'Small Business Jobs Act' to Benefit Auto Dealers On September 27 President Obama signed the Small Business Jobs Act which, among other things, contains the framework for a new SBA Dealer Floorplan Program (DFP). NADA is working with the SBA to develop the new floorplan program which is expected to be rolled out before yearend.

Eligible loan amounts will be from $500,000 to $5 million with a 100% advance rate, a five-year term, reduced fees, and guarantees up to 75% (other 7(a) loans have guarantees up to 90%).

The Act also sets a new maximum alter-

native size standard of $15 million net worth and $5 million in net income as measured over two years.

In addition to a new Small Business Lending Fund and a new State Small Business Credit Initiative, the Act: • Eliminates capital gains taxes on investments held for five years for the rest of 2010.

• Increases to $500,000 the amount of capital investment businesses may immediately write off in 2010 and 2011, and raises to $2 million the level at which the write-off phases out.

• Extends the provision for 50%

“bonus depreciation” through 2010, thus accelerating the rate at which capital expenditures can be deducted.

• Allows cell phone use to be deducted without burdensome documentation.

• Allows certain small businesses to “carry back” general business credits to offset five years of taxes, while also allowing these credits to offset the Alternative Minimum Tax. • Changes the penalty for failing to report certain tax transactions from a fixed dollar amount to a percentage of the tax benefits from the transaction.n

EPA Issues Notice of Comment Period, Listening Session Regarding Hexavalent Chromium Toxicological Review Draft The Environmental Protection Agency (EPA) has announced a 60-day public comment period and a public listening session for the draft human health assessment of a toxicological review of hexavalent chromium. Hexavalent chromium (Cr6), a metal used in many industries - including automotive service and repair due to welding, sanding and grinding of some motor vehicle parts - can be toxic and is considered to be a carcinogen when inhaled. The question for the EPA is whether to adopt a strict risk measure as California did or to adhere more to a less-stringent stan-

dard.

The Occupational Safety and Health Administration (OSHA) issued standards in 2006 that limited workplace exposure to hexavalent chromium. It has been determined by OSHA that average levels of the substance that workers are exposed to today places them at significant health risks.

The Automotive Service Association (ASA) expressed concern about the lowering of the permissible level because of the lack of data as to the potential economic impact the lower level will have on collision members.

Collision shop employees use many refinishing products in their shops as well as sand, grind and weld vehicle parts. Each of these procedures presents the opportunity for hexavalent chromium to exist.

The public listening session is to be held Nov. 20 of this year.

U.S. EPA, DOT Announce Notice of Intent to Increase Automotive Fuel Efficiency, Reduce GHG Emissions The U.S. Department of Transportation’s (DOT) National Highway Traffic Safety Administration (NHTSA) and the U.S. Environmental Protection Agency (EPA) issued a Notice of Intent (NOI) Oct. 1, 2010, regarding fuel economy and greenhouse gas (GHG) emissions standards for cars and small trucks manufactured between the year 2017 and 2025. According to the EPA, this national program continues the administration’s commitment to reduce greenhouse gas emissions, increase fuel efficiency and reduce U.S. dependence on foreign oil.

The EPA claims the initiative will help make it possible for manufacturers to build a single national fleet of cars and light trucks that satisfies all federal and California standards, while ensuring that consumers have a full range of vehicle choices.

interim technical assessment that details different potential outcomes. The assessment, developed through extensive dialogue with automobile manufacturers and suppliers, non-governmental organizations, state and local governments, and labor unions, takes into consideration the costs and effectiveness of applicable technologies, compliance flexibilities available to manufacturers, potential impacts on auto industry jobs, and the infrastructure needed to support advanced technology vehicles.

The EPA and DOT state in the technical assessment that they will issue an interim report in November with further details regarding the new fuel economy standards for vehicles manufactured in 2017 and afterward.

The final rule for the intended standards is scheduled for almost two years from now, and there are several things that will determine how extensive the

restrictions will be. One of these major factors is the extent of time it takes for the automotive industry to develop electric vehicles and other advanced technology. Currently there are 245 million registered vehicles in the United States.

Only 1.6 million of these vehicles are hybrids, and only 33,000 of those are fully electric. Currently, cars are required to attain 27.5 miles per gallon. The EPA announced just last year fuel economy standards that increase the current average mpg required from 27.5 to 35.5 by 2016. The administration expects to have a final rule by July 2012.

2010 Infiniti G37 Coupe Adds Interior Refinements, Enhanced Navigation and Entertainment Features When it comes to a pure, seductive expression of intense per formance, many Infiniti vehicles likely come to mind.

ASA Reminds Collision Shops of Automotive Paint Regulation Compliance Deadline

By Jan. 11, 2010, collision repair shops were required to file an Initial Notification with the U.S. Environmental Protection Agency (EPA) and/or their state in compliance with the National Emission Standards for Hazardous Air Pollutants (NESHAP), Paint Stripping and Miscellaneous Surface Coating Operations Rule. For an existing affected source, the compliance deadline is Jan. 10, 2011, and full compliance status is due by March 11, 2011. These rules became effective in January 2008.

