On 21 January 2014 the Supreme Court of India indicated in Writ Petition (Criminal) no. 55 of 2013 that the ratio laid down in Devender Pal Singh Bhullar v. State (NCT) of Delhi (2013) 6 SCC 195 is per incuriam and that there is no good reason to disqualify TADA cases as exception from commutations on the ground of delay. 30
