It’s (Almost) Showtime!

T

he COVID-19 pandemic caused a cultural shift for the AAOC after pushing our association in a direction that required fast-tracked technological innovation and alternative methods to deliver member services and programming. The pandemic may have prevented the association from holding in-person events, classes, and other functions, but true to AAOC’s mission — “To promote, protect and enhance the rental housing industry by providing programs and services that enable our members to operate successfully…,” — our AAOC staff quickly pivoted and were able to continue doing just that — online. And that online delivery of programs and services is now something that will continue to be offered, even as businesses (including AAOC)

transition back to more normal and familiar operations. We stood together over the past 16 months, and we are now coming out of the pandemic, perhaps a bit battered and bruised, but still on our feet and in business. I have said many times before that our rental-housing industry is comprised of resilient individuals and businesspeople who may get knocked down from time-to-time, but who get back up, dust themselves off, and get back to doing what they do best. This speaks to our industry’s strength and determination, and I am proud to be a member of this industry with you. That strength was particularly evident as AAOC triumphantly resumed in-person events last month with its Multifamily Mingle on June 24th. Member attendance and enthusiasm was off the chart, and it confirmed that our industry is eager and ready for more in-person interaction. I look forward to welcoming members back this month for select in-person and online combined education classes at the AAOC office, and next month on board The Wild Goose for AAOC’s Summer Cruise on August 12th. What I am most looking forward to, however, is having our industry come together for the Apartment Association of Orange County’s 50th Annual Trade Show & Conference on Thursday, September 30th at the OC Fair & Event Center. This will be the place for us to enthusiastically and joyfully reconnect and get back to doing business. We

have all come out of an extremely challenging time — both personally and professionally — and I can’t wait to say hello to all of our rental property owners and operators, vendors, and other valued participants and attendees at the show. This will be a truly special and celebratory day for AAOC and our industry. Who would have thought, when we chose our trade show theme nearly two years ago, that “Rental Housing: Roaring into the ‘20s” would take on so much additional meaning after a one-year delay due to a worldwide pandemic? We planned to present a show with a fun theme that would encourage creative booth décor and exhibitor costuming, channeling the spirit and style of the “real” “Roaring ‘20s” — 100 years earlier. Little did we know that our show would end up being a case of life imitating art, imitating life. I hope you will join us at the show and be a part of our “Roaring ‘20s” celebration. We want our ‘20s — the 2020s — to be a decade of prosperity for the rental-housing industry. AAOC members who attend this trade show and do business with fellow members is certainly a way to help make this happen. Plus, the show provides an excellent opportunity for you to network with fellow housing providers and vendors, attend educational seminars and maintenance demonstrations, and more. California’s Economy Continues Going Strong; Seemingly Unfazed by Pandemic

D

o you wonder why we have an affordable housing crisis? Let’s start with our Golden State. It does not have a peer among developing economies for growing GDP, creating jobs, increasing household income, manufacturing growth, innovation, unquestionably producing and requiring producing clean energy, and unbelievable wealth through stocks, bonds, and technology. This is underscored by Governor Newsom’s press

statement that he would engage in the largest state tax rebate in America. The state has added 1.3 million people to its non-farm payrolls in one year. The time period April 2020 through April 2021 is remarkable. This is equal to the entire workforce of the state of Nevada. Our state easily surpassed the states of New York and Texas. Our household income increased by $164 billion, which is almost as much as Texas, Florida and Pennsylvania combined. So, does this give you an idea that the state’s operating budget surplus, fueled by its rapidly growing economy and capital gains taxes increased to a record $75 billion? California’s record productivity was accelerated by COVID-19 over the last few months. Revenue per employee of publicly traded companies rose to an all-time high of $1.5 million in May which is 63% greater than a decade ago. The remaining U.S. states performance was nothing special. In fact, the other economic index, referred to the Russell

