, the question above refers to traditional headlights, which also provide additional illumination for the driver as well as other road users, and the circumstances when they must be turned on during the day. There are certain times and locations when you must turn your lights on during the day, these locations are indicated by a white pictogram of headlights on a blue circle sign. You will see these as you approach tunnels for example. In addition, during the winter months when the sun is lower and visibility can become problematic as a result, the DGT recommend having headlights on during the day to achieve the same increase of visibility as is achieved through the DLR. Under normal circumstances however, there is no mandatory requirement to have your headlights on during the day, and that also applies when driving through road works. Article 104 of the Reglamento General Circulacion, refers to the use of headlights during the day, and explains how you do not have to turn on your lights when there are road repairs on the road, but details the situations when it is compulsory. All vehicles travelling on a reversible lane, sometimes called a bi-directional lane, which can at times be used by traffic in either direction. These sorts of lanes are common near to city centres, where the flow of traffic can alter to give more space for vehicles in one direction, such as towards the centre of the city at the start of a working day, and then away from the city at the end of the day. Although the accessibility of the lanes will be clearly marked, there is a risk to other road users and so increased illumination is of benefit. A circumstantial additional lane, such as when a lane is created with a series of cones to avoid an obstruction or to improve the traffic flow in one direction. These “circumstantial” lanes are often created at busy holiday times, allowing

the road management to create extra lanes to ease congestion at certain times, such as when many people are expected to leave a city to go on holiday at the coast, for example. They are also often used to bypass an obstruction that may pose a problem for the normal flow of traffic, such as a broken down truck that is disabled and cannot move. A lane normally used by traffic in the opposite direction, known as a contraflow. These lanes are frequently used on motorways when traffic is diverted onto a lane on the opposite carriageway for example. Here is the text from the article that explains this. Now, it is cheaper to present a claim in Spain! The Spanish Court fees end. In this article, we would like to inform readers that Royal Decree Law (RDL) 1/2015, of February 27, of second chance mechanism, providing reduction of the financial burden and other measures of social order, has been approved. In this RDL, the Law 10/2012, known as the Court Fees Law has been modified. In particular its Article 4 concerning exemptions, which now include as exempt individuals as natural persons. This is good news, since it means natural persons (individuals) no longer have to pay any court fees in order to be able to bring claims before the courts, present appeals, etc. These changes have come into force from the 27th of February, and are now in effect. The money to be saved is substantial, considering that the court fees were very high, especially for appeals, or claims for significant amounts. But it also affects minor court cases, for example: Previously, to file a claim or lawsuit for 10,000€ meant an initial cost of 310€ court fees in the first instance, and the amount is increased in case of appeals, etc. The removal of these court fees will allow individuals to access justice in a more economical manner, they will no longer be an obstacle in case of not having sufficient financial means. Remember that for legal entities (i.e: companies) the court fees are still required, within the requirements set by law. This RDL 1/2015 also includes other measures, known as second chance or for the reduction of the financial burden, which aim to allow debtors to be able to get rid of remaining unpaid debts after the liquidation of all their assets, even if said sale of assets was not enough to pay all debts, the law makes extrajudicial payment arrangements more flexible, to allow individuals a real second chance. It is expected that these measures will apply not only to people in business but also to individuals not involved in business. These second chance measures could have a significant impact, especially in this climate of crisis, and we will talk about them in later articles. If you need legal advice please contact us.

If you lost money investing in Bankia’s shares? You can get your money back.

Almost daily now there are new court judgments from audiences all over Spain: Madrid, Valencia, Oviedo, ruling against Bankia, in complaints from consumers who purchased Bankia shares (stock) after its initial public offering (IPO) . Many courts understand that investors who bought shares (before knowing the real situation of Bankia) did so on the basis of information provided by Bankia, mainly in the prospectus, which was absolutely wrong and did not reflect the real situation of the financial entity. Proof of this fact is highlighted in that shortly after its IPO, in 2012, the accounts were reformulated and the authorities had to bail out the bank. Moreover, as published in the press, experts of Bank of Spain concluded in their reports that Bankia’s accounts did not reflect a true picture of the entity. Those who can sue or claim. In principle Bankia could be claimed against by all those who bought shares until approximately May 2012, when the accounts of Bankia were redone and the real financial situation was known. (shareholders, and also those who sold their shares at a loss).

