Letter from the Dean. It is my pleasure, as the new dean of Boston University School of Law, to welcome you to the fall issue of The Record. Since beginning my appointment in August, I have greeted the newest class of students to the law school at orientation, sat down with dedicated faculty and staff, and met talented and engaged alumni and students. I’ve devoted these first months to listening and learning as much as I can about the school and the community to understand the challenges and opportunities we will meet together. It’s been a joy to learn about the strengths of BU Law—both the new and historical. I am impressed by the school’s top-notch scholars, educators, staff, and students, and by the innovations in the doctrinal and experiential curriculum. DR.
ANGELA ONWUACHI-WILLIG, a noted scholar of employment discrimination law, family law, and law and inequality, joined Boston University School of Law as dean in August. A prolific writer and authority on racial and gender inequality as well as anti-discrimination law, she is author of According to Our Hearts: Rhinelander v. Rhinelander and the Law of the Multiracial Family. Previously, she was Chancellor’s Professor of Law at the University of California, Berkeley, School of Law. She has taught employment discrimination, evidence, family law, critical race theory, and torts. A graduate of Grinnell College, Dean OnwuachiWillig received her JD from the University of Michigan, where she was a Clarence Darrow Scholar, a Michigan Law Review note editor, and an associate editor for the founding issue of the Michigan Journal of Race & Law. After law school, she clerked for Chief Judge Solomon Oliver of the Northern District of Ohio and US Sixth Circuit Judge Karen Nelson Moore. She received her PhD in sociology and African American studies from Yale University. The Record spoke with Dean Onwuachi-Willig about how she approaches teaching and scholarship, why she wanted to join the BU Law community, and how she intends to build on the success of previous deans. This interview has been edited for concision and clarity.
The Record: When did you become interested in the law and teaching? Angela Onwuachi-Willig: In my junior year [at Grinnell College], I took a couple of courses that inspired my interest in law school. Also, the summer thereafter, I participated in a summer research program that sparked my interest in teaching. The program was designed to recruit students of color to work in academia. At the end of the program, our advisors asked us whether we’d been convinced to become academics. My response was, “I really enjoyed writing scholarship, but I’ve decided to go to law school.” One of my professors, though not my advisor in the program, said, “Well, you should think about becoming a law professor.” I didn’t know what it meant to be a law professor, and aside from the exposure that I had in that program, I don’t think I had a full understanding of what it meant to be a scholar, but I went to law school thinking in the back of my head, “maybe I want to be a law professor.” That one sentence changed my life. That experience has taught me how important it is to encourage students to pursue careers or goals they may not otherwise consider. And then you went to the University of Michigan for your JD? Yes. I very much remember going to law school and feeling really out of place during my first week. People were talking about law firms and they all seemed to know the names of these firms. I didn’t even really understand the structure of a firm or what a firm was. It all sounded like a different language to me. Many of my classmates also knew what law review was. They knew about clerkships. I later learned about all those things, in part because of the networks I developed with other students in law school. It was an interesting experience, and I think my lack of knowledge about the “goodies” in law school when I was a student really shaped the way that I think about legal education and access to the law.

One of the things that I learned throughout law school and in the legal profession is that access to information, in addition to resources, is really key. I was lucky to have access to information that allowed me to pursue opportunities and become a professor. Simply having access to information opened up a lot of doors for me. What drew you to family law and employment discrimination, and law and inequality more generally? My interests turned initially to employment discrimination law and antidiscrimination law because those were the things that shaped my life. The things that caught my attention in law school were the anti-discrimination cases because I grew up in the South and experienced discrimination throughout my life. Plus, I went to law school because I wanted to know how to use the law as a tool to assist other people. Law struck me as a powerful tool to effect social change.

I had a number of friends who were personally affected by this type of sexual orientation discrimination in the law. I remember, distinctly, learning a lot from people in college and being exposed to people who had completely different life experiences. I also was drawn to family law and antidiscrimination law because I’ve always been someone who has rooted for the underdog, in part because of what I have seen and experienced my whole life. Do you feel that law schools can address these systemic challenges? Yes, I think so. It’s difficult to really tackle them because we’re part of a larger society with huge structural problems. I wanted to be an administrator in part because I believe it’s important to have people who are interested in providing access to legal education for a broader range of people and people who are interested in thinking more structurally about how we can make the legal profession more inclusive and how we can make legal services more accessible. As a professor, you have enormous potential to influence how students think about the law, how critical they are, and what they think they can do when they
empowered. I liked that they asked me difficult questions during my interview. I like that they feel a real ownership of the school and are really protective of it. They also expressed how much they have loved their experience at BU Law, and that is really meaningful to me. Maureen did a great job of leaving the law school in a great position with a successful capital campaign, a new building, and more. So, I felt like BU Law was a good school to come in and continue to build on the success of the previous deans. I am not entering the law school in emergency mode. My faculty colleagues and I can take our time to think about how we want to advance the school and set the school up for a brighter future.

