In February, over 50 ABC members from across the state came to Lansing to take part in our 2017 Legislative Day. In addition to discussing legislative priorities for ABC of Michigan with fellow members, attendees had the opportunity to meet with their lawmakers, legislative staff, and policy experts. Senate Majority Leader Arlan Meekhof and Speaker of the House Tom Leonard also joined members for breakfast, highlighting the importance of skilled trades and the permanent repeal of Michigan’s prevailing wage law.

These reforms...are set to make their way through the legislature and should be a significant step towards providing greater opportunities for Michigan students.

Following Legislative Day, a group of Michigan legislators introduced a series of bills aimed at reforming the Michigan Merit Curriculum to provide more flexibility to Michigan students as they head down the path towards a career. These reforms, highlighted in this issue, are set to make their way through the legislature and should be a significant step towards providing greater opportunities for Michigan students. In addition to the policy reforms that are in pursuit, ABC of Michigan is deep into planning the 2017 Michigan Construction Leadership Summit. The inaugural summit in 2015 received rave reviews from attendees and 2017 looks to be even better. Be sure to take note of the “Save the Date” (see page 21) inside this issue and keep an eye out for when registration opens this spring! 2017 is gearing up to be one of our most successful years yet, and we look forward to working with you to ensure that free enterprise and the merit shop philosophy continue to have a strong voice across the state. MEMBERS FROM AROUND MICHIGAN ENJOY A MORNING IN LANSING February 16 was an exciting day in Lansing when over 50 members of The Associated Builders and Contractors of Michigan came from across the state to partake in the annual State Legislative Day. With more than 30 lawmakers in attendance, members had the opportunity to meet and discuss policies that affect their businesses. Newly-elected Vice Chair of ABC of Michigan’s Board of Directors, Corey Hannahs of Consolidated Electrical Contractors, kicked the morning! Inspiring and exciting guests for all the morning had to offer! ABC of Michigan State Director Jeff Wiggins provided a legislative update—particularly addressing public-private partnerships, proposed reforms to skilled trades education,

and the outlook on repealing Michigan’s Prevailing Wage Law. With the information presented in the legislative update, members engaged in conversation with their lawmakers on these issues while enjoying breakfast. After breakfast, ABC of Michigan was honored to present Senate Majority Leader Arlan Meekhof with ABC of Michigan’s 2017 Senate Lawmaker of the Year award. Majority Leader Meekhof has been a fighter for merit shop principles since he as first elected to the House of Representatives. He has always stood firm for the merit shop and, for the second legislative cycle in a row, has introduced bills in the Senate to repeal prevailing wage. With a defender of free enterprise like Majority Leader Meekhof at the helm of the Senate, we know that the issues important to ABC members will be at the forefront of the discussion for the next legislative term, and, finally resulting in the repeal of Michigan’s prevailing wage law. Also accepting ABC of Michigan’s 2017 House Lawmaker of the Year award was State Representative Gary Glenn. Glenn has been an avid supporter of ABC nationwide over the past two decades, working directly with Idaho’s chapter to get the state to pass Right to Work legislation, as well as playing a role in helping Michigan become a Right to Work state in 2012. He has a 100% voting record with ABC of Michigan and has sponsored legislation that promotes free enterprise and the merit shop philosophy.

Glenn also continues to be a vocal advocate for repealing Michigan’s archaic prevailing wage law. We were excited to have F. Vincent Vernuccio as our keynote speaker, addressing the climate of the labor force in Michigan and throughout the country. Vernuccio is the Director of Labor Policy at the Mackinac Center for Public Policy, an independent, nonprofit research and educational institute in Michigan. His impressive background combined with extensive knowledge about our industry provided an uplifting and fascinating speech on the current state and future policy prospects in labor policy. He dove right into national politics and the effects of the election of President Trump on America’s economy. Connecting national politics to Michigan, Vernuccio highlighted Michigan’s labor market, while also explaining how the politics of education have a significant effect on our labor force. Getting more involved in our school boards and getting government out of curriculum development were just a few of the specific areas that Vernuccio drove home. Following Vernuccio, ABC members got the chance to listen to the new Speaker of the House, Tom Leonard. Speaker Leonard captivated the audience with his energy and expertise. As a long time ally of ABC, Speaker Leonard was a crowd favorite as he elaborated on his priorities for the year and took questions from the attendees. He made quite clear that two of his top priorities for this legislative session were finding ways to support and promote skilled trades training and education and teacher pension reform. Bringing the morning to a close, attendees had the chance to hear a wide range of labor policy issues discussed by a panel of experts, moderated by the President and CEO of the Greater Michigan Chapter, Jimmy Greene. The panel included Charles Owens, Executive Director at the National Federation of Independent Businesses (NFIB), Kathy Hoekstra, Regulatory Policy Reporter

