Byron Shire could be exception for govt holiday-letting rules A group of approved accommodation operators have expressed hope that Byron Shire could be excluded from the state government’s recently announced holidayletting rules after a recent meeting with Nationals MLC Ben Franklin. The NSW Liberal-National state government plans to introduce laws that will override Council’s planning policies, and Council staff have indicated the laws are
ambiguous and are not consistent with existing laws. Critics also say the burden of compliance and infrastructure will be borne by local councils. A small fee paid to local councils with every Airbnb transaction – which is common in other countries – has been rejected as part of the new government rules. Byron councillors resolved on Thursday (Cr Hunter against) to ‘write (again) to
the minister for planning to seek an urgent meeting to request a deferral of Byron Shire from the new statewide planning rules (pause to implementation).’ The motion also asks the Department of Planning and Environment if Council can require the ‘dwelling’ used for short-term rental accommodation to be the principal place of residence of the owner, and that it be permissible for 90 days (not 180
days). Council have also asked the planning department that if owner or manager of a property used for short-term rental accommodation could be required to ‘register on a Byron Shire Council Short Term Rental Accommodation Register,’ and ‘exclude shortterm rental accommodation from (to be nominated) areas in the Byron Shire that are needed for permanent residential and key worker accommodation.’

NRCF hands out $114k The Northern Rivers Community Foundation (NRCF) distributed around $114,000 to a range of social and environmental groups throughout the northern rivers region at Tuesday’s annual grants ceremony. The philanthropic organisation says it has distributed over $1.5m since 2004, and is totally independent and funds community organisations across seven northern rivers shires. The awards ceremony was held at the Murwillumbah Community Centre, which last year received a
significant NRCF grant to help re-establish its community food pantry wiped out in Ex-Cyclone Debbie floods of 2017.

Water mining restriction motion passes in Ballina Council Chris Dobney Ballina Shire Council last week voted unanimously in support of a proposal to restrict water extraction in the shire and to reinvestigate existing licences. The motion, from Cr Jeff Johnson (independent), seeks a staff report on ‘options to amend the LEP to prohibit water extraction for the purposes other than for agricultural or domestic uses’. It will also see Council
write to water minister Niall Blair ‘calling for a halt to any new water licences for nonagricultural purposes such as bottled water within the Ballina Shire’. Clarification was also requested on whether existing licences can be transferred to third parties for non-agricultural uses. In addition, the council will ‘engage with Rous Water with regard to water supply security for the Ballina Shire and neighbouring councils’.