I have a deep appreciation for what educational institutions can do in terms of shaping people and providing them with opportunities. What attracted you to BU Law? BU is an excellent institution in a lot of ways. It has a stellar academic reputation. It has this rich and beautiful history of diversity and access, and I love that the very foundation of the school is built on access and inclusion. And, I love that BU is proud to have not only top scholars on the faculty, but also some of the very best teachers in the academy. The students are phenomenal. They are smart, talented, and they feel really
The alumni have also been phenomenal. They are just an absolute treasure. I hear more and more amazing things about what people have accomplished after graduating from BU Law. The alumni are fiercely loyal to the school, and they want the generations that follow them to have the same kind of excellent education they had. Plus, everybody whom I met loved BU, and many of them had been working at BU a long time, and that kind of employee loyalty is a sign of a really good place. Do you have any goals that you would like to accomplish in your first year as dean? As a new dean and a new member of the community, I have to simply come
And then, one of my primary goals will be fundraising to ensure that our programs remain top notch and our students have the support they need and deserve. Legal education is more expensive than ever, so I want to raise funds for scholarships as well as support curricular and scholarly innovations. I also want to get out and meet alumni—in groups and individually. I will spend time meeting our most active and loyal alumni, and I will travel to cities where there are big pockets of alumni to meet with people in groups. I want to introduce myself and talk about the success of the law school and where we hope it can go and how the alumni can assist in that effort.

Finally, I think that BU Law is a really distinctive community, and I want to be thinking about how we can communicate that and best inform the public about all the amazing things that are happening here. What do you like to do for fun when you’re not teaching or doing research? I like to spend time with my family, of course. I like pop music a lot. I listen to the radio and dance by myself. I like the show Beat Shazam. I’m really good at guessing songs after hearing just a few notes. I’ve often joked that I should engage in some kind of competition with the students. I enjoy bad TV. My favorite show is Survivor. I’ve seen every season but the first one. I just think it’s super fascinating to watch the race and gender dynamics on the show, to see who forms alliances with each other, who gets voted off and in what order. I think it’s one of the most interesting things on the planet. And I like to write creatively. So, I guess you could say the arts in general, but not even the high-brow stuff! Is there anything else that you would like the BU Law community to know about you? I believe in the transformative power of education, and I have a deep appreciation for the role that alumni have played, can play, and will play in enabling generations of BU Law students to come and get an excellent education just like they did, to leave with great opportunities, and to do good in the world. And there are a lot of ways to do good. I think that alumni are an incredibly important part of BU Law’s continued success. A CAREER THAT COMPUTES Aravind Swaminathan (’02) turned his interest in tech and experience as a prosecutor into a thriving cybersecurity and data privacy practice.

WHEN A MAJOR PUBLIC COMPANY suffered a data breach recently, Aravind Swaminathan (’02) took the unusual step of working with the relevant federal authorities to have law enforcement personpersonnel seize a server containing his client’s stolen data. As a result, the company faced no consumer or regulatory complaints. “No regulator or class action plaintiff wanted to touch this case, given the lengths to which Aravind went to protect, and indeed recover, the company and its customers’ data,” says Antony (Tony) Kim, who, along with Swaminathan, cochairs Orrick’s Cyber, Privacy & Data Innovation practice. “Most lawyers don’t have the contacts, or know-how, to even think about retrieving stolen data.” Swaminathan isn’t most lawyers. In fact, he almost wasn’t a lawyer at all. The New Jersey native studied biology as an undergraduate at Cornell University and then taught high school math, science, and comcomputer science for a couple of years before deciding to go to law school “kind of on a whim.” He knew he wanted to get a graduate degree but was only sure of one thing: he didn’t want to study medicine.

