Some family members of the Winz shooting victims are expressing disappointment as WorkSafe NZ lays a charge against their loved ones’ employer. Peggy Noble and Leigh Cleveland were killed at their workplace of Ashburton’s Winz office on September 1 last year.

Ms Noble’s partner Donald Campbell of Ashburton said he was disappointed by the move from WorkSafe. “Who knew that a crazed person was going to go in there,” he said, adding he did not know what more the ministry could have done to protect its employees “apart from putting them behind bullet-proof glass”. “It was a freak sort of thing,”

Mr Campbell said. His fifth grandchild had recently been born, something Peg, his partner of 11 years, would have been happy to have seen. He was beginning to move on after losing his “soul mate”, and was starting to get over the angry stages of grief. “I don’t need this really because the last month or two I have felt positive and the Minis-

try of Social Development have been good to me.” Leigh’s mother Kathleen said from her Alexandra home yesterday that both Winz and WorkSafe had phoned her on Monday to inform her of the news, which she had been surprised to hear. She believed Winz managers had also been surprised at the laying of the charge. “I was a bit disappoint-

ed, you think you are getting over everything and getting on with life and then this crops up.” Mrs Cleveland said the family, which included Leigh’s three siblings, had just sold Leigh’s Ashburton home and were wanting to move on from this horrible chapter in their lives.

Judge Judy Sheindlin still in session Daytime television’s most popular personality, Judge Judy Sheindlin, has extended her contract for three years and will keep her court in session into 2020. CBS Television Distribution didn’t discuss terms of the deal yesterday. TV Guide has reported her current salary at $47 million a year – making her by far the highest-paid personality on television. Sheindlin is 72. The new deal also gives CBS first look at any projects by Sheindlin’s production company, which makes the new court show Hot Bench. Judge Judy is now in its 19th season. Netflix’s NZ launch date revealed A launch date has finally been confirmed for Netflix in New Zealand – and it’s just weeks away. The TV on-demand provider will kick off its services here on March 24, in direct competition with Spark’s Lightbox, Sky TV’s Neon, Quickflix and Ezyflix. But the American-based company is still staying mum on pricing plans, saying they will be available on launch. In a press release, it said it would offer a single-stream standard definition plan, two-stream high-definition plan and four-stream 4K ultra-high definition “family” plan. It will be bringing a large library of original content, including Bloodline, Daredevil, Marco Polo, Sense8 and The Unbreakable Jimmy Smit.

Iggy is glad she didn’t win the Grammy Rapper Iggy Azalea is glad she missed out on a Grammy Award because she feared an avalanche of criticism if she took home a top rap trophy. The hip-hop star was nominated for four awards at the 2015 ceremony, including the coveted Best Rap Album for The New Classic, but she came away empty-handed. Kiwi dam buster One of only two New Zealanders to take part in the famous “dam busters” air attack on Germany during World War Two is to auction his medals to raise money for the upkeep of the Bomber Command Memorial that commemorates his comrades who were killed. Les Munro, 95, is the last surviving member of the pilots who took off for the raid, later immortalised in the film The Dam Busters. London auction house Dix Noonan Webb said Mr Munro’s awards and other items will be auctioned there on March 25 and are expected to fetch nearly $NZ60,000 to $NZ75,000.

The building where last year’s horrific shootings in Ashburton took place has been sold to be reborn as a community hub. Community House Mid Canterbury has bought the former Work and Income building, which it plans to redevelop as a base of accommodation and support for social service agencies. It paid $1.1 million for the building and anticipates a new drive to raise at least another $750,000 to refit the building’s interior before it reopens by the beginning of next year. The forlorn and tragically evocative exterior is also likely to be redesigned, with a new entrance and a memorial to those affected by the shootings being actively considered. chairman, John Driscoll, yesterday confirmed the purchase, which was made possible by four rapid-fire months of community

fundraising. That the ambitious target was met in such a short space of time was testament to the “amazing” support of do-

nors and funders who saw merit in rehabilitating the building. Mr Driscoll said he and other members of his board were initially uneasy when the building was mooted to replace community house’s temporary premises on Tancred Street. However, further investigations showed the 800sq m building could be suitable and there was strong community support following subsequent publicity. There was also a strong desire to redevelop the building to the point it was “significantly different” to the scene of the shootings, Mr Driscoll said. Before the purchase, the board approached the Ministry of Social Development which contacted staff and the families caught up in the September 1 shootings. All were supportive, and victims’ families would be consult-

ed again as community house considers a suitable memorial to the women who were hurt and killed in the incident. Between 25 and 30 present and past community house tenants have indicated they would like to move to the refurbished building. Safer Ashburton would be the anchor tenant. An Ashburton District Council $500,000 grant reinforced the worth of the project and funds were subsequently secured from the Lion Foundation ($200,000), Community Trust of Mid and South Canterbury ($250,000), Mackenzie Charitable Foundation ($100,000), Lochhead Foundation ($20,000), Advance Ashburton ($12,500), Four Winds Foundation ($10,000), Trust Aoraki ($10,000), the Ashburton MSA ($2000) and several private donations.

Restricted access and window barriers could be on the table for the country’s Work and Income offices in the wake of last year’s double shooting fatality at the Ashburton office. Front counter workers Peggy Noble and Leigh Cleveland both died during the September 1 attack, and a third woman, Lindy Curtis was seriously injured. This week WorkSafe NZ laid a charge against the Ministry of Social Development, alleging the ministry failed to take all practicable steps to ensure the safety of its employees while at work. Section 6 of the Health and Safety in Employment Act, under which WorkSafe laid the charge, required employers to take all practical steps to ensure the safety of employees. An independent review, conducted after the tragedy, found all practical steps

were taken to ensure the safety of staff at the Cass Street office. However, it also disclosed safety and security protocols had evolved over time, resulting in inconsistent practices and cultures across the organisation. Employment relations consultant Christine Summerville said it was “entirely appropriate” to take the circumstances of individual offices into account in determining appropriate health and safety procedures. However, it was important that differences to policy were part of a systematic process of identifying the individualised risks and determining how to manage the risk, rather than the evolutionary approach of determining what the processes or policy will be. “Reviews should be regular and planned.” Other agencies, such as IRD, Child, Youth & Family and businesses such as

banks, could also be affected by the outcome of the Work and Income case. “Depending on the individual circumstances of this case and the outcome, the case may set a high benchmark of what ‘all practicable steps’ means,” Ms Summerville said. “Interacting with members of the public who may become volatile is a risk that may require greater controls, for example restricted immediate access at entrances and glass barriers between employees.” The Public Services Association (PSA) has also come out in support of the decision to charge MSD. “Everybody has the right to go to work knowing they’ll be home safely at the end of the day,” PSA national secretary Richard Wagstaff said. “I don’t know if safety barriers such as glass or mesh are necessary, but all options should be considered,” he said.