for Watchdog.org, Jarrett Skorup, Policy Advisor at the Mackinac Center for Public Policy, and former ABC of Michigan President and now Partner at Midwest Strategy Group, Chris Fisher. The questions posed by Greene elicited great discussions, including one that appeared to be a favorite for the panelists and the audience. When asked what they would you do if they could get any bill passed, the panelist’s responses varied slightly, however, education reform, including teacher pensions and curriculum for skilled trades, and the repeal of prevailing wage were clear favorites of the panel. The 2017 ABC of Michigan Legislative Day provided a great forum for policy discussion, as well as an opportunity to look at the future goals of our association. ABC MEMBERS FROM ACROSS MICHIGAN COMPETE IN

NATIONAL CRAFT CHAMPIONSHIP For the 30th year competitors from ABC chapters around the nation headed to the ABC National Craft Championships (NCC) competition. This year’s competition in Fort Lauderdale, Florida from March 1-3 was an exciting event. Competitors endure a two-hour written exam, which counts for 25% of their total score. The other 75% is a grueling six-hour practical performance practical test in the form of a project based on their craft. The NCC awards the first, second, and third place winners a medal and cash compensation in addition to any tools or gifts from NCC sponsors. The competition planned by ABC’s National Craft Championships committee, consisting of contractor representatives and ABC chapter and national staff. The championship provides an opportunity for craft trainees and apprentices to compete against one another for top honors in their craft. Competitors choose from 13 competitions representing 11 crafts.

The NCC also offers the relatively new team competition in which five craft journey-level professionals are put into a team to compete in craft-specific tasks focused on electrical, pipefitting, millwright, carpentry, and insulation over a six-hour period to simulate real life working conditions. Team competition is scored the same way the individual competitions are with the emphasis placed on teamwork, planning, and leadership. To ensure a relatively even playing field, all competitors are enrolled and sponsored by an ABC Chapter or ABC member firm within nine months of the competition and cannot be certified as a journeyman six months before the competition. Competitors cannot have more than six years worth of experience and cannot compete in the same craft competition they may have in previous years. Five representatives from one of Michigan’s three local chapters had the opportunity to compete this year.

“Our two competitors did not place however the competition is tough. To make it to National is an accomplishment in itself,” said Stephanie Davis, Vice President of GMCA. “Our students work very hard to learn their craft to the best of their ability. It is very rewarding to see that our instructors are doing a job worthy of national recognition.”

Swem competed in the Electrical: Industrial-Commercial Competition and took home the bronze medal. “To meet and compete among so many talented electricians and then win at the national level was a humbling experience,” Swem said.

ABC SOUTHEASTERN MICHIGAN CHAPTER Richard Doran of Shoreview Electric in Sterling Heights was sponsored by the ABC Southeastern Michigan Chapter. Doran competed in the Electrical: Residential-Commercial category. When asked what advice he had for anyone interested in a career in the trades he said, “If a traditional college program is not for you and you want to earn while you learn, then the trades may be a career path for you.”

“Feyen Zylstra is incredibly proud of Matt for his hard work and national accolades,” said Feyen Zylstra CEO Nate Koetje. “We take pride in how our inhouse apprentice program prepares individuals for leadership opportunities in the electrical industry.” Heetderks competed in the Electrical: Residential-Commercial category.

