County Executive C. Scott Vanderhoef proposal of additional taxes to Rockland County’s roster in an effort to battle the county’s $80 million dollar deficit- a tax on hotels and cell phones, were approved ten to four, and eleven to four respectively in the Rockland County legislature. There will now be a thirty cent increase in the cost of having a cell-phone per month, and staying at a local hotel will also cost more. Although hotel owners are less than pleased with the new tax, Legislator Aron Wieder said he viewed these new taxes as a way to battle the fiscal crisis of the county. Legislator Phil Soskin said that the county needs the money. The legislators who voted

against the new taxes said they did so because they didn’t have enough information on how the taxes fit into the new budget plans, and the county’s new tax cap. Meanwhile, with school districts preparing to vote on different issues pertaining to their budgets for 201213, the time has come to explain what exactly the 'tax cap' is. There seems to be some misunderstandings pertaining to the cap. The public's knowledge is unclear as to what the cap is, what it means to them as tax-payers, and what the effects of the cap will be. Ossining, a Westchester town consisting of mostly workingand-middle class families was mapped out to be redistricted out of Westchester across the Hudson and into Rockland County. The potential move looks odd to many considering the fact that the town is east of the river, and many Rockland residents have never even heard of the town. Ossining, which is home to Sing Sing jail, would become an outpost of a redrawn, Rockland-centric 38thstate senate district, under draft maps made public this week. In the newly envisioned district, Ossining and its 37,674 residents would replace Haverstraw, which had 36,634 in the 2010 census. Haverstraw and

another Rockland town, Stony Point, would become part of a reconfigured, largely 39th District, which lies largely in Orange County. Under the draft maps, some of Rockland’s towns would not be part of the 38th for the first time in two decades. Sen. David Carlucci, D-Clarkstown, who currently serves the district, told the Advocate, “No matter what the final proposed senate redistricting lines will look like, I will remain committed to working tirelessly for my constituents and the people of Rockland and Orange Counties.” The new maps are published by the legislative task force that drew the new district boundarcont. A bill was passed, sponsored by Senator John Bonacic, that increases the penalties for passing a stopped school bus. The legislation would impose a sixty day suspension of a driver’s license if con-

THE ADVOCATE February 23, AS WE GO TO PRESS OLD TAPPAN ZEE BRIDGE MAY BECOME WALKWAY Tarrytown, NY - Gov. Andrew Cuomo says the state is considering turning the Tappan Zee Bridge into a “greenway” instead of demolishing it when a new adjacent span is built to cross the Hudson River. Cuomo says Wednesday his administration is discussing whether to turn the current 57-year-old bridge into a walkway similar to the one spanning the Hudson 45 miles upriver at Poughkeepsie. Officials have said a new bridge carrying the Thruway between Rockland and Westchester counties would cost $5.2 billion, with rail lines and bus lanes costing billions more if added to the project. The governor says turning the current Tappan Zee into a crossing for pedestrians and bicyclists would offer outstanding views and recreational opportunities for visitors. The walkway idea has been raised by town of Greenburgh Supervisor Paul Feiner. “In these difficult economic times, it is more important than ever to make New York a hospitable environment so nonprofits can continue to carry out their vital work,” Schneiderman said. “At the same time, we must maintain the public’s trust by ensuring that nonprofits are governed effectively, and with meaningful oversight.”

The new plan for the Tappan Zee Bridge that connects Rockland to Westchester has been disMendel Hoffman cussed for over 10 years. Many questions regarding this bridge, (and probably many tax payers dollars as well) have come and gone, they still have questions. Will it have a train? What towns will it run through? What to do with the old bridge: Make it a pedestrian walk- way? Well the answer is clear, the plan for the new Tappan Zee Bridge should be re-named the Rockland Bridge connecting Haverstraw to Ossining. There is a six person advisory commission on redistricting in New York, known as the Legislative Task Force on Demographic Research and Reapportionment that spends almost one million dollars on mapping out how the districts in each county will look in New York State. Every ten years they go back to the drawing board. This year they have come up ROCKLAND ROCKLAND with a new plan, and it sounds like a joke. They have proposed that the Town of Ossining, in Westchester be pulled into Rockland County. Of course there is a river in between, but maybe there is a solution to both problems with the Rockland Bridge.