“My dad’s a doctor; all my dad’s friends are doctors,” he explains. “I went to the Boston University campus and picked up a coursebook because my girlfriend at the time was there. When I came to ‘Law,’ I read a bunch of the class descriptions and thought, ‘Wow, that seems really great.’ So, I decided to go to law school.” Nearly 20 years later, Swaminathan is a leading cybersecurity and data privacy lawyer, having first honed his skills in those areas as an Assistant US Attorney in Seattle. Although the topics weren’t covered explicitly at BU Law when Swaminathan was a student (the nation’s first security breach notification statute— in California—didn’t take effect until the year after he graduated), today the school
Tallman of the Ninth US Circuit Court of Appeals. But it was Swaminathan’s move to the Western District of Washington US Attorney’s Office that put him on track for a career in cyberlaw. After working on a few of the office’s digital crimes investigations and prosecutions, then US Attorney Jenny A. Durkan designated Swaminathan as one of the district’s Computer Hacking and Intellectual Property Section (CHIPS) prosecutors. “That’s kind of what kicked it off,” says Swaminathan, although he says he’s always been “into technology.” As a high school student, he took computer programming and learned how to code in “languages so old, most have never heard of them”—Fortran, Pascal, and COBOL.

THIS IDEA OF THE CONVERGENCE OF TECH AND LAW IS GOING TO BE AT THE CENTER OF WHERE THE LEGAL INDUSTRY IS GOING TO GROW.” offers a variety of courses and experiential learning opportunities in the field. Over the past few years, BU Law has launched a Technology & Cyberlaw Clinic in partnership with the Massachusetts Institute of Technology and an interdisciplinary Cyber Alliance of computer science experts, law professors, and social scientists designed to generate learning and research opportunities. In fall 2017, the school hired Associate Professor Ahmed Ghappour, a former computer engineer who is an expert in criminal law and computer security. Swaminathan applauds the school’s cybersecurity-related expansion. “You have to recognize that this is an area of the law that’s grown, and it’s here to stay,” he says. “This idea of the convergence of tech and law is going to be at the center of where the legal industry is going to grow.” Swaminathan’s own entry into the field came organically. After graduating from BU Law, he worked in law firms and spent a year clerking for Judge Richard C.
Swaminathan says the forensic techniques used in cyber cases—including how investigators leverage technology to “comb through computers to identify evidence”—appealed to him right away. Since leaving the government in 2013, he has continued in the field, first at DLA Piper and now at Orrick. Even though he’s no longer a prosecutor, Swaminathan says it’s overly simplistic to think of his current work as a traditional defense practice. “Most of our clients are the victims of a cybercrime,” he says. “As more and more plaintiffs and regulators begin to allege that companies should be liable for being negligent data custodians, they become defendants. But at the inception, they are victims.” Swaminathan says the technology behind his clients’ work continues to excite him. “Our entire practice is based around the idea that data is the new currency,” he says, adding that data is crucial not only for his traditional technology company
clients, like Microsoft, but also for entities that normally wouldn’t be associated with Big Data, like the city of Seattle. Orrick and Swaminathan represent the city in its Open Data Program, which makes municipal data available to the public for a variety of reasons, including improving transparency, encouraging initiatives that might improve quality of life, and creating economic opportunities. In every matter, Swaminathan says, “We’re trying to help our clients—how do you collect data, store it, and protect it from bad guys? As clients increasingly depend on data to drive innovation, we’re really at the center of their needs.” Because of his diverse career background, Swaminathan recommends students take a “broad variety” of classes

that interest them before zeroing in on the thing they love best. “The more you expose yourself to, the better off you’ll be,” he says. Swaminathan’s own time at BU Law was influential in a variety of ways. A criminal law and procedure course with Professor Tracey Maclin was especially “formative in thinking about what I wanted to do,” he says. “I’m still a bit of a Fourth and Fifth Amendment junkie, so Tracey has rubbed off on me permanently,” he jokes. And BU Law was important personally, too—a classmate and fellow moot court competitor introduced Swaminathan to her roommate (a Harvard Law student), who eventually became Swaminathan’s wife: Sarah C. Johnson, a partner at the Pacifica Law Group.
“I take full credit for their happy family,” jokes the classmate, Joanne M. Hepburn (’02), of counsel at K&L Gates. Hepburn says that, even as a student, Swaminathan demonstrated some of the talents that would later serve him well as a trial attorney. “He’s always been a very polished speaker,” she says. “He has that dynamic personality where he can really convey the information that he knows like the back of his hand to people who might not know it as well.” At Orrick, Swaminathan has been a “game changer,” says Kim. In addition to growing the practice internally—with a focus on women and minority attorneys (Swaminathan was named a 2018 Rainmaker by the Minority Corporate Counsel Association)—Kim says Swaminathan
has “tripled” the firm’s roster of public company cyber and privacy clients. “Aravind’s greatest value to clients is his ability to ‘see around corners,’” says Kim. “As a former prosecutor, trial lawyer, and tech-enthusiast, he has a special ability to anticipate how his clients’ defense narrative (both legal and technical) will play out before a regulator, a court, and/or in the press.” Howard S. Altarescu (Questrom’70, LAW’74), one of Swaminathan’s colleagues at Orrick and a fellow BU alum, agrees: “Aravind comes in with not only that litigator’s advocacy but, more importantly”—and somewhat ironically, given Swaminathan’s decision to skip medical school—“an analytical approach like a surgeon.” THE RECORD | Fall 2018

