A lot can happen in the space of a year and in recent times, more often than not, it does! However, looking back twelve months to my thoughts last June, it feels to me like a case of Déjà vu. And if not exactly the same, there are definitely a number of similarities – a good start to the year being one. Unfortunately though, that good start seems to have plateaued somewhat, well that’s what I’m hearing. As ever, there’s likely a number of reasons for that, but the two biggest factors are of course the relentless inflation across just about everything, combined with the most non descript weather I can recall for quite some time. The Met Office call it ‘unsettled’ and I’m sure there are many other descriptions that have been used over recent weeks that aren’t quite so politically correct! A run of decent weather is starting to become essential to provide a much-needed shot in the arm to our industry (and I’m sure many others too!). Decent weather is essential to raise spirits and stimulate the season, but there’s sadly nothing we can do about what’s happening in the sky or on the ground the economy wise, other than hope things change for the better sooner rather than later!

As an innovative industry, adapting to challenges has always been a strength across the many sectors which make up the wider wet leisure industry. For example, placing the spotlight on being eco-friendly and producing more energy efficient products were high priorities for many manufacturers way before this current energy crisis came about, although with costs looking to remain elevated for some time yet, even more products and innovations are been made available, which is no bad thing. It goes without saying that the high costs of

energy have hit everybody, but they appear to have really impacted the hot tub sector particularly hard. So it’s fitting that in this issue we’ve a feature which rounds up a number of the more recent energy, and therefore, money saving options that are aimed at reducing the cost of ownership.

Inside, we also explore what’s new in the world of above-ground pools, a sector that’s come into its own over the last couple of years, thanks to a wide range of options offering lots of flexibility. There’s an in-depth look at the various options for heating swimming pool water too, with a focus on solutions which aren’t base around heat pump technology – solutions which will definitely take the chill out of the water in a variety of settings – especially in above-ground pools.

Fun is put firmly in the spotlight as we showcase the companies that are providing water play solutions for commercial facilities across the UK, plus with face-to-face trade events both in the UK and around the world now taking place again, we round up what’s on and where over the next 12 months or so.

And as if that wasn’t enough, we’ve a number of shorter pieces this issue too. Golden Coast’s Adam Clark provides his first ‘Opinion’ piece and gives some thoughts on a on a changing world and industry, while Luke Griffiths at the STA takes a look at a triple electro-disinfection system with the hope of reducing chlorine use. Lighthouse have news of an exciting new initiative utilising their HeatForm products, whilst Waterco Europe showcase some unique work in Birmingham which they supplied plant equipment for.

David Lloyd’s Epsom Club Receives £2m Makeover

The David Lloyd Club in Epsom has recently undergone a significant £2m refurbishment including opening a new luxury indoor and outdoor Spa Retreat.

The investment by one of Europe’s leading health, fitness and wellness groups will ensure that Epsom members are provided with the highest standard of spa and wellness facilities to achieve their health and fitness goals.

At the heart of the new club is the brand new luxurious super-spa known as the Spa Retreat. Set within a newly built area of the club, it’s a world away from anywhere, with extensive state-of-the-art facilities.

Heat, cool and relax are the three guiding principles of the expertly designed ‘spa journey’, scientifically designed to boost overall wellness and help relax, unwind and escape.

The new-look spa includes a large hydro pool, plunge pool, Finnish sauna, crystal steam room, fire and ice room, salt sauna, heated beds and a feature shower. The stunning experience rooms heal the body and soothe the mind. The club has also expanded its spa garden which includes a new outdoor hydro-pool, outdoor sauna and a relaxation area with a fire pit.

Along with the investment in the spa and wellness facilities, the second phase of the refurbishment involves a further £1.8m

investment into the central hub of the club, the Clubroom, with a stylish extension which will provide more space for members to relax with their friends and family.

The family changing rooms, showers and indoor pool have also undergone refurbishments which are set to be complete before the summer.

Russell Steere-Jones, General Manager at David Lloyd Epsom said: “We can’t wait for our members to see the new changes to the club. We’re able to offer both indoor and outdoor spa spaces where our members can relax and unwind after a workout or busy day. The brand-new luxury Spa Retreat will rival the top spas in the UK.”

New Leisure And Learning Hub Breaks Ground In Lincolnshire

Alliance Leisure have started work on a multi-million pound development to improve leisure and learning opportunities for residents in Mablethorpe, Lincolnshire. To mark the occasion, a group of stakeholders, partners and the local community came together officially to break ground at the construction site.

A new 3,000m² Leisure and Learning Hub, made possible by a £14m investment from Towns Funding, will replace the existing Station Sports Centre, adding a six lane, 25 metre swimming pool and changing village, a gym and fitness facilities as well as indoor and outdoor play facilities. In addition, the site will incorporate a digital inclusion learning centre.

development, designed by lead architects, Pozzoni, will be managed by Alliance Leisure through the UK Leisure Framework, owned and managed by Denbighshire Leisure, with ISG named as principle build contractor.

“This is an exciting project because of the integration of leisure and education services. Located just behind the High Street in Mablethorpe, with its own dedicated car park, the development offers good accessibility creating a muchneeded activity and learning provision for everyone to enjoy. Residents have been calling for an indoor swimming provision for many years so it is fantastic to finally be able to deliver this,” commented Sean Nolan, Business Development Manager at Alliance Leisure.

PLANS SHELVED FOR CUMBRIAN TOWN’S POOL

Members of Cumberland Council’s Executive have reluctantly decided to shelve plans for a new swimming pool at an existing facility in the town of Maryport as operational costs have spiralled to unaffordable levels.

There had been major concerns about the cost of building a pool at The Wave Centre for some time as construction costs rose dramatically and energy prices also increased. At the meeting, councillors said they were left with no option but to come up with a Plan B as they were warned potential subsidies for the building could reach half a million pounds per year.

A Council spokesperson said: “Councillors felt that the Council simply cannot afford to commit large amounts of revenue funding for a pool which may never be financially sustainable.

“We are, sadly, not alone in this – swimming pools are closing across the UK for the very same reasons.”

SERCO LEISURE TO OPERATE FORMER DAVID LLOYD FACILITY

From June this year, Serco Leisure and its operating partner in the region, Maidstone Leisure Trust (MLT), will begin management of a health and fitness club previously operated by David Lloyd.

