YPN members have found that can be a great way to find an agent in a specific area that their client might be looking in. In the past if we had a client who was moving out of state there were only a few options to finding an agent to refer your client. FROM THE EVP’S DESK Mulling the Mulligan One of my wife’s college friends is turning 40 this month and the entire gang is invited to their home in La Quinta for a birthday celebration. While there, the men are planning a golf outing and they asked me to play. This is funny in itself because I don’t play golf. And what’s even funnier to me is playing golf in the California desert in the middle of July. They tried to persuade me anyway by saying they’d give me a few “Mulligans” to get me through the day. I asked if a mulligan is something that lowers the temperature by 40 degrees. Apparently it isn’t. I was was told a mulligan is when you are given a second chance to make up for a mistake or a poor shot. I wondered to myself if this is only limited to golf. I sure could use a few mulligans when it comes to buying my wife her birthday and anniversary presents. This mulligan thing got me thinking how the month of July is very significant from a business standpoint. July represents the beginning of the second half of the year. If you aren’t pleased with the first 6 months, July is the perfect time to play your “mulligan” and start over again. It’s the ultimate opportunity to make a behavioral or attitude change and to reassess your goals. You can choose to think, “Oh no, I can’t believe the year is half over already where has it gone?” or you can opt for “This is exciting – I still have half the year to produce more sales!” When you think of it in that perspective, which thought process is more conducive to positive sales activity? One of the easiest ways of igniting a behavioral change is to start participating in educational opportunities – or participating in more of them. As an association, it’s our job to provide world-class events, education and career-building opportunities for our valued AAR Realtor® and Affiliate members. As members of the AAR, it’s the responsibility you have to your business to attend these world-class events, education and careerbuilding opportunities. Year-to-date we’ve already offered 67 events to help you grow your business. How many have you attended? We promote these events with every conceivable communication tool available: standard emails, weekly e-Newsletters to Realtors® and Affiliates, Broker eBlasts, on our new and improved website, in our monthly printed magazine, at the weekly MLS Marketing Meetings, flyers in our office and lastly on now- ubiquitous social media outlets like Facebook, Twitter, LinkedIn and YouTube. I believe the only thing we might be missing is sky-writing. If you need to, we encourage you to play your mulligan before it’s too late. It’s better to start over now than to regret it in six months, when the year is already over. On behalf of the AAR staff and 2013 Board of Directors, we all wish you a prosperous and successful last half of 2013. We look forward to seeing you at one of our many events very soon.

By Dave Freeman, Association Counsel 1. LOAN MODIFICATION AND SHORT SALES: An important point that I have not mentioned in my previous discussions of this subject is a, “Catch 22”. Most of the time, when a party applies for a loan modification or short sale, the lender involved instructs the borrower to stop making payments on the loan. As the loan modification or short sale process takes a great deal of time, sometimes a year or more, a great deal of back payments are eventually due, when the loan modification or short sale is approved or turned down. At this point, the borrower is unable to catch up or cure the back payments, thereby starting a foreclosure process. I have seen this situation occur numerous times, putting even large earners in foreclosure situations, which are difficult, if not impossible, to rescue. The solution is to instruct and strongly encourage your clients in similar situations to set up a separate account (similar to a trust account), where the monthly payments are paid on a regular basis into this account until the loan modification or short sale process is completed. Thus, the borrower will be able to retain the home without foreclosure jeopardizing the successful or unsuccessful modification/short sale

process. 2. TAXES – EQUITY SHARING: In today’s market, many potential home buyers don’t have the credit to qualify for a loan, while others have the credit and desire to invest, but already own their residence. These two parties sometimes get together and enter into an agreement that is loosely called an “Equity Sharing Agreement”. It may be called by any name, but certain factors are important to consider. The IRS looks to the party who is on title to the property for the tax benefits and deductions. If the property goes up in value or falls, or goes into foreclosure, the parties may have a dispute over benefit or liability. Please alert your clients to these possibilities, and encourage them to have a comprehensive written agreement as to the responsibilities, liabilities and profitability’s, and the relative split of same. As the tax benefits and profitability/liability are very important to the parties, be sure they both consult with their separate C.P.A.s and attorneys to advise concerning and to draw up the agreement. It is much more complicated than meets the eye, if one party wishes to live in the property and pay the monthly payments and expenses, while the other party is the principal investor.

