A GOOD RULE OF THUMB is to write about a lawsuit after it’s filed, rather than reporting about how someone is threatening legal action. That way you know for sure that the lawsuit actually happens. But hey, this is the age of COVID-19, and requiring anyone to get vaccinated is a surefire way of getting sued. That’s why I’m putting my money on Pat Lynch’s threat of taking legal action to stop Mayor Bill de Blasio’s latest vaccine mandate – this time for all municipal employees. De Blasio’s got the fact that mandates are working on his side. Nevertheless, Lynch, president of the New York City Police Benevolent Association, fired back that since de Blasio’s “haphazard vaccine rollout” began, the union has worked to make the vaccine available its members who wanted it, while “protecting their right to make that personal medical decision in consultation with their own doctor.” “Now that the city has moved to unilaterally impose a mandate, we will proceed with legal action to protect our members’ rights,” Lynch said on the union’s website. Is Lynch bluffing? No way. But you have to wonder how successful a lawsuit will be in stopping de Blasio. Several legal challenges to earlier mandates failed. Yet there may be hope for those looking for it. A judge did side with Stephen Crampton of the Thomas More Society and 17 hospital and nursing home workers the group represents after they sought a religious exemption to the rule. So we should expect religion and personal choice will continue to fuel these legal fights. Meanwhile, there’s still a battle to be won against the virus.

Born and bred New Yorker Colin Powell died from complications from COVID-19 last week, leading to an outpouring of tributes from leaders in and around the South Bronx neighborhood where the former chair of the Joint Chiefs of Staff was raised. The first Black secretary of state, Powell was known for both his trailblazing and his eponymous international relations doctrine. Despite his leadership on a global stage, Powell said once that “the Bronx never left me.”

remarks “disgusting.” Rep. Alexandria OcasioCortez went a step further and called on Jacobs to resign. Jacobs did release a tepid apology, which Hochul seemed to find sufficient, not heeding calls to immediately replace him. And Walton herself responded by saying she understands that people make mistakes. But in another shakeup, just days after Jacobs’ comments, Schumer announced his endorsement of Walton over Brown, who is still waging a write-in campaign. The Senate majority leader was one of several prominent state Democrats who have steered clear of the race, but his support will likely be a significant boost for Walton as Election Day draws closer. Hochul, meanwhile, confirmed that she would not endorse anyone in the race.

New York City’s two major party mayoral candidates Eric Adams and Curtis Sliwa went head-to-head in their first debate shortly before voters head to the polls. Nearly all political observers already treated Adams’ victory as a foregone conclusion in the overwhelmingly Democratic city, and the debate really drove home that point. Sliwa faced scrutiny for his past fabrications of crime as the leader of

the Guardian Angels, while Adams continued to give nonanswers on questions about his residency, as well as who he would back for governor next year. But overall, Adams remained calm and largely kept to policy points during the televised debate, much to his benefit.

MORE VAX MANDATES IN NEW YORK CITY

Mayor Bill de Blasio announced that he will remove the COVID-19 testing option for all municipal workers beginning Oct. 29, meaning there will no longer be

an alternative for getting vaccinated. If city workers, including police officers and firefighters, don’t get the shot, they’ll be placed on unpaid administrative leave. The move was criticized by municipal unions, and several said they would challenge the new rule in court. The success of such a lawsuit is questionable given that a similar mandate for city teachers has withstood legal scrutiny. The new mandate also raises concerns about worsening staffing issues that already exist if thousands of municipal employees choose not to get the vaccine.

Illegal evictions on the rise in New York For the past 18 months, renters in New York and across the country have been protected by a variety of emergency measures meant to keep people in their homes during the COVID-19 pandemic. Officially, these protections have slowed evictions in the state to a trickle: In New York City, for example, marshals have executed just 72 evictions since the start of the pandemic – only a few more than they carried out every day in 2017. But off the books, a very different story has been unfolding as landlords, sometimes frustrated by the eviction moratorium, take matters into their own hands. Tenant organizers across the state say there’s a growing trend of landlords changing locks, shutting off utilities and taking other drastic measures to get tenants out – and court data shows that few of these landlords face legal consequences. Illegal evictions have largely escaped public scrutiny, in part because the laws designed to prevent them are rarely enforced. Just 25 landlords faced charges for illegally evicting a tenant in 2020, according to New York state court data released this summer. Most of the cases were dismissed, and none led to a criminal conviction; three

