✔Declarația 5/2022 privind implicațiile Deciziei C-817/19 a Curții Europene de Justiție a UE referitoare la implemen-

Curtea a constatat că valabilitatea Directivei PNR nu a fost afectată. În același timp, Curtea a decis că, pentru a asigura conformitatea cu Carta, Directiva PNR trebuie interpretată ca incluzând limitări importante ale prelucrării datelor cu caracter personal. Acest lucru este de o importanță deosebită, având în vedere ingerințe grave în drepturile garantate în articolele 7 și 8 din Cartă.

Pentru a limita aceste interferențe la ceea ce este strict necesar, Curtea identifică mai multe aspecte pe care legile naționale care transpun directiva trebuie să le respecte. Printre cele mai relevante se numără în special:
