Biddle, meanwhile, brings 27 years of experience to his practice, where he represents clients in white-collar investigations, federal forfeitures, trials, appeals, and post-conviction proceedings. Biddle previously chaired the American Bar Association’s Subcommittee on Forfeiture, and before entering private practice, he served as an assistant U.S. attorney and a federal law clerk.

A Leader in Medical Malpractice Law Thirty years after its founding, Schochor, Federico and Staton P.A. continues to secure some of the country’s highest results for medical negligence

T

his past September, a Baltimore judge approved a $190 million class action settlement for the more than 8,000 patients of a Johns Hopkins’ gynecologist who secretly photographed and filmed women during exams. This recovery is reputedly the largest settlement for a single-perpetrator sexual abuse case in the history of the United States. Jonathan Schochor, who chaired the plaintiffs’ steering committee and was lead counsel throughout the litigation, says, “The patients of Dr. Nikita Levy have experienced unimaginable trauma as result of his violations, and it’s very

gratifying to see that justice has been served.” Dr. Levy’s conduct of secretly taping and photographing his patients—in addition to alleged inappropriate verbiage and physical conduct—first became public in February 2013. Shortly thereafter, Schochor and his firm, Schochor, Federico and Staton P.A, met with about 2,000 of Dr. Levy’s former patients and filed the first class action complaint. “There was a huge outcry when Dr. Levy’s patients learned of this extraordinary breach of trust,” Schochor recalls. “They were afraid that they had been photographed

and that those photos had been uploaded to the internet; so, as you can imagine, they felt and still feel betrayed.” Consequently, Schochor adds, many of Levy’s former patients quit the medical system. They stopped seeing any obstetricians/gynecologists; they did not get their tests and studies. Many even stopped taking their children to their doctors and were dysfunctional in the workplace and at home with their spouses or significant others; many required counseling from religious leaders, professionals, and friends. “Our clients’ injuries and damages have continued through the present, and hopefully with this settlement they will finally be able to find the closure they need,” Schochor notes. Schochor filed the first complaint in the case, after which there followed about eight months of negotiation with the hospital. Subsequently, Schochor put together a steering committee and later filed a joint motion for class certification, both of which were approved. As lead counsel in the litigation, Schochor and his committee engaged various specialists to assist in preparing the case; they also notified Dr. Levy’s former patients of the lawsuit both through formal correspondence and by publicizing the case in newspapers and magazines, as well as on television, social media, and the internet. Moreover, a website was set up and telephone operators were made available to register clients—all pursuant to a notice plan approved by the court. “We believe that Dr. Levy had approximately 12,600 patients, and through these efforts the number of patients registered in the class action increased from 3,800 women at the time of certification to more than 8,000 women today,” Schochor says. With the settlement of $190 million now approved, the allocation process can begin; and Schochor notes that

he and his committee will be bringing in a team of medical and other experts who will evaluate each of the plaintiffs with respect to their individual damages. Eligible patients will then be placed into four tiers based on the level of harm they incurred. “This has been a very challenging case—we have been contacted by thousands of patients who have suffered because of Dr. Levy’s actions,” Schochor notes. “But we believe that with this recovery the community will be able to start moving forward again.” Schochor, Federico and Staton, P.A. has been fighting for injured patients and their families since 1984, when medical malpractice attorneys Schochor, Philip Federico, and Kerry Staton founded the firm to better represent medical malpractice victims. The firm has since become a fixture in the medical malpractice field, with approximately $1 billion in verdicts and settlements for its clients. County and a $1.25 million verdict against Nordstrom for failing to provide shoppers with adequate security; in 2013, he won notable verdicts for two families that suffered the wrongful death of a loved one. In the first case, Bekman secured a jury award of $1.3 million for a 77-year-old woman who died after her doctor failed to immobilize her, despite radiology results indicating movement could cause paralysis. Then, seven months later, he obtained an award under the Federal Tort Claims Act of more than $346,000 in damages for the four adult children of an Army veteran who died as a result of a missed diagnosis. “The findings of wrongful death, personal injury, and cause of death in these cases clearly warranted awards of this size,” Bekman notes. “And while the financial compensation won’t make these families whole again, it can at least help to make their lives a little bit better.” Salsbury’s achievements include securing one of the highest recoveries in Maryland for a brain-injured child and successfully representing individuals who died because of the water taxi disaster in Baltimore Harbor.

