From the

Director of Publications WELCOME TO THE ANNUAL EDITION of Indiana's Best Lawyers, featuring the 845 lawyers who have been selected by their peers to be included in The Best Lawyers in America for 2015 in Indiana. In this focused yet comprehensive guide you will find top lawyers from 211 firms practicing in 107 key areas of specialization. Our aim is to provide you with a shortlist—fewer than three percent of the region’s registered attorneys, in fact—of highly qualified, vetted lawyers in your area of residence. To refine your search and to find out more, we encourage you to visit BestLawyers. com/Indiana, our dedicated site for the attorneys listed here, where you can view detailed contact information, in-depth practice area definitions, allnew firm and attorney profiles, office location maps, client testimonials, and more.

We congratulate all who have earned a place in this year’s guide and offer special recognition to the 43 lawyers selected for the first time by highlighting their names in green throughout the publication. In addition, we are thrilled to announce the 84 recipients of the “Lawyer of the Year” award. Only one lawyer per practice area per

metropolitan zone is granted this distinction, based on the highest peer ratings received. Go to page 13 to see the full list.

This year, we have reorganized the listings by city so that no matter where you are, from Anderson to Warsaw, you will find the right attorney to resolve your personal or professional matter. On the move? Simply scan the QR code on page 3 with your smartphone and take Indiana's Best Lawyers with you, wherever you go: each lawyer with a profile on BestLawyers.com is hyperlinked and highlighted in blue within this publication, truly putting the power to make an informed decision at your fingertips. Because it’s inevitable—at some point in your life, you’re going to need a lawyer, and you won’t always be able to predict when that need will arise. The lawyers listed in this guide are here to help.

Meredith Hinshaw-Chaney Director of Publications mhinshaw@bestlawyers.com

About Us Best Lawyers is the oldest and most respected peer-review publication in the legal profession. A listing in Best Lawyers is widely regarded by both clients and legal professionals as a significant honor, conferred on a lawyer by his or her peers. For more than three decades, Best Lawyers lists have earned the respect of the profession, the media, and the public, as the most reliable, unbiased source of legal referrals anywhere. Our lists of outstanding attorneys are compiled by conducting exhaustive peer-review surveys in which tens of thousands of leading lawyers confidentially evaluate their professional peers. If the votes for an attorney are positive enough for inclusion in Best Lawyers, that attorney must maintain those votes in subsequent polls to remain on the list for each edition. Lawyers are not permitted to pay any fee to participate in or be included on our lists. Best Lawyers' peer-reviewed listings are now published in almost 70 countries around the world, and our presence has grown substantially in the international legal community. The twenty-first edition of The Best Lawyers in America (2015) includes 52,488 attorneys in 137 practice areas, covering all 50 states and the District of Columbia, and inclusion in this year’s publication is based on more than 5.5 million detailed evaluations of lawyers by other lawyers. The Best Lawyers Board of Advisors includes legal luminaries from almost every major world economy as well as general counsel from global companies with business on every continent. This very distinguished group of professionals contributes to our knowledge of an ever-changing legal marketplace to ensure that all of our initiatives are responsive to both the concerns of the legal profession and the needs of clients. “All they wanted was to say, ‘Will my partner and my family be taken care of if I don’t come home that day?’ ”

COVER STORY

No One Stands Alone

–Kathleen Sweeney

Kathleen Sweeney tackles civil rights and criminal defense— with a team approach

athleen Sweeney says that each career choice she’s made has been in pursuit of doing something meaningful. From being a state and federal prosecutor to training public defenders to founding her own private law firm, Sweeney has chosen to do things that would be important not only to herself as an attorney, but to the clients she has helped. “Choosing things that are meaningful, I think, has made me a better lawyer,” she says. Sweeney began her career as a prosecutor, serving as Assistant United States Attorney in whitecollar prosecution for the Southern District of Indiana, and many of her cases involved sex crimes and child abuse. In 2001, she decided to start her own private civil rights practice because she “wanted to be in touch more with the people who were being accused or deprived.” Sweeney said she has always been one to root for the underdog. The Sweeney Hayes firm, founded in 2014, also includes Kathleen’s partner, Charles Hayes, whom she met while serving as the Director of Training at

the Marion County Public Defender Agency. Sweeney says one thing that makes their firm unique is that she and Hayes take on every case as a team effort. One of them takes the lead on each case, but they’re both very much involved and invested in every client. “One of our firm sayings is ‘No one stands alone,’ ” she says, and that doesn’t just apply to the attorneys. “We really want to make sure we’re in touch with the entire family. It’s not just one person who has been impacted by what led up to the lawsuit and the lawsuit itself…. We keep everyone up to date.” Sweeney Hayes often takes on police misconduct and wrongful prosecution cases, as well as fair wages cases, among other civil rights issues. A case Sweeney is particularly proud of is Mueller v. State, in which she successfully argued that Indiana’s policy for diversion (which required defendants to pay a fee to have charges dismissed) violated the Equal Protection Clause of the 14th Amendment. Sweeney said her argument was initially laughed at, but eventually, the judge came

around and ruled the policy was unconstitutional. Now, if defendants can’t pay the fee, they can do community service to get charges dismissed. Another case that Sweeney is proud to have been part of is Lee v. Pence, which brought marriage equality to Indiana last year. Sweeney was part of a group of lawyers that represented several first-responder same-sex couples in their fight to achieve the same legal benefits as heterosexual married couples. “They are courageous every day, and all they wanted was to say, ‘Will my partner and my family be taken care of if I don’t come home that day?’ ” Sweeney says. Sweeney says it has been meaningful to her to devote so many years of her legal career to helping people who were lacking rights, but her clients don’t always realize how much effort and how many steps it has taken for her to accomplish their goal. “When a client says thank you, that’s really very rewarding,” Sweeney says. “That is why I do it. We were there as a team and we made it.” www.bestlawyers.com

