I am honored and proud to be recognized by my peers as being professionally excellent as a lawyer and for my respect of the responsibilities and obligations that lawyers have in our society. What is one piece of advice you would give to new attorneys? Always do your best, keep your clients informed in a timely manner, and be prompt in your response to clients, your fellow lawyers, and to the court. Also, it is very important to be fair and honest with your client and with opposing counsel; and if you are not skilled in what you are being asked
to do, get help, and never be afraid to tell your client you don’t know or are not sure of the answer, but will find out or get outside competent representation for the client if needed. What is the biggest obstacle you see for your practice area in the next 30 years? The growing expansion of nonlawyer participation in many areas which have traditionally been the sole province of attorneys, such as the areas of business, tax, employee benefits, and trusts and estates. I see a continuation of non-lawyer competition, which will continue to cause a decline in these areas of the law. I also see a continuation of the trend of the legal profession becoming a highly skilled “industry,” which blends in with non-lawyers who practice in these non-litigation areas.

What interested you about going into your particular area of law? Since middle school, I wanted to be an architect, but after studying architecture for two years, I decided to become a lawyer. Working in the commercial real estate practice gives me an opportunity to be on the team developing new real estate projects. What would you say is the most rewarding aspect of practicing in your area of law? Most of what I
work on is a win-win project. Overall, new value is added, which is shared by all parties involved. I tried litigation, but the win-lose nature of it was not satisfying. It usually is a lose-lose experience, because the winner of a law suit is usually unhappy about the time and expense he had to go through. What has been the key to your success? I identify completely with the needs and desires of my client. His victories and losses are my victories and losses. I usually become personal friends with my clients and enjoy socializing with them. What is one example of a case/ matter you are particularly proud of? I represented a major bank that was a subordinate lender in a large construction project. Due to cost overruns, the first mortgage lenders increased their loan, which decreased
the value of the collateral held by my client. I found in the details of the loan documents that the increases in the first mortgage lenders loan was not secured by the collateral, which made it necessary that they get my client’s consent to increase their loan. We negotiated in New York City all day each day for about 8 months to reach an agreement on the restructuring. How has the legal industry in your field changed in the last 30 years? When I started with a leading Atlanta firm, we had 24 lawyers. When the firm reached 135 lawyers I left to start my own firm. The firm I left now has over 900 lawyers, and my firm is the size that my former firm was when I started out with it. My firm is like an extended family. What does being included in Best Lawyers for 30 years mean to
you? I have always been proud to be included from the first year. The fact that the best commercial real estate lawyers in my state include me in their ranks is more important than being selected by outsiders. What is one piece of advice you would give to new attorneys? You have to learn to enjoy the day-to-day practice, with all its ups and downs, stresses & boredom. If you don’t enjoy the day-to-day, go do something else. What is the biggest obstacle you see for your practice area in the next 30 years? The practice is becoming more and more subspecialized. Each lawyer will be limited to a very narrow, repetitive practice, like a worker in an automobile manufacturing plant, just attaching one small part to a large machine, over and over and over again.

For all intents and purposes, Tommy Malone’s first medical negligence case—tried over the course of just a few short days in the late 1960s—should have been a slam dunk. His client, a 15-year-old girl, had taken a sulfur drug prescribed by a well-liked local physician despite her documented allergy to the chemical. The results were disastrous: the young girl, Malone says, developed severe exfoliating dermatitis, as in weeping blisters, all over her body, which left painful sores, raw skin, and complete paralysis. “At the hospital, the nurses had to put cornstarch on the sheets so she wouldn’t stick,” says Malone. “It was really horrible stuff.” As Malone is quick to point out, this was the deep South at a turning point in history, and young lawyers like himself all knew better than to take on the establishment in rural Georgia. But it didn’t stop Malone from trying. Sadly, they lost the trial. “It wasn’t polite to sue your neighbor, much less your doctor,” he says matter-of-factly. And while the outcome of the trial, given the times, may have been predictable, it was no less devastating for Malone. “I was left asking myself how I possibly could have failed this child,” Malone says with no small measure of emotion, despite the decades that have passed. “Here you’ve got a girl with a known allergy to sulfur who was given a sulfur drug. What was my life all about? I questioned everything.” For Malone, it was a swift punch in the gut and a reality check rolled into one. This isn’t where the story ends, however, in either the sulfur-drug case—in a separate suit, the drugmaker eventually settled for sum that satisfied his client’s medical bills and saw to her continuing care—or in Tommy Malone’s personal narrative. In fact, it was just the beginning, and was the case that Malone says for better or for worse cemented his path. “There are lessons to be had in losing a case that I felt nobody should lose,” says Malone, the son of a lawyer turned judge (Tommy worked at his father’s firm out of law school before striking out on his own some years later). “To lose such a case was more than humbling, it was earthshattering. But if anything, it, and others, is
what motivated me to keep moving forward.” Today, from his hardfought vantage point as one of the state’s best plaintiffs’ lawyers, the losses are much fewer and farther between, and the verdicts and settlements he and his firm obtain for clients are routinely some of the largest Georgia sees. In one 2009 example, Malone won a staggering sum, nearly $50 million in compensatory damages, for the victim of a traumatic brain injury who was hurt in a devastating accident involving two commercial truck drivers. ow does a former local police officer end up one of the top personal injury lawyers in the entire country? For Atlanta-based “out of the box” attorney Joe Fried, it’s been a natural progression. “I have always hated bullies and stood up for the little guy,” Fried says. “Holding those who are responsible for hurting others fully accountable is what I did as a police officer and it is still what I do today as a lawyer—I just have a better education and much better resources.” That education goes way beyond law. Fried has formal education and real world experience in physics, accident reconstruction and forensics, as well as hundreds of hours of training in psychology, neurolinguistics, persuasion science, story structure and story-telling. When you add all these pieces together with a tireless work ethic and a spiritual calling, the final product is a lawyer who is hard to beat. “Cases are about much more than a string of facts and legal principles,” Fried muses. “It’s my job to figure out why anyone should really care about my client’s case and how I can present that case in a credible and compelling way. The jurors in my cases get a chance to be heroes by righting a wrong and restoring justice.” All you have to do is spend a few minutes talking to Fried to know he is not your typical lawyer. He is genuine and real—and has a rare ability to feel what is going on in others and connect with them at a deep level. “I wasn’t always like this,” Fried says. “I had to learn to deal with my own fears— to be willing to be vulnerable—and to find my own truth before I could feel the truth in others. I am still a work in progress.” Fried is a master at seeing through negatives that constrain other lawyers and turning them into positives. A defense lawyer recently said of Fried, “I thought I had him boxed in with a world class expert who was set to gut his case, but by the end of a short deposition that expert had flipped and was supporting Fried’s case. There was nothing I could do about it.” “I don’t let the defense dictate what is
important in a case,” Fried admonishes. “Lawyers often fight the wrong issues and then get mad and look like jerks when they lose the fight.