It had been announced in February that the David Lloyd facility at Lockmeadow Leisure Complex in Maidstone would close at the end of May. From that point, and as part of its Distressed Contract Workstream, Serco Leisure engaged with Maidstone Borough Council regarding the possibility of keeping the club open.

In May, it was announced that Serco Leisure and MLT would become the new operators at the centre, which features a swimming pool and sauna/steam room. The facility will continue to operate as a private members’ club.

Annual Survey Reveals Energy Crisis As Industry’s Biggest Challenge

Launched by Golden Coast and supported by industry associations and trade press, the annual Wet Leisure Industry Survey asked the sector to offer its insight on business conditions, sales and influences in 2022, as well as expectations for 2023.

“2022 was another eventful year,” said Golden Coast General Manager Adam Clark. “We had good weather in the summer which is always great for our sector, but the continuing war in Ukraine and onset rise in energy prices led to the biggest jump in the cost of living that we’ve seen in decades. It has had a huge impact on what products customers choose and how suppliers run their business.

“Energy prices were by far the biggest concern among the survey respondents, and understandably so. Many reported that the most important thing their customers are looking for is energy efficiency. They want products that can save them money, and we will undoubtedly see more and more products arrive on the market designed to do just that.”

Despite the challenges, the Survey highlighted that many

product areas continue to sell well in 2022 with significant growth in pool construction and for those working in the sauna and steam sectors. Many of the survey respondents said they are very confident about 2023 too. Adam also noted from the Survey: “Spa sales have been declining since 2022, but they remain high in the leisure market as more facilities add hot tubs as a feature to their premises.

“More than 10% of survey respondents expect next year to be extremely difficult. These are mainly smaller business, predominantly in the spa and hot tub sector, who may have already been hit hard by rising energy costs.

“We live in uncertain and challenging times, but the wet leisure sector remains resilient due to its ability to adapt. It will be interesting to see how things continue to change throughout 2023.”

FIVE-YEAR LEISURE CONTRACT EXTENSION AWARDED IN NORTHERN IRELAND

Serco’s leisure business has been awarded a five-year extension on its contract to operate three facilities in the Ards and North Down area of Northern Ireland.

Serco and its operating partner in the region, Northern Community Leisure Trust (NCLT) have managed Bangor Aurora Aquatic & Leisure Complex, Bangor Sportsplex and Queen’s Leisure Complex in Holywood since April 2013, when they were awarded a 10-year contract by Ards and North Down Council.

In July 2021 the Council made the decision this contract would not continue beyond its original 10-year period, with leisure services planned to be directly managed by the Council from April this year.

However, in September of 2022, the Council decided to re-engage with Serco and NCLT to explore options, which could result in their continuing management of the three centres.

AFTER YEARS OF WAITING, EPPING FOREST TO FINALLY GET A POOL!

A new low-carbon leisure centre incorporating the latest energy efficiency technologies will provide residents of Epping with their own swimming pool, learner pool, sports hall, fitness gym and studio – with the new swimming pools being be a first for Epping.

Epping Forest District councillors agreed to appoint Places Leisure in partnership with contractor Pellikaan Construction Ltd to build the new £33m leisure centre.

Councillor Chris Whitbread, Leader of Epping Forest District Council said: “Having lived in Epping all my life, better leisure facilities, especially a swimming pool have been asked for a long time – probably 50 years!”

Work is expected to start on site in the summer and Epping Leisure Centre could welcome its first visitors in 2025.

Luxury Indoor Swimming Pool Created In The Derbyshire Dales

Nestled in the picturesque Derbyshire countryside, this luxurious, self-contained, two-storey indoor swimming pool replaced several existing buildings at a stunning 250 year-old property.

Ceramic Tile Distribution in Derby supplied the tiling products and adhesive and grout for the project. It involved constructing the 15 x 5m swimming pool building which features a statement apex roof, floor-to-ceiling sash windows and a set of arched French doors that lead out to a new courtyard area. Inside, there’s a steam room, comfy poolside seating a mezzanine floor.

High performance tile fixing products by SaintGobain Weber were specified throughout the project. A total of 150 bags of Weberset Rapid SPF tile adhesive and 15 bags of Weberjoint premium grout in Limestone were used to fix and secure the tiles in place inside and around the pool.

“Our extra-flexible premium grout is ideal for swimming pools. Not only is it water repellent and long-lasting, it incorporates our PURE CLEAN anti-stain technology. This unique feature helps reduce the appearance of patchiness and improves

resistance to staining,” explained Tim Martin, Area Sales Manager for Saint-Gobain Weber.

Weberjoint premium tile grout offers a professional standard high quality finish. It’s available in a range of colours and silicone shades. Scratch-resistant, it’s suitable for both interior and exterior tiling on to walls and floors where some movement or vibration is expected.

Plans For New Whitchurch Swimming Pool Taking Shape

Works by Shropshire Council to develop a new £13.1m swimming pool and fitness centre in Whitchurch are taking shape with the project team revealing the detail of the new centre that will include a six-lane 25m pool.

Specialist architects Roberts Limbrick have designed a centre over two floors, and it’s planned that the new building will sit on the site of the old pool and youth centre, which will be demolished.

The ground floor will accommodate a café, changing village and pool whilst the upstairs will host a gym and a flexible studio space.

member for culture and digital, welcomed the news and said: “I am delighted to see work on this project progressing at pace.

“The designs are stunning and we can be confident that we are delivering a first-class swimming and fitness centre for Whitchurch. This is an exciting project which demonstrates our commitment to both investing in the area and to public health. The pool and fitness centre will serve the public for many years to come and it will have a significant positive impact on exercise and activity levels across the wider area.”

Shropshire Council voted to go ahead with the £13.1m development after hearing that a new centre would be the most viable and cost-effective way to replace the current facility, which has not been able to open since the pandemic began.

Since the pool’s closure in March 2020, investigations to identify the cause of an ongoing leak at the facility and the practicalities of carrying out repair works showed that the swimming pool defects are such that it would not be able to reopen in its present guise.

Featuring 1.2 metre infinity edges, large walk-in steps, and the latest underwater jets to aid total body massage, it is the perfect place to relax and unwind with friends and loved ones.

What’s more, with an average water temperature of 39°C powered by a sustainable heating source, guests can relax even during the cooler months.

