President’s Message: Nancy Lea

Did you make it to the Winters Lighted Tractor Parade on December 1st that we noticed in in our Constant Contact Monday November 26th? If not --- and you want your “Christmas Parade Fix” (but without the lighted tractors ---) you have a happy alternative, the Woodland Holiday Parade on Saturday, 10:00 am, December 8th. There will be fun for all: Expect to see and hear bands, horses, youth groups, floats, Santa Claus – and some tractors! Since the election is behind us, perhaps we will be spared some of the politicians!

Once again we are preparing for our Agricultural Celebration (also known as: Annual Dinner and Meeting) at my favorite venue, Waite Hall at the Yolo County Fair Grounds, on January 17, 2019. We have selected Gene Miyao, VERY recently retired Farm Advisor for Vegetable Crops, as our Agriculturalist of the Year. As most of you know, for years Yolo County’s highest grossing crop has been Processing Tomatoes, earning between $70M and $80M in Farm Gate value that has positively resonated throughout our county’s economy. Your YCFB board appreciates the contributions that Mr. Miyao has made toward the consistent high quality and value brought to Yolo County by this crop. Those who know Mr. Miyao value his creativity and commitment to the crop to which he has devoted much of his life. The leading tomato industry organizations and companies share this respect and admiration. We look forward to our opportunity to thank him for his many contributions to Yolo County agriculture. Please plan to join us.

When someone departs this earth after 82 years there can be sense of emptiness and deprivation, but, hopefully, there is an appreciation of a life well lived. YCFB past president (1995-1996).

Dona Mast passed away on November 10. Dona also served as president of the Woodland Chamber of Commerce and the Woodland Noon Rotary. She made valuable contributions to many other community organizations. Past president Jeff Merwin commented that Dona was YCFB president when he first came on the board in the 1990’s, and she was an integral and valuable part of Farm Bureau. A message to Dona’s family: she and her many contributions to our community are valued and she will be missed. In consolation, the many positive results of her efforts remain with us.

We continue to work on issues that are relevant to agriculture in our County and to many of us directly. A big one is the SWRCB’s apparent intention to require unimpaired flows in certain rivers, starting first on the San Joaquin River and its tributaries and then moving in an even more draconian fashion to the Sacramento River and its tributaries. That latter step would negatively impact eastern Yolo County. The SWRCB expects to make a decision on December 12. Unimpaired flows means disallowing some currently permitted diversions from the rivers for irrigation and other purposes. Reductions in irrigation means taking land out of production, which means loss in income and tax base. In our constant search to build connections and relationships with relevant groups, Denise and I met with the top City of Woodland administrative officials on November 13 on other issues relevant to YCFB: we asked if either was aware of the SWRCB proposed “water grab”: they were not.

One has to question the adequacy of the SWRCB outreach.

I attended the “Water Summit” hosted by Colusa County Farm Bureau on November 19: speakers were SWRCB Chair Felicia Marcus, Dept. of Fish and Wildlife Director Chuck Bonham, our CFBF President Jamie Johansson, CFBF lawyer Chris Scheuring, State Senator Jim Nielsen, Assemblyman James Gallagher and David Guy, President, Northern CA Water Association. SWRCB

Chair Marcus asked for “volunteer” plans to work around the Board’s decision that there are too many diversions leaving rivers too high in temperatures and too low in flows to accommodate fish.

She stated that the Board would not debate matters of science.

Director Bonham noted the remarkable and unmatched diversity of fish and wildlife in CA – more than any other State, and described his department’s role as its “Steward”. Chris Scheuring reminded the regulators present that no other state has the complexity and diversity of agricultural crops (I add – “and farmers”) that California has: and a goal has to be to protect California ag, also. Senator Jim Nielsen had earlier commented that in the 2009 California State Water Plan, a “water right” for Humans – and Human Activity – is recognized as a co-equal right with other water plan objectives. A sobering experience. One walks away from that “Summit” with the sense that decisions already have been made that will negatively impact areas that use river water, including Yolo County, and nothing that we do or say will make much of a difference. I am not so sure about the SWRCB’s characterization of negatively impacted ag organizations trying to offer acceptable fish friendly accommodations as “volunteers” - maybe “hostages”?