cases resulted in fines, and three more are still pending. City & State contacted prosecutors in 10 of the state’s most populous counties, including the five boroughs of New York City. Of those who responded, Manhattan District Attorney Cy Vance’s office reported the highest number of prosecutions: a total of 17 since 2019, including three cases in 2020 and seven cases this year. Queens District Attorney Melinda Katz’s office said it had prosecuted no such cases. The district attorney in Nassau County listed three cases since last year; in Monroe County, which includes Rochester, three cases since August of this year; and in Erie County, which includes Buffalo, one case this year. Data on illegal lockouts is hard to come by, since most go unreported, but tenant advocates say they dwarf the number of prosecutions. Sateesh Nori, attorney in charge at the Queens neighborhood office of the Legal Aid Society said Legal Aid receives about a dozen complaints of lockouts a week in the borough of Queens alone. In some cases, the tenants facing such evictions are living in informal apartments in the first place, including basement apartments, he said. – Colin Kinniburgh

What is something you’re emphasizing at the first in-person Somos since the pandemic began? The service trips. We’re doing one that focuses on how Afro Latino lives matter. It is going to take place where African slaves were made to live. African culture has been very influential in the way we eat, our music, and so we want to make sure that everyone that comes to Puerto Rico understands this. What is an example of self-reliance in the Puerto Rican community in response to the long history of government neglect?

One thing about Puerto Ricans is that the people are resilient. You have young people learning how to cultivate hydroponics. They’re learning because they know they’re going to have to go back to their roots if they’re going to be self-sustainable. The goal is to help those in need. That’s where Puerto Rico is at right now. They have gone through it all, and they’re still going through it and still thriving. Hurricane Maria brought people together to be quite honest. How so? You know when Hurricane Maria hit Puerto Rico it was really, really heartbreaking. We’ve all seen the

images on TV. We saw how devastated people were and how severely neglected they were. So the (New York) community just decided to help, which created such a whirlwind that we were able to collect 68 pallets of water – tons and tons of food and cases. We had to do a packing party because it was so much. We had over 300 people. People were extremely generous with their time because they wanted to do something for Puerto Rico. It wasn’t just Puerto Ricans, it was every nationality wanting to come together. So this was the start of “Wow, we can turn this into other ways of helping the community.” Then the earthquakes

came at the end of 2019, and I once again went to Puerto Rico, this time with a couple Assembly members. My district provided cots and blankets and things that people really need. Fast forward to the pandemic. So who benefited on the island from all this help? We were able to give the pallets of water and food through an organization of retired teachers. I did not do it through Somos. I didn’t do it through anything but people power. I’m a born Puerto Rican woman, so it’s really hard to watch your people suffer like that without getting involved. The way Puerto

Rico has been treated has just been so heartbreaking and so surreal for me because it’s just not necessary. What were some of the groups you worked with after Maria that later helped the community response to COVID-19? I have built a good coalition of faith-based organizations, the community boards, the police precinct councils, the community education councils of my district. I have brought everybody to the table to discuss how we’re going to deal with things during the pandemic. – Zach Williams

Races to watch in New York’s 2021 general election

These are the few competitive seats up for grabs.

Y NOVEMBER IN New York City, the outcomes of many local elections seem somewhat predetermined. While top positions including mayor, public advocate and comptroller have candidates from multiple political parties on the ballot, the overwhelmingly Democratic city pretty much already decided those outcomes, as well as many City Council races, during the June Democratic primary. That means mayoral candidate Eric Adams, incumbent public advocate candidate Jumaane Williams and comptroller candidate Brad Lander – all Democrats – are very likely heading to victory in the upcoming general election. But that doesn’t mean there aren’t any competitive elections to watch this year. Several City Council swing districts are up in the air, as is the borough president race on Staten Island. And some of the most competitive races are happening far outside the five boroughs, including the India Walton and Byron Brown rematch for Buffalo mayor. Plus, voters across the state will vote on five ballot proposals to amend the state constitution. Ahead of the Nov. 2 election, City & State rounded up some of the more competitive races to watch this year. BUFFALO MAYOR India Walton (Democratic) vs. Byron Brown (write-in) Can an incumbent mayor win a writein campaign? That’s the central question in Buffalo this year, after incumbent Mayor Byron Brown lost the Democratic primary in June to socialist India Walton. Brown, now running a formidable write-in campaign, is playing catch-up after taking the primary election for granted. Walton may have a natural ballot advantage in being the Democratic Party’s official candidate, but some major state party leaders aren’t exactly lining up to stump for her. Gov. Kathy Hochul won’t endorse in the race, while state Democratic Party Chair Jay Jacobs made a mess in making a point not to endorse her. As a write-in candidate, Brown maintains the backing of some Buffalo political and business leaders. Walton may be the only candidate listed on the ballot, but Byron still poses a serious threat.

