2015 | SAN FR ANCISCO

It’s inevitable—at some point in your life, you’re going to need a lawyer, and

you won’t always be able to forecast when that need will arise. Finding an advocate in whom you can place your trust—particularly during times of strain or duress—can be a particularly daunting task. For most of us, the choice must be made quickly and decisively, and large sums of money are potentially on the line. As when choosing a doctor, we place an immense amount of responsibility in the counsel we hire to represent us. In our search for the highest quality advocate, we expect to be treated fairly, for our grievances to be heard, and for our lawyers to take on our case as if it were their own. Best Lawyers is proud to be the oldest legal peer-review organization in the United States. Since 1983, lawyers have been nominating and voting on their colleagues, culminating in what is currently the 21st edition of The Best Lawyers in America, from which this directory has been culled. The 2015 edition includes 52,488 attorneys in 137 practice areas, covering all 50 states and the District of

Columbia, and inclusion is based on more than 5.5 million detailed evaluations of lawyers by other lawyers. A lot has changed in the last three decades. We now have myriad tools at our disposal, but has it gotten any easier to find a lawyer? No one is allowed to buy his or her way into Best Lawyers, so when you search for representation here, you are certain to find only the most highly regarded advocates in their chosen field. Lawyers must be re-nominated every year, thus ensuring that those listed are still considered the most esteemed in the profession. As a result, we congratulate those lawyers who have earned a place in this year’s guide and offer special recognition to those selected for the first time by highlighting their names in green throughout this publication. There have been other improvements to the magazine as well. This year, to make your search even more useful, we have included all listed lawyers in San Francisco and Oakland broken out by practice area and are pleased to announce the 2015 recipients of the “Lawyer of the Year” award. Only one lawyer per practice area per metropolitan zone is granted this distinction,

based on the highest peer ratings received. Turn to page 15 to find out more. We are also thrilled to unveil our new, fully interactive digital edition, truly putting the power to make an informed decision at your fingertips. Each lawyer and firm with an online profile on BestLawyers.com is hyperlinked within these pages and highlighted in blue. Simply scan the QR code on page 4 with your smartphone or go to the Regional Publications section of BestLawyers.com to access the fully responsive digital edition. It’s available anytime, anywhere—accessible for free, all year long. Our aim is to quickly connect you to the Best Lawyer that best suits your needs and our publication strives to put you in touch with the Best Lawyers in your hometown. Because it takes a community to recognize the best, if you know an outstanding attorney who isn’t listed here, do not hesitate to go online to BestLawyers.com and nominate him or her today.

Meredith Hinshaw Director of Publications

METHODOLOGY Inclusion in Best Lawyers is based entirely on peer-review. The methodology is designed to capture, as accurately as possible, the consensus opinion of leading lawyers about the professional abilities of their colleagues within the same geographical area and legal practice area.

NOMINATION

BALLOTING

Best Lawyers employs a sophisticated, conscientious, rational, and transparent survey process designed to elicit meaningful and substantive evaluations of the quality of legal services. Our belief has always been that the quality of a peer-review survey is directly related to the quality of its voting pool.

WALKUP, MELODIA, KELLY & SCHOENBERGER Now in its sixth decade of practice, Walkup, Melodia, Kelly & Schoenberger continues to set the standard for excellence among personal injury firms in the western United States. The firm is widely recognized for its demonstrated expertise in varied case types, having achieved substantial verdicts in cases involving medical products, medical malpractice, consumer products, aviation disasters, transportation crashes, general negligence, and mass torts. “While the legal basis of recovery in our cases varies, all of our clients have suffered a terrible tragedy through no fault of their own, be it a catastrophic injury or the death of a loved one,” partner Michael Kelly says, “and our ability to maximize their recovery stems from the unique commitment and experience of our

legal team.” Walkup, Melodia, Kelly & Schoenberger comprises 15 lawyers, nine of whom have been selected for inclusion in The Best Lawyers in America. Members of the firm have been elected president of the American Board of Trial Advocates’ San Francisco Chapter and the San Francisco Trial Lawyers Association (SFTLA). In addition, on seven different occasions, an attorney from Walkup, Melodia, Kelly & Schoenberger has been nominated for the prestigious SFTLA Trial Lawyer of the Year award. “These are especially meaningful awards and leadership positions that are decided by our peers,” Kelly observes. “And typically these organizations are very objective in how they recognize lawyers; so it’s impressive that so many members

