ONE TIMES SQUARE, the former home of The New York Times, has been butchered over the years with billboards and electronic signs. One would think the home of the New Year’s Eve ball drop would have been given more importance. But in truth, it was basically reduced to serving as a 25-story advertisement after the Times moved out, with little respect for its 118-year history. The building became a focal point for New Yorkers, not just for the ball drop, but also because of its news ticker, which is no longer in use. Known as “The Zipper,” the ticker shot out headlines that stopped passersby in their tracks. This old school tech, however, went dark years ago, and the building has long looked weathered and neglected. Finally, though, there’s a plan that will not just spruce up the building, but give it renewed purpose. Jamestown, a real estate management company that has owned the building since the 1990s, is spending $500 million to redevelop the property. Under the plan, the public will have access to the building, where a museum and visitors center will be added, along with a viewing deck. The latter is a big plus for tourists to the area, since previously one could only gaze out over Times Square from a pricey hotel room or office. The plan was touted by New York City Mayor Eric Adams, who noted that it shows New York is coming back from the coronavirus pandemic. It also gives this iconic building the recognition and new life it deserves. Now that’s breaking news.

Immediately, Democratic lawmakers and other officials called the Buffalo shooting a racist act of domestic terrosism that targeted Black New Yorkers. Gov. Kathy Hochul called out social media platforms in the immediate aftermath of the shooting for allowing the video of that attack to be streamed online and for permitting the proliferation of white supremacy online. President Joe Biden visited Buffalo soon after the shooting as well, where he similarly spoke out against white supremacist extremism as calls for stricter federal gun laws were rekindled. Hochul announced several bills and executive orders meant to combat both online extremism and to tighten the state’s already strict gun control laws. She required through executive order the state police to file for extreme risk protection orders under the state’s Red Flag Law in instances where it could be needed after the law enforcement failed to invoke the law with the Buffalo shooter last year. Hochul also set up a new unit focused on domestic terrorism within the state Division of Homeland Security and Emergency Services in order to track the spread of white supremacist ideologies online.

ADAMS GOES TO ALBANY

New York City Mayor Eric Adams made a rare appearance in Albany to push for his priorities as state lawmakers wrap up for the year. Some unfortunate timing meant that he missed both legislative leaders and the governor when he visited – all three were in Buffalo for the president’s visit – but it didn’t damper his enthusiasm or confidence. Adams focused on a handful of issues that topped his agenda – an extension of mayoral control of schools, home rule on speed cameras and renewing or replacing the 421-a tax break for developers to build affordable housing. Things seemed to be looking good for Adams when it came to a mayoral control extension as a key lawmaker in those debates said the mayor will likely get what he wants, albeit with some tweaks. And soon after his visit, Adams and state lawmakers said they reached a deal

After it once again unanimously passed the state Senate, a spokesperson for Assembly Speaker Carl Heastie indicated that the lower chamber had the votes to pass the Adult Survivors Act. The bill would create a lookback window for people who had been victims of sexual abuse as adults to bring civil suits against their alleged abusers. Despite its broad bipartisan support, it stalled in the Assembly last year. But now that it appears poised to pass the state Legislature as a whole, Hochul said she would sign the bill once it hits her desk.

Injuries at Amazon warehouses and logistics facilities in New York climbed 64% in 2021 over the previous year as the company continues to expand its footprint in the state, a new analysis by the National Employment Law Project found. In 2020, Amazon facilities in New York saw an injury rate of 5.5 injuries per 100 fulltime equivalent (FTE) workers, and that rate rose to 9.0 injuries per 100 FTEs in 2021. The increase follows a national trend – Amazon’s injury rates across the country rose 20% in 2021, but the increase was even steeper in New York. The project’s analysis, which relies on data that Amazon reports to the Occupational Safety and Health Administration, found that the rate of injuries at Amazon’s New York facilities in 2021 was higher than Amazon’s overall injury rate in the United States that year. Overall across the country, Amazon’s injury rate is higher than non-Amazon warehouses, according to another analysis of OSHA data by a coalition of labor unions called the Strategic Organizing Center. The vast majority of injuries – recorded nationwide and in New York specifically – were identified as “serious injuries,” meaning they kept employees from continuing their normal job

duties or caused them to miss work. “The vast majority of these injuries are musculoskeletal injuries, repetitive strain injuries from lifting repeatedly at an excessively rapid pace over a long period of time,” said Irene Tung, the author of the National Employment Law Project’s report. “Those are serious and often disabling injuries that can stay with workers for their entire lives.” Amazon did not comment on why injury rates at its New York facilities might be higher than in other parts of the country. “Like other companies in the industry, we saw an increase in recordable injuries during this time from 2020 to 2021 as we trained so many new people,” spokesperson Kelly Nantel said in an emailed statement. Tung has a guess about why data showed a dip in 2020 and then an increase in 2021. In 2020, Amazon said it was suspending enforcement of its productivity quotas during the COVID-19 pandemic, but reinstated them by that October. “When Amazon suspended its signature quota-based disciplinary system in 2020, worker injuries declined,” Tung told City & State. “When it began aggressively disciplining … based on those quotas, worker injuries skyrocketed again.” – Annie McDonough

