Downsize Current Digs For now, skip the luxurious rental in a popular part of town. You could save hundreds of dollars on your monthly rent by downsizing to a smaller place in a less trendy neighborhood. Real Estate Auctions Flip through a newspaper or magazine and you’ll see a surprising number of different types of real estate auctions offered. Most people tend to skim over the type to flip the page over to the next glossy photo. So what are the different types of auctions? The three most popular are real estate owned (REO), bank owned, trustee sale and consignment auctions. Let's take a closer look at each one of these and maybe then, you’ll be able to find one works for you whether you’re a seller or a buyer. The most popular kind of real estate auction is an REO (real estate owned). The property can be owned by a bank, the government or a loan insurer. As soon as the property goes into distressed status, such as when a borrower starts missing his mortgage payments, the bank starts by determining the home's value. Typically the distressed property gets listed as a short sale. If a short sale is not requested, at this point, the beneficiary will move onto the foreclosure process. If the property cannot be sold through a short sale or foreclosure auction, then it becomes an REO property. The next type is a trustee sale. Most of which are held on the town's courthouse steps, local sheriff 's office, or

The most highly publicized real estate auctions are sold through consignment auctions. The owner of the property selects a real estate auction company to help prepare, show and market the home to potential buyers. A date is set and the auction is conducted. Best of all, properties sold by consignment auction are financeable and insurable.

a public location specified by the trustee. These auctions are conducted under the stipulation of the Deed of Trust and are open to all bidders. The property is either sold to a third party bidder at the auction or reverts back to the beneficiary. Trustee Sales require the most due diligence, as the properties are sold as-is, without any warranties expressed or implied. All sales are cash-only and payable immediately after the auctioneer cries "Sold!" Most properties sold this way cannot be inspected or have the advantage of title insurance.

Brother, calling from the Northeast corner of Oregon, is wanting to sell a rental house and, as his replacement property, buy the family farm from Sister. Sister bought the property from Mom and Dad a couple years earlier. There are various flavors of related party exchanges. Selling the old property to a related party in a 1031 exchange – No problem. Swapping properties with a related party (“I’ll give you mine. You give me yours.”) – No problem, as long as there is proper 1031 documentation prior to the swap and both sides hold their new interests for 24 months. Buying the replacement property from a related party – BIG problem. Why? Take a look at our example. Brother is doing a 1031 exchange so he won’t pay tax. Sister only recently bought the property and will be selling it to Brother with little or no gain so she won’t pay tax. Who lost in this equation? Uncle Sam. Whenever families do these deals the IRS will lose - every time. For that reason…the basic 1031 rules prohibit buying the replacement property from a related party.

One exception (this is tax law, there is always an exception)…if Sister, when selling to Brother, is going to do her own exchange then Brother can buy from her. Sister’s exchange will keep those dollars invested in the American real estate economy – the behavior Congress wanted to encourage when it first enacted IRC §1031. Of course, in our scenario Sister has no gain so she has no reason to enter into an exchange, then Brother can’t buy from her. This article merely scratches the surface of some very complicated related party rules. The client must review their situation with their tax and legal advisors, and the exchange company, to determine what options might be available to them. Watch this space for next month’s War Story.

Look Into Alternative Savings Methods Many states offer special incentives to lock in a low interest rate for qualifying home buyers. The U.S. Department of Housing and Urban Development (HUD) also offers free and low-cost counseling for buyers and assistance programs. State grants and loans are often limited and claimed quickly, however, and these programs can expire or change. Consider tapping into an annuity or structured settlement and selling your future payments to a company like J.G. Wentworth for a lump sum of cash now. You could then apply the money toward your IRA account or other down payment savings plan. Don't Forget When you've saved up enough for a home in your price range, get pre-approved for a loan. GLEANING PROGRAM Gleaning is the act of collecting leftover crops from farmers’ fields after they have been commercially harvested or on fields where it is not economically profitable to harvest. Gleaning has, most recently, become a common practice at farmers market too, with local food security organizations and non-profits visiting at the end of the market day to glean “left-over” foods from market vendors. Farmers market gleaning benefits the vendors by providing them with an easy outlet for their