ACHIEVEMENTS OF 2016 ABC of Michigan had another productive year in 2016. In no particular order, here are the top 10 things we accomplished: The greatest feat of 2016 was the passing of HB 4813, ABCbacked legislation that eliminated the state’s costly and burdensome ratio of one journeyman electrician for every apprentice on a jobsite. The new legislation, Public Act 73, replaces the former ratio with a far more flexible and efficient ratio that allows up to three electrical apprentices per journeyman. ABC of Michigan hosted another successful Legislative Day in Lansing. More than 60 members joined over 30 lawmakers at the Radisson Hotel to hear from many prestigious speakers including; Lieutenant Governor Brian Calley, President of the Mackinac Center for Public Policy Joseph Lehman, and Congressman Mike Bishop. ABC of Michigan hired State Director, Jeff Wiggins in June. After the departure of Chris Fisher, ABC was excited to bring on board Wiggins, who brought with him years of expertise in the Michigan House of Representatives most recently having served as the lead advisor on the Energy and Regulatory Reform committees. Longtime ABC of Michigan President & CEO, Chris Fisher, left the association in June, but he did not go far. Fisher joined Midwest Strategy Group, a multi-client lobbyist in Lansing, as a partner and took ABC on as a client. He will continue to be one of ABC’s greatest allies and supporters. With Fisher’s departure, the ABC of Michigan Board established the “ABC of Michigan ‘Chris Fisher’ Chairman’s Award.” The award was presented to Fisher and will be awarded annually to individuals who are not lawmakers that make significant contributions to state policy that affects our members. In November, ABC of Michigan hosted a Strategic Planning Retreat at Soaring Eagle Casino in Mt. Pleasant. The retreat, facilitated by President of ABC of Iowa Greg Spenner, brought more than 40 ABC members and chapter staff together to develop a plan of goals and outcomes for the next three to five years.

In the fall of 2016, the team kicked off planning the 2017 Michigan Construction Leadership Summit, securing the Grand Hotel for October 3-7. Registration opens in 2017, but planning starts early to ensure programming and speakers meet the needs of attendees. ABC backed legislation and applauded the House of Representatives on the passage of two bills that protected the rights of Michigan job creators and those exercising their right to free speech. The bills eliminated language from statute that previously forced employers to notify applicants if a position they were applying for was made available due to labor strikes or lockouts. They also would strengthen current law that penalized illegal picketing activity that directly hinders or prevents a business’s activity while also protecting private residences and the families that live there from similar illegal activity. Both bills did not make it through the Senate before the end of session, but ABC will support reintroduction in 2017. The general election was a great sign of things to come in Michigan. SIX CORE LEADING INDICATORS OF WORLD-CLASS SAFETY ABC’s 2017 Safety Performance Report, “Understanding the Impact of STEP Participation on Overall Safety Performance,” released in March, is the first report of its kind. For the first time, a study takes a look at the correlation between the use of measures companies can take to keep workers safe on jobsites - leading indicators - and the number of incidents, accidents, and injuries that occur. We highly encourage reading the full report, but in this article, we highlight the six core leading indicators that have the most dramatic impact on safety performance. A leading indicator is a system or process used to identify hazards and eliminate or minimize the condition to prevent injury. 1. Substance Abuse Program. A written substance abuse program/policy with provisions for drug and alcohol testing where permitted. One-third of all incidents on construction jobsites are drug- or alcohol-related. Companies with substance abuse programs in place dramatically outperform those without an implemented program in terms of safety. Plus, substance abuse testing can be an effective method of incident prevention if used properly. 2. New Hire Safety Orientation. Length of time spent on safety awareness and education during training for new hires. Companies that conduct an in-depth indoctrination of new hires into the safety culture, systems and processes based on a documented orientation process experience 48 percent to 50 percent lower incident rates than companies that limit their orientations to basic safety and health compliance topics. 3. Site-Specific Safety Orientation. Companies that conduct site-specific orientations reduce their TRIR and DART rates by 45 percent and 37 percent, respectively. These sessions incorporate: • Site-specific policies and procedures • Site-specific hazards and operations • Company safety vision and core values • Emphasis on the importance of stop-work authority and peer observations

4. Toolbox Talks. Brief, single-topic training sessions of 15 to 30 minutes conducted on the jobsite for all employees. Can you brief employees on safety too much? No matter what you may have heard, there is no negative effect to conducting daily toolbox talks. The less frequently this type of training is conducted and the fewer safety topics covered, the higher the lagging indicators. Companies that conduct only monthly toolbox talks have a TRIR more than four times higher than those that hold them daily. 5. Near-Miss/Near-Hit Analysis. The quintessential leading MICHIGAN MERIT • ISSUE 1 2017

indicator, near-miss/near-hit analysis records observations of situations that could have potentially been catastrophic, but did not result in disrupted or lost lives. While there is no industry-wide recognized definition of a near miss, tracking and learning from such episodes shows much promise in improving safety, with TRIR and DART rates reduced by 41 percent and 39 percent respectively at companies that do so. 6. Site Safety Committee. Regular meetings coordinated by the general contractor or construction manager that include representatives from site employees, subcontractors, vendors/suppliers and the client. Companies that participated in site safety committee meetings had 46 percent to 47 percent fewer incidents. These information- and idea-sharing sessions: • Serve as a communications hub to enhance jobsite safety

