CITY OF WALTON, KENTUCKY ORDINANCE NO. 2010-_04 AN ORDINANCE ANNEXING A 0.70 ACRE PARCEL OF REAL PROPERTY LOCATED AT 125 CHAMBERS ROAD IN BOONE COUNTY, WHEREAS, David R. Kelly and Carla L. Kelly, being the owners of record of the hereinafter described real property, have requested that the City of Walton annex said real property and, pursuant to KRS 81A.412, said owners have given written consent to such annexation; and, WHEREAS, the City of Walton has determined that it is desirable to annex the real properly; and, WHEREAS, the Boone County Planning Commission has previously established the zoning for the real property; and, WHEREAS, neither the owner of the property nor the City of Walton have requested a change in zoning of the property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WALTON, KENTUCKY, as follows: SECTION ONE The City of Walton finds that the real property meets the requirements of KRS 81A.410, in that It is contiguous to the boundaries of the City, it is suitable for development for urban purposes without unreasonable delay, and that it is not included within the boundary of another Incorporated city SECTION TWO The real property owned by David R, Kelly and Carla L. Kelly, consisting of 0.70 acres located at 125 Chambers Road In Boone County, as described in Dead Book 645, Page 299 of the Boone County Clerk’s records, and which is more particularly described on Exhibit "A" attached hereto and Incorporated herein by reference, is hereby annexed and made a part of the corporate territory of the City of Walton, Kentucky for all purposes. SECTION THREE The current zoning of the real property shall remain unchanged until changed in accordance with the provisions of KRS Chapter 100. WHEREAS, the City of Walton, is a legislative body member of the Boone County Planning Commission, a joint county-wide planning unit or commission established under Chapter 100 of the Kentucky Revised Statutes; and, WHEREAS, the Boone County Planning Commission received a request from Andrew Piaskowy (Applicant) an behalf of Sisters of St. Joseph the Worker (Owner) for a Zoning Map Amendment to the Boone County Zoning Map, and such Zoning Map Amendment being a zone change from Office Two (0-2) to Public Facilities (PF), and two Variances to reduce the rear building yard setback and the rear landscape buffer yard, all for a 1.07 acre site located at 1 Beatrice Avenue, Walton, Kentucky; and, WHEREAS, the Boone County Planning Commission, as the planning unit for the City of Walton, was requested to and has conducted a Public Hearing serving as a due process trial-type hearing and made findings recommending approval, with conditions, for the Zoning Map Amendment and Variances; and, WHEREAS, the City of Walton, has received Resolution R-10001-A of the Boone County Planning Commission recommending approval for this request; and, WHEREAS, the City of Walton deems it necessary to enact this Ordinance to preserve and protect the health, safety and convenience of the inhabitants of the City of Walton, pursuant to the City of Walton’s legal authority, including but not limited to KRS Chapter 100; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WALTON, KENTUCKY, as follows: SECTION ONE The request for a Zoning Map Amendment with conditions is hereby approved, The Zoning Map Amendment is a zone change from Office Two (0-2) to Public Facilities (PF), and two Variances to reduce the rear building yard setback and the rear landscape buffer yard, all for a 1.07 acre site located at 1 Beatrice Avenue, Walton, Kentucky. The real property which is the subject of this request for a Zoning Map Amendment is more particularly described in Deed Book 969, Page 995 (as supplied by the Applicant) as recorded in the Boone County Clark’s records. SECTION TWO Resolution R-10-001-A of the Boone County Planning Commission, recommending approval of the Zoning Map Amendment, with conditions, and two Variances. is hereby approved and adopted. Firefighters host MDA concert Burlington Uniform Fire Fighters IAFF Local 4521 will host a concert 8 p.m. May 1 to raise money for the Muscular Dystrophy Association. The concert will take place at the Black Sheep Restaurant & Lounge located on North Bend Avenue and Harrison Avenue in Cheviot, Ohio.