Recently, he also achieved a million-dollar-plus verdict, obtaining a $1.53 million award for a 38-year-old man whose genitals were mutilated by flesh-eating bacteria that went untreated for 58.5 hours due to a misdiagnosis in a Harford County hospital. The award included $1.4 million in noneconomic damages, which was ultimately reduced to $650,000 due to Maryland’s cap in medical malpractice cases; given the cap, the final award was $763,320. “I enjoy what I do because every case is a challenge and every case is different,” Salsbury says. “Each of our clients has a story that will break your heart—their lives have been virtually ruined because of some tragedy; so it’s very satisfying to be able to serve as their advocates.” From winning record-setting malpractice awards to defending Prince George’s County’s civil rights record, Clements has spent countless hours advocating for injured persons and consumers. In another case where the firm obtained a result exceeding Maryland’s medical malpractice cap, Clements asked a Harford County jury to award $13,179 in past medical expenses and

$500,000 in pain and suffering to a 27-year-old woman whose undiagnosed ectopic pregnancy led to a burst fallopian tube. Following the trial, the jury awarded Clements’ client the full $513,179, recognizing that the woman’s injury had resulted in diminished fertility. “One of the main reasons we’re able to obtain such large results is because we understand which elements of a case will resonate the most with jurors; and most importantly, we are skilled at explaining to jurors how our clients’ injuries will impact their lives,” Clements observes. Adkins, who has obtained many multimillion-dollar jury verdicts—including a $17.4 million award in the District of Columbia for a woman who was left with permanent pain and disability after a student doctor improperly delivered her baby— adds: “We work hard to learn the medicine and overcome testimony from expert defense witnesses so that the jury will understand that we have a valid, meritorious claim; because ultimately, we are determined to see that our clients are fully compensated for their injuries.”

Martha Lessman Katz Information Technology Law Baltimore ■ Over the past two decades, Martha Lessman Katz has focused her practice on issues relating to technology transactions, internet agreements, privacy and data security, intellectual property, licensing, and social media. Lessman Katz began her career in the late 1970s as a general corporate and transactional lawyer, but even back then, she had a strong interest in technology-related matters. “I was the only person in my office who would use the computer for more than a calendar,” she recalls, “so any work that came in involving technology was sent to me.” In 1994, Lessman Katz moved to Baltimore, where she began working exclusively in the information services group of the insurance company USF&G. “The company was on the brink of bankruptcy when I arrived; and because they were so far behind, they had to leapfrog over technology to catch up,” she explains. “The result was that I ended up handling

a lot of technology business transactions; and from then on, I was able to focus in that area alone.” Lessman Katz has since been certified by the International Association of Privacy Professionals as an information privacy professional. Weltchek Plaintiffs, Medical Malpractice Law Lutherville ■ Robert Weltchek’s 34-year career as a plaintiffs’ personal injury and medical malpractice attorney has been highlighted by many landmark achievements. During the early 1980s, Weltchek was one of the first lawyers to take on the lawn care industry for using carcinogens in their products, and he was featured in People magazine for his work. He has since taken on several drug companies and medical device manufacturers in cases of first impression. Moreover, Weltchek doesn’t shy away from trying cases that have the potential for multimilliondollar damage awards when their jurisdictions are in historically low-verdict areas for plaintiffs. His victories at trial include the largest medical malpractice verdicts—at the time—in Ann Arundel County, Baltimore County, Carroll County, and Charles County. Weltchek has also successfully litigated cases against some of the country’s largest corporations, such as ExxonMobil, Ernst & Young, and American

Motors Corp./Hummer. He credits this winning track record to a policy of only handling a limited number of cases: “At any moment in time we may have 12 to 15 cases open, and that allows us to really focus on getting our clients the highest awards possible for their injuries.” For Weltchek, the most gratifying part of his practice is being able to help families in need. To that end, he is very active on the board of the Casey Cares Foundation, which provides services to critically ill children. He also sits on the board of the National Foundation for Affordable Housing Solutions, a non-profit organization that provides housing for low-income families.