SKILLED TRADES PACKAGE PROMOTES FLEXIBILITY FOR MICHIGAN STUDENTS At the beginning of March, a group of legislators in the Michigan House of Representatives introduced a package of bills that would modify existing high school curriculum requirements to accommodate the future needs of Michigan’s workforce better. The bills, House Bills 4315 – 4318, aim to provide students with educational options as they position themselves for the workforce, whether in skilled trade disciplines or degree holding jobs. House Bill 4315, introduced by Rep. Beth Griffin (R-Mattawan) addresses the need to revamp the education curriculum for the 21st century, providing students with a more dynamic and flexible education path than presently offered. The proposed bill will prepare Michigan students for the workforce by stipulating that high school students fulfill three credits worth of courses from a combination of language, visual/performing/applied arts, computer science of coding, and a Michigan Department of the Education-approved technical education program. This proposal is aimed at increasing student awareness of career paths outside of a college degree, providing a break away from the “cookie-cutter”

pathway of our current system. The second bill introduced by Rep. Curt Vanderwall (R-Ludington), HB 4316, will end the sunset on the Foreign Language Equivalent Credit, allowing students to continue substituting a foreign language credit with for-credit CTE training. By removing the sunset on the Foreign Language Equivalent Credit, consequently increasing the flexibility in merit curriculum, students will find themselves with increased exposure to additional career options. Another reform, HB 4317, introduced by Rep. Roger Hauck (R-Mt. Pleasant), will give Michigan students the option to pursue a MIOSHA 30-hour Safety Certification, in either general industry or construction training, as a substitute for their health education course. With the quality of work and jobsite safety being top priorities for ABC members, having the background of the 30-hour course makes young students much more attractive to future employers. Finally, HB 4318, introduced by Rep. Gary Howell (R-North

Branch), again, provides muchneeded flexibility to Michigan’s curriculum, with this reform coming in the subject of mathematics. The current curriculum requires four credits to be taken, with only one credit worth of classes being elected by the student. This bill allows students greater freedom of selection and the ability to decide between statistics and algebra II when taking their third level math course. This package has received strong bipartisan support in the House and is awaiting action in the Senate. ABC of Michigan will continue to monitor the progress of this legislation and will do everything we can to ensure that these common sense reforms become law. MM

ASSOCIATED BUILDERS AND CONTRACTORS PRAISES PRESIDENT TRUMP FOR ELIMINATING ILLEGAL OBAMA BLACKLISTING RULE On March 27, Associated Builders and Contractors (ABC) commended President Trump for signing a resolution into law effectively eliminating the Obama administration’s illegal “blacklisting” rule (formally known as the Fair Pay and Safe Workplaces final rule). Implementation of most of the rule’s onerous and duplicative reporting and disclosure requirements were temporarily blocked on Oct. 24 when a U.S. District Court judge ruled in favor of ABC’s lawsuit and granted a preliminary injunction. “Associated Builders and Contractors has opposed the illegal blacklisting rule from the day it was first proposed as an executive order by President Obama,” said ABC Vice President of Regulatory, Labor and State Affairs Ben Brubeck. “The rule violated the due process rights of contractors by forcing them to report mere allegations of misconduct—which are often frivolous and filed with nefarious intentions by special interest groups—the same as fully adjudicated violations. “Additionally, the cumbersome and duplicative requirements

of the rule, most of which were temporarily blocked when a U.S. District Court judge ruled in favor of ABC’s lawsuit and granted a preliminary injunction, would have driven up the cost of public construction projects to taxpayers and served as a costly barrier to entry for small businesses. ABC is committed to working with the Trump administration and Congress to improve the government’s current procurement system to ensure that taxpayer-funded projects are awarded through a transparent and fair bid process that encourages competition from all qualified contractors.” The CRA measure was introduced by House Committee on Education and the Workforce Chair Virginia Foxx (R-N.C.), House Small Business Committee Chair Steve Chabot (R-Ohio) and House Committee on Oversight and Government Reform Chair Jason Chaffetz (R-Utah). Why did you run for office, and what are you most passionate about in your position? After having served in local government for nine years and as a state legislative staffer for fourteen years, I felt well placed to hit the ground running as a representative. I am passionate about crafting good