“IT’S GRATITUDE. IT’S SUPPORT. IT’S EXCITEMENT ABOUT ALL THE FANTASTIC THINGS THAT BU IS DOING NOW.” That’s Richard DeSanti (CAS’76, LAW’81), listing the reasons he and his wife, Susan DeSanti (LAW’81), recently pledged $125,000 to BU’s School of Law and College of Arts & Sciences. Of that gift, $62,500 will create the DeSanti Family Fund for the School of Law. The fund, which will support the priorities of the dean, honors the couple’s past relationship with BU Law and celebrates their enthusiasm for the school’s future. As the DeSantis reflect on the benefits of having attended BU Law, they find much to be grateful for—including meeting each other. Richard and Susan met as second-year students on the staff of the Boston University Law Review. But they didn’t have time then for social lives. “Richard and I were working much too hard in law school,” Susan recalls. “Richard, in particular, was spending 16-hour days
as editor-in-chief of Law Review, so dating was not something that was on our minds.” After graduation, though, both Richard and Susan moved to Washington, D.C. “I wanted to be in D.C. after graduation,” says Susan, “because I had always been interested in working for the federal government.” In the early 1980s, however, the federal government was downsizing, so she instead took a job in private practice and eventually went to the D.C. law firm Hogan & Hartson (now Hogan Lovells), where she discovered her talent for antitrust law, a subject she had enjoyed studying under BU Law Professor Joseph Brodley. Richard left his beloved Boston to move to D.C. for a one-year clerkship with Judge Spottswood W. Robinson III, the first black chief judge of the US Court of Appeals for the District of Columbia Circuit and a renowned civil rights attorney who helped

argue the landmark Brown v. Board of Education case in the US Supreme Court. When Richard’s clerkship ended, he accepted a position in the D.C. offices of Covington & Burling, largely because the job allowed him to stay close to Susan. In D.C., Richard and Susan found time for budding law careers and a growing relationship. They were married by Judge Robinson in 1984. The couple now credits BU for planting the seeds of their marriage and for providing the tools to build rewarding legal careers. “I got an excellent education at BU Law,” says Susan. “I’ve always felt that BU gave me the best foundation possible for being a lawyer.” After making partner at Hogan & Hartson, Susan decided it was time for a change of pace, and in 1991 she took a job at the Federal Trade Commission. “And then I got really fortunate,” she says. “In 1995, when Robert Pitofsky, who was a giant in the antitrust field, came in as chairman of the Federal Trade Commission, he decided that he wanted to have an agency-wide policy shop, and he chose me to head that up.” Susan loved her job as director of policy planning for the FTC. “I got to hold hearings on antitrust law, bringing all the brightest minds in to talk about various issues and write reports about them,” she says. In the early 2000s, when thousands of patents—many of them questionable and overlapping—were being issued for computer software and hardware, her office published a highly influential report with recommendations for bringing the patent system back into balance with competition policy. Meanwhile, Richard was building a career in environmental law, first in private practice and then in-house at Mobil Corporation, which became ExxonMobil, and then at Chevron. The work brought together the legal skills he learned at BU Law and the expertise he gained studying geography as an undergrad at BU’s College of Arts & Sciences (CAS). “In the geography program of that day,” he explains, “there was a significant focus on economic geography, which is how economic activity happens over the landscape and how the landscape and the economy interact. I found all of that fascinating.” Over the years, Richard also became interested in law management, and he has enjoyed the leadership and management aspects of running several law groups. “Lawyers are generally not known for being great managers,” Susan says, “but Richard really is a terrific manager.” It’s one of the first things she noticed about him, she says, when they were on Law Review together at BU. The DeSantis relocated to California in 2012, where Richard is currently chief environmental and safety counsel for Chevron and Susan is discovering the joys of retirement. Their gratitude to BU continues to grow as they watch their daughter, Elena, thrive as an undergraduate psychology