By Justin Sondel Several people have described the Jefferson Avenue Tops as a safe place in the neighborhood that offered a sense of community. What do you feel it will mean for the neighborhood and the rest of the East Side going forward that this space has been taken from them, at least temporarily, and will certainly never be the same? It’s a community gathering spot. Some people go there every day, not because they want to buy something, but because they know they’re going to see somebody that they know and they get to chitchat. It’s a community gathering spot that’s needed for dialogue to go back and forth in the community. Everybody doesn’t go to the barbershop. Everybody doesn’t go to the hair salon. This store actually served as a similar respite, like hair salons and barbershops, where you could go and catch up on all the latest information in the community and around the state, with the federal, national government. People talk about these issues. I just think that it’s going to take some time. We do know it’s still a crime scene. But at some point, it’s my priority that Tops pulls us back together and they continue to do business there. Now, does that mean that there should not be an additional opportunity for fresh fruit and vegetables in and around this neighborhood? No, it doesn’t

mean that. It means that maybe there should be something else as well. I won’t discard that as an opportunity for additional growth in this community because it is needed. But that Tops is needed as well. Do you think people will want to return to shop at that location? I’ve talked to some people who have said they will never go in there again. Then I’ve talked to a lot of people like myself, who will be the first one to walk in there on the first day, because you are not going to frighten me out of my community with your ignorant, racist actions. I’m angry about that. I’m disappointed in how America allows racism to continue. But you are not going to scare me away from my community. generational neighborhoods. It’s not just about segregation. Granted, this country actually developed its housing strategy on a racist proposition. It just did. It started out that way. But people could leave. They don’t have to stay. They chose to stay. Many researchers and academics over the years have documented the deep segregation that exists in Buffalo and the discriminatory practices – redlining, unequal access to education, employment discrimination, unequal access to quality food – that are exacerbated by those conditions. Is it particularly painful that the systemic discrimination that has led to more hurdles and fewer opportunities for people of color in Buffalo made the city a target for this attack? No. It’s just painful that he would go after Black people, period. The fact that he came to my town makes it even more painful. But I would be hurting if he went to Rochester or Syracuse or if he stayed in Binghamton and did the same thing. I can’t buy into the narrative that this place was chosen just because of segregation. No, it wasn’t chosen because of segregation. It was chosen

because there are more Black people here who chose to be here. I wouldn’t disagree that there are some people who would want to move somewhere else but can’t afford to. But I would offer to you that most people who live in the 14208 (Editor’s note: The ZIP code where Tops is located.) live here because they want to be here. It’s not like this is all because of segregation. This is all because of racism. Does this attack highlight the need to address some of the underlying issues at the root of Buffalo’s segregation? What can be done from a legislative perspective to address those issues? Those are problems. But they’re problems in 14215 (Editor’s note: The ZIP code for an area of Buffalo northeast of the shooting location.) too. They’re problems in Binghamton. And those are the same problems they have in Syracuse and the same ones they have in Rochester. It’s racism that’s the problem. It’s racist policies that the government sets up. Protect New York’s Warehouse Workers Now!

arehouse workers are the backbone of the modern ecommerce economy, yet regulations protecting workers and communities affected by this new industry have lagged far behind its rapid growth. When New York’s warehouse and distribution center workers leave for work every day, they face a job that sees them three times more likely than the average private industry worker to suffer an injury or illness. That’s why New York needs to pass the Warehouse Worker Protection Act (WWPA – A10020/S8922), which helps protect workers from inhumane quotas at companies such as Amazon.

A Dangerous Job New York’s warehouse industry has alarmingly high injury rates, and nowhere is this more apparent than when reviewing the data at Amazon, which has opened over 70 new facilities in New York State since 2018. Amazon workers are injured at a rate of six per 100, which is five times the average in New York. While all warehouse work is dangerous, Amazon

warehouse workers are 54 percent more likely than others in the industry to get sick or hurt on the job. Research shows that many of these injuries and illnesses are preventable and are the result of management philosophies at these facilities that prioritize speed over workers’ safety. Unsafe work speeds, unreasonable work quotas, dangerous work, and insufficient breaks all contribute to the skyrocketing rate of injuries in the industry. Amazon workers have told RWDSU representatives that their productivity is monitored so closely that they are afraid to take bathroom breaks. While Amazon is the highest-profile offender, workers throughout the industry suffer from higher-than-average injury rates, and many of the same dangerous policies and lack of protection.

Addressing the Warehouse Industry Injury Epidemic The WWPA, modeled after similar legislation signed into law in California last year and targeting large facilities and employers, would

important issue that America needs to confront before it implodes on itself, and that’s racism. That’s pure and simple racism. You cannot keep judging people because they are different than you. You cannot keep having policies that are set up that people get treated different because people are different than you. Where do we go from here? Every time we have these incidents in America everybody says we need to have more communication. We need to start talking about this. A couple months later, no one is talking about it anymore. Because people are uncomfortable in acknowledging that they’re actually racist too. And I’ve said this to some of my white colleagues, “Listen, I don’t like you. But I do have to love you. So I’m not going to treat you like you treat me.” But if other people don’t get to that, then we’re not going to solve this. I don’t care how long we talk about it. I don’t care how many laws we pass. I don’t care who we elect. If we don’t get to that, that you must treat me the way I treat you – it’s the golden rule. If you can’t get to that, then this society is going to implode on itself.

create important guardrails to protect warehouse industry workers from the brutal line speeds and quotas that are driving injuries and sickness at New York’s warehouses. These inhumane and abusive quotas, and the fear of being disciplined for not making them (even though workers aren’t told and don’t know exactly what they are), pressures workers into denying their basic needs and over-exerting themselves to the point of injury or illness. The WWPA creates transparency for the often arbitrary and ever-changing quotas that many workers at large warehouses are subjected to. The law would inform workers on what their quotas are, and prevents workers from being disciplined if they fail to meet these quota requirements because they need to exercise basic human rights such as going to the bathroom when they need to. New York’s warehouse workers are getting injured because there is no reason for unscrupulous employers to respect their basic humanity. The WWPA would change that, and these workers deserve passage of this important legislation that forces large employers like Amazon to reform the way it treats employees.

