MINUTES MAYORAL ELECTION MEETING OF COUNCIL

7 NOVEMBER 2016

WELCOME Mr Simon McMillan, Chief Executive Officer. OATH OF OFFICE AND COUNCILLOR CODE OF CONDUCT DECLARATION On Wednesday, 2 November 2016 at 10.00am, the Election results were declared by the Returning Officer, Pat Southwell, from the Victorian Electoral Commission. On Wednesday, 7 November 2016, the Councillors were Sworn into Office by the Chief Executive Officer, Simon McMillan, in front of members of the public and staff. Councillors are required to make an Oath of Office before they officially become Councillors. The Oath of Office must be signed and dated by the Councillor before the Chief Executive Officer, and recorded in the Council Minutes. The Councillors also declared that they had read the Councillors Code of Conduct and made a written declaration that they will abide by the Councillor Code of Conduct. The following Councillors took the Oath of Office and made a written declaration to abide by the Councillor Code of Conduct before the Chief Executive Officer : Councillor Tom Melican Councillor Mark Di Pasquale Councillor Alison Zandegu Councillor Peter Castaldo Councillor Rick Garotti Councillor Wayne Phillips Councillor Craig Langdon

APPOINTMENT OF TEMPORARY CHAIRPERSON The Chief Executive Officer, Mr Simon McMillan, called for nominations for a Temporary Chairperson. Cr Wayne Phillips was nominated as Temporary Chairperson by Cr Craig Langdon, seconded by Cr Mark Di Pasquale. Cr Wayne Phillips assumed the chair at 7.15pm

The Meeting opened at 7.15pm.

PARTICIPATION – COMMUNITY INVOLVEMENT IN COMMUNITY LIFE 6.1

OATH OF OFFICE AND COUNCILLOR CODE OF CONDUCT DECLARATION

EXECUTIVE SUMMARY The role of a Councillor is to:   

participate in the decision-making of the Council; and represent the local community in that decision-making; and contribute to the strategic direction of the Council through the development and review of key strategic documents of the Council, including the Council Plan.

In performing the role of a Councillor, a Councillor must— (a) (b) (c) (d) (e)

consider the diversity of interests and needs of the local community; and observe principles of good governance and act with integrity; and provide civic leadership in relation to the exercise of the various functions and responsibilities of the Council under this Act and other Acts; and participate in the responsible allocation of the resources of Council through the annual budget; and facilitate effective communication between the Council and the community.

Before being capable of acting as a Councillor, all persons elected to be Councillors must: 1. 2. 3.

Take the oath of office; Read the Council’s Councillor Code of Conduct; and Make a declaration that they will abide by the Council’s Councillor Code of Conduct.

Until each of these requirements has been completed an elected person cannot act as a Councillor. Resolution (CO2016/324) That Council note the following Councillors: 1.

Tom Melican, Mark Di Pasquale, Alison Zandegu, Peter Castaldo, Rick Garotti, Wayne Phillips and Craig Langdon made an oath of office.

Tom Melican, Mark Di Pasquale, Alison Zandegu, Peter Castaldo, Rick Garotti, Wayne Phillips and Craig Langdon signed and declared in writing that they have read the Councillor Code of Conduct and that they will abide by the Code at all times; and that this declaration was made in front of, and witnessed, by the Chief Executive Officer as required under Section 76C(6B) of the Local Government Act 1989.

MAYORAL TERM

EXECUTIVE SUMMARY The Local Government Act 1989 (the Act) stipulates that Council must elect a Mayor. Before a Mayor is elected, the Council may resolve to elect a Mayor for a term of two years. Banyule has traditionally elected a Mayor for a one year term. In accordance with section 71 of the Act, Council is required to determine the Mayoral term. A resolution is required to set the term of the Mayor. Resolution (CO2016/325) That Council resolves to elect the Mayor for a term of one year.