Both Richard and Susan say they were very impressed by the quality of the BU campus tour and freshman orientation sessions they attended with Elena. “It was so well done and thoughtful,” Richard says. “It really made me proud as an alum.” As they’ve reconnected with their alma mater as parents of a BU student and as members of reunion, advisory, and fundraising committees, the DeSantis say they’ve been thrilled to witness the University’s forward momentum. “Every time I attend a presentation about what’s going on at BU, I’m amazed and intrigued by everything that’s happening at the University,” Richard says. “There’s nobody at BU— either in the College of Arts & Sciences or at the law school— who’s just sitting still,” says Susan, adding that she was particularly impressed with Dean Emerita Maureen O’Rourke’s leadership at BU Law and the many new and practical programs she introduced. In making their recent gift to BU Law, the DeSantis took advantage of two corporate matching programs to multiply their generosity. Chevron, Richard’s current employer, matches educational gifts one to one, and ExxonMobil, where Richard is a retiree, matches his gifts at a ratio of three to one. CARB-X Draws $50 Million+ from Gates Foundation, UK Government
ASSISTS COMPANIES COMBATTING ANTIBIOTIC-RESISTANT BACTERIA.
n a sign of the growing recognition of the threat of antibiotic resistance, last spring the Bill & Melinda Gates Foundation and the UK government joined CARB-X (Combating Antibiotic-Resistant Bacteria Biopharmaceutical Accelerator), the BU Law–based publicprivate partnership launched two years ago to give financial, scientific, and business support to small companies focusing on drug-resistant bacteria. The Gates Foundation committed up to $25 million over three years to support scientific research to develop new vaccines, preventatives, and other antimicrobial products, particularly for health needs in low- and middle-income countries. The UK government, through its Global Antimicrobial Resistance Innovation Fund, contributed up to $27 million for similar work. CARB-X—overseen by executive director Kevin Outterson, a School of Law professor of law, the N. Neal Pike Scholar in Health & Disability Law, and an expert on pharmaceutical markets—is the world’s leading public-private partnership dedicated to the early development of innovative antibiotics, vaccines, and other products to fight the global threat of superbugs. The commitments bring to more than $500 million the total funding available to CARB-X for the development of products to protect people from superbug bacterial infections.

Her new responsibilities include developing and implementing initiatives and programs to provide faculty and staff with education and training that will assist them in offering an effective education for all students.
Mintz Levin, the EVA Center, and others to draft and file a bill to vacate criminal convictions for survivors of human trafficking. That advocacy was rewarded over the summer when Governor Charles Baker signed into law a landmark criminal justice reform bill that includes a cutting-edge provision to allow just that: survivors of human trafficking are now able to vacate certain criminal convictions related to their victimization. The position was created by Dean Angela Onwuachi-Willig to address some of the areas of need identified in the 2017 Campus Climate Survey, which assessed students’ experience of the School of Law as an open, inclusive, and dynamic learning community. In addition, Associate Dean Bridges will strategize with Dean OnwuachiWillig and others on the recruitment of faculty and staff from historically underrepresented and marginalized groups and other underrepresented groups. She will also develop strategies around how best to support such faculty to ensure their success in tenure and promotion and foster a greater sense of belonging within the BU Law community. “I believe that Associate Dean Bridges is an excellent pick for this position,” says Dean Onwuachi-Willig. “She has thought extensively about race, class, and gender in her scholarship, and is the author of two books that explore issues around race, class, and gender. Her third book, Critical Race Theory: A Primer, will be published in 2019 with Foundation Press.” n

The categorization of the Constitution as a fiduciary instrument has the potential to offer a collection of “background rules” for interpretation of the document. “Knowing what kind of document you’re reading tells you what to look for, what not to look for, what to expect, what not to expect, and how to deal with various kinds of ambiguities— how to fill in holes that are going to appear in any text,” Lawson says.

