Putting the fast-paced corporate world behind him, he now lives in Madison. He has a BS in Computer Science from Rutgers University.

professional at LifeScape, where he helps provide support for people with disabilities in a group home setting. He is currently finishing a degree in Journalism and Mass Communications at South Dakota State University. His pursuit for a degree has landed him here at BizNOW where’s he involved in writing and design work. Whether you’re deciding where to meet for lunch or you’re negotiating a million dollar deal-of-a-lifetime, life is all about negotiations. And much like a chess match, you’ve got to have the right strategy to win the game. Biz has taken a look at the top 5 negotiating mistakes people most commonly make, and we reveal them here for YOU to avoid: 1. Believing something is non-negotiable: Everything

is negotiable. It may not always seem like it, but any rules can be changed. It just takes the right mind-set. Plus, if you never ask, you will never know.

Improve the likelihood of getting what you want by being prepared. This will convey confidence and show the other individuals involved that you know what you are doing/ what you are talking about. Never walk into a negotiation without doing some research first.

4. D oing all the talking: The best way to display

confidence and show you are an expert negotiator is to ask for what you want firmly. Once you ask for something, be QUIET and WAIT for the answer. It’s uncomfortable to wait through the silence, but it’s worth it. We have a

LOFTS: LUXURY LIVING DOWNTOWN

Is it for You?

Lofts are a hot commodity across the U.S. and are reaching Sioux Falls as the downtown area has been rejuvenated with restaurants, shopping, coffee shops, and the nightlife scene. Loft spaces became popular in America in the 20th century. They began as storage warehouses in New York and Boston. As businesses went under during the Great Depression, many warehouses were abandoned, and starving artists began converting these empty warehouses into loft apartments in the 1940s. In the 1970s, investors got into the act. They saw the opportunity for these beautiful, open spaces to become highend luxury living quarters, and began renovating them from commercial to residential spaces. During the 1980s, lofts became popular with Yuppies and spread from the big city to smaller cities around the nation.

Boyce Greeley: 11th Street & Phillips, lofts range from $1,200 to $2,400 per month in rent. The building has a central elevator and storage. Phillips Avenue Lofts: 601 North Phillips Ave. with 1 & 2 bedroom apartments from $825 to $2,926 in rent. Luxury lofts feature fireplaces, laundry, grand tile showers, walk-in closets, a fitness center, elevators, patios.

BIZ Real Estate Lofts aren't your typical living space, though. They are very different from your average apartment or condo. Whereas your typical apartment usually has 8 to 10 feet ceilings, lofts feature high ceilings (10 to 14 feet) and are known to have exposed duct work and patios. While some lofts are located in brand-new buildings downtown, others offer an old, historical building feel with their rich history, charm, character, and aesthetics.

Falls River Greenway, concerts, events (First Friday's, Moonlight Movies), restaurants (such as CH Patisserie, Falls Overlook Cafe, Minerva's, JL Beers, Phillips Avenue Diner), coffee shops (Coffea Roasterie), bars (Crawford's Bar and Grill, Icon Bar and Lounge), and shopping (Ten Thousand Villages, Zandbroz Variety). Lofts offer people of all ages an opportunity to live downtown and walk to their favorite places.

Rick Gourley of Gourley Properties was one of the first to convert buildings into market rate lofts in Sioux Falls. Lloyd Properties contributions began in the 1980's when they worked on the River Tower Apartments and continued renovating from Main Street to Phillips. Many of the lofts offer excellent views of the city, Falls Park, or quiet urban spaces.

If renting a loft sparks your interest, jump on it, because according to local realtors, people are snatching them up!

While some lofts can be owned, most can only be rented in downtown Sioux Falls such as Bonton Lofts, Boyce Greeley, Crane Centre, Dakota Lofts, Harvester Building, Rehfeld's Lofts, and the Frank Building which provides Sioux Falls with a variety of choices, sizes and amenities. Downtown Sioux Falls is becoming more enticing all the time as a family-friendly place to enjoy with bike trails, parks, the Sioux

BUYING OFFICE SPACE?