Is there anything wrong with New York’s Red Flag Law?

HE BUFFALO SHOOTING suspect who reportedly threatened a murder-suicide less than a year before he shot 13 people, killing 10, at a Tops supermarket on May 14 may have been prohibited from acquiring the firearm he used in the massacre if law enforcement had pursued the available protections under the state’s Red Flag Law. The law, which passed in 2019, said law enforcement, family members or school employees can file for an “extreme risk protection order” that would require a state Supreme Court judge to decide if there is probable cause that the person would be likely to seriously harm themself or another individual. Questions were raised about why the law wasn’t executed in the wake of the Buffalo shooting after officials revealed that 18-year-old Payton Gendron had made a “generalized threat” of violence in June 2021 while attending Susquehanna Valley High School in his hometown of Conk-

lin. According to The New York Times, citing a law enforcement source, Gendron responded to a school project about his post-graduation plans by stating he wanted to commit a murder-suicide. New York State Police confirmed they responded to the school on June 8 to investigate a “generalized threat” made by a 17-year-old student, who was then taken into custody and transported to the hospital for a mental health evaluation. The agency, which would not say whether Gendron was the student, citing privacy reasons, said in an email to City & State that it did not apply for an extreme risk protection order against the student and noted the threat was general in nature and did not target the school or anyone in particular. Months later, sometime earlier this year, Gendron purchased what was described by Gov. Kathy Hochul as an “AR-15-style” rifle from Vintage Firearms in Endicott. The store owner, Robert Donald, told NPR that Gendron’s background check showed nothing that would have prevented him

Assembly Member Jo Anne Simon, who sponsored the Red Flag legislation, expressed disappointment that law enforcement did not pursue a protection order after the incident with his school a year ago, noting the law was set up so that a judge could make the final determination if there was probable cause to believe a person would likely engage in violence. “He was brought in last year. There was a complaint he had threatened violence last year when he was in high school, so law enforcement should have applied for an extreme (risk) protection order because he clearly demonstrated an intent to commit violence to himself or others,” Simon told City & State, adding that she is considering calling for a public education campaign to heighten the public’s awareness of the law in the wake of the shooting. “I can’t tell you how many people I’ve seen on Twitter saying, ‘It’s not working.’ It’s not working unless people know how to use it.” Under an extreme risk protection

order, a person would be flagged in the FBI database used by gun sellers, prohibiting them from buying a firearm. Law enforcement, such as a sheriff’s office, must confiscate any firearms the person possesses, along with their firearm license. Within three to six days of the initial “temporary order” being issued, a hearing must be held to determine if a final extreme risk protection order should be granted. While the order stays in effect for one year, law enforcement must hold any surrendered firearms for three years after the order goes into effect. State Sen. Brian Kavanagh, who sponsored the bill in his chamber, said a thorough investigation should be conducted to determine “what specifically the evidence was last June and whether there was a conscious decision about whether a Red Flag order was appropriate,” he told City & State. Regardless of the results of the investigation, he added: “This is an important moment to remember that we’ve got a law in the books that is a very effective way to

determine when someone is identified as being a danger to themselves or to others.” Since the law was enacted on Aug. 25, 2019, New York courts have granted 875 temporary orders of protection and 589 extreme risk protection orders under the legislation – and the number of orders issued by each county varies widely, according to data from the Office of Court Administration. No orders have been granted in Manhattan, and just two temporary protection orders have been granted in Brooklyn. Suffolk County has the largest number of extreme risk protection order approvals by far, with 116. Sgt. Paul Spinella, a spokesperson for the Suffolk County Sheriff’s Office, which is responsible for executing the orders, told City & State that all but two of the petitions for protection orders were filed by law enforcement. “Most of them probably come from someone calling 911. And then based on that, the law enforcement agency files for the petition for the (extreme risk protection order),” Spinella said.

New York needs a boost The state lags behind West Virginia and 25 other states in getting residents a third COVID-19 shot.