The authors reject a myriad of characterizations of the Constitution, including that of an “instruction manual,” which they had previously suggested in earlier works. “Some . . . descriptions are closer to the mark than others, but none accurately situates the Constitution within the universe of documents known to eighteenthcentury makers of legal instruments,” they write in the first chapter. According to Lawson and Seidman, the Constitution has the “form, function, and feel of an agency instrument,” with the attributes, duties, and limitations of the actors laid out much as one would expect to see in a fiduciary document. A Great Power of Attorney “takes an approach to understanding the US Constitution that would not have been startling or interesting 200 years ago but that has been lost,” Lawson says. This new (or very old, depending on how one looks at it) approach to the Constitution as a fiduciary document was largely inspired by the work of constitutional scholar Robert

Cooley Book Prize for “A Great Power of Attorney”: Understanding the Fiduciary Constitution (University Press of Kansas, 2017). Named for Hon. Thomas McIntyre Cooley, a noted legal scholar who served as chief justice of the Michigan Supreme Court as well as dean and professor at the University of Michigan School of Law, the award recognizes a book that “makes an important scholarly contribution to our understanding of the Constitution,” according to the announcement. In A Great Power of Attorney, Lawson and Seidman explore the ways in which the US Constitution functions as a legal text and argue that it should be understood as a fiduciary document. Using such a framework, they consider the Constitution’s grants of “limited powers to the national government” and explore the implications of interpreting those powers

New Practicums Enhance Experiential Opportunities
FACULTY, STUDENT, AND ALUMNI HONORS THE MASSACHUSETTS BAR ASSOCIATION
T
his fall, the School of Law launched two practicums that give students even more options for hands-on learning while in school. The Consumer Debt Practicum is a new clinical course that teaches trial practice skills and substantive consumer law through participation in the Fair Debt Clinic, which is hosted by the Volunteer Lawyers Project in the Central Division Small Claims Court at the Boston Municipal Court. Students are providing pro bono representation to low-income defendants on credit collection matters in negotiations and small-claims trials. An accompanying seminar covers substantive law, allows for case reviews, and engages students in mock trial simulations. The Sex Crimes Practicum offers students the
opportunity to work on a sex-crimes-related project— either litigation or policy oriented—as a supplement to the Sex Crimes Seminar taught by Lecturer Eric Tennen (’01). Students are assisting Tennen in casework related to his sex crimes practice, including gathering documents and preparing defenses in registration cases, assisting in research and drafting of appellate briefs, writing memos on novel and/or constitutional issues in pending cases, and more. Students may also work on research projects— for example, those involving sex crimes policy, such as an evaluation of state-level implementation of the Federal Sex Offender Registration and Notification Act, or an analysis of state policies related to sex offender community supervision. n

THE RISE OF THE WORKING-CLASS SHAREHOLDER: LABOR’S LAST BEST WEAPON
U
nearthing shareholder power and its significance for the 21st-century worker has been a career-long pursuit for Professor David H. Webber. His book, The Rise of the Working-Class Shareholder: Labor’s Last Best Weapon (Harvard University Press, 2018), synthesizes his research, practice, and experience uncovering the hidden strength of the modern laborer within the financial market. As a practicing attorney in New York, Webber noted that holders of workingclass pension funds were the only investors to stand up and sue in the face of fraud or other corporate misbehavior. Much of his early research focuses on how people with such pension funds
use their shareholder power to police the market when no one else is willing to do so. With an estimated $3 to 6 trillion in pension funds alone, laborers, Webber asserts, can use that substantial power in their own favor. By collectively pushing for better benefits and a stronger voice, they can use their shareholder power to enact change. “My book boils down to putting a spotlight on this invisible activism, that no one’s aware of, that’s so critically important,” he says.

LLM BANKING & FINANCIAL LAW PROGRAM DIRECTOR JAMES E. SCOTT TO RETIRE James E. Scott will retire from the School of Law this January, having led the LLM Banking & Financial Law Program since 2013. He was also an adjunct professor with the school before becoming director. Prior to joining BU Law, Scott worked for 40 years as a bank regulatory lawyer, first with the Federal Reserve and later at a group of global US banks. He held senior regulatory positions with Security Pacific, Bank of America, Bankers Trust, Citigroup, and Morgan Stanley.
Under Scott’s leadership, the LLM in Banking & Financial Law Program introduced a financial services fundamentals course to prepare students for future coursework, established a certificate in financial services compliance, and was ranked among the top 10 US programs for US Tax Law and Banking/Finance/Securities Law by the LLM Guide. BU Law congratulates Professor Scott on his retirement and thanks him for his years of service!