Deadline to sue or claim

Although the deadline to claim is not clear, it is advisable to sue before three years, starting from May 2012, i.e. before May 2015. Amount to be claimed. In principle one could claim for the amount of the investment, or the damage caused by the investment.

Legal basis for the claim

Revocation or cancellation of the shares purchase due to lack of consent, as the investors agreed to buy based on data provided, which was not true and correct. Contractual liability (malpractice) could also be claimed against Bankia. Also

liability for the wrong information contained in the prospectus published. Those interested in claiming, should prepare the following documents: - Copies of receipt or documentation relating to the subscription, purchase order of the Bankia shares, etc. .-Any other documentation from or to the bank, such as convenience and suitability test, previous claims, correspondence (emails, letters ...), etc. - Proof if you did not receive any formal further/higher education - Bank statements that show the performance of the Bankia shares, at least the latest one. -Summary of other products you contracted with the entity, any contract signed with the bank, etc. We believe that the chances of getting back the investment are high. BFA, the parent company of Bankia, recently announced that they have reserved 468 million euros to meet the liabilities from Bankia’s IPO in 2011, and Bankia had also reserved another 312 million euros, to cover this same liability. dress from Oxfam where they were able to pick up a long cream dress for £200 which could be altered to fit and be improved. They had been to a boutique a few days earlier but the dress of their choice would cost in excess of £1,000 and they considered this far too much to spend on a dress with a budget of £9,000 to pay for everything. The dress was altered and the bride had a fitting two days before the wedding. She had to wear rubber gloves and be blindfolded so she couldn't see or feel the dress. Final adjustments were made by pins and the dress taken away to have the final alterations made. They spent hours sewing beads on the bodice to give the dress a touch of class. Two of the family members had agreed to make the desserts, which of course had to be chocolate based! It took them twelve hours to make the 80 desserts but they looked wonderful. The day before the wedding the family and friends were allowed to go into the conference centre to start work converting the wide corridor into a dining room. They draped chocolate and cream material from ceiling to floor down both sides of the corridor to hide all the doors. One of the doors I noticed was the WC and hoped for the sake of the guests there was another close by! On the day of the wedding, an hour or so before the bride was due to leave for the Church, the sheet covering the dress was removed and the bride shown her dress. Unfortunately, she burst into tears and said she didn't like it at all and it wasn't the type of dress she would have chosen. The bride's mother relented and there was a mad dash back to the boutique which housed the dream dress which cost them over £1,000 but her mum knew it was what the bride would have chosen. When they brought the dress back from the shop her face lit up when she saw it and said it was just what she would have chosen. Emma got changed into her new dress and she really did look beautiful and very soon she was ready to leave for the Church. The programme filmed the Church ceremony and it was obvious from the tears in Emma's eyes as she made her vows that she was so much in love with Steve. After the ceremony and photographs the bride and groom left in the classic car, which did look very smart, to the reception. The couple were led into the room with their eyes closed and not allowed to look at the room until they were told to. It was really amazing the difference the family and friends had

made to the wide corridor, everything looked so professional. When the pyramid of chocolate desserts were brought into the room there were gasps from the guests. They looked as if they had been made by top professionals. The bride was trying so hard to keep her composure during the toasts and speeches, but finally broke down when they showed a video on a television screen of a greeting from her grandmother who lived in Yorkshire and wasn't able to be at the wedding because of bad health. As the reception came to an end, Emma and Steve thanked all their family and friends for making their wedding day "The best day of our lives" and for all the hard work which had made it so special. At the end of the programme a breakdown was given on the money spent, and even taking into consideration that they had spent over £1,000 on the dream wedding dress, the total spent was less than the £9,000 budget. As I was watching the programme, it brought back memories of my own wedding day. When I was married in 1960, all of my friends were only able to afford simple weddings with receptions held in church halls or community centres. Tradition states that the father of the bride pay a good proportion of the cost but in those days most parents didn't have vast sums of money to spend on weddings. Clive and I didn't have much money either to spend on a wedding as we were saving like mad and working overtime whenever we could to put down the deposit on a 38 foot mobile home which we moved into after our honeymoon, but similar to the television programme, our family and friends stepped in to make our wedding day a very special day for us to remember. Five months before I was married, and less than one month after our engagement party, my family left London to live in Yorkshire and I went to live with Clive's family in Sidcup, but before I moved in my mother-in-law to be stipulated that it could only be a short engagement!! Clive's mother had always wanted a daughter and she was thrilled when I asked her if she would help us with all the arrangements as my own mother lived too far away to help. In one of the previous jobs that Clive had, he had been given a roll of beautiful white hand-woven lace from Israel and Clive's mum said we would choose a pattern together and she would have it made into a dress for me. She worked at "Tiptop Bakery" and said she would provide all the cakes and savouries for the meal and also have a three-tier wedding cake made for us as a

