2 WHAT'S DOING IN WATERBURY

Another year is upon us, and we face it with the uncertainty, the likes of which most of us probably don’t remember in our lifetimes. But as Yidden, we do what is embedded in our DNA and we continue to move forward with vigor and positivity. And in Waterbury, it’s a mood that is easy to fall into, because the atmosphere is charged with the excitement of a new school year, a new Zman and of course the upcoming Yamim Tovim. With sixteen new families having moved in over the summer, and four new families in Naugatuck, the greater community is full of new faces, and bursting with new talent and energy. It’s hard to believe that we no longer all know the names of every student in Yeshiva K’tana! But we hope that trend continues along with the growth of many new community businesses, whose ads grace the pages of this issue. So, shop local! It’s one easy way to help support the community and assist in its expansion just by shopping for items which you need anyway! And speaking of expansion, we hope you love our brandnew format and as always, we would love to hear your feedback. Withing the entire community a K’siva V’chasimah Tovah and a Gut G’bentched Year for all of Klal Yisroel.

My 4-year-old daughter said to me one day as she ate an apple, “Mommy, can we take the seeds and plant them in the ground now so I can have an apple tree tomorrow?” S.R.

My daughter was looking through a cookbook and saw a recipe she liked. She exclaimed, "Oh, this looks so good." My three-year-old son pipes up, "You mean it looks heaven." L.S.

I was acting out Tashlich to my class one day and I wanted to see if anyone would remember what it was called. One of my students enthusiastically raised her hand and said, “It’s called Baal Tashchis!” T.H.

My kids were watching the hatzala-thon, and enjoyed reading the names of the families that were donating. After awhile they told me that there is one family that must be really rich because they keep on donating tons of money. Curious, I asked them what the name of the family was. They replied, "Anonymous." :-) L.S. I was amazed to see my nursey kids playing a very interesting game – taking each other’s temperature on each other’s foreheads! R.G.

SPOTLIGHTON... Expansion at Avalon Circle What started out as a small enclave of a few families has blossomed into a beautiful new area – under the leadership of Rabbi Azi Gendelman – just a few short blocks from Waterbury’s main hub. With over 20 families and more families on the lookout for homes, there is a tangible atmosphere of growth and excitement. The shul members describe the shul as, ‘welcoming’, ‘accepting’, ‘a place where you can connect to Hashem’, ‘vibrant with friendships’. This is a warm and welcoming group of families where people feel accepted and nourished through the Torah and ruchniyus that is the hallmark of the community. Rabbi Gendelman says that the goal is to grow, and to keep growing; and with minyanim seven days a week, and weekly shiurim, the Avalon shul is definitely on the right path. On Shabbos, Rabbi Gendelman gives a shiur as well as a rotation of men who speak at the weekly hot kiddush. There is also a weekly shiur for women given in one of the neighborhood homes, a Tehillim group on Friday nights after licht bentching in rotating houses, and learning groups for the boys run by Rabbi Willner – a sixth grade Rebbe in Yeshiva K’tana – and a daily early morning Kollel. But that’s not all! A night seder program, a mishmar program and a new otzar hesefarim are all in the works, and with the enthusiasm that every shul member generates, these programs are sure to be a success. Rabbi Gendelman is also happy to announce that after some recent construction and renovation, the shul now has a small simcha hall that accommodates up to 40 people. It is with great excitement that our Mesivta welcomes the new 10th grade Rebbi, Rabbi Zvi Dana. Rabbi Dana has already created a name for himself as a mechanech who is able to connect with bochurim and inspire them to achievements in learning and avodas Hashem. He is committed to nurturing his talmidim to grow in their learning while also providing them the tools and foundation to develop into refined B'nai Torah in every sense of the word. He looks forward to cultivating a warm and lasting relationship with his talmidim and we are so excited he has joined our staff.