The Advocate has been around as long as I can remember, and it just keeps getting better and better. I also appreciate the fact that you have taken an objective look at politics unlike some other newspapers who seem to endorse one plan or another. Mrs. R, Monsey, NY Dear Editor, After reading about Councilman Friedman’s new initiative, I want to just say: good for him. It’s about time someone in this community took a stand for the environment. There is so much daily waste, so much excess. All you have to do is look around- it’s all over. Let’s hope Daniel Friedman’s leading our town to a cleaner, greener time. So the question now is, will the grass start looking green, I mean, who is going to

pick up the trash littered through out the town? Hybrid cars are one thing, but actual dirt and carbon emissions are two separate issues. Pollution starts when someone forgets about their property, the property of others and it slowly deteriorates till we have polluted waters. Have you seen some of the brooks and streams in Ramapo? They are really a disgrace. Please, I am urging the town council to ‘green-ify’ our land. Guided by population data, and likely a welter of political considerations, the bipartisan task force—its members selected by the Legislature’s divided leadership—has defined a new state political map in time for November’s elections. Those maps now go to the Assembly and State Senate for a vote. After that, they would go to the governor for a signature or veto, which has been threatened in the event of what some times seems like gerrymandering. Ossining Supervisor Susanne

Donnelly told the Advocate that she is not happy about the redistricting plans and has written a letter to Governor Cuomo addressing her concerns. Gov. Cuomo unveiled his own bill for redistricting reform on February 17, 2011. The plan, known as the Redistricting Reform Act of 2011, would establish a permanent Independent Redistricting Commission to redraw boundaries for congressional and state legislative districts. It was introduced into the Assembly by Speaker Sheldon Silver as A5388 and is known as S3419 in the Senate. Governor Cuomo stated, "Redistricting in New York is a system that has prioritized incumbency and partisan interests over democratic representation. This pro-

cess needs to be about the people and not the politics. To help restore faith in our State government, we need to reform the system. This bill ensures greater independence, transparency, and a commitment to fair representation and equality." By mid-May, though, press were calling him out for falling inexplicably silent on backing his own bill, suggesting his make better use of his appearances through the state to urge voters to pressure their legislative representatives on the matter. In July 2011, the Senate and Assembly majorities hired law firms to serve as legal counsel during the redistricting process. The GOPcontrolled Senate hired Jones Day with a $3 million contract that runs through March 31, 2014. The Democratic-controlled Assembly hired Graubard Miller and lawyer C. Daniel Chill with a $1.55 million that runs through December 31, 2014. With New York slated to lose two seats in 2012, the question is who will be most likely to lose their seats. Many believe that this will be done by consolidating two adjoining Republican districts into one and doing the same with two Democratic districts. On March 15, 2011, the state Senate passed SB 3331, which made the first step toward a Constitutional amendment creating an independent, non-partisan apportionment commission. A Constitutional change requires the approval of two consecutively elected legislatures and thus would take years to implement. If approved it would not be in effect until redistricting following the 2020 census.

Cuomo’s top priorities. It was enacted by the state Legislature last June. Cuomo did a symbolic bill-signing in Pleasantville because of Westchester’s highest-in-the-nation property taxes. Governor Cuomo's whole idea was that the cap would offer tax relief. But taxes will still rise under the cap, yet by a percentage point or two less than they did before. The cap pertains to each individual municipality and school district’s tax levy. If a school district’s assessed value goes down, often as a result of a tax assessment, the tax rate will drive up the homeowners’ tax bills to make up for the difference. For the past few years, local school districts have kept their tax-levy increases below two percent because of taxpayer concerns. But tax bills have continued to rise. The cap limits tax-levy increases to two percent or the rate of inflation, whichever is less. According to the state Education Department, the cap will be two percent

for 2012-13.A few expenses are exceptions from the cap, including any increases in pension costs that go beyond the two percent, and any voter approved capital costs. The districts should also understand that due to rising costs and falling revenues, it will be much more difficult to come up with a budget that stays under the cap. The districts should also know that staff and program cuts in the future are, unfortunately, likely to occur, because any fixed costs will bump against the tax-levy cap. Not many districts are expected to try to exceed the cap. May 15th, budgets that stay under the cap will need a simple-majority public vote. But any budget that goes beyond the cap will need a “super majority” vote. In the past, a simple majority –– 50 percent of the vote plus one –– passed a budget. In order to get past the two percent cap, a district now must pass a budget with a supermajority –– 60 percent of the voters.