IX MONTHS AFTER COVID-19 booster shots became available to all eligible New Yorkers who wanted one, uptake of the extra dose is still lagging in New York City – as it is in the rest of the state. Like many other challenges in the nation’s response to the pandemic, some experts think part of the reason for the large gap between the proportion of vaccinated people and boosted people in New York could be due to poor messaging. “It starts very fundamentally with the term ‘booster dose,’” said Dr. Jay Varma, an epidemiologist and senior adviser for public health to then-New York City Mayor Bill de Blasio. “Anytime we study a vaccine, it can take many years, sometimes even decades, to figure out what is the right number of doses and spacing of doses to get long-term protection against the (virus). I think what public health officials should have done is basically said that based on all the evidence we have, we have now decided that this is no longer a two-dose vaccine, it is a three-dose vaccine.” While the booster rate nationwide is also a fraction of the vaccination rate – roughly 102 million people have a first booster dose, compared to 221 million who are fully vaccinated – the gap is particularly wide in

New York, which has one of the highest vaccination rates in the country. In New York state, roughly 77% of the population has been fully vaccinated, compared to just 39% who have received a booster shot. In New York City, roughly 78% of the population is fully vaccinated, compared to only 38% who have received an additional dose. There are also geographic and racial disparities in booster rates, with a larger share of Manhattan residents getting the extra shot, and higher rates of white, Asian and Pacific Islander, and Native American residents in New York City getting extra doses, compared to Black and Latino residents. The booster is currently only available to fully vaccinated people ages 5 or older, while a second booster dose is available to those over 50 years old, as well as those 12 and older who are immunocompromised. In New York state, roughly 87% of adults (ages 18 and older) are fully vaccinated, and 46% of adults have received a booster dose. That places New York roughly in the middle of all 50 states, and just below West Virginia, in the proportion of vaccinated people who have also been boosted. As New York experiences a rise in COVID-19 cases, some public health experts and elected officials said the city should redouble its efforts to increase boost-

er uptake. “I think we have consistent data that tell us that over time protection does wane,” said Dr. Wafaa El-Sadr, a professor at the Columbia University Mailman School of Public Health, on the level of protection against infection and severe illness offered by COVID-19 vaccines. “I think that’s what makes it so important that we continue to push hard for people who are eligible for a booster to get a booster dose.” The de Blasio administration credited vaccine mandates and the Key to NYC vaccine requirement to enter restaurants and other indoor venues with increasing New York City’s vaccination rate last year. Adams suspended the Key to NYC program in March. As cases rise and New York City now enters the “high” COVID-19 alert level, the city is urging, but not requiring, the wearing of masks indoors. Varma suggested one way to increase uptake of boosters in New York City is to reimplement the Key to NYC program with an added booster mandate. But given the Adams’ administration’s move to roll back that program, a move to beef it up now might not be likely. “That is a politically challenging position for the mayor and the governor right now,” Varma said. “It’s not something you can see that a lot of jurisdictions are moving towards. In fact, pretty

much every jurisdiction around the country is moving away from mandates like that.” When vaccines became widely available last year, New York City rolled out not just mandates but cash incentives to get vaccinated, as well as targeted outreach to hardhit neighborhoods to ensure equitable access and adoption of vaccines. According to the city’s vaccine finder tool, the city is still running pop-up vaccination sites. When asked what the city is currently doing to boost booster rates, a spokesperson for the Department of Health and Mental Hygiene said the city has been clear in its messaging about the importance of vaccines and boosters. “There probably isn’t a single New Yorker who hasn’t heard us say, ‘get vaccinated.’ That message is true of first doses, second doses and boosters. But let’s say it again, please, get vaccinated,” spokesperson Patrick Gallahue wrote in an email. “NYC has run public service announcements across all forms of media and held thousands of educational events that provided information about boosters as well as the vaccines. We aim to continue communicating to New Yorkers the importance of getting vaccinated and boosting your protection when the time comes.” But some said that the city’s messaging

hasn’t been strong enough over the past couple months. “I would like to see stronger messaging from the city to remind people that this is still a time for caution and to restart boosters, which have essentially ground to a halt,” Manhattan Borough President Mark Levine told City & State last month. “I’d like to see the city launch a major campaign to promote boosters, to incentivize boosters. For example, bringing back the $100 incentive and reaching out to people directly who got their primary vaccine series, but never got their booster.” At an April 1 press conference, New York City Health Commissioner Dr. Ashwin Vasan was asked about bringing back a cash incentive for booster shots. “I think we’ve seen incentives have a limited and strong but narrow effect,” Vasan said. “I think now we’re encouraging New Yorkers to make that choice. Go get boosted as soon as you’re eligible.” In recent weeks, federal health officials have pointed to the importance of boosters. “It’s really important that we try to get the half – or a little bit more than a half – of Americans who have only received two doses to get that third dose,” Dr. Peter Marks, director of the Center for Biologics Evaluation and Research at the Food and Drug Administration, said. “That may

make a difference moving forward here, and it may particularly make a difference now that we’re coming into yet another wave of COVID-19.” Though health experts don’t have a single consensus about why so many people who are vaccinated have not taken that extra step of getting a booster, some ventured guesses about why that gap persists. A lack of booster mandates is one possible explanation, as is still widespread misinformation about vaccines, said Denis Nash, a professor of epidemiology at the City University of New York. “When you look across all of their information sources, most people are being exposed to some kind of misinformation or disinformation about vaccines and boosters. And I think that plays an important role,” he said. El-Sadr estimated that barriers to higher uptake of boosters likely exist both on the supply and demand sides. A lack of individual awareness about the importance of boosters – not just for immunocompromised and older people, but for everyone – might be contributing to a lack of demand. On the supply side, while doses remain widely available at pharmacies and other health centers, vaccination sites are not as ubiquitous as they were last year, when jabs were offered at pop-up sites in the subways or in large cultural institutions like the American Museum of Natural History. Anna Bershteyn, an assistant professor of population health at NYU Grossman School of Medicine, said the most important thing is still to reach the unvaccinated. New York City data shows that the unvaccinated still see far higher rates of cases, hospitalizations and deaths. Bershteyn noted that according to the city’s data, case rates are actually slightly higher among people who are vaccinated and boosted, as opposed to those who are just vaccinated with no booster. Hospitalizations and deaths are roughly even among the boosted and the vaccinated but not boosted. Health experts warned not to overinterpret the city’s data, however, as it doesn’t include at-home tests and that higher case rates among boosted people might reflect that people who are boosted are at higher risk of exposure, such as health care workers.

