I

n the 1960s and 1970s when Zihuatanejo first began to attract large amounts of foreign tourists, visitors would find themselves lodging in structures that were built with some combination of adobe, enjrejado (a wall’s skeleton is built with sticks and then filled in with mud and coconut shells, rocks, or other things), and/or huesito (the stem of a palm leaf), and sported Mexico’s authentic thatched palm palapa roofs. In these structures form followed function: they were open to the cooling breezes of the Pacific Coast unaided by fans or air conditioning, (as in many cases electricity was unavailable). And Ixtapa? There wasn’t much to it, Ixtapa was covered in trees

and visitors to El Palmar beach played with the deer that wandered there. Today the modest guesthouses of Playa La Ropa have been replaced by (or in a few cases updated to) multi-million dollar hotels, inns, and residences that, to a great extent, carry on the logic of using local building materials and native housing styles. These logical climate-informed designs have shifted into a decorative and architectural technique that has increasingly come to define Zihuatanejo Style. According to Nicole Dugal—a designer who first visited the area in 1972, and who since went on to create the design for La Casa Que

Canta hotel, among other notable creations— this was how modern Zihuatanejo Style began. Not as the brain child of any one architect or by commission from a wealthy family looking for a second home, but in response to a way of life. A way of life that had people sleeping alfresco in hammocks or on petates (woven palm mats) during the hot siestas and slightly cooler nights. In the late sixties and early seventies, when foreigners began to take root on La Ropa Beach, this is where they dwelled: in spaces built with function, tropical weather, and local materials in mind more than rent-ability, fashion, and attention to stylistic detail. Dugal characterizes this way of building as a logical response to the “needs we have when living in this kind of weather. Much cooler is the thatched roof than the slab of cement enclosed with glass windows that turn the inside into a steam bath which has to be cooled with tons of air conditioning.” The Zihuatanejo Style that is categorized by the look of the thatched roof and traditional way of building did not immediately take shape, however, as the bay was developed into a tourist destination. The first big projects were persuaded by “progress” to build with cement and glass, requiring a lot of air conditioning to keep the structures habitable. Hotel Sotavento, the first modern guesthouse built on La Ropa, was constructed in a rustic fashion, but with cement and a tile roof. The other hotels came later, building a “flashy cement construction,” as Dugal describes it. Throughout the 1970s and 1980s this type of modern construction prevailed and was defined by the use of cement walls, glass windows, and aluminum framing. Architects at this time were also taking to ignoring the area’s long-standing logic of orienting buildings according to what was known about the area and the weather (that storms come from the South, for example). In 1972, Gloria Guinness commissioned the Sonoran architect Marco Aldaco to build a

huge residence in Acapulco, which he designed to include a thatched palm roof. Dugal classifies this as the starting point for the return to constructing modern buildings in the traditional style of this region. The trend did not come to Zihuatanejo, however, until La Casa Que Canta was built in 1992—designed by Nicole Dugal, Enrique Zozoya, and Enrique Muller. This luxury hotel, “recouped the traditional way of living and the use of fine materials,” Dugal said, “… plus everything there is made by hand.” Zozoya and Muller went on to design other influential projects in the area, continuing with the use of the thatch roof look, if not the authentic roof itself. The taste for this style spread quickly, and soon buildings were being refurbished to match the trend. And now the style has spread outside the bay to Barra de Potosi, Saladitas, Troncones, and beyond. Thatched palapa roofs are now also being used solely as decorative adornment, but this is the

evolution of what was once a way of life. Dugal characterized this way of life in many ways. With rooms open to the outside, one can’t have bright lights or the bugs will be attracted. One must accept that when a home is open to elements, especially the humidity “all of your possessions will eventually be ruined”—though provided one has only what is needed to survive, as was also an aspect of this lifestyle, this isn’t actually a problem. Today however, the Zihuatanejo beach home builder is stylizing the architecture of this way of life without clients having to actually live the “way of life” that comes with it.