wedding gift. Clive and I were members of Hatcham Evangelical Church in south east London and the Pastor said that after the ceremony, we could hold the reception in the room at the back of the Church providing we arranged our own catering. On Friday evenings there was a meeting held each week at the Church for young people aged between 15 and 35 and the people that attended the meeting were our closest friends. They all said they were willing to help in any way with decorating the room, helping to prepare the food and serve on tables on the day. The parents of one of my friends owned the local florists and Kathleen said she would arrange for her parents to provide all the flowers at half the price it would have normally cost us and one of the youth leaders at the Church, Cliff Eatwell, was a partner in a local wedding car-hire company and he arranged for a car to collect me from my Auntie's home to take me to the Church as a gift from his family. On the evening before the wedding after the meeting at the Church, our friends got stuck in. The boys set up all the tables and chairs and decorated the room. Some of the girls went into the kitchen and spent the next couple of hours preparing the food for the reception, while others set the tables and put out the cutlery. Last month we turned the Spotlight on two members of the Fear family focussing both on Ray (89 years) an exsoldier and bookmaker who to-date has had a colourful life and his youngest daughter Natasha (17 years) who must decide this year if she is to become a Pro Golfer or focus her attentions towards obtaining a PGA Coaching certificate. Our Jávea Jeard spotlight this month features Angel Villalgordo Muñoz and his wife Paula who like the freedom of cycling and in thirty six years of married life have only been apart twice. Angel Villagordo Muñoz was born on 2nd March 1960 in Pedro Muñoz which is in the community of Castile-La Mancha in the province of Ciudad Real. His father Luis Villalgordo was a lorry driver and his mother, Francisca Villalgordo (nee Muñoz) a housewife who kept everything in order. Angel also has three sisters, Mercedes, Paqui and Ana. built up a restaurant business which is called Restaurante Villalgordo in Pedro Muñoz. Paula has two brothers Ignacio and Felix. At the tender age of 15, Angel went along to his local discotheque called “Las Vegas” and it was here that he met his 16 year old sweetheart Paula. After a few dates Angel and Paula found they had many things in common as they both enjoyed the freedom of cycling and going fishing. Angel was encouraged by his father to take up cycling from the early age of 6 years old and today Angel says his father Luis retains his first adult bike which has now been modified into an exercise bike. After a few years dating both Angel and Paula decided they should get married and so they chose the month of January because it was the start of a new year together. They were about to break the good news to Angel’s family when his sister Mercedes and her fiancé Javier announced their wedding plans which coincided in the same month. The two couples then thought it would be a great idea to have a double wedding ceremony. In fact, this year both couples have celebrated their 36th wedding anniversaries.

A cycle for 2 but a wedding for 4

The double wedding took place at the San Pedro Church, Pedro Muñoz on 10th January 1979, having a double wedding also meant holding a double reception and Angel recalls a funny story where he says that in the 1970s it was customary to have a wedding tray where guests would place money onto the tray. A guest opened his wallet and took out a rather large note and then placed it onto the tray. Angel said he was surprised and thankful that such a guest had placed a big note on the tray

which would have provided both couples with some extra cash to spend on their respective honeymoons. Angel was about to walk over to thank the guest for his kind gesture when suddenly the guest retrieved an amount of change from the tray in exchange for the big note. “Did you still say thank you Angel?” I asked “of course not” came the reply. If you’re like me you are probably wondering how the double wedding works when it comes to the honeymoon, well, Angel and Paula decided to head down south to Jávea from their home town for one week’s honeymoon while Mercedes and Javier headed off east to Madrid. After the honeymoon our couple returned to their home town but Angel and Paula had no place of their own to live and so it was decided that they would take up residency with Paula’s parents and the couple would earn their keep by working in the restaurant. Angel serves his ‘Mili’ in Majorca In March 1979, Angel turned 19 years old and was conscripted into the army for his national service where he was sent to Palma, Majorca (Mallorca). He was stationed in Palma for the entire length of his national service of 15 months. From their very first date Paula and Angel had not been apart and so naturally Paula wanted to be beside her husband during his national service and therefore she found a place to stay which was near to where Angel was stationed. After a few months the political scene started to change causing some unrest amongst the people, Angel became concerned for Paula’s safety as