3000 Index, which is made up of large and small companies, really did not change much over the past 10 years. Many people have claimed our state to be bad for business but, job performance, GDP, wealth, job growth and many other economic factors belies the investor demand. Using the weight of the S&P 500 Index, investor demand increased 3 percentage points since a year ago. This is the highest increase among all states. Even credit usage was incredible with the weight of corporate bonds sold in the state rising the most of any state to 12.5 percentage points, from 11.7 percentage points, according to the Barclays US Corporate Bond Index. So, what can we conclude? Investors had high levels of confidence in California companies during the pandemic. And another measure of economic strength is the state’s gross domestic product, which increased by 21 percent during the past five years, which far out produced the No. 2 state, New York (14%) and Texas (12%). The gains added $530 billion to the state and 30% more than the increase for New York and Texas combined. To put it in another prospective, it was the equivalent to the entire economy of Sweden. California outperformed the U.S., Japan, and Germany with a growth rate that was exceeded only by China. California’s base in factory jobs gained 13% over the past five years to $315 billion in 2020 which was far more than any of the 10 largest manufacturing states. Texas was No.2 with 9% growth


and Indiana at 8%. Corporations are also the undisputed leaders in renewable energy. Twenty-six companies are worth $897 billion or 36% of the U.S. industry. No other state can claim that 21% of the electricity derived is from solar energy. Shares from these companies increased by 282% during the past 12 months. The companies also increased their workforce by 35% since 2019, almost triple the rate for the rest of the United States and four times the global rate. Water shortages and wildfires have devastated the state. It seems as if that is the continual topic of conversation. The state GDP equivalent of $40.2 billion is derived from agriculture, forest and hunting last year. That is greater than the combined next largest states of Iowa, Washington, Illinois, Texas, and Nebraska combined. Economic disruption caused by COVID-19 was interesting. California was the No. 1 state for global trade, with the Port of Los Angeles and the Port of Long Beach seeing growth that led all the U.S. rivals for the first time since 2020. Investing in California marches on. And so, the legislature and the Newsom Administration should capitalize on growth and wealth. They, among other things, should not punish rental property owners, agents, the millions of personnel, and businesses that serve the industry, nor should they dissuade capital investment providing rental housing by enacting incredibly harmful new or revised laws. Our next article will focus on changes to the Emergency Rental Assistance Program (ERAP). Hopefully, the legislature recognizes property owners need to be renumerated and to do that requires structural changes to the ERAP. ORANGE COUNTY LEGISLATIVE WATCH B y B ill C hristiansen , V ice P resident of G overnment A ffairs

Citizen Politicians and Rent Caps

F

rom Ronald Reagan’s Farewell Address to the Nation “[B]ack in the 1960s, when I began, it seemed to me that we’d begun reversing the order of things—that through more and more rules and regulations and confiscatory taxes, the government was taking more of our money, more of our options, and more of our freedom. I went into politics in part to put up my hand and say, ‘Stop.’ I was a citizen politician, and it seemed the right thing for a citizen to do.” In Orange County we have 34 cities, all governed by citizen politicians who are elected by the voters of their respective city. We are fortunate to have nearly 250 citizen politicians serving as city council members in Orange County. These individuals give up significant amounts of personal time to help govern their communities. While not all city council members share our values and support rental housing industry issues, most cities in Orange County do have clear majorities of council members

who do. AAOC supports city council members and others who, like Ronald Reagan, will say “Stop” to policies that can hurt our industry. Our AAOC Political Action Committee exists to support candidates for elected office who share our values and who are committed to the defense of private property rights, free enterprise, small business, and responsible regulation of the rental housing industry. Over the next year, the AAOC Legislative Committee and AAOC Political Action Committee trustees will work to identify, vet, interview, endorse and approve contributions to the candidates running in the 2022 city council elections whose values align with AAOC and the rental-housing industry at large. We are fortunate that no cities in Orange County currently have rent control or eviction moratorium ordinances that go beyond what has already been imposed at the statewide level through the legislative process. The