of our firm have regularly been at the forefront when it comes to these accolades and elections.” Beyond its legal practice, the firm is active in the community providing financial support to a host of organizations, including the Asian American Bar Association, the Legal Aid Society of San Francisco, the San Francisco Bicycle Coalition, the Susan G. Komen Breast Cancer Foundation, the Lawyers’ Committee for Civil Rights, the California Women Lawyers’ Association, and the National Association of Women Judges. “We’re a law firm that prides itself on its ability to assist people who have suffered serious injuries,” Kelly says. “And whether we’re advocating for them in the courtroom or the community, we’re dedicated to providing them with the highest quality of representation.”

T

he light at the end of the tunnel is rarely visible for victims of catastrophic injury and the families of those lost to wrongful death. But the attorneys at Rouda Feder Tietjen & McGuinn make it their mission to help those touched by tragedy reach that light and enjoy quality lives with economic security – and they’ve been doing it since founding partner Ron Rouda opened the firm’s doors in 1980. “We’ve had a number of cases that have really been extraordinary,” says managing partner Tim Tietjen, himself a 30–year veteran of the firm who has personally helped clients recover tens of millions of dollars over the course of his career. “And extraordinary results start with exceptional and deserving clients.” Indeed, the firm is known – by clients and adversaries alike – for putting people first. Results naturally follow, from the $29 million the firm obtained in a settlement for a client electrocuted at work, to the $18 million jury verdict recovered by Ron Rouda and John Feder for a woman who was hit by a car while in a crosswalk, and the multimillion–dollar jury verdicts obtained by Cynthia McGuinn for injured laborers, tradespeople and consumers during her 33 years of practice.

The firm is equally committed to the legal profession, with several of its partners holding leadership positions and memberships in various invitation–only peer groups. Partner John Feder currently serves as the state president of the Consumer Attorneys of California, while June Bashant holds an executive board position for the San Francisco Trial Lawyers Association. Additionally, Ron Rouda is a former president of the American Board of Trial Advocates, while partner Cynthia McGuinn was the first woman president of the ABOTA’s San Francisco chapter. “We prepare every case as if it is going to trial,” says Tietjen. “Our work begins and ends with a complete commitment to our clients and their case.” The firm leaves no stone unturned in its efforts to obtain the best results for their clients.

When it takes a case, the firm assembles a team of sophisticated investigators, accident reconstructionists, and experts to delve deep into the nuances of the case, in order to discover evidence that is often overlooked. By combining expert testimony, rigorous investigation and analysis, and skillful courtroom examination, GJELL is able to achieve verdicts and settlements that clearly put the firm in the elite of the plaintiffs’ bar. Some examples of results over the years include: $111.7 million against Tenet Healthcare for individuals who were victims of unnecessary heart operations; $90 million against Sega Corporation for the theft of intellectual property; and multiple wrongful death verdicts and settlements in excess of $10 million. Through it all, the firm’s partners have never lost sight of their individual public interest backgrounds, all of them starting their careers representing society’s indigent, needy and less fortunate. “We all have our roots in the public sector,” says Gillin. “The driving motivation in our approach to working so hard for our clients started decades ago, and it continues today with each individual we represent.” When the firm takes a case, helping the clients put their lives back together is of paramount importance. “Many times scores of hours are spent helping our clients with the ancillary fallout from a personal injury tragedy,” says partner Jim Larsen. “When we take on a client we do everything we can for them, not just their case. For example, Andy and I are handling a catastrophic injury case for a woman whose home was about to be foreclosed on; we stopped that.” “I am very fortunate to work for such deserving clients, and to work with everyone here,” says partner Kristin Lucey. “It is a remarkable team. We are totally committed, and we give every case everything we have.”

