What interested you about going into your particular area of law? Since I was a young boy I have wanted to be a trial lawyer. I loved debate, giving speeches, and in high school we had a minister only one Sunday a month so the Bishop commissioned me to lead

the morning prayer service and read the sermon. What would you say is the most rewarding aspect of practicing in your area of law? The pleasure you get by helping people when they have problems that they can’t solve on their own. What has been the key to your success? Working hard and studying people more than most. What is one example of a case/ matter that you are particularly proud of? Defending a prominent

woman who was charged with hiring a person to kill her husband. We proved that the tapes they were relying on had been edited and added to. This was before all of today’s technology. How has the legal industry in your field changed in the last 30 years? People seem to believe today that they are owed and that entitlement has taken the place of responsibility. What does being included in Best Lawyers for 30 years

mean to you? It has been the most satisfying recognition for me because of its longevity. It was harder to come by 20 or 30 years ago. What is one piece of advice you would give to new attorneys? As a trial lawyer, there is no possibility of being over-prepared and 8am-5pm/ five days a week will not get you the success you would like. What is the biggest obstacle you see for your practice area in the next 30 years? People trying to destroy the jury system.

What interested you about going into your particular area of law? After handling many types of matters—corporate, real estate—I found the challenges and often definitive outcomes of trial work more satisfying to my somewhat competitive nature. I came to appreciate the give and take of trial work, working with (and against) good lawyers in a fair process to resolve serious disputes.

What would you say is the most rewarding aspect of practicing in your area of law? Trials and litigation create an environment conducive to developing strong bonds among those on your side of the lawsuit, and often even with those across the courtroom or on the bench. These bonds can last for a lifetime. What has been the key to your success? The contributions of so many others, that I hesitate to identify a “key.” How has the legal industry in your field changed in the last 30 years? Without a doubt, technology has had a major impact on the practice of law. The expectations for quality and value have always

been there but where 30 years ago you responded to an urgent request with a letter that arrived in three days, today a response is expected within three minutes after receiving an email. Time and geographic boundaries have been shattered. The advantage, and the disadvantage, are the same—you can work from anywhere at any time. What does being included in Best Lawyers for 30 years mean to you? Since my unexpected early listing, I have always valued the honor of the anonymous process and the kind words of other experienced lawyers over so many years. I always try to pay forward these benefits I’ve received over time from Best Lawyers.

What is one piece of advice you would give to new attorneys? Always remember that today’s adversary may be tomorrow’s cocounsel or colleague. What is the biggest obstacle you see for your practice area in the next 30 years? Litigation has become too expensive, and trials for the civil practitioner seem to be ever more scarce due to these costs. Pretrial discovery has become an industry unto itself, with little eye towards strategic usefulness at trial. This hurts everyone involved—most especially the client. It also does damage to the process itself by undercutting efficiency and speed to a resolution.

Harnessing the fear of trial by using that fear to thoroughly prepare is the key. What is one example of a case/ matter you are particularly proud of? Lawsuits filed by 200 prisoners (not a class action) against a private prison company, Corrections What has been the key to Corporation of America (CCA), for your success? Thorough and injuries sustained in a prison riot complete preparation of a client’s caused by the negligence of CCA, case for trial and then just being resulting in individual settlements a “real” and honest person in the following public exposure of the courtroom, which has permitted companies policies and procedures me to be spontaneous, creative, compassionate and self-righteously that led to the riot. The lawsuits

resulted in five appeals to Colorado Appellate courts with two published opinions, one resulting in new law favorable to prisoners’ rights. How has the legal industry in your field changed in the last 30 years? There has been a steady decline in jury trials as access to justice diminishes and as the American trial lawyer is replaced by litigators and ADR. The changes in tort law commenced nationwide in 1985 and are ongoing. Corporate America continues to succeed in increasing profits by depriving citizens of access to justice.

What is one piece of advice you would give to new attorneys? Understand and care for your clients. Treat them with the respect they deserve. Get to know them, like them, and become a friend and a warrior on their behalf. The people you represent are not merchandise to be used by you for profit, but are people who have often entrusted you with their lives and livelihood. You therefore have a responsibility to help them seek justice, which sometimes requires dedicating your own life to their lawsuit, day and night. www.bestlawyers.com | 5

For more than 30 years, Elizabeth Temkin has focused her practice exclusively in the area of environmental law and litigation. As a result, she has been included in The Best Lawyers in America for years, and in 2014 she was named Lawyer of the Year in Denver for environmental law. In addition, her firm, Temkin Wielga & Hardt LLP, has been ranked Tier 1 in Colorado for environmental law and litigation by U.S. News – Best Lawyers “Best Law Firms” for 2014. “I think our success has a lot to do with the cutting-edge nature of what we do,” says Temkin of these recognitions. “We are known for handling complex projects, from complicated redevelopment matters to high-stakes litigation and enforcement cases. Our reputation therefore lies in our ability to litigate when need be, but also to be creative in moving the parties involved toward an outcome or resolution that is hopefully positive.” As part of her focus on complex environmental cleanup and risk management, Temkin has worked with many of the states’ site cleanup programs, including some of the most complicated Brownfields and Superfund sites in the West. She is particularly well known for her work involving the Coeur d’Alene Basin Superfund site, which is one of the largest and longest litigated Superfund sites in the country. “The science and policy in these cases are fascinating, and my perspective has always been that there’s only so much gross national product to be spent on environmental protection, so whenever I’m involved I try to make sure the money needs to be spent and is spent well,” Temkin says.

