Setback for Makhado municipality in PAIA court case By Anton van Zyl The Makhado Municipality’s efforts to avoid disclosing information about dodgy property transactions suffered a setback in the Limpopo High Court on Friday morning when their appeal against an earlier judgement was struck off the roll. The municipality had appealed against a mag­ istrate’s court ruling ordering it to disclose all documentation relating to the transactions. The Makhado Magistrate’s Court made the ruling in September 2020 in the matter of Zout­ net CC vs the Makhado Municipality. Zoutnet CC is the publisher of the Limpopo Mirror and Zoutpansberger newspapers. Magistrate Vanessa Grundlingh ordered the municipality to grant the publishing company access to records that had been requested in terms of a Promotion of Access to Information Act (PAIA) application. The first PAIA application was sent to the mu­ nicipality almost a year earlier, in October 2019. The documents requested relate to the sale of a public park in Louis Trichardt, Limpopo. The park was divided into two sites, which were offered for sale by public tender. The ten­ ders were, however, not awarded to the highest

ie lesers van die brief het hierdie beeld van Paulus onmiddellik verstaan, wanneer Hy so verduidelik dat hulle met die Heilige Gees verseël is. Dit was ‘n teken van eiendomsreg. Die Gees getuig saam met ons dat ons kinders van God is (Romeine 8:16) en gee sekerheid van ons saligheid. Toe die verlore seun van die vreemde land teruggekeer het, het die vader ‘n ring aan sy vinger gesit om sy terugkoms te verseël. Het jy reeds sekerheid in jou hart, hierdie stempel van eienaarskap op jou afgedruk? Dit is die werk van die Heilige Gees, Hy sê vir jou: “Ek het jou by jou naam geroep; jy is Myne!” (Jesaja 43:1). Wanneer ‘n stempel op was afgedruk word, moet die was eers sag word, sodat die indruk daarop blywend kan wees. Harde en koue was kan nie gebruik word nie. God moet ook ons hart sag maak, voor Hy ons verseël. Die Heilige Gees soek harte wat gebroke is, waarvan die hardheid en koudheid verwyder is (Esegiël 11:19), sodat Hy die beeld van Christus al dieper op ons kan afdruk. Niemand sal ons uit sy hand ruk nie (Johannes 10:29), want deur die Gees is ons “verseël tot die dag van verlossing” (Efesiër. 4:30). bidders. One section of the property was, in fact, sold to the lowest bidder. The other section was sold to a bidder who offered R450 000 less than the highest bidder. The municipality would have been paid R850 000 more for the two erven, had it accept­ ed the highest bids. At the time, the municipality refused to make specific information about the transaction avail­ able to the media. Requesting information to find out who the successful bidders were, took weeks. But even then, the correct names of the companies were not supplied. The municipality also refused to give any reasons as to why the highest bids had not been accepted.

PAIA (not) to the rescue The initial PAIA application served on the municipality was completely ignored, despite the law stating that such applications must be responded to within 30 days. Because the lack of a response is construed as a refusal, an appeal was filed in December 2019. This appeal against the deemed refusal was also ignored by the municipality. Papers were served on the municipality in March 2020, indicating that the court would be asked to rule on the matter. This was also ignored by the municipality. The case then made its way to the Louis Trichardt Magistrate’s Court, where the date for hearing was set as 12 April 2020. This was unopposed by the municipality and a default judgement was expected. However, in April that year, the country went into hard lockdown and all cases were post­ poned. When the matter was put on the roll again, the municipality suddenly woke up and decided to oppose the application in court. It argued, among other things, that the applicant had never provided reasons why the information was sought and that to adhere to such requests would be a waste of officials’ valuable time. The municipality further argued that the successful bidders should have been notified of the applica­ tion and should have consented to the informa­ tion’s being made available. In her ruling in September 2020, magistrate Grundlingh brushed aside the municipality’s arguments and pointed out that a person who

requests information from a public body, such as the municipality, does not need to prove that any right is sought or that any right needs to be protected. The municipality is obliged to make the information available, within the ambits of the PAIA. The municipality was ordered to make the in­ formation available within 15 days and pay costs.

