Bundaberg Refresher Day 30th June 2011 :LWK -3¶V DWWHQGLQJ ZH KDG D IXOO GD\ ZLWK H[FHOOHQW VSHDNHUV LQ WKHLU ¿ HOG As Bundaberg is in a rural sector we had a new speaker from the stock squad from Kingaroy deliver a talk on how JP’s are asked to assist them with livestock and other rural crimes. Bundaberg refresher day had JP’s as far south as Brisbane north to %XQGDEHUJ :RUNVKRS Rosedale west to Kingaroy. Delegates from Kingaroy and Gympie branches came not only for the professional development but with the view on how to set up their own workshops so we look forward to seeing great things from these branches. 3UHVLGHQW¶V 5HSRUW Dear Colleagues, 7KH &RQVWLWXWLRQ KDV XQGHUJRQH D VLJQL¿FDQW UHYLHZ E\ WKH Board with the assistance of John Payne of Hall Payne Lawyers who has done a very in depth overhaul of the old Constitution and Branch By-Laws. A copy of the updated Constitution is available on the QJA website and Branches and Members with an email have been sent a copy. More detail about the changes and how to obtain a copy can be found later in this Journal. In the time since the last edition of the Journal, new branches have been established at Caboolture, Cairns and Ingham with interest from Bamaga. Refresher days have been conducted at Logan, Bundaberg and Rosewood. The Company now consists of 23 Branches and 7 Contact Groups with a growth of membership now over 5,700.

Monday 7th March, 2011 to obtain a licence to deliver the new course 30942QLD. Director Keith Revell and I had a meeting ZLWK 0V -DVPLQD -ROGLF $FWLQJ 3ULQFLSDO $GYLVRU 2I¿FH RI the Deputy Premier and Mr David Mackie, Executive Director, Department of Justice and Attorney General on Monday 29th October. Matters discussed included training and how the QJA could collaborate with the JP Branch to further strengthen the quality of JP Training in Queensland. Mr Mackie has since advised that the QJA will be offered a licence to deliver 30942QLD and negotiations will continue to work out details. This edition of the Journal is larger than usual as the Company is required by law to pass onto Members information as IROORZV

From the $XGLWRU¶V 5HSRUW WKH &RPSDQ\ KDV ¿QLVKHG WKH \HDU ZLWK D As advised previously, the JP course 39215QLD has run out healthy surplus. of accreditation on Monday 25th July and TAFE Queensland has declined to re-accredit it. A new course 30942QLD Course in Community Services (Commissioner for Declarations and Justice of the Peace {Qual}) of 28 Hours duration has been developed by the Department of Justice and Attorney General. The course consists of two units, Commissioners for Declarations of 10 Hours duration and Justices of the Peace (Qual) of 18 Hours and which is funded.

Timely receipt of membership subscriptions is necessary to enable the FRPSDQ\ WR HIIHFWLYHO\ EXGJHW DQG SODQ RXW LWV DFWLYLWLHV IRU WKH ¿QDQFLDO year. The Annual General Meeting of the QJA will be held at 10.00am on Saturday 12th November, 2011. All are welcome to attend and the draft agenda appears later in this Journal. Afterwards, all attendees are invited to stay and partake in a light lunch.

If there are any members who have neglected to pay their subscriptions, it is requested that they do so as soon as possible. If you fall into that category, you should have recently received a reminder notice, either by post or by email. &RQVWLWXWLRQ 8SGDWH Throughout this year, the QJA has undertaken a consultation process with our Honorary Lawyers – Hall Payne Lawyers, to correct anomalies LQ RXU FRQVWLWXWLRQ DQG WR PDNH WKH FRQVWLWXWLRQ PRUH UHÀ HFWLYH RI current practice. A proposed constitution is now available for review and will be presented at the AGM in November for adoption. This update has been emailed to eligible members, distributed to Branches, has been loaded onto our website www.qja.com.au, and can be supplied in paper version free of charge to members upon request made to the Registrar. 7KH QHZ FRQVWLWXWLRQ LQFRUSRUDWHV WKH IROORZLQJ