Fire engine and police car rides for kids are set to become a thing of the past. According to Ashburton’s chief fire officer, children are no longer allowed to go for a ride in the big red engines. Alan Burgess cited tougher health and safety regulations for putting a stop to the rides. However, according to WorkSafe NZ, there are no specific rules around the activity. “It certainly has got considerably tighter in the way that any sort of amusement vehicle is used, and we’re using it in that format,” Mr Burgess said. “Like our vintage stuff, if we were to use that as far as the regulations are concerned, each person has to be seatbelted and we are not equipped to deal to that.” Mr Burgess said while there was “a bit of latitude” for operational vehicles, he was erring on the side of caution. “We’re quite happy to go and display the vehicles, let people sit in them, that’s fine,” he said. “But when you’ve got the chance of somebody popping out of a door or something, we will be taking the very cautious road.” Mr Burgess said it was sad the rides had stopped. “I can go back as a kid and remember getting a ride on it,” he said. “The reality of it is, it’s just a real shame the bureaucracy of the system now, and I’m talking about health and safety, it really does put the onus back on either the owner or the operator of vehicles.” Mr Burgess said he could not remember any local incidents during fire engine rides. “If you physically haven’t got them in your sight, and in the back of a fire truck you’re

Missing man found An Ashburton man who went missing in Whakatane has been located, police say. Robert Bennett, 27, was reported missing after he failed to show up at work on February 17. Mr Bennett, a former employee of Guardian Print in Ashburton, had not contacted concerned family or co-workers for two weeks. A Whakatane police spokesperson told the Guardian yesterday that Mr Bennett had been located in Whakatane, but said they could not provide any more details for privacy reasons. not always going to have them visible, it does make life a little bit tougher from that point of view,” he said. “And now the liability of those people that are operating those vehicles at any given time is just getting more and more onerous.” Ashburton police Senior Sergeant Scott Banfield said unless a child could be restrained as directed by transport regulations, they would not be getting rides in police cars. According to a WorkSafe NZ spokesperson, that sort of activity is covered by the general provisions of the Health and Safety in Employment Act – meaning all practicable steps must be taken to ensure people are kept safe. “There is nothing in the current law, or the Bill currently before parliament, that would prevent that sort of activity as long as sensible precautions are taken,” the spokesperson said.

HEALTH AND SAFETY REFORM BILL A new Health and Safety Bill could see some organisations forced to tighten up safety guidelines and practices, or face possible culpability. The Health and Safety Reform Bill, which is still before a select committee, seeks to make every workplace responsible for the health and safety of all workers. According to a WorkSafe NZ spokesperson, organisations that have a mix of voluntary and paid staff will be regarded as Persons Conducting a Business or Undertaking (PCBU) and have the same duties to those volunteers as they would to any other worker. Voluntary organisations that have no paid employees will not be covered by the legislation. “WorkSafe NZ knows volunteers make an important contribution to communities around New Zealand and the last thing we want to do is detrimentally affect volunteering under these reforms, as they are

aimed at targeting high risk activities,” the WorkSafe spokesperson said. The Salvation Army, which has both volunteers and paid staff, is one of the organisations that will be affected by the proposed changes. Ashburton Salvation Army Major Ken Smith said he was aware changes were being made to the rules, and he believed there would be some cost involved in implementing those rules. “I think if we can do things that make people safer in the workplace, and it holds people accountable, then it is necessary,” he said. “I know it’s comprehensive, and I’ve been told I need to look at it now so I can make allowances in my budget.” A WorkSafe NZ spokesperson said the bill was expected to come into effect in the second half of this year, provided it was passed in parliament.

Gallery opening Further delays have beset the opening of Ashburton’s new art gallery as a replacement air conditioning unit is delivered at a glacial pace. Initially scheduled for arrival in mid February, the Ashburton District Council has this week been advised it will arrive in Christchurch later this week. “The Christchurch arrival date is slightly later than initially planned and understandably this is frustrating for all parties,” senior communications adviser Nyia Strachan said. “From Christchurch the unit will be transported to Ashburton and installed. We don’t have a confirmed installation date from the air conditioning consultant at this stage.” Art gallery spokesperson Nicole Bourke said a decision on the gallery’s opening date would be made once the unit is installed and running.

Parents recognise V Path success An Aoraki Polytechnic programme that sees education break out of the classroom and into the real world has given Heath Fulton his first chance at academic success. The 17-year-old Mt Hutt College student is one of 160 students from secondary schools who are this year part of the polytechnic’s Vocational Pathways, or V-Path, programme. The programme is a partnership between the polytechnic and secondary schools which offers students, many who are at risk of dropping out of school, the chance to pass NCEA through industry training. It helps students see how their strengths, interests and achievements relate to future study options and job opportunities. Heath is studying Heavy Automotive. He spends three days a week at the polytechnic campus, and two days in hands-on training an Ashburton based company. His mum Cynthia said Heath has a learning disability which meant he struggled at school. V-Path had re-engaged Heath in education and he was hoping to secure an apprenticeship at the end of the course, she said.

“Heath was struggling to find suitable subjects at school. Having a learning disability is a huge mountain for him to climb. School really wasn’t his thing and it was really, really hard for him. “We were ready to pull him out of school when he was offered a place on the V-Path programme. “Heath is loving it. Working with his hands is really his thing. To see him go from strength to strength and not have to struggle is really fantastic.’’ This is Heath’s second year on the V-Path programme. Last year he studied Automotive, spending every Friday at the polytechnic’s Big Machines workshop. “The V-Path has given Heath an insight into the industry and what it entails. It’s given him a foot in the door,’’ Cynthia said. Vocational Pathways has been so successful that the polytechnic has expanded the programme this year. 15 Aoraki secondary schools had come on board – a huge tribute to the programme’s popularity and success.

