CITIES MAKE PAYMENTS TO STATE By Jerry Bernstein

he cities of Cerritos, Artesia and Hawaiian Gardens were notified by the state they had to make payment on money it says the cities owe related to the dissolution of their Redevelopment Agencies authorized by an act of the state legislature signed by the Governor on June 27. Cerritos City Manager Art Gallucci said the city received an e-mail [demand] on July 9 at 5 p.m. calling for a payment of $6 million by July 12 at 5 p.m. He said e-mail arrived just prior to the city council meeting but would not effect the budget because city had anticipated what the amount might be and was prepared for the hit. The city of Hawaiian Gardens had to pay $74,207. Artesia officials were in a meeting at press time and could not be reached. At the July 9 city council meeting, Cerritos Assistant City Manager Kathy Matsumoto gave a brief report on AB1484, the Redevelopment Budget Trailer Bill that was signed by the Governor on June 27. The 73 page document expanded the powers of the Department of Finance, empowering them to suspend the payment of sales taxes and property taxes to successor agencies if they do not make a payment of property taxes to other local taxing agencies by July 12. The $6 million allegedly will be paid to the local taxing agencies. Matsumoto said the bill also allows the Department to impose $10,000 a day in fines to the successor agencies. She said the League of California Cities has called the bill unconstitutional as sales taxes that are used at the local level and the reallocation of property taxes requires a 2/3 vote of the legislature which AB1484 did not receive.

Other Structure Burglary: An incident was reported on the 14000 block of Estero Rd. A tool box was stolen after the latch was pried off from a carport storage locker at the location. Vehicle Burglary: Six vehicle burglaries were reported last week. A vehicle’s door lock was punched in on the 16700 block of Trojan Way. Speaker boxes and an MP3 player were stolen. A window smash burglary was reported on the 12000 block of Santa Gertrudes Ave. A purse was stolen from the vehicle. A burglary occurred on the 14600 block of Mercado Ave. A car stereo, third row seat, and other items were taken. A window smash burglary was reported on the 13500 block of Dalmatian Ave. A laptop computer was stolen. Two separate incidents occurred on the 14200 block of Firestone Blvd. and the 14500 block of Artesia Blvd. Car stereos were stolen from both vehicles. Grand Theft: Two grand thefts were reported last week. A theft was reported on the 15200 block of Rosecrans Ave. A suspect was arrested in connection with the incident. July 2, 2012 - July 8, 2012 There were 27 Part I felony crimes investigated last week, up from 22 the week before. Vehicle burglaries increased, robberies remained the same, while residential and commercial burglaries along with vehicle thefts dropped. 281 calls for service were handled by patrol personnel, up from 263. The current 2012 weekly average in calls for service is 267 For the second consecutive week, there were no robberies reported. Residential burglaries were down from three to one last week. An open win-

dow was the point of entry in the lone case where a loss could not be initially determined. The 2012 weekly average in residential burglaries is now 4.3 Open windows equal easy access for the burglar. Don’t make anything easy on the criminal. Make sure that your residence is secured prior to leaving. Commercial burglaries were down from four to one last week. A closed business was targeted and a security camera was taken. The 2012 weekly average in “other structure”/commercial burglaries is 1.8. Vehicle burglaries increased from seven to nine. Six of the crimes last week occurred in high-volume commercial parking lots. Eight were SUVs. Purses, wallets, ID, cell phones, plumbing tools, cash, a garage remote control and a DMV disabled placard were taken. In addition to those items, third-row seats were removed from SUVs. The 2012 weekly average in vehicle burglaries is 7.6. Garage door remote control devices are of valuable use to a residential burglar. It is almost like giving the thief a key to your home. Think about locking it in the trunk if you must park outside, or take it with you. Vehicle thefts were down from five to four last week. Three of the cases were from lots. Two Hondas and two Toyotas were stolen. The new 2012 weekly average in vehicle thefts is now 3.4. ANY form of an anti-theft device is better than nothing at all. A wide range exists from simple steering wheel locks to global positioning satellite tracking (GPS). Steering wheel locking devices can cost as little as $30.00 and are a visual deterrent. Use of these devices tells the would-be thief to find an easier target.