Throughout her life, Charlotte Wiessner has always had an interest in design and construction; indeed, over the years she has built two houses and renovated others. So when the opportunity to handle construction cases arose early on in her career, she saw it as a natural fit. “I’ve focused in construction law for probably the last 25 years,” Wiessner notes. In her practice, Wiessner handles construction litigation, arbitration, appellate work, and contract preparation and negotiation. Many of her clients are involved in airport construction, and in one of her biggest cases she obtained a $20 million verdict—including $9 million in punitive damages—for a runway contractor at Denver International Airport. She also handles a significant amount of work for airline fuel consortia and heavy highway contractors. She regularly represents municipalities and counties on public projects in Colorado. “The highlight of my career has been working with great clients,” Wiessner says. “When I was a young lawyer, I remember a senior partner saying that your practice is only as good as your clients, and I have found that to be completely true— it takes a great client to get a good result.” This year, Wiessner was selected by her peers as Best Lawyers’ Lawyer of the Year in Denver for construction law. She previously served for two years as co-chair of the Construction Litigation Committee of the Section of Litigation of the American Bar Association.

ver its nearly 40-year history, Burg Simpson Eldredge Hersh & Jardine, P.C. has become a true institution among plaintiffs’ law firms, with a national footprint and a reputation for trial success. In all, the firm has recovered in excess of $1 billion for its clients, including more than 100 verdicts, settlements, and judgments of $1 million or more. “There aren’t many plaintiffs’ firms that have achieved track records comparable to ours, and a lot of that has to do with the depth of experience and expertise that we are able to offer our clients,” says the firm’s founding shareholder, Michael Burg. Shareholder Seth Katz, meanwhile, serves as a board member of Make-A-Wish Colorado, and shareholder Holly Kammerer is the current president for the Longmont-based Wild Plum Center, a non-profit dedicated to providing underprivileged children with opportunities for learning and growth. In 2013, Michael and his brother Peter Burg were recognized for their humanitarian service—as well as their professional achievements—when their alma mater, the University of Denver Sturm College of Law, awarded them its

Outstanding Alumni Award. Both lawyers are strong supporters of the Ali Meyer Foundation, an organization that offers medical assistance to underprivileged children and educates the public on the dangers of drunk driving. Currently, Peter is on the Foundation Board for Craig Hospital, a non-profit rehabilitation facility for survivors of spinal cord and traumatic brain injuries; he previously served a six-year term on the Craig Operating Board, including serving as chairman of the board. In 2013, Peter helped set a new fundraising record of more than $1.3 million as co-chair of Craig Hospital’s annual PUSH Dinner (Burg Simpson was a presenting sponsor of the event). Peter is also on the board of directors of Rocky Mountain Human Services, which provides aid to military veterans suffering from traumatic brain injuries through Operation

We feel we’ve done an outstanding job in terms of lining up experts and making sure fair compensation has been paid to women injured by the Yaz/ Yasmin product,” Michael says. “During the course of this litigation, we’ve taken more than 117 depositions, reviewed more than 90 million pages of documents, and represented, globally, more than 260 law firms. We’ve also successfully argued 17 Daubert motions. As a result of all that, over the last year and a half more than $2 billion has been paid to women injured by the Yaz/ Yasmin product. Settlement conferences in thousands of other Yaz/Yasmin cases are scheduled through 2014.” Not only was Michael appointed as co-lead in the Yaz/Yasmin multidistrict litigation, but Janet Abaray was selected as co-chair of the MDL Science and Expert Committee, and Seth Katz was named chair of the MDL Discovery Committee. Both are fellow Burg Simpson shareholders. “Janet is one of the top experts in the country with regard to the pharmacological issues relating to drugs and devices, and Seth is an expert in electronic discovery, which is very important in these cases,” Michael notes. Katz has also been appointed to the plaintiffs’ steering committee in the DePuy ASR hip implant litigation, and he has been named as the co-lead lawyer on the multidistrict litigation involving the drug Pradaxa. In addition, Peter Burg acted as co-lead of the plaintiffs’ steering committee and the executive committee for the Gadolinium litigation. “Having such a high level of expertise and leadership—not to mention the people at our firm who work day and night