Two international companies have applied for permits to prospect for oil and gas off the Mid Canterbury coast this year, much to the dismay of Ashburton Forest and Bird. An area off the Mid Canterbury coast is part of two petroleum prospecting permit applications that cover a much larger area off New Zealand’s east coast. The applications are currently being considered by the Crown’s permitting agency New Zealand Petroleum & Minerals (NZP&M). Searcher Seismic Pty Ltd have applied for an offshore permit that stretches from above Gisborne to Stewart Island, while Schlumberger Seaco Incorporated have applied for an offshore permit from Canterbury south to Stewart Island.

These two Hector’s dolphins were viewed off Wakanui Beach last week. The endangered species could be affected by seismic surveying, says Ashburton Forest and Bird.

The permits come within about 13 and 35 kilometres of the shoreline, east of Ashburton, respectively. The companies would employ large seismic survey ships that pull equipment emitting soundwaves below the surface of the water, to create a picture of the geology under the sea floor.

They would aim to sell the data to oil companies, which may bid for exploration permits in annual “block offer” tenders run by NZP&M. Companies gaining exploration permits can then undertake further seismic surveying and geological studies, which may lead to drilling a test well.

Acting national manger petroleum David Jeaffreson said while wells had been drilled onshore around Ashburton since 1914, and one offshore in 1975, there was no petroleum exploration in the area at present. He said any permits issued would be just “the first step in the regulatory process that can require approvals from a range of other agencies” such as the Department of Conservation. “This system creates a series of independent checks and balances to ensure petroleum development in New Zealand is undertaken safely and responsibly.” The granting of deep sea exploration permits has raised the ire of Forest and Bird nationally due to the dangers of climate change caused by the burning of fossil fuels. Deep sea exploration permits were issued for

several areas off North Island’s west coast and near Cook Strait last December. Forest and Bird Ashburton chairperson Edith Smith said additional to climate change concerns, there was scientific proof regarding seismic surveys emitting sound waves which impacted on communication signals between dolphins and whales. She had visited Wakanui just last week and observed two Hector’s dolphins. “Endangered Hector’s dolphin frequent our coastline and it would be hoped the survey would have no impact on these little mammals. It would be expected that there will be a consent process that will take these issues into consideration.” Schlumberger’s New Zealand office and Searcher Seismic’s Australian office did not return Guardian calls.

Banana lovers beware – Ashburton could be in the midst of Bananageddon. The district is at the mercy of macroeconomic forces that have slowed the supply of bananas from Ecuador and the Philippines. Ashburton New World has not received its full order of bananas for over a week following problems with its supplier, Dole. Store manager Devin Young said the shortage was being seen nationwide. “They’re rationing their orders,” he said. “If we’re ordering a certain amount, we’re probably only getting half the quota.” Dole’s New Zealand market representative Steve Barton said “a number of circumstances” had come together at the

same time to affect supply. “Primarily we had a storm through the farms a year ago, which has affected the fruit that has grown since,” he said. “In association with strong demand in all markets, particularly China, and a coinciding shortage from Ecuador, where we source some of our fruit.” “A number of things have come together, and production’s not coming off the farm as normal.” Mr Barton said supply should be back to normal by April. New World produce manager Brian Shimmin said the fruit was popular, with bananas contributing to nearly 10 per cent of the store’s produce sales. “It has had an impact on trade,” he said. A spokesperson for Countdown said they did not have a shortage of bananas, as they sourced stock from several countries.

The most at-risk communities may feel prejudiced if sexually transmitted infections (STIs) are added to the list of notifiable diseases, says the Mid Canterbury GP spokeswoman. The Health Protection Amendment Bill, which passed its first reading in November, would place HIV, gonorrhea and syphilis on the list of notifiable diseases.

Dr Charlotte Cox said her main concern about adding the three STIs to the list, which is intended to help health officers and local authorities keep track of diseases, was that the current situation may be made worse for those most in need. “The most at-risk, including gay and immigrant communities, can feel prejudiced and any service needs to address this,” she said. It was important, however, to

have good statistics to understand trends in disease and to make the service of diagnosis, treatment and contact tracing easy, she said. The Health Protection Amendment Bill has now been referred to the Health Committee, and submissions have now closed with a report due in May. While most sexually transmitted infections are not notifiable in New Zealand, The Insti-

Ashburton Art Gallery staff still do not have an operating art gallery, but that is not stopping them from encouraging creativity in their community. Communication/exhibition assistant Nicole Bourke is calling for entries from Mid Cantabrians for a gift card competition. The gallery plans on producing 10 limited edition cards featuring art works, with the theme Discover Art in Ashburton. The cards will be sold in the gallery’s gift shop once the gallery opens. “We ask local artists, children, designers and anyone with a great idea to fill out the entry form and send us a high quality image,” Ms Bourke said. Entrants were encouraged to interpret the theme in any way they wished, and the medium could be anything from paint-

Yesterday may have been damp and drizzly for much of Mid Canterbury, but the weather had had little effect on the district’s fire risk level. A total fire ban was lifted in the Ashburton Plains on February 21 and replaced with a restricted season. However, the district’s chief rural fire officer Don Geddes warned unless Mid Canterbury received some much needed rain, it was possible the ban could be reinstated. While grey clouds remained steadfastly overhead in the district yesterday, MetService recorded less than 1mm of rainfall in Ashburton. Mr Geddes said the small amount of rain had no effect on the region’s dry conditions. According to MetService, further showers are expected on Friday, and are set to continue into the weekend.

A Chinese tourist driver who nearly collided with a police car in Queenstown yesterday also had an unrestrained child in the vehicle. Sergeant Keith Newell of Queenstown police said the 36-year-old man was issued with infringement notices after being caught driving on the wrong side of Frankton Rd about 3.10pm. “He almost collided head-on with a police car.” One of the infringement notices related to an unrestrained 5-year-old child in the vehicle. St John Ambulance Ashburton operational staff are now sporting a dapper new look. The staff have discarded their old traditional white uniforms, for brand new dark green items. The changeover happened midway through last week, with Canterbury one of the last districts to get the new uniforms. St John communications advisor Ian Henderson said the uniforms have now been rolled out to all St John operational staff throughout New Zealand. The new look is comprised of a dark green shirt, white under-shirt and dark green trousers. St John Ashburton paramedic Donald Harborne welcomed the change.