"Unfortunately, there are individuals who are careless, putting their priorities above the safety of children, making this legislation necessary. This amendment to current law is designed to further reflect the severity and danger in passing a stopped school bus. It's an obvious and necessary precaution we need to take." This legislation would make the penalties for passing a stopped school bus multiple times the same as penalties for drivers convicted of speeding in a construction zone two or more times. The Senate also passed a bill, sponsored by Senator James Seward, that would give school districts the option to put their website on their school buses. Currently, school districts are only permitted to affix their phone numbers on the rear of the school bus, but with advancements in technology and communication, some school districts have created websites which have become an increasingly important tool for communication. “School districts are increasingly using the internet to communicate important infor-

mation to students, parents and district residents,” said Senator Seward. “Allowing schools to print their website addresses on buses is part of the natural evolution of providing that information and will help open the communication lines between school districts and community members.” “Reflective technology provides the same safety benefits as an electrically lit ‘school bus’ sign at a lower cost. At a time when every dollar counts, school districts should be able to utilize this technology to reduce their costs. This legislation would allow them to do that, and I am pleased that it has been passed by the Senate,” said Senator Fuschillo, Chairman of the Senate’s Transportation Committee. The current required illuminated signs are more expensive, both initially and to maintain. New York is one of only two states – the other being Maine – that require this feature. Additionally, these lights accumulate snow and ice and are often times found to be the source of water leaks and leading to structural corrosion. Both of these negative externalities can now be avoided with the use of reflectorized coatings and graphics.

Legally Speaking Ryan Scott Karben, Esq. This week, we'll take a break from a discussion from the intricacies of the Zoning Law to discuss the assessment of real property taxes. The taxable status date for real property in the Town of Ramapo is March 1st. That means that a property is assessed based on its condition as of March 1st. For example, a house that is 50% completed as of March 1st of a given year will be assessed at 50% of its construction value even though the house will completed during the coming tax year. For tax exempt properties, they must comply with all of the requirements for real property tax exemption as of March1st of a given year. While this might sound arbitrary at first, the law understands that there needs to be a fixed date for assessable status. This date needs to apply to all properties so that an equitable assessment role can be established. The deadline for applying for a real property tax exemption for a property owned by a non-profit is March 1st. This is paperwork intensive process, so churches, synagogues, schools and other non-profits should make sure they have plenty of time to prepare the application. Properties that change in status (for example change from a single-family home to a multi-family condominium) are also assessed as of their status on March 1st of a given year. Based on any changes (or the absence of changes), the Assessor will assign each property in the town a tentative assessment. (Some village, such as Spring Valley, have their own assessor and their own deadlines. A property can legaly be assessed at difference values by the different municipal jurisdictions in which it is located. The trend has been toward consolidation of assessment functions. The Village of Pomona, for example, turned the assessment of property in is border over the the Towns of Ramapo and Haverstraw, respectively, a few years ago).

If you disagree with the tentative town assessment, or believe you were entitled to either a full or partial exemption, your period to challenge that assessment runs roughly through the end of May. The relevant municipality will publish a notice of times that the assessment role can be inspected and the time period to file a challenge to your assessment. Attorneys and property tax challenge services can assist you with this process, though some individuals choose to gather the data and file the paperwork on their own. After you file a tax challenge, also known as a grievance, the Assessor and the Board of Assessment review will review your evidence and ether uphold, reverse or modify the determination of the Assessor. If you are still unsatisfied with the outcome, you retain the option to take the municipality to court through either a SCAR petition (Small Claims Assessment Review, for homeowners) or a full property tax challenge for commercial and non-profit exemption cases. Assessments vary widely based on improvements to real property and the year in which the property was assessed. Despite a court order going back more than a decade, Rockland County has failed to implement a countywide reassessment of properties, leading to multiple complications in comparing the appropriate value for taxation of properties in multiple municipalities and even in the same jurisdiction. This lack of reassessment generally benefits older, unimproved homes, some of which have not had their assessment updated for decades.

FINANCES Greek Debt Crisis Drives Heavy Losses For Europe's Banks Greece's debt problems drove a slew of heavy losses across the European banking sector on Thursday, and bosses warned the euro zone crisis would continue to threaten earnings. From France to Germany, Britain to Belgium, some of the region's biggest banks lined up to reveal billions of euros lost through writedowns on Greek loans. "We are in the worst economic crisis since 1929," Credit Agricole chief executive Jean-Paul Chifflet said. Credit Agricole reported a record quarterly net loss of 3.07 billion euros ($4.06 billion), performing worse than expected from the cost of shrinking its balance sheet and after a 220 million euro charge on its Greek debt. "We think 2012 is going to still be a tense period," Chifflet said, adding: "We're hoping that our results

will be largely better than in 2011." Europe's banks have already written down billions of euros from losses on Greek government bonds and loans, and a deal agreed this week with its creditors will inflict losses of 74 percent on bondholders. "We can't say that the writedowns are over," said Franklin Pichard, director at Barclays France. "Even if some can say that the worst is over, we are only at a new stage in terms of provisioning and not necessarily at the end." That is because, despite the bond swap deal, bondholders could suffer further hits if Greece's economy fails to recover. Britain's Royal Bank of Scotland has marked its Greek bonds at a 79 percent loss -- or 1.1 billion pounds -- for 2011. The state-owned bank posted a fourth quarter loss of nearly 2 billion pounds on Thursday.