goal of the AAOC Legislative Committee is to keep things that way. AAOC recently became aware, however, that a movement is afoot in Santa Ana to implement an aggressive and radical rent control ordinance in the city. The same Santa Ana activists who have twice failed to place rent control measures on the city election ballot, proposed to city officials in late June introduction of a new rent control ordinance by the city council. As of the writing of this article, AAOC is actively monitoring this development and working as part of a larger coalition of housing industry associations to fight this proposal and keep rent control out of Santa Ana. If Los Angeles-style rent control gains a foothold in Santa Ana, it could easily spread to other cities in the county. AAOC will keep you apprised as this issue evolves in Santa Ana. California Rent Caps and Current CPI for Orange County Rent Increases California’s rent cap restriction law, AB 1482 by Assemblyman David Chiu, took effect in January 2020. It establishes a statewide cap on rent increase of 5% plus the regional Consumer Price Index (CPI) per year. The rent cap calculation is based on the CPI from April 1 of the prior year to April 1 of the current year. Effective August 1, 2021, rent increases for the next 12 months in Orange County will be capped at 5% plus 3.6% CPI, for a total of 8.6%. Should I check smoke alarm batteries in my units or is that the residents’ job? Also, how often should I clean out my water heaters, not to mention A/C filters and so on? Linda

Dear Linda, 1. Most rental agreements have a check box that says the resident is responsible for the operation of the smoke alarm. The newest rental agreements now have a check box for carbon monoxide alarms. We lay awake at night thinking about that little check box. In order to sleep, we check the residents smoke and CO alarms every time we do maintenance on the unit. We keep a log of each time we check and what action was taken. The smoke and carbon monoxide alarms should be “officially” checked and logged at least once a year. Typically, January is a good month

2. A typical 100-gallon water heater, depending on the BTU rating, will cost anywhere from $4,700 to over $6,500 installed. That cost alone should be incentive to clean out the heater regularly. Normally, the clean out should be done at least once a year. If the water at your building has a high mineral content, then it should be cleaned out every nine months. Again, keep a log of each clean out. It will help in remembering when to do the next cleaning. 3. If your building has forced air and heating, the filter should be checked, cleaned or replaced each October or November and each May or June. This will help keep your systems working properly and reduce strain on the components. It will also ensure proper filtration before the winter and summer workloads. 4. of the laundry room dryer. Everyone knows about cleaning out the dryer lint basket and throwing it on the laundry room floor. We’re talking about cleaning out the lines leading out the back of the dryer. Keeping the exhaust vent tubes clean will help cut down on gas and electric usage, longer machine life and shorter drying time and lint in these tubes have been known to be a fire hazard. Maintenance Men — continued from 10 want to get rid of the rodents yourself. Keep in mind that rats and mice are smart and conservative. They are not risk takers. In their minds, a trap out in the middle of the floor is too risky to investigate. Rodents will run along walls, rafters and other low exposure areas. Put the traps along these routes about ten feet apart. A good bait to use is peanut butter. Patience is king when

trying to trap a rat. Place all your baited traps, but do not set them for a day or two. Let the rat nibble at the bait danger free. This last part is the hardest to do. However, patience will win out. If you rush ahead and set the traps and the rat triggers one and is not caught; it will remember! Also, avoid using traps designed for mice. It will only annoy the rat and it will be smarter for it. The same goes for using rat traps to catch mice. The trap is too big and when

sprung may miss the mouse. Using poison is another option. Anticoagulant poison is very popular. This poison causes the rat’s blood to thin. It will make him thirsty and when he drinks water, he will bleed internally. When using this option, be sure to leave a saucer of water near the poison. The poison normally comes in bars that can be broken up into pieces. Remember, rodents hoard, so just because the poison is gone, does not mean they ate it. Put more until they stop taking it. The local hardware store should carry this product, but it is best to go to a farm supply store. They will have the best quality supply. Be careful with placement, so other animals do not eat this poison. The hardware or farm supply store carry approved bait dispensers designed for rats or mice. Again, patience is rewarded. Before using poisoned bait, use crunchy peanut butter to let the rats get used to the bait station for a few days. Then add the poison bait with a little bit of peanut butter. Glue traps are also a viable option. It is important to use large rat-sized traps. Put the glue trap along a known rat runway, or along a ledge or rafter used by the rodents. It is important to nail or fasten the glue trap in place. Place a bit of peanut butter in the middle of the trap as an attractant. Happy hunting!