“I actually like it, it’s more practical,” he said. Mr Harborne is no stranger to switching from one uniform to another. He had seen four uniform changes in his time – from black and white, to blue, to white and finally now, green. The traditional white uniform was in use for about 17 years. Mr Harborne believed the change was partly to do with health and safety, as green was an internationally recognised colour. St John Ashburton paramedic Robyn Kelland said she too liked the new uniforms. Not everyone upgraded though, the shuttle staff and other areas of the St John team will continue wearing the traditional black and white uniform.

Teina Pora free after 20 years The Privy Council in London has quashed Teina Pora’s convictions for the rape and murder of Susan Burdett in south Auckland in 1992. The decision means that Pora is a free man. His parole conditions immediately fall away. The former star schoolboy rugby league player was released on parole last April after spending 20 years in prison. The news was broken to Pora

by his support team, which includes private investigator Tim McKinnel and lawyers Jonathan Krebs and Ingrid Leary, about an hour before the decision was announced by the Privy Council. Pora watched the decision delivered by live feed from London surrounded by supporters at a private home in Auckland. Solicitor-General Michael

Heron, QC had no immediate comment. The decision was reached by a panel of the Judicial Committee of the Privy Council made up of New Zealand chief justice Dame Sian Elias and four law lords. Pora was 17 and the father of a toddler when charged with the crimes and imprisoned on remand. He is now a 39-yearold grandfather. - NZME

Port worker injured A Lyttelton Port worker’s been hospitalised after falling several metres on a ship. Lyttelton fire crews were called to rescue the worker just before 9am yesterday, after he fell two metres through an open hatch on a container vessel, NewstalkZB reported. He was in a stable condition in Christchurch Hospital. Maritime New Zealand will be investigating the incident. This latest incident follows a raft of injuries at the port. Last week, WorkSafe New Zealand announced it was pressing charges over the death of port worker Brad Fletcher last year. The 40-year-old Maritime Union branch president was killed when a large scissor lift he was operating toppled to the ground in August. - NZME

South Island’s top rose growers vying for glory

Man’s leg crushed A young man whose leg was crushed under a tractor has been airlifted to hospital by a specialist team. The Waikato Westpac Rescue Helicopter service said it was dispatched to transfer the man to Waikato Hospital about 2pm yesterday. The man had initially been flown to Gisborne Hospital after the accident but needed to be flown to Waikato for further treatment. The Waikato helicopter carried a specialist intensive care unit to transfer the man. - NZME

Hundreds of roses will be out in bloom this weekend in Ashburton. Hosted by the South Canterbury Rose Society, the South Island Rose Show is set to take place in Ashburton for the first time this weekend. Past president of the South Canterbury society, Pauline O’Leary said the show will be held at the Ashburton Trust Event Centre with 70 entrants from all over the South Island set to compete for the coveted wooden shield. “We will have a good crowd,” she said. South Canterbury currently holds the shield but Mrs O’Leary said competition was tough. “We always like to think we will [keep it] but there’s always competition,” she said. Each rose society pools their roses, and submits one entry per class, of which there are 12 in total. The competition is based on points which are distributed throughout the 12 classes, and there are also special classes which require the contestants

Facing five charges A man arrested after allegedly assaulting and setting his dog upon a police officer on Monday has appeared in court. Justin Taylor, 40, a seasonal worker, appeared in the dock in the Palmerston North District Court yesterday with his arm in a sling. He did not have legal representation but told the judge he would have someone attend his next appearance. Taylor is facing five charges, including three charges relating to Monday’s incident outside the Foxton Winz office on Main St. Those charges include causing grievous bodily harm to an officer, failing to stop for police and wounding with intent. He is also facing two charges relating to an incident on January 29, from which the defendant is alleged to have escaped police custody. During his appearance, Taylor repeatedly claimed he was “sovereign”. - NZME

Fostering couple’s labour of love BY CAITLIN PORTER

Elaine Mowat, a mother to nearly 150 children, has been involved with foster care for over 30 years. This week is Foster Care Awareness Week, a chance to celebrate the extraordinary contribution of foster carers, such as Mrs Mowat, all over New Zealand. The Maronan resident, along with her husband Gavin, started fostering in South Canterbury when the couple were asked to assist with caring for a young solo mum’s 18-month-old child. From there, children came for time out from their families – many of whom had been physically, sexually and mentally abused. Many had issues with drugs and alcohol abuse and came from all walks of life, she said, not just lower socio-economic groups. Mrs Mowat and her husband never stopped the children from being able to contact their families. “We never tried to take away their heritage.” The most important thing about foster care, is of course, the chil-

dren, she said. “Children need someone to listen, give them love, encouragement, security, stability and discipline to build self-esteem.” During the past 30 years, Mrs Mowat and her husband have fostered up to 150 young people, treating every one the same as if they were their own family. “We are private people, we have done it for the love of children, we both had good family upbringings and close family for support,” she said. Mrs Mowat credits her husband for all of his support throughout the years, as he acted as a male role model for many of their foster children. Mrs Mowat’s efforts were recognised back in 2004 when she won the Barnardos Mother of the Year award. It’s certainly not an easy job though, she said. Now, Mrs Mowat continues to look after her family but has stepped back from foster care, instead spending more time with her grandchildren.

Tourist crash driver lost partner in motorbike smash BY KURT BAYER She came to New Zealand to recover from depression brought on by her partner’s death in a motorcycle crash. Instead, Chia-Fang Chu’s grief has been compounded by the death of her father in a collision brought on by a “momentary lapse of attention” on unfamiliar roads. The 39-year-old Taiwanese tourist admitted charges of careless driving causing death and careless driving causing injury when she appeared in Christchurch District Court yesterday. Chu had been driving her family to Christchurch Airport after a fortnight tripping around the scenic South Island when she failed to see a stop sign on February 18. Her 66-year-old father Fu-Hwa Ju – who had suggested the holiday to try to help Chu recover from her partner’s death – died in the collision with a 4WD vehicle near Templeton. Chu’s mother, Mei-Yu Chu Yeh, received multiple rib injuries, pneumothorax, liver laceration and a fractured scapular. Chu’s two children, her cousin and her child were uninjured. In court yesterday, Chu’s lawyer Josh Lucas said the accident had been a “momentary lapse of attention” and a mistake that could’ve been made by any nationality, including New Zealanders. Judge Tony Couch remanded Chu on bail until Friday. It comes after a horror period on the roads involving foreign drivers.