NOTES TO THE FINANCIAL STATEMENTS FOR THE YEAR ENDED 30 JUNE 2011 NOTE 1: STATEMENT OF SIGNIFICANT ACCOUNTING POLICIES The financial report is a general purpose financial report that has been prepared in accordance with Accounting Standards, Urgent Issues Group Interpretations, other authoritative pronouncements of the Australian Accounting Standards Board and the Corporations Act 2001.The financial report covers the economic entity of Queensland Justices Association. Queensland Queensland Justices Association is a company limited by guarantee. The financial report has been prepared in accordance with the mandatory Australian Accounting Standards applicable to entities reporting under the Corporations Act 2001 and the significant accounting policies disclosed below, which the directors have determined are appropriate to meet the needs of members. Such accounting policies are consistent with the previous period unless stated otherwise. The financial statements have been prepared on an accruals basis and are based on historical costs unless otherwise stated in the notes. The accounting policies that have been adopted in the preparation of this report are as follows: Accounting Policies a.

Revenue Revenue from the sale of goods is recognised upon the delivery of goods to customers. Grant revenue is recognised in the income statement when the entity obtains control of the grant and it is probable that the economic benefits gained from the grant will flow to the entity and the amount of the grant can be measured reliably. If conditions are attached to the grant which must be satisfied before it is eligible to receive the contribution, the recognition of the grant as revenue will be deferred until those conditions are satisfied. When grant revenue is received whereby the entity incurs an obligation to deliver economic value directly back to the contributor, this is considered a reciprocal transaction and the grant revenue is recognised in the balance sheet as a liability until the service has been delivered to the contributor, otherwise the grant is recognised as income on receipt. Donations and bequests are recognised as revenue when received. Interest revenue is recognised using the effective interest rate method, which for floating rate financial assets is the rate inherent in the instrument. Dividend revenue is recognised when the right to receive a dividend has been established. Revenue from the rendering of a service is recognised upon the delivery of the service to the customers. Members of the Company are Justices of Peace and Commissioners for Declarations who pay an annual subscription fee. Subscription paid In advance is treated as current liabilities. All revenue is stated net of the amount of goods and services tax (GST).

Inventories Inventories are measured at the lower of cost and current replacement cost. Inventories acquired at no cost, or for nominal consideration are valued at the current replacement cost as at the date of acquisition.

Plant and Equipment Plant and equipment are measured on the cost basis less depreciation and impairment losses.

INDEPENDENT AUDIT REPORT TO THE MEMBERS OF QUEENSLAND JUSTICES ASSOCIATION The carrying amount of plant and equipment is reviewed annually by directors to ensure it is not in excess of the recoverable amount from these assets. The recoverable amount is assessed on the basis of the expected net cash flows that will be received from the assets employment and subsequent disposal. The expected net cash flows have been discounted to their present values in determining recoverable amounts. Plant and equipment that have been contributed at no cost or for nominal cost are valued and recognised at the fair value of the asset at the date it is acquired. Depreciation The depreciable amount of all fixed assets are depreciated on a straight line basis over the assetÕs useful life to the entity commencing from the time the asset is held ready for use. . The assetsÕ residual values and useful lives are reviewed, and adjusted if appropriate, at each balance sheet date. An assetÕs carrying amount is written down immediately to its recoverable amount if the assetÕs carrying amount is greater than its estimated recoverable amount. Gains and losses on disposals are determined by comparing proceeds with the carrying amount. These gains or losses are included in the income statement. When revalue assets are sold, amounts included in the revaluation reserve relating to that asset are transferred to retained earnings. d.

Leases Leases of fixed assets where substantially all the risks and benefits incidental to the ownership of the asset, but not the legal ownership that are transferred to entities in the economic entity are classified as finance leases. Finance leases are capitalised by recording an asset and a liability at the lower of the amounts equal to the fair value of the leased property or the present value of the minimum lease payments, including any guaranteed residual values. Lease payments are allocated between the reduction of the lease liability and the lease interest expense for the period. Leased assets are depreciated on a straight-line basis over the shorter of their estimated useful lives or the lease term. Lease payments for operating leases, where substantially all the risks and benefits remain with the lessor, are charged as expenses on a straight-line basis over the lease term.