ISRAELI FOREIGN MINISTER VISITED RIBNITZER’S REBBE KEVER

BARACK OBAMA TO MEET WITH PRIME MINISTER BINYAMIN NETANYAHU

Monsey, NY - A visit to the United States last Wednesday by Israel’s foreign minister, Avigdor Lieberman, included not just a forty five minute meeting with Secretary of State Hillary Clinton in Washington and a briefing with the United Nations Security Council, but also a twelve minute stop at the grave of the Ribnitzer Rebbe in Monsey, NY.

US President Barack Obama will meet with Prime Minister Binyamin Netanyahu on March 5, the White House said on Monday. Netanyahu will be in Washington to address the annual policy conference of the pro-Israel lobby AIPAC, which will be held on March 4-6. The announcement of the White House meeting came in a briefing of a weekend visit between Netanyahu and Obama’s National Security Advisor, Tom Donilon, in Jerusalem, amid heightened concern that Israel might attack Iran to thwart its nuclear program. “Mr Donilon and his delegation addressed the full range of security issues of mutual concern,” the White House said. “The visit is part of the continuous and intensive dialogue between the United States and Israel and reflects our unshakable commitment to Israel’s security.” Donilon’s talks were to have included Iran and Syria, the White House said before he left on the trip. The West accuses Tehran of using its nuclear program to pursue weapons capability, while Iran insists it is for peaceful purposes. The March 5 meeting between Netanyahu and Obama will mark the first face-to-face-conversation between the leaders since they met on the sidelines of the UN General Assembly in September. At a joint press conference on that occasion, Netanyahu thanked Obama for voicing his opposition to the Palestinian bid for recognition of a state at the United Nations.

According to reports on Haaretz , this is not Lieberman’s first visit to the kever of the Ribnitzer Rebbe, quoting an advisor who said that Lieberman’s family, which lived in the same Romanian town as the Ribnitzer Rebbe, was close with the Rebbe and that Lieberman received a bracha from the Ribnitzer at his Bar Mitzvah. The Ribnitzer Rebbe, Reb Chaim Zanvil Abramowitz zt’l, was considered by many to be a miracle worker in his lifetime, and reportedly even members of the KGB would bring their children to receive his blessings. Lieberman’s twelve minute visit to the site Wednesday night was coordinated with local police who sealed off the site in anticipation of his arrival. While security was tight for this visit and Lieberman was accompanied by a group of security guards, most locals were completely unaware that a high ranking Israeli politician was in the area.

One factor in the upswing is better detection by doctors, but at least one doctor thinks a common over-the-counter drug also has something to do with it. All the studies he looked at showed a link between asthma and acetaminophen. The more acetaminophen somebody takes, the more likely it is that they have asthma. Also,

there's an incredible consistency. Everybody around the world who's looked for this association has been able to find it. In asthma, the airways of the lungs get blocked by mucous. that leads to wheezing and shortness of breath. The rise in asthma has closely paralleled the increased use of acetaminophen. There are no scientific studies proving the medication causes asthma, but experts say it may make asthma worse in kids who already have it.