WHAT YOU NEED TO KNOW ABOUT COMMERCIAL LENDING As a business owner you may be thinking about buying your own brick and mortar location. How different is it from purchasing a home? Property is property but the entity changes along with loan type and term, insurance needs and risks. For example, if your business is listed as an LLC or a Corp you do not have to qualify solely using the resources of the business. Projected business income will be utilized in the loan approval process considering the business income will repay the new property debt. Every bank has different underwriting standards but if business income is inconsistent then personal income will be heavily relied upon for the approval. In fact, anyone owning over 20% of the business will most likely be a guarantor on the loan. Therefore, personal finances and credit can play a major role in deciding whether or not the bank will approve your loan. Terms will vary from bank to bank but typically the loan-to-value ratio on the property needs to be 70/30, meaning 30% equity in the property. The loan repayment would be based on a 20 year re-payment period with a 5 year balloon payment or an interest rate adjustment after a predetermined period. Most commercial real estate loans, depending on the size, will typically be kept in house whereas home mortgages tend to get bundled and sold on the secondary market. Homebuyers are sometimes confused by this switch which has no impact on the loan, just where the payment is sent for servicing. Also, this is why you can get a 30 year fixed rate for a home mortgage and only a 5 to 10 year rate on a commercial loan. u

WORK MAY NOT BE A JOKE A humorous story or experience can give your business new ideas and inspiration, or even help sell a product. So look for the funny things in life.

BUT A LITTLE LAUGHTER NEVER HURTS!

With the average American spending over 1800 hours a year at work, there are inevitably some stressful days.

Even slow days can drain you, as each hour slowly ticks by and you think of all the chores on your personal “to do� list. Those hours can actually be detrimental to your health, so learn how to incorporate humor not only in your personal life, but in your workplace as well to create a happier, healthier environment. 12 | BizNOWmagazine.com | August 2014

Although humor is individual, it is also cultural. What Americans think of as funny may make no sense to someone from another culture. Humor in advertising is a very effective technique; make them laugh and they will not only remember the ad, but they will tell their friends, multiplying the effect of the ad. For example, Geico uses a variety of humorous ads to sell insurance - the little green Gecko lizard, camels on "hump" day, a pig, and even Old McDonald at a spelling bee. Most of us have seen these commercials, and maybe even laughed at them. But when is it appropriate to use humor within the workplace? And how do you do it?


Smart BIZ Let’s start with the Don’ts. • Do not walk in the f irst day and start cracking jokes. You must prove your professionalism and abilities before using humor or you will be tagged a prankster and not taken seriously when it matters.

• When a serious matter is being discussed, avoid humor. The boss needs a solution, not a joke. It is also an indication that you have no clue what is going on.

• Avoid sarcasm and be cautious with religion, politics, or sexually charged comments. What is funny to one person can be insulting to another.

• Never pick on an individual. If you have to pick on someone (or culture or nationality), pick on yourself.

A humorous one liner or short joke is always appreciated when presenting at conferences. It gets the audience’s attention, builds a connection, and then they are ready to listen. For example, international minister Joel Osteen starts every sermon with a joke. No one wants to be late to his sermons; they’d miss the great joke at the beginning! In the same way, if you’re known for starting off every meeting with a funny joke, you can almost guarantee people will want to be on time!

Most importantly, laughter in the workplace can not only motivate employees, but it will also reduce stress, enhance communication and provide employees with a heightened sense of teamwork. According to the University of Pennsylvania's Behavioral Health Corporate Services, laughter increases the immune system, eases muscle tension and provides relaxation - providing very real health benefits.

• If you start with "I hope this doesn't offend anyone," don't say it. It’s offensive. • If you wouldn't tell it to your grandmother or Pastor, don’t say it. If you are not good at telling a joke, post jokes or funny stories on your office door or in the break room. Perhaps a funny anecdote or picture that reflects your workplace or shows your lighter side. Posted humor can also break the ice and open the door to a new friendship.

