No pay for Illinois school superintendents BY BENJAMIN YOUNT Illinois Statehouse News

SPRINGFIELD — Any local school with a new building, new teachers, new bus drivers or even new students may be in danger of missing the first day of school because of the ongoing political fight over paychecks for regional superintendents in Illinois. Because he wanted local communities to bear the costs, Gov. Pat Quinn zeroed-out the state budget line of $11 million intended to pay for Illinois’ 44 regional offices of education. Quinn used his amendatory veto power to strip the money, but the constitutionality of elimi-

nating state funding for the elected regional superintendents is in question. However, local taxpayers have not taken any action, and regional superintendents have been working without pay since July 1. But Madison County Regional Superintendent Bob Daiber said no one can work for free forever. “We have held things together, and we will hold things together until Aug. 3,” said Daiber, president of Illinois Association of Regional Superintendents, which lobbies on behalf of Illinois’ 44 regional superintendents. “We have a meeting Aug. 3 in Springfield. At that meeting, I’m not sure what decision

SPRINGFIELD — Illinois ended fiscal 2010 as the most broke state in the nation. Illinois owed $37.9 billion more than all of its assets combined, including cash, investments and property, as of July 1, 2010, according to a recent statewide financial audit by the Illinois Auditor General William Holland and Illinois Comptroller Judy Baar Topinka. Illinois even shorted unknowing taxpayers of $1.4 billion. An examination of the Income Tax Refund Fund by auditors revealed a $1.4 billion deficit, because the state

The deficit would have been worse without a $3 billion cash infusion of federal stimulus money. Illinois was one of four states with a deficit when comparing all its debts to assets in fiscal 2010, and of those four, it was in a hole of about $10 billion more that its nearest cousin — New Jersey, which ranked second. A combination of mismanagement and a global recession are the largest factors in Illinois monetary woes. Former Gov. Rod Blagojevich, who was convicted on corruption charges in federal court recently, came into office in 2003 during a small recession. He immediately promised he wouldn’t raise taxes, but he and the Legislature did not cut spending, resulting in a fullblown fiscal crisis. “We had a period, maybe three, four or five years, from 2004 to 2007, where we could

have, not solved all our problems, but gotten things under control. But we wasted those years and got deeper and deeper in the hole just because of a lack of discipline,” Fred Giertz, an economist with the Institute of Government and Public Affairs at University of Illinois at Urbana-Champaign. Another reason for the state of Illinois’ financial misery is how it keeps its books, according to the audit. Ralf Seiffe is the director of research at the Institute for Truth in Accounting, a nonprofit that works to make governments provide accurate financial reports, according to its website. “Bad accounting policies and bad budgeting policies are the means and manner by which legislators and the governor get away with essentially spending more than they should,” Seiffe said. The state was faced with a smaller, but similar problem in the early 1990s. Former Gov. Jim Edgar and the General Assembly

were handed a $2 billion deficit and produced a $1.5 billion surplus by 1999 through a tax increase, budget austerity measures and some good fortune in the financial markets. “Edgar was either good or lucky, or both,” Giertz said, adding that a similar combination is needed to pull the state out of its $37.9 billion hole. Bringing the state’s finances in line will be a struggle. Illinois recently instituted what was billed as a temporary income tax increase on individuals and businesses. Money from the tax hike is paying off old bills and making sure new ones are paid on time. Politicians will be faced with a situation where letting the income tax hike expire is unpalatable, because that would require a corresponding $6.8 billion cut to the state’s budget to make up for the lost revenue. Former Dist 209 Superintendent cashes in $100,000 on taxpayers dime District 209 pays out a hefty six figure severance package to former hand picked superintendent who served less than one year. By MARY O’CONNOR