Amongst others, diversity can appear in the form of different student backgrounds, different family values, or different learning abilities. We would like to address that of different learning abilities. No classroom can be perfectly homogeneous in terms of learning ability. Every classroom is comprised of students with some degrees of difference between them, be they quite pronounced or relatively subtle. Although most within the same classroom will be average, some students may be quicker learners or deeper learners than their average classmates. Quicker learners are often referred to as “high achievers”, while deeper learners are “gifted.” The first group is highly motivated to learn; they take the ball and run with it. They get excited about what they are learning and look for opportunities and resources with which to learn more. These kids study hard and care about the results of their efforts. High achievers aim high and aim to reach that height. They are a dream to have in class. Children who are gifted are fascinating. They are exceptionally smart. They analyze things and see depth where others don’t. They grasp concepts easily and know how to expand a topic. They often read between lines and gather hidden meanings. They go well beyond the popular myth that they learn more independently and need less instruction from teachers. These learners have high-level needs. Contrary to popular belief, they require at least as much educational nourishment as average or below average students do. So, which one is better: brighter or faster? Of course, this is an inappropriate question. There is no better; there is only different. High achievers are easier to teach because of their high motivation, but both are a pleasure to teach. ers in the class is not the same thing as assisting classmates with their learning. The research-presentation idea combines learning for oneself and contributing to the learning of others. We don’t support the earlier mentioned resentment argument. Children should learn to help each other. It is not healthy or proper for children to selfishly learn for themselves only. A learning environment that fosters learning and teaching by all is best for all parties. Rather than excuse gifted kids from helping their classmates altogether, we support the idea of their teaching others things that they have learned which may qualify as enrichment material. So far we have discussed high achievers and those who are gifted. What should we do for a child who is both a high achiever and gifted. Now, that would be dynamite! Is it possible to satiate a high-gear genius? Is it possible to do so within a regular classroom? Again, we believe that these children are entitled to receive an education that caters to their strengths and satisfies their needs. There is no reason why gifted high achievers cannot pursue the research-and-teach model that we described above, while receiving direct instruction sessions. These kids are loaded, and teachers and fellow students can gain much from learning with them. That has been our experience as we have learned with these children and also guided teachers who have hosted them in their class. Children come in all sizes and flavors. The challenge and thrill of teaching is being able to accommodate all of these varieties from top to bottom. The more integrated they are, the better, as long as each receives what he deserves. Encouraging children to interact with each other, despite their differences is healthful for society in general, and classrooms and families specifically. Guiding children about how to get and give the most they can within a given environment is an important part of “helping children to help themselves.”

who never stop learning from their students, gifted students have plenty to teach teachers. How can we accommodate gifted students? It is inadequate to settle for the popular idea of deputizing gifted students to teach the less endowed students in the class. As a matter of fact, many children who are gifted resent being assigned to that task. They would like to receive their tuition’s worth of education, not a teacher’s college degree. This is a common mistake that schools make. Therefore, if you are going to host a child who is gifted in your class, you need to give him plenty of opportunities to stretch his legs and learn at his level. Some schools provide pullout sessions with learning specialists who are versed in gifted education. Others satisfy the child who is gifted within the regular classroom. Obviously lessons tailored to satisfy the needs of the child who is gifted will be needed. As differentiated instruction dictates, teachers need to group students for direct instruction within the class. While one or more groups are independently reviewing or working on assignments geared for their level, the teacher is directly teaching another group. One of those groups is comprised of children who are gifted. Every group gets direct instruction time at least every day or two. What may be hard to swallow is that your group of children in your class who are gifted may be a group of one, but so be it; she is still entitled to learn at her level. In addition to formal direct instruction sessions with the group of children who are gifted, one may satisfy their thirst by empowering them to research topics at their level that they can then present to others in the class. For the gifted child, this would be on-level learning, while it would provide enrichment for others.

STOMACH FLU OUTBREAK CONT. FROM FRONT PAGE Nurses at Monsey Family Medical Center are spreading the message that hand washing is the best defense. The stomach flu tends to appear with small outbreaks, lasting 2-5 days. Symptoms include nausea, fever, stomach cramps, diarrhea, and vomiting. Without rest, your immunity weakens. Since antibiotics wouldn't work in treating a gastroenteritis virus, plenty of fluids and sleep are crucial for self-recovery. While stomach bug cases increase, there is better news on the influenza front. Local doctors have seen very few cases of true influenza this year. So far, the vaccine mix seems to be effectively fighting the flu strains that were anticipated this year. Doctor Landau also said the mild winter may have prevented influenza cases as people aren't spending so much time in closed quarters this season. The flu is more likely to spread when people stay inside in close contact. Nationwide, the Centers for Disease Control is calling this the latest start to the influenza season in 25 years. There is no medicine that will kill stomach flu viruses (antibiotics are not effective against viral infections). Therefore, stomach flu treatment goals are focused on providing supportive care while the body fights the stomach flu. Supportive care involves treating symptoms, such as dehydration, that can occur as a result of the stomach flu. Fortunately, for people with healthy immune systems, the body is able to effectively kill stomach flu viruses, and after 1 to 10 days (depending on the virus), stomach flu symptoms generally improve. Your body needs fluids to function. Dehydration is the loss of fluids from the body, Children with stomach flu present special concerns. Because of their smaller body size, infants and children are at greater risk of dehydration from diarrhea and vomiting. Parents of children with severe diarrhea should take their child for medical evaluation. Severe cases may require a visit to the emergency room or hospitalization. Stomach flu treatment may involve replacing body fluids directly using an intravenous (IV) line. For this reason it is very important to speak to your physician at the first sing of flu like symptoms in children.