NEW YORK CITY COUNCIL DISTRICT 19 Tony Avella (Democratic) vs. Vickie Paladino (Republican, Independent) vs. John-Alexander Sakelos (Conservative, Save Our City) With moderate Democrat Paul Vallone on his way out, District 19 in northeast Queens has a chance of flipping to the Republicans. It’s one of a few districts that Republicans are hoping to claim from the Democrats this year, but GOP candidate Vickie Paladino goes into the race as an underdog. Former state Sen. Tony Avella carries not only name recognition but a history of winning elections in the area, including serving on the council from 2002 through

2009. Still, the Republican voting population can’t be underestimated in this section of Queens, and Paladino maintains a fundraising edge. Conservative Party candidate John-Alexander Sakelos could end up pulling some of Paladino’s votes, however, to the benefit of Avella.

NEW YORK CITY COUNCIL DISTRICT 32 Felicia Singh (Democratic) vs. Joann Ariola (Republican/Save Our City, Conservative) vs. Kenichi Wilson (Community First) One of Queens’ only remaining Republican seats is up for grabs, and Felicia Singh, a teacher and progressive Democrat, is hoping to flip it. Southeast Queens’ District 32 is currently represented by Republican Eric Ulrich, and flipping the district will be no easy feat. Singh faces opposition from Republican Joann Ariola, chair of the Queens Republican Party, and Kenichi Wilson, a Queens Community Board 9 member running on the Community First line. The race will be a test for Democrats on whether they can elect not just a member of their own party, but mobilize enough voters to elect a further left member in a swing district. “If Felicia Singh is able to win, it’ll put to rest the claims that moder-

ates won’t vote for a progressive,” said Evan Stavisky, partner at The Parkside Group, a political consulting firm. “If she’s unsuccessful, it’ll raise the question of could a different Democrat have been successful?” NEW YORK CITY COUNCIL DISTRICT 43 Justin Brannan (Democratic, Working Families) vs. Brian Fox (Republican, Conservative) Democrat Justin Brannan is probably a safe bet, but he’s not taking this race for granted, after winning by just 3% in the 2017 general election. The southern Brooklyn neighborhoods of Bay Ridge and Dyker Heights have seen seats flip blue, but Republicans maintain a strong foothold in the area by holding seats in the House and Assembly. Brian Fox, who founded a technology staffing firm and now spreads conspiracy theories on social media, is a first-time candidate and is running on hot-button issues claiming that

New York City Council Member Justin Brannan hopes to be speaker, but first he needs to keep his southern Brooklyn seat.

Brannan “defunded the police” when he voted for the city budget last year that cut New York City Police Department funding by $1 billion. Brannan is one of the contenders to be the next speaker of the City Council, and a close contest that doesn’t get called on election night could cut into the time he needs to be campaigning for that race. NEW YORK CITY COUNCIL DISTRICT 48 Steven Saperstein (Democratic) vs. Inna Vernikov (Republican, Conservative/Centrist) There’s a lot of party hopping going on in southern Brooklyn’s District 48. Democratic candidate Steven Saperstein previously ran for office as a Republican, while Republican contender Inna Vernikov used to be a registered Democrat. It’s not a surprise that Saperstein and Vernikov are aligned on some issues, as Saperstein himself has acknowledged. Vernikov, a lawyer, has organized her campaign around key issues like opposing vaccine mandates and opposing a state cap on charter schools. She is also running as an avowed Donald Trump supporter. The district consists of neighborhoods that turned out for Trump in the 2016 and 2020 presidential elections, but it has consistently elected Democrats in local races, and Democrats still outnumber Republicans. (Conservative Democrat Chaim Deutsch vacated the seat