Having fun is now formally recognized in many innovative companies because it enhances morale and builds team synergies. Wild Tie Tuesday or

Monthly Hat Day can be both professional and bring a sense of fun into the workplace. Try starting your weekly team meeting with a funny story or picture. Red Bull of London creates fun spaces to work – they have a rooftop outdoor patio workspace and even have a slide to get from floor to floor.

While the short-term effects of laughter enhance your intake of oxygen-rich air, and stimulate circulation, the longterm effects will not only improve your immune system, but relieve pain, increase personal satisfaction, and improve your mood, according to the Mayo Clinic. So what’s not to love about laughter? And to get you started, here’s a joke we like at BizNOW:

I know a person who refused to attend a meeting simply because it was held at the office of a competitor who had once done them wrong. The meeting was an open forum for discussion, networking, and perhaps forging friendships that could be mutually beneficial on a personal and business level. It could have resulted in a lot of new business for the person. However, the person adamantly refused to attend because of their past bad experience with the competitor. I do not know the circumstances of what transpired or even if the competitor is aware of this person’s feelings. Maybe it was a devastating incident or just a petty misfortune.

What's a typical day for you? I meet and talk with

multiple clients each day to discuss the work they need completed. I spend much of my time negotiating and drafting contracts for business, real estate, and loan transactions.

What are the common situations where a business owner should have a contract? Businesses

often need leases, employment agreements, and sales contracts. A good contract details each party’s rights and obligations in clear and concise words.

If I have a great idea and want to sell it to a business, what do I need to know? Before sharing a

new idea, process, or design with a third party, you should consider protecting the intellectual property rights associated with it. Many times disclosures of new ideas and designs are only made after the creator enters into a confidentiality agreement with the other party.

If I want to develop my idea into a product, how can I protect my idea or product? It depends on the

nature of the idea or product and your goals, time frames and resources. Patent, trademark and copyright each apply to specific circumstances and provide certain protections.

How complicated are these processes? While a

confidentiality agreement can be utilized almost immediately, it can take months to register a copyright or trademark, and more than a year for a patent application to be reviewed and the patent issued. Counsel can help you identify which types or combinations of protections would be best for your situation. Each type of protection has its own rules and advantages related to the timing of your application. For example, patents utilize a first to file priority and a patent must be filed within one year of the first public disclosure.

generally describes the legal rights in what is developed by a person’s mind. A patent is a government granted exclusive right to prevent others from making using, or selling an invention for a specific term. Patents have been issued for prescription drug formulas and windshield wiper blade designs. A trademark is a recognized name or symbol that identifies who makes or distributes the product. Commonly recognized trademarks include the Nike swoosh and name Coca-Cola. Copyright is a government granted exclusive right to use an original work of authorship for a specific term. Copyrightable items include books, movies, painting and music scores.

What are the pros and cons of hiring family members? Direct or extended family members may be willing to sacrifice more for the business due to a strong sense of commitment to the family. If you are already familiar with the person’s strengths and capabilities, you

can more accurately assign their various tasks. Hiring a family member to help run your business may help you ensure the business will continue for future generations and you should have a good succession plan in place in the event you want to retire or sell the business in the future. The disadvantages of hiring family members can include the family member expecting to receive special attention, such as in workload, management, or compensation. Personal family issues could be brought to the workplace and effect performance. A written contract addressing his or her duties, expectations, responsibilities, and compensation should be in place for each family member, just as you would for any other employee.

What do you like best about your job? I am a

litigator and I like to try cases. I consider it a great honor to be able to represent my clients to the best of my ability before a jury of their peers.

Can you describe a typical trial day? I will likely

spend 8 or 9 hours in the courtroom and it usually involves additional preparation that evening for the next day, such as drafting a closing argument, witness cross-examination, or preparation of jury instructions.

