Closer to home, acting judge Nkosi of the High Court in Pretoria awarded R160 000 in damages to Ms Johanna Pavier of Louis Trichardt on 23 June. According to court documents, Pavier (who was 61 years old at the time) was arrested without a warrant by Constable Ravele of the Makhado SAPS. The arrest took place at around 17:00 on February 16, 2012, at Reclam in Industria Road, with Pavier only being released at 15:00 the next day. Like Mashele, Pavier’s account of the human rights violations she suffered at the hands of the police reads like a horror story. Pavier was summarily arrested for illegally dealing in second-hand goods (scrap metal) after she, according to Ravele, failed to produce a valid “trade” certificate issued in terms of the Second-Hand Goods Act, Act 23 of 1955. This was despite Pavier producing an affidavit that she had obtained from the Makhado SAPS just prior to visiting Reclam, stating that she was sell-

The court records show that Ravele did not understand Afrikaans and made no effort to find out what the Afrikaans note said. Ravele admitted in court to not knowing what the certificate looks like he was asking for. Despite this he instructed Pavier to escort him to the Makhado police station. Here she was left standing for an extremely long period of time while Ravele opened and registered the charge against her. He then informed Pavier that she is going to be placed in the police’s holding cells. The shock caused Pavier to collapse. When she regained consciousness, she was being attended to by ambulance staff and transferred to hospital where her one arm was handcuffed to the hospital bed. The handcuff was in full view of her children who came to visit her. One of the police officers also told her “Jy moet lekker lê, because the next day at 06:00 you would be taken into the police cells where criminals belong and would be raped”. Later, the court documents state, Pavier asked to use a toilet. She was, however, dragged with the handcuffs to the toilet, where her one wrist was kept handcuffed and the police officer held the other end of the handcuffs. She did not have full privacy in the toilet and Pavier was left humiliated and degraded. The next day, Pavier was escorted to the police van and was ordered to climb into the back of the van. She obviously had difficulties doing so, because of her one arm being handcuffed and because of her age. Pavier said she had asked the police officer to assist her, but he replied: “I do not render assistance to rubbish.” As Pavier was climbing into the back of the van, the court heard, the same police officer persistently slammed the door against her causing injury to her right shoulder, right hip, right knee and right foot. Halfway through 2017, Ma­ kha­do Crossing in Louis Tri­ chardt remains untouched. The mall was earmarked for development way back in 2015 already. The developer, the Masingita Group of Companies, completed the land and property sale early in 2016. The development, it was announced, was to take place on the piece of property currently housing the town’s rugby fields, squash club, gymnastics and wrestling hall, the well-known Rugby Lapa and netball fields. Since the announcement, however, the deal has seemingly been put on ice. For the past two weeks, the Zoutpansberger has been trying to enquire from the Makhado Municipality on the progress of the project since the sale was finalised. The municipality,

however, has been hesitant to react, specifically about the expanse of the total development, which has dramatically decreased in size. According to a modified architect’s drawing of what the new mall would look like after completion, tenants such as Ster Kinekor and Virgin Active have been cut from the plans. The smaller size of the extensions, as shown on the map, also reveals that only the rugby club will have to be relocated. Additionally, no clear indication of the project’s expected date of completion has been given. Masingita Group of Companies was at first confident to break ground on the project in September 2016. In September, however, the company retracted their statement and expressed the hope to complete the extensions by 2018. Ever since Masingita acquired

the property, the municipality had yet to give further particulars as to how the sale had been constructed. There have been rumours that Masingita struck an informal deal and was granted the sport clubs’ property, provided that they would foot the bill for the various clubs’ relocations. Apart from this, the municipality has never answered questions put them about whether an environmental impact assessment was done regarding the proposed development or whether the municipality will be able to supply basic services (sewerage, electricity and water connections). These questions have been put to the municipality since 2016. At the time of our going to press, the municipality had once again only confirmed receipt of the newspaper’s questions.