Another issue of increasing importance to Yolo County is biomass availability for orchard and vineyard removal. Have you looked at the cost of removing an orchard lately? In the recent past, with the benefit of subsidies for renewable energy, PG&E took removed trees and the biomass facility turned them into energy: the removal/clean up cost was negligible to the grower especially if walnut burls were part of the mix: and the air stayed clean. Those subsidies are gone: orchardists (and tax collectors) are going to be looking at sub par plantings with little or no income.

And, orchardists will be burning removed wood. I met with VCE representative Chris Cole at our Farm Bureau office to discuss this situation and request that VCE include biomass as part of their energy mix. If the cost of orchard removal impacts you, I encourage you to call Farm Bureau and arrange your own meeting with Chris. Also contact your Supervisors and State Senator Bill Dodd and Assemblywoman Cecilia Aguiar-Curry.

The AG Roundtable was held on November 15, presenting timely and helpful updates by UC Cooperative Extension, YF&R and the WCC Ag Dept. District Attorney Jeff Reisig followed up with an excellent overview of the realities of property crime enforcement here in Yolo County. A summary of his presentation is at page 6. The program was nicely put together by Board Member, Mike Howard, Ag Education Chair.

We continue to reach out to other groups that have an interest in Yolo County ag and should be our natural allies: I attended the Woodland Food Front representing YCFB on November 15 and gave a “What Farm Bureau does for Farmers and Ranchers” overview to the Yolo Land Trust board on October 30 – always working to connect with more allies and supporters of your YCFB, and the work that we do to protect agriculture.

Your YCFB does not hold a December meeting in part because of scheduling difficulties around board member obligations and holiday events. Some board members, who will be delegates or alternates to the 100th California Farm Bureau Federation convention in San Diego, have been attending District and Northern California caucuses to have the advantage of issue discussions in preparation for anticipated convention votes. YCFB is sending as delegates Past President Jeff Merwin, First Vice President Joe Martinez and Second Vice President Garrett Driver: our Alternate is Stan Lester. We are fortunate to have such committed and qualified attendees.

Farm Bureau Board Meeting Minutes October 9, 2018 President Nancy Lea called the meeting to order at 7:00 PM. It was held at the Farm Bureau Board Room, 69 West Kentucky Avenue, Woodland.

Guests in attendance were Center For Land Based Learning Presenter Marisa Alcorta; David Ogilvie; Woodland School Board Candidate Deborah Silva Batista and Jim Barrett.

Adoption of Consent Agenda President Lea presented to the Board the Consent Agenda. It was duly moved, seconded and carried: RESOLVED: to approve the consent agenda of the October 9, 2018 Board of Directors meeting.

Presentations • Marisa Alcorta presented for the Center for Land Based Learning California Farm Academy Apprenticeship Program. The program teaches skills to farm employees, managers, or owners.

David Ogilvie has an employee in the program and described the benefits of the program.

• Woodland School Board Candidate Deborah Silva Batista discussed the reasons she is running.

President’s Report President Lea reported she drove to the sites of the applicants submitted to YC for Development Agreements for cannabis growers; YCFB submitted comments on the draft EIR Impact Report for the YC Cannabis Land Use Ordinance; there is a Davis Citizens group that seem to have the same position on cannabis as YCFB; Union Pacific Railroad withdrew their application to close the crossing at County Road 32A while groups meet to come up with a solution that works for all; YCFB sent a letter to CFBF President Jamie Johansson praising Karen Mills for her excellent work on the crossing issue; Sponsorship letters are being mailed; a notation was made that sponsors could also donate to the Annual Meeting Silent Auction; she asked board members review list of companies still to be contacted and write down the name and title of the person the letter should be addressed to; a postcard was sent out to members who did not renew during the past year; we are short membership goal for the year and urged board members to call anyone they know on the expired member list; and she attended the latest Board of Supervisors meeting to remind them how important the Williamson Act is to Yolo County and thanked them for continuing the program.

After President Lea’s report there was discussion about funding for the Williamson Act; where Jesse Salinas is on his proposal to get Williamson Act funding; and what CFBF is doing to request Subvention Funding be restored. After further discussion it was duly moved, seconded carried: RESOLVED: To send letters to Senator Bill Dodd and Assemblymember Cecilia Aguiar-Reyes strongly suggesting they work to restore Subvention Funding for the Williamson Act contracts, and copy to all the county farm bureaus.

