(AGI) exceeded $150,000 ($75,000 if filing status is married separate), or 90% of their 2015 tax liability. If prior year AGI was below $150,000, then the safe harbor percentage is 100%. For New Jersey, one must pay the lesser of 100% of their 2014 tax liability or 80% of their 2015 tax liability.

There has been very little in the way of federal and New Jersey tax law changes for 2015. And with 2016 being a major federal election year, one would not expect significant changes to the tax code next year.

Taxpayers that generate withholding, typically from wage income, can catch up before the end of the calendar year via accelerated withholding. All withholding is treated as paid ratably throughout the year regardless of when the withholding occurred.

Individuals can avoid incurring an underpayment of estimated tax penalty by having their 2015 income tax payments reach the lesser of two thresholds. For federal purposes, one must pay the lesser of 110% of their 2014 tax liability (safe harbor) if their 2014 adjusted gross income

A focus area for potentially lowering 2015 personal income tax liabilities is capital gains and losses. If a taxpayer has realized significant capital gain income for 2015, they might consider selling any items in their portfolio with unrealized

losses in order to trigger those losses as an offset against the capital gain income. For New Jersey, one never wants to be in a situation with an overall capital loss since no carryforward is permitted. If there are year-to-date capital losses, consider generating capital gains to utilize the losses. For federal purposes, a $3,000 capital loss deduction is permitted with a carryover of any additional capital losses indefinitely. Retirement contributions remain a valuable deduction. For 2015, an employee can contribute up to $18,000 to a 401(k) plan and, if over age 50, an additional $6,000 for a total of $24,000. Those with self-employment income can make contributions to a Keogh plan or SEP of up to $53,000 on earned income of $265,000

as of December 18, 2015 DiLORENZO TO SENATE BUDGET COMMITTEE: “DON’T GIVE UP ON ATLANTIC CITY” On December 17, 2015, Debra P. DiLorenzo, President & CEO of the Chamber of Commerce Southern New Jersey (CCSNJ) testified before the Senate Budget and Appropriations Committee in strong opposition to SCR-185 (Sweeney), which would allow gaming outside of Atlantic City. Under the current Constitution, casino gaming is permitted only in Atlantic City. SCR-185 would allow for up to two casinos to be built in different counties that are at least 75 miles away from Atlantic City. The Legislature will determine the location of the casinos, as well as how they are taxed and regulated. The measure could be on the ballot for voters as soon as November 2016. In her testimony, Ms. DiLorenzo told the members of the Senate Budget and Appropriations Committee: “There is no question and no doubt that this constitutional amendment will ultimately result in more Atlantic City casino closures, more lost jobs, less business for vendors and higher unemployment, especially given that anywhere from 35 to 40% of Atlantic City casino customers hail from North Jersey and New York.” As currently written in SCR-185, revenue from gaming from the new casinos would be deposited into the New Jersey Investment Fund and allocated as follows:

year 10, at which time 19% of the revenue will be allocated to Atlantic City; •Half of the remaining 49% (which would increase by 3% per year for 10 years), would be allocated to all counties and municipalities for property tax relief for senior and disabled citizens and the other half allocated to the municipality in which the casino is located; •2% for programs that aid thoroughbred and Standardbred horsemen Ultimately, the measure easily passed out of Committee by a vote of 101-1, with the only “no” vote cast by South Jersey Senator Jeff Van Drew of the First Legislative District. Additionally, the Assembly Judiciary Committee considered ACR-2, which would also allow for casinos to be built outside of Atlantic City. However, the Assembly version – which does not match the Senate version – would call for less dedicated revenue to filter back to Atlantic City. This measure also won approval from the Committee, but the two constitutional resolutions need to be identical in order to continue to advance through the legislative process. The Chamber will keep our members apprised of new developments as they occur and, as always, will continue to fight this and other measures that would dilute the Atlantic City gaming market. PAID LEAVE LEGISLATION WINS FINAL APPROVAL IN SENATE Yesterday, the full Senate passed S-785 (Weinberg), the so-called “earned sick leave” legislation that the CCSNJ has been fighting for more than two years. This bill will require employers of all sizes to provide paid sick and other paid leaves to their employees. Among the bill’s many problems, the legislation imposes a one-size-fits-all approach on businesses with no consideration of the many differences that exist between industry types, the financial ability of businesses to comply nor the creative ways in which these businesses already accommodate employee needs. Despite the CCSNJ’s and the entire business community’s strong and vocal opposition, S-785 (Weinberg) passed by a vote of 22-17. The Assembly version of the bill, which is different than the Senate version, has not yet passed. An identical bill must be passed in both houses by January 11, 2016. If that does not happen, the bill will have to be reintroduced in the new legislative session, which begins on January 12, 2016. Click here to read the Chamber’s full position on this legislation.

BEIP TAX CREDIT LEGISLATION ADVANCES Yesterday, A-4834 (Lagana/Burzichelli) and S-3232 (Sarlo/Oroho), passed their respective houses and the bills now awaits the Governor’s signature. This legislation would allow businesses due to receive a grant under Business Employment Incentive Program (BEIP) the option to receive tax credits instead. This measure was proposed by Governor Christie in his FY2016 Budget Address as an option for businesses, as the BEIP program has experienced funding shortages. While successful in supporting the creation of approximately 115,000 jobs in our state, awarding of the grant money has been stalled due to budgetary constraints. These bills would allow companies to amend their agreements with the NJEDA and change their grants to refundable tax credits, if they so choose, as an alternative to waiting for their BEIP grant.