It is important to note that while the look of the thatched roof and authentic style has returned to popularity, it is not always accomplished by actually building in the traditional manner. The availability of amenities such as electricity, fans, and air conditioning have made it possible to combine luxury with the traditional look most easily identified by the thatched palm roof. Often there is a mix of the customary way of roofing a home and the more modern. At La Casa Que Canta hotel, though the building appears to be roofed completely in thatched palm, only the lobby is authentic thatch. The guest rooms are roofed in concrete but covered to give them the palapa look. Advancements in thatch roof technologies are also making them easier to rely on as they are being improved to be less likely to leak. Thus “true and authentic elements are being accommodated to modern life,” as Dugal put it. Dugal compares the stylization of authentic building traditions to similar trends in other industries. “I think something similar happened in fashion,” she says. “That which used to be the garment industry was suddenly revealed as the fashion world. The thatched huts became the fashionable beach residences,” and have come to define the architectural style here in Zihuatanejo. Certainly not all the homes built in the area have abided by the customary form-following -function principals — Zihuatanejo’s own Parthenon is a stark example of incongruity. It has, however, become the trend of the last decade and a half to build, or give the appearance of building, in this authentic way. This style has undoubtedly regained its popularity not because of a desire to return to the lifestyle originally associated with it, but a desire to imitate the authentic, traditional style of the region, as the city continues to grow.

Aimed at home decorators, developers, architects and the individual homeowner, Habitat Expo promises to promote innovative, creative, and high-quality home furnishings as well as design ideas. In an attempt to strengthen the industry in Mexico, the first three days of the expo are reserved for interior design professionals. Conferences and seminars scheduled for the 22nd and 23rd will be offered by international experts in the fields of Urban Design, Business and Design, Interior Design in Latin America, and others. Karacadir Center for Sustainable Development San Miguel de Allende, GTO

ocated outside of San Miguel de Allende, Guanajuato, Karacadir is a center dedicated to environmentally sound construction. Using “earth-bag construction,” Karacadir’s homes follow Santa Fe adobe architecture. The homes are built using recycled construction material, straw bale, cobb and stone as insulation and support, then the walls are covered with plaster and lime wash. A first glance at the center’s website may make Karacadir seem too “eco-hippy” for most, but a closer look at their completed projects shows an ecologically sensitive and elegant southwestern style home. Aside from contract building, the Center offers a Bioregional Building Program. The 7-day intensive course covers a variety of sustainable building methods such as grey-water management, passive solar energy, composting toilet systems, earth-bag construction and more. The course costs $500 USD for the week and includes materials, meals and camping space. A workshop on building bread ovens is also offered by the Center. radEx, Mexico’s largest producer of trade shows, will combine forces with the Mexican Association of Real Estate Professionals (AMPI) and the National Association of Realtors (NAR®) to present the fourth annual edition of Mercado Inmobiliario Turistico (MINT), (main event scheduled for June 19-20, but with activities on both the 18th and 21st.) MINT brings together Realtors® and exhibitors from the United States, Canada, Latin America and the Eastern Hemisphere for two days every summer. Last year 1,592 people registered for the event and an additional 355 attended. Almost 3,000 national and international visitors—including members of the international real-estate industry—and trade show exhibitors came from 22 Mexican states as well as Canada, France, Spain, the U.S.A., Costa Rica, Panama, Chile and Peru. Vistors include developers, legal firms, real estate agencies, architectural firms, and other real estate and tourism related industries, in addition to property seekers. In addition to the exhibits of the Trade Show, there will be an educational component to the event, with classes scheduled the 18th and