Pressing for improved safety measures is also a core principle. “Protecting the public is very important to us,” Feder says. “When we take on a case, we’re always interested in promoting public safety, and it’s rewarding when the wrongdoer adopts our suggestions for what needed to be done to make the product, workplace, or roadway safe.” It comes as no surprise that many of the firm’s cases lead to important safety improvements to roadways across California. John Feder and Ron Rouda obtained an $18 million jury verdict against the City of Los Angeles on behalf of a student who was struck by an SUV while using a defectively designed crosswalk. The city later removed the crosswalk to prevent similar accidents. And in a wrongful death case involving a cyclist killed by a big-rig truck, the case resulted in major improvements to the road. With decades of noteworthy resolutions, recognition naturally follows. Many of the firm’s cases are referred from attorneys across the country, and the firm has received accolades from peer groups. The firm’s attorneys have all held leadership positions in a variety of organizations, including several invitation-only groups. Feder currently serves as the president of the Consumer Attorneys of California, a group of over 3,100 plaintiffs’ attorneys committed to accountability from wrongdoers, and June Bashant sits on the executive board of the San Francisco Trial Lawyers Association. “We’re a dedicated team of attorneys who combine a passion for excellence with compassion for our clients,” says Feder.

“We know that [people] come to us during the darkest moments of their lives, and we take that responsibility to heart.”

Campisi has a nationally recognized litigation practice, having completed 45 trials in state, federal and other tribunals, and he has served as an arbitrator in more than 80 cases. He continues a career-long practice of serving as a leader in national organizations. Currently he heads the Fiduciary Surcharge subcommittee of the American College of Trust & Estate Counsel; he teaches for ALI-CLE and FIRMA and serves as an ABA representative on the National Conference of Lawyers and Corporate Fiduciaries. Together, firm co-founders Campisi and Tom Latham established Evans, Latham & Campisi in 1980. Cynthia R. Rowland Non-Profit / Charities Law Since starting out as a tax lawyer twenty-six years ago, Cynthia Rowland has developed a reputation for her work on nonprofit tax and charitable giving issues, to the point where the majority of her clients now work in the philanthropic field. “Most of my clients are high-networth donors or large, complicated charities,” Rowland says. “They all come to me with an idea for making the world a better place and it’s rewarding to be able to help them with the diverse issues they face— everything from business to tax concerns.” A partner in Farella Braun + Martel’s exempt organizations and family wealth groups, Rowland has successfully obtained federal and state tax exemption status for a range of charitable organizations, including public charities, private foundations, trade associations, and charitable trusts. She assists charitable organizations in all aspects

of their missions, including entity formation, business transactions, regulatory compliance, mergers, and dissolutions. Individuals also seek her counsel on charitable planning questions, both for lifetime giving and bequests to charities. “This is a highly regulated industry where the rules are always evolving; so, I spend a lot of time trying to stay current with the law,” Rowland notes. “I’m always on top of the issues and I think clients appreciate my responsiveness in getting back to them about their questions.” In addition to being selected as a Best Lawyers’ Lawyer of the Year, Rowland was recognized in 2011 as an Outstanding Attorney of the Year by the American Bar Association’s Business Law Section Nonprofit Organizations Committee.

F E AT U R E STORY

How To Manage a Catastrophic Injury Law Firm: CARE ABOUT THE CLIENTS, BUT DON’T FORGET THE COPIER

Andy Gillin

I

f you ask Andy Gillin what he does at Gillin, Jacobson, Ellis, Larsen & Lucey, one of California’s leading plaintiffs’ law firms, he will probably tell you that he makes sure the copier is working. That turns out to be an inside joke at the firm, because Gillin can’t stop himself from having his hands in every case and every aspect of the operation. Gillin, a leading lawyer in his own right, relishes the role of both managing the cases and managing the firm. With seven-, eight-, and nine-figure recoveries from major corporations and insurance companies, Gillin and his firm always draw extremely talented opposing counsel. “I prefer it that way, because handling cases at this level forces you to stay on your toes,” says Gillin. “We like to face the best.” Partner Jim Larsen says, “Andy’s mantra is quality yes, quantity no. Andy chooses the cases and intentionally keeps the caseload extremely low. He takes the initial call from a referring attorney or potential client and ends up accepting fewer than one out of ten cases.” The vetting process includes an extensive investigation prior to accepting the case. Gillin contends that turning down cases that dilute the firm’s energy and intensity is of equal importance to accepting cases the firm feels passionately about. Under Gillin’s management, GJELL never backs away from a tough case if they believe in the client. Some of the firm’s most memorable recoveries have come in extremely tough and legally challenging cases. “If the objective facts are tough but the plaintiff is human and honest and