FUND SUPPORTS STUDENTS IN THE ENTREPRENEURSHIP, IP & CYBERLAW PROGRAM Tony Gomes (’96), senior vice president, general counsel, secretary, and chief legal compliance officer at Citrix, created the Matthew Z. Gomes Fellowship Fund at Boston University School of Law to support two summer fellowships with the Entrepreneurship, IP & Cyberlaw Program, which partners with MIT to offer legal services to student innovators. Established in memory of Gomes’ son, the fund was created to promote diversity and inclusion in the fields of technology, cyberlaw, and intellectual property law. By supporting students from communities and populations traditionally underrepresented in the technology space as they gain experience in law school, Gomes hopes these fellowships will help build a pipeline of talented young attorneys prepared to practice in the technology and intellectual property fields.

WELCOME, NEW FACULTY. SCOTT HIRST ASSOCIATE PROFESSOR OF LAW Scott Hirst joined BU Law in July to teach Corporations and Corporate Governance. His research seeks to explain phenomena in corporate law, securities regulation, and related areas, and to inform policy-making on these subjects. His work combines empirical methods and conceptual analyses from finance, accounting, and economics, with close attention to the institutional environment within which corporations and investors make decisions. Before joining BU Law, Hirst served as research director of the Harvard Law School Program on Institutional Investors and practiced for seven years in the mergers and acquisitions group of Shearman & Sterling LLP in New York. He received his SJD and LLM degrees from Harvard Law School, and his Bachelor of Laws and Bachelor of Commerce degrees from the University of Queensland in Brisbane, Australia.
PORTIA PEDRO ASSOCIATE PROFESSOR OF LAW Portia Pedro, a former public interest litigation fellow who also worked as a litigation associate at Debevoise & Plimpton LLP, has joined the BU Law faculty to teach civil procedure, remedies, and evidence. Her research explores the procedure of procedure— how procedure develops and what hinders or furthers procedural decision-making. Pedro teaches and writes about the processes that judges use to make procedural decisions and the ways in which judges use civil procedure to navigate the tensions between law and equity, standards and rules, finality and fairness, and governments and marginalized groups. This fall, Pedro was chosen to receive a BU Peter Paul Career Development Professorship, an annual award that includes funding to support the work of promising young academics. She clerked for Hon. Joseph A. Greenaway,

Nina Totenberg (COM’65, Hon.’11), American legal affairs correspondent for National Public Radio, delivered the Commencement speech, in which she urged graduates to keep an open mind and seek a range of experiences as they begin their careers. Following Totenberg’s address, LLM student Abd Gafur and JD student Kevin Smith delivered two exceptional speeches. Having received their degrees, the roughly 490 graduates joined their friends and families at a reception following the ceremony.

Reunion Weekend 2018. Alumni celebrated their homecoming at several events throughout Reunion Weekend 2018. After exploring the BU Law complex during an open house on Friday, June 8, the community honored the life of former Dean and Professor William Schwartz (DGE’52, LAW’55, GRS’60). That evening, graduates of the Class of 1968 enjoyed a special Golden Circle Dinner, while members of classes ending in ’3 and ’8 reconnected during their respective milestone-reunion parties. After revisiting the city on Duck Boats and tours of the Museum of Science, alumni gathered for the annual gala dinner and Silver Shingle Awards presentation, held Saturday night at the Four Seasons Hotel. The weekend culminated with a reception at Fenway Park, after which attendees watched the Red Sox take on the Chicago White Sox.

Hon. Thomas Brennan was honored for his service to the Lawrence District Court with an official portrait in the Fenton Judicial Center in Lawrence, Mass. David Hanrahan authored his second book, A Deadly Recollection.

Hon. Dean Pineles retired from his tenure as a Vermont trial judge and moved with his wife, Kristina, across the globe to the Republic of Georgia, where he volunteered as part of an American Bar Association team advising the Georgian Judiciary. After his assignment, they moved to Kosovo, where Dean served as a criminal court judge and Kristina taught business communications.

Michael R. Miller has served as general counsel of the Florida Association of Professional Employer Organizations since its inception. He has drafted or assisted in drafting all of Florida’s PEO/Employee Leasing legislation, much of which has become prototypical throughout the nation. Earlier this year, the organization hosted the Mike Miller Gala benefiting CureSearch for Children’s Cancer. The event raised more than $150,000 for children’s cancer research.

Richard Driansky passed away earlier this year at age 68. Richard started his career at the NLRB as a labor lawyer, and then worked in-house at RhônePoulenc Rorer (RPR), where he became vice president and general counsel. Richard caught the biotech bug at RPR and founded Octagen Corporation, which developed a hemophilia drug that was approved by the FDA. He is survived by his wife of 41 years, Robin Matlin (’77), his three children, Keira, Alexa, and Leila, and three grandchildren. Hannah-Beth Jackson, a state senator from California, received an honorary doctor of laws degree from Santa Barbara & Ventura Colleges of Law. Chad Lamar was sworn in as US attorney for the Northern District of Mississippi.

