PROPOSAL AND BACKGROUND: On June 20, 2019 the Town of Whitecourt received a letter from Woodlands County’s Mayor Ron Govenlock providing notice of the County’s intention to terminate the Tax Revenue Sharing Agreement effective immediately. The agreement was signed in 2010 by both municipalities along with five provincial Ministers (Energy, Finance, Culture & Community Spirit, Housing & Urban Affairs, and Environment), as well as our previous MLA George Vanderburg. The agreement allows our municipalities to work together on future non-residential developments and share tax revenues on projects valued at over $50 million in the pre-determined tax share area. This agreement was provincially recognized as the first of its kind for two municipalities to enter into this type of arrangement; and as a result, the Town of Whitecourt and Woodlands County received the Award of Municipal Excellence. The agreement has become a benchmark throughout the province for intermunicipal collaboration. The transfer of funds was intended to recognize that both the Town and County provide services, facilities and other things that are necessary and desirable to maintain safe and viable communities; and to accomplish this it would be fair and equitable that each municipality share with the other some of the tax revenues collected. Annually, both municipalities transfer the following funds to each other: Whitecourt to Woodlands County $ 85,656 Woodlands County to Whitecourt $114,864 Net Benefit to Whitecourt $ 29,238 The Tax Revenue Sharing Agreement is more than a monetary exchange between municipalities; this agreement is a representation of the relationship between the Town and the County and quite literally allowed our communities to “plan without borders.” The agreement recognizes the unique services each municipality provides to residents, regardless of where people choose to live. Knowing that the County had large tracts of land with water, rail, and highway access, while the Town had urban services and synergies between like-types of businesses, our communities did not compete for development. Through this partnership, we:  worked together to attract any and all types of businesses and locate them where they best belonged (regardless if they were in the Town or the County);  provided investors more options and flexibility for development on an equitable basis;  deferred annexing land or trying to make sites available that didn’t necessary fit with Whitecourt’s existing development. Through this partnership, we take a true regional collaboration approach to planning, which in turn has provided our region with a competitive advantage over other municipalities. Some of the strategies and initiatives that have been developed and undertaken over the years since adoption of the agreement include:  Joint advocacy efforts on important local topics and major trade issues (including health services, caribou range planning, mountain pine beetle, softwood lumber, Bill C-69 and Bill C-48, etc.);

Development of the Business Visitation Program (through this program, representatives have visited over 30 resource based companies within Alberta and internationally, including Chevron, Paramount Resources, Strike Oilfield, Coral Hills, XTO); Promotion of available land for highest and best use. Partnering with area industry on economic diversification strategies (ex. ANC’s Hatch Report). Creation of the joint economic marketing package, brochures, advertisements and profiles to showcase both municipalities. Making joint presentations to site selectors. Hosting joint community tours of both municipalities to major industries looking at investing in the area. Co-hosting of events and participation at major economic development trade shows.

Over the years, Whitecourt and Woodlands County have been recognized multiple times for our economic development efforts. Most notably, we are the only municipalities to be recognized nationally as the Forest Capital of Canada for two years in a row; and are the only municipalities to receive the prestigious Alex Metcalfe Award from Economic Development Alberta three times. The immediate termination of this agreement is of major concern as it could impact decisions of businesses currently contemplating investment in our region. Moving forward with the termination of this agreement could also jeopardize future growth and development opportunities in our region. It would also call to question how Whitecourt proceeds with economic development practices and initiatives currently in place, including the Regional Visitation Program, local business support programming, etc. Most notably, Whitecourt and Woodlands County received joint funding from the Alberta Community Partnership Grant for the Regional Industrial Business Park Feasibility Study; termination of this agreement and the “planning without borders” philosophy would greatly impact the completion and results of this study. BENEFITS/DISADVANTAGES AND OPTIONS: The letter from Woodlands County indicated the termination is based on Section 8(d) of the Agreement that states that: “in the event of an extreme situation which causes significant and material financial hardship on a party, as determined by the affected party, such lesser written notice that in all the circumstances is reasonable”. The letter provides no basis to support the existence of such a significant and material hardship so as to constitute an “extreme situation”, beyond referring to “financial constraints that Woodlands County has experienced in the last several years.” To date, Whitecourt has not received any financial information to support the County’s position and has no basis for accepting this termination based on Clause 8(d) of the agreement. As the reason provided does not warrant termination, and no substantive evidence has been provided by the County, Council may wish to reject the termination and/or request the information or reconsider its position.