Police again on wrong side of the law (Contd from P1) Pavier’s right arm was handcuffed to the van. According to her, the driver of the van found joy driving at a high speed and into all available potholes in the road to cause her discomfort. Pavier also testified that the driver deliberately took longer to reach his destination, because he took unscheduled detours to prolong the trip. At the police station, Pavier’s handcuff was removed and she was escourted to the police cells. It was only at around 15:00 on February 17, 2012, that Pavier was released after a warrant officer Bekker intervened. During the journey, however, Pavier used her cell phone to take a video of her being handcuffed and show the high speeds at which the van was driving. The van also came to a sudden halt, with Pavier hitting her body against the hard steel surface of the back of the van. At this point, judge Nkosi remarked that he has seen the footage several times and that it was clear that the footage is not rehearsed or fabricated. “She appears to be in severe distress, very anxious and traumatised. Her facial expression tells it all,” judge Nkosi said. In his judgement, judge Nkosi

stated that Pavier was arrested for contravening the Second-Hand Goods Act. He, however, stated that the Act has sixteen sections and none of them make provision for a person to be arrested. At most the act makes provision for the imposition of a fine. The defendant (Minister of Police), however, claimed that Pavier’s arrest was justified in accordance with Section 40(2) of the Criminal Procedure Act. This section allows a peace officer to arrest a person without warrant subject to certain conditions as set out by that law. “None of the provisions of the Act [Second-Hand Goods Act] deal with the arrest of an offender or empower the police to arrest the offender. The justification for the arrest as stated by the defendant is therefore clearly incorrect. The fact that the word ‘arrest’ is not found in the Act, indicates that the legislature never intended that a person who contravenes any provision of the Act should be arrested …” said judge Nkosi. As for the assault on Pavier, judge Nkosi stated that Pavier’s evidence about the humiliating treatment she had received at the hands of the police officers at hospital, as well as outside and inside the police van, remained unchallenged by the defendant.

“The defendant failed to call a witness, notwithstanding the fact that the defendant was always aware of the nature of the claims. The fact that she was handcuffed to the hospital bed, which was cruel given the fact that she was an elderly woman of approximately 61 years of age and was in hospital due to a medical condition, leads me to believe that the police officers were so insensitive and cruel. The police behaviour leads me to a conclusion that it is highly probable that they slammed the door of the police van against her upper and lower limbs causing her injuries,” Nkosi sated. All of the above eventually led to judge Nkosi ordering that the Minister of Police pay Pavier R160 000 in damages. Interest will also be calculated at 10.25% per annum from the date of the judgment until the amount is paid. The Minister of Police is further also liable for the cost of the law suit. Adv. V. Although the Musina Municipality could technically be considered bankrupt, it did outperform the Makhado Municipality with regard to the 2015/16 report of the auditor-general (AG). Musina walked away with an “unqualified” audit for the third consecutive financial year, unlike Makhado, who received a “qualified” report for the second consecutive year. This might all sound a bit confusing, but basically an unqualified report is better than a qualified report. Let us explain: There are five types of audit outcomes, the best being a “no findings” unqualified opinion. This means the AG can state, without reservation, that the financial statements of the municipality fairly represent the financial position of the municipality and are in line with generally recognised accounting practices (GRAP). The second best is a “emphasis of matter items” unqualified opinion, such as the one Musina received. It is the same as an unqualified opinion with no findings, but the AG wants to bring something particular to the attention of the reader. Next up is the qualified opinion, which Makhado achieved. This is where the AG expresses reservations about the fair presentation of the financial statements, as there is some departure from the GRAP but this is not sufficiently serious to warrant an adverse opinion or a disclaimer of opinion. An adverse opinion is up next. This is expressed when the AG concludes that the annual financial statements do not present the municipality’s financial position, results of operations and cash flows in line with GRAP. A disclaimer of opinion is last in line. This is where the AG does not have all of the underlying documentation needed to determine an opinion. For example, the lack of underlying documentation and the amounts in question may be so great that it is impossible to give any opinion on the matter at all. Like the article about Makhado’s 2015/16 audit report last week, the Zoutpansberger looked at Musina’s key drivers of internal control, viz. leadership, financial and performance management, as well as governance. As is the case with his findings regarding Makhado, the AG stated that Musina’s leadership did not detect or prevent the risks of material misstatements to the financial statements and performance, which were only identified during the audit process. He added that the slow response by the leadership to resolve recurring findings and its inability to follow a pro-active approach have resulted in material misstatements in financial and performance reporting. “Those charged with governance have not yet provided adequate evidence to confirm that unauthorised, irregular and fruitless and wasteful expenditure incurred by the municipality in the prior years has been investigated,” stated the AG report. During the 2015/16 financial year, the AG found that Musina’s unauthorised expenditure amounted to R5 757 290. This, the AG stated, was due to expenditure incurred in excess of the limits of the amounts provided for in the votes of

the approved budget. As for fruitless and wasteful expenditure, this amount totalled R10 766 174. This was incurred due to interest on late payments of accounts. Irregular expenditure amounted to R21 104 415 due to contravention of the supply-chain management policy. One of the most notable findings of the AG was, however, that the Musina Municipality is technically bankrupt. The AG pointed out that the municipality had incurred a net deficit of R70 156 556 (2015: R36 613 580) during the year ended on 30 June 2016 and, as of date, the municipality’s current liabilities exceeded its current assets by R138 695 223 (2015: R79 496 796). The AG specifically referred to this in his remarks regarding leadership. “The municipality’s efforts to address the cash flow and liquidity challenges did not yield the desired results to minimise the municipality’s exposure to cash flow risk and liquidity problems, which leads to going concern and financial viability difficulties,” the AG stated. As for financial performance, the AG found that the municipality did not adequately oversee the operations of the municipality, as the financial statements and annual performance report contained material misstatements not detected by the municipality’s own system of internal control. “The municipality’s management of records was inadequate in keeping performance information that supported the reported information. This included information that related to the collection, collation, verification, storing and reporting of actual performance information,” the AG found. He added that the implementation of the supply chain management (SCM) processes and procedures were also inadequate, resulting in irregular expenditure. In regard of the SCM, the AG found that: * He could not obtain sufficient audit evidence that contracts were only awarded to providers whose tax matters had been declared by the South African Revenue Service (SARS) to be in order; * Awards were made to providers who were in the service of other state institutions, in contravention of the Municipal Finance Management Act (MFMA), although similar awards were identified during the previous audit year and no effective steps were taken to prevent or combat the abuse of the SCM process; * Construction contracts were awarded to contractors that did not qualify for the contract; * Contracts were awarded to bidders who did not submit a declaration on whether they are employed by the state or connected to any person employed by the state; and * Bid adjudication committees were not always composed in accordance with SCM regulation. The Makhado Municipality shared similar findings by the AG. It would seem that all municipalities in Limpopo are struggling with regard to leadership and financial and performance management. No single municipality in the province could achieve a clean audit. The Musina Municipality at least seemed to do better than Makhado in accurately summarising their dire financial situation.

Has Google “stolen” the town’s Grobler Street?

The official link supplied ( com/intl/en/press/) only returns a 404 error. As Google quite correctly identifies: “That’s an error. The requested URL /intl/en/press/ was not found on this server. That’s all we know.” Seeing that Google has managed to lose more than just a street, we went one step further and contacted Mr Richard Gingras, Vice President, News of Google. At the time of our going to press he had, unfortunately, not responded to our email. For the immediate future, it seems as if Louis Trichardt will have to learn how to cope without a Grobler Street. With the press of a button a street name disappeared. An unknown, unreachable entity seems to decide on such issues. Very soon you may find that, when searching for a street in town, you will get the message: “That’s an error. The requested street was not found on this server. That’s all we know.” On the positive side, someone else remarked that the problem of the “ladies of the night” might now disappear. These working girls used to frequent Grobler Street, ensuring that the lights emanating from the street poles are not wasted. But they will probably just move their work addresses to Meyer Street…