Continued from previous page during this time the political confidence throughout Spain was rather low and there had been a rumour about a possible coup d'état or Golpe de Estado, a sudden overthrow and illegal seizure of the government. Angel knew that if the rumour was true then this could be a serious problem as if the Golpe de Estado or coup failed it could spark a civil war. Angel had to break the bad news to Paula that he may have to fight and so for her own safety he asked her to go back to their home town and he would come for her when he could. This period was to become the FIRST time the pair had been separated since their very first date. On 17th November 1978 a coup d'état or Golpe de Estado plan was being hatched by Guardia Civil Lieutenant Colonel Antonio Tejero, Major Ricardo Saenz Ynestrillas, and another colonel, whose name has never officially been revealed. The objective by the officers was to form a "National Salvation" government and arrest Adolfo Suárez González, who was the 1st Duke of Suárez, Grandee of Spain and the first elected Prime Minister after the Francisco Franco dictatorship ended with his death in 1975. The hatched plan was called Operación Galaxia because the officers who took part in the planning of the coup met in Cafetería Galaxia in Madrid which is now called the Van Gogh Café. Fortunately the plan was foiled in early 1979, when an Infantry Captain of the Police and an Infantry Commander of the Army were present at the meeting in Madrid who then informed their superiors of the plot. The officers who were planning the coup could not be immediately arrested as evidence was being collected against them. Eventually the officers were arrested later in the year and public calm in the political system was restored. After the threat of the coup passed, Angel was given a weekend pass every fifteen days to leave the camp where he

would make the journey from Palma Majorca to his home town of Pedro Muñoz to visit Paula and his family. For eight months Angel made the 1078km (670 miles) round trip. After completing his national service in April 1980 Angel set about looking for work for his wife and himself but decided he did not want to go back to his wife’s family business as he did not enjoy working in a restaurant environment. He looked for work elsewhere but unfortunately could only find work for them both in other restaurants. In 1985 came the break Angel was looking for he successfully secured two jobs for him and his wife at the Imprenta Botella, Jávea. The inseparable husband and wife packed up their belongings and moved to Jávea which was to become their new home town. The jobs Angel had secured for them was ideal for the couple as they were employed as printers working the same shift rotas. The pair would work the same hours and so they went to work together, had lunch together and at the end of the day, would come home together, at the weekends the couple spent their time shopping, cycling and fishing. I decided to ask Angel and Paula a personal question about the amount of time they spend together, so with this thought in mind, I asked how did they both cope seeing each other for twenty four hours a day, seven days a week and what on earth did they speak about? Did they ever get bored with each other’s company and did they argue? Angel’s answer back to me was “We both share the same interests and passions and our conversations are usually about these things although we do talk a lot about our shop. We know each other very well and so finding conversation is very easy for us I

suppose and in the true sense we are soulmates as well as being the very best of friends.” Although Angel and Paula do not have children they do have Chiqui their friendly pekingese dog to care for. The years 1985 to 2008 were blissful ones as Angel and Paula were both employed and earning the same money which Angel decided he would invest some of his into starting up a new business. Angel has a passion for cycling and so he decided in 2009 that he would join a few friends and open a cycle shop. His plan was not to work at the shop as he and Paula were happy working together as printers. The shop is called Gurugú Bicicletes SL, Gurugú taking its name from the famous battle and mountain in Melilla. The shop until recently was originally situated in Av dels Furs, near the Port. “The shop specialised in selling a wide Continued on page 27

The shop was situated in an ideal location because the two main roads coming down from the town, Av Amanecer de España and Av del Palmela all lead into Av dels Furs and so we were visible to the local cyclists as well as those tourists who wanted to leave their cars at home and discover Jávea by bicycle.” I asked Angel why he had a passion for cycling where he said “I love to get away from everything in my spare time and keep fit. Cycling provides a sense of freedom that allows you to explore the area or to enjoy the landscapes of Jávea. There are many cycling routes around the area some are easy and others may be a bit more demanding but the important thing is that you can always escape the busy routes and find new places of interest or peaceful places to have a sandwich. Cycling can also be a social event where groups of friends can join in or you can cycle solo and still have a lot of fun. It is an excellent form of cheap transport and is environmentally friendly.”