Saperstein, a special education teacher, enters the race with a strong fundraising advantage and the backing of organizations like the New York City Police Benevolent Association – a benefit in districts like the 48th, where public safety is a prevalent issue. NEW YORK CITY COUNCIL DISTRICT 50 Sal Albanese (Democratic, Staten Island 1st) vs. David Carr (Republican) vs. George Wonica (Conservative) When Republican John Fusco left this Mid-Island City Council seat in 1998, his former chief of staff, Jimmy Oddo, won the seat. When Oddo was term-limited out in 2013, his longtime chief of staff Steven Matteo won it. Eight years later, Matteo is term-limited, and his longtime chief of staff David Carr is hoping to keep it in the family. The district has traditionally voted Republican, but insiders say Sal Albanese has a real shot, thanks in part to union endorsements such as the New York City Police Benevolent Association, which is influential in the district. Albanese also has a relatively high profile for a council candidate, since he previously served in the

council representing a Brooklyn district and has run for mayor three times – most recently falling to New York City Mayor Bill de Blasio in the 2017 primary. Carr has raised and spent the most in the race, but Conservative George Wonica’s presence could siphon away some right-leaning voters, particularly after Carr’s bruising Republican primary against Marko Kepi. STATEN ISLAND BOROUGH PRESIDENT Mark Murphy (Democratic, Staten Island 1st) vs. Vito Fossella (Republican) vs. Leticia Remauro (Conservative) Staten Island hosts New York City’s only really competitive borough president race this year, with former Republican Rep. Vito Fossella facing off against Democrat Mark Murphy, a real estate developer and former congressional candidate, and Conservative Party candidate Leticia

Remauro, a former chair of the county Republican Committee. Murphy and Remauro are both spending heavily in the race, with Murphy doling out roughly $488,000 and Remauro spending roughly $648,000 since Oct. 1. Fossella, by comparison, has spent just $96,000. It’s an uphill battle for Murphy; the borough presidency hasn’t been held by a Democrat since 1989. Still, Remauro’s candidacy on the Conservative Party line could end up pulling votes from Fossella and give Murphy an opening. NASSAU COUNTY DISTRICT ATTORNEY Todd Kaminsky (Democratic) vs. Anne Donnelly (Republican, Conservative) Democratic state Sen. Todd Kaminsky is running against Republican prosecutor Anne Donnelly for Nassau County district attorney. While Kaminsky enters the race as the more prominent politician, having

some, including the chair of the Independent Redistricting Commission, it’s facing some pushback in part because changes are being proposed in the middle of the current redistricting process.

a political record to attack isn’t always a good thing. Donnelly has made bail reform a key issue in the suburban county, criticizing Kaminsky’s vote for criminal justice reforms as part of the 2019 state budget. The race is thought to be very close – state Democratic Party Chair Jay Jacobs told City & State that Kaminsky was only slightly ahead in a recent internal poll. Kaminsky, a former federal prosecutor, still has a fundraising advantage. If attacking bail reform becomes a winning strategy for Donnelly’s campaign, Republicans across the state are likely to deploy it in 2022. SYRACUSE MAYOR Ben Walsh (Independence) vs. Khalid Bey (Democratic) vs. Janet Burman (Republican, Conservative) In a reliably blue city like Syracuse, one would think the Democratic candidate goes into an election with an obvious advantage. But in this year’s mayoral race,

Democratic Syracuse Common Councilor Khalid Bey is actually the insurgent hoping to take down incumbent Mayor Ben Walsh, who won as an independent in 2017 and is running on the Independence Party line this year. Walsh has a heavy advantage in fundraising over Bey and Republican candidate Janet Burman, and name recognition can always be counted on to serve an incumbent, even if he’s a third-party candidate. NEW YORK STATE BALLOT PROPOSALS Proposal 1 – Redistricting This proposal would make several changes to the state’s redistricting process, including freezing the number of state senators at 63, including undocumented immigrants in the population count that redistricting is based on and counting incarcerated New Yorkers at their last place of residence, rather than the place where they’re detained. While the proposal is backed by

Proposal 2 – Right to clean air, clean water This measure would amend the state constitution to add that every person has a right to clean air, clean water and a healthful environment. It’s a laudable goal endorsed by local environmental groups that few disagree with on its face, but opponents have raised concerns that the general language would lead to excessive litigation. Proposal 3 – Same-day voter registration Same-day voter registration is a goal good-government groups have long fought for, and this proposal would enable the state Legislature to pass a law allowing same-day registration. Proposal 4 – No-excuse absentee voting While the COVID-19 pandemic effectively made no-excuse absentee voting a temporary reality, an amendment to the state constitution is required for the state to allow it permanently. Proposal 5 – New York City Civil Court Voters have a chance to decide whether New York City Civil Court can hear claims for up to $50,000, an increase from the current limit of $25,000. The distinction may be in the weeds for some voters, but the idea is essentially to expand the Civil Court’s jurisdiction and take some pressure off the state Supreme Court’s caseload.