COST AND SOURCE OF FUNDING: It is unclear how the County intends on handling 2019 funding allocation; however, as the letter was received after the 2019 final budget was approved, it would be implied that this notice would impact 2020 and future budgets. COMMENTS: This agreement encompasses the philosophy behind our municipal relationship; it is the foundation for how we promote ourselves provincially, nationally and internationally, and the basis for how we develop economic development strategies and activities. Termination of this agreement calls to question the foundation of our intermunicipal collaborative and cooperative efforts for the future. RECOMMENDATION: That Council provide direction to Administration on how to proceed with the notice of termination to the Tax Revenue Sharing Agreement dated June 20, 2019 from Woodlands County. Policy 41-006 Rural Utility Services Schedule “A” Rural Utility Connection Standards 1. The Town of Whitecourt will provide water and sewer services to customers beyond the municipal boundary provided the customers within Town are not disadvantaged by the service and are treated equitably. All installations shall include both water and sanitary sewer. 2. Customers may include Woodlands County, the Province of Alberta, individuals, corporate entities, or other organizations. 3. Any prospective Customer shall provide the Town written approval from Woodlands County for the Town to provide utility service within the County. If more than one property will be served by the utility extension, the County shall be the Customer, and enter into an Inter-Municipal Services Agreement for the services provided. 4. The Customer is required to extend the Town’s main system from the end of the existing system to the municipal boundary at his own cost. a. Main extension shall be of the same or greater size than the existing Town main being extended. b. Work shall be done to Town standards. c. Engineering and all approvals are the responsibility of the customer. d. A fire hydrant and meter chamber shall be installed at the end of the Town system, with vehicle access provided to this point. e. The Town will own and maintain the extension to the Town system, as located within the Town. f. If customers within the Town connect to the main extension provided by the Customer, the Town may seek a contribution at the time of connection and provide this contribution to the Customer. 5. The point of service shall be the Town boundary. 6. The Customer is required to obtain all approvals, install, maintain, and operate all components beyond the point of service. 7. The Customer will retain ownership of the system beyond the point of service. 8. All consumption shall be metered, and charged per Policy 13-002 Fees Policy Schedule “A” Fees Schedule.” 9. The customer shall purchase a water meter from the Town:

The service line is pressure tested annually, with the results provided to the Town, and; ii. An agreed surcharge for out of town meter reading is paid or a remote readout is provided at the point of service. 10. Payments for utility charges shall be made by the Customer as noted on the utility bill. a. Failure to pay a utility account will result in termination of services at the service point. b. Reconnection charges and arrears shall be paid prior to service being reestablished. 11. The Customer shall pay the Town a contribution for treatment and trunk facilities at twice the rate established in Policy 13-002 – Fees Policy for in-town Off Site Levies or as per the Fee Rate established within the service agreement. 12. All fixtures installed on the customer’s site shall be of a low consumption nature, and comply with the Town’s Utilities Bylaw a. The Customer shall provide the Town with an inspection report by a Plumbing Safety Codes Officer certifying that all fixtures comply with this requirement within thirty days of any installation.

Background

The Town of Whitecourt (the Town) is a growing, dynamic community of 10,574 residents (2013 Municipal Census), with a surrounding population of approximately 4,300 people. Whitecourt is the largest urban centre in Alberta between Edmonton and Grande Prairie. The Town has projected a 25 year population growth of 1.82% (as per the 2015 Municipal Development Plan), resulting in a projected total population of 17,208 by the year 2040. To accommodate and facilitate future growth, a number of infrastructure and land use planning initiatives have been undertaken. These initiatives have identified, quantified, and laid out the key transportation networks, potable water supply facilities, and sanitary sewer services required to service the future industrial, commercial and residential developments. While most of the development will be initiated and undertaken by the private sector, the Town provides overall coordination for these developments. Much of this coordination activity is directed to help ensure that the transportation and utility services required by development in the Town is constructed and available when required. To cover the costs of the infrastructure required for new development, the Town has implemented and managed an Off-Site Levy Bylaw (OSL), which was last updated in 2008. The collection and use of OSLs helps ensure that the Town has the appropriate funds for the construction of new water, sanitary and transportation facilities required for future development. The funds allow for infrastructure to be constructed in a timely manner, while meeting the Town’s objective of development paying the cost of development.

Infrastructure Improvements

1.1

Under the Municipal Government Act (MGA), the Town is permitted to impose off-site levy charges to recover the cost of infrastructure projects. The OSL is intended to recover all or part of the capital cost of the following: • • • •

New or expanded facilities for the storage, transmission, treatment or supplying of water; New or expanded facilities for treatment, movement and disposal of sanitary sewage; New or expanded roads required for, or impacted by, a proposed development or subdivision; and Land required for, or in connection with, any facilities described above.