Cut the grass. 2. Edge the grass. 3. Pull out weeds between the sidewalk cracks, walk around the building, including the alley. 4. Turn over the dirt in all the flowerbeds each week. 5. Pick up any trash around the property. 6. Broom, blow or hose down the walkways. 7. Turn on the sprinkler lines, check for clogged heads, broken lines, etc. 8. Check that the timer is set properly.

10. Maintain communication with the owner about problems or improvements. The above list takes time, half an hour minimum at a small property. If your landscape gardener completed the list on a weekly basis, you could very well have the best-looking property on the block, which means higher rents. And if you add colored flowers, even higher rents! Finding a landscape gardener to do above list consistently is not easy. Ask your local apartment association for recommendations or look in your neighborhood or city for a property with outstanding landscaping and ask who the gardener is. Request a quote according to your “list.” Keep in mind that a landscape gardener who provides the above service will charge more than a “blow and go” gardener, however, your property will reflect their above average service.

Inflation and Proposed Tax Changes

R

ising inflation and tax changes are two developments that have recently surfaced, so let’s take a look at them.

INFLATION —

As of the writing of this article, inflation has spiked. Depending on who you listen to, you either think the “sky is falling” or there’s nothing to worry about and this inflation spike is transitory. In April, the inflation rate of 4.2% topped mortgage rates of 3.1% for the first time since 1980. The Fed, however, believes this is transitory. The Fed has a tough juggling act to keep inflation mild and employment high, and has done this largely by keeping interest rates historically low. Now, the Fed is ignoring new inflationary hints like soaring prices in commodities (gas prices), durable goods (used autos) and homes (record values) that this low interest-rate policy helped create. However, the Fed says an increase shouldn’t be a surprise, especially in light of the economy evolving out of the COVID pandemic at unprecedented rates and in untypical ways. For example, three sectors — used autos, public transportation and lodging away from home, though making up only 6.5% of core CPI, imposed a major impact on the inflation trend. For instance, used autos, largely due to semiconductor shortages stunting new car production and sales, made up nearly one-third of the 3-point rise in Core CPI. Of course, we know that recent price increases in

airline fares and hotels and motels reflect the easing of COVID- related restrictions. The Fed believes these one-time increases of prices are likely to have only transitory effects on inflation and expects inflation to return to — or slightly above — their 2% long-term goal in 2022 or 2023. This is open for much debate, and opinions seem to swing as new data points are released.

TAXES —

President Biden recently proposed tax code changes that, if passed, would dramatically change our tax and estate planning. Though this is a proposal only, the president whose party controls Congress is proposing it. President Biden says this proposed change to the tax code would fund his multi-trillion “American Families Plan.” Here are some of the highlights or lowlights: Basically, the three aspects of our business that are threatened are: 1. 1031 Tax-Deferred Exchanges 2. Capital Gains Tax 3. Step-up in basis

Limitation on 1031 Tax-Deferred Exchanges:

The proposed change to IRS Section 1031 would affect real estate investments where the profits exceed $500,000. Nationwide, approximately 70% of deals included a 1031 exchange with 80% of these transactions exceeding $500,000

in deferred gain. This would affect most all of us!

Increase in Capital Gains Tax:

Today the Federal Capital Gains Rate is 23.8% (includes Capital Gains Tax + Medicare Surcharge on Net Investment Income). Biden’s proposal would increase this Capital Gains Tax rate from 23.8% to 43.4%. Adding in California’s rate of 13.3% would push the total to 56.7%.