Lessons learned after disasters in Puerto Rico helped inform mutual aid efforts in New York.

P

UERTO RICO HAS endured a lot over the years. This includes state-sponsored violence, natural disasters and social engineering by the government over the past century. Poverty remains widespread, and its status as a U.S. territory continues to cause a range of problems. Federal law makes consumer goods more expensive on the island while Wall Street lending has resulted in an enormous amount of municipal debt. A group of unelected members of a fiscal control board have cut public services in recent years while Hurricane Maria demonstrated that government neglect was as out of control as ever. “Most of us are raised with that mentality that we (cannot) wait for the government to act,” Democratic District Leader Samy Nemir-Olivares, who is originally from Puerto Rico but now lives in Brooklyn, said in an interview. “The recovery (from Maria) was like a wake-up call that we cannot wait for the government, and we need to take justice and solidarity up into our hands.” This spirit of communal self-reliance has helped Puerto Rico confront adversity on the island and beyond in the absence of government protection. This includes recovery efforts from Hurricane Maria that activists, elected officials and New Yorkers later used to deal with COVID-19. While much of this aid was provided by elected officials and established nonprofits, a significant amount has come through an idea with deep roots in Puerto Rican culture. “Mutual aid is when everyday people get together to meet each other’s needs,” writes Joel Izlar, a doc-

toral candidate at the University of Georgia who has written about mutual aid during the pandemic. “Mutual aid is an idea and practice that is based on the principles of direct action, cooperation, mutual understanding, and solidarity. Mutual aid is not charity, but the building and continuing of new social relations where people give what they can and get what they need, outside of unjust systems of power.” Relevant examples abounded during the pandemic. Community fridges popped up across New York City to facilitate food donations. A “rolling library” brought books to far-flung neighborhoods. Nemir-Olivares said he got involved with a Brooklyn group called Bushwick Ayuda Mutua – one of dozens of mutual aid groups across the city and state – after seeing a flyer one day and realizing that his Spanish-language skills and organizing experience could be useful for his community at a time of great need. “Most food pantries and nonprofits closed in Bushwick and Brooklyn during the very first month of COVID, so there was literally nothing for people to eat,” Nemir-Olivares said. “We couldn’t stay at home because we knew there was a lot of people who couldn’t go out.” More than 200 people in total eventually came together, Nemir-Olivares said, to deliver boxes of “chicken, eggs, rice, beans – you name it” to hundreds of struggling families. The benefits of mutual aid come in a variety of forms, including the solidarity it enables across different communities. New York City Council candidate Marjorie Velázquez, whose parents moved to the city from the island, said she channeled her own family’s experience with mutual aid into

local efforts to provide tens of thousands of halal meals to neighbors celebrating Ramadan last year. “(The city) was just giving peanut butter and jelly sandwiches,” she said in an interview. “I’m not Muslim, right? But that doesn’t mean that I can’t be there for that community.” Assistance from elected officials and community groups helped keep the operation going for months, but mutual aid groups continued to fill other needs as they popped up, including connecting people with translation services. The concept of mutual aid has roots stretching back to at least the 18th century when organizations like the Free African Society served Black Americans as they navigated freedom in a country where white-dominated institutions often denied them basic services. Schoolchildren two centuries later have the Black Panthers to thank for normalizing the idea of free school lunches through the use of mutual aid. Indigenious groups in New York City have also leveraged mutual aid in their own activism that emphasizes anti-capitalism, anti-colonialism and solidarity. Some Puerto Ricans look to the pre-Columbian inhabitants of the Caribbean for inspiration on what mutual aid means for them. “When you read up on the Taíno culture, it is about taking care of each other,” Velázquez said. “That’s the blood and the spirit that we have within our communities. We know firsthand that our responsibilities are for one another.” Solidarity between people in Puerto Rico and its diaspora in places like New York – one of the top mainland destinations from the island – has been especially important in recent years. many of the territory’s approximately 3 million people without power and basic necessities for months, but it inspired mutual aid groups, traditional charities and elected officials to do what they could. Subsequent earthquakes and COVID-19 also showed how the government has failed Puerto Ricans. The upcoming Somos conference near San Juan in early November is one forum where New York politicians and others can discuss how to come together for the island. “We want to make sure that everyone that comes to Puerto Rico understands that we’re in the midst of a pandemic, but we also have issues that need to be resolved,” said Assembly Member Maritza Davila of Brooklyn, the chair of the Puerto Rican/Hispanic Task Force, which puts on the conference. “We’re all dealing with it, the way we can, however we can.”