In September 2007, the Environmental Protection Agency (EPA) issued proposed air toxics standards for smaller emitting sources. These emitting sources were referred to as area sources, and were involved in three industry sec-

tors, including paint stripping and surface coating operations.

Area sources are defined as those having the potential to emit less than 10 tons per year of a single toxic air pollutant or less than 25 tons per year of any combination of toxic air pollutants.

Sources affected by the rule need to implement equipment and management practices in compliance with the new standards. The practices both reduce toxic material consumption and produce a savings to the facility. The restrictions include the following rules: • For paint stripping operations, the proposed rules would also require new and existing area sources to implement management practices that minimize evaporative loss of MeCl. Existing

area sources consuming more than 150 gallons per year of paint stripping formulation must also develop and implement a minimization plan designed to reduce their consumption of MeCl by identifying alternatives, when possible.

• For surface coating operations, the proposed rule would also require new and existing area sources to implement equipment and management practices that minimize the amount of coating required and to capture toxic metal particulates from the process. The toxic metal compounds are those containing cadmium, chromium, lead, manganese and nickel. The equipment practices include confining spray operations to Paint Regulation Please Turn to Page 22

House and Senate Pass Small Business Lending Fund The Senate has passed “The Small Business Jobs and Credit Act of 2010,” H.R. 5297, by a vote of 61-38. The House has agreed to the Senate version of H.R. 5297, by a vote of 237-187. The bill originally passed the House on June 28, 2010, and then passed in the Senate Sept. 16 by a vote of 61-38 with changes. This legislation creates a $30 billion lending fund that will be distributed to regional banks, which will in turn lend to small businesses. It also authorizes $12 billion in tax

small businesses in America. Upon signature by the president, these businesses will benefit from $12 billion in immediate tax cuts. $12 billion will transfer from the federal treasury into the hands of small business owners to help them navigate these difficult financial times. It is the right thing to do and the smart thing to do.”

Rep. Melissa Bean, D-Ill., also commented on the passage of the bill by saying, “Jobs in our community are created by businesses in our community, and providing an environment for small-business growth is key to Congress’ mission to strengthen our ongoing economic recovery.”

The U.S. Department of Treasury will be responsible for the small business lending fund. American Military Society Requests Congress Pass ‘Right to Repair Act’ to Support Military Families at Home The American Military Society (AMS) requests that Congress support passage of the Motor Vehicle Owners Right to Repair Act (S 3181/HR 2057) on behalf of its membership which includes active, reserve, National Guard, retired and veterans of the uniformed services, their families and survivors.

“Military personnel and their families are often stationed in remote locations far from any dealerships, relying on independent repair shops to service their vehicles,” said Charles C. Partridge, Col, USA (Ret) of AMS. “Spouses of deployed service members, holding their families together alone, are particularly disadvantaged when their local auto repair shop is denied ready access to repair information from the car companies. Most do not have the time to find the nearest dealership, drive all the way there and wait for their sole source of transportation to be repaired. That is one more burden that military families

do not need to face. All consumers benefit from competition, but those serving our country and their families derive particular benefit from being able to obtain affordable, effective and convenient repairs for their vehicle.”

The Right to Repair Act protects motoring consumers from a growing and potentially hazardous vehicle repair monopoly by requiring that car companies provide full access at a reasonable cost to all non-proprietary service information, tools and safety-related bulletins needed to repair motor vehicles. The legislation provides car companies with strong protections for their trade secrets, only requiring them to make available the same diagnostic and repair information they provide their franchised dealers to the independent vehicle repair market.

“As cars become more complicated with more computer systems, the problem becomes more acute,” continued

Partridge. “Selling a car without complete access to repair information is like selling prescription drugs without the doctor’s dosing instructions. It doesn’t make sense. That’s why we are asking Congress to rectify this situation and support passage of the Right to Repair Act. Our military families should not be forced back to the dealer for service and passage of Right to Repair would ensure that they can conveniently and affordably have their vehicles serviced at the shop of their choice.”

The Right to Repair Act has bipartisan support in both chambers of Congress. The Senate version of the bill (S 3181) was recently introduced by Sens. Barbara Boxer (D-CA) and Sam Brownback (R-KS) and has 5 co-sponsors. The House version (HR 2057) was introduced by Reps. Edolphus Towns (D-NY), Anna Eshoo (D-CA) and George Miller (D-CA) and currently has 71 cosponsors.n

Kia Motors Manufacturing Georgia Launches Second Shift Production Kia Motors Manufacturing Georgia, Inc. (KMMG) recently celebrated the launch of a second shift of production at its new West Point facility. KMMG hired more than 600 new team members to prepare for the addition of the second shift bringing the total number of jobs created at the plant to more than 2,000.