Commenting on the launch, Eden Hall’s Managing Director Nerys Chell said: “We’re thrilled to unveil the new Spa Garden at Eden Hall. Helping our guests relax and unwind is core to Barons Eden, and we know the garden will be a haven for guests to help improve their overall health and wellbeing.”

The introduction of this new outdoor oasis completes the ultimate Spa experience at Eden Hall as it is already home to a crystal-clear swimming pool, outdoor hot tubs, rose infused steam room, healing saunas, tropical showers and 25 individual treatment rooms.

A dedicated manager at one of the Midland’s biggest tourist attractions is celebrating 30 years of service.

Group Operations Manager Garry Ford is now the longest serving employee at the Waterworld Leisure Resort in Stoke-on-Trent. He joined in 1993, just four years after the popular attraction first opened.

Resort owner, entrepreneur Mo Chaudry, advised: “Garry is one of Waterworld’s most integral people and is the beating heart and backbone of the company. We would be lost without him, professionally and personally.

“We owe a lot to Garry and we would like to thank him from the bottom of our hearts for the loyalty, service and love he has shown to the rest of the Waterworld family over those 30 years of service.

“Waterworld really is a family affair – and, in this case, that means Garry’s family! It’s a running joke here that he has worked with most of his own family during his

time at Waterworld.

“Thirty years is an outstanding achievement and it’s a career story you don’t come across every day.”

Mo said Garry started at Waterworld Aqua Park in 1993 when he was approached by thenowners Rank Leisure Group after he was spotted fixing the floor of the pool whilst working as a subcontractor. He is now responsible for operations at the Waterworld Leisure Resort which has undergone a £12m investment in recent years and welcomes about 400,000 visitors annually, with 12 million enjoying the park in the 30 years since Garry joined.

Garry said: “Waterworld is a huge part of my life and I’ve loved being part of a success story in Stoke which spans decades. I’ve seen a number of changes over the years and the recent upgrades and investment mean we’ll continue to be one of the top family attractions in the Midlands for decades to come.”

“The wet leisure sector is a new industry for me but it’s the same areas of business,” he said. “My job is about challenging the status quo and identifying ways to enhance procedures. I will be overseeing activity within warehousing, logistics, distribution, procurement, engineering and customer support, and working with suppliers and couriers.”

Based at the Barnstaple branch, Richard will be working across departments to review processes and support Golden Coast in improving efficiency wherever possible.

“Golden Coast already has an extremely motivated and focused team,” said Richard. “It is a very collaborative environment, so my job will be to support business operations and add value where I can.

“Following the acquisition by Pollet Pool Group, and the formation of one Golden Coast team, I will be working with Kristy Carlisle, Operations Manager at the Newbury branch, to support business integration across the two locations. I’m looking forward to working with the teams at each of the sites.

“Learning is the first step. I’m getting to know the different areas of the business and how it works so that we can eventually put project plans into place. Everyone at Golden Coast has been fantastic and very welcoming.”

SpaFlo Deliver An AwardWinning Project For Listed Home

When SpaFlo were approached for a bespoke hot tub for a client’s Grade II Listed home, they rose to the challenge as this project at Ahm House in Hertfordshire shows. Due to the building’s historically important status, there were planning constraints and special permissions were required. SpaFlo also had to work with a team of landscapers, to effectively incorporate the project into their garden design and in doing so, created this Award winning project. The company created a bespoke six-seater stainless steel hot tub, with overall external dimensions of 3.0 metres x 2.4 metres. The design incorporated individually placed seat massage jets, so each seating position offered a slightly different massage. Colour changing LEDs, with many different pre-programmed sequences, completed and enhanced the project which was completely tailored to the landscaped garden and usage requirements. Creating a luxury bathing facility that didn’t look out of place at the property was a big design factor for the clients. The hot tub was

Located in Arcachon, in the region of Nouvelle Aquitaine, this seaside resort area in south-west France is famous for its oysters. Curiously, the region’s four districts are named after the seasons of the year: winter, spring, summer and autumn.

Although there are very few deaths in pools and hot tubs, we are still aware of the need to promote safety, so we welcome this article from our colleagues at RoSPA and the National Water Safety Forum (NWSF). The NWSF brings a number of bodies together in cooperation with an interest in water safety, including a campaign called #RespectTheWater; please see their article on page 37.

Discussions continue with members and the wider industry about supporting and promoting the ‘Selling Chemicals Responsibly’ Code. It is vital that our industry is aware of its legal responsibilities and can advise staff about what they should and should not be doing.

Thanks to the continued efforts of Will Dando at Plastica and other members of SPATA’s Technical Committee, work is progressing on a useful xls calculator tool to help meet the requirements in the domestic outdoor pool standard EN 17645 ‘Environmental performance efficiency –Performance evaluation, methodology, and classification of the use of pools and their equipment’. The standard is now available, and once the xls calculator is in place, further training will be provided.

Work is also continuing with colleagues at the HSE to better understand the water hygiene management regimes for hot tubs in business settings and spas in commercial settings. It is hoped to use the experiences of members (and the wider industry) to identify what is happening now and what may be possible to revisit in future guidance of HSG 282.

BISHTA is again looking to make further progress on ‘Hot Tubs in Business Settings’ with a follow-up meeting to be held in the Forest of Dean, courtesy of Ryan Birchnall and Forest Holidays. This will further develop the earlier discussions at Forest Holidays’ venue in Cropton, Yorkshire. One of the outcomes is to arrange some holiday park

operator training.

Following several complaints raised by members of the public and the trade, SPATA is liaising with Surrey Trading Standards to identify how these complaints can be dealt with more effectively. Surrey TS is working with Buckinghamshire TS to provide a Primary Authority Partnership to SPATA and BISHTA. Plans are underway to have a webinar later this year, and members will be informed via their weekly e-newsletter.

It will soon be time for SPATA and BISHTA to reveal the categories and entry criteria for the British Pool and Hot Tub Awards 2024. Members are encouraged to collect photos of their projects over the summer in readiness to enter the Awards later this year.