Elimination of Step-up Basis:

The bill includes an exemption of $1 million for individuals and $2 million for married couples, but eliminates step-up above these levels. The increase in capital gains tax and elimination of the step-up in basis go hand in hand in efforts to increase tax revenue from real estate owners. This would affect our heirs. If passed, there are three options on the table as to when these tax changes might be implemented: 1. Retroactive to January 1, 2021 (unlikely) 2. Date bill is passed; and 3. January 1, 2022. To summarize: • We know the capital gains tax is as low as it will be, but we won’t know the increase until the bill works its way through Congress. Craig’s Corner — continued on page 20

June General Membership Meeting Recap

A

s the California economy officially “reopened” on June 15, many questions remained regarding new health and employmentrelated guidelines for businesses to follow. These questions and many other burning COVID concerns were discussed that evening during the AAOC General Membership Meeting entitled “Getting Back to Business: What You Can Expect in a ‘Post Pandemic’ California.” Colin Calvert, a partner with the law firm Fisher Phillips, LLP reviewed the guidelines issued by the California Occupational Safety and Health Administration (Cal/OSHA), which included the provision that employees who are fully vaccinated will no longer need to wear face coverings. Individuals who are not fully vaccinated, must wear

coverings when indoors or in vehicles with other employees. Employers must provide N95 masks upon request. However, a new revision states that employers must allow fully vaccinated employees to wear face coverings, if they so desire, without fear of retaliation. Calvert also advised that employers will be required to “have documented” that a person is fully vaccinated. Employers can request the vaccination card, but Calvert is recommending not to retain a photocopy of the card, but simply confirming or having the employee sign a form verifying vaccination. Calvert was hesitant to the idea of keeping card copies, due to the potential for the document to be misused, stolen, or pirated. If there is an outbreak of COVID-

19 in the workplace, employers are required to provide a written notice, along with a “verbal notice” if they reasonably know than an employee has not received the written notice or has limited literacy in the language in which the written notice was provided. Fully vaccinated employees without symptoms generally will no longer need to be excluded from the workplace after exposure to COVID-19. This also extends to relief from having to exclude employees who were in close contact if they had COVID-19 within the last 90 days and have remained symptom-free. A Mid-Year Market Check-In

T

he restrictions of the pandemic appear to be behind us. Even Disneyland has re-opened and everyone is hopeful that there will be a full economic recovery. But is that really possible? What about real estate and the housing market? We all know that home prices skyrocketed. However, now we are seeing a slight pullback. Certainly, the same cannot be said for other real estate sectors. Rental property values have definitely been challenged. But the overall picture is one of neither a balloon burst nor a crash. Sellers have not flooded the market and buyers have not fled. For the last ten months, using MLS (Multiple Listing Service) data, I have been taking periodic snapshots of fourunit property sales in Orange County. Between July and August of last year, active listings decreased by 16% from 67 to 56. This downward trend continued through the end of the year and into January. By the first of February, the number dropped to 39 active fourplex listings and has continued to hold steady with 35 properties listed for sale as of June 22nd. As might be expected, sales reflected a similar pattern. What is interesting is that the numbers for expired and cancelled listings also dropped significantly. In mid-August of last year, 37 properties were listed as expired and another 23 contracts as cancelled. Ten months later, those numbers are 27 and 10, respectively. That’s a 37% decrease

for expired listings and 130% for cancellations. All of the above statistics demonstrate that there is a demand. But, when you look at prices, nearly 90% of the active listings are being offered at less than originally priced. Researching a little deeper into those properties that sold within one to two months versus others on the market for longer periods of time, the reality is that although there is demand, buyers are cautious about what they are willing to pay. Unlike what happened in the singlefamily market, there has been no “feeding frenzy.” So what are four-plex buyers seeking? Low mortgage rates have made buying real estate attractive. Investors are also looking for opportunities that offer cash flow, plus an upside potential. However, with the realities of statewide rent control and the uncertainties of how long the eviction moratorium will last, buyers want to see that the numbers make sense or, at least, the potential is there. Prices are definitely up from where they were as the realities of the pandemic gripped Southern California, delinquency rates soared and apartment owners had to figure out how to operate under new protocols and in a much more virtual world. Despite the downward pressures on the rental market, investing in residential income property has remained popular. A look at recent sales shows that a well-priced four-plex will close