HEN BROOKLYN resident Octavius Moore tested positive for COVID-19, confirmed by two at-home tests, his co-workers gave him advice about how to treat his symptoms. “A team member who also tested positive after coming back from Caucus Weekend told me about the antiviral treatment and that I should try to reach out and get a prescription for it. So I decided to do that,” said Moore, who said he called a number through New York City Health + Hospitals to get the pills. “I called the 800 number, which was horrific. It took me three times calling the number to actually get it,” he said. It was so hard for Moore to stay awake on his three 30-minute calls to Health + Hospitals that when he finally did connect with an operator, they had to scream into the phone to wake him up from his virus-related fatigue. In response, Dr. Ted Long, senior vice president of ambulatory care and population health at New York City Health + Hospitals, said: “Our experience has been that the wait time has been pretty good, but we always welcome more feedback.” Moore’s experience – waiting a long time to get in touch with the hospital system to get a prescription and having a friend pick up the prescription because he was too sick to get it himself – has not been unique. Several other people in New York City have reported the same issue and the inability of Alto, the city’s preferred delivery service, to get them medication in a timely fashion. With COVID-19, treatment needs to start within five to seven days, depending on the drug, of testing positive. If antivirals are taken too late, a person’s symptoms can continue to worsen, even for those who are vaccinated. Antiviral treatments, which range from pills like Pfizer’s Paxlovid to an intravenous infusion of antibodies, were initially available at the end of January to seniors in the city as well as to immunocompromised residents who tested positive. Though as of late March, treatments were available to anyone who tested positive, either through PCR testing or at-home testing, and wanted to ensure their symptoms would not worsen after a positive test. Health + Hospitals has doled out over

3,500 prescriptions for Paxlovid, with 90% of those prescriptions being completed through their phone system, according to spokespeople Patrick Gallahue and Adam Shrier. The system has also delivered 22,000 courses of Paxlovid, with around 75% of those being placed through Alto. Moore heard about these treatments from someone who contracted the virus at his workplace and was able to get a prescription for the antiviral medication to quell his symptoms. While the treatments have been widely available for a couple months, public health experts said that antivirals haven’t been widely publicized outside of social media and through word of mouth. Miesha Marzell, a public health professor at Binghamton University, said high-profile politicians who tested positive for COVID-19 and immediately received the best treatments might be hesitant to

nouncements similar to those that became popular with former Health Commissioner Dr. Dave Chokshi on social media, and the city Department of Health and Mental Hygiene has been working with local media to get word out about these treatments in multiple languages. Plus, the city has begun a Test to Treat program, which allows certain pharmacies to test patients for COVID-19 and, if they test positive, can prescribe Paxlovid on the spot. However, transmission rates are trending upward due to the spread of various omicron subvariants. The hospitalizations and deaths that result from this new surge, which has pushed the city back to “high” levels of transmission, could be mitigated with the widespread availability of antiviral treatments. According to the U.S. Department of Health and Human Services, New York

City has more than 500 pharmacies where residents can get Paxlovid. Some public health experts, while happy to hear about the availability of these treatments, felt like their availability in pharmacies might not be known by residents looking for a prescription after testing positive at home. “Oftentimes folks who are older might not have access to the same information you have on social media. I do think that the city does need to do more, maybe more targeted outreach to community members who are in these different groups who would benefit the most from it,” said Dr. Oni Blackstock, founder and executive director of Health Justice, a consulting group focused on anti-racism and equity in health care. Blackstock said these advertising campaigns would need to be more focused on the audience that could benefit the most

Complaints about messaging and communication regarding these treatments are to be expected from residents like Moore who had firsthand experience dealing with the city’s bureaucracy. He and experts like Marzell both felt that delivery and overthe-counter options should be better implemented to make sure New Yorkers can treat their symptoms in a timely, safe manner. Marzell said: “So it’s just like we have the tools in the state of New York. We have the tools in the country. We have the tools in the world, but who do the tools get to? Who do these efforts get to?”

HE 2020 RACIAL justice demonstrations in New York City became a stage for the brutal police tactics that drove protesters to the streets following the murder of George Floyd on May 25 of that year. Dozens of videos of New York City Police Department officers shoving, beating and pepper-spraying protesters emerged, sparking even more outcry. Former New York City Mayor Bill de Blasio was widely criticized for his response – or lack thereof – to NYPD aggression against protesters, leading members of his own staff to publicly denounce his approach to criminal justice and policing. What began as an emotional response to police brutality evolved into a movement to “defund the police.” Beyond calls for cuts to the massive NYPD budget, demands from protesters in 2020 were far-reaching, including everything from emptying Rikers to enhancing officer accountability. On a state level, the Legislature responded to protesters’ demands by passing a package of reforms aimed at lifting the “Blue Wall of Silence,” a term that refers to police departments’ attempts to hide officer misconduct, by limiting the use of chokeholds by police and requiring officers to record demographics when making low-level arrests. The City Council also passed a package of reforms that summer on officer accountability and to tamp down excessive force, along with cataloging surveillance technology. But as the Black Lives Matter protests swept the city and the country, so did a pandemic-induced counterforce to the progressive police reform movement. The unraveling of societal norms contributed to a national increase in shootings and homicides. Domestic violence incidents spiked as victims were stuck at home with their abusers. The uncertainty drove record increases in gun sales across the U.S. School closures, along with household disruptions, were widely believed to have contributed to an increase in killings and violence among youth. Distrust in police reached an all-time high. In the two years since Floyd’s murder by a white police officer in Minneapolis, Minnesota – and the popular movement sparked by his death – these factors have contributed to a marked shift away from policies and rhetoric meant to radically change the role of policing in New York. New York City Mayor Eric Adams,