LIVING WITH CHRONIC PAIN HOW IT AFFECTS EMOTIONAL HEALTH

Living with chronic pain should be enough of a burden for anybody. But pile on depression -- one of the most common problems faced by people with chronic pain -- and that burden gets even heavier. Depression can magnify pain, and make it harder to cope. The good news is that chronic pain and depression aren't inseparable. Effective treatments can relieve depression and make chronic pain more tolerable. If you have chronic pain and depression, you've got plenty of company. That’s because chronic pain and depression are common problems that often overlap. Depression is one of the most common psychological issues facing people who suffer from chronic pain, and it often complicates the patient's conditions and treatment. Consider these statistics: • According to the American Pain Foundation, about 32 million people in the U.S. report pain lasting longer than one year. • From one-quarter to more than half of patients who complain of pain to their physicians are depressed. • On average, 65% of depressed people also complain of pain. • People whose pain limits their independence are especially likely to get depressed. Because depression in patients with chronic pain frequently goes undiagnosed, it often goes untreated. Pain symptoms and complaints take center stage on most doctors' visits. The result is depression, along with sleep disturbances, loss of appetite, lack of energy, and decreased physical activity which may make pain much worse. "You almost have to assume a person with chronic pain is depressed and begin there." CHRONIC PAIN AND DEPRESSION: A VICIOUS CYCLE Pain provokes an emotional response in everyone. Anxiety, irritability, and agitation -- all these are normal feelings when we're hurting. Normally, as pain subsides, so does the stressful response. But what if the pain doesn't go away? Over time, the constantly activated stress response can cause multiple problems associated with depression. Those problems can include: • chronic anxiety • confused thinking • fatigue

• irritability Some of the overlap between depression and chronic pain can be explained by biology. Depression and chronic pain share some of the same neurotransmitters -- the chemical messengers traveling between nerves. They also share some of the same nerve pathways. The impact of chronic pain on a person's life overall also contributes to depression. Once depression sets in, it magnifies the pain that is already there. Depression adds to chronic pain by reducing the ability to cope. Research has compared people with chronic pain and depression to those who only suffer chronic pain. Those with chronic pain and depression: • • •

report more intense pain feel less control of their lives use more unhealthy coping strategies

Because chronic pain and depression are so intertwined, depression and chronic pain are often treated together. In fact, some treatments can improve both chronic pain and depression. Chronic pain and depression can affect a person's entire life. Consequently, an ideal treatment approach addresses all the areas of one's life affected by chronic pain and depression. Because of the connection between chronic pain and depression, it makes sense that their treatments overlap. The fact that chronic pain and depression involve the same nerves and neurotransmitters means that antidepressants can be used to improve both chronic pain and depression. Many people with chronic pain avoid exercise. "They can't differentiate chronic pain from the 'good hurt' of exercise," says Dr. Geraldo. But, the less you do, the more out of shape you become. That means you have a higher risk of injury and worsened pain. The key is to break this cycle. Everyone with chronic pain can and should do some kind of exercise. CONGRESSMAN ELIOT ENGEL STOP DISTRACTED DRIVING

Congressman Eliot Engel (D-NY17) praised the U.S. Department of Transportation’s efforts in curbing distracted driving. The DOT announced the first-ever federal guidelines to encourage automobile makers to “limit the distraction risk for in-vehicle electronic devices.” Rep. Engel has his own legislation designed to prevent the dangerous, and growing, epidemic of distracted driving. Rep. Engel said that “Secretary Ray LaHood has called distracted driving a deadly epidemic and I agree. The guidelines regarding factory installed devices are a great first step from the Administration in taking on such an important safety issue.” The DOT distraction guidelines include recommendations to: · Reduce complexity and task length required by the device; · Limit device operation to one hand only (leaving the other hand to remain on the steering wheel to control the vehicle); · Limit unnecessary visual information in the driver’s field of view;

I urge my colleagues to support it.” Rep. Engel’s bill would also create a national advertising campaign, administered by the NHTSA, to educate the public on the dangers of distracted driving. FEDS PROPOSE BAN ON CAR DIALING, TEXTING

The Department of Transportation has proposed guidelines that would block all in-vehicle communications by a driver, including texting, dialing, Internet browsing, and even entering a GPS address by hand. So far, the proposed guidelines would only affect in-vehicle communication systems. But DOT also held open the possibility that future restrictions would clamp down on smartphones and tablets, and even crack down on voice-activated controls.