Twelve people died in crashes caused by overseas licence holders last year, according to provisional New Zealand Transport Agency (NZTA) data. There have already been several fatal crashes and more near-misses this year – including eight deaths in as many days last month. In response, New Zealanders have been taking the law into their owns hands and dispensing vigilante justice. Police are aware of five occasions where concerned motorists have taken keys off rental car drivers. In the latest incident, an incensed Dunedin man snatched the car keys from a tourist who had stopped to take photos on Otago Peninsula, causing eight vehicles to back up on the narrow road. But legal experts, police, the Ministry of Transport, the Rental Vehicle Association and even Prime Minister John Key have warned against the practice. Dr Chris Gallavin, dean of law at University of Canterbury, described taking keys off drivers as “highly risky behaviour”. “You’re exposing yourself to trespass actions in civil law, allegations of theft, and the prospect of things escalating to the level of being assaulted, or assaulting somebody.” He believes police might soon make a “symbolic arrest” to send a signal that the practice won’t be tolerated. Police advise motorists to phone 111 or *555 or film bad driving while waiting for officers to arrive. - NZME

The proposed Air Plan is the culmination of a long-term process to work with the community on an effective strategy to ensure the region’s air quality meets the national health-based air quality standards. This feedback along with work with our partners and stakeholders has informed the further development of the proposed Air Plan which includes measures to manage air quality through reducing pollution caused by home heating, outdoor burning, industry, odour and dust. Safety first for MSD’s court date Stu Oldham

veryone has the right to go to work knowing they will be home safely at the end of their shift. They deserve protection from expected hazards and to have measures in place to meet the unexpected. These should be the basic expectations for every workplace, even if some are harder to plan for than others. This is especially the case when dealing with some of the most unpredictable of potential hazards: people. People are capable of doing just about anything, at just about any time and without perceptible warning. It follows that workplaces dealing with people should plan for the unexpected no matter how over-the-top it seems. All risks, no matter how unlikely, should be considered and minimised. This is worth bearing in mind when considering WorkSafe’s decision this week to charge the Ministry of Social Development in the wake of the Ashburton Work and Income shootings. The charge alleges the ministry failed to take all practicable steps to ensure the safety of its employees. It has been laid after an investigation WorkSafe conducted soon after what happened. Conversely, the ministry commissioned an independent review last year which found it had taken all practicable steps to ensure the safety of its employees. It has pledged tougher security will be the norm. It was clear from the outset that the shootings would have long-lasting, far-reaching repercussions for the public service. Now, court action may establish a new benchmark for workers’ safety. This might mean a social service – the sort of service that often needs humanity and personality – might soon be conducted behind screens and with obvious security. Impersonal measures will protect personnel from the people they are trying to help. Whatever the case, there is clearly a conflict between the findings of the MSD’s independent review and the investigation WorkSafe conducted after the shootings. A court date, no matter how distressing, will determine how well the ministry planned for the now, lamentably, expected unexpected.

f you are thinking about buying a property, it’s strongly recommended that you get a Land Information Memorandum before finalising the purchase. What is a Land Information Memorandum? Known as a LIM for short, it is a report prepared by council staff that contains all relevant information the council knows about a property or section. It can include historical, as well as current, information and can be requested for any property, whether it is commercial, rural or residential, with buildings or without. LIMs typically include the following information: ■ Special land features or characteristics such as erosion, subsidence, slippage, flooding and possible contamination. ■ Information the council holds on stormwater and sewerage drains. ■ Rates (including any rates that may be owing). ■ Any consents, notices, orders or requisitions affecting the land or build-

This includes details of building consents and resource consents. ■ District plan zoning and any special provisions that relate to the land or buildings. ■ Any other information notified to the council by statutory organisations in terms of any other legislation, or by network utility operators (eg power companies) in relation to the Building Act. Councils are required by law to produce LIMs upon request within 10 working days. In any given month the Ashburton District Council produces between 50 to 80 LIMs. In our most recent report to the council’s environmental services committee meeting on February 5, officers reported producing 70 LIMs for the month of December 2014. That brought the

total for the year to 745 LIMs. The year before we produced 861. With the volume of work we have on at the moment, it usually takes about six to seven working days to receive a LIM. The cost for a residential LIM in Ashburton is $248.40 and $496.80 for a commercial LIM. When we consult on our fees and charges for 2015/16 in a few months’ time we will be proposing that these fees remain unaltered. By comparison Timaru charges $280 for a residential LIM and $385 for a commercial LIM. Occasionally people try to save money by visiting the council office and searching through the property file themselves instead of requesting a LIM. Be warned that this is not a good idea. Council holds numerous records electronically; a search of the hard copy information in the property file will only give you some of the information you need and in many cases it may not be the most up-to-date information council holds. If you are buying a section,

the LIM will tell you whether or not the water and wastewater connections have been paid for and what the cost is. Many people think that because they are buying a “serviced” section the connections have been paid for, however that is not usually the case. Ashburton District Council charges for these connections when the building consent is issued. These charges are called development contributions and are levied in accordance with council policy. The amount payable ranges from around $1500 to $5500 depending upon the section’s location in the district. In Chertsey, for example, the development contributions total $3697 whereas in Methven they total $5493. Going forward, the council’s overall strategy is to provide as many services as possible online. In the near future customers will be able to apply for and receive LIMs online. Execution ‘within days’ By GaBrielle Dunlevy Myuran Sukumaran and Andrew Chan will be transferred to a penal island for execution very soon, Bali’s prosecutor says. Momock Bambang Samiarso was meeting other authorities in Bali yesterday to co-ordinate the move of the Bali Nine pair. “If not tomorrow, the day after,” he told reporters. “There’s still various preparations (needed). “The most important thing is they be moved immediately.” In Jakarta, Attorney-General HM Prasetyo said preparations for the executions on Nusakambangan island were “95 per cent” complete. “We will do it when all preparations are truly finished because we evaluated from the previous executions that a few things need to be perfected,” Mr Prasetyo said.