After the motion was passed it was suggested the letter include that the very nature of agriculture decreases CO2 emissions and this should not only be recognized but credits given.

Reports • John Young reported that the Oriental Fruit Fly quarantine had spilled over into Clarksburg but has not expanded; no new fliers have been found; Yolo County Office of Emergency Services wrote two letters for disaster declarations regarding the County Fire and to the Secretary of the US Department of Agriculture regarding the Branch Broom Rape; an Ag Department internship program has been approved to work with Woodland Community College and UC Davis.

• Mike Howard reported the solicitation letter for the 2019 Silent Auction is ready and each board member was given three copies; the November Ag Roundtable meeting will be held November 15th at the Yolo Fliers Club and District Attorney Jeff Reisig will be speaking; he has asked Sheriff-Elect Tom Lopez to speak at the January meeting (and wants to be certain the Buckhorn restaurant in Winters can accommodate the expected crowd); and the YC Sheriff Department’s Rural Crime and STARS groups have been asked to be the guest speakers at the March 2019 Ag Roundtable event.

• Miranda Driver reported for Garrett Driver - the Membership Committee reported calls will be made to all expired members and asked for help from board members.

• Gary Sack provided a written report.

• Justin Rominger reported that the October YF&R meeting was held at Yolo Land & Cattle where about 20 members learned about the history of the ranch and land sustainability; and committee members are starting to plan the 2019 Spring Fling.

• Mike Vereschagin had provided a written report.

Discussion • YC moved the Cannabis Department from the Ag Department and to the Community Services Department. The focus has changed from enforcement to licensing.

• President Lea requested that all Silent Auction donations be brought to the YCFB office.

• Miranda Driver was congratulated for being chosen to participate in the Ag Leadership program. Adam Borchard was also chosen for the program.

Speaker Jeff Reisig at November 15 Ag Roundtable Meeting Recap of November 15, 2018 Ag Roundtable Meeting Yolo County District Attorney Jeff Reisig opened his comments by explaining that his office reviews approximately 8,000 cases each year for potential criminal charges. Those cases are sent to his office by law enforcement agencies from across Yolo County. The DA employs 36 deputy prosecutors who assist him in his duties.

DA Reisig next spoke about the most common types of crimes his office deals with from the rural communities, including burglary, theft, possession of stolen property and drug use.

DA Reisig explained that over the last several years, there has been a noticeable uptick in rural crimes, most noticeably theft crimes. He explained that he believes the rise in crime is connected to several changes in the law that have resulted in reduced penalties for theft and drug offenses.

In November of 2014, voters passed Proposition 47, also known as the “Safe Neighborhoods and Schools Act,” which lowered the penalties for many theft crimes when the value of the property taken is $950 or less. In addition, Prop 47 reduced penalties for the possession of drugs such as heroin, cocaine and methamphetamine. DA Reisig explained that as a result of the change in the law, people who are actually caught for such crimes are immediately released by most law enforcement agencies and are only given a ticket to appear in court. Of those cited for such crimes, about 80% fail to appear in court in Yolo County.

Those who actually appear in court and are convicted of such theft and drug crimes are unlikely to actually spend any time in jail because the crimes are mere misdemeanors. This is because the jail is so crowded in Yolo County. Typically, only people convicted of felonies actually serve any jail time. Misdemeanor offenders serve no jail time or only a fraction of the sentences imposed by judges. As a result, the DA explained that the system has become a “turnstile” for certain types of criminals, which he believes has resulted in higher property crime rates, especially as those addicted to drugs often steal to support their habit.

Reisig explained that there is a desperate need for more effective drug treatment programs in California to address the needs of so many of the offenders, but that because of the changes in the law that took away judge’s discretion and downgraded the crimes, there is no effective way to compel people into treatment. He was adamant that the current system is broken and that changes need to be made to give judges and law enforcement more tools to force drug offenders into treatment programs or stay in custody.

The DA described how his office has worked around some of the imperfections in the new laws by charging individuals with felony conspiracy crimes when 2 or more people commit theft crimes together. He explained that this approach allows his office and the courts more tools to address the needs of the offenders and keep the community safe.