The regulations, if imposed and enforced, could dramatically alter the future of connected vehicles within the United States, as well as how U.S. drivers use devices like GPS navigation systems and cell phones. The department's National Highway Traffic Safety Administration (NHTSA) would establish specific criteria for electronic devices installed in vehicles at the time they are manufactured that require visual or manual operation by drivers. In other words, those devices could have controls built in that could prevent them from functioning while the vehicle is in motion, or allow them to operate in a less-distracting state." The recommendations have been published in the Federal Register, and the public has 60 days to comment. Public hearings will be held in Los Angeles, Chicago, and Washington, D.C. in March. The DOT report comes two months after the NHTSA called for a nation-

wide ban on the use of personal electronic devices while driving—including talking on the phone, as well as sending and reading text messages. The NHTSA, however, has no authority to regulate, fund, or be directly involved in the operation of any mode of transportation. A lawmaker, however, could conceivably use the agency's recommendations in crafting legislation. The goal of the regulations is to cut down or eliminate distracted driving, which contributed to 16 percent of all fatal crashes in 2009 and 20 percent of injury crashes, according to the NHTSA. The percentage of drivers who were text messaging or visibly manipulating handheld devices while driving increased significantly from 0.6 percent in 2009 to 0.9 percent in 2010, according to the National Occupant Protection Use Survey, which was also conducted by the NHTSA. A report released Thursday by the Governors Highway Safety Association found that the number of 16- and 17-year-old driver deaths in passenger vehicles increased slightly for the first six months of 2011. Troy Costales, the GHSA chairman, said in a statement that he favored "absolutely prohibiting any type of cell phone or electronics device use while driving." "Distracted driving is a dangerous and deadly habit on America's roadways – that's why I've made it a priority to encourage people to stay focused behind the wheel," said DOT Secreatary Ray LaHood, in a statement. "These guidelines are a major step forward in identifying real solutions to tackle the issue of distracted driving for drivers of all ages."

Siyum HaShas Committee Announces Groundbreaking Masmidei HaSiyum Program By Moshe Nerl As the Yom Tov of Purim approaches, myriad members of Klal Yisroel know that the Twelfth Siyum HaShas of Daf Yomi will I”YH take place on 13 Av / August 1, 2012, at MetLife Stadium in New Jersey. The Siyum promises to be the most significant celebration of Limud HaTorah in modern history – an opportunity to bring over 90,000 Yidden together in one venue, with tens of thousands more participating via live hookups worldwide, in an unprecedented display of Kiddush Shem Shomayim. Nearly everyone knows someone who plans to complete Shas in connection with the Siyum. And each Misayem has his own personal story of perseverance, sacrifice and determination, of early morning sedorim or late-night shiurim, of life-changing Limid HaTorah during the seven and a half year odyssey through Shas. Proud wives and children, fathers and mothers, friends and neighbors plan to join the Misaymim at the Siyum HaShas, in a marvelous display of achdus that is a serendipitous byproduct of this historic event. Fathers sitting with sons, grandparents sitting with grandsons – all will be inspired by the words of Gedolei Yisroel, Tefilah with thousands of Yidden from all walks of life, and the sheer enormity of the Siyum. Thousands of children will surely be inspired on August 1 to increase their own Limud HaTorah so that they, too, can one day join as participants in a Siyum HaShas. But what if “one day” were today? What if thousands of bachurim could metamorphose from spectators to participants at this Siyum HaShas? Now, they can. Our Precious Children: From Spectators to Participants With the encouragement of Gedolei Yisroel and the guidance of Rosh Yeshivos and Menahalim nationwide, the Siyum Executive Committee has launched the Masmidei HaSiyum initiative. This groundbreaking program is designed to provide bachurim of all ages with the opportunity to be misayem something – be it a perek mishnayos, several blatt Gemarah, a masechta, or more – in conjunction with the Siyum.