3. BUYER REPRESENTATION AGREEMENTS: Experienced agents are well aware of this dilemma and the difficulty of protecting their commissions. The problem is: Many buyers will have you show them many properties and expend much of your time, effort and money, and upon finding the ideal property will have their brother-in-law or sister-in-law or friend write up the contract for them, thereby cutting you out of the commission. The solution is having your potential buyers execute a Buyer Representation Agreement. There are two such agreements available to you through C.A.R. documents, exclusive and non-exclusive. While it may be difficult to get your clients to execute this agreement, many agents do on a regular basis, and many agents refuse to waste countless hours of their time showing properties to parties who refuse to sign the agreement. The agreements can be used for a particular buyer, a particular property and can be exclusive or non-exclusive. The questions becomes: do you have something better to do with your time and what are the chances that this buyer will go around you once you have found the perfect property for them?

“Department of Real Estate Becomes Bureau of Real Estate” Duane Gomer’s Interview with Commissioner Bell

Department of Real Estate Commissioner Wayne Bell was appointed by Governor Jerry Brown in February. He is the first employee of the DRE to be appointed Commissioner. Commissioner Bell allowed me to conduct a live, in-person, one hour plus, no questions barred, in-depth interview. This article is based on that interview. 1. Question: “What is the Governor’s Objective in GRP2 in relocating the Department of Real Estate to the new Business and Consumer Services Agency in lieu of its current location?” Background: As of July 1, 2013, the Department of Real Estate became the Bureau of Real Estate. This change is one of many included in Governor Brown’s Government Reorganization Plan #2 that was approved by the Little Hoover Commission and codified by the State Legislature in 2012. Answer: Governor Brown’s objectives were to promote effectiveness, and more efficiency, therefore saving money and enabling more functional governing. Some redundancy of operation will be eliminated. A couple Agencies were eliminated and Bureaus and Departments were reassigned. 2. Question: The new name will be Bureau of Real Estate under the Department of Consumer Affairs under the new BCSA (Business and Consumer Services Agency), and DRE will be grouped with some very diverse groups. How will this affect your department as to staffing, enforcement, etc.? Answer: The core functions of the DRE, Enforcement, Licensing and Subdivisions should not be affected. With the re-grouping of different Bureaus some administration functions might be combined but not to the detriment of the public. Some of the diverse groups to be under the new DCA include the Appraisers, Funeral Directors, Pest Control, Chiropractors, Barbers, Veterans, Appliance Repair, etc. This is designed to promote greater administration efficiency, coordination, and

uniformity. 3. Question: What do you consider possible benefits of the change? Answer: The DCA has an outstanding program of Basic and Advanced Investigator Training, and a Division of Investigation that has the power to arrest, search, issue warrants and issue Notices to Appear, etc. These factors should allow us to improve and enhance our enforcement procedures and efforts. We currently spend about 65% of our budget on enforcement activities to protect the public, with a focus on unlicensed activities, Loan Modifications and Foreclosure Scams, plus licensee violations. Also, DCA has some robust Mediation programs, and an efficient Call Center that should be extremely beneficial to the BRE. 4. Question: Will licensees have to get new business cards after July 1st, to change DRE to BRE? Answer: No. We have more urgent things to do from a public protection standpoint than enforce such technical and minor matters. Just change it when you get new cards. DRE links will still work after July 1st so clients can check your license status. 5. Question: Any final comments? Answer: Our main focus in Enforcement will be to investigate unlicensed people, and licensees acting improperly. Our staff will have additional training, and we hope that they will be able to work more efficiently. We will greatly appreciate the support of all licensees and concerned non-licensees with regard to providing assistance in our Enforcement efforts. “Disclosures are Like Politics” By Maria Howard, First American Natural Hazard Disclosures

Disclosures, like politics, are “local” (think City and County). Regardless of which side of the deal an agent is on, success is directly tied to the ability to understand and address the concerns of the buyer. The Buyer cares most about local amenities that will enhance the enjoyment of a new home—and local issues that will limit it! A “local” issue is not a lofty intangible policy from Washington, D.C.., or a legislative action in Sacramento. A local issue is typically a condition or restriction enforced by City Hall or the County Seat that limits or prevents an owner from improving a property. For example, a local storm sewer chronically backs up and floods nearby property. Or, a scenic canyon above the neighborhood has a history of debris flows during wet winters. Or, a suspect fault was recently recognized by the Department. Those local hazards won’t show up on the

regulatory Federal and State hazard maps. They’re not statutory FEMA flood zones or earthquake-triggered landslide or active fault zones.