Stan Fields resigned after serving just one year as superintendent of Proviso Township High School District 209 where he was put on a leave of absence, faced with termi-

nation and required by board officials to apologize to the community. Yet, Fields walked away with $100,000 in severance pay. Not 12 months after being hired Fields was suspended from his job during a July 2007 special meeting of the school board, pending the outcome of a termination hearing. The startling decision came with no public discussion from board members. However, it was preceded by a

lengthy deliberation held behind closed doors. Fields offered little insight into why the board slapped him with a 60-day paid administrative leave and said he could not speculate as to whether several recent controversies were behind the decision. Prior to Fields’ leave, his relationship with the school board had undergone a noticeable change. With greater frequency, the board

was voting on contracts and other initiatives that the superintendent refused to recommend. Additionally, Fields began to publicly criticize board members for this behavior, which he said made it increasingly difficult for the district to overcome its poor reputation. children? What is fair for the taxpayers?’ “In these tough economic times, we’ve got to make commonsense, fair decisions. It probably is not going to look like it has in the past. We cannot mirror Wall Street. These are publicly paid individuals.” Emanuel “Chris” Welch, president of the Proviso 209 board, and rumored candidate for the 7th District Representative race, who signed off on Fields’ $100,000 severance, believes boards are wellmeaning and take seriously the hiring of district leaders. An attorney, Welch said severance deals can be less costly than legal battles if superintendents contest or sue. “The termination of a superinten-

dent is not cheap,” he said. “At some point, it’s wise for boards to sit down to talk about all options, and that includes buyouts or resignation agreements.” Early in his tenure as district superintendent, Fields was touted by Welch, the school board president, as being an agent of change who would force the district to begin living within its means. Proviso high schools began the 2006-07 school year with a deficit projection of $14 million. Recent projections put the high schools roughly $7 million in the red, according to financial reports submitted to the board.

Finney strongly believes that big banks are turning their backs on Cook County homeowners. “…If we don’t do something to bring our banks to the table , we are going to lose significant chunks of the city to blight for a generation or more…I will not sit idly while faceless financial service companies undo a lifetime of work on behalf of the people of Cook County,” he said in a press release. Prewinkle said that much like the nation’s economic crisis, foreclosures have also played a “devastating and disproportionate impact on African Americans and Latinos.” The county leader says she is ready to help residents who may be or who are in the process of facing foreclosure. “I’m committed to working with our Cook County elected officials…state officials, delegation in Washington and interested groups to try to move forward in ways that will stabilize our community….I want to help as many people as possible to save their homes,” she said. Justice Theis discussed the lack of legal representation among homeowners who are currently in foreclosure proceedings. She believes more action should be taken to provide these individuals with adequate legal representation. “Many homeowners in foreclosure cases cannot afford to hire a lawyer to represent them. They may not understand the proceedings against them and they don’t know if

lenders have taken shortcuts by false documentation. We need to provide protocols that are uniform and exist throughout the state to deal with the explosion of foreclosures that drive down property values and destabilize neighborhoods.” Additionally, Theis said that the state’s highest court is dedicated to providing justice to all Illinoisans. “The Illinois Supreme Court is committed that every citizen in this state will have access to justice,” she said. Yarbrough discussed the Illinois General Assembly’s role in the foreclosure crisis. As chairman of the Housing committee, she says the legislature is working hard to combat predatory lending. “For the past several years the General Assembly has focused its attention on foreclosure prevention and also to combat predatory lending.

We made good progress in recent years on predatory lending from state chartered banks but because we are limited in the State Capitol with trying to deal with nationally chartered banks we rely on our federal partners,” Yarbrough said. The representative also discussed abandoned properties that are often left behind because of foreclosure. “..The lengthy court process for foreclosure allow many families to stay in their homes for longer periods of time , on the flip side, it has left many communities with hundreds of vacant homes with no one to maintain them,” she said. During a Chicago City Council meeting, also on July 28, an ordinance passed holding banks responsible for maintaining foreclosed-upon properties in neighborhoods across Chicago. “With this ordinance, Chicago is leading

the way in protecting residents, neighborhoods, and communities from the devastating impact of foreclosures,” said Mayor Rahm Emanuel. “I am proud of this strong piece of legislation requiring banks to be good neighbors and maintain the foreclosed-upon properties.” In 2010, the City spent more than $15 million to deal with vacant buildings: the Department of Buildings demolished or boarded up more than 500 buildings at a cost of $13.7 million; the Department of Streets and Sanitation performed general upkeep on 1,963 vacant properties and demolished 345 vacant garages at a cost of $1.8 million, according to figures released from the Mayor’s Press Office. “When vacant buildings are left to deteriorate, local property values tumble and criminality gains an entry into the neighborhood,” said Alderman Pat Dowell (3rd) , who introduced the ordinance. “The landmark piece of legislation passed today will hold banks responsible for the upkeep of vacant properties, keeping them secure and keeping neighborhoods intact.” From going after predatory lenders to being the state’s chief consumer advocate, Illinois Attorney General Lisa Madigan’s office has fought to help those currently in or facing foreclosure. The attorney general’s office urges homeowners to call its Homeowners’ Referral Helpline at (866) 544-7151 to report an abusive mortgage lender or to learn options for avoiding foreclosure.