within one-to-two months. Properties on the market for five or six months or longer have sold as well, but usually only after one or more price adjustments. The question remains — what is ahead? During the mid-June meeting of the Federal Reserve, there was an acknowledgement by Chairman Jerome Powell that some of the dynamics of the reopening are “raising the possibility that inflation could turn out to be higher and more persistent than we anticipate,” but the anticipation is that there will not be rate hikes until 2023. A combination of low mortgage rates and a stronger economy is good news, but what apartment owners need to watch is what happens in terms of income and expenses. That topic has been touched upon in previous articles but may bear some further consideration. At the moment there are probably more questions than answers, but as an apartment owner and investor, the very fact that you are continuing to read, learn and stay aware is one of the best protections that you can ever find. New Legislation Aims to Bolster Affordable Housing Special from the National Apartment Association

O

n May 20, 2021, Senators Coons (D-Del.) and Kramer (R-N.D.) introduced S. 1820, the “Choice in Affordable Housing Act,” a bipartisan piece of legislation that will increase investment and reduce programmatic barriers to attract and retain robust housing provider participation in the Section 8 Housing Choice Voucher (HCV) program. The National Apartment Association (NAA) proudly supports the

“Choice in Affordable Housing Act” and applauds both senators for their work on this bill, which addresses many of the burdensome barriers that complicate and deter housing providers’ participation in the HCV Program. Importantly, the proposal maintains the voluntary nature of the program, as Congress intended. The HCV program is the nation’s primary and most successful rental subsidy program. New Legislation — continued from 24 property owners in the study’s dataset who refuse to accept voucher holders had, in fact, accepted them previously, a testament to the program’s programmatic challenges. Revitalization of the HCV Program has remained a key priority for NAA and the industry it represents; in fact, it was a key priority at this year’s Lobby Day. In 2018, NAA gathered industry experts to identify the most significant challenges for owners and operators. We proposed practical solutions that would incentivize voluntary participation in the HCV Program and optimize its potential for success. Due to NAA’s strong, continuous advocacy, many industry asks were included in the bill, such as: • Incentive payments to new housing providers who operate in areas of opportunity, in order to increase renters housing choice and access.

• Administrative fee bonuses for Public Housing Authorities (PHAs) that administer the program to hire “landlord liaisons.” Liaison would serve as a dedicated resource for program participants to resolve challenges and provide consistent guidance and training.

• Application of Small Area Fair Market Rent (SAFMR) methodologies in more jurisdictions to ensure accuracy of payments and alignment with market rates, including an exception to prevent SAFMR calculations from decreasing rent payments.

• Security deposit assistance to help voucher holders with upfront housing expenses and provide housing providers greater protection against damages.

By speeding tenancy approval processes, reducing duplicative inspections requirements and providing better ongoing support for housing provider participants, the “Choice in Affordable Housing Act” will encourage more voluntary participation in the program and, most importantly, increase positive outcomes for participating owners and residents alike. Inflation — Is It Baa-aack?

And if so, is it good or bad for rental housing?

F

or those old enough to remember, inflation used to be “a thing.” If around during the Carter Presidency (1977–1981) you experienced some of the most harrowing years, as double-digit inflation seemingly became an entrenched feature of the U.S. economy. Punishing inflation — it peaked at 13.5% in 1980 — weighed on America, inflicting hurt on a broad spectrum of society, from families having to dig deeper and deeper into pocketbooks to buy groceries, to businesses and investors confronting debilitating borrowing rates. Mortgage rates spiked into the mid-teens and bank prime rate topped out in nosebleed territory at 21.5% (that benchmark rate is presently 3.25% as of the writing of this article on June 14, 2021). High inflation and its resultant financial trauma continued to afflict the economy through the 1980s…bank prime was at the still very unpleasant level of 11.5% as late as 1989. But then inflation went quiet for thirty years. The Consumer Price Index (CPI), the most commonly used index to measure inflation, averaged just 2.38% from 1991 through 2020, with the past ten years registering at barely a whisper, at an average 1.73% annual rate. In fact, it had become so de minimis in the eyes of some economists that deflation had become a greater source of worry than inflation. But hold on…could inflation now be emerging from its multi-decade hibernation? While the adjacent chart shows CPI