surplus, perishable foods, and it benefits the participating organization by allowing them to collect fresh, local food that they then distribute to their community members. SJFM has had gleaners at the market each season, working with the Portland chapter of Food Not Bombs in 2009, Sisters of the Road in 2010 and AllOne Community Services for the past two seasons. What NOT TO DO as a NEW HOMEOWNER Don’t let the excitement of owning a house cause you to overlook the basics. We’ve gathered up a half dozen classic boo-boos new homeowners often commit — and give you some insight on why each is critically important to avoid. Not Knowing Where the Main Water Shutoff Valve Is: Water from a burst or broken plumbing pipe can spew dozens of gallons into your home’s interior in a matter of minutes, soaking everything in sight — including drywall, flooring, and valuables. In fact, water damage is one of the most common of all household insurance claims. Quick-twitch reaction is needed to stave off a major bummer. Before disaster hits, find your water shutoff valve, which will be located where a water main enters your house. Make sure everyone knows where it’s located and how to close the valve. A little penetrating oil on the valve stem makes sure it’ll work when you need it to. Not Calling 811 Before Digging a Hole: Ah, spring! You’re ready to dig into your new yard, plant bushes and build that fence. But don’t — not until you’ve dialed 811, the national dig-safely hotline. The hotline will contact all your local utilities who will then come to your property to

mark the location of underground pipes, cables, and wires. This free service keeps you safe and helps avoid costly repairs. In many states, calling 811 is the law. Not Checking the Slope of Foundation Soil: The ground around your foundation should slope away from your house at least 6 inches over 10 feet. Why? To make sure that water from rain and snow doesn’t soak the soil around your foundation walls, building up pressure that can cause leaks and crack your foundation, leading to expensive repairs. This kind of water damage doesn’t happen overnight — it’s accumulative — so the sooner you get after it, the better (and smarter) you’ll be. While you’re at it, make sure downspouts extend at least 5 feet away from your house. Not Knowing the Depth of Attic Insulation: This goes hand-in-hand with not knowing where your attic access is located, so let’s start there. Find the ceiling hatch, typically a square area framed with molding in a hallway or closet ceiling. Push the hatch cover straight up. Get a ladder and check out the depth of the insulation. If you can see the tops of joists, you definitely don’t have enough.

Whatever your weather, caring for your home now will help to ensure worry-free days from here on out.

The recommended insulation for most attics is about R-38 or 10 to 14 inches deep, depending on the type of insulation you choose. BTW, is your hatch insulated, too? Use 4-inch-thick foam board glued to the top. Carelessly Drilling into Walls: Hanging shelves, closet systems, and artwork means drilling into your walls — but do you know what’s back there? Hidden inside your walls are plumbing pipes, ductwork, wires, and cables. You can check for some stuff with a stud sensor — a $25 battery-operated tool that detects changes in density to sniff out studs, cables, and ducts. But stud sensors aren’t foolproof. Protect yourself by drilling only 1¼ inches deep max — enough to clear drywall and plaster but not deep enough to reach most wires and pipes. Household wiring runs horizontally from outlet to outlet about 8 inches to 2 feet from the floor, so that’s a no-drill zone. Stay clear of vertical locations above and below wall switches — wiring runs along studs to reach switches.

• Inspect exterior surfaces for cracks and make any needed repairs. • If paint is peeling, cracking, or chipped, repair and repaint now to limit damage to the underlying materials. • Repair any damaged caulk around windows and doors. • Remove window screens and clean with a soft brush and soapy water. Repair any holes or tears or replace the screen material before reinstalling. • Clear debris from gutters and eaves to allow rainwater to drain properly. • Seal cracks in the driveway and keep walkways clear of debris and overgrown plants. • Test irrigation/sprinkler systems and replace any broken sprinkler heads or emitters. Check for proper water coverage and adjust if necessary.