The DA also discussed the impacts of another change in the law, which resulted from voters passing Proposition 57 in November of 2016. The law, which was sold to voters as an early incentivized parole system for “non-violent” prisoners has actually been applied to prisoners previously convicted of violent crimes such as robbery and felony assault and resulted in their

early release back into our community. The DA warned that such early prison releases pose risks to our communities and that his office routinely posts the details of such releases and the pictures and names of those offenders on his website at www.

YoloDA.org.

The DA closed out his remarks by providing safety tips to rural residents, including a reminder to use fencing, lights, high definition cameras, dogs and neighborhood watch programs, like NextDoor.com. He also reminded us all to report all suspicious circumstances and crime to the local law enforcement agency in order to make an adequate record for the need for service in the rural community.

The DA encouraged rural residents to contact his office if they needed assistance in tracking the status of a criminal report or case. He explained that while he is not familiar with all of the 8000 plus cases each year reviewed by his staff, he would review any situation brought to his attention and welcomed the calls.

Minimum Wage Increases

That coverage provision might trump some or all of the overtime exemptions in Industrial Welfare Commission Wage Order 14 for irrigators, salaried managers, immediate family members, truck drivers whose hours of service are regulated by federal or California highway safety laws and sheepherders. AB 1066 also directed the Dept. of Industrial Relations to “update” Wage Order 14 to be consistent with the new law, but the DIR has not acted yet.

State Goal to Retire Tractors The California Air Resources Board (ARB) adopted a State Strategy to supplement the San Joaquin Valley’s PM 2.5 State Implementation Plan (SIP) at its board meeting this week.

Included in the State Strategy are two measures of particular interest to farmers in the San Joaquin Valley, and one measure of interest to farmers and ranchers throughout the state.

The State Strategy includes a goal of retiring 12,000 tier 0, tier 1, and tier 2 tractors by 2024 by using financial incentives.

The State Strategy also includes a plan to adopt a rule requiring the replacement of those tractors if the incentive program does not meet the replacement goal.

The State Strategy also includes a measure to create an inspection and maintenance program for heavy-duty vehicles. This concept has been compared to the smog check program for lightduty vehicles. ARB plans to adopt this program in 2020, which is likely to require regular inspection of heavy-duty vehicles to ensure that their engines are continuing to operate at emissions levels at which they were manufactured.

Farm Bureau testified before ARB to request their support for obtaining the funds necessary to incentivize the purchase of tier 4 final tractors to replace tier 0, 1, and 2 tractors. Without significant funding, the incentive program won’t be successful.

Additionally, Farm Bureau asked for consideration of how out-of-state trucks will be handled in an inspection and maintenance program. There is concern that access to out-of-state trucks could be limited under a new program, and livestock producers depend upon many out- of-state trucks to move livestock.

The San Joaquin Valley Air Pollution Control District plans to adopt its portion of the SIP at its November board meeting, with the final adoption of the entire SIP to occur at the January 2019 ARB meeting.

Reports Due Cal/OSHA Emergency Reg for 300A Submissions Bryan Little, Farm Employers Labor Service

On Nov. 6, the California Office of Administrative Law (OAL) approved an emergency regulation by the Division of Occupational Safety and Health (Cal/OSHA) published an emergency regulation requiring all employers with 250 or more employees or employers of 20 to 249 employees in industries deemed

by OSHA to be hazardous like agriculture, construction, and manufacturing to submit information from the employer’s 2017 Cal/OSHA Form 300A by Dec. 31, 2018.

The emergency regulation remains in effect for 180 days unless OAL approves a re-adoption of the emergency regulation for a maximum of 90 additional days; OAL may grant an additional 90-day renewal of the emergency regulation. During the pendency of the emergency regulation, the agency will likely undertake a process to enact a permanent reporting rule.