a former police officer, has reinstated the controversial NYPD anti-crime unit and proposed an NYPD operating budget that maintains the increases under de Blasio, exceeding the budget put in place before the protests. Adams participated in the 2020 protests as Brooklyn borough president. During the mayoral primary, he touted his work as a reformer of the NYPD who called out racism from the inside. He helped paint “Black Lives Matter” in front of Trump Tower in July of that year. But the city’s second Black mayor now finds himself on the opposite side of the police reform debate. While he once stood in solidarity with Black Lives Matter demonstrators, local leaders of the protest movement have reacted to many of his new policing policies with vitriol. Brooklyn Movement Center Executive Director Anthonine Pierre recently penned an op-ed in the Daily News in which she accused Adams of “caving to the demands of the police instead of meeting the needs of Black communities.”

Adams, in turn, has used the movement’s own rhetoric to contest the criticism and what he views as the movement’s lack of action against gun violence. “If Black lives matter, then the thousands of people I saw on the street when Floyd was murdered should be on the streets right now stating that the lives of these Black children that are dying every night matter,” Adams said in April on NY1, speaking about the Brooklyn subway shooting in April. “We can’t be hypocrites.” In this new political climate, Adams has also promised policies to target underlying causes of crime and community-police relations – such as new investments in the city’s mental health crisis teams and youth programs – advocates say they’re overshadowed by a return to what they view as problematic policing tactics. “All Adams has done is create more of a narrative of ‘The way we combat violence is by more policing,’” Jessica Sanclemente-Gomez, board chair of the police reform organization the Justice Commit-

That clearly showed no real dent in creating a better system and better flow of accountability.” Adams, when asked by City & State where he thinks the city stands in implementing the reforms he and others called for in the wake of the 2020 protests, said he remains committed not only to holding bad cops accountable, but also to supporting police. “You had (calls to) ‘defund the police.’ I didn’t call for those. ... I support police accountability. I also support police support. We need to be there for law enforcement officers,” he said during a Q&A with reporters on May 18. “The small number that are not suitable to be police officers, they need to expeditiously be removed from our department because they hurt our police department.” “There are some specific reforms I called for ... there may be reforms that I don’t think are reforms. I think they could hurt public safety. And I’m never going to do anything that’s going to hurt public safety.” Reforms enacted at the state and city levels have resulted in some changes to holding police accountable for incidents of violence and racial bias, but they have also faced fierce legal challenges and stonewalling from police departments and their unions. Here’s where some of the most prominent police reforms that came out of the 2020 protests stand today.

DEFUND THE POLICE WHAT WAS PROMISED: Amid calls from protesters, de Blasio agreed to cut the NYPD budget by $1 billion. The City Council approved the budget in August 2020, and council leaders and activists accused the mayor of using some budget trickery to create a perception that funding had been cut more significantly than it was. WHERE WE ARE NOW: De Blasio ultimately fell short of the demands, and the police budget has since been restored to an amount that’s even higher than it was before the 2020 protests. The fiscal year 2021 budget, which was approved in July 2020 amid the summer protests, included $4.9 billion in city-funded NYPD operating expenses, what was projected to be a $345 million reduction from the prior year, according to an August 2020 analysis by the Citizens Budget Commission. A large portion of the proposed reduction came from “unrealistic cuts to overtime,” according to the fiscal reform nonprofit, along with a hiring freeze. “These savings are unrealistic; they were not accompanied by a plan or operational strategy, and prior efforts to reduce overtime at the uniformed agencies have been more successful in slowing growth rather than decreasing expenses.” In reality, the city spent $317 million less on the NYPD’s city-funded operating budget in fiscal year 2021 compared to fiscal year 2020 the Citizens Budget Commission reported during the fiscal year 2022 budget negotiations. Overtime expenses exceeded the projected cuts by $216 million. The fiscal year 2022 NYPD budget raised the NYPD’s

operating expenses by $465 million to a level even higher than its preprotest budget. In addition to promises to cut overtime spending, de Blasio also pledged to shift funding for school safety agents and crossing guards to the city Department of Education, but that never happened. Adams’ first proposed budget also keeps school safety agents under the NYPD. Adams’ NYPD spending plan, pending approval from the City Council, raised cityfunded operating expenses by $539 million, according to the CBC. “This increase is largely due to the city employing a one-time, $500 million use of American Rescue Plan funds” in the previous fiscal year, said CBC Deputy Research Director Ana Champeny. However, the

full picture of projected NYPD spending in fiscal year 2023 has yet to be determined due to an expected influx of federal funds. As of now, city-funded operating expenses are budgeted at $5.3 billion. Rather than calling for blanket budget cuts to the NYPD, progressive City Council members and community activists have become more targeted in their rhetoric, instead focusing on reinvestments in programs and services to curb the underlying causes of crime and negative interactions with cops. In a statement responding to Adams’ Blueprint to End Gun Violence, the progressive advocacy group Communities United for Police Reform had a mixed reaction. “Pieces of Mayor Adams’ plan support non-police

WHAT WAS PROMISED: Among the bills state lawmakers passed targeting police reform in the wake of Floyd’s death was the repeal of the state’s Section 50‑a law. Sponsored by Assembly Member Daniel O’Donnell and state Sen. Jamaal Bailey, the bill largely rescinded the 1976 law that shielded officer disciplinary records from the public. Under the 2020 legislation, disciplinary documents are subject to release via Freedom of Information Law requests.

safety solutions that we have been demanding for years, like expanding the Summer Youth Employment Program and providing resources for programs and organizations in communities working to interrupt violence,” the organization wrote in a statement. “But these initiatives are made secondary to an approach that increases the power and reach of the NYPD, expands the notoriously violent plainclothes unit, and doubles down on dangerous police surveillance technologies.” Adams’ gun violence plan included plans to offer “a record number” of 100,000 summer job opportunities for young people ages 14‑24. Advocates, however, have called for at least an additional 50,000 spots to

meet the high demand for the program. Reformists said that while they’re not marching the streets en masse, the 2020 protests shone a spotlight on their movement and drew new recruits and resources that they have used to further their goals. They’re now working to strike a balance between the “defund” rhetoric and more practical solutions. “You can’t just say, ‘defund the police’ and that’s it,” Sanclemente‑Gomez said. “It’s defund the police to redirect that funding to potentially pay teachers more or to provide more affordable housing. Communities want a lot more ... and for us to not really be able to dive deep into what that strategy could look like, is a disservice to us as organizers.”

WHERE WE ARE NOW: The 2020 law has faced legal roadblocks from police unions that have sued to prohibit the release of records, some successfully. Police departments have also found ways to circumvent 50‑a’s repeal by using narrow interpretations of the law to deny records requests. The New York Civil Liberties Union sued the NYPD in September, claiming its complaint database published in March 2021 following 50‑a’s repeal only included details of investigations that were “substantiated.” Sanclemente‑Gomez said the 50‑a legislation was “definitely progress” and sparked a new conversation surrounding police accountability, but “it is not the silver bullet by any means. We just chipped away at the problem.” Legislation introduced earlier this year by Assembly Member Jessica González‑Rojas and Bailey sought to formally eliminate the availability of the “unsubstantiated” excuse. The bill would amend the 2020 law to explicitly state that records can not be denied “because such records concern complaints, allegations or

charges that have not yet been determined, did not result in disciplinary action or resulted in a disposition or finding other than substantiated or guilty,” according to the bill text. While the legislation is still in committee, another bill that changed some of the provisions under the repeal of 50‑a was recently passed and signed by Gov. Kathy Hochul on March 18. The law removed the requirement that a judicial hearing be held to determine if disciplinary documents related to an ongoing investigation – an exception frequently cited by police departments – can be withheld. Instead, under the newly passed amendments, government agencies must simply obtain a certificate from the investigating agency “that the FOIL‑requested records may be withheld because they would impede an ongoing investigation,” according to an explanation of the bill, which was sponsored by Democrats state Sen. James Skoufis and Assembly Member Steve Englebright. There was some disagreement about whether the new changes would hinder or help public access to records. The government watchdog group Reinvent Albany said the newly enacted provisions improve transparency by requiring police departments to explain why releasing records would impede an ongoing investigation. But some legal experts have said it gives police departments more leeway in making those determinations by eliminating judicial intervention. “We are back to a situation where the police simply have to give no justification, just blanket denials for access to information. They can simply cite the existence of an ongoing investigation,” lawyer James Henry told the New York Post.

DISBANDING THE NYPD ANTICRIME UNIT WHAT WAS PROMISED: Amid the protests, de Blasio promised to do away with the city’s anticrime unit that was notorious for its controversial use of stop and frisk. Former NYPD Officer Daniel Pantaleo, who put Eric Garner in a lethal chokehold while arresting him on Staten Island in 2014, was a member of the anti-crime unit. Made up of about 600 undercover police officers, the unit was formally disbanded in June 2020 under former NYPD Commissioner Dermot Shea. “I would consider this in the realm of closing on one of the last chapters on stop, question and frisk,” Shea said at the time. WHERE WE ARE NOW: In one of his first major policing announcements, Adams said the city would bring back the anti-crime units, sparking criticism from progressive City Council members and criminal justice activists. “The anti-crime unit has just been rebranded in some other capacity, especially under Mayor Adams,” SanclementeGomez said. “We’re just going back to square one.” The units, now called Neighborhood Safety Teams, were deployed on March 14. The approximately 200 officers are divided into groups of five officers and one sergeant, stationed in 30 precincts and four housing police service areas where 80% of the city’s gun violence occurs, officials have said. While the officers historically wore street clothes, they now wear a less conspicuous version of the NYPD’s uniform. Adams said the officers selected for