Finally, having been in my role for 15 years, I have met many people passionate about helping the industry and have tried to thank many of them over the years. I wanted to say another thank you to Jamie Adams, who has recently retired from Golden Coast. On joining the BSPF, the Board tasked Jamie (along with Patrick Thorpe and Allen Brobyn) to help me with the various roles and responsibilities. nsurance Brokers will often say that ‘insurance is there for when things go wrong’ and whilst true, I am afraid that only goes so far. Some things are not insurable and, with so little cover available, it is easiest to say the cost of rectifying defective workmanship is not covered.not requiring damage to occur, but often exclude contractual losses and as ‘pure’ financial loss claims not involving damage are only enforceable by contract law, they are effectively worthless.

I would immediately clarify that I am talking about the cost of rectifying the actual defective work itself, not the damage or injury caused by defective workmanship which is usually insured. Another fundamental point is that the situation with defective design is different, and the cost of rectification can be insured, although more about that later.

Rather than constantly use ‘generally’ or ‘usually’ what follows is the norm in most insurance policies for small and medium size contractors, as few will have the cover extensions that I refer to later.

With Public Liability the cost of rectifying defective work is not insured but third party injury or damage to third party property arising from negligence is covered. ‘Third Party’ is the important term here, as damage to the contract works is not covered by Public Liability (but may be by a Contract Works Policy). Also, there has to be injury or damage for a public liability claim. If work is ‘just’ defective but has not caused injury or damage, say a commercial pool cannot open because of alleged defects, any claim for financial losses incurred by the operator will not be covered. Some insurers offer ‘financial loss’ extensions

Contract Works (also known as Contractors All Risks) policies also exclude the cost of rectifying the defective work itself but cover other defect free parts of the contract works that are damaged as a result of the defective work. Damage has to occur during the installation or maintenance period, and this can be a source of dispute when claims occur.

With defective design, the position with Public Liability (assuming design is part of your normal work and not a specialist activity for a fee) and Contract Works cover is the same as defective workmanship with the consequences of defective design covered in the same way as for defective workmanship.

However, with defective design, there is the option of economically insuring both the cost of rectifying the defect and any resulting pure financial loss claims. ‘Design and Construct’ Professional Indemnity policies provide cover for claims arising out of ‘professional activities’. These are defined as design or specification, supervision of construction or installation, feasibility study, technical information calculation and surveying activities undertaken by qualified people, i.e., the equivalent of a structural engineer or those with a minimum level of experience, usually five years. The oversight of work from a professional capacity is also covered, but defective workmanship and supervision of normal contracting activities is excluded.

So, the ‘norm’ is complicated enough but wider cover is available, and I will use a

Having the widest policy cover as a budget will allow is important and I am pleased to say that we have recently obtained insurers agreement to extend the wording of our specialist Poolsure and Spasure policies for the Wet Leisure Industry. For contractors with turnovers up to £10m, policies will now include a Completed Part Damage extension which is a mid-way point between DE3 and DE4 but as it is a Public Liability extension, has the advantage of providing cover after completion of a contract.

There is also a Financial Loss extension up to £50,000 during any one period of insurance which covers implied contractual cover, i.e., under legislation such as the Sale of Goods Act.

concrete beam with a defective inner metal support rod as an example. A DE3 wording is the norm for Contract Works policies and covers damage to the property the beam was supporting but not the beam. A DE4 extension also covers the beam but not the defective support rod and DE5 would cover everything except any subsequent design improvements required during rectification. However, these extensions, as well as specialist Latent Defects policies, only tend to be available for the biggest construction projects. They are expensive, with significant excesses and very few insurers are prepared to provide DE5 cover.

Safety First For Swimming Pools And Hot Tubs

Swimming pools and hot tubs are great for family fun, fitness and wellbeing – but they must be used sensibly and managed and operated with safety at the top of the agenda.

The fourth edition of ‘HSG 179: Managing health and safety in swimming pools’, published by the Health and Safety Executive, provides guidance for those who have any involvement with the operation and management of health and safety in swimming pools. It includes health and safety law, new developments in relation to equipment and facilities, and swimming pool design.

Swimming pool managers should consider the environment within which they are operating. Who will be using the area? Are there any particularly vulnerable users such as under-5s or later-life swimmers? What is the proximity to areas where glass and/or alcohol are used?

The design of the pool should follow HSG 179 and other relevant guidance, ensuring that deep water and vertical sides are not immediately presented to visitors. Consider how the area is left when not being used. For

example, in a domestic setting can children get to the water unnoticed? Supervision is a key factor of swimming pool safety and technology such as pool monitoring equipment and CCTV should be considered in addition to traditional methods. Emergency arrangements must also be put in place. For example, if children are reported as missing, the water should be checked first.

It is essential that the water quality is checked at intervals that are proportionate to the amount of use. The Pool Water Technical Advisory Group (www.pwtag.org) offers relevant training in this area for all swimming pool owners and operators.

The Chartered Institute for the Management of Sport and Physical Activity (www.cimspa.co.uk) provides industry practice and guidance on the operation of hot tubs and spas. In addition, RoSPA has issued the following advice on installing a hot tub for a family:

• Ensure that the hot tub is fitted with a solid and lockable cover that a child can only open with adult help

• Make sure the hot tub is covered when not in use

• Always ensure that children are supervised when around an open hot tub

• Ensure that chemicals are stored safely, out of reach of young children

• Children under five should not go in a hot tub.

A voluntary network of groups, working together to reduce water-related deaths and associated harm was established in 2004 following a government review into water safety. The National Water Safety Forum (www.nationalwatersafety.org.uk), hosted by RoSPA, brings together a number of national organisations, including The Royal National Lifeboat Institute, Maritime & Coastguard

Agency and the Royal Life Saving Society UK, with the ambition of creating a ‘onestop shop’ for drowning prevention and water safety in the UK.

‘Respect The Water’ (www.respectthewater. com) is the national campaign for National Water Safety Forum members. It runs throughout the year, but focuses on the busy spring and summer months, complementing and amplifying a number of national water safety campaigns. It aims to provide lifesaving advice for those in danger in, on or close to the water.

This campaign highlights what to do if someone is discovered struggling in the water. The best way to help them is by staying calm, staying on land, and following the three-step rescue guide – Call, Tell and Throw. Call 999 and ask for the right service. Tell them to float on their back. Throw them something that floats.

In addition, 25 July 2023, is World Drowning Prevention Day. Organisations and individuals are encouraged to share information about the day on social media to raise awareness about drowning prevention, using the hashtag World #DrowningPreventionDay. The United Nations also recommends measures to prevent drowning such as teaching swimming and water safety, and training bystanders in safe rescue skills and resuscitation of drowning people.