Angel organises cycling trips where anyone is welcome, he can provide cycling routes and guided tours. He is also the founder of The Gurugú Cycling Club which holds regular cycling meetings and other social events. One of his favourite cycling routes is around our local ghost town which I believe is only accessible by cycling or hiking. I was going to write the route in here but not wanting the responsibility of losing our Jávea cyclists I thought it best for me to suggest contacting Angel as he will be able to provide detailed maps of cycling routes in and around Jávea and of course you will have access to his free advice. I understand ghost town was a near completed town until the money ran out and so the developers had to stop the building work. The ghost town is situated towards the Montgo national park offering great views of the Montgo and across the area of Jávea and the Arenal. Although Angel was originally a silent partner in the shop when he invested his money, the unfortunate time came when he and his wife Paula were made redundant from Imprenta Botella and this period became a tough time for Continued on page 29

time, all of us working together, preparing our wedding reception and sharing our excitement with our closest friends. My family, mum, dad, sisters Linda and Carol and brother Derek, had made the journey from Yorkshire the day before the wedding with my Aunty Susie, Uncle John and the rest of their family. It was wonderful to see them all, especially my mum, I was particularly close to her. When I was a child and teenager, as well as being my mum, she was also my best friend. Everything went to plan the next day. The wedding was conducted by our own Pastor Sydney Sims. Dad gave me away and my two sisters were bridesmaids. The wedding took place in the presence of the local Registrar and afterwards we all sat down to our meal. When the reception was over, our friends did all the washing up, and cleared the tables and chairs away. They were happy to have been so involved in our wedding day and nothing was too much trouble for them. After the reception Clive and I went to change into our motorbike gear ready to travel down to Bognor Regis for our honeymoon. My Auntie Violet and Uncle Bill had given us the use of their bungalow for a week as a wedding gift, while they stayed on in London to visit family. Unfortunately when we went to collect the bike, it wouldn't start. We eventually found that Clive's best man had stuffed kippers up the exhaust. We finally cleared the kippers and were soon on our way

People come into the Oasis Centre where I work each morning from 10am to 2pm to buy cards from our extensive range at 1 euro each and they love to stay and chat. People love to talk about their wedding and many have told me similar stories as our own, of family and friends that stepped in to offer their help to keep the cost down. About two and a half years ago, Clive and I attended the wedding of my niece Katy and her husband Les. It really was a beautiful occasion and Katy looked fabulous in her new expensive wedding dress. The reception was held at a wedding hall and the meal was fabulous. Everything was so professional and I enjoyed it very much. After the deal was agreed Angel was back in work but he could only just afford to pay himself and Paula had to find work elsewhere and so this became the SECOND time when their 24/7 together routine became disrupted. The Spanish Tax Authorities have approved a special procedure for tax residents in Spain who have undeclared pensions abroad. No surcharges or interest will be imposed. The Administration will not require any penalty to those tax residents in Spain who voluntarily regularise the pensions that have not been previously declared in Personal Income Taxes (Tax Form 100). The kind of pensions that can be regularised with this extraordinary measure, are detailed as follows: Private Pensions State Pensions Those tax residents in Spain who have received pensions abroad during the period 2010-2013 and have not declared them, could benefit from this change. The period of claim for this amnesty on overseas pensions is from 1 January to 30 June 2015. If the marker hasn't fallen to the floor it means the flat is empty. Straight away the criminals gain access to the property using various techniques and commit the robbery.

Drivers of private cars may use a rotating flashing device in their vehicle to effectively signify an emergency situation, such as an accident or a breakdown, and thus avoiding further accidents in the case of poor visibility. Besides the compulsory kit composed of “1 reflective jacket and 2 warning triangles”, drivers of private vehicles may add a V-2 type light device, which may have one or several "yellow auto" coloured lights (traditional yellow colour for front, rear and indicator lights on Spanish vehicles), which should be visible in all directions from a distance of 100 metres. The V-2 will be installed above the highest direction indicator lights, without affecting the driver's visibility or the vehicle’s structure protection. Do not forget that whether or not you have a V-2 type light device, the proper way to signify an emergency situation is by using the direction indicators along with the warning triangles.

