Within the industry we are seeing a number of exciting developments as intellectual property becomes increasingly vital to the success of the corporate world. When undertaking a new project, the first thing I do is listen to my client so that I can fully understand their needs. It is important to understand where a client is in terms of its growth, what their key drivers are, where the threats are, and what is most important to them. It’s also very important for me that I get to understand the level of knowledge on IP that the client possess, in order to identify key issues. This approach helps me to achieve my overall mission: to get the clients to their target, or as close as we can on the budget allocated. I like to understand what the client really wants, what is acceptable and unacceptable as outcomes, and then plan the strategy. Looking ahead there are a few very interesting cases coming towards the courts for me and my firm. I am always hopeful that suitable resolution will arrive for my clients, but I suspect there will be a few appearances this year, both in the courts and the trade mark offices. There are plans to add extra staff, but this is an incredibly difficult process. As with all specialist professional services, the right candidates have the ideal mix of temperament, ethos and intellectual interest so that they can serve clients well. Overall I am excited for what the future will bring.

Currently the IP service industry as a whole is thriving, due to a growing appreciation that the value of an IP portfolio is increasingly recognised both in terms of a company’s balance sheet and as an important commercial tool for dealings with third parties. Consequently competition within the IP service market has continued to increase over the past decade, although consumers recognise that, given the value of the IP to their businesses, cheap advice isn’t always reliable. Unfortunately for the consumer that realisation often comes only after experiencing sub-optimal, possibly ineffective service and indeed failing to achieve necessary IP protection. The cost of putting such things right, if they can be put right at all, often exceeds what the costs would have been if a more capable adviser had been instructed from the outset. EverEdge are an international firm with offices in London, Los Angeles, Raleigh (RTP), Auckland and Sydney and work with multinationals, smaller and medium sized companies and the investment community. Our unique engagement proposition is that most of the value of today’s corporations is driven by intangible assets. This includes obvious assets such as patents or copyrights but also encompasses less obvious intangibles such as business model, unique data sets and trade secrets. Since such assets do not easily conform to traditional valuation approaches (much of their impact is specific to industry and strategic context) they are often overlooked in corporate finance transactions or investment decisions where they are given cursory valuations or often none at all. This is a mistake since the intangible assets of a company support its earnings quality, credit strength and provide the basis for strategic pivoting into new products or markets. In the context of mergers and acquisitions, private equity investing or initial public offerings our team works with management and advisors to identify the value contribution of intangibles. This can lead to better loan to value ratio’s in financing, greater operational leverage for private equity owners and bridging of pricing gaps between buyers and sellers. Goodwill is in essence the distillation of intangible value. A contextual knowledge of the intangible assets of a company provides investors with a road map of the development or growth path ahead of time. Patent filings in particular are hidden signals for where the competition is going and what strategic risks lie ahead. This is particularly important for research and development driven companies or innovators who are pioneering new applications of older (protected) technologies. In thinking about intangible assets as strategic business tools rather than legal or “soft” assets EverEdge differentiates itself from many other specialist consulting firms. Our success is measured not by hours billed or reports written but by the acknowledgement from our clients that we have improved their businesses. This reflects itself both subjectively and objectively, the latter through enhanced stock price, higher sales value, greater revenue or profits or increased market share.