More delays But rather than comply, the municipality filed a notice of appeal a week later against the judge­ ment. In its notice of appeal, the municipality argued that the first applicant (Zoutnet CC) had no locus standi, because the owner of the busi­ ness had not indicated on the PAIA form that he was representing a publishing company. The municipality still argued that the success­ ful bidders should have been contacted for their consent. They also reckoned that the applica­ tion to obtain the information was a waste of taxpayers’ money, because “(t)he applicants are looking for a ‘topical story’ for the sole purpose of boosting their newspaper sales, which is not the purpose of PAIA”. The matter then dragged on for several more months, with the municipality’s legal representa­ tives seemingly in no hurry to push for a hearing. In January 2021, the municipality’s lawyers, Wisani Baloyi Incorporated, withdrew as attor­ neys of record. In a letter attached to this notice, it transpires that the law firm and the munici­ pality could not agree on an increase in the fees charged for work done. On 29 January 2021, Dabishi Nthambeleni Inc were appointed as new attorneys of record. Even after the appointment of a new legal team, the matter dragged on for more than a year, with not much happening. After a lot of pressure was applied by the newspaper’s legal team, a High Court date for a hearing was set for 10 June 2022.

respectfully declined this rather bizarre offer. The case then hit another snag. When judges Frans Kgomo and Thogomelani Tshidada en­ tered, they pointed out that the documentation was not in order. The responsibility resides with the party who brings the matter to court (in this case the municipality) to file, index and paginate the documents properly. Judge Kgomo described this as a complete mess and chaotic. He and judge Tshidada crit­ icised Adv Nthambeleni for the sloppiness and said that this was in contravention of the court rules. Because of this chaotic situation, the case was to be struck from the roll. Adv Nthambeleni blamed the situation on the correspondent he used in Thohoyandou, PBN Mawila Attorneys. The judges explained that the matter was now back to the stage where the magistrate’s court had made a ruling. This ruling is enforceable, and should the municipality still feel that it is not just, they must file a new appeal and restart the process. This time, however, judge Kgomo said the process could be fast-tracked. The municipality was also ordered to pay costs on a party-to-party scale.

Enters a friend of the court

Because of the importance of the case, the South African National Editor’s Forum (SANEF) and Media Monitoring Africa (MMA) became involved and asked to be allowed as amicus curiae (friends of the court). In the founding affi­ davit, SANEF and MMA describe themselves as “non-profit organisations dedicated to ensuring that the rights to freedom of expression, access to information and a strong, independent press are realised in South Africa”. Roshini crowned as queen of influential women in Durban Deur Pétria de Vaal Roshini Pakkiree from Louis Trichardt brought home a crown once again after being chosen as the queen during the “Influential Women and Artes Awards 2022” in Durban on Saturday, 11 June. Both Roshini and her husband, Mark, went on stage to accept the award for their involvement with the youth-development project that Big M Productions runs. Readers will recall that the Pakkirees founded the “Sanjit Train of Hope Foundation” in memory of their beloved son, Sanjit Pakkiree, who sadly passed away at the age of 16. This foundation brings hope to the hopeless by bringing financial relief to children in need. “Pinky Mothie of Big M Productions was the one who nominated us as a power couple for the Influential Women and Artes Awards. This

was due to us being the key sponsor for the youth development and for the uplifting of other women. On stage, they also gave us a tribute to our son. There were many other women as well who contributed to their own projects – they had their own development going. Mark and I were both involved in this. I was recognised as being the “chief ” of involvement and the sponsor of the event,” Roshini says. Mark said: “Once again my wife has done us proud: Influential Queen of the Year. Sanjit Train of Hope still running strong nationally. Thank you, Pinky Mothie and Big M Produc­ tions, for this recognition.” The people of Louis Trichardt will remember that Roshini was crowned as “Mrs Shakti Beats Stunning Goddess” earlier this year. Shakti Beats wrote on Facebook: “We as the Shakti Beats Family is ecstatic and very proud of you both, having been chosen and acknowledged for your