Tell me about being a powerful woman in a traditionally male f ield. That might be the perception but as I look around at my colleagues I see more and more women as my partners and adversaries. u

WHY A SELF-DIRECTED IRA MAY BE BEST FOR YOU There are a handful of firms that will truly allow you to manage your own retirement funds. The IRS has a broad set of rules and regulations that govern self-directed retirement funds within an IRA commonly called a SDIRA. The IRA can be a Roth or Traditional. In a SDIRA, you can buy stocks, bonds, indexed or mutual funds, precious metals and minerals and some collectables such as rare coins, stamps and art. You can also purchase real estate, office buildings, malls and hotels. But there is a catch, always a catch. You or your direct vertical heirs cannot benefit from any of the assets in the IRA while you are not retired. What is a vertical heir? One in direct line to inherit your estate should you pass before retiring. This includes your parents as well as spouse, children, grandchildren, etc., but it does not include your siblings, aunts, uncles and cousins unless they are specifically identified as an heir. This is an important distinction when it comes to selecting a trustee for any of the assets in your SDIRA. Another catch is that you or your heirs cannot do anything to maintain the assets in the SDIRA that will provide a direct benefit to you or them pre-retirement. For example, if you buy

a rare piece of art, it must be kept in such a way that you cannot derive any pleasure from it, like in a vault that is managed by your trustee or on display where you can never see it until you retire. In the case of real estate, you must have an independent trustee, one who can oversee the property, ensure rents are collected, and taxes paid. You or your heirs cannot derive any direct benefit from the real estate; you cannot live in it, paint it, and mow the lawn or anything that aids its value. These tasks must be done by an independent. The nice thing about a rental in a Roth IRA, is that the rents can be used to pay the mortgage or accumulate tax free. Then one day you can withdraw the home from your IRA as a distribution and use it as your retirement home after someone else bought it for you. Brokerage firms that sponsor a SDIRA will probably limit your acquisitions to instruments they can buy/sell (with your direction) and collect a commission, otherwise there is nothing in it for them. The non-brokerage firms that allow you to acquire real state and collectables per IRS rules will simply charge annual fees or transaction fees based on the value of the asset being procured. They are also linked to a brokerage house so you can still buy stocks and bonds and other monetary instruments. u

Are you overworked? Anxious? Pushing yourself too hard? Studies have shown that there is a link between stress and heart disease, and that can lead to a heart attack. When you’re overworked and feeling stressed, your blood pressure increases, you may skip exercise, eat more or start smoking. It is important to know the warning signs of a heart attack so you can take action.

5 Warning signs of a heart attack: Chest Discomfort

The most common symptom of a heart attack is pain or pressure in the center or slightly to the left in the chest. This can come on slowly OR suddenly and it isn’t always intense. If you are experiencing chest pain, consult your doctor immediately or call 9-1-1. Remember, minutes can make a big difference.

Shortness of breath

Another common symptom of a heart attack is shortness of breath, which is usually accompanied with chest pain or other symptoms. Shortness of breath can occur even without chest pain and should be taken seriously.

Upper Body Discomfort

Discomfort can stem from a lot of different places; commonly the jaw, arms, back, stomach, and neck. Often, pain will begin in the chest and spread to other areas. If you’re experiencing pain in your upper body along with chest pain, it’s time to see a doctor.

Dizziness or Lightheadedness

Dizziness or lightheadedness occurs because of a drop in blood pressure or blood flow to the brain (Source: WebMD). This is a telltale sign that a heart attack is present when accompanied with chest pain. The dizziness can be mild or more severe, which can lead to fainting.

Fatigue

It’s common for people to feel a bit fatigued on any given day, but unusual or sudden fatigue may be your heart telling you that something is wrong. This symptom is probably the most overlooked symptom, because many people experience the usual fatigue that comes with that everyday grind. If you notice that you are experiencing a lack of energy for no apparent reason, it could be a sign of a heart attack.