sympathetic, the jury is going to respond to that human quality. I try to put myself in the shoes of the juror and if I connect with the client I tend to believe a jury will also,” says Gillin. Former client Laura Tindall relays a telling example. In 2008, Laura’s husband Bill was struck and killed by a motorist, who slid off the road. Bill was a Good Samaritan trying to help another motorist who had just overturned in the same gravel-covered curve. The police blamed the accident on the drivers, exonerating the county’s roadwork. Tindall believed otherwise, and knew something was wrong with the road. “Andy’s compassion and understanding was apparent during my first call,” says Tindall. “As I told him the story, he too could see there was something wrong with what I was being told.” After consulting with his partners, Gillin asked partner Luke Ellis to take the case. After some 40 depositions, Ellis uncovered 15 other serious accidents and deaths on that same rural road during previous resurfacing work. A jury awarded Tindall and her daughter $11.7 million in damages against the county. The verdict was in addition to $1.3 million in pretrial settlements. Gillin is equally proud that after the verdict, the county permanently changed its construction practices consistent with the theory of the plaintiffs’ case. Specialization and teamwork are two attributes Gillin emphasizes. GJELL lawyers share common values, having started their careers in public service. The

same commitment to representing the rights of the downtrodden has made the firm a top shelf plaintiffs’ shop with the reputation for a meticulous approach to case work and compassionate client services. Moving from legal services for the poor to plaintiffs’ work was a natural transition for Gillin. “Providing legal services to those in need, regardless of their financial situation or the resources of their opponents, is the beauty of the contingency fee system and part of who Andy is,” says partner Kristin Lucey. “The feeling is you never have to turn down a client just because they do not have enough money. If it is a righteous case, just like when we were at legal services for the poor…you just say…’Let’s go, money is not an issue here’,” Gillin says. Gillin continues, “It allows someone with nothing to take on the biggest institutions in the country, and I love the idea that GJELL can stand up and fight those institutions and their armies of lawyers.” “Yes, he’s the managing partner, and he’s an amazing lawyer in his own right,” says Ellis. “He’s a strategic thinker and has an uncanny ability to analyze a case. But the truth is, Andy cares about every single client. He knows who they are and he knows their story. And he is fully committed to assuring we do right by them. He makes sure that nothing is ever left undone in any case.” As for Gillin, he laughs and says that he plans to keep the copier running for years to come.

“We like to face the best.”

SCARLETT LAW GROUP Scarlett Law Group is a premier California personal injury law firm that in two decades has become one of the state’s go-to practices for large-scale personal injury and wrongful death cases, particularly those involving traumatic brain injuries. With his experienced team of attorneys and support staff, founder Randall Scarlett has built a highly selective plaintiffs’ firm that is dedicated to improving the quality of life of its injured clients. “I live to assist people who have sustained traumatic brain injury or other catastrophic harms,” Scarlett says. “There is simply no greater calling than being able to work in a field where you can help people obtain the treatment they so desperately need.” To that end, Scarlett and his firm

strive to achieve maximum recovery for their clients, while also providing them with the best medical experts available. “As a firm, we ensure that our clients receive both the litigation support they need and the cutting-edge medical treatments that can help them regain independence,” Scarlett notes. Scarlett’s record-setting verdicts for clients with traumatic brain injuries include $10.6 million for a 31-yearold man, $49 million for a 23-year-old man, $26 million for a 7-year-old, and $22.8 million for a 52-year-old woman. In addition, his firm regularly obtains eight-figure verdicts for clients who have endured spinal cord injuries, automobile accidents, big rig trucking accidents, birth injuries, and wrongful death. Most recently, Scarlett secured an

$18.6 million consolidated case jury verdict in February 2014 on behalf of the family of a woman who died as a result of the negligence of a trucking company and the dangerous condition of a roadway in Monterey, Calif. The jury awarded $9.4 million to Scarlett’s clients, which ranks as one of the highest wrongful death verdicts rendered in recent years in the Monterey County Superior Court. “Having successfully tried and resolved cases for decades, we’re prepared and willing to take cases to trial when offers of settlement are inadequate, and I think that’s ultimately what sets us apart from many other personal jury law firms,” observes Scarlett, who is a Diplomate of the American Board of Professional Liability Attorneys.