the 19th. Among those classes that are likely to be the most popular are, “Doing Business in Mexico,” and “Doing Business in the United States,” which have been designed to help agents who receive inquiries and who need to work on co-operative transactions, in Mexico and abroad, with international Realtors®. Apostille – The way in which a legal document from one country can be legalized or authenticated for acceptance and use in another country. It is a certification of authenticity that must accompany documents that have originated outside of Mexico for them to be accepted for use in Mexico. In cases where apostille documents are accepted in place of appearing in front of a Mexican notary to sign a document, the document to be signed must be signed and notarized in the signer’s state of residence, and then sent to the official government office to be “apostilled”/certified. This usually involves fees and time delays, but can often be preferable to returning to Mexico to simply appear before a notary to sign a document. See ADIP March 2005 for more information. Capital Gains Tax (Ley de Impuesto Sobre la Renta ISR) – When a property is sold, capital gains taxes are calculated based on gains as determined by the deed’s declared value, regardless of what you actually paid for it--if what you actually paid for it is different from what you declared on your deed….So, whatever value you declare when you buy a property will be the tax basis value used to calculate gains when you re-sell the property. See ADIP April 2004 and March 2008 for more information. Ejido, Ejidal, Ejiditario – In 1917, after the Mexican Revolution, hundreds-of-millions of acres from the original Spanish land grants were expropriated by the government and classified as ejidal or agriculture properties, accounting for almost 50% of all land in Mexico. The state retains ownership of these lands and the Ejiditarios, the farmers who live on them, have the collective right to use them. The rights of usage pass from father to son, but this land can never be sold as private property. In the early 1990s a decree was passed allowing Ejido land to be converted into private property, and thus available to be sold to third parties. The procedure is a multi-step and often lengthy process wherein all members of the group must be in agreement. See ADIP February 2005 and January 2008 for more information. party institution for security and peace of mind, is now available in Mexico. Articles 273 to 308 of the Mercantile Commission of Mexico provide the guidelines for Escrow in Mexico. Factura – Official receipt for goods or services that contains the buyer’s and seller’s RFC number and any IVA collected that is essential for tax deductions. Fideicomiso – A bank trust through which foreigners can acquire title to the beneficial rights in a real property. Per Article 27 of the Mexican constitution, any property located within the “restricted zone” (see below) acquired by a foreign person must be held in a Mexican bank trust (a fideicomiso). Essentially, the fideicomiso is a contract with a Mexican bank for it to hold title on behalf of the foreign person. Flat Tax Law –(IETU) New in 2008, a 16.5% business flat tax imposed on all tax residents performing services or entrepreneurial activities in Mexico that are considered to be permanent establishments, as well as on corporations and individuals residing in Mexico, which taxes income obtained from the transfer of goods, provision of independent services, and use or temporary enjoyment of goods (though there are several exemptions). It is paid in addition to the ISR, Impuesto Sobre La Renta. See ADIP March 2008 for more information. Foreign Investment Act – Mexican Law governing investment activities by foreigners in Mexico with the purpose of establishing rules to attract foreign investment to the country and promoting its contribution to national development. FM-T – A Tourist Visa, non-immigrant, which is good from 30 days to no more than six months and is granted upon entering. It does not allow for work or business activities.

Presta nombre – The idea of using someone else’s name to buy property, usually to circumvent the prohibition of a foreigner owning property in the federal zone by putting the title in the name of a Mexican national. Not only is this totally illegal and not recommended, but it basically constitutes buying property for someone else, as you will have no legal recourse or rights to the property if things go wrong later. See ADIP March 2004 for more information.

FM-3 – A visa granted to a non-immigrant visitor who wishes to work and stay longer than six months that must be applied for at a Mexican Consulate before arriving in Mexico or at an Immigration office once in Mexico. FM-2 – A visa for immigrants who wish to obtain the right to reside in Mexico permanently that is usually granted after having an FM-3 for a period of years. IVA (Impuesto al Valor Agregado) - Value Added Tax. Law on Cash Deposit Tax (Ley del Impuesto a los Depositos en Efectivo or LIDE) – A 2% tax on cash deposited into any type of bank account which exceeds 25,000 pesos (or its foreign currency equivalent). The bank withholds this 2% and forwards it to tax authorities. Exemptions are made in the case of authorized donations, financial institution loans, and others. See ADIP March 2008 for more information. Notario (Notary) – U.S.A. Notary Publics, in most states, are regular people who after a simple process have obtained a license to act as a witness to acknowledge that something has happened before them, (i.e. the signing of a contract) but they do not need to know or understand the legal scope or duties that the parties are acquiring through that contract. Conversely, the Mexican notary (Notario) is required to be an expert of the Law. They have the obligation to make sure all parties understand the legal act they are entering into and that the act is legal. Mexican notaries are held legally liable for their actions and are subject to harsh penalties if found to be acting incorrectly--their license can be revoked and they can even be legally prosecuted. The services of a Mexican Notary, and the costs

Private Contract between Buyer and Seller - A written and signed agreement between parties defining the purchase terms before official purchase proceedings begin. This is done keeping in mind that a foreigner does not buy property in the restricted zone, they buy beneficiary trust rights to property, so a private contract that states property is being sold can be null and void. See ADIP November 2006 for more information.