On Monday, the attorneygeneral rejected the idea the executions should be delayed for drug offenders - such as Chan and Sukumaran - who have legal appeals pending. “If there’s already clemency (rejected), there should be no more other legal challenges submitted,” he told reporters. “What else? “They have admitted they’re guilty, they have accepted the sentence, and then they asked for forgiveness. “Then the forgiveness is not given, that’s the last decision.” Lawyers for Chan and Sukumaran were on Monday lodging an appeal against their latest court loss in the Jakarta administrative court. Some of the other eight to be executed also have future court dates. Chan and Sukumaran’s barrister, Julian McMahon, warned that sending them for

Netanyahu, Obama spar over Iran deal By Stephen Weizman Barack Obama and Benjamin Netanyahu sparred over Iran’s nuclear program yesterday, with the US leader pointedly warning that the Israeli premier had been wrong about the issue before. On the eve of a landmark speech to the US Congress, Netanyahu declared that a US-Iran deal on curtailing Tehran’s nuclear ambitions “could threaten the survival of Israel.” He spoke even as US Secretary of State John Kerry and his Iranian counterpart Mohammad Javad Zarif met in Switzerland for three days of talks. But Obama and his leading foreign policy officials did not leave the field to the Israeli leader, insisting their plan was the best way to contain Iran’s alleged threat. Obama and Netanyahu both insisted the traditional alliance between their countries remains strong, but the US leader pointedly criticised the Israeli’s previous declarations. Referring to criticism of a previous interim US-Iran deal that paved the way for this week’s ongoing talks in Switzerland, Obama said: “Netanyahu made all sorts of claims. “This was going to be a terrible deal,” he told Reuters. “This was going to result in Iran getting $50 billion worth of relief. Iran would not abide by the agreement. None of that has come true.” Netanyahu’s lobbying trip to Washington culminates today with the address to Congress. He was invited by Speaker of the House John Boehner, one of Obama’s leading Republican opponents, and he accepted with neither party informing the White House. - AFP

Killings shock town When three gunshots echoed through the sleepy rural Queensland town of Biddeston late on Sunday night, residents assumed the bullets were aimed at kangaroos. None could have imagined the horrific scene to be discovered in a low-set brick home, about 20km west of Toowoomba, the following evening. The bodies of a 27-year-old pregnant woman, her seven-year-old son and a 52-year-old man, believed to be her father, were found by a female relative. Police have said the man’s death wasn’t considered suspicious, but stopped short of describing the tragedy as a double murder-suicide. - AAP

Shooting defended The Los Angeles police chief has defended officers who shot dead a man in the Skid Row homeless district, after a video of the killing went viral, triggering widespread condemnation. Under intense pressure over the incident - just the latest to put police tactics in the United States under the spotlight - Charlie Beck said video evidence showed the victim reached for one of the police officers’ guns just before to the fatal shots were fired. “While on the ground and struggling with the officers, the man forcibly grabbed one of the officers’ holstered pistols, resulting in an officer-involved shooting,” Beck told reporters. - AFP

Yahoo marks 20 years Yahoo is celebrating its 20th anniversary with a look back at its history and an eye to the future of the internet pioneer in the midst of a transformation effort. On its home page yesterday, Yahoo displayed an animated birthday cake as part of its logo, and the company launched a series of events marking its trademark “Yahoo yodel”. Yahoo was incorporated on March 2, 1995 by two Stanford University electrical engineering students, Jerry Yang and David Filo, who originally called it “Jerry and David’s Guide to the World Wide Web”. They renamed it Yahoo, jokingly saying it was an acronym for “Yet Another Hierarchical Officious Oracle”. - AFP

Bomb blast kills two Two people have been killed and nine wounded, including seven policemen, in a bomb explosion outside the Egyptian supreme court in Cairo. Ministry spokesman Hossam Abdel Ghaffar said that a 22-year-old man “died of injuries sustained in his backbone” in Monday’s attack. Another man, aged 24, who had suffered head injuries and internal bleeding, also died of his wounds, he said. - AFP

‘Cold case’ rape Karl Boyd Bryhn lured a prostitute to a house in Perth, handcuffed her and then dragged the woman to a vacant block where he repeatedly raped her. More than 20 years later, Bryhn was finally caught after a cold case review of DNA evidence linked him to the July 1994 crime. After pleading guilty to five offences, Bryhn was sentenced in the West Australian District Court yesterday to six years and nine months behind bars. - AAP

Bryers running out of time BY FIONA ROTHERHAM Mark Bryers, bankrupted in 2009 owing $230 million, is running out of time to get back on his feet, his lawyer told a High Court hearing seeking to discharge the former boss of Blue Chip. Associate Judge Jeremy Doogue reserved his decision at the end of a two-day application by Mark Bryers for discharge from his 5 1/2-year bankruptcy. His lawyer, David Chisholm, QC, said 57-year-old Bryers was at an age where he needed to re-establish himself.

“He needs to get back on his feet again, before it’s too late,” Chisholm told the court. The court was told Bryers’ debts were unrelated to Blue Chip’s 2011 collapse, and were a result of personal guarantees he had made to financiers for third-party property developments and to Mide, the New Zealand franchisee of Australian-based Blue Chip Financial Solutions (later Northern Crest) which were never pursued by the parent company. the end of employment. She claimed that she decided to raise a grievance on September 2, however her solicitor was away until October 1, which accounted for the delay in raising the grievance. The authority member stated in the decision: ‘I do not accept this so affected or traumatised her that she was unable to properly consider raising a grievance within 90 days.’ Although Mrs Lowe had contacted her doctor about the stress she was feeling, the authority noted she was able to prepare affidavits and other documents for her husband’s personal grievance during this period. The authority also noted that Mrs Lowe did not decide to raise a grievance until 27 September, and this decision related to the employer’s response to Mr Lowe’s personal grievance and the umbrage she took to what she saw as an accusation of her being untruthful. Irrespective of the outcome the whole scenario is a sad way for 45 years of a relationship to end.

fter living on Waimapu Station for 45 years as a casual employee working with her husband who managed the farm, Margaret Lowe’s employment relationship ended with her ultimately raising a personal grievance. This case unfortunately demonstrates how quickly relationships can sour, however it also shows that sour grapes is not a justifiable reason for a personal grievance to be raised outside of the usual time constraints. Mrs Lowe’s employment ended on or about August 14, 2014 when her and her husband left the farm. On 20 October 2014 she raised a grievance claiming she had been disadvantaged by actions of her employer, which occurred on June 30. The claim was 112 days after the incident. Ordinarily an employee must raise a grievance within 90 days of the event occurring or becoming aware of an event. Unless an employer agrees to a grievance being raised out of time an employee can only do so in exceptional circumstances. Those exceptional circumstances include occasions where the employee has been so traumatised they were unable to properly consider raising a grievance in time, their representative failed to raise the

Over-ripe bananas? Don’t biff, bake instead

O

ut of all the fruits that grace our fruitbowls, bananas are not only the most widely available, they’re probably the most universally liked. There are dozens of definitions of what makes a good banana, ranging from one that is on the green side of ripe to the banana that’s on the opposite side of the ripeness scale. One thing all bananas have in common is that when they’re brown or black, they’re overripe, but unlike many fruit that are only worth composting at the over-ripe stage, bananas come into their own for baking.