SOMOS: WHERE NY POLS HUDDLE The conference is aimed at aiding Puerto Rico. It has also gained a reputation for wheeling, dealing and drinking. NEXT MONTH, the biggest names in New York’s political world are scheduled to congregate once again at the annual Somos conference just outside of San Juan, Puerto Rico. Focused on the aftermath of Hurricane Maria and the COVID-19 pandemic, this year’s conference, “Somos La Samy NemirOlivares, center left, is a Bushwick district leader from Puerto Rico.

Recuperación,” or “We Are The Recovery,” is completely sold out. It’s been four years since Hurricane Maria wreaked havoc on the island, and Puerto Ricans are still reminded of the storm with thousands of homes covered in blue tarps waiting to be repaired and outages from the island’s fragile power grid still affecting schools, health care and work. The November conference is nominally aimed to help the people of Puerto Rico and mobilize participants with workshops, but it’s not a secret that New York deals and careers also get made after hours and behind the scenes on the tropical weekend getaway. This year, all eyes will be on the New York City Council speaker race, for example, ahead of when the top candidates emerge in December. The $375 general admission tickets to attend this year’s event give access to workshops on topics including how New York state can protect the future of Puerto Rico when it comes to the debt crisis, LGBTQ community and gender violence in Puerto Rico, and analyzing the effects of Hurricane Maria. The event will conclude with a beach club farewell event featuring an all white dress code and music “inspired by Marc Anthony.” It should also conclude with a legislative agenda focused

on meeting the needs of the Latino community, but documentation of those action items and progress toward them has been scarce in the past. Additionally, the conference, which is sponsored this year by the likes of Uber, DoorDash, the Real Estate Board of New York and health care giant Montefiore, has provided the perfect opportunity for lobbyists to directly meet with politicians and make their cases on certain policies. The conference is organized with the state Senate and Assembly Puerto Rican/Hispanic Task Forces and dates back to 1988. The organization went through different stages of their name, starting with Somos Uno, then Somos el Futuro, but recently settled on Somos. Somos also collects money to empower Hispanic youth with a wide range of resources, such as scholarships, college internships partnered with CUNY and apprenticeship programs to foster opportunities for the next generation of Hispanics to develop and grow. In a 2018 interview with City & State, thenAssembly Member Marcos Crespo mentioned several accomplishments have been made from the conferences. The Somos conference is an opportunity for the progressive Latina to prove she’s the perfect fit for the job. By Jeff Coltin

O MANY, Carlina Rivera seems like the perfect fit to be the next speaker of the New York City Council. She’s a Latina, of Puerto Rican heritage, at a time when there are no other Latino citywide or statewide leaders. She’s a woman in a city where the mayor, comptroller and public advocate are all men, and will all be men in 2022. She’s from Manhattan, the home of the past four City Council speakers, often chosen as a compromise to keep the peace among the historically stronger Bronx, Queens and Brooklyn Democratic parties. Rivera did not endorse anybody in the Democratic primary for mayor, as a member of a legislature that’s eager to be seen as a co-equal branch of government. And she’s a progressive in a city that fancies itself as left-leaning but whose Democrats nominated Eric Adams, a mayoral candidate friendly with big businesses whose idiosyncratic politics could hardly be called progressive. Despite all that, Rivera hasn’t put the votes together yet to secure the position, which has some observers – critics and allies alike – feeling like Rivera has lost her front-runner status. “Four months ago, everyone thought she’d be speaker,” said one labor operative who asked for anonymity to discuss private conversations. But that’s changed: “There’s been