VAT Questions: Domestic Reverse Charge (DRC)

In this article, Kevin Hall, VAT Partner at Wright Hassall, looks at some of the awkward issues with the DRC

VAT is still causing confusion and, being 20% of the full sales price, any inaccuracy is expensive.

It used to be simpler. A supplier would construct and maintain a swimming pool, charge VAT on an agreed fee at the standard rate (currently 20%), and the customer would pay. Now there are a variety of issues to consider.

Different questions arise, such as whether the swimming pool is part of a new house build and potentially zero-rated, leading to further questions before zero-rating can be agreed. After all, it is the constructor that HMRC will pursue if VAT is not charged when it should have been. On the other hand, overpricing a job by 20% will make the supplier more expensive and lead to loss of work. It is an awkward balance to achieve, but given the amounts involved, it is worth spending a little time getting it right.

The same is true of the new VAT rules which came into force on 1 March 2021: the Domestic Reverse Charge or “DRC”. It is these new VAT rules which we will discuss in this article.

WHAT IS THE DRC?

The DRC is intended to remove the VAT charge from sales invoices in the construction industry, but only for specific supplies to certain customers in certain circumstances. This is an anti-avoidance measure: VAT is usually paid by the customer to the supplier and by the supplier to HMRC. However, HMRC found significant VAT fraud involving suppliers disappearing without passing on the VAT. The DRC requires the supplier to charge no VAT and the customer to pay the VAT directly to HMRC, simultaneously recovering that VAT if permitted.

The difficulty, however, is that not all transactions are subject to the DRC, and it is the supplier’s responsibility to determine

when VAT is and is not chargeable. In broad terms, HMRC wants the DRC to apply (no VAT to be charged) when a construction service is supplied to a contractor who will supply on that construction service to someone else. There are some simple indicators that the DRC does not apply:

• If the customer is not VAT registered, no DRC and VAT is charged.

• If the customer is not CIS registered, no DRC and VAT is charged.

• If the customer states, they are an end user, no DRC and VAT is charged.

The term ‘end-user’ is not quite what it seems. An end-user includes someone who is not really an end-user themselves but is connected with an end-user, such as a landlord who shares an interest in the same property with a tenant: the landlord is an end-user (no DRC) even if they recharge the construction service to their tenant. Similarly, members of the same corporate group are connected, triggering end-user status even when one group company purchases construction services and supplies them to another.

If the customer is VAT registered, CIS registered, and not an end-user, additional questions should be considered, such as whether the service supplied is a qualifying construction service. While the qualifying nature of a construction service will be clear when something is being built, questions arise in respect of other activities. For example, decorating is included, but separate inspection reviews are not. How about constructing off-site and delivering

items; installation services; the materials; labour-only supplies; site inspections and planning; activities which are part of a wider supply; and so on? Each activity should be considered on its own merits and in context before concluding whether the DRC applies and removing the VAT charge from an invoice.

SIMPLIFY

Once the DRC and non-DRC activities are determined, a further step can simplify matters. In respect of certain non-DRC supplies, supplier and client can agree that they will become DRC supplies. This can simplify things, with no requirement to split invoices between DRC (no VAT charge) and non-DRC supplies (VAT charge). The agreement is not automatic and must be actively pursued; however, it can only come into effect when the supplier makes other DRC supplies on the same site to the same customer.

There is also a 5% ‘disregard’. If there are DRC supplies below this threshold, the DRC requirement can be disregarded and VAT applied to the entire supply.

Constructors and their advisers should consider the above process and seek specialist support where the distinctions become unclear or when the client challenges the VAT rules applied.

So yes, let’s say it, swimming pool constructors have been thrown in at the deep end with these new VAT rules!

Selling Chemicals Responsibly

With additional measures effective from 1 October 2023, in this article, we provide an introduction to the Control of Explosive Precursors and Poisons Regulations 2023 and look at the main changes that are coming into force

On the night of the 22 May 2017, 22 innocent people were killed and over a thousand more injured, many of them children, in the Manchester Arena bombing attack. The recent publication of the third and final part of the Manchester Arena Inquiry report made clear the importance of work to prevent access to explosives precursors and detect suspicious transactions. Since that attack, the police and security services have stopped 37 late-stage attack plots and many more plots in their early planning stages.

Identifying and stopping these terrorist threats is not an easy task, as highlighted by MI5 Director General Ken McCallum in his annual threat update in November 2022 when he commented: “In a free country, detecting self-initiated terrorists – who often don’t reveal their plans to anyone, and can move quickly and sometimes spontaneously from intent to violence – is an inherently hard challenge”.

After the 2017 terrorist attacks in Manchester and London, Lord Anderson QC carried out an Operational Improvement Review, and while its focus was mainly on the police and security services, one of the recommendations was to increase cooperation with the private sector to improve the detection of suspicious sales of chemicals that could be used to make explosives. This highlights that the police and security services can’t do their job alone and need your help detecting suspicious activity. You know your business better than anyone else. You know what is right and, more importantly, what isn’t.

Since this recommendation, the Home Office has worked closely with private industry to increase awareness of the obligations placed on suppliers by the Poisons Act 1972 on reporting suspicious activity involving certain chemicals. As a result, over the last year, the Counterterrorism policing National Precursor Chemical Team has received multiple reports and actioned them to disrupt terrorism, crime and safeguarding people who intended to cause self-harm. All of those reports originated with a supplier who felt the transaction was suspicious. Based on the recommendations from Lord Anderson, the Home Office reviewed the Poisons Act 1972 and recognised that there were ways that the existing controls could be improved, including by strengthening the obligations on retailers to report suspicious transactions.

After consultation with industry, suppliers, users and other interested parties, the Control of Explosives Precursors and Poisons Regulation 2023 was laid in Parliament in January 2023. The regulations add additional measures to the Poisons Act 1972, which comes into force on the 1 October 2023.

The main changes are:

• Businesses selling reportable and regulated substances to other businesses must inform them of the restrictions and reporting obligations associated with those substances. If selling to members of the public or professional users, businesses must ensure their workers understand which of their products contain reportable and regulated substances, as well as the associated obligations under the Poisons Act.