Banana chocolate loaf 100g butter 1C sugar 1 egg 1 1/2 C flour 2T cocoa powder 1/2 t baking powder 2 bananas, mashed 1/2 C chocolate chips 1t baking soda 1C warm milk ■ Preheat oven to 180°C. ■ Grease and line a 24cm loaf tin. ■ Beat butter and sugar until pale and creamy. ■ Add egg and mix well. ■ Add sifted flour, cocoa powder, baking powder, mashed bananas and chocolate chips. ■ Dissolve the bak-

ing soda in warm milk, then add to the mixture. ■ Pour into prepared tin. ■ Bake for 50 to 60 minutes until loaf tests cooked. ■ Cool for 10 minutes in the tin before turning out.

Banana muffins 1 1/2 C flour 1t baking powder 1/2 t baking soda 3/4 C brown sugar (well packed) 150g butter, melted 2T golden syrup 2t vanilla essence 3/4 C mashed banana 2 eggs ■ Preheat the oven to 220°C. ■ Grease muffin tins or use muffin tin liners. ■ Sift the dry ingredients together and make a well in the centre. ■ Melt the butter and golden syrup together. ■ Add the vanilla essence and bananas to the butter mix. Then add the eggs. ■ Pour the liquid mixture into the dry ingredients and mix until just combined. ■ Spoon the mixture into lined or greased muffin tins. ■ Bake for 12 minutes or until a skewer comes out clean.

2t baking powder 1t baking soda 1/2 C milk Icing: 1/3 C smooth peanut butter 1/3 C milk 1 1/2 t vanilla extract 3C icing sugar

■ Preheat oven to 180°C. ■ In a large bowl, cream butter and sugar until light and fluffy. ■ Add eggs, one at a time, beating well after each addition. ■ Beat in bananas and vanilla. ■ Combine flour, baking powder and baking soda; add to creamed mixture alternately with milk, beating well after each addition. ■ Transfer to a greased 33x23cm baking pan. ■ Bake 30-35 minutes or until a toothpick inserted in centre comes out clean. ■ Cool on a wire rack. ■ In a small bowl, beat peanut butter, milk and vanilla until blended ■ Gradually beat in icing sugar until smooth. ■ Spread over cake.

Easy banana bread 4 super ripe banana (mashed 1 1/4 C) 1/3 C melted butter 1C sugar 1 egg, beaten 1t baking soda 1t vanilla pinch of salt 1 1/2 C flour

125g butter, softened 3/4 C caster sugar 2 large eggs 2 large bananas, mashed 1/4 C hot milk 1t baking soda 2C self-raising flour 1t ground cinnamon 1/2 t ground ginger ■ Preheat the oven to 180°C. Line a 20cm round cake tin with baking paper. ■ Place the butter and sugar in a bowl and beat until the mixture is light and fluffy. ■ Add the eggs one at a time, beating well between each addition. ■ Add the mashed bananas. ■ Combine the milk and baking soda and stir to dissolve. Add to the creamed mixture. ■ Fold in the sifted flour, cinnamon and ginger. ■ Turn the mixture into the prepared tin. ■ Bake in the preheated oven for 45 to 50 minutes or until a skewer inserted into the centre of the cake comes out clean. ■ Remove from the oven, leave in the tin to cool slightly then remove the cake from the tin and cool on a rack. ■ Ice with lemon icing or cream cheese icing.

Greta Casey-Solly followed her dreams to Australia three years ago, now she’s back in New Zealand to continue the journey. The 20-year-old Methven singer, dancer and actor’s latest project is taking the role of Rizzo in the Variety Theatre of Ashburton’s upcoming production of Grease. Miss Casey-Solly left the comforts of home at the end of Year 12 at Mount Hutt College to complete her high school

education at Brent Street Talent Development High School in Sydney. She then moved to Melbourne to undertake a Diploma of Musical Theatre at APO Arts Academy. Upon completing the diploma two years later, Miss Casey-Solly said as much as she loved Australia, she suffered from homesickness and missed her dairy farmer parents and younger siblings. However, her yearning to go home was not such a bad thing for her career, as she was able to enroll at Christchurch’s Na-

tional Academy of Singing and Dramatic Art (Nasda). She was accepted into the second-year intake for the three-year Bachelor of Performing Arts in Musical Theatre. Miss Casey-Solly said she was pleased she was going to be able to get a degree in her chosen profession, a qualification which will segue into teaching if that’s what she decides to do. Her main goal is to just keep performing, and break into a career involving stage or film and television. She knows more than anyone that that is not the

easiest thing to do. “It’s very, very challenging. You have to be so disciplined and motivated, but it’s exciting at the same time.” Miss Casey-Solly is a keen singer and writes her own music, mainly in the folk and blues genres. She said she was enjoying Grease rehearsals and playing the role of Rizzo. She said she could relate to the character of the “tough” Pink Lady character, as while she had plenty of swagger she was also “quite vulnerable”.