Progress Reveals Herself on Artesia’s Thoroughfares

orty-five years ago, a man named Richard Salisbury won a contest put on by the City of Artesia, which at the time had ten years of incorporation under its belt. The contest Artesia Mayor was to give the city a JOHN LYON motto, and the words that Mr. Salisbury had chosen were, “Service builds tomorrow’s progress.” Since then, progress has been building and this year is no exception. Even despite economic hardships, we as a City are pulling out all the stops this year. For example, we recently were recognized for our efforts on Artesia Blvd. with the 2012 Compass Blueprint Award for Achievement in Livability by the Southern California Association of Governments (SCAG). This is impressive because SCAG represents plenty of cities, and to be recognized among so many cities means that

what we’ve done is truly remarkable. On Pioneer Blvd. today, we can witness some of the spirit that Mr. Salisbury must have envisioned for the new city. We can also see the obstacles that such spirits often must overcome. Wh ile the final piece of downtown Pioneer’s renewal was under way, the State’s Department of Finance decided on a technicality that it won’t let the City use the redevelopment money that was already set aside for the project. The DOF informed the Successor Agency to the Artesia Redevelopment Agency (or just “Successor Agency) that it rejected the three contracts which were involved with the project.

These plants will be drought resistant and help conserve water while also creating beautiful scenery. The plants will be watered through a drip and bubble irrigation system which will be operated by solar timers.

The previous quote is the words of Richard Nixon back in the days of the infamous Watergate crimes and cover-up that eventually forced Nixon from the White House. They were probably the words of Acting Mayor Bruce Barrows with regard to Barrows’ admitted battery of Cerritos resident Jay Gray. What did he do and when did he do it? The facts are plain; Bruce Barrows admits to committing battery upon Cerritos resident Jay Gray. Barrows’ own account of the incident to the Cerritos Sherriff’s Office states that Barrows initially profaned Gray, calling him an a**hole BEFORE Barrows says Gray responded “Your wife doesn’t think so” which then resulted in Barrows’ actions, in Barrows own words “I LOST CONTROL” resulting in a clear case of BATTERY; grabbing and pushing Gray in a threatening manner, indicating a threat of bodily harm. Gray withdrew pressing legal charges against Barrows in order to give Barrows the opportunity to do the right thing; apologize publicly, tell the truth and own up for his actions, instead Barrows has engaged himself and the City of Cerritos in a shameless cover-up. At a recent city council meeting from up on the dais, Barrows contradicted his own account by claiming that he was “Defending the honor of my wife” A cowardly and patently false obfuscation of what really happened.

Curiously, the Cerritos City Council went on the attack, cutting their print advertising from the Los Cerritos Community News after LCCN printed the Barrows story and demanded answers from the silent city council and city management. Why all of a sudden, after MILLIONS of lost revenue on the Performing Arts Center, is it necessary to cut PRINT advertising in LCCN? This is an obvious attempt at taking punitive measures against Publisher Brian Hews to silence the paper that exposed ousted L.A. County Tax Assessor Noguez under a corruption scandal. Will ‘Barrowsgate’ be the downfall of a Cerritos City Council that appears to be in collusion with Barrows to lie, deny and get by’? Losing Control in Public Office: Congressman Jesse Jackson Jr. is reportedly undergoing treatment for a “Mood Disorder” but his office only came forward with this revelation, months after he took a leave from his elected duties and under pressure from congressional colleagues. Unlike Barrows, Congressman Jackson, never assaulted a constituent but the stigma of mental illness was apparently too great to come forward in a forthright manner and admit his problem. Barrows has not only not been forthright he has devised a delusional version that contradicts his own testimony and that of eye witnesses. Barrows may in fact have a psychological problem and definitely has displayed out-of-control anger issues but his latent maniacal tendencies go unattended while Barrows drags the city of Cerritos deeper into his cover-up. OBITUARY Kathryn Ellen (Shryock) Joseph Kathryn was born to John and Maime Merritt on August 25, 1922, in Rapid City , South Dakota . She was the fourth of five children. After graduating from High School she moved to Washington , DC to work at the Pentagon. On August 31, 1946 she married Wallace Shryock. They had four children, Suzanne, Timothy, Bennett and Ross. Wally passed away in June, 1975. In 1989 she married Dick Joseph in La Mirada , California . Dick passed away in 2007. Only one more win was needed to be eligible for Nationals, and this game was against Corona. Corona took the lead, scoring 5 runs. La Mirada knew this was do or die right here; they had to win. Ostrowski, known power hitter, started things up with yet another triple. Garcia, Victoria Calcanas, and Ebonie Coleman both stepped up too, contributing to the 4 runs LM scored to catch up. Finally, it was 5-4, Corona in the lead, runners Mary Ramirez and Madelyn Falcetti on third and second, known as scoring position. Ryann Ippolito comes up to bat, steps up, and hits a grounder up the middle, bringing 2 runs home, ending the game, final score being 6-5, La Mirada. La Mirada ended up placing 9th in State Championships, meeting the criteria to go to Nationals in Fort Collins, Colorado. The girls have until the end of July to perfect their game, and most importantly, make their city proud. As this trip to Colorado brings pride to our city, it also brings a significant cost to our players and their families. Knight in a 3rd Floor Hearing Room at the Flower Street facility for the District Attorney’s Office. Sandi Gibbons, spokesperson for the Los Angeles County District Attorney’s Office would not comment on the specifics of the Barrows hearing on Monday afternoon. “We don’t comment about what takes place in Office Hearings,” Gibbons said. “We can say that normally in cases such as this, the suspect involved is usually mandated to a program such as community service work, or other programs such as anger management,” she said. “Hearings like this are to resolve disputes,” Gibbons said. runs coming in the seventh inning. Later in the day, Norwalk slammed the Vista Thrillseekers 11-2, a team that has had vast experience in the state tournament. Norwalk resumed action this past Sunday morning with a 4-3 victory over the San Fernando Valley Xplosion in a game that went into the international tiebreaker. The loss sent the Xplosion to the losers bracket where later in the day, the two teams hooked up again with Norwalk winning in convincing fashion, 13-1. The game was put away in the first inning as Norwalk scored five runs, then added four more runs in the second inning before the game was called in the fourth inning due to the mercy rule. For the past several months, the firstyear team has had to deal with a lot of adversity, beginning with starting two weeks later than the other all-star teams. But once the team got under way, it was looking as if it had been around for years. Norwalk advanced to the championship game of the North Torrance Tournament June 24 before falling to Paramount 9-4. “Last year, I felt confident because it was our second-year 16s and we already had that one year of experience,” Hernandez said. “We had a great pitching staff last year. This year, just knowing we were going to the state tournament with basically two pitchers-the [Madrigal] sisters, we were really nervous.” Hernandez added that lot of people were not too supportive of the NGSA adding an 18-U All-Star team. Hernan-