cated to local schools and local students, but they are also realists, and many have families and financial needs. “As we get into the end of July, first of August, any jobs that might be available, regional superintendents are going to take,” said Donkin. Donkin said closing a regional office leaves local schools with only one option — going to the state for help. And Fox River Grove Consolidated Schools Superintendent Tim Mahaffy said the state hasn’t been much help to local schools recently. “People are asking us questions that we don’t have the answers to. We used to refer them to the (regional office of education), now we refer them to the state…and I don’t know if people are getting their questions answered,” said Mahaffy.

Mary Fergus, a spokeswoman for the Illinois State Board of Education, said the state can answer some questions but little more than that. “We do not have the capacity at the State Board of Education to take on all the responsibilities of the regional offices of education,” said Fergus. Since the state budget was approved in June, lawmakers have been discussing how to find a new funding source. But the Legislature is not scheduled to return to Springfield until late October for the fall veto session. Daiber said schools could operate until late October without a regional superintendent, but a lot of work may not be done or done properly. “You can drive a car without a drivers’ license,” said Daiber. “But you’re not driving legally.”

When a government’s bond rating falls, it’s harder to sell bonds, because investors don’t see them as good investments. Faced with that prospect, Quinn and the Legislature decided to make the state’s contribution with cash for first time in two years, instead of adding to the $13 billion the state owes in pension payment bonds. Additionally, since fiscal 2010, the state has taken the first steps of a long journey to get it on a more solid financial footing. Pension and workers’ compensa-

tion reforms, changes to Medicaid, a slimmer budget and an income tax increase were all passed this winter and spring. What’s needed to turn those baby steps into full strides? “It’s going to take Republicans talking about finding additional revenues. It’s going to take Democrats (finding) ways to talk about making cuts, and I think you’re seeing a form of that here with Quinn and the union. He’s clearly telling them something they don’t want to hear,” Yepsen said. A

s I escorted my three-year old nephew to several fun places in July, I observed the same actions on both outings. He is absolutely crazy about cars even at his young age and will often call out “See my car” as he looks out a vehicle’s window from his car seat. Of course the first thing that would catch his eye at the carnival and arcade center were the car rides. As with all amusement rides they are designed to go around in a

Two lawsuits, one in Illinois Circuit Court and one in the U.S. District Court in Springfield, are pending on this issue. While politicians seem to be moving in the right direction, Yepsen said he is concerned about the speed with which they are doing it. “I just worry that it’s not fast enough. And that what’s going to happen to Illinois is as this recession ends, other states are going to get out the problem quicker than we are. And those states are going to become more attractive to economic growth and development than we are, because we are going to be lagging behind in cleaning up this

So each time my nephew circled around us on a ride we waved to him and he soon caught on after the first two rides and would wave back. After about the fourth ride he was actively looking for a familiar face as he rounded a turn and he was proactive in waving or smiling at his kin folks with the wide grins. At the end of the month when my son treated my nephew to his first Go Cart ride even though it was a new experience he pretty much knew what to expect. As he sat in the passenger seat while my son navigated the course, each time

The audit released Thursday answers that question by simply saying: It’s nearly impossible to tell. However, the state’s mounting debts were contrasted against the state’s assets in this audit. A report by Treasurer Dan Rutherford released in May said the state owes $45 billion in debt through 2036, including interest. Taxpayers owe $140 billion in unfunded pension and retiree health care liabilities, according to the same report.

Just like the amusement rides at some point we can cease to go around in circles no matter how complex the current predicament. There is a way off and a way out. The key during these times is that we can offer that smile of encouragement when we know that someone is going around in circles because we too look for the same as we circle around a major decision or our next move in life.