SHARON’S STORY: Lung Cancer, Radon Exposure, & a Call To Action

E

nvironmental Works met Sharon one day while installing a radon mitigation system on her street. She saw our van and came out to ask some questions about radon. This is when we learned about Sharon’s story. Sharon and her husband Jim lived in their NE Portland home for over 40 years. Sharon was a nurse and Jim was an avid outdoorsman and mountaineer. Neither had ever smoked. Sharon went to the doctor for some GI issues, at which time they performed an MRI. The MRI revealed a tumor in her lung. Luckily the tumor was confined to a small region in her lung and had not spread to other organs or tissues. Her cancer was completely removed with surgery, and it has remained in remission. Sharon is now a lung cancer survivor. Around the same time, Sharon noticed that Jim had an unusual sounding “dry cough”. She believes that most people would not have raised concern, but her nursing experience gave her an ear for things that “Just didn’t sound right”. Sharon wanted Jim to see the doctor regarding the cough, but Jim said “It’s just allergies”. Within a

short time Jim woke up one morning and was unable to speak clearly. This was very frightening, and there was no longer any doubt that something was very wrong. Jim’s doctor performed an X-ray showing multiple tumors in his lungs, followed by an MRI showing tumors in his liver and surrounding tissues. A CAT scan then revealed the reason for Jim’s loss of speech. Jim also had a tumor in his brain. Jim started Chemo Therapy, but the cancer was heavily metastasized and the Chemo was causing loss of motor function in his legs. It was soon apparent that treatment was not going to work, forcing the difficult question “How much time does Jim have left?” The doctor told them that he might have 6 months left. Jim passed away just 3 weeks later. From diagnosis to death was only 4 months for Jim. This is common with lung cancer, which is why it is called a silent killer. Often, by the time you have symptoms, it’s too late because the cancer has spread to other areas of the body. After Jim’s death, Sharon started to wonder how? Why? What are the odds that we would both have lung cancer and we’ve

never smoked? Sharon’s physician had mentioned radon gas exposure as a possible contributor. Sharon immediately set up her own short term charcoal tests in the basement of their home, which is also where Jim spent a lot of time after his retirement. The radon levels of her home averaged 17 pCi/L! This is over 4 times the EPA action level of 4.0 pCi/L. That’s when it all came together, and she realized that the most likely reason for their cancer was long term exposure to radon gas in their home. It was hard for Sharon to deal with, all the emotions, the pain of her tremendous loss, the frustration that she just never even knew what radon was or that it could be so easy to test for it and to fix it. So Sharon hired Environmental Works to install a simple radon remediation or “mitigation” system, also called a sub slab depressurization system. The system was installed in one day for around $1,500, and her follow up testing showed a reduction in radon levels to below 1.0 *Continued on page 12

im's KPROPERTY TALK: Common Mistakes Buyers Make e In last month’s article, I discussed the need for buyers to become pre-approved for a home loan before beginning their home search. The failure to become pre-approved prior to commencing a home search is one of the biggest mistakes that homebuyers make when buying a home. With so much information available online and with friends and family giving buyers advice, buyers can become overconfident or overly excited in their quest to purchase a home and often make the following mistakes: Overestimating how much buyers can afford. In conjunction with their online home searches, buyers often use the online mortgage calculators to estimate how much house they can afford. What most buyers fail to account for, however, is the cost of private mortgage insurance (PMI), which varies depending upon the amount of the down payment and the type of loan buyers utilize when purchasing a home. Whenever buyers are putting down less than 20% of the sales price, or qualify for a special loan product that does not require PMI, the charge can add tens of dollars to hundreds of dollars to a monthly mortgage payment. Since buyers’ ability to qualify for a loan and the amount of the loan is heavily dependent upon the total monthly housing cost which includes the principal loan payment, interest, taxes, insurance – hazard as well as private mortgage - and homeowners’ association dues (where applicable), all of these costs must be known in order to adequately calculate how much buyers can afford. Thinking they can accomplish everything on their own. Precisely because there is so much information available to buyers, many believe that they can simply attend open houses or call the listing agent to view the property, and then submit an offer with the listing agent based upon the home value provided by Zillow. The first problem with this practice is the fact that the listing agent represents the seller and not you, the buyers. In our local market, an

