Native American Law Denver, CO ■ Since co-founding the Native American Rights Fund (NARF) in 1970, John Echohawk has dedicated his career to defending the rights of Native American tribes, organizations and individuals. Now the Executive Director of the Native American Rights Fund (NARF), Echohawk oversees the organization’s staff in its main office in Boulder as well as its satellite offices in Washington D.C. and Anchorage. NARF works as a non-profit, prioritizing the most important cases involving protection of tribal sovereignty, protection of natural resources and Indian homelands, and protection of Indian cultures and religions. Echohawk said NARF typically has around 50 open cases at any time. Echohawk, a member of the Pawnee Nation of Oklahoma, received a scholarship from the federal government to attend the University of New Mexico School of Law, where he took one of the first law school courses on Indian treaties and federal Indian law. “[The government] saw a need to develop Native American legal professionals,” he said. “We were way underrepresented.”
While some Indian tribes and organizations are represented by private law firms, NARF stands out because it is able to provide legal counsel to those who Echohawk says would not be able to afford an attorney otherwise. A recent successful case that Echohawk pointed out was an enforcement of the Federal Voting Rights Act in Alaska, ensuring the state implemented the language assistance provisions of the Act, since many Alaska Natives’ first language is not English. “[NARF] is a 44-year-old organization that has been involved with most of the major litigation that benefited the Indian nations,” Echohawk said. “It’s very rewarding to see the progress that Indian country is making, and I’m proud to know we have had a role in helping that progress occur.” Also of note: During the 2010 Federal Bar Association’s Indian Law Conference, Echohawk became the third recipient of the Lawrence Baca Lifetime Achievement Award, in recognition of his tremendous contributions to Indian country over his long and successful career.

At Burg Simpson, experienced trial lawyers strive to make a difference both inside and outside the courtroom

ince 1976, Burg Simpson Eldredge Hersh & Jardine, P.C. has secured more than $1 billion in verdicts, settlements, and judgments for its clients, including more than 100 recoveries in excess of $1 million. But while most law firms would be content to be known solely for this accomplishment, Burg Simpson strives to be acknowledged as something more—“Good Lawyers. Changing Lives.®” “From the start, our goal was to build a firm that would make a difference for its clients and the community,” says founding shareholder Michael Burg. Indeed, Burg Simpson contributes to a variety of charities and non-profit organizations (see sidebar). In its practice, the firm, after achieving a successful result, will often donate to related causes or find ways to help its clients create positive action. As one of the country’s leading plaintiffs’ trial firms, Burg Simpson is known for its dedication to protecting the legal rights of injured individuals. Moreover, its attorneys include prominent members of the community, many of whom play important roles both inside and outside 12 | D E N V E R
the courtroom. “Despite how they are often portrayed, trial lawyers are protectors of the community—they guard the rights of injured individuals,” notes shareholder Peter Burg, Michael’s brother. For this reason, in 2012 Burg Simpson was quick to represent the victims of the Lower North Fork fire, which started when the Colorado State Forest Service lost control of a prescribed burn. The fire killed three people, destroyed 23 homes, and burned 4,100 acres of land. There were a number of obstacles to obtaining justice. As Michael explains, “We took on this case knowing there would be challenges to overcome—specifically the issue of the cap that would limit damages to an aggregate of $600,000 for everyone affected by the fire.” Burg Simpson was ultimately successful in getting the state legislature to waive the cap. In 2014, the state passed a law granting $18 million in liability payments to victims of the wildfire. “That was my proudest moment as a lawyer, and I’ve been practicing for nearly three decades,” says shareholder Tom Henderson,
who, along with shareholder David Hersh, represented several of the fire’s victims. “It was a case of lawyers doing good and not being derailed. This is what you go to law school for—to help people,” Henderson notes. Given this dedication and expertise, it’s not surprising that this year 21 of Burg Simpson’s 50-plus lawyers were included in The Best Lawyers in America®. In addition, the firm as a whole
received a national Tier 1 ranking in plaintiffs’ mass tort litigation/class actions (as well as Tier 1 regional rankings) from U.S. News – Best Lawyers “Best Law Firms.” “There aren’t many plaintiffs’ firms with rankings or track records comparable to ours, and a lot of that has to do with the depth of experience that we are able to offer our clients,” Michael remarks. appointed by federal judges to leadership positions in multidistrict litigation. Michael’s appointments include serving on the state liaison committee for the Vioxx MDL and on the executive committee for the Zyprexa litigation, which achieved a settlement in excess of three-quarters of a billion dollars. He continues to serve as co-lead counsel in the Yaz litigation, representing more than 14,000 clients.

Burg Simpson has been at the forefront of mass tort and multidistrict litigation (MDL) mainly because of its ability to provide leadership in these cases. In 2013, the firm was involved in negotiating a global settlement with Bayer over injuries related to the oral contraceptive Yaz/Yasmin (Yaz), and in recent years, four of the firm’s lawyers—Peter Burg, Janet Abaray, Seth Katz, and Michael Burg—were

When you’re in a leadership role, firms around the country look to you to put this litigation together,” Michael says. “So far we’ve taken more than 117 depositions, reviewed more than 90 million pages of documents, and globally represented more than 260 law firms; we’ve also successfully argued 17 Daubert motions. As a result, over the last year and a half, more than $2 billion in compensation has been paid to women injured by Yaz.” For the Yaz litigation, Janet Abaray was also selected as co-chair of the MDL Science and Expert Committee, and fellow Burg Simpson shareholder Seth Katz was named chair of the MDL Discovery Committee. “Janet is one of the top experts in the country with regards to the pharmacological issues relating to drugs and devices. Seth is an expert in electronic discovery, which is very important in these cases,” Michael notes. Katz has also been appointed to the plaintiffs’ steering
committee in the DePuy ASR hip implant litigation, and he has been named as the co-lead lawyer on MDL litigation involving the drug Pradaxa. In addition, Peter Burg served as co-lead of the plaintiffs’ steering committee and executive committee for the Gadolinium litigation, and the firm is currently handling litigation involving testosterone replacement therapy. “There aren’t many firms that have the number of leadership appointments by federal judges that we do, and that’s because of our hard work and our high level of expertise,” says Michael, who in 2014 was also appointed to the Colorado Supreme Court Nominating Commission by the governor and attorney general of Colorado, as well as by the Chief Justice of the Colorado Supreme Court. Beyond pharmaceutical litigation, Burg Simpson is known for handling serious personal injury, medical malpractice, workers’ compensation, and commercial litigation. Moreover, with the addition of the lawyers of Sullan², Sandgrund, Perczak & Nuss, P.C.—including Scott Sullan, a Best Lawyers® 2015 Denver Lawyer of the Year— the firm has an established preeminent construction defect group. “We’ve known the lawyers at the Sullan firm for years, and they really are considered the premier construction defect firm in the country,” Michael says of the acquisition. “They’re at the top of their game, and most importantly, they share our main goal, which is to be good lawyers changing lives on multiple levels.”

Seth Katz serves as a board member of Make-A-Wish® Colorado; Holly Kammerer is the current president for the Longmont-based Wild Plum Center, which provides learning opportunities to underprivileged children; and Michael and Peter Burg are strong supporters of the Ali Meyer Foundation, an organization that offers medical assistance to underprivileged children and educates the public on the dangers of drunk driving.