Financial Instruments Initial recognition and measurement Financial assets and financial liabilities are recognised when the entity becomes a party to the contractual provisions to the instrument. For financial assets, this is equivalent to the date that the Company commits itself to either purchase or sell the asset (i.e. trade date accounting is adopted). Financial instruments are initially measured at fair value plus transactions costs except where the instrument is classified Ôat fair value through profit or losses in which case transaction costs are expensed to profit or loss immediately. Classification and subsequent measurement Finance instruments are subsequently measured at fair value, amortised cost using the effective interest rate method or cost. Fair value represents the amount for which an asset could be exchanged or a liability settled, between knowledgeable, willing parties. Where available, quoted prices in an active market are used to determine fair value. In other circumstances, valuation techniques are adopted. Amortised cost is calculated as: i.

the amount at which the financial asset or financial liability is measured at initial recognition;

ii.

less principal repayments;

iii.

plus or minus the cumulative amortisation of the difference, if any, between the amount initially recognised and the maturity amount calculated using the effective interest method; and

iv.

less any reduction for impairment.

The effective interest method is used to allocate interest income or interest expense over the relevant period and is equivalent to the rate that exactly discounts estimated future cash payments or receipts (including fees, transaction costs and other premiums or discounts) through the expected life (or when this cannot be reliably predicted, the contractual term) of the financial instrument to the net carrying amount of the financial asset or financial liability. Revisions to expected future net cash flows will necessitate an adjustment to the carrying value with a consequential recognition of an income or expense in profit or loss. The Group does not designate any interests in subsidiaries, associates or joint venture entities as being subject to the requirements of accounting standards specifically applicable to financial instruments. (i)

Financial assets at fair value through profit or loss Financial assets are classified at Ôfair value through profit or lossÕ when they are held for trading for the

Such assets are subsequently measured at fair value with changes in carrying value being included in profit or loss. (ii)

Loans and receivables Loans and receivables are non-derivative financial assets with fixed or determinable payments that are not quoted in an active market and are subsequently measured at amortised cost.

(iii)

Held-to-maturity investments Held-to-maturity nvestments are non-derivative financial assets that have fixed maturities and fixed or determinable payments, and it is the companyÕs intention to hold these investments to maturity. They are subsequently measured at amortised cost.

(iv)

Available-for-sale financial assets Available-for-sale financial assets are non-derivative financial assets that are either not capable of being classified into other categories of financial assets due to their nature, or they are designated as such by management. They comprise investments in the equity of other entities where there is neither a fixed maturity nor fixed or determinable payments.

(v)

Financial liabilities Non-derivative financial liabilities (excluding financial guarantees) are subsequently measured at amortised cost.

Fair Value Fair value is determined based on current bid prices for all quoted investments. Valuation techniques are applied to determine the fair value for all unlisted securities, including recent armÕs length transactions, reference to similar instruments and option pricing models. Impairment At each reporting date, the entity assesses whether there is objective evidence that a financial instrument has been impaired. In the case of available-for-sale financial instruments, a prolonged decline in the value of the instrument is considered to determine whether impairment has arisen. Impairment losses are recognised in the Income Statement. Derecognition Financial assets are derecognised where the contractual rights to receipt of cash flows expires or the asset is transferred to another party whereby the entity no longer has any significant continuing involvement in the risks and benefits associated with the asset. Financial liabilities are derecognised where the related obligations are discharged, cancelled or expired. The difference between the carrying value of the financial liability, which is extinguished or transferred to another party and the fair value of consideration paid, including the transfer of non-cash assets or liabilities assumed, is recognised in profit or loss. f.

Impairment of Assets At each reporting date, the entity reviews the carrying values of its tangible and intangible assets to determine whether there is any indication that those assets have been impaired. If such an indication exists, the recoverable amount of the asset, being the higher of the assetÕs fair value less costs to sell and value in use, is compared to the assetÕs carrying value. Any excess of the assetÕs carrying value over its recoverable amount is expensed to the Income Statement. Where the future economic benefits of the asset are not primarily dependent upon on the assets ability to generate net cash inflows and when the entity would, if deprived of the asset, replace its remaining future economic benefits, value in use is determined as the depreciated replacement cost of an asset. Employee Benefits Provision is made for the entityÕs liability for employee benefits arising from services rendered by employees to Balance Sheet date. Employee benefits expected to be settled within one year together with benefits arising from wages, salaries and annual leave which may be settled after one year, have been measured at the amounts expected to be paid when the liability is settled plus related on costs. Other employee benefits payable later than one year have been measured at the net present value. Contributions are made by the entity to an employee superannuation fund and are charged as expenses when incurred.