It might not qualify as the “crime of the century”, but it is still a sad loss. It seems as if Google has “stolen” one of Louis Trichardt’s streets. Yes, Grobler Street is no more. In their defence, it must be stated that Google did replace the street with something else. In the place of Grobler Street, a strange extension of Meyer Street has appeared. Perhaps a bit of background for the benefit of the readers not aware of the crime: Some more observant residents of the Soutpansberg pointed out a few weeks ago that Google Maps no longer shows Grobler Street, one of the main streets in the town’s CBD. The street has been renamed to Meyer Street, which creates a bit of a conundrum, because the existing Meyer Street (opposite Bergwater Hotel, where it meets Rissik Street) is still there. The disappearance of a street in the CBD is a serious matter for many residents. A number of businesses are situated in Grobler Street and these businesspeople may wonder whether people using GPS devices relying on Google Maps will be able to find their shops. Based on comments Mr Schultz made on social media, this is not true. On his Facebook comments Mr Schultz wrote that he had merely received a “unanimous vote” of support from his committee members. Last Tuesday, Mr Schultz sent an email to the Zoutpansberger with a photo of AfriForum Louis Trichardt’s executive committee. The information accompanying the photo was very brief, stating that: “The local branch of AfriForum have voted unanimously in a vote of full confidence in Wally Schultz as chairman of AfriForum Louis Trichardt.” It then gives the names of the people in the photo.

The Makhado Municipality will be hosting their annual show at the municipal show ground in Louis Trichardt from Thursday, 27 July to Saturday, 29 July. The show once again promises lots of fun and entertainment for everyone. The entrance fee for children is R30 for each day and R50 or adults on the Thursday and Friday and R70 per adult on the Saturday. Pensioners will be able to enter for free on all three days. his ability. “The task before me is huge, but I’m happy that I have a dedicated team of councillors and officials who will help me to realize my dream of improving service delivery to the people of Musina. Although there are some challenges that the municipality is facing, it gives me courage because there are some areas where we are doing very well in terms of service delivery. I’m ready to steer this ship in the right direction for the benefit of all the people of Musina.” At the time of his appointment, Tshiwanammbi was the general manager for economic and development planning at Musina Municipality, the position he held from October 2012. He also served as acting municipal manager from December 2016 to date. Before joining Musina Municipality, he worked as programme manager for economic and development planning for the South African Local Government Association (SALGA) in North West between 2009 and 2012. He

also served as town planner for the eMalahleni Local Municipality between 2006 and 2009 and worked at various private companies as planner, land surveyor, project manager and researcher. Tshiwanammbi is a graduate of the universities of Venda, Pretoria and the Witwatersrand. He also completed various short courses from recognized educational institutions around the country. He is currently furthering his studies with the University of Venda and the University of Pretoria.