no forward momentum at all.” Of course, it’s still early in the speaker race. The Somos Conference in Puerto Rico, where a lot of politicking is expected to happen, is a little over a week away. And the past two speakers, Melissa Mark-Viverito and Corey Johnson, didn’t secure the votes they needed until midDecember, ahead of the early January vote. But Rivera seems to be coming face to face with the fact that her progressive political identity – and her lack of alignment with Adams – could actually be a liability in this year’s speaker race. Adams is all but guaranteed to be the city’s next mayor, and many people are eager to see action on issues that didn’t get addressed in the past eight years of Mayor Bill de Blasio, whether that’s property tax reform, noncitizen voting or a streamlined government with a lower headcount. Unlike in 2017, when independence and oversight were the name of the game and Johnson won in a field that tried to distance itself from de Blasio, cooperation could be key. Rumors fly about whether Adams prefers Justin Brannan, Francisco Moya or somebody else – but nobody thinks it’s Rivera. Still, Rivera is de-emphasizing the divide between her and Adams. “I don’t think there’s tension there. Every time I’ve encountered Eric Adams he’s been pleasant and very direct about his agenda,” Rivera told City & State.

“New York City is still in a crisis. We need the next mayor to be successful. No one benefits if the mayor’s not successful. Of course the City Council needs to be independent, proactive and provide oversight, and as speaker we are going to do just that. But the people of New York City aren’t interested in a constant fight. And neither am I.” It didn’t have to be this way – Adams was harshly criticized in the primary by opponents like Maya Wiley, who won over much of the city’s progressive establishment and left-leaning voters. That same progressive establishment could end up throwing its weight behind Rivera, but the major players have so far resisted doing so, at this relatively early stage in the race. “We’ve made no decisions at this point,” said Elana Leopold, New York City political director for the Working Families Party. “We hope and are confident that there are things that we’ll be able to work with Eric Adams on, but also are certain that there will be moments where we need to push back and hope that whoever the speaker is that we can count on them to be on our side and to act as that counterweight.”

Incoming progressive members, too, are hesitant to line up behind Rivera just yet, even if she seems to be the contender best aligned with their views. “I haven’t endorsed or am backing anyone right now,” said Tiffany Cabán, a democratic socialist who’s expected to win election in Council District 22 in Queens. “I’m continuing to get to know my new colleagues, trying to find my people, find the folks that are politically and values-aligned and get a sense of, collectively, what we want to prioritize going into the next session.” Cabán has already been putting in some work on that. In August, she organized an open letter calling on de Blasio and the city’s district attorneys to immediately reduce the number of people being held on Rikers Island. Including Cabán, 19 presumptive incoming members signed on, which is a decent approximation of what the council’s left flank could look like next year. And Rivera could be their candidate. She was the one speaker contender who voted against the contentious city budget in 2020, when progressives wanted to see far more significant budget cuts to the New York City Police Department. “There was no

equity in cuts, in my opinion,” Rivera said this month. “My issue at the time was that we really should have focused on equity in those cuts. It was a tough decision.” And one that many council sources say harmed her relationship with Johnson. “I think people know who I am and where I’m coming from and that I stand up for what I believe in. And that was a decision that I made for my constituents and my district. And I think Corey understands that.” But even if you add a few other members to the 19 progressives who signed Cabán’s letter, such as Christopher Marte, Charles Barron or Diana Ayala, a returning member who is running for speaker herself, the list falls short of a 26-member majority in the 51-member council. That would suggest that Rivera, or any candidate, couldn’t solely rely on progressive members to become speaker. They need to win over more moderate members as well. “People aren’t interested in the labels,” Rivera said. “They don’t want to hear where you are on the (political) spectrum. … I’m hoping we can all be on the same page in saying how are we going to take care of the people who are living in poverty and make sure that the garbage gets picked up on time?”