• Businesses supplying regulated explosives precursors to other businesses must obtain and record information designed to verify

the legitimacy of a business customer and must be satisfied that the regulated precursor is being obtained for a purpose reasonably connected with the business. This information should be recorded and stored for 18 months.

• Reporting suspicious transactions. All suspicious transactions must be reported within 24 hours of the supplier becoming aware of the suspicious activity and, where possible, must be reported via the electronic reporting system.

• When making a suspicious activity report, businesses must provide all information that they hold which is likely to be useful in identifying the individual involved in the suspicious transaction.

• Additions to the lists of reportable and regulated substances under the Poisons Act. The following substances will become regulated explosive precursors on the 1 October 2023: Ammonium Nitrate (above 16% Nitrogen content), Hexamine, Hydrochloric Acid (10% W/W) and Phosphoric Acid (30% W/W)

• Sulfur will become a reportable explosive precursor, and Sodium Hypochlorite solutions (above 6% available chlorine) will become a reportable poison on the 1 October 2023.

• Additional substances have also been added to the list of regulated poisons.

Surrounded by the Symphony Hall, Library of Birmingham and the Hall of Memory, the multi-million-pound redevelopment of Centenary Square Fountain now features a mesmerising 60m x 30m, 20,000m3 shallow reflective pool comprising 20 ‘dancing’ water columns.

Designed by Edinburgh-based Graeme Massie Architects, the fountain’s zerodepth design relies on several of Waterco’s commercial-grade products, including:

• 2 x Micron SMDD900 commercial media filters complete with Waterco EcoPure Glass media

• 2 x Hydrostar 4hp 3 phase commercial pumps

• 4 x Trimline C75 Bag filters

• 4 x Multicyclone MC16 centrifugal filtration systems.

“The two Hydrostar pumps draw water from the main water feature and through two different systems,” explained Waterco Europe CEO Tony Fisher. “Each consists of two C75 bag filters and double manifold MC16 centrifugal filtration units before entering Waterco’s Micron SMDD900 commercial media filters and re-entering the feature via the main reservoir. The primary sanitisation is chlorine and acid with UV installed as a secondary system.”

VICTORIA SQUARE – ‘FLOOZIE IN THE JACUZZI’

The centrepiece of Victoria Square is a well-known artwork known as ‘Floozie in the Jacuzzi’. Officially titled ‘The Goddess to The River’, artist Dhruva Mistry designed the sculpture in 1993 to instil a feeling of ‘peace and safety’ in the public space. However, in 2013, Birmingham’s iconic water fountain was completely drained and planted out.

Following the regeneration of Centenary Square, the 1.75-tonne sculpture is officially back on as a working fountain – much to the delight of resident ‘Brummies’ and visitors.

This October, two brave teams of ex-international rugby players – Rugby Union versus Rugby League – will race across the English Channel as part of an event called The Big Rugby Swim on behalf of the sports injury charity Head for Change. And, as SPN discovered, the team at HeatForm are backing them all the way!

Both HeatForm and Velocity are designed and manufactured in Plymouth, Devon by Lighthouse, the UK’s only independent, family owned specialist pool distributor. Managing Director Daniel Phillips, an avid rugby fan and youth coach, was looking to give something back and what better way than by combining his passions for rugby and swimming with a global initiative to make sport safer for all!

The Big Rugby Swim is a relay race which will bring together former rugby league and union players making up teams of six to swim the English Channel in October. In addition to raising funds, the key objective of the event is to raise the profile and awareness of Head for Change and highlight the plans being made to protect players and the game of rugby.

What makes this challenge extraordinary is that some of the ex-professional, elite sports people could not swim a year ago! The training has been arduous, with very early

So, one gloriously sunny weekend in May, in a field in Tenby which overlooked the stunning Pembrokeshire coastline, a fully working HeatForm pool with Velocity swim jet was rigged up for the players to train as part of the charity’s launch event. Led by Dave Tonge of Heathwood swimming, all the participants took part in designated training sessions and the launch was a huge success.

In this issue, we take a look at just some of the products within the sector

When it comes to raising the water temperatures of swimming pools in the UK, there are numerous options available to suit a wide range of pool types, project settings and of course budgets.

Whilst heat pumps and even more complex environmental systems provide some of the latest sophisticated technologies to meet the needs of many pool owners, boilers, solar, electric options, heat exchangers and more, all play their part in the heating mix, and in doing so, offer flexibility for the many pool environments that exist. Available from Plastica, the Solar Pod™ Plus is a sun-powered water heating option that is suitable for above-ground pools up to 9,000 litres.

The Plus model has a reflective internal base, generating passive solar gain within the dome – increasing the captive air temperature by an average of 11°C in comparison to the standard Solar Pod™ version. The higher the temperature within the dome the greater the heat transfers to the pool water passing through the solar heater.

The Pahlén Maxi-Flo is a tube heat exchanger that offers capacities of 40-117kW, and is suitable for installations that operate under high pressure. It is made of acid-proof stainless steel and can be easily installed using adjustable stainless steel attachments. For extra durability, the Hi-Temp spiral heat exchanger is made of thermoplastic with a high glass content and a coil of acid-proof stainless steel.

Whether it is releasing new models, updating technologies or making improvements to products – there’s a full on assault taking place on multiple fronts to help ease the overall cost of hot tub ownership within both the domestic and commercial markets.

With a broad range of approaches being taken, in this issue, we round up some of the more recent energy, and therefore, cost saving options that are now available within the sector.

pump automatically optimises the refrigerant flow rate by varying the speed of both the fan and the compressor. This allows the pump to reach extremely high coefficient of performance, which equates to greater efficiency and lower energy use. For each kilowatt of energy consumed, Dura Pro offers an output of up to 13 kilowatts of heat – that’s 13 times more efficient than a standard electric heater.

“Not only is it powerful yet quiet, but it also has a touchscreen display that enables owners to monitor energy usage easily and change settings as required. For example, they can adjust the temperature in increments as small as 0.1°C. This high level of control helps owners to manage their electricity consumption and avoid any surprises when the bill comes.

The patented biometric design maximum heat exchange efficiency, and a real-time power consumption display allows users to track usage.

The high coefficient of performance means that for every kilowatt consumed, InverX offers 16 kilowatts of heat in return. Even

at 50% capacity, InverX still delivers high coefficient of performance of 11.6.