at a relatively benign 2.6% at close of Q1 2021, the rate has climbed sharply the past few months, reaching 4.2% in April and then 5% in May, and a number of prominent market observers have voiced concerns that inflation could potentially be reemerging as a disruptive economic factor. Former U.S. Treasury Secretary Larry Summers, a Clinton appointee, and former chair of the Global Development Council, Mohamed El-Arain, an Obama appointee, are among the higher profile economists to question messaging from Fed Chairman Jerome Powell and U.S. Treasury Secretary Janet Yellen, both of whom have repeatedly stated that recent higher inflation is thought to be “transitory,” i.e. NOT a long-term, structural problem. Dr. Ed Coulson, an economist at UC Irvine and Director of the UCI Center for Real Estate, who studies inflation and teaches about it, finds the case for temporary inflation to be a reasonable view. He points out that “the pandemic has had profound impact on supply chains, causing scarcity shocks in raw materials, parts and finished goods, forcing prices higher in the short term.” But Dr. Coulson expects successful COVID vaccine roll out programs to gradually reverse the balky supply lines as vaccinated workers return to jobs and business operations bounce back. He emphasizes that supply chains are largely integrated within a global network, stressing the critical importance of getting vaccines distributed worldwide to July 2021

ultimately achieve a more normalized international movement of goods and services and an improved equilibrium in supply-demand relationships that affect the pricing of goods and services. Regardless of which way investors may play the transitory inflation versus extended inflation proposition, it seems undeniable that some upward inflation is presently deploying into the economic biosphere. Regarding rental-housing investors, netting out the pluses and minuses, it’s hard to envision that inflation would bring lasting benefits. While one might anticipate some upward pressure on real estate values from inflation, there would also be detrimental impacts like increased labor and general operational costs and a basic financial toll taken on the working-class citizens that comprise the customer base (tenants) in most multifamily communities. On balance, and this is not breaking news, stable, moderate inflation works best for consumers, businesses and governments. It allows everyone to budget, assess financial risk and predict financial outcomes more accurately, which in turn fosters confidence in investment and spending, and “faith in the future,” a vital component of healthy economies. The traditional inflation antidote has been a dose of higher interest rates. Not a pleasant thought, but nevertheless a likely necessity to preserve marketplace order and maximize productivity and prosperity over the long haul.

Commercial Property Assessed Clean Energy (C-PACE) is a decade old finance tool that enables energy and water efficiency, seismic retrofitting and electric vehicle charging infrastructure, renewable energy, and fire resiliency improvements on multifamily buildings, among other commercial property types. Retroactive financing through C-PACE allows multifamily property owners access to capital for PACE eligible projects completed in the last five years. Ygrene C-PACE financing is viewed as gap financing which compliments, rather than replaces, traditional commercial financing. Depending the size of the C-PACE project and underlying asset, interest rates on C-PACE financing are comparable to other traditional finance options but with far more favorable terms. Multifamily property owners are utilizing C-PACE to replace more expensive mezzanine debt or preferred equity, ultimately lowering the blended cost of capital for the project. When considering a project’s capital stack, Ygrene C-PACE financing works well with federal and state incentive programs, such as tax credits, tax incremental financing, bond financing, and utility rebates. Moreover, with the special tax attached to the property, there is an opportunity for the multifamily property owner, in certain situations, to pass the special tax along with some of the savings through to commercial tenants. Ygrene C-PACE benefits include: (i) 100% upfront financing with no required down payment (ii) competitive fixed market rate interest (iii) self-amortizing principal and interest payments (iv) long-term maturity based on the useful life of the improvements, often lasting between 20 and 30 years (v) no prepayment penalties and the ability to partially prepay at any time (vi) nonrecourse obligation with no personal guarantees Ygrene C-PACE proceeds are repaid by a special tax lien, paid through property taxes, which attaches to the property thereby eliminating any personal liability or credit constraints to the property owner.