the teams would undergo enhanced training and a strict vetting process. “These anti-crime teams are not the anti-crime teams of old. They look different. They’re vetted different. There’s significant oversight,” NYPD Commissioner Keechant Sewell said during a March City Council hearing. A spokesperson for the mayor said Adams “will not allow abusive practices to take place” within the NYPD. “To show his commitment to transparency and accountable policing, Mayor Adams is making sure the NYPD’s new anti-gun unit will not make the mistakes of the past. Like all uniformed officers of the NYPD, the Neighborhood Safety Teams all wear bodyworn cameras. Additionally, all members of the anti-gun unit wear modified uniforms that clearly identify them as NYPD,” spokesperson Fabien Levy said in a statement. The units were supposed to be responsible for finding illegal guns, but department data showed most of their arrests have been for low-level crimes. As of April 5, the most frequent arrest made by the units was for criminal possession of a forged instrument, such as a fake ID. The teams had made 27 such arrests of 135 total, according to the NYPD. As of May 10, the unit had made 397 total arrests and removed 69 guns, according to the department. Meanwhile, a federal monitor reported earlier this month that the NYPD continues to underreport stops but “has made significant strides” regarding stop and frisk, including increases in justifiable stops and the use of bodyworn cameras. However, the monitor found that 29% of stops made by the NYPD last year were not properly documented, something the

department said was, in part, an effect of the pandemic. “This report describes many accomplishments primarily relying on data from 2019-2020,” the NYPD said in a statement. “In the time period since the report, compliance has steadily and consistently increased.”

PUBLIC OVERSIGHT OF SURVEILLANCE TECHNOLOGY ACT WHAT WAS PROMISED: First introduced in 2017, City Council legislation requiring the NYPD to publicly report technology it uses and plans to acquire in order to surveil the public, such as drones and license plate readers, gained momentum during the 2020 protests and passed in June of that year. In 2019, national backlash to the use of facial recognition software by police and bans on the technology in other cities, such as Oakland and San Francisco, also brought renewed attention to the legislation. The NYPD has used facial recognition on children as young as 11 years old to compare crime scene photos to mug shots, The New York Times reported. Department leaders staunchly opposed the legislation, stating that it would “help criminals and terrorists” and “endanger police officers,” Deputy Commissioner of Intelligence and Counterterrorism John Miller said in an interview with AM 970’s John Catsimatidis in 2017. WHERE WE ARE NOW: The NYPD in January 2021 released a list of the surveillance technology it deploys, including geolocation tracking devices and mobile X-ray technology, along with

an “impact and use policy” for each device. Advocates said the data dump did not go far enough and did not disclose who is shared on the information collected from the technology or how the NYPD prevents racial biases historically associated with the technologies. “In general, the disclosures

obscure the breadth, depth, and complexity of the NYPD’s surveillance, and in some instances even include misrepresentations and inaccurate statements,” the NYCLU wrote in response to the release of the information. Advocates continued to report racial bias associated with facial recognition software – technology that faced widespread criticism for

The technology was used to track down Black Lives Matter activist Derrick Ingram, a cofounder of the group Warriors in the Garden, who was accused of yelling in an officer’s ear through a megaphone during the protests. LIMITING THE USE OF CHOKEHOLDS BY POLICE WHAT WAS PROMISED: Both the New York City Council and the state Legislature passed laws banning the use of chokeholds by police. The Eric Garner Anti-Chokehold Act, sponsored by then-Assembly Member Walter Mosley and then-state Sen. Brian Benjamin, was passed by the Legislature in June 2020. The bill made it so a police officer who injures or kills someone by using “a chokehold or similar restraint” could be charged with a class C felony, punishable by up to 15 years in prison. The council legislation criminalized “the use of restraints that restrict the flow of air or blood by compressing another individual’s windpipe or arteries on the neck, or by putting pressure on the back or chest, by (a) police officer making an arrest.” The NYPD’s own policy has prohibited chokeholds for decades, but the new law made it so that officers who engage in the practice could face a class A misdemeanor charge under the law. WHERE WE ARE NOW: The NYPD’s police unions sued over the legislation, and last year a state Supreme Court judge ruled that the policy was “unconstitutionally vague” and must be rewritten. On May 19, an appeals court reinstated the law, writing the “Supreme Court should have not found the diaphragm compression ban to be unconstitutionally vague. The diaphragm compression ban is sufficiently definite to

give notice of the prohibited conduct and does not lack objective standards or create the potential for arbitrary or discriminatory enforcement.” Officers have continued to use the restraint tactic since Garner’s death, according to the New York City Civilian Complaint Review Board, which reported in January last year 40 instances in which officers have used chokeholds since Garner’s death.

BETTER OFFICER ACCOUNTABILITY WHAT WAS PROMISED: The NYPD Internal Affairs Bureau, along with the Civilian Complaint Review Board, was charged with investigating hundreds of complaints of officer misconduct during the 2020 protests. De Blasio, at the time, said he was concerned about the dozens of videos of officers behaving aggressively toward protesters, but he also expressed support for the department’s handling of the demonstrations overall. WHERE WE ARE NOW: The Civilian Complaint Review Board earlier this month reported that it has substantiated 267 of 316 cases of officer misconduct related to the 2020 protests and recommended the highest level of discipline for 88 officers. The NYPD has closed 44 of those cases and agreed with the board’s recommendations just 10 times. However, the board said it faced barriers in investigating due to its inability to identify some of the officers on video footage engaging in aggressive tactics, forcing it to close 26% of cases for that reason.
