When it’s OK to Slam the Door The month of January is conventionally thought to be named after Janus, the Roman mythological god of beginnings and transitions. Further, the word Janua is a Latin derivative for “door”. While these facts by themselves are probably useless unless you’re playing Trivial Pursuit, they are relevant for the purposes of this edition’s article since January is the door to the New Year. Some of us have already ran through the 2016 door recharged, renewed and ready to go. While others have profoundly slammed the door shut on what might have been a not-so-great 2015. If you’ve slammed that door in anger or frustration, that’s a great thing! It’s a sign that you’re fed up and sick and tired of being sick and tired and you might be ready to make changes for a better year. Change is necessary and change is good - there are term limits with our politicians for a reason. If we aren’t constantly changing to improve our business, our personal lives and our communities then we will forever be condemning ourselves to eternal life in the present. Essentially, if we aren’t moving forward, we’re moving backwards. Individuals and organizations that enjoy consistent success make the process of positive changes an abiding and critical element in their business models and business plans. They believe this to the point that they actually expect for change to happen and invariably it does. Behavioral studies have now established that when we expect and make plans for something positive (or negative, for that matter) to happen, that positive or negative result is what’s likely to happen. It’s called the Pygmalion Effect and it can be very powerful - either way, the choice is ours. So go ahead, triumphantly slam that door on 2015! Exciting changes await you on the other side if you plan for and expect them to happen. On behalf of the staff and Board of Directors, we wish you a happy, healthy and successful 2016.

Property Management - E&O Insurance

If you are a broker and your agents participate in property management, you must:

A) Supervise and review their work and accounts. You are responsible, and there are many pitfalls and areas of lack of expertise or lack of knowledge regarding the requirements in this area. AND

B) Carry separate E&O Insurance. Check with your insurance agent. Most normal office E&O policies do not cover Property Management, and you must have it. The dangers and size of the possible judgments are considerable and cause for sleepless nights, if an action is filed against you.

Brokers’ Trust Accounts - Non-Licensed Parties

If a non-licensee employee is authorized to make withdrawals on your trust account, you are required to have fidelity bond coverage equal to the maximum amount that employee has access to. The California Bureau of Real Estate (CalBRE) feels the bond must be with zero deductible. However bond companies generally won’t issue this coverage above $100,000 without a deductible. The new law, effective January 1, 2016 allows for a bond with up to a 5% deductible, where the Broker shows financial responsibility to cover the deductible amount by:

A) A separate fidelity bond to cover the deductible amount, or B) A cash deposit to remain in a separate account, sufficient to cover the deductible, or C) Other evidence to be determined by the Commissioner…?

Empty Homes - Adverse Possession And Phony Rentals

Many properties sit empty for considerable periods of time, due to foreclosures and some investors living abroad. This sets up a scenario ripe for problems.

A) Adverse Possession: If a party enters the premises, and lives there for a period of five years, paying the property taxes currently, they may claim, successfully that they are the new owners of the property. B) Phony Rentals: People have entered empty properties, and rented those to unsuspecting tenants, as if the trespasser was the owner of the property. One husband and wife team perpetrated this scam on hundreds of properties over the years before they were eventually caught.

Solution: Advise your clients who purchase or own property that will remain vacant for any period of time to be sure to have someone visit the property on a regular basis, and report to the owner and the police if there is any unexpected activity.

3 Homebuying Trends That Will Stick Around in 2016 By Brian Buffini, inman.com, Contributor

Buyers are more agile and better equipped with information than ever before The real estate market is always changing, and the growing reliance on technology in our industry makes it move even faster. Buyers and sellers search for homes and communicate differently than they did just two decades ago. On top of that, they also have more access to data and information than ever before. What are some trends that will have an impact on how you do business in 2016? Read on to find out.

buyers looked for properties online before contacting an agent or looking for information about the homebuying process. This percentage is even higher for younger buyers or millennials. It only makes sense. After all, younger buyers are more likely to have grown up with computers in their homes and access to the Web from an early age. But they’re not the only ones using the Internet to answer their questions - the National Association of Realtors® Profile of Home Buyers and Sellers shows that most buyers continue to search for information on the Internet throughout the homebuying process.

In most areas, it’s cheaper to buy instead of rent. According to Trulia, nationally, it’s 35 percent cheaper to buy instead of rent, and CNN Money reports that for millennials, it’s 23 percent cheaper.