agent can act as a dual agent – representing both the buyer and seller – but don’t you want an agent representing only your interests? An agent who will advocate for the best terms for you and who will recommend the most experienced home inspectors and contractors who can assist you? Furthermore, the value, or Zestimate, that Zillow provides is not always, or even rarely accurate. Zillow attests to a margin of error of about 7%, but studies have shown that the Zestimate can be off by as much as 20%. Regardless, even a margin of error of 7% translates into a significant amount of money, no matter the price of the home. A buyers’ agent will know the neighborhood and the properties and can distinguish characteristics of comparable sales to assist buyers in determining the value of the home and help craft an offer that benefits you. Focusing on the granite and stainless steel appliances. Who doesn’t love a brand new house or a shiny remodel? Too often, buyers focus on small attributes of the home instead of the overall picture. When purchasing a home, buyers also need to answer the following questions: How long do I expect to live in this home? Does the size of the yard fit my lifestyle and needs? What schools will my children attend, or how good are the schools in this area? Do I like the neighborhood? How much are the annual maintenance costs? There is a wonderful view now from the back of the house, but can it be blocked in the future? Do I want to be the first owner in a new neighborhood? All of these questions need to be asked when purchasing a home. Buyers with three kids who play a lot of sports and spend significant time outdoors may regret purchasing the brand new home with a backyard that barely extends beyond the patio. Conversely, the buyers who like to travel and explore on the weekends may want to reconsider the home on the halfacre lot unless they plan on changing

The CARE FEEDING of YOUR HOME: Classy Kitchen Cabinet Fence Repair

A

s a handyman, I was asked from time to time to repair damaged fences and gates so I thought I’d share some of my observations from the past seventeen years. First of all, the majority of fences I was asked to repair are wood and of those, the vast majority of the damage was preventable. The most common failure occurs at the bottom of the fence boards, where they have rotted away, because someone let the landscaping stay in contact with them. Fire is the only thing more damaging to your home than water and, in this case, I’m going to include your wood fence as part of the home. When the fence was first built, the fence boards were probably an inch or two off the ground, but as bark chips and other landscaping got added, the space disappeared and now the bottoms of the boards are buried in damp mulch all year long. And, I know that you’ve been told that cedar holds up well – it does – against bugs. But it rots just like any other cellulose.

So, how do you correct the problem? The first thing to do is get into your garden and remove a bunch of the mulch that has built up at the bottom of the fence line and then examine it for damage. Assuming it’s not too extensive, just keep the fence line clear each year when you add landscaping materials and the wood will dry out. Once the wood is dry, the rot will not get any worse. If you find a few boards that need replacement, measure the length and width and note any special shape to the top of the boards. Then visit the lumber yard and come as close as you can to matching what is already there. You may have to trace the outline of an existing board onto the new material and cut it out, if the shape is customized. Remove the old boards and nail on the new ones and you’re good to go. I keep stainless steel fasteners loaded in one of my nail guns for this purpose, because anything other than that or aluminum will react with the acids in the board, causing a stain to bleed down from the nail. You might choose to use a special polymer coated screw, but all things considered, replacing a few boards

The next most frequent repair finds me replacing fence posts that have rotted off at the ground. Generally, these are fences where the post was cedar, rather than pressure treated wood. Cedar definitely resists rot longer than most other species, but pressure treated lumber lasts virtually forever. It used to take the better part of a day to replace a post, but with the invention of the Stur-D Fence Post Bracket, I re-use the old post and it only takes about half an hour. These are available at Parr Lumber yards and Pro-Build Stores. Finally, I end up replacing a few gates each year. These can be built from scratch and they definitely look more craftsmanlike, but I’ve been using the prefab steel frame method for the past three years. They hold up longer, they’re easier to adjust, and for most folks, they are every bit as acceptable as one built the old fashioned way. But you’ll get a huge bang for a few bucks by buying 10-packs of simple, contemporary hardware at big box stores for less than $20. Molding Miracles Crown molding adds a touch of class to the tops of tired cabinets for less than you’d expect. Three-inch, primed composite crown molding with a dentil design costs as little as $20 for 8 ft. Fancy Glass Change the glass insert in a cabinet door, and you change the look and feel of your kitchen. Types of glass inserts are limitless — contemporary, bubbles, raindrops on water, antique — and cost $7 to $9 per square foot.