LATEST PLATINUM SPAS DELUXE RANGE PASSES CEC TEST

Superior Wellness recently announced that their Platinum Spas Deluxe Range was successfully CEC tested which shows the commitment to being more energy efficient.

The CEC (California Energy Commission) is the only third-party accreditation organisation recognised by the spa and hot tub industry.

HEAT HOT TUBS FASTER AND SAVE ENERGY WITH BOWMAN

Bowman manufacture a range of heat exchangers designed for use in swim spas, hot tubs and spas where external heat sources are present. These will include gas, biomass or LPG boilers, ground and air source heat pumps, plus the latest hybrid heating systems.

Bowman EC 80-5113-1T heat exchangers feature a shell and tube design. Hot water from the external boiler enters the heat exchanger and circulates inside the outer ‘shell’ of the unit and over the tube core, whilst spa water travels through the tubes collecting heat on the way.

Though compact in size, when compared to the electric heaters often supplied with hot tubs, they heat the pool water much faster – often by around 10°C to 12°C per hour, reducing heat up times to around three hours using ambient temperature water – a significant benefit for holiday parks at guest change over periods.

heat exchanger, with an external boiler can reduce costs significantly, and reduce the electricity loading for a holiday park.

ULTRA CHEMS SPA FILTER CLEANER SAVES MORE THAN JUST MONEY

Launched at the end of last year, the arrival of Ultra Chems, provided Park Leisure Solutions (PLS) and their customers with a safe, fully certified and highly efficient filter cleaner which thanks to using advanced chemical cleaning technology, takes hot tub or spa filter cleaning to the next level. DOODLE BUILD’S SWIMBOX – A UNIQUE AND ECO-FRIENDLY CONCEPT

For something altogether different in the world of above-ground pools, shipping container conversion company Doodle Build, in collaboration with Eco Pool Award-winning Love2Swim Ltd, have developed SwimBox – the first ‘Plug & Play’ swimming pool inside a shipping container, to be designed, engineered and manufactured in the UK.

These pools are produced by up-cycling shipping containers and from the beginning of the design process, efficiency was at the heart of the product. Designers wanted to create a sustainable pool that was cheap to run and held the heat within the structure. This was achieved with a very high level of PIR insulation, a cleverly designed plant room and a solar cover to take advantage of what nature provides.

Factory built to reduce carbon footprint, SwimBox pools require minimal site work and are vastly cheaper to run than a traditional pool, creating minimal environmental impact. Available in two sizes – 20ft and 40ft –each SwimBox is completely customisable. With COVID now seemingly behind us or at least not causing any restrictions, shows and events are back in full swing. For the vast majority of biennial shows this year, 2023 also means the first edition for four, long years so there’s bound to be some excitement and extra special efforts combined with no doubt huge relief going around in many an event organiser’s office!

In this issue, we roundup some of the key events that have relevance for the wet leisure industry taking place both here in the UK and further afield over the coming months.

AQUANALE 2023 ON COURSE FOLLOWING STRONG EARLY BIRD PHASE

German international trade fair aquanale, is on course following the end of a strong the early bird phase at the start of the year. As a leading international industry trade fair, it has already registered a strong exhibitor response, including all domestic and foreign companies of relevance for the market. “We anticipate a very good aquanale that will seamlessly connect with the strong previous events and will continue to develop – especially since we can now plan without the restrictions of the past three years,” said Matthias Pollmann, Vice President Trade Fair Management of Koelnmesse – a clear signal from the industry that aquanale is indispensable as an international industry platform.

Taking place in Cologne from 24 to 27

October 2023, the autumn event runs parallel with FSB, the International Trade Fair for Public Space, Sports and Leisure Facilities. aquanale will once again take place in Koelnmesse’s modern Northern Halls 7 and 8. Hall 7 will present pools and swimming pool technology. The talks venue for the International Swimming Pool and Wellness Forum will also be located in Hall 7. Saunas, whirlpools, wellness and spas as well as the private swimming pool segment, including aboveground pools, will be on display in Hall 8.

The International Swimming Pool and Wellness Forum (ISWF) will be staged for the tenth time. Organised and hosted by the bsw in cooperation with IAKS, the International Association for Sports and Leisure Facilities, an informative and thematically oriented specialist programme will be presented here on all four trade fair days whilst the EWA Village, a cooperative project of the European Waterpark Association (EWA) and Koelnmesse will this year concentrate on the theme of ‘Green Waterparks’.

New for this edition, aquanale has also reached agreement concerning a strategic partnership with the association of the Finnish sauna industry ‘Sauna from Finland’.

HOLIDAY PARK & RESORT INNOVATION RETURNS WITH NEW OWNERS

Agriconnect – the people behind the country’s biggest agricultural information business – are looking forward to hosting the UK’s largest

exhibition and conference for holiday parks, leisure and attraction businesses this November at the NEC, Birmingham.

The company acquired the Rural and Leisure portfolio from Fortum International in late 2022 which included the annual Holiday Park & Resort Innovation show.

Scheduled for 15-16 November, Agriconnect will bring together over 12,000 buyers and sellers to four co-located shows to network, share ideas and innovations, do business and make valuable connections.

Determined to put their mark on the 2023 shows, the new owners have already made some exciting changes, including moving to halls 18, 19 and 20 at the NEC which provides a much better space and greater opportunities for exhibitors and visitors to collaborate. “We have a long and successful track record in delivering large scale events which positions us perfectly to transform all four shows into something spectacular for both exhibitors and visitors alike,” said Justine Sumner, Operations Director at Agriconnect.

As Europe’s largest event in the leisure and hospitality industry, the two-day Holiday Park & Resort Innovation 2023 show is an unmissable opportunity for those within this sector, especially given the recent rise of popularity seen in the UK’s domestic holiday market. Visitors to the event will be able to expand their knowledge on the industry as a whole as the show delivers first-hand expert advice on the latest products and trends.

With the wet leisure remaining a key sector again this year, the event’s organisers are expecting some incredible exhibitors to head to the Midlands venue, many of whom will

EXPECT MORE COMPANIES AND SPACE AT PISCINA & WELLNESS BARCELONA

Barcelona is on a very good commercial path having reported in February that it had already exceeded the surface area contracted in 2021 by 30%. At that point, Fira de Barcelona’s biennial trade show, which will take place from 27 to 30 November, confirmed the participation of more than 200 exhibitors from 23 countries, equalling the number of companies from the previous edition. These figures point to one of the best editions of the last ten

years, coinciding with the good prospects for a sector that is growing at 5% per year in Spain.