NAUGATUCK CAMPUS UPGRADES Computer Lab This year's 11th grade curriculum will include a course in computers. A state of the art computer lab, housing eighteen computer stations, has been constructed . Dining Room Due to the incredible growth of the Mesivta, we have expanded our dining facilities. The dining room and prep kitchen have been relocated to the basement and the bochrim are enjoying their new spacious facilities. Dormitory With the new incoming 9th grade class, which includes 12 bochurim from out-of-town, we are expanding the dorms to accommodate this amazing growth. Exercise Room A new exciting development for this year is an exercise room adjacent to the dining room. This gives the bochurim a chance to use their free time on Friday afternoons and Sundays in a productive and healthy manner.

We have packets from ATIME to ease the pain when experiencing pregnancy loss.

 Bikur Cholim Meals

Bikur Cholim assists families with short term meal assistance. The meals are prepared fresh daily and are provided by community volunteers. Simply call to arrange meals.

 Shabbos Box

When a patient needs to remain in a hospital without a kosher pantry, we deliver a box of Shabbos essentials to provide Oneg Shabbos. It includes grape juice, bechers, matzah, tissues, Shabbos paper goods and cutlery, Shabbos Siddur and Chumash, etc.

 Transportation

Rides can be arranged for medical needs to and from the hospital or other out-patient services.

 Emergency Childcare

We maintain a Chessed Program with select volunteers who are trained to assist with emergencies and special circumstances.

ARE APPEALS A “DO-OVER”? BY: RAPHAEL DEUTSCH, ESQ.

In this season of forgiveness and second chances, it seems an opportune time to clear up a misconception that many have with the “appeal,” an important process in the American legal system. Often we’ll hear about the outcome of a lawsuit which invariably contains a winner and a loser, but not to worry, the loser plans to appeal.

Appeals in either civil or criminal cases are usually based on arguments that there were errors in the trial’s procedure or errors in the judge's interpretation of the law. There must be a legal basis for the appeal – a significant mistake of law in the trial, not just the fact that the losing party didn’t like the verdict.

Is an appeal just a second chance? Is it a “do-over”? Granted, a “do-over”is a well-established process in elementary school playgrounds worldwide, but how can a “do-over” be allowed in life and death criminal cases and multi-billion dollar verdicts?

In fact, most appellate courts rarely reverse lower court decisions. The vast majority of appellate court decisions at the federal and state levels affirm the decision being appealed. One would correctly guess the outcome of 92% of recent federal appeals by always predicting the court to affirm.

The truth is that an appeal is not a “do-over.” An appeal is not a retrial or a new trial of the case. The appeals courts do not usually consider new witnesses or new evidence.

Obviously this in contrast to the appeal we make in a spiritual sense at this time of year, in which our Judge encourages us and seeks to reverse our judgments with any and all means.

PROTECTING PACKAGE DELIVERIES With online shopping creating a busy time for package deliveries, keep in mind there can be more foot traffic throughout all neighborhoods. That does not mean all foot traffic is going to result in criminal activity, rather a time where we need to continue to be vigilant towards crime prevention. Here’s How You Can Help Protect Package Deliveries: · Track all of your package deliveries online. · Set up delivery times with your carrier to deliver packages when someone is home. · Have packages delivered to an alternate address, such as work, a friend or family members house that will be home for delivery. · Going away? Contact local carriers including the US Postal Service to hold deliveries while you are away or ask your shipping carrier to hold the package at their facility for you to pick up. · Request a signature confirmation of delivery and arrange to be there to sign for the package. This is especially useful to consider for expensive, desirable or irreplaceable items. · Insure valuable items being shipped. · Install security cameras if possible. · Always report suspicious activity and thefts to the Police Department. In crime prevention we focus on reducing the opportunity for a would be criminal. We can do this by ensuring that ALL doors are locked (vehicle, sheds, houses), no keys to vehicles left inside of vehicles or unsecured, setting alarms or having cameras turned on/charged and reporting suspicious activity to the Police Department immediately.