But Rivera does have some numbers on her side. The council is expected to have 29 or 30 women next year – a huge increase from this session, which means that women will make up a majority of the council for the first time in its history. So pretty much anyone you talk to says they’re hoping to see a woman lead the council. The United Federation of Teachers, one of the city’s more influential unions, passed a resolution this month supporting a female speaker, without naming any names. Women endorsed by 21 in ’21 have also made it known that they’d like to see a woman lead the council. The City Council has been led by women twice before: Christine Quinn and Mark-Viverito. But Rivera isn’t the only woman vying for the position. Adrienne Adams, Diana Ayala and Gale Brewer are all running too. Rivera has been laying the groundwork for a speaker run almost since she entered the council, while Ayala jumped in the race recently, leading some to speculate that her campaign was only a reaction to Rivera’s – a Latina in the race whose politics would be more palatable to power brokers like Rep. Adriano Espaillat and state Sen. Jamaal Bailey, the Bronx Democratic Party chair. MarkViverito, an Ayala ally, rejected that.

Viverito’s top choice, it seems like Rivera would be her second. “We have good candidates, two good candidates,” she said. “It should be a Latina speaker.” Rivera, unsurprisingly, denies that her speaker campaign is flagging. “People

will always have opinions,” she said. “I think if they’re still talking about me, it says something else.” But there’s no doubt that the Somos conference is a huge opportunity for Rivera. Dozens of incoming council members and stakeholders will be flying to San Juan, Puerto Rico, immediately following the Nov. 2 general election, and the stillevolving speaker race is expected to come into much clearer view there. Rivera is “a proud Puerto Rican woman” with family on the island, and she has an ally in Rep. Nydia Velázquez, one of the few power brokers in the speaker race who has actually talked openly about who she is supporting. If Rivera is going to convince her colleagues, and the influential players around them, that she actually is the perfect fit to be the next speaker, Somos will be the place to do it. “Somos is always a place where we discuss very serious issues and where people also get to know each other and they have pretty serious political conversations. And there’s no question that someone like Nydia Velázquez is a powerhouse,” Rivera said. “Sure, it’s going to be nice to feel that tropical breeze in my hair … but I’m excited about the conversations to be had but it’s not going to be easy.”

UNNING FOR elected office is like launching a startup. Besides hiring staff and recruiting volunteers, campaigns enlist consultants to craft a political strategy, draft policy positions, create ads, handle communications, raise money, conduct polls, compile voter lists and ensure compliance with rules and regulations – all with the goal of getting out the vote. In New York, there’s a vibrant ecosystem of consulting firms who assist with these tasks. And there has been plenty of demand for their services this past year, from the presidential, congressional and state legislative elections last fall to the many New York City races this year, including for mayor, comptroller, Manhattan district attorney, Queens and Bronx borough president and New York City Council. The trend of insurgents challenging incumbents is bringing even more candidates into the arena. The downfall of former Gov. Andrew Cuomo has half a dozen or more politicians mulling a run for governor, not least of all his successor, Gov. Kathy Hochul. That’s why City & State is publishing a Political Consultants Power 75, up from 50. The 2021 list highlights consultants young and old, giving weight both to the track records of experienced veterans

and the promise of talented newcomers. The list is largely made up of full-time consultants, although a few informal advisers and others who do political work on the side made the cut. The list features New York-based firms that are largely national in scope, national firms that did significant work in New York and, of course, New York firms who mostly work in their home state. While compiling such a list is more art than science, City & State assessed performance over the past 12 months, including major wins and losses by clients, consultants’ importance to various campaigns, and the prominence and power of their winning candidates. Congressional and state legislative contests that were essentially won in the primaries last year were factors on last year’s list and are largely omitted here. However, some 2022 races already underway, most notably the gubernatorial race, were factored in. City & State reached out to each firm on this list to designate its top employees, share its biggest accomplishment over the past year and to highlight its clients, and we’ve filled in any gaps based on our own research and conducted a review of public filings. ERIC ADAMS Eric Adams essentially has the New York City mayoral race in the bag, and nothing Republican candidate Curtis Sliwa did at their first debate changed that. Adams has been likely to be the city’s next mayor since he won the Democratic primary in June, and while Sliwa criticized the Brooklyn borough president, Adams showed that no amount of “buffoonery” from his opponent will knock him off course.

With Halloween just around the corner, former New York City Mayor Rudy Giuliani gave the internet an early scare when he used a filter on a video of himself to appear like Abraham Lincoln. Giuliani thought this was the best way to rally Virginia voters against Democrat Terry McAuliffe’s gubernatorial run. His rendition of Honest Abe, however, sounded more like he was gasping for air. Cameo might consider dropping Rudy G from its personalized video service after seeing this desperate call for attention.