With February’s results in mind, the event’s organisers expect to exceed 300 exhibitors this year and occupy 30,000m2 gross in halls 1 and 2 of the Gran Via exhibition centre. If these new objectives are met, the show will grow by more than 40% in terms of both the number of companies and the surface area contracted compared to the last edition. Likewise, it would once again be confirmed as one of Europe’s most international shows for the sector, bringing together 65% of firms from outside Spain.

With the backing of the Spanish association Asofap and the world’s leading companies in the swimming pool sector, the Barcelona trade fair will showcase the most representative and innovative commercial

offer of the swimming pool and wellness product value chain. Sustainability and savings in water and energy consumption, the improvement of the user experience of swimming pools, wellness areas and aquatic facilities, as well as the automation and digitisation of maintenance will be the main features. It will also demonstrate how innovation applied to the world of swimming pools creates new spaces for wellness, health and community enjoyment.

The trade show’s director, Ángel Celorrio, attributes this high level of interest in the fair to “the high level of loyalty and confidence of the major brands, the return of many companies that are participating again after the pandemic break and the international appeal of the Spanish swimming pool market, the second largest in Europe, which is very receptive to the incorporation of innovations”.

TURKEY’S AQUAFUN TEAM ANNOUNCES EXPANSION OF EXPO

The AQUAFUN Expo, which forms part of the larger ATRAX event, has achieved great success in three years as the only leading expo in the pool, spa and water entertainment sector in the region. However, due to the fair’s success pushing the limits of the existing halls, a decision has been made to move into Hall 8 of the Istanbul Expo Center, which offers a wider and more spacious venue.

This new hall will accommodate more companies and offer a larger business platform for the AQUAFUN part of the Expo and bring together industry companies in a new location. AQUAFUN itself provides numerous opportunities such as collaborations, product presentations, brand visibility and networking opportunities.

The International ATRAX-AQUAFUN Expo will take place from 11–13 January 2024, and aims to bring together industry companies and buyers from all around the world.

entertainment, leisure, physical activity areas, parks, urban design and social activity areas. While guiding investments as a massive industry in the sector, ATRAXAQUAFUN invites both exhibitors and visitors to push the boundaries of new business ideas with a holistic approach.

A total of 22,605 professional visitors from 62 countries, including 6,330 overseas visitors were at the previous fair, and met in Istanbul to see the products and services exhibited by 196 companies, to establish connections and to evaluate business opportunities.

AQUAFUN will host strong commercial connections and make a strong contribution to the sector by bringing pool and spa professionals together with tourism and

social facility investors from different parts of the world, public, construction companies, municipalities, architects and sector representatives.

The number of foreign visitors is expected to increase to a record level at the ATRAX & AQUAFUN 2024 exhibition with Istanbul being one of the most important trade points of the world – the junction point of the continents of Asia and Europe.

New Beginnings

I’m new to this… I haven’t merged two businesses into one before and I haven’t written a magazine piece either. The first one seems to be going pretty well. I will let you make your own mind up about the writing when you’ve reached the bottom of the page. (If you do.)

Before I joined Golden Coast I worked for Audi. Audi know a thing or two about customer service and it didn’t take me long to realise that Golden Coast shared that commitment. It was a completely different business but it shared values that I clearly recognised. The principles of good customer service cross industries but it’s fair to say that there is a considerable difference between a spa and an S4, but I was in luck. If you were looking for someone to introduce you to the wet leisure industry, if you were looking for a mentor or a guide, you would be hard pushed to do better than Jamie Adams and within a year or two I was thoroughly immersed in the world of pools, spas and saunas and enjoying every minute of it.

Perhaps there was an element of transferring skills between companies that held me in good stead when, after five years of working as Golden Coast’s Sales Director, I was asked to be General Manager of the new business that resulted from the merger with PPG UK.

A NEW OPPORTUNITY

Bringing two businesses together isn’t the same as starting one from scratch. It goes without saying that it was something I had never done before. I was new to it.

When we looked at the two businesses we realised that they had achieved their success in their own different ways. They had their own ways of doing things, their own practices. These were qualities that had to be recognised and built on. We weren’t looking for a new broom. We weren’t working with a blank sheet of paper.

Golden Coast and PPG UK needed to be stronger together than they had been as separate concerns and that meant we had to respect the qualities that made them successful in the first place.

It’s fair to say that in the beginning there were a few problems. It’s one thing getting the people from two separate businesses to

work as one, it’s quite another thing to get the technology from the two to do the same thing. From phone systems to stock control, nothing seemed to share a common language. From IT infrastructure to warehouse processes, the two businesses had found different ways of doing the same jobs and those processes had to be brought together.

Most of the integration is complete now but that means that the work is just beginning, not that the job is done. We are making changes that reflect what is new in our industry and what sort of a distributor our customers want us to be.

SO WHAT’S NEW?

The global events of the last few years have changed the wet leisure business landscape more than it has been changed before.

Staycations, home improvements and an increased focus on health and wellbeing have been immensely positive influences. On the other hand, major concerns are energy efficiency and environmental sustainability. According to the latest Wet Leisure Survey, 85% of customers are looking for energy saving and eco-friendly products. While rapid progress in areas such as water treatment, energy efficiency, and automation is revolutionising the industry, this growth in the importance of technology and the constant

innovation in that area make technical training and technical support even more valuable than before.

The wet leisure industry has witnessed a significant shift towards wellness and health.

As people become more conscious of the importance of self-care and stress reduction, water-based activities will be sought after for their therapeutic benefits. Hydrotherapy in one form or another formed the basis of our industry and it looks like we are witnessing a return to those values. By emphasising wellness, the industry is better positioned to cater to the evolving needs of the healthconscious consumer.

People are increasingly looking for a unique and personalised experience.

With almost every pool, spa or sauna installation, people are seeking something that is exclusive to them in terms of aesthetic, performance or style. Being able to provide that unique experience is key to success in today’s wet leisure market.

So although Golden Coast may well be looking at a new beginning, it seems that many of its principles, those of knowledge, innovation and customer service, have retained their value.