Alberta Bill 21 was passed in December 2016 which amended the MGA to allow municipalities to also collect OSLs for recreation facilities, fire halls, police stations, and libraries. The Town has not included these facilities in the current or proposed OSL project list.

1.2

Introduction

Opus Stewart Weir has been engaged by the Town of Whitecourt to update and review the rates of the OSL. With the help of Town staff, OPUS undertook a review of the off-site infrastructure requirements and associated costs. Using reports from AECOM and Stantec, the Town developed cost estimates for this review. These included estimates for water treatment plant capacity upgrades, waste water treatment plant capacity upgrades, headworks and bio-solids handling/disposal upgrades, and

roadway infrastructure. All estimates included engineering and contingency. The Town also supplied the proposed development area to be included in the OSL. This report outlines the results of the review and updating of the levies to 2017. This 2017 review includes revisions to the OSL calculation methodology.

Methodology

The Town of Whitecourt collects OSLs for projects that are required for growth, and that benefit the community as a whole. These projects include water/wastewater treatment plant capacity upgrades, widening of arterial roadways, and arterial traffic signals. Projects that benefit only a portion of the community (i.e. lift stations or local roadways) are negotiated with Developers as site specific costs/requirements at the time of subdivision and/or development and are not funded through OSLs. To complete this OSL review, the Town has undertaken various studies and planning exercises to understand the water, wastewater, and road projects and costs anticipated to be required to accommodate the Town’s growth over the next 25 years. These projects and associated costs will be discussed further in Section 3.

2.1

Off-Site Levy Development Lands

The Town has identified projected development areas for the next 25 years. Figure 1 classifies this land into industrial, commercial, and residential areas. The anticipated development areas are shown as orange for industrial growth, green for commercial growth, and yellow for residential growth. The total area of land forecasted for development in this off-site levy review is 397.49 ha. Approximately 161.16 ha is anticipated to be residential development, with the remainder for non-residential development.

2.2 Financial Assumptions For this review, costs were determined based on the previously mentioned construction cost estimates. Amounts currently in off-site levy reserves as well as any off-site levy funds previously paid towards these projects were then deducted from these estimates to determine the final amounts required to be collected from OSLs. The OSL project costs have been based on estimates that are current as of the date of this bylaw review. It is recognized, however, that construction costs fluctuate and will result in different project costs in the year of actual construction. To help mitigate these changes, and as required by the 2016 Municipal Governance Act, the off-site levies and costs will be reviewed and an updated report submitted to Council annually. The annual report is to include: • • • •

Projects constructed during the previous calendar year, and their final costs; Updated construction cost estimates for projects yet to be constructed and an explanation of adjustments, including any unrecorded grants or other sources of funding received for the projects; Amount collected in Off-Site Levy Fees in the previous calendar year; Specifics of the total value of Off-Site Levy Fees being held by the Town of Whitecourt to December 31 of the previous calendar year, interest earned and commitments for future expenditures of such monies; and Updated Off-Site Levy Rate Schedules.

The Town has committed to a review of the Bylaw every five years. At that time, the updated projects, population, dwelling unit and land development projections for the upcoming 25 years; and updated residential/non-residential and redevelopment rates based on the building permit information will be incorporated.

2.3 Levy Calculation The total amount required from off-site levies to sustain growth over the next 25 years was equally divided over the projected land development area. As such, the cost of these improvements are spread uniformly across the development area so that all parties are assessed on the basis of a uniform rate, often referred to as a “postage stamp rate.” In this manner, all developable lands share equally in the cost of the improvements.

2.4 Levy Application The off-site levies are still proposed to be collected at the time of development permit. Residential projects will continue to be charged on a per dwelling unit basis. One change, however, is that nonresidential developments are proposed to be charged based on land area rather than building footprint. This is primarily due to legislative requirements only allowing the municipality to collect OSLs once per property. The residential redevelopment rate, based on building permit applications, has also been included in the calculations for this reason.

2.5

Residential Growth Assumptions

As with the current levy, the costs for residential development were further broken down from the calculated per hectare rate and distributed across the projected dwelling unit developments. Residential development has been divided into two types for the purposes of the OSL: • •

Average Volume Developments includes single family homes, manufactured homes, duplex, triplex, and fourplex developments, but excludes row housing Higher Volume Developments includes any development with 5 or more units, including row-housing

Based on 2013 census information and the 2015 Municipal Development Plan projected growth rate of 1.82% and average of 2.6 people per dwelling unit, the Town anticipates that 2325 new dwelling units will be created by 2040 to meet the population growth (see Table 5 in Appendix A). Using development permit data collected between 2006-2015, the Town anticipates that 75% of the new dwelling units, or about 1,744 units, will be average volume development. The remaining 25% is anticipated to be higher volume developments, or about 581 units. This data also indicated that 3.6% of the average volume development permits were redevelopments (i.e. there was a previous structure on the property) and 22% of the higher volume developments were redevelopments. With these ratios, this leaves 1,681 average volume developments and 453 higher volume developments projected dwelling units from which to collect the required OSLs from within this study window.

The WTP now has a capacity of 15 000 m3/day and is expandable to 18 000 m3/day. Based on current consumption rates, it is estimated to serve a population of 19,000. Based on growth projections, the Town’s population will not reach this threshold within the 25 year timeframe of this review. Therefore, no new capital upgrades/projects have been included in the off-site levy project list. The Town also provides water services to rural areas within Woodlands County. Rural counterparts pay a fixed fee for water that encompasses future capacity for their needs and is therefore not included in the off-site levy amounts.

3.2 Wastewater There are two projects included in the OSL calculation under the wastewater category. Project S1 included a capacity upgrade in 2000, and project S2 involves future headworks upgrade and bio-solids handling and disposal.

3.2.1

S1 Wastewater Treatment Plant Capacity Upgrades

In 2000, the Town undertook a Wastewater Treatment Plant (WWTP) capacity upgrade to accommodate growth with a total actual construction cost of $ 3,117,447. The Town received grant funding in the amount of $904,605, and contributed $509,121 from existing off-site levy reserves. This project (S1) benefits all of the new lands equally and the remaining amount is to be recovered from OSLs uniformly across the developable lands. This data can be seen further in Table 3 in Appendix A and is summarized in Table B below.

3.2.2

S2 Wastewater Treatment Plant Headworks and Bio-solids Handling and Disposal

In 2016, the Town of Whitecourt commissioned Stantec Consulting Ltd. to provide a master plan study of the Town’s Wastewater Treatment Plant (WWTP). According to Stantec’s report, the WWTP requires upgrades to meet future treatment needs over the next 40 years. The master plan study recommends the following projects: • •

Headworks upgrade: Includes fine screens, grit removal, and grit washing equipment. (Estimated cost is $5,300,000) Bio-solids handling and disposal: Involves replacing the ponds with a mechanical dewatering system. (Estimated cost is $2,500,000)

A secondary treatment expansion and upgrade was also proposed as part of the Stantec report, however is not anticipated to be required within the 25 year window of this review and is therefore not included in the project list.

tracks. As this roadway was required for future growth and the rail crossing was outside of the scope of what would normally be required from a developer it is funded 100% from off-site levies. The Town has since identified several new arterial roadways (R7-R11) that will be required to accommodate future growth within the municipality over the next 25 years. Roadway cost estimates were reviewed by AECOM in 2013 and confirmed by municipal staff this year. These new estimates calculate the cost to widen a 2-lane road to a 4-lane arterial to be 9.33% of the total project cost. One project of note is the completion of 33rd Street (project R8). This project is only proposed as a 2lane roadway within the 25 year review timeline. Per the above mentioned theory, a developer would usually be required to install the roadway to a 2-lane standard at his/her own cost. Approximately 40% of this roadway, however, traverses a steep escarpment where development will not occur. Therefore 40% of this project is proposed to be fully funded by off-site levies as the roadway is needed for future development, however cannot be imposed on a specific development.

OFF-SITE LEVY REVIEW: 2018 REPORT

Introduction This report is an annual update on the status of off-site levies (OSLs). This yearly update is not intended to reevaluate any of the methodology that the OSL is based on. Rather, it provides an update on the financial details and status of projects that contribute to the OSL. Complete details of the OSL calculations and methodology can be found in the Off-Site Levy Rates Review by Opus, 2017. This yearly update is required by Provincial legislation and OSL Bylaw 1532.

Projects Completed in 2017 As this is the first annual report since the adoption of Bylaw 1532, projects from both 2016 and 2017 are being included. Projects are intended to be constructed when a certain population threshold is met (threshold is project specific). Off-site levies for arterial roads are based on the cost to widen the road from 2-lanes to 4-lanes. Based on the Off-Site Levy Rates Review by Opus in 2017 it was determined that this cost difference equates to 9.33% when the road is constructed as 4-lanes initially (i.e. is not built to 2-lanes originally and then widened to 4-lanes at a future time). As the majority of the Mink Creek Road project was constructed prior to the adoption of Bylaw 1532, the amount of OSLs applied to that project were based off of Bylaw 1435 in effect at the time of construction. Bylaw 1435 calculated the OSL amount for Mink Creek Road at 16.7% of the overall project cost. Actual projects costs have been close to estimates. The cost estimate for McIlwaine Drive was $1,340,883.00 to complete 0.43 km of road; in actuality 0.54 km of road was completed at a cost of $1,347,774.11. The accuracy of this estimate raises our confidence in the rest of cost estimates used to calculate the OSLs.