dez said his team had to practice at other sites while the other NGSA All-Star teams practiced at its home base at Los Alisos Middle School. “We weren’t really welcomed at first,” he stated. “I guess that was the thing that got us going. OP Welding Instructor Brent Tuttle and his SkillsUSA La Mirada High Welding Fabrication team of Jordan Asti, Ryan Cooper and Dakota Sun (SkillsUSA California State Officer) competed at the SkillsUSA 48th Annual National Leadership and Skills Conference in Kansas City, Missouri during the Week of Champions, June 20-27, 2012. They placed in the Top 10! They finished 7th out of 35 other high school welding fabrication teams from across the country. The welding fabrication competition consisted of two parts: a 100 question written test covering safety, and welding fabrication; and the hands-on portion. The following day, the fabrication team competed in their hands-on competition, a grueling schedule from 8am to 4pm. Since April, the team has spent approximately 30 hours designing a fire pit using Google Sketch-up, a free on-line design program. To prepare for Nationals, the team actually fabricated 3 fire pits as practice. Competitors Jordan, Ryan and Dakota participated in the orientation and passed the written exams for their specific competition. Artesia Survey Shows Residents Value City Services, Want More Local Control Over Funds

ccording to a recent community survey, residents of Artesia want to protect and maintain their local community services, placing a high degree of importance on protecting public safety services and street maintenance. Residents also indicated support for local revenue generation that would serve as a protected, reliable source of revenue for local needs that cannot be taken by the State. The survey was conducted March 14 through March 26 by opinion research firm Godbe Research with 183 residents across the community. The City commissioned the survey to evaluate the Artesia community’s views related to the City’s fiscal challenges, general City services, and attitudes toward potential local funding measures. Maintaining crime, drugs and gang prevention programs was the top priority at 73 percent, as was maintaining 9-1-1 police response times (72 percent) and maintaining neighborhood police patrols (69 percent). Fixing potholes and maintaining and repairing neighborhood streets and roads both scored 70 percent. 69 percent of Artesia residents also valued and want-

ed to maintain the City’s efforts to remove blight by preventing dumping and discarding of waste, debris, furnishings and appliances on public streets. “With Artesia facing so many difficult budget decisions due to State takeaways and declined revenue, it was important to have community feedback on what our service priorities must be,” stated City Manager Maria Dadian. “It is clear from the survey that we must find ways to enhance local control over revenue sources in order to maintain current levels of public safety and police services, including neighborhood patrols, and crime and gang prevention programs.” The City Council received the results of the community survey at the City Council meeting on Monday, May 14. Artesia participates in America in Bloom This year, Artesia is participating in the America in Bloom program, which is a national program that judges cities based on their floral displays, landscaped areas, urban forestry, environmental efforts, heritage preservation, and the overall impression left on the judges.

