FROM THE CEO’S DESK 4th Quarter Fortunes or Foibles? Hold on to your Halloween hats ladies and gentlemen - October marks the beginning of the 4th and final quarter of 2014. As we work through this 4th quarter, let’s be clear that our efforts now and until the end of the year (or our lack of efforts) will have a direct and lasting impact on our start for 2015. The AAR takes our members’ success very seriously and even though we’ve already provided a record-breaking number of classes and events this year we’ll be offering even more classes and events with a focus on legal and technology classes. The AAR is doing this in an ongoing effort to help you finish the year strongly and to help you prepare for 2015. So please read our weekly eCommunication emails now sent on Saturday mornings, this publication, our Facebook, Twitter and LinkedIn accounts and also our events calendar at www.TheAAR.com to remain aware of what we are offering. To close out this month’s article, I’d like to share an interesting story I read in a book aptly titled “Goals” written by Brian Tracey: In a Harvard University experiment, a graduating class from the university was asked about their goals they had for their life upon graduation. 10 years later, when the professors followed up with the same students, they discovered that those students who had only thought of their goals in their heads were earning twice as much as the students who had no goals after graduation. Further, it was determined that those students who had clearly defined and written goals upon graduation were earning 10 times as much as the other two groups combined. I leave you with this as a factual illustration on how important it is for us to create our goals. Let’s establish those goals starting now - If we wait until January it’s too late. Attorney Comments October 2014

By Dave Freeman, Association Counsel SWIMMING POOLS - LANDLORD’S DUTY OF CARE: In a stunning decision, the Appellate court recently ruled that a landlord was responsible for protecting from the possible danger to a four year old child, who was a guest of the tenant of a rented house. The mother of the child, who was not present when the child drowned, sued the real estate agent and the landlord, but not the relatives of the child, including the father and grandmother, who were present. The court, reasoned that the landlord should have foreseen that the tenants would have guests with children and that the protection was inadequate. (There was a six-foot fence around the pool, a sliding glass door from the house and an exterior security gate, without a self-locking device). There is another case that ruled the Homeowner had no such liability, but the solution is obvious: Do what you can to prevent the danger; install a self-latching device where there may be children around a pool.

ONE BITE AT THE APPLE: Another case that appears to exhibit the court’s prejudice against landlords ruled that a landlord could not sue two of the three tenants who breached a lease, although all three tenants signed the lease making them each liable for the whole rent, up to the amount owed ( no doubling of the collection). One tenant originally sued the landlord, and the landlord cross-complained against all three, but did not serve two of them. The landlord won a large judgment vs. the one tenant (commercial lease, long term, breach), then sued the other two. The court ruled you must sue all at the same time if: - The earlier case involved the same claim. - The earlier case went to a final decision. - The (Landlord in this case) was a party in the first case. Solution: Be sure to include all possible parties that you may later want to include, at the start of the case. This is why lawsuits often include

seemingly irrelevant parties. BUYING YOUR OWN LISTING: This will get the courts on you every time, no matter how fair the deal is, if the seller later gets seller’s remorse. Don’t do it. It will appear that you took advantage of the client, didn’t properly advise of the true value and didn’t properly advertise the property. The agent lost every such case I have seen or read of, even if the client came to you and stated the price desired. The better solution is to not list the property, don’t show that you are reducing the price by the commission, and do suggest the seller consult with an unrelated (different brokerage) agent and/ or attorney. It is possible to negotiate a lower price, if there is no agent involved. But don’t make yourself the seller’s agent (with fiduciary responsibility) by showing any wording reflecting a commission.

Scott Burtz Memorial Charity Golf Classic Tournament The Arcadia Association of REALTORS Events 4 Charity Auxiliary recently hosted the AAR’s Annual Scott Burtz Memorial Charity Golf Classic Tournament. The event was again held at the Glendora Country Club in Glendora. The tournament was an amazing success in raising money which will be distributed during the holidays to many needy local charities. In addition to the money raised, all who attended had a great time!
