In January 2015, Best Lawyers spoke with legal malpractice powerhouses Charlotte Perrell and Christine Mast, two preeminent Atlanta attorneys who were named 2015 Best Lawyers “Lawyers of the Year” in legal malpractice law. Both women have spent two decades honing their skills in this complex and fascinating area of law. With Perrell on the plaintiff’s side and Mast on the defense, these formidable litigators have earned their accolades. Away from the bench, they’re the best of friends.

est Lawyers: Charlotte, in your own words, legal malpractice is a “complex area of professional malpractice law that occurs when a client sues her own lawyer for mistakes the lawyer made which may have cost the client her case.” When is it appropriate

for an “everyday person” to hire a legal malpractice attorney?

Charlotte Perrell: A person who suspects wrongdoing on the part of his attorney should only go forward when he feels that the negative outcome is truly the lawyer’s fault. We have had so many people come to us who were upset with the adverse outcome of a lawsuit, but the lawyer did not commit malpractice. Christine Mast: As a defense attorney, I consider my lawyer clients to be everyday people! I also represent professionals who are not licensed lawyers, like insurance agents and brokers, real estate agents, appraisers, property managers, small business owners, and the like. So while I certainly spend a lot of my time with lawyers as defendants, my practice actually allows me to develop relationships with other “regular” people too. What are some perceived misconceptions regarding legal malpractice cases? CP: Lawyers often believe that if you pursue this type of case you are betraying one of your own. I’ve introduced myself to people and in fairly short order they say they have somewhere else to go [laughs]. CM: That people hate lawyers. We find that jurors do not automatically dislike lawyers. When we have a situation where our lawyer did make a mistake, the jury seems to recognize that we are human like they are, and will forgive a mistake if the lawyer owns up to it. CP: Every case is different. A lawyer making a mistake is the common thread, but this can cover so much. CM: I can’t do my job in a complacent way. I have to read a lot and become an expert in whatever area the lawyer [I’m representing] has been practicing.

CM: My job offer brought me to Atlanta in 1992, right after law school graduation. I’ve been in Atlanta and at my current firm, Hawkins Parnell Thackston & Young, my entire legal career. BL to CM: You were named partner in 1999. What did it feel like to accomplish that recognition? CM: I was named partner at about the time I had my second daughter. Partnership meant to me that I had succeeded in earning the respect and high confidence of the senior partners, my peers, and colleagues outside of the firm. It was even sweeter because I had been able to do it while raising a toddler.

That’s quite a feat, given the challenges women in the legal profession have historically faced. CP: That’s true. Maintaining work-life balance

is a big challenge, especially if you have young kids. You have to put aside the feeling that you’re not doing anything really well. You’re not at the job as late as you need to be. You’re not home like you need to be.

What motivated you to study law? CP: Growing up in St. Thomas, my

dad’s company had a lawsuit against a government agency when they failed to pay my family for work they had done. I was just nine years old when the suit began and ultimately, eight years later, we won the case. I met some inspiring lawyers who worked on our case. I ended up studying at St. Louis University law school. CM: In my senior year of college at the University of Illinois, I was influenced by a young and enthusiastic professor who encouraged his students to enter into legal careers. He was a graduate of the University of North Carolina School of Law, which is where I ended up going to law school.

What’s it like to be friends and also on opposing counsel? CM: Charlotte and I have a strong

professional relationship as well as a personal friendship over the years. We can battle out the fighting issues and we know we can trust each other. She is a worthy adversary. CP: Christine is very thorough and truly cares about her clients. She’s a trusted friend and an excellent attorney.

Is there a standout case you’ve worked on in your career that changed you? CP: As an associate I worked on a case where we represented the family of an Iraqi general who was killed by Saddam Hussein and we were representing his estate against the bank. We ultimately prevailed in the case, and it was a lesson in overcoming prejudices for me; the family of one of Saddam Hussein’s generals was not a group I would normally have had a natural affinity for. The case taught me to look at how they were wronged more objectively.

CM: One of the first cases I worked on went

to the Georgia Supreme Court. One of the partners argued it and to help him prepare we did mock examinations—it was a real team effort. Twenty years later, I myself was privileged to argue before the high court. The issue was whether a lawyer expert in a legal malpractice case can give an opinion of what would have happened if the underlying case had gone to a jury. We won on that and now an expert is not allowed to testify on that. The experience was a highlight in my career and gave me a true appreciation for the intense dedication of appellate specialists.

What brought you to Atlanta? CP: My husband and I wanted to be in the

South. My mom actually suggested Atlanta, so we moved in 1994 with no jobs and about $500. After I passed the bar I started working under Frank Beltran, a well-known Atlanta lawyer. He became my mentor and is still one to this day. I practiced in Atlanta for 20 years before moving back to St. Thomas in 2014.