ELECTION OF MAYOR

EXECUTIVE SUMMARY The Mayor is responsible for leading the Council and has a number of roles which are both legislative and functional. The legislative requirements are outlined in Sections 71 to 73 of the Local Government Act 1989 (the Act). The Act states that Council must elect a Mayor at a meeting that is open to the public. The Act states that the Mayor not only takes precedence at all municipal proceedings within the municipality but must also take the Chair at all meetings of the Council at which he or she is present. The Mayor’s role, however, extends well beyond officiating at Council Meetings or other municipal proceedings. Additional important roles are providing leadership, promoting positive relationships, and modelling good governance. This report relates to the election of the Mayor for Banyule City Council for the 2016/2017 Mayoral term. Resolution (CO2016/326) The Temporary Chairperson called for nominations for the position of Mayor of Banyule City Council for the period as determined by Council which will finish at 6am the day of the next Mayoral election. Cr Mark Di Pasquale nominated Cr Tom Melican, seconded by Cr Alison Zandegu. Cr Tom Melican accepted the nomination. The Acting Chairperson thereby declared Cr Tom Melican successfully elected as the Mayor of Banyule City Council for the next 12 months, commencing 7 November 2016, having received an absolute majority of votes cast.

The Temporary Chairperson vacated the chair and Cr Tom Melican took the chair as Mayor at 7.20pm. The Mayor gave a speech of appreciation and thanks to his fellow Councillors and acknowledged the outgoing Mayor and Deputy Mayor. He also congratulated and thanked retiring Councillor Steven Briffa and outgoing Councillor Jenny Mulholland for their years of service as Councillors of Banyule City Council. This was followed by speeches of support for the Mayor and further acknowledgement of fellow Councillors and the community for their support from each individual Councillor.

CONSIDERATION OF NOMINATIONS FOR DEPUTY MAYOR

EXECUTIVE SUMMARY The Local Government Act 1989 (the Act) does not deal with the election of a Deputy Mayor. Accordingly, councils may choose to appoint a Deputy Mayor if they believe this will assist. Traditionally, Banyule Council has appointed a Deputy Mayor to provide support and assistance to the Mayor in undertaking his/her workload. The Act does not prescribe a role for the position of Deputy Mayor or permit a level of remuneration over and above that available to councillors. For councils that have a Deputy Mayor, the position is a title only, and does not have a statutory role. Unlike the roles of Deputy Premier or Prime Minister, a Deputy Mayor is not able to automatically step into the role of Mayor if this becomes necessary. An Acting Mayor must be appointed by Council on each occasion whenever an Acting Mayor is required. This report requests Council to consider the appointment of a Deputy Mayor for the 2016/2017 Mayoral term. Resolution (CO2016/327) The Mayor called for nominations for the position of Deputy Mayor of Banyule City Council for the next twelve (12) months. Cr Wayne Phillips nominated Cr Mark Di Pasquale, seconded by Cr Tom Melican.

The Mayor thereby declared Cr Mark Di Pasquale successfully elected as the Deputy Mayor of Banyule City Council for the next 12 months, commencing 7 November 2016, having received an absolute majority of votes cast.

Former Councillor, Steven Briffa, served Council from 2008 to 2016, and former Councillor, Jenny Mulholland, served Council from 2000 to 2016. APPOINTMENT OF COUNCILLORS ON COMMITTEES

EXECUTIVE SUMMARY Annually Council appoints Councillor delegates to the Council Advisory Committees and other committees. Advisory Committees are made up of Councillors and community members. They have Terms of References and meet to discuss issues and advise Council. In addition to Advisory Committees, Council is often invited to participate on a range of external committees in partnership. Both Advisory and external committees provide important linkages between Council, Community and State agencies and interest groups. Council’s approval of the Councillor appointments to the various committees is required. In addition, the following Advisory Committees terms have expired and expression of interests from community groups and representatives as outlined in the Terms of Reference (attached) require a call for nominations:      