hard work and dedication, which has made a substantial difference in our communities. The Legacy of Sanjit Pakkiree lives on through both of you.” Roshini continued by mentioning that, since they had started the Sanjit Train of Hope Foun­ dation, their initiative had opened many doors. “Our angel is still blessing and protecting us. I feel honoured to be on the cover of the magazine of influential women. Thank you, Pinky Mothie, for these blessings and especially for including my baby boy in this magazine,” Roshini says. Zoutpansberger Hierdie week, 25 jaar gelede, het die stof nog lank nie gaan lê rondom die aanstel­ ling van ‘n nuwe stadstesourier vir Louis Trichardt nie en het die destydse Inwo­ nersvereniging beoog om die saak na ‘n hoër hof toe te neem. Op die voorblad van 13 Junie 1997 word berig van ‘n loodsvergadering wat gehou is om ‘n mandaat te kry om hof toe te gaan. ‘n Loodskomitee is gestig om aksies verder te koördineer. Die aksies het gevolg nadat die ANC-beheerde Stadsraad mnr. Dan Masengani in die pos van stadstesourier aangestel het op grond van regstellende aksie, ten koste van kandidate wat veel beter gekwalifiseerd was. Dieselfde week is ook berig van mnr. Patrick Sikhutshi wat vir ‘n tweede termyn ingehuldig is as burgemeester van die destydse Groter Louis Trichardt Oorgangsraad. In ander voorbladnuus is berig van drie mans wat die voorafgaande week in motorongelukke op die streek se paaie dood is. Twee jagters van Pretoria, mnre. Fotograwe sal tot en met die laaste week van elke maand hê om hulle foto’s vir daardie maand in te skryf en ‘n wenfoto sal vir elk van die 12 maande gekies word. ‘n Maksimum van vyf foto’s per fotograaf per maand kan ingestuur word. Strongman Champs On 25 June this year, Louis Trichardt will play host to the first ever Limpopo Strongman Cham­ pionships, organised on behalf of the Southern African Strongman Federation (SASF) and hosted by Paul’s Body Shop from Air Force Base Makhado. In charge of arrangements is local strongman Leon le Roux. Le Roux needs no introduction among our readers, boasting numerous top­3 and top­10 finishes in both national and inter­ national strongman competitions in his age and weight class over the last couple of years. By hosting the event, also a first for Limpopo, Le Roux hopes to promote the sport and arrange more competitions for the province. The compe­ tition will be open for all classes, ages and sexes to participate and will be done according to ASU (Southern African Strongman Federation) and international standards. Battle of Delville Wood commemorated July 2022 marks the 106th anniversary of the Battle of the Somme, one of the bloodiest battles in human history. Between 1 July and 18 November 1916, more than one million men were wounded or killed on the banks of the river Somme in France. Among the soldiers killed and injured were more than 2 400 South Africans who fought for control over a small piece of land in the northeast of France, called Delville Wood. This Sunday, 17 July, at 11:00, a special service will be held at the Moths’ Turbi Hills Shellhole to commemorate Delville Wood and to pay tribute to the South African soldiers who lost their lives during his war. Waldo Strijdom van Musina het Saterdag tydens die 35 km Kremetart-wedren die manne met die padfietse ore aangesit met sy bergfiets deur die wedren te wen. Hy was ook die eerste Youth seun oor die eindstreep.

Hoërskool Louis Trichardt se fietsryers het heelwat Top-10 plekke ingepalm in die 70 km Kremetart-wedren, waaronder twee met podium plekke weggestap het. Jacques du Preez (regs) was derde in die junior afdeling, terwyl Andani Raphalalani (links) van Ridgeway College die tweede junior was. Die eerste junior was Musa Mabuza (middel) van Bosbokrand, wat ook die algehele wenner van die 70 km-wedren was. Die ander Triegie wat ‘n podiumplek gekry het, was Douglas Piorek, wat derde was in die afdeling vir Elite mans.

Karla van Zyl van Louis Trichardt het Saterdag die 35 km Kremetart-wedren vir vroue gewen. Sy was ook die eerste Elite-vrou oor die einstreep en algeheel vierde tussen die mans en vroue. Tweeling Daniel (bo) en Matthew Lee (onder) het ‘n gedugte span gemaak die afgelope naweek tydens die 35 km Kremetart-fietswedren deur onderskeidelik algeheel tweede en derde te eindig. Hulle was onderskeidelik ook die tweede en derde Youth-seuns tuis.