Construction Cost Estimates Construction costs from the first 5 months of 2018 are very similar to those seen in 2017, thus it was determined that increasing by the Consumer Price Index (CPI) would be the best way to update the costs for this annual review. From April 2017 to April 2018 Statistics Canada tracked an overall price increase of 2.3% for the Province of Alberta. This increase can be seen in column 10: “2018 CPI increase 2.3%” of the updated Project List located in Appendix “A”. Appendix “A” includes all of the projects that are being paid for with OSLs as determined by the Municipal Government Act and Bylaw 1532. Estimated future project costs have been updated with the 2018 CPI of 2.3%. The Mink Creek Road and McIlwaine Drive projects (project numbers R10 and R11 in Appendix “A”) have been updated to reflect the actual length of road constructed, and the future remaining lengths to be built. Projects that have already been constructed but the costs are still being recovered from OSLs remain on the list. As these projects are already completed, the construction costs reflect the actual cost of construction of those projects.

Financial Details This chart breaks down the specific details of OSLs being held by the Town. The second column shows the OSL funds that were collected in 2017; the third column shows the interest earned on all of the OSLs held by the Town; and the forth column shows the balances being held as of December 31, 2017. OSLs are typically collected at the development permit stage in Whitecourt. Under this annual review, there has been a small change in the OSL percentage breakdown. Water increased from 7% to 8% of the total OSL, wastewater decreased from 42% to 41%, and transportation remained steady at 51% of the total OSL costs. Updated Rate Schedules The proposed updated OSL rates for 2019 based on this annual review can be seen on the chart below. The total cost of all of the OSL projects, as detailed in Appendix “A,” are divided across the total land area expected to be developed to provide an OSL rate per hectare. For residential properties, this figure is then calculated into a per unit rate based on the anticipated number of new dwelling units. The anticipated development land areas, population projections and forecasted dwelling units were not updated as part of this yearly review. These calculations will be re-examined at the 5 year major update. OSL rates for 2019 as calculated will remain very close to the 2018 rates. No new projects have been added as part of this annual review and construction costs for projects completed came in very close to estimated amounts. We share the concerns of Woodlands County residents and businesses in respect of the Town’s notice to terminate services under the 2013 Agreement. Council carefully considered the Town’s offer to withdraw that notice on the condition that Woodlands County agree to continue being bound by the 2013 Water and Wastewater Agreement. We are most grateful for the recognition in your letter that “it was never the intention of the Town to leave the County with no other source of water as now appears could be the case”, which we understand reflects your assurance that there will be no termination of the public utility services provided under the existing agreement. Thank you for that assurance. Woodlands County Council believes that a fair and transparent process with an independent arbitrator will assist the Town and the County in reaching terms that are sustainable and that accord with public utility and municipal government legislation and achieve fair results for both municipalities. We look forward to working with your municipality on the ICF through arbitration and thank you again for the generous assurance regarding the continuation of water and wastewater services while that process proceeds to resolution. The increase is due to adding an estimated market deflation of 2.6% (assessor’s estimate for all classes) to the 2018 tax rate to maintain 2018 tax burden and the addition of 3.07% for the impact of the interim budget. Changes to the non-residential tax rate will be finalized once we receive the breakdown of the 2019 assessment numbers.

The purpose of the bylaw once passed will be to enable Woodlands County to set a mill rate that will tax a small business property in Woodlands County at a rate that these properties pay an equivalent amount of taxes as their business counterparts within the Town of Whitecourt. At the present time small business properties in Woodlands County pay more in taxes than their counterpart businesses located within Town limits. The desired outcome is to create an even playing field and create a complimentary tax structure in the region. Prior to second and third reading of the bylaw which is scheduled for January 15, 2019 the administration has been requested by Council to provide an estimated calculation of what the 2019 nonresidential tax rate will be for the Town of Whitecourt. Using a similarly assessed property in Woodlands County our administration will be able to calculate what mill rate we will need to establish and what the potential impact will be on the reduction in taxes the County would generate. Your assistance in helping us understand what the estimated projected nonresidential mill rate in 2019 for small businesses in the Town of Whitecourt would be greatly appreciated and assist us in preparing the information that has been requested by our Council as they consider second and third reading to Bylaw 515/18.