Ballot for new QJA Board INSTRUCTIONS FOR VOTERS All ordinary members, joint members, concession members and life members have the right to vote in an election of members to the board. Associate members and Honorary members are not eligible to vote (Section 6.7 of the QJA Constitution). Voting can only take place by completing the ballot paper as provided in the QJA Journal, Spring edition, or a photocopy of that voting paper. The ballot paper has two sections Section 1 - a section for your name, address, QJA membership number and signature. Section 2 - the ballot paper itself. Section 1 must be filled out clearly, correctly and completely for a ballot paper to be declared valid. Remember that your QJA membership number is the number appearing on your membership card or membership certificate Ð it is not your JP signing number. If in doubt, contact State Office to ensure that the number is correctly entered. This section is required to determine your eligibility to vote. Section 2 must be filled out by ticking

a maximum of one box for the position of President, and a maximum of three boxes for the position of Vice President

He has been a Justice of the Peace since 1979 and upgraded to JP (Qual) in 1991. He has been a QJA member since his appointment in 1979. Ray has been the Secretary of the QJA Redland City branch since 2005. He has served on the QJA Board since 2007 and was elected President in 2009. He was the QJA Journal editor from 2007 to 2009. His other services to QJA have been to co-ordinate the QJA refresher workshop in Cleveland in 2006, co-ordinate the State Conference in 2009. I became a JP (Qual) back in 2001 and soon after started up the Bundaberg branch of the QJA. I was the coordinator for the 2007 State Conference held in Bundaberg, which was the biggest conference ever held. I have also been instrumental in starting the social barbecue’s that Hervey Bay, Bundaberg, Howard and Gladstone attend. I have a lot of rural JP’s that call me for assistance at all times of the day and night and I am always happy to help. At the 2007 AGM I was accepted onto the Board of Directors. Since joining the Board, I have assisted in working through the many challenges that the company has faced, some of which are still ongoing. I have assisted other branches RI WKH 4-$ WR DFKLHYH WKHLU JRDOV LQ EXLOGLQJ WKHLU QXPEHUV DQG ¿QDQFHV $V D 'LUHFWRU , KDYH EHHQ ZLOOLQJ WR WUDYHO IDU DQG ZLGH RIWHQ DW P\ own expense, to support QJA branches and QJA events and enjoy this for the network system that has developed. /RFDWLRQ /RJDQ

Keith is a current Director of the QJA and is seeking re-election as Vice-President or Director. Keith was born in the UK and migrated to Brisbane in 1971 where he married Gwen. They have two married sons and three grand-children. He has been a Justice of the Peace since 1987 and upgraded to JP (Qual) in 1995. Keith has been on the Branch Executive Committee of the Logan City branch since its inception and co-ordinated the QJA refresher workshops in Logan in 2009, 10 & 11. He is the editor of the QJA Journal, and overseas the Information Technology systems used by the QJA. He regularly volunteers as a JP at various Logan signing centres and at the Beenleigh Courthouse.

Marian Vierveyzer is one of the current Vice-Presidents is seeking re-election as Vice-President or Director. In November 1999, Marian completed her JP (Qual) preparation course at Yeronga TAFE and took her Oath of Service in 2000. She became a member of QJA in 2001. Marian has been a member of the QJA Ipswich branch since 2003 and was elected Chairman of the branch that year. 2YHU WKH QH[W WKUHH \HDUV VKH HVWDEOLVKHG D QXPEHU RI LQLWLDWLYHV IRU WKH EUDQFK LQFOXGLQJ WKH ¿UVW UHIUHVKHU ZRUNVKRS open to non-member JPs, raising interest in branch meetings to regular attendance rates of 15-20 people. She has been a guest speaker at many branch meetings and taken an active role at the Annual State Conference. 0DULDQ ZDV UH HOHFWHG LQ DQG WKHQ LQ ZDV HOHFWHG 9LFH 3UHVLGHQW 5HFHQWO\ VKH IDFLOLWDWHG WKH FUHDWLRQ RI RI¿FLDO 4-$ 9LVLRQ DQG Mission statements and has established the QJA Women’s & Diversity Committee, with goals to foster social inclusion within QJA. In her paid career, Marian works full time in the Safety arena in the construction industry. She is married to Bill with three married children and six grandchildren (and counting).