Museum reopening boosts Iraqi pride Even as Iraq mourns the destruction of priceless artefacts by jihadists in Mosul, the national museum in Baghdad has brought joy and pride to visitors by opening its doors for the first time in 12 years. The public opening at the weekend was brought forward in response to a video released last week by the Islamic State group showing militants destroying statues in Mosul. Many of the pieces on display in Baghdad were among the 15,000 looted when mobs ransacked the museum during the plundering spree that gripped the capital when US forces toppled Saddam Hussein in 2003. The blow was cataclysmic for

an archaeological collection until then considered to be one of the world’s richest. Close to a fifth of the stolen artefacts have been recovered. Around 100 visitors trickled into the national museum on Sunday morning - the start of the work week in Iraq - as the reopening took Baghdad by surprise. Like many visitors, education ministry employee Umm Ahmed was a first-timer. “I always felt I should see the museum,” said the middle-aged woman, wearing a black cardigan and a beige headscarf. “These are masterpieces. I have never felt so proud,” she said, slowly walking along a

spectacular relief of nine huge slabs depicting Assyrian king Sargon. Hassan Ali and his two friends rushed to the museum because they wanted to see an artefact representing Ur-Nammu, a Sumerian king who ruled 4000 years ago and is credited with giving the world its first legal code. “We are proud that these civilisations were in our country.” Last week’s footage of IS militants in Mosul gleefully smashing ancient statues with sledgehammers and defacing a colossal Assyrian winged bull at an archaeological park with a jackhammer shocked Iraqis and the rest of the world. Museum

staff and archaeologists worldwide rejoiced at the fact that Iraqis, for an entrance fee of $US1, will be able to see their country’s greatest heritage treasures without travelling to the Louvre in Paris or to London’s British Museum. “It will make accessible to the Iraqi people and to the world community the unparalleled collections in its galleries, which have been mostly unseen for a generation,” said Charles E. Jones, a US professor at Penn State University who has worked on the recovery of artefacts looted in 2003. “It is one of the great national museums of the world.” – AFP

In brief Big finish for softballers The Mid Canterbury under 15 boys’ softball team finished the South Island Tournament on a high in Blenheim at the weekend. Mid Canterbury finished the fourday tournament, the first team to attend such a tournament in two decades - by beating Central Otago 15-8. They had lost all seven games in pool play before the win over Central Otago but gained valuable experience of what the next level of competition, above club, is all about. On day one they were beaten by Nelson 2-9 Canterbury 3-13 and eventual winners Canterbury 0-9. Day two had a losses to Southland 1-10, Marlborough 0-12 before another two defeats on day three, 7-18 to Central Otago and 5-18 against Otago. Canterbury beat Marlborough 4-3 in the final.

Taylor moving away Three-test All Black and Crusaders utility back Tom Taylor has signed a deal with French club Bayonne. The 25-year-old, who made his debut for the All Blacks in the No 10 jersey against Australia in 2013, has signed a three-year contract with Bayonne and said he is not discounting returning to play in New Zealand again one day. He has struggled for regular game time at first five-eighths with both Dan Carter and Colin Slade also at the Crusaders. - NZME

Ranger moving back Former All Black Rene Ranger is to return to the Blues next season and will be available to play for North Harbour in the ITM Cup this year. The 28-year-old has gained an early release from his contract with French club Montpellier after two seasons. Ranger scored 25 tries in his 65 Super Rugby caps for the Blues, enjoying six caps for the All Blacks. He has become a fan favourite with Jake White’s Montpellier side, scoring six tries in his first 15 games. He said his return to New Zealand is primarily for family reasons. - NZME

Hayne joins 49ers Jarryd Hayne has 20 weeks to prove he has what it takes to make it in the NFL after picking up a rookie contract with the San Francisco 49ers. The Detroit Lions and San Diego Chargers had also shown interest in Hayne, but the 49ers were the only franchise to offer him a contract guarantee of US$100,000. “It feels surreal,” Hayne said. “This is a small step in the right direction, it all starts now.” - AAP

NZers climb rankings New Zealand’s strong performances in the World Cup are reflected in the latest ODI rankings. Tim Southee, on the back of his splendid seven for 33 against England, is the leading wicket taker in the cup, with 13. That has enabled him to climb 10 places to 12th. Fast start a good thing? The Black Caps have got off to a flier in the World Cup, winning their first four games to sit top of pool A. It’s a great start, but it’s worth asking whether fast beginnings are always (or ever) bellwethers of future success. Saturday’s exhilarating win over Australia lit a fuse of excitement across the country, with many people, including former players, experts, pundits and punters, daring to call New Zealand favourites to take out the tournament. The prediction is a cautious one at the moment, but the fact the Black Caps are even being talked about in this way shows just how far this New Zealand team has come under Brendon

In only one of those tournaments had New Zealand won their first four games. That was in the West Indies in 2007,

To round out the analysis, it’s worth asking whether the four-game mark provides any sort of barometer on the chances of success. In 2011, India won the World Cup having tied their second game against England. Australia triumphed in 2007 and 2003 having won their first four games on the trot. But then again, the Australians also managed to take the spoils in 1999 after losing to New Zealand in their second game and Pakistan in their third game. Qualifiers revel in lightning-fast Ashburton track The four horse field negotiate the home straight in Indian file on the first lap of the Qualifying Mobile Pace that had Franco Cristiano kick home for the win at yesterday’s Mid Canterbury Trainers and Owners trials. Three of the four runners clocked a qualifying time, bettering the mark of 3:10.00. Driver John Dunn was able to steer Franco Cristiano to the line in 3:05.6 to win by one-and-a-half lengths from the James Geddes-driven Bontz. It was then 10 lengths back to She’s A Flyin and Terry Chmiel, but that horse was still inside the qualifying time.

She’s Insatiable has the form Mount Somers-based trainer Terrill Charles has She’s Insatiable racing in the 500,000 Group I Barfoot and Thompson Auckland Cup at Ellerslie Racecourse today. The gruelling 3200m handicap race for any aged horse was first run back in 1874. Jockey Chris Johnson will be on board the six-year-old bay mare that is enjoying a strong season to date, collecting two wins from nine starts thus far. The horse was also third in the Group 3 New Zealand Cup over 3200m in Christchurch

in November, and third in the Group 2 Wellington Cup in January. However, She’s Insatiable was underwhelming in her last visit to Ellerslie, coming home 12th in a field of 17 in the 2400m Avondale Gold Cup last month. As of 5pm yesterday, Benzini and Rock Diva shared the favourites tag, both at $5 at the TAB, with She’s Insatiable out to $31. After leading for most of the match, the Ashburton College A netball team went down to St Margaret’s 19-21 at Horncastle Arena in Christchurch on Monday night. Playing in the curtain raiser to the Mainland Tactix ANZ Championship game against Northern Mystics as part of the nationwide college netball knockout competition, Ashburton College went close to a first round upset. Ashburton District Council publicly notified its provisional Local Alcohol Policy (LAP) on 3 March 2015. The provisional LAP is available on our website, from the Council office or the public library.