Yes. In Spain you can select the ITV station you wish as long as it is a legal and authorised station. There is an exception to the rule though. If you live in a Spanish region, such as the Valencian Community, which in 2002 passed the "Law of Noise Pollution": A). - "Law7/2002 of 3rd December of the Generalitat Valenciana, of Protection Against Noise Pollution". Subsequently, a decree in 2004 was issued to specify the obligation for all vehicles, whose legal address was in Valencia, to pass the noise emission test. B). - "Decree 19/2004 of 13th February established by the “Consell of the Generalitat” laying down rules for the control of noise from motor vehicles". Article 6: Periodic testing of noise from vehicles. 1. Vehicles with log books legally registered in any municipality within the Valencian Community fall with the scope of this Decree and therefore are required to undergo a verification of noise emission levels. A). "Law 7/2002 of 3rd December, established by the Generalitat Valenciana, Protection Against Noise Pollution". Article 4: Administrative Power 1. The “Generalitat” and local authorities will exercise their administrative power in coordination to ensure the effective implementation of such tests. Article 52: Noise Control 1. The officers monitoring traffic on the road will formulate fines for the infringement of this Act if they determine that, by using noise measuring devices and by the procedure established by regulation, the noise produced by a vehicle exceeds the stipulated limits. 2. If the vehicle’s noise should go beyond the limits established by more than 6dB (A), it will be immobilised and transferred to agencies authorised for such occasions. The owner of the vehicle, having previously submitted the documentation of the car, will be able to take the car by means of a tow truck, cargo or any other method which enables the vehicle to be delivered to a mechanic without starting the ignition of the vehicle. Article 54: Inspections 1. The inspecting authority which underwrites all activities relating to this law are town halls and other regional administration departments who are involved in this field. Article57: Penalties 2. Town halls and the “Generalitat” will be responsible for the execution of penalties stated under this Article. The Civil Guard 'punish' agents fined for not generating enough fines to justify their salary. The UniónGC claims the fines imposed by this new Benemérita Instruction Traffic "abusive, unfair and discriminatory". The union of the Guardia Civil, UniónGC, has made official a statement in which it denounced "the Directorate General of the police force" for issuing a new instruction to Traffic officers, "it is not only unfair, unjust and discriminatory

but also camouflages the payment of the civil guards productivity by sanctioning capacity." According to UniónGC, the Council of the Guardia Civil intended this new instruction "with malice aforethought productivity serguridad Vial", which according to them becomes a way of pressuring the Traffic Group of the Guardia Civil as a "priority to sanction any other action in the course of a service road". An agent of the Traffic Civil Guard told EFE (the Spanish news agency): The union says the implementation of this new instruction to traffic officers, "the policemen who do not achieve the score required by their superiors will be warned twice and the third occasion will have them removed as traffic officers with a fine of 143€ a month." This monthly evaluation, according to the union "is scored heavily with sanctions and further still the amount of fines". It is unclear how anyone excluded from ‘traffic duty’ can cancel the monthly punishment. "This way of rewarding and punishing overlooks the prevention of crime and giving help aspects of the job. Some GC officers "concentrate on control of drugs and alcohol and others use and monitor persistent speeders on traffic duty with mobile radar equipment". The Instruction, which has been approved against the advice of all the professional associations of the Civil Guard, is considered by the UniónGC "new" regulating the activity of civil traffic wardens as barbaric, so they are considering legal action against this "imposition", which they say, "not only generates discrimination but also could be abusive and clearly prejudices not only to the civil guards but also the public at large."