The approved emergency regulation requires California employers to submit Forms 300A to a secure web-based portal but offers little further information about the submission process and does not specify what the agency intends to do with this information. The agency’s justification for issuing this regulation on an emergency basis rests in part of the position taken by the federal Occupational Safety and Health Administration (OSHA) in April 2018 that California employers covered by injury and illness recordkeeping requirements were required to upload their 300A summaries to the federal agency’s Injury Tracking Application (see, “Fed-OSHA Requires CA Employers to Upload Forms 300A,” from FELS’ website, updated June 28, 2018.) Cal/OSHA says they wish to relieve “confusion” among California employers created by the federal agency’s mandate, though it is unclear whether the new state mandate will supplant the federal mandate. The agency also justifies its emergency action by claiming federal OSHA may withdraw its approval of California’s state plan claiming Cal/OSHA failed to enact reporting requirements that are “substantially similar” to federal requirements as required by federal law.

Credit Card and ATM Card Theft From Daily Democrat article

Card skimmers were found at a Woodland gas station on Wednesday afternoon, according to County Agricultural Commissioner John Young, who also oversees weights and measures.

This is the second case of skimmers being found in Yolo County so far.“For the consumer, the best way to protect themselves is to pay cash or have the clerk inside run their card,” Young added. “ Card skimming is not something Yolo County has typically been affected by in the past, Young said, although it is common throughout the United States. The most common place skimmers are found are inside fuel dispensers (not visible unless machine is open), on top of pumps’ external card readers (visible) and on top of pin pads in the store (visible), according to the Phillips 66 anti-skimming tool kit.

He also explained what happens if criminals do get a hold of card information. “If its an ATM card, thieves will empty your bank account. But if you file a report with bank, they will do an investigation and usually money will be returned eventually,” he said. “If it’s a credit card, the company will usually flag odd transactions and stop all payments on the card.”

If the cardholder did not make the transaction, the bank will proceed to send them a new card — but getting the replacement can take weeks and throw a wrench in any holiday plans, Young said.

November 2018 Update, CFBF Industrial Hemp

The California Department of Food and Agriculture’s Industrial Hemp Advisory Board met on October 30th to discuss items, including: methodology and procedures to amend a list of approved industrial hemp seed cultivars, what constitutes industrial hemp destruction and associated grower responsibilities, sampling procedures, definition of tetrahydrocannabinol (THC), the development of an agricultural pilot program, and recent changes to state and federal law. The Board also heard a proposal to amend the existing list of approved seed to include those specified in SB 1409 (Scott Wilk, R-Antelope Valley). This suggested approved list of cultivars will be discussed in the next Industrial Hemp Advisory Board meeting in the coming months.

Labor

The Division of Occupational Safety and Health at the Department of Industrial Relations (Cal/OSHA) has taken two regulatory actions in recent weeks:

On October 18th, the Division published an emergency regulation requiring all employers with 250 or more employees or employers of 20 to 249 employees in industries deemed

Revisions to Heat Illness Regs Cal/OSHA has also furnished stakeholders a revised draft of the Indoor Heat Illness standard it is required to propose to the Cal/OSHA Standards Board by Jan. 1, pursuant to the requirements of legislation passed by the California Legislature in 2016.

CFBF has expressed concerns about possible conflicts between the existing Heat Illness Prevention Standard for outdoor employees. CFBF has urged the agency to minimize conflicts with the existing regulation by clearly defining indoor worksites as distinct from outdoor worksites, to clearly define the applicability of the new regulation to vehicles, and to provide simple requirements for hazard assessment and abatement. The most recent draft continues to be unclear on these points. CFBF will file comments on the draft by the agency’s Nov. 30 deadline.

The Department of Industrial Relations is in the process of revising Wage Order 14 as required by agricultural overtime legislation passed in 2016. CFBF continues to work with the agency to encourage reasonable language preserving key overtime exemptions wherever possible. The Department indicates they intend to finish the revised Wage Order before the end of 2018 and to implement it through an abbreviated legal process typically used by administrative agencies to comply with legislative mandates.

Pesticides

The Department of Pesticide Regulation will be hosting a public meeting to discuss proposed changes to regulations which would classify chlorpyrifos as a toxic air contaminant (TAC). The listing of this chemical as a TAC may have future impacts on agricultural uses. CFBF staff will be present at this hearing.

Water

The State Water Resources Control Board will consider requiring releases of 30 to 50 percent of water in the Merced, Tuolumne and Stanislaus rivers next week at their board meeting. The water board will consider adopting a resolution amending the Water Quality Control Plan for the San Francisco Bay/Sacramento-San Joaquin Delta Estuary and adopting the Final Substitute Environmental Document this coming Wednesday, November 7th. Farm Bureau has submitted detailed comments opposing the proposal and urging the water board to consider the contributions of nonflow measures and adaptive management towards achieving beneficial uses when considering the water quality control plan or amendments to a plan.