Philip Beck was named among the 2017 Lawdragon 500 Leading Lawyers in America, the publication’s annual list of the top names in the legal profession. Vincent Luizzi served as the interim chief diversity officer at Texas State University from January to May 2018.

She was the 2016–17 vice president for government relations of IEEE-USA, and was named counsel of record in IEEE-USA’s amicus curiae to the US Supreme Court in Oil States Services LLC v. Greene’s Energy Group LLC. She is also active with the Women’s Bar Association of Massachusetts and the Venture Café, which supports the global innovation community. rofessor Mark Pettit Jr., known to many as the “singing professor” for his playful renditions of classic and contemporary songs in his first-year Contracts class, passed away this summer after a long and hardfought battle with cancer. A dedicated member of the Boston University School of Law faculty since 1977, Professor Pettit taught thousands of students in the areas of contracts, evidence, consumer law, and professional responsibility. He twice served as associate dean for administration and annually chaired the admissions committee. Professor Pettit’s incomparable teaching style introduced props and law-themed parodies of Top 40 hits to entertain 1L students in his Contracts class. The idea grew out of a poem a former student wrote about a case under discussion. More poems followed, until a few years later a student brought in a song to be sung to the tune of The Brady Bunch. The practice continued from there, and many students and alumni recall fondly the Pettit classics, “Don’t Go Breakin’ My Nose,” “Breach It,” “Smoke Ballin’,” and “Statute of Frauds.” In a 2007 interview with NPR, Pettit said his “shtick” was “really about breaking the tension in class.” And that “his willingness to embarrass himself in front of students
encourages them to take more risks as well, and they participate more in class.” His methods paid off. He was a beloved professor who in 1993 was recognized with the Metcalf Award for Excellence in Teaching, the highest honor for faculty at Boston University. He received a Silver Shingle Award for Service to the School in 2001, and at this year’s Commencement ceremony, Dean Emerita Maureen O’Rourke and the BU Law community honored him with the Michael W. Melton Award for Excellence in Teaching. He also received awards from the dean for his service and teaching. Before joining the BU Law faculty, Pettit served as an associate at the New York City law firm of Cravath, Swaine & Moore and as a clinical fellow and staff attorney for the Mandel Legal Aid Clinic at the University of Chicago. He was a visiting professor at Harvard Law School in fall 1999 and spring 2001 and was appointed to the Massachusetts Supreme Judicial Court Advisory Committee on Massachusetts Evidence Law. “It is hard for me to find the words to express how much Professor Pettit meant to me and to the School of Law. I treasured his friendship and, like many of our faculty and students, considered him a role model,” Dean Emerita O’Rourke says. “As much as his humor and warmth inspired his colleagues and law students for decades, it is his goodness of heart that we will miss most. We are now in the final year of BU Law’s $100 million Building on Excellence Campaign and I am pleased to report our resounding success. I know Dean Emerita O’Rourke and President Brown would agree that the level of support from BU Law alumni, faculty, and friends to the law school’s first-ever campaign has been exceptional. We are most grateful that so many of you share our vision for the future of this outstanding institution. BU Law has reached this point in the campaign largely because of Dean Emerita O’Rourke’s extraordinary leadership, her perseverance, and her commitment to ensuring BU Law remains at the forefront of legal education. Though her 14-year tenure as dean has ended, her legacy can be seen in every facet of BU Law—from its state-of-the-art physical space and innovative curriculum to the quality of its students and the success of its recent graduates—and, fortunately, she will return to campus after her sabbatical to continue teaching. I am delighted to welcome our new dean, Dr. Angela Onwuachi-Willig, to the BU Law community and to witness a new era of growth at the school under her leadership. Dean Onwuachi-Willig brings to BU Law her own distinguished achievements and wealth of experience, which will no doubt energize our law school community as we close out the campaign and look toward the future. Plan Your Legacy. Legacy Planned gifts have an enormous and lasting impact on Boston University, creating a legacy for School of Law students that will last for generations. At the school, there are many options for planned giving, all of which allow alumni and friends to give ambitious, up-and-coming law students—and the distinguished faculty who teach them—a financial boost. To date, there are 1,112 BU alumni in the Claflin Society, which pays tribute to alumni and friends who have provided for the University in their estate plans or through the establishment of life income gifts.