The judges were here on the weekend of July 5th. Evelyn Alemanni, one of the America in Bloom judges, said she was amazed by the amount of work Artesia has done toward greening its community, and found especially moving the partnerships between the City, local volunteer organizations like Artesia in Action, and with the school district. The judges were also very impressed by the nature gardens at Niemes Elementary. Participation in the America in Bloom program benefits the community because it gives Artesia a chance to document everything that it has done over the last few years to make a more verdant city. In return, America in Bloom judges provide a report to the community, with suggestions on how it can improve. “We’re a built up urban community,” said Mayor John P. Lyon, “but we’ve done a lot that we can be proud of and showcase. I think we’re ready for this program.” The City last participated in 2008, and since then the community has developed enough “green” projects, and has come to understand just what needs to be done in order to do well in the America in Bloom

Failure to properly execute the Proposal Cost Schedule/ Non-Collusion Affidavit will render the proposal non-responsive and the proposal will not be accepted. The work or improvement to be performed consists of providing all labor, services, tools, equipment, materials, appurtenances and incidentals necessary for performing miscellaneous annual plumbing maintenance for the City of Cerritos. Typical tasks completed under past contracts include; clearing laterals and drain lines, replacing plumbing fixtures and lines, minor repairs, conducting video inspections and other similar tasks (the “Work”). Contractor shall have a minimum of five (5) years experience performing similar tasks. The City intends to retain the services of the two lowest responsive and responsible contractors through the term of the contract to be utilized at City’s sole discretion for the performance of specific plumbing maintenance tasks as may arise. During the Term, City reserves the right to solicit cost proposals from any or all retained contractors for work tasks as they arise, and assign work to one of the retained contractors based on cost proposal received, availability of resources, experience with completing a particular type of work and other relevant factors. The City’s final selection criteria for award of contract will be based on, but not limited to the following analysis:

• City’s evaluation of the Contractor’s Qualification Statement, Experience in a Plumbing Maintenance Service Questionnaire and proof of State Contractor’s License. • Commitment by contractor to supply necessary services and equipment to fulfill the contract specifications, experience with completing a particular type of work and other relevant factors. • Availability of resources. • The best economic value of the proposal. • Contractor’s ability to provide the required insurance certificate(s) and satisfactory references.

No proposal will be accepted from a contractor who has not been licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professions Code of the State of California. The contractor must possess a license of the following classification at the time the contract is awarded: "C36". The contractor’s attention is also directed to Section 7028-15 of the Business and Professions Code. The contractor agrees to indemnify, defend and hold harmless the City, its officers, officials, employees and volunteers from and against any and all claims, losses, liabilities, damages, costs of expenses, of whatever character, type or description, including attorney’s fees and costs, in law or equity, arising from, by reason of or resulting from damages to property or personal injury, including death, as a result of or arising out of, in whole or part, of the performance of any and all obligations and/or work on the project by contractor, any of the contractor’s employees or agents, or any of its subcontractors. This indemnity and hold harmless shall be construed to the fullest extent allowable under the law, except that if any such liability is determined by agreement between the parties or by the findings of a court of competent jurisdiction to have been caused by the active negligence or willful misconduct of the City, the contractor shall not be required to indemnify and hold harmless the City for the percentage of liability attributable to the City’s active negligence or willful misconduct. Before a contract is entered into with the successful contractor, the contractor shall present evidence in writing to the City of Cerritos that he or she has current public liability and property damage insurance from a responsible insurance company authorized to do business in California that is acceptable to the City of Cerritos of at least the following amounts: Bodily injury and property damage - Combined single limits in the amount of $1,000,000. NOTE: The insurance policy must include a special endorsement to policy that provides:

1. The City, its officers, officials, employees, agents and volunteers are included as additional insureds but only insofar as operations under the contract are concerned. 2. The insurer shall not cancel or reduce the insured's coverage without first providing (30) thirty days advance written notice to the City of Cerritos. 3. The City of Cerritos will not be responsible for premiums or assessments on the policy.

The Insurer shall furnish the City of Cerritos a certified copy of the policy within five (5) days of the City requesting a copy. The successful contractor shall maintain during the life of the contract the above specified insurance with the above-referenced special endorsement. Pursuant to the provisions of Section 1776, et al. of the Labor Code of the State of California, the Director of Industrial Relations for the State of California has determined the general prevailing rate of wages and employer payments for health and welfare, vacations, pensions and similar purposes applicable to the work to be done.