/RFDWLRQ 5RFNKDPSWRQ

In 1989 I was elected Convenor of the Central Queensland Regional Sub-Committee of the Queensland Justices’ Association and have been involved as JP leader in the community ever since. With legislation changing every year I saw the need to upgrade the standards of local Justices of the Peace. This led me to be heavily involved in the development of training seminars in Central and Western Queensland. I have been the Chairperson of the Rockhampton Branch for many years and was elected a member of the QJA Board in 2002. Since then I have been involved in reforming branches in Gladstone, Townsville, Mt. Isa, and Mackay. When I am in Brisbane during the Christmas and New Year break, I always make an effort to go out and meet QJA members at local signing centres. I have also had the pleasure with my committee of organising three QJA State Conferences in Rockhampton. In 2005, I became a QJA accredited tutor so that I could conduct JP (Qual) training courses and in 2009 had my QJA trainer accreditation renewed under the new RTO system. I have always been prepared to travel far and wide to support the people and events of the QJA and I ask the members to consider electing me to the Board of Directors again so that this work can be continued.

5HJLRQDO 5RXQGXS &DERROWXUH %UDQFK &RPPLWWHH Ray Young OAM (Vice-President), Angela Yin (Registrar) and Ray Burrows (President) travelled to Caboolture on Saturday 2nd June for a second meeting with QJA members in the Caboolture area to form a

branch. Positive results with eleven people attending the meeting. The group elected as QJA Branch Chairperson Ron Court, with Secretary John Geary and Treasurer John Olding. The new branch will be called the QJA Caboolture Branch and have already discussed options for hosting refresher days and information workshops.

Trawling of social media sites that contain birth dates and private details can become the basis to establishing a false identity. Identity theft is the fastest growing and most lucrative criminal activity today, surpassing the drug trade. Annabel Buchanan Solicitor Inspector – Project Manager for the Inspectorate spoke about cruelty to animals. Ms Buchanan spoke to the JPs regarding their roles in authorising search warrants upon allegations of suspected criminal acts against animals. Support and compensation for victims of crime was a topic covered E\ *HUDOGLQH :DONHU 6HQLRU &RXUW 6XSSRUW 2I¿FHU RI 9LFWLPV $VVLVW Queensland who spoke about how victims of crimes navigate the acquisition of compensation after they have suffered an injury or the loss of a loved one. Ms Walker advised that Victims Assist Queensland was based upon a philosophy of criminals taking responsibility for their crimes and contributing to their victims’ compensation claims.

If anybody was under the misapprehension that jewellery or computers were the most valuable items a person can own, DSC Shelton refuted this notion, advising instead that it was in fact, rubbish bins and social media LQWHUQHW SUR¿OHV &ULPLQDOV WDUJHW UXEELVK ELQV EHFDXVH WKH\ RIWHQ FRQWDLQ insecurely disposed personal details such as old bills and bank statements.

The Acting Registrar of the JP Branch, Dimitri Glianos also addressed the group about developments the Government is proposing for JPs in 4XHHQVODQG LGHDV WKDW ZHUH GLVFXVVHG LQFOXGHG WKH SURIHVVLRQDOLVDWLRQ RI the JP service. Mr Glianos made himself available to answer questions throughout the day regarding the authorities and procedures of JPs in Queensland. JPs were advised to keep a log book or diary of all JP jobs they conduct, recording basic information and procedures used. 7KH GD\ ¿QLVKHG ZLWK LQIRUPDWLRQ DERXW 4&$7 4XHHQVODQG &LYLO DQG Administrative Tribunal) presented by Jon Duncan – Deputy Registrar, Ipswich Courthouse. Apart from being very informative Mr Duncan noted that he was a local boy and went to school in Rosewood. It was a rare opportunity to speak before his former primary school teacher who was in the audience.

A personal thanks is given for the support and friendships that have been formed over the recent years. Max has been a QJA member since 1974 and in 1985 was instrumental in the formation of the QJA Toowoomba Branch. Max has been a very active Branch member and a consistent and eager volunteer at the JP Signing Centre at Clifford Gardens Shopping Centre.

Maroochydore AGM Angela Yin (Registrar) and Ray Burrows (President) travelled to Maroochydore on Tuesday night 19th July to address the QJA Maroochydore Branch AGM at the Maroochydore RSL. It was a good night with new blood being appointed. Chairman John Pearce, Secretary Anne Fletcher and Treasurer James Withford. Around seventeen attended with a number of apologies recorded.