Registration is both easy and free, and is open to all boys from third grade and up. After completing the brief registration process, participants will receive a complete orientation packet by mail. The packet will explain the program and the learning tracks (Mishnayos and/or Gemarah). As they learn, boys will accumulate points that can be used for the program’s rewards component. All registrants will receive a commemorative gift and a chance to use their points to enter to win one of hundreds of fabulous prizes – including father-son trips to Eretz Yisroel with pre-arranged meetings with Gedolei Yisroel, sets of Shas and Mishnayos, bicycles, electronics and much, much more. Rosh yeshiva of Ner Yisrael Rav Yosef Tendler Z'TL By. A. Tendler Monsey boys graduating from the eighth grade have their choice of high schools to pick from. Some stay local. Some travel to different countries. Some dorm out of town. And some go to Baltimore, to Yeshivas Ner Yisrael. But it is not only young boys who are mourning the loss of Rav Yosef Tendler, Rosh Mechinas Ner Yisrael. It is all of Klal Yisrael who have lost a true tzaddik and leader. Rabbi Tendler was born on the Lower East Side of Manhatten. He went to the Rabbi Jacob Joseph School (RJJ), and then proceeded on to Yeshiva University. Hoping to enter the shiur of Rabbi Soloveitchik, he went to Lakewood for the summer, to prepare himself. After returning back home, he went back to Lakewood once more, for Simchas Torah, on the invitation of R' Ahron Kotler. He ended up staying for eleven years. In 1961 Rabbi Tendler accepted a teaching position in the new Mechina of Ner Yisrael. In 1964, he became the Menahel, and proceeded to leave life long impressions on the minds of his countless talmidim. They all recall his strength, his vigor, and his love for true life. That was the mantra he instilled in his students: don't waste your life. Live it to the ultimate. He truly cared about his talmidim, as if they were his own children. He felt

as if each one's success or failure was his own personal responsibilty. He didn't only accept "top" boys, from "top" families. He wasn't interested in taking the best boys. He wanted to make the best boys. He directed the mechina for almost fifty years. His petira on Tu BiShvat has left a great scar on Am Yisrael. He was one of R' Ahron Kotler's earliest talmidim, and he truly embodied his speacial ways. He leaves behind his wife of fifty-four years, Rebbetzin Esther Tendler, thirteen children, grandchildren, great- grandchildren, and all of his talmidim. May klal Yisrael be comforted this loss with all the mourners of Yerushalayim, and in Rav Tendler's merit, may we be zoche to rejoice in the coming of Moshiach, soon, in our days.

HOW TO WEATHERIZE A SLIDING DOOR As much as 30 percent of energy loss is associated with inadequate weatherization around windows and doors. A sliding glass door looks great and allows a lot of natural light to flow into a room, but it is also a major contribution of energy loss. Weatherizing a sliding glass door will reduce the amount of lost energy and save money every year on heating and cooling your home. Things You’ll Need: • Soapy water in a bucket • Scrub brush • Clear water • Damp rag • Scrub rags • Caulk gun • Alcohol • Exterior caulk • Self-adhesive stripping • Long nail • Scissors • Utility knife Step 1 Remove the door. Lift the door up off the track and angle it to allow it to move down out of the top track. Place it to the side. Step 2 Install self-adhesive tubular or felt weatherstripping on the edge of the door where the side of the door meets the wall when closed. Do not install felt or tubular weatherstripping on the tracks, since it will bunch up and the glue will be hard to remove. Start from the corner of the top of the vertical part of the sliding glass door frame, peel off the protective backing and press firmly into place. Trim at the opposite end so the edge is tight to the corner of the track. Cut weatherstripping in position for the best fit. Step 3 Clean the tracks thoroughly with hot soapy water and a scrub rag. Rinse with clear water and a clean rag and allow them to dry completely. Wipe with alcohol to remove all soap residue. Step 4

Install fin seal weatherstripping to the top and bottom tracks on the door. This weatherstripping has a brush-type pile on each side of a central fin used for the track area in sliding glass doors. Remove the protective backing from the fin seal weatherstripping and, starting from one edge, press firmly into place. Trim at the opposite end so the edge is tight to the corner of the track. Cut weatherstripping in position for the best fit. Step 5 Clean the frame around the exterior of the sliding glass door and around the door trim to remove all dust and loose soil before caulking. Do this with only a scrub brush and damp rag as soap residue may reduce the caulk’s ability to adhere to the surfaces. Step 6 Place the tube of caulk in the caulk gun. Cut the tip of the caulk tube on an angle with the utility knife. Push the pin attached to the caulk gun into the tip of the caulk gun to pierce the foil seal at the end of the tube of caulk. If your caulk gun does not have an attached pin, use a long nail to pierce the seal. Step 7 Place the tip of the tube of caulk against the corner of the trim where the exterior of the house meets the trim around the sliding glass door. Slowly depress the trigger on the caulk gun, allowing a bead of caulk to fill the corner where the wall and trim intersect. Continue on the top, bottom and sides. Repeat with a bead of caulk where the sliding glass door frame intersects with the trim on all four sides. Tips & Warnings • Try to complete weatherization projects on comfortable days so that heating or cooling does not escape through open windows and doors. • Never measure weatherstripping. It can stretch as you install it. Always start from one end, press, nail or screw into position and cut off the excess in position.