public policy that helps the residents of our state to reach their full potential as educated and prosperous free citizens. Do you remember your first interaction with ABC? What impact has that had on your legislative efforts? I first interacted with ABC members and their policy team in 2002 during my work as a new legislative staff member. Interacting with trades professionals on an ongoing basis has continued to help me in having a clear understanding of the need for our contractors to function in a regulatory environment that encourages success, entrepreneurship and accessible training opportunities to build a skilled workforce. Of which legislative effort are you most proud? I am most proud of efforts a few years back to bring additional flexibility to our state high schools for career based classes. ABC was a vital part of a coalition which successfully worked toward this measure’s passage and we are seeing schools begin to bring back vocational programs. What do you believe is the single biggest issue facing Michigan now and what do you think is the best solution to that issue? The largest problem facing Michigan today is a lack of skilled workers. Much additional prosperity and growth within our economy is held back when employers cannot count on the workforce they need to expand their companies. As chairman of the House Workforce and Talent Development Committee, I plan to address various workforce challenges head on. This includes building an additional awareness of career offerings among school guidance counselors, even more flexibility within high school curriculum options for career classes, further granting of credit for veterans service experience, and additional options toward a career for adults seeking additional training. How can ABC members continue keeping lawmakers up to date on key issues and priorities for their businesses and employees? ABC is at its best when it directly pairs grassroots members with their elected leaders. Invitations to visit local job sites and


facilities are fantastic opportunities for such interaction. Members should also visit lawmaker coffee hours and town halls to ensure their voices are heard. What are your top legislative priorities for 2017-18? My top legislative priorities for the present session are: 1. Intense focus and measurable progress on expansion of careerbased education and career pathways for all ages and abilities. 2. Removal of rule and mandate burdens on our schools and local governments so teachers can focus on educating students and local officials can concentrate on providing core services. 3. Protection of family farm operations from regulatory hazards and a focus on agricultural processing sector expansion as well as ag technology job training. Why did you run for office, and what are you most passionate about in your position? As a small business owner, I was extremely frustrated with how our great state was being run, and the direction our elected leaders were leading us. Just as important, I was concerned about the future of my three boys, who were just a few years away from adulthood, and their prospective livelihood in the State of Michigan. Do you remember your first interaction with ABC? What impact has that had on your legislative efforts? I actually remember ABC during my first campaign in 2010 and realized that our business philosophies (especially on Prevailing Wage) were very similar. Since 2010, ABC has been very supportive and helpful with all the legislation I have sponsored (2011, 2013, 2015 & 2017) to eliminate the prevailing wage laws in Michigan.

Of which legislative effort are you most proud? My continued effort to eliminate Prevailing Wage will eventually come to fruition and will be quite an achievement for our taxpayers. Some of my past legislation that I’m very proud of is the creation of a Mobile Dental Facility law, the creation of the Veteran’s Home Ombudsman law, and the Fostering Futures Scholarship Fund law. What do you believe is the single biggest issue facing Michigan now and what do you think is the best solution to that issue? The $26 billion unfunded liabilities our state taxpayers are burdened with is probably the single biggest issue we are facing (i.e. public school pensions/health care and the Other Public Employee Benefits or OPEB). Skilled trades training and improvements to our state’s infrastructure are huge issues facing Michigan as well. How can ABC members continue keeping lawmakers up to date on key issues and priorities for their businesses and employees? ABC members should continue to invest their time in building strong relationships with lawmakers, and invest resources in potential future candidates, who have a solid private-sector working experience. Personal success stories (and disappointments) your members experience with current issues or laws always helps put matters in perspective. What are your top legislative priorities for 2017-18? Eliminating Prevailing Wage has always been a priority for me since 2011. Other priorities would be to eliminate the unfair HICA tax on our state businesses, help creating the MI Thrive Brownfield legislation, foster care’s Child Care Fund payment process solution, and of course responsible Tax Relief for all our citizens.