According to National Association of Realtors® Profile of Home Buyers and Sellers, 88 percent of buyers would use their agent again or refer him or her to others. Despite having incredible access to information, buyers and sellers still rely on agents to guide them through the real estate process.

Buyers want their agents to help them find the right home, negotiate a great deal and help them with all the paperwork. Sellers, on the other hand, want their agents to market their home to potential buyers, sell it within a particular period and price it to sell.

According to recent trends, rents will only continue to rise. If you have clients who have been on the fence about buying, this might be the encouragement they need to spring into action and make their dream of homeownership a reality. 2. The Internet is king

Technology hasn’t made agents obsolete - it’s made them more valuable. After all, a computer, tablet or smartphone isn’t going to hold your hand through the process and the Internet certainly won’t infer frustration by your tone of voice and offer reassurance.

“Perils Your Home Insurance Policy Doesn’t Cover” By Mark Wu, AMS Insurance Many policy holders mistakenly assume their home insurance will pay for any type of damage when disaster strike their homes. This is not the case. The standard HO3 Homeowner’s Policy, better known as the “All Risk” coverage policy covers your home for many perils such as Fire, Lighting, Wind , Hail, Explosion, Falling Objects, Vandalism/Riots and Smoke. However, there are certain common exclusions that are not covered. Earthquakes Damages from earthquakes are not covered by most home insurance policies. In California, earthquake insurance is handled by the California Earthquake Authority. Flood & Other Water Damage While your policy might say that it covers certain types of water damage, flood as a result of surface water, waves, tidal water or overflow of any body of water are often excluded. Flooding exclusions include mudflow as well. Flood Insurance can be purchased separately through the National Flood Insurance Program. Damage Caused by War, Nuclear Hazard or Terrorism Standard home insurance policies cover for riots, civil unrest and vandalism. However, most insurance policies of any kind tend not to provide coverage for war, terrorism or nuclear hazards. Many policies do not specifically reference terror attacks. Damage Due to Neglect and Failure to Maintain the Property This includes: termite and insect damage, bird or rodent damage, rot or mold, general wear and tear, damage caused by smog, smoke, or other industrial and agricultural waste or damage caused by hidden defects and mechanical breakdown. I strongly suggest you contact your Insurance Carrier or Agent for information regarding your policy or coverage’s. Every year, the Events 4 Charity Auxiliary hosts several events including the weekly 50/50 raffle at our MLS Marketing Meetings, Bingo, Golf Tournament, and Smokin’ Jack. The proceeds of these charitable events are gathered up and distributed to local charities at the end of each year. We sincerely thank each and every person who not only has volunteered so generously of their time and effort, but also those who attended these events and contributed financially. It is because of you that the E4C Auxiliary and the AAR were able to give so generously this year to those in a time of need. 2016 Installation & Awards The Arcadia Association of REALTORS® recently installed the new 2016 Officers and Directors at the 92nd Annual Inaugural Celebration held on Friday, January 15, 2016 at the DoubleTree Hotel in Monrovia. More than 200 REALTORS®, Affiliates and guests attended the “Come Fly With Us” themed event. Master of Ceremonies for the evening was Andy Bencosme with Century 21 Village. The Installation ceremony was conducted by Mr. Anthony Portantino. The Officers installed were: Roy Blume, President; Sylvia Ramos, President-Elect and Kelvin Chang, Treasurer. The 2016 Directors are: Ryan Asao, Julie Bencosme, Cecil Griffin, Fred Madjar, Yvonne Rosas-Petty, Irene Truong and Mike Vachani. The Installation ceremony of 2016 President, Roy Blume and Officers and Directors was followed by the presentation of the coveted “REALTOR® of the Year” award presented to Mike Vachani, Provenio Realty & Investments and the “Affiliate of the Year” award presented to Kal Antoun, First Priority Financial. Kal is a long-time affiliate member of the AAR with First Priority Financial. Since almost day-one she became involved with the AAR volunteering in numerous capacities. She found her niche at the AAR by volunteering with the E4C Charity Auxiliary by working on many events and eventually ascending to Vice Chairperson. As Vice-Chair in 2015 Kal helped lead the committee that raised over $25,000 for local charities. She was instrumental in pulling off very successful Bingo and Smokin’ Jack events in 2015.