Wildlife

The Department of Fish and Wildlife (DFW) is in the early stages of developing a Mountain Lion Conservation and Management Plan. Mountain Lions are protected in California and take is prohibited except in limited cases of proven depredation or public safety situations. The plan is intended to develop guidance to DFW in establishing a greater understanding of the population of Mountain Lions in the State and their regional distribution. DFW held a meeting with interested stakeholders and Mountain Lion researchers to discuss development of the plan this week. Farm Bureau participated in the meeting and will continue to provide input to DFW as it works to develop the plan.

Nighttime Labor Regs Update A proposal to implement further nighttime labor regulations for the agricultural industry is continuing to make progress. The Division of Occupational Safety and Health, better known as Cal/OSHA, had previously put an advisory committee together to draft language to regulate lighting conditions in agriculture.

While developments from that committee have not been widely publicized in the subsequent years, the regulatory standards are still advancing through the administrative process.

Nighttime Labor Regulations“ The Agricultural Operations that Take Place between Sunset to Sunrise proposed standard is currently in the phase of that process where it gets its fiscal review by the California Department of Finance,” said AgSafe President and CEO Amy Wolfe. “That data gets pulled in with the proposed language and then that’s what gets sent to the Cal/ OSHA Standards Board for review.”

Once reviewed the proposal will be open for comment from stakeholders who will be impacted by the regulations if they are adopted. “We can expect this language and its finance review at the latest, to go to the Standards Board in the first half of 2019. But more likely, the Standards Board will receive it in Q1 of 2019…to then potentially be approved and take effect for our 2020 season,” Wolfe noted.

There appear to be seven key components to the proposed standard, which includes a brightness requirement for individual agriculture employees working at night. “What this standard is saying is 360-degrees around him, there has to be ten-feet of light from him, outward,” said Wolfe. “The other lighting element…is they’ve gone out of their way to make sure that you are specifically lighting and marking your water hazards.”

There are already current illumination standards for all employees. What the new regulatory language is seeking is a more stringent requirement specifically for the agriculture industry. One of the key concerns with the proposed nighttime labor regulations is that the common practice of employees using headlamps will no longer be sufficient. Farmers will also be challenged with arranging adequate lighting equipment that will meet the illumination standard, while also adhering to emissions standards as it pertains to the use of diesel-powered stadium lighting devices.

Taking Inventory of your Farm Equipment Think about how long accumulating your farm equipment took.

And about the money you spent on each piece. If a fire, flood, tornado or other covered disaster strikes your farm or ranch, will you be able to make a list of all of the damaged or destroyed equipment for your insurer?

Be prepared if you have to file an insurance claim. Conduct an equipment inventory so you have a detailed record of each tool, including: • Purchase date and purchase cost. Include receipts.

• Estimated replacement value • Serial or ID number • Model number, brand and year This information helps your insurance company reimburse you fairly and quickly, according to your policy provisions. Many farm management software packages include inventory tools that help make the job easier. But a notebook and a file box of organized receipts can also work.

Whatever you use, store your inventory records in a safe, off-site location, such as a safe deposit box. If your home is damaged, your records could be damaged, too.

Examples of equipment to inventory Be sure to inventory all pieces of equipment essential to your operation, such as: • Tractors, trucks, ATVs • Combines, corn pickers • Backhoes, hay balers, wagons • Disks, cultivators • Seeders and planters • Fertilizer spreaders, sprayers • Milking machines, air compressors • Pumps, irrigation equipment • Post hole diggers, manure spreaders • Mowers, snow throwers, motors Consider marking each piece with a permanent identification number. If your equipment is stolen, an ID number will be useful for law enforcement. Use a metal engraver or stamping tool, and place the number in an inconspicuous spot.

Other ways taking equipment inventory may help. Conducting an annual equipment inventory will also help you: • Determine if equipment may need to be repaired.

• Ensure that your existing equipment is adequately

covered when your policy renews.

• Add new equipment to your policy when it renews.