What advice do you have for young lawyers looking to break into your field? CP: Be exposed to as many different lawyers

and styles as you can. Emulate those you like and know what to avoid in the future. Not everyone has to be a mentor. Learning what you don’t want to do is just as important. CM: Do your best work, always, even if it is provided internally and not to a client or a court or opposing counsel. Work hard and be dependable. Be a dedicated person to the firm and an irreplaceable part of the team.

What do you like to do when you’re not busy lawyering? CP: I love sailing and travel, especially to

Europe. My husband has family in Italy. My 13-year-old daughter sails, and we may be going to Peru this year for one of her competitions. She participates in Opti class regattas, which is the precursor to boats used in high school and collegiate sailing. CM: I have three children who take up most of my personal time. Right now I’m going through the college application process with my oldest daughter. I also like art. Living in rural Illinois for many years gave me a great appreciation for barns and pastoral scenes and I enjoy painterly and unique interpretations of these subjects. It’s hard to take the country out of a girl even after almost 25 years in the city. Maybe in another life I’ll be an artist [laughs]. www.bestlawyers.com

“At that time, Georgia was not known for adequate awards in injury and death cases,” Malone recalls. “I remember that the defense couldn’t believe we didn’t take the $150,000 settlement they offered in that case, because the general thinking at that time was that children didn’t warrant high recoveries, as they hadn’t established an earning capacity. “But I realized that my job was to help the jury know that precious child—if they knew her, they would love her, and then they would understand that the defense’s argument that her life wasn’t of significant value didn’t make any sense.” Malone was successful in conveying this position, and the result, an award of $1.2 million, was the largest verdict ever returned in that venue. “Because my dad had the courage, endurance, and stamina to fight for people few lawyers would even represent, he helped pave the way for lawyers like me. Today, we’re able to try cases in communities throughout Georgia and obtain just recoveries for our clients,” observes Adam, who achieved a $24.5 million verdict—the largest personal injury verdict in Dougherty County—for the victim of an unnecessary amputation. In addition to achieving results separately at trial, Tommy and Adam Malone have found great satisfaction in trying cases as a team, as they did in early 2014 in a case involving a brain-damaged infant. “The third world war will be fought over water,” is a phrase people rattle off at cocktail parties. But water rights have been a playing out in the West for years and now, “the water wars in the East have begun,” Lawyer of the Year Patricia Thrower Barmeyer, partner at King & Spalding’s Atlanta office and head of its environmental practice, tells Best Lawyers. The substantive issues are the same for both regions, but because the legal regimes are distinct, east side water fights can’t simply follow western precedents, Barmeyer explains. She’s been working on water for 15 years, as well as natural resources, and site visits are both her forte and an essential part of her due diligence. “[To] the coastal barrier islands of Georgia or a landfill or a paper mill or a defunct manufacturing facility… I love being out there and seeing the reality of what we’re dealing with.” Barmeyer—a feminist and environmentalist— comes from a celebrated tradition of lawyering: she graduated from Harvard Law cum laude, has argued a case in the Supreme Court and her late father Randolph W. Thrower, the commissioner of the IRS, was considered a hero for his noncompliance with the Nixon administration. “He has instilled in me a high moral standard,” she said. Barmeyer was also involved in the landmark case that held that Georgia beaches and marshlands are owned by the state. She’s a member of the American College of Environmental Lawyers, is ranked No. 1 in her field in Georgia by Chambers and is the Chair of the Georgia of Advisory Counsel Trust for Public Land.

Donald F. Samuel—criminal defender at Garland, Samuel & Loeb in Atlanta, Georgia, since 1982 and Lawyer of the Year 2014—is nothing shy of prolific. He’s authored five books (two of which he updates with hundreds of pages yearly), teaches at Georgia State, makes television appearances, and speaks at seminars. He’s a father to nine children—no second-generation lawyers yet—and husband to an award-winning author. He’s even found time to enjoy Serial, the popular podcast about a Baltimore murder trial. That covers Samuel’s nights and weekends. Weekdays, he’s tried more than 100 felony cases, including one Supreme Court case. “Go interview this woman who has just killed her husband and don’t come back until the case is ready for trial,” were the marching orders that turned him into a criminal defender 33 years ago. What fascinates him most about his line of work today is the intersection of the Fourth Amendment and technology. “Even the U.S. Supreme Court has trouble keeping up with it,” he says and then lists GPS, cell towers and phone monitoring as elements outpacing government regulation. To the stereotypical question often asked of criminal defense lawyers, “How can you represent those people?” Samuel flips the script. “To me, the more realistic question is how the prosecutor could sentence someone to jail for 10 years for a minor drug offense. I find their jobs, personally, much more problematic than what I do for a living.” He has tremendous empathy for the people he represents—the people quotient is the one he emphasizes most. Luther H.