Ready & Willing Hovde Dassow + Deets doesn’t back down from well-funded opponents by Johanna Marmon Left to right: Rob Dassow, Nick Deets, Rick Hovde,Boyd Hovde

B

oyd Hovde, Rick Hovde, Rob Dassow, and Nick Deets are used to handling complicated and difficult cases where the odds are stacked against them. That is simply the nature of catastrophic personal injury litigation. Their track record of success in state, federal, and appellate courts throughout the country stands as the ultimate proof that their firm is willing to take cases to trial. They’ve tried more than 300 cases to verdict over their collective 110 years in practice, winning numerous milliondollar and multimillion-dollar verdicts and settlements. “Approaching every case as if it is going to end up at trial is one of the cornerstones that Boyd and Rick have established at our firm—it is deeply ingrained in how we approach every case,” says Deets, a partner in the firm. “We firmly believe that if you’re not prepared to take the case to trial, then you should not agree to undertake representation.” For Deets and his partners, being prepared means digging deep and spending the time—and money—that each case demands. “Some firms bring in plaintiff cases and then settle them for much less than their true value because they’re simply not willing to spend the time and money and take the risk necessary to go to trial,” he says. “When Boyd and Rick started this firm, they wanted it to be the exact opposite of that, and it’s at the heart of how we approach every case.” Says Boyd Hovde, “I learned early on in my career that the only way to get the respect of your opponent is if you’re prepared to go to trial. Insurance companies, large corporations, and the lawyers who defend them know who is willing to go to trial and who isn’t. If you can’t back up your position with performance, you aren’t going to get the best settlement that the defense is willing

to make.” Even so, says Hovde, a storied Lawyers six times since 2009 and as trial lawyer with close to 55 years of Trial Lawyers of the Year by the Indiana practice under his belt, there’s no magic Trial Lawyers Association in 2010. It has in what he and the attorneys at his firm two of the five Indiana members of the do. “We are just willing to work hard and International Academy of Trial Lawyers and spend the time and money to go to trial three of the 94 Indiana members of the if necessary and it pays dividends for our American College of Trial Lawyers. He wasn’t expecting the first immigrationrelated case he took, and when he began, he didn’t quite know what he was doing. But Lewis & Kappes’ Steven Tuchman has made a name for himself in the field of immigration law, in a region of the country that’s experiencing a noticeable increase in number of foreign-born citizens. “By the time I was done, I was a self-anointed expert,” Tuchman laughingly says of that first case. And that early, in-the-trenches experience has allowed him, as Indiana’s immigration law field has grown, to aid and train many of his colleagues in what is now perhaps Indiana’s largest immigration practice. Tuchman was initially focused on real estate law and was one of the first in-house lawyers at what is now Simon Property Group. After several years of intense work there, Tuchman decided real estate law was not what he wanted to do with the rest of his life, and he established a private practice, one that shortly began specializing in immigration law. Compared to those of states more known for immigration issues, like Texas or California, Tuchman says Indiana’s Department of Homeland Security personnel is generally nice and not “so jaded by years of horrible cases.” That’s not to say there isn’t a need for the work Tuchman does in the Indianapolis region. Burgeoning biotechnology and university sectors and a temperate climate for agricultural work are among the reasons the area is growing and drawing newcomers, many foreignborn and some here illegally, Tuchman says. “There’s not a week that goes by that somebody doesn’t call from businesses around the region,” Tuchman says. “It’s the CEO on the line and he says, ‘I just found out that my most valuable employee is not here legally. What can I do?’ He asks in a panic. Or, he’s [looking] for the best and the brightest, and the winning candidate is from abroad.... That’s where I come in.” Tuchman says he can relate somewhat to the feeling of being a so-called foreigner. He lived in Copenhagen for a couple years after law school and has maintained a relationship with the country: He serves as the Danish Consul for the lower Midwest and was recently knighted by the Danish Queen. “I have an intense interest in helping my clients,” he says. “We know these people essentially come to us with their lives in their hands, and they end up in our hands. One great reason I’m still working is that at the end of the day, there is someone who says thank you. It’s very rewarding.” By Maggie Burch

For over 22 years, Steve has advised clients in business disputes and media law matters. Steve’s broad range of experience includes contract disputes, defamation and first amendment law, access to public records and meetings, copyrights and trademarks, alcoholic beverages law, professional malpractice, banking and lender liability, insurance law, employment litigation and covenants not to compete. Steve employs a practical approach to resolve disputes efficiently and believes that the most effective solutions are reached when lawyers work together collaboratively with business clients. Steve has been listed in Best Lawyers in the areas of business litigation and first amendment law since 2008. Steve is also a registered civil mediator in Indiana.

Since 1993, Robert W. Johnson has represented clients who have suffered personal injury or who have lost a loved one due to a wrongful death. He specializes in cases involving brain injuries, motor vehicle accidents, and medical malpractice. His focus on brain injuries arises out of personal experience: his daughter, who did not receive enough oxygen at birth, was diagnosed with cerebral palsy. As a result of caring for his daughter, Mr. Johnson understands the difficulties others face and treats his clients with empathy and compassion. In 2011, he established Johnson Jensen LLP with friend and colleague Travis Jensen. Together, they commit their practice to a strong defense for the rights of those they represent.