anneer die Bybel sê: “Wandel deur geloof, en nie aanskouing nie,” beteken dit nie dat daar nooit sigbare getuienis was nie. Ook beteken dit nie dat daar nie vandag sigbare getuienis is nie. Lees 1 Kor. 15:3-6; Ps. 19:2; Rom. 1:20. Wat word bedoel wanneer die Skrif sê: “Wandel deur geloof, nie aanskouing nie”? Die konteks is belangrik. Lees 2 Kor. 5:4-7 Christus is gesien deur mense. Hy het wonderwerke gedoen met ’n woord of aanraking. Ja, Hy het gesterf en opgestaan uit die dood en aan baie mense verskyn, maar vandag word Hy nie meer gesien nie. Ons sien Hom nie meer fisies nie. Soos die Skrif sê: “...solank ons in die liggaam bly, ons nog nie by die Here woon nie.” Dit beteken ons sien Hom nie nou nie. Nie net dit nie, ons “sug”. Maar God het ons Sy Gees as waarborg gegee. Die Heilige Gees is onsigbaar, maar word ervaar in die lewe van ’n kind van God. In watter opsig wandel ons deur geloof en nie deur aanskouing nie? Ons lewe deur geloof as gevolg van God se fisiese en sigbare optrede in Christus in die verlede, en die onbetwisbare getuienis van die verlede. Daarom vertrou ons die lewende Christus en wat Hy belowe het vir ons, alhoewel ons Hom nie fisies sien met ons oë nie. Lees hoe Romeine 8:24-25 dit stel. Petrus stel dit so: “Hom het julle lief, al het julle Hom nie gesien nie. Deur in Hom te glo, al sien julle Hom nie nou nie, het julle reeds deel aan die saligheid wat die einddoel van julle geloof is.” (1 Pet. 1:8). Ons het nog nooit die Here Jesus gesien nie, maar daar is ’n soort sien wat nie sien met ons oë is nie. Paulus het daarvoor vir ons gebid. Lees Efesiërs 1:18. Die Skrif praat ook van “die lig van die evangelie van die heerlikheid van Christus” (2 Kor. 4:4). Dit sien ons wanneer God die blindheid wat Satan oor ons verharde harte gebring het, wegneem. Daarom kan ons sê soos Paulus in Galasiërs 2:20 “... leef ek deur die geloof (nie aanskouing nie) in die Seun van God.” As dit nie jou ondervinding is nie, vra daarvoor in nederigheid. Dit is waarvoor Paulus vir ons gebid het in Efesiërs 1:18. Dit is reg en volgens God se wil om vir “verligte harte” te vra. Dit is reg om Ps. 119:18 te bid. Dit is om verder te gaan as net Bybel lees. Dit is om die wonder van God in Sy Woord te aanskou. En die wonder wakker ons geloof aan en bewaar dit. Plato once said: “Music is a moral law. It gives soul to the universe, wings to the mind, flight to the imagination.” A fortnight ago, residents were treated to a rare delight: the Winter Music Concert of budding young, local musicians. The concert was the result of the combined effort of two local music teachers, Christiane van Heerden and Celeste Smit. Christiane has been playing the violin since childhood and has also travelled the world playing with internationally acclaimed orchestras. Last year she decided to qualify as a music teacher and this year she obtained her certification from the European Suzuki Association, which gives Christiane accreditation to teach students nationally and internationally. The association employs

the Suzuki method to teach students. They teach from the principle that all children possess the ability that can be developed and enhanced through a nurturing environment. The method is called the mother-tongue approach; because all children learn to speak their own language with ease and if the same natural learning process is applied in music teaching, the skills can be acquired successfully. Christiane’s new students performed live for the very first time with the piano students of Celeste. “My aim is to instil a lifelong passion for the piano and music in general,” says Celeste. Her strategy is based on a firm theoretical foundation whilst still treating each student as the unique individual that they are. “As students progress, I try to provide them with musical

Eerstes kou harde bene teen Noordelikes Rugbynuus

Polokwane se rooi masjien, die Noordelikes-rugbyspan, het Saterdag behoorlik gemors met Louis Trichardt se eerste rugbyspan. Die twee eerstespanne het die naweek teen mekaar te staan gekom in die laaste uitdunwedstryd van die provinsiale Boet Fick-liga op Louis Trichardt se tuisveld.

The first match in the Limpopo Dairy League of the Louis Trichardt Cricket Club is scheduled for Sunday afternoon. The Limpopo Dairy team will face the Vikings. Vikings are the current “champions” of the previous T20 tournament. The league serves as a warm-up competition to prepare players for the new provincial season, which will start in September. In the Limpopo Dairy league, teams will battle it out over 18 overs, with each bowler limited to three overs. Five teams have entered for the competition and the rivalry is expected to be intense. Next Saturday (22nd) Vikings will play against Strikers. Strikers surprised friend and foe a few weeks ago by winning the six-a-side tournament. Cricket players who have not yet joined the club and are not playing for a team are invited to contact any of the committee members.