Buiten vir Louis Trichardt eie Eliz-Mari Pretorius (middel) wat die vroue-afdeling van die 70 km Kremetart-wedren gewen het, was nog ‘n Louis Trichardter, Jeanette Coetzer (links), algeheel derde in dié wedren. Die Soutpansberg het die afgelope naweek weer gasheer gespeel vir die 30ste Kremetart Fietswedren. Alhoewel die hoof wedren, die 175 km uitdaging, die groot name van die voorwêreld telkens gelok het, het die plaaslike ryers in die 70 km- en 35 km-wedrenne uitgeblink. Een van hulle was Eliz-Mari Pretorius wat ‘n eerste plek losgery het in die vroue-afdeling van die 70 km-wedren. Sy was ook die eerste Elite-vrou tuis en vierde algeheel onder die mans en vroue.

The Louis Trichardt Parkrun is back in full swing, and residents are welcome to take part in the 5km run/walk on Saturday mornings. During the winter season, the run starts at 08:00, still at the park next to the information centre along the N1. Louis Trichardt’s 63rd Parkrun on Sat­ urday was attended by a smaller number of Parkrunners than usual, due mainly to the large number of events happening in town on the same day. The group of enthusiasts included two visitors from Gauteng, namely Rob Millerd and John Horrocks. Rob Millerd is a Parkrun fanatic, and he completed his 289th Parkrun on Saturday. What makes this even more impressive is that he has done this at 199 different Parkrun venues. He spent some time in Japan and 24 of his Parkruns were completed there. Whilst in Japan, he helped establish the first Parkrun in Japan at Futakotamagawa, Tokyo. Rob was in Louis Trichardt on business and decided to stay for the Parkrun. Both he and John’s home venue is the Delta Parkrun in Randburg, Gauteng. John Horrocks visited Louis Trichardt to support his wife, who was riding the Kreme­ tart cycle race. On Saturday, he completed his 216th Parkrun at his 70th different venue. Rob finished first on Saturday, with John coming in fifth. Parkruns are free community events, for walkers, runners and volunteers and are held weekly at 194 venues in South Africa with more than 2 000 venues in 23 countries worldwide. As Saturday’s visitors have shown, Parkruns can be an excellent way to connect with different communities wherever you find may yourself. Die Louis Trichardt Rugbyklub se eerstespan het Saterdag, 11 Junie, teen Letaba se eerstes uitgedraf. Die spelers van beide Letaba en Louis Trichardt het die toeskouers getrakteer op ‘n interessante stryd. The Isability golf day at Soutpansberg Golf Club on 11 June was keenly supported by local golfers as well as one or two from further afield. Fanti Holtzhausen, a golfer on vacation from Pretoria, was impressed with the beautiful course and friendly reception she received. Inspirational, to say the least, was the participa­ tion of 91­year­old Denise Fourie, who flew up from the Cape to participate. With a comfortable swing, Fourie completed the 18 holes of golf in the morning chill ­ an encouragement to all that we can be healthy and active even when we are over 90! Denise won the prize for the furthest “drive” (flight from the Cape) – 1 582 km! Later in the day, prizes were handed out by Gavin “Magic” Johnson, ex­Springbok rugby player and Louis Trichardt resident. The winners of the tournament were the Tim­ bercity 4­ball consisting of Zagrys Nortjé, André Schoeman (a single­leg amputee), Craig Lee and Eben Moller with 95 points on a count out. Also with 95 points, in second place, was the SACM team consisting of George Mahlauli, Richard Machumela, Khangale Malange and Dumisani Nzimande. In third place with 91 points was the 4­ball NewCo Meat team, consisting of Johan Pretorius, Beukes Haasbroek, Wikus Botes and Francois Jonker. The event was also attended by some of the Jumping Kids and Icexpress prosthetic limb beneficiaries based in Limpopo, namely Jorrie Jordaan, Corrie Dercksen and Vhutuhawe Nemutandani (junior Limpopo ambassador for Jumping Kids). Alwyn from “Die Boer Roer” and Elmarie Buys from Isability served guests with mouth­watering potjiekos, and steaming hot custard made over the braai coals was generous­ ly heaped over delicious desserts kindly made by volunteers to round off the evening dinner.