Kia Motors added the second shift in response to the successful sales of the 2011 Kia Sorento, which has been Kia's best-selling model in the U.S. every month since it debuted in January. The sec-

Volkswagen Announces I-Car Training Requirements For Certified Repair Facilities Volkswagen of America, Inc. has announced that I-CAR training courses and the in-shop I-CAR Steel GMA (MIG) Welding Qualification Series are required components of the Volkswagen-Certified Collision Repair Facility Program. This program provides VW-certification for collision repair facilities that perform body repairs in accordance with Volkswagen’s high safety standards and specifications.

Dan Ducharme, Parts Specialist for Volkswagen of America said, “I-CAR training will equip collision repair facility technicians with the necessary knowledge to repair our vehicles to factory standards. If a body shop follows Volkswagen

standards and specifications, they can positively impact the customer experience and help maintain the vehicle resale value.”

Body technicians will receive I-CAR training on advanced steel properties, structural part repair and replacement, procedures for corrosion protection during the collision repair process, as well as comprehensive welding instructions that includes theory, hands-on practice, and the in-shop I-CAR Steel GMA (MIG) Welding Qualification Test. Porsche Announces I-Car Training Requirements For Technicians I-CAR, the Inter-Industry Conference on Auto Collision Repair has announced that Porsche now requires I-CAR classroom training, the I-CAR Steel GMA (MIG) Welding Qualification Series, and the I-CAR Structural Parts Steel Welding Qualification Series as components of the “Porsche Approved Collision Center Program”. Collision repair facilities that meet all standards of the program will be recognized as Porsche Approved Collision Centers.

Mike Kukavica, Collision Repair Technology Instructor said, “We are excited to be able to provide Porsche technicians with up-to-date collision repair training from I-CAR as part of the “Porsche Approved Collision Center Program”. With a strong background in some of today’s most commonly used materials and procedures, as well completion of two of I-CAR’s Welding Qualifications Series, technicians will be wellequipped to complete Porsche training and perform quality repairs on Porsche vehicles.”

Larger stabilizer bars keep the vehicle very flat during cornering and help provide quick turn-in response.

Tucson features the Theta II 2.4-liter DOHC inline four-cylinder engine. The Theta II engine delivers about the same amount of power and acceleration as its prede-

cessor’s V6 engine with 20 percent better fuel economy than the old four-cylinder engine. In fact, the Tucson is more fuelefficient than its competitors boasting

an impressive estimated 23 mpg city/31 mpg highway fuel economy rating with the available six-speed automatic trans-

The Theta II is rated at 176 horsepower (26 percent more than its predecessor) and 168 lb.-ft. of torque.

This high-tech, all-aluminum, 16-valve engine features Continuously Variable Valve Timing (CVVT) on both camshafts and a Variable Induction System (VIS) for better engine breathing. In the green states, the 2010 Tucson is certified as a Partial Zero Emission Vehicle (PZEV) which means it is as clean as a hybrid.n

Inequities Exist in Texas Franchise Laws for Automotive Repairers

The Automotive Service Association (ASA) is concerned about inequities in the Texas Tax Code. Currently, in the Texas Franchise Tax Code, automotive repair and collision shops owned and operated by new or used car dealerships are taxed at half the rate used to tax independently owned automotive repair businesses doing identical work. The tax code classifies dealership sales as “retail” and allows their service and repair business to be included under that banner. Texas independent repairers are seeking similar treatment.

ASA is asking Texas repairers to contact their state legislators and urge them to help stop further audits of the automotive service industry until this issue is resolved.

Fuel Economy Announcement Raises NADA’s Concerns In response to the Obama administration’s announcement on setting new fuel economy mandates for the 2017-2025 Model Year, the National Automobile Dealers Association (NADA) issued the following statement: “America’s franchised auto dealers have long supported fuel economy improvements.

“Less than five months ago, the administration issued the most expensive fuel economy mandates ever, estimated to cost industry and consumers

over $50 billion. Now, before the ink has barely dried on those as yet unimplemented rules, the U.S. Department of Transportation, Environmental Protection Agency and the State of California have decided to launch a new and far more costly set of fuel economy mandates that would require light-duty cars and trucks to achieve up to 62 mpg on average by 2025. Why the rush?

Apparently, California regulators are once again threatening the administration with an unworkable patchwork of

state-by-state standards at the expense of one national standard premised on sound analysis.

“For many Americans, the prospect of being priced out of the car market means being driven out of the job market, so a primary concern for our members is the affordability of basic transportation for Americans. Preventing further job loss, preserving consumer choice and affordability, and improving safety should be primary factors in setting any fuel economy standard.”n

The Detroit News reports that the potential requirements are greater than twice the current fuel economy standard, and that the toughest of these requirements could add $3,500 to the cost of an automobile, or up to $50 billion annually for what American consumers pay for new vehicles. .n