AGAINST SPAIN E U COURT RULES AGAINST SPAIN ON INHERITANCE AND DONATION TAX

In Spain, the “Inheritance and gift tax” is a state tax applicable throughout the national territory (except in the Basque Country and Navarra who have their own completely different tax system), but is transferred to the several autonomous communities, (i.e, Murcia region, Valencian Community, etc), which can approve their own rules in order to supplement or replace the basic rules laid down by the central Government. This chaotic situation of delegated regional legislation, has in practice led to very high differences in treatment between expats and non-residents depending on the specific location of the property or assets. In simple words, the former Spanish law was totally DISCRIMINATORY because it established unjustified differences in treatment between residents and non-residents in the 17 different autonomous communities of Spain. Fortunately, the good news is that this situation has changed as the European Court of Justice (ECJ), has determined in a recent landmark ruling (C127/12), that the Spanish Succession and Donation tax failed to comply with the European rules, by not permitting non-residents to benefit from the tax advantages and deductions offered by regional administrations to resident and Spanish citizens. Moreover, the ECJ ruling declared that the design of the Spanish tribute was a blatant restriction on the free movement of capital within the EU territory, which is a fundamental principle of the European Union market, infringing the Treaty of Operation of the European Union. According to the EU Commission, discrimination occurs when the deceased or donor, the heir or donee are not resident in Spanish territory and particularly in the case of donations, where the property being transferred is located abroad, regardless of the place of residence of the taxpayer. The EU Court stated it was contrary to the free movement of capital, because it discouraged non-residents from making or holding investments in any EU country.

To be accepted, any possible difference in treatment should be justified by overriding reasons of general public interest. In the Spanish case, the ECJ considered that there was no difference whatsoever between the “objective” situation of a resident and a non-resident that may justify a different tax treatment. In other words, any difference in treatment concerning tax reductions simply leads to discrimination and as a result it must be forbidden. As a consequence, the ECJ decision has forced Spain to implement a new state regulation, which has taken place last November the 27th 2014, by means of the “26/2014 Act”. In a nutshell, the new Spanish regulation establishes at present the following different categories, applicable for both the inheritance and donation tax:

1) If EITHER the deceased or alternatively the legal beneficiary might be nonresidents IN SPAIN, BUT RESIDENTS IN ANY OTHER EU COUNTRY (England, Germany, etc), the appointed legal heir will benefit from the reductions applicable in the region where the dwelling or assets are located (i.e Valencia Comunidad).

2) However, reductions will NOT be applicable if the legal beneficiary might be a resident in a NON EU country. For example, let’s suppose the case of a Spaniard living in

Argentina inheriting a dwelling located in Alicante. In this particular scenario, the legal beneficiary will be obliged to pay the inheritance tax in Madrid, without being able to benefit from any reductions whatsoever applicable in the Valencian Community. In our view, the new legislative reform is still defective and discriminatory because it infringes the free movement of capital BEYOND the EU territory. Likewise, it implies a perfect argument for those non resident people who might have paid excessive taxes on inheritance or donations in the past, to bring legal action against the Government aimed to claim back the refund of those taxes paid in excess.

RAFFLING YOUR SPANISH HOME IS PROBLEMATIC

We’ve been receiving several enquiries from clients asking us for information about this interesting topic. The concept sounds alluring. Rather than selling your Spanish house in a standstill property market,- (and getting thousands of Euros less than you hoped for),- why not just raffle it, flogging tickets for around 5 to 35 €uros (or more), to thousands of people anxious to fulfil their dreams of acquiring a good property in the sun? Many examples can be given (like for instance the Spaniard who tried to raffle his property by printing 64,000 tickets for 5€uros each, etc). However, what in theory might look like an attractive and profitable option both for buyers and seller, has unfortunately ended in failure in the majority of cases. The problem lies in the fact that in Spain there is a pretty complex legal and tax regulation, which requires the seller to follow a very bureaucratic process. In a nutshell, first of all, the specific detailed rules of the raffle must be submitted for approval to the “Organismo Nacional de Loterías y Apuestas del Estado-ONLAE”. The ONLAE, with two centuries of history, has secured its position as the most reliable games and lottery operator in Spain.

Secondly, irrespective of the outcome of the raffle, a non refundable expensive bond or deposit must be paid by the seller upfront, which is usually the 10% or 15% calculated on the total value of the tickets to be issued. In addition, it will be necessary to pay the stamp duty tax (18% based on the value of the dwelling), before the ticket prize is given at the Notary, not to mention that a large capital gains tax might also be encountered. Further, due to the fact that the Spanish Notary must supervise the legality of the whole raffle process in order to avoid scams, it will be necessary to pay Notary and land registry fees as well. Therefore, it will be crucial to determine who is going to pay for all these expensive costs, in order to avoid late unpleasant tax surprises for the “lucky winner”. Therefore, Licensees should advise any participant in such a raffle to consult a Solicitor and tax advisor concerning the tax consequences to the winner. Moreover, there is another danger for ticket-buyers: most of the competitions stipulate that the house won't be sold unless all the tickets have been snapped up. Subsequently, considering that most of the tickets sell for between 20-30
