Proviso Township High Schools District 209 officials recently issued a response to an article published last week about a court ruling related to a former vendor with the district.

Village Free Press previously reported that an Illinois Appellate Court ruled earlier this year that the district has to pay the roughly $1.4 million it owes Restore Construction Company for emergency repairs that took place after a fire broke out at Proviso East High School in 2014.

The appellate court’s decision reversed a 2017 decision by the Circuit Court of Cook County, which dismissed a lawsuit Restore had filed in order to secure the balance.

In November, the Village of Forest Park entered into an intergovernmental agreement with the Chicago Transit Authority (CTA), through which Forest Park police officers will provide services on CTA property, including platforms, trains and other CTA locations within the village.

The project is known as the CTA Special Detail and, according to the agreement, provides provisions for “the use of sworn, off-duty, full time PD officers as security personnel.”

The CTA will provide $95,000 per year to the Forest Park police department to pay officers for their time, and officers must voluntarily choose to work these extra hours. They can participate in the CTA Special Detail when they are on furlough, a regular day off, a day off due to holiday or on personal time.

The collaborative agreement comes out of a desire for more security at Forest Park CTA stops. As the agreement states, “the security of CTA passengers, employees and property is a matter of public concern, and the provision of such security is in the public interest.”

The duties of the Forest Park police department include assigning voluntary officers on a daily basis to CTA property within the village; facilitating the employment of the officers by accepting requests of those who wish to participate and maintaining a roster of these individuals; maintaining weekly employment schedules, as well as keep records of CTA incidents, including crimes and arrests, that involve Forest Park police officers; and to conduct meetings with CTA representatives on a regular basis.

Forest Park Police Chief Tom Aftanas believes this arrangement will help cut

down on crime.

“We are called multiple times a day to the CTA stops in town,” said Aftanas in an email. “Participating in this security detail with the CTA ensures that a police officer is solely assigned to patrol CTA property for up to eight hours a day. This gives us increased visibility at the CTA stations in the hopes of reducing graffiti and tagging of the rail cars as well as the common nuisance offenses such as soliciting and intoxicated/disorderly riders. The ultimate goal is to create a safer environment for CTA customers as well as CTA employees.”

The agreement was approved unanimously by Mayor Rory Hoskins and all four Forest Park commissioners – Jessica Voogd, Ryan Nero, Joe Byrnes and Dan Novak – at a village council meeting on Nov. 12.

Triton to offer free certificate program for in-demand jobs College gets $1M from Illinois Community College Board to train minorities in high-demand careers

A new career training program at Triton College will give Proviso Township residents the opportunity to earn a professional certificate from the college at no cost to them, thanks to a $1 million grant the college received a few months ago that’s designed to boost the number of minorities who are represented in high-demand fields.

The free certificate program will last for nine months and offer between 12 and 18 credit hours in a variety of areas, including

Moreno stated the “factual disputes involved in the litigation, including if money is owed, were never addressed by the parties because the Circuit Court determined that Restore’s case was legally deficient. If the matter is eventually remanded to the Circuit Court, then the Circuit Court will determine if Restore is entitled to any more money and, if so, how much. This process has not occurred.”

The two-alarm fire on May 10, 2014 broke out in the second-floor social room at the high school, with smoke spreading to the third-floor chemistry labs. Roughly two weeks later, on May 22, former D209 Supt.

Nettie Collins-Hart signed two contracts on behalf of the district — one with “Restore Restoration to mitigate and remediate fire damage and the other with Restore Construction to repair the fire-damaged school. The agreement did not go through the typical competitive bidding process,” according to the appellate court opinion.

On Aug. 12, 2014, former D209 school board president Dan Adams signed an amended agreement with Restore Construction for emergency repairs, but that amended agreement was never presented to the full school board for approval and a vote.

Audrey Jonas, Triton’s director of public affairs and community relations, said during a Nov. 25 regular meeting of the Maywood Board of Trustees that the Workforce Equity

Based on the agreement, Restore performed “emergency mitigation and repairs” valued at $6.9 million, with total work valued at $7.3 million. By February 2015, Legat, the district’s architectural firm, had certified that Restore had completed $5.8 million worth of work, which was paid through the district’s insurance policy.

Village Free Press previously reported that by 2015, the board had stopped paying on the total due and owed $1.4 million. The D209 school board has argued that they don’t have to pay the remainder, because the contract was never valid in the first place.

In her statement Moreno explained that while Restore claims that it’s owed an additional $1.4 million, “District 209’s insurance carrier has already concluded that Restore was paid full value for the work and is not entitled to any money. … It must be understood and clear that the Board never stopped paying anything for the fire loss. It never made any payments for the fire loss since the matter was covered by the District’s insurance policy.”

As this paper previously reported, Restore filed a lawsuit in Circuit Court on October 2015, but that lawsuit was dismissed a year later. The company then appealed the decision.

According to a summary of the case by attorneys with the labor law firm Franczek P.C., which doesn’t represent either side, Restore “sought payment for what it was owed based on equitable principles, not the existence of a valid contract. The Appellate

Initiative Grant was made possible through the Illinois Community College Board and legislation sponsored by the Illinois Legislative Black Caucus.

The caucus was responsible for appropriating a total of $18.7 million in fiscal year 2020 for the equity grants. All 48 community colleges in Illinois were encouraged to apply. The grant is designed to increase the numbers of minorities, particularly African Americans, in “indemand, well-paying jobs in a variety of fields,” Jonas said.

According to the Illinois Community College Underrepresented Report, which evaluates the degree of access to educational opportunities and diversity among community colleges in the state, African Americans accounted for only 12 percent of Career and Technical Education (CTE) program graduates in the state in fiscal year 2017. Minorities, in general, accounted for 34 percent of CTE program graduates that fiscal year.

“This is not an associate degree, but job training,” Jonas said. “Our goal is to close the skills gap in communities of need in the

local workforce.”

The Black Caucus does have one major requirement for community colleges that take the equity grant money — at least 60 percent of the program participants have to be African American.

“They want to make sure that this job training goes toward African Americans in our community district,” Jonas said.

The program starts Jan. 21, 2020, she said, adding that the “idea is to have students graduated by the end of the year in 2020.”

There are roughly 160 seats that will be available in the program, Jonas said.

Jamila Thomas, a Maywood native who is the founder of Community Support Alliance, a Hillside-based nonprofit that’s focused on nonprofit development, said that she agreed to host an informational meeting at her offices for the grant program because she wants to ensure that as many people in her hometown take advantage of the opportunity.

“Anything I can do to help and give back to the community I came from, that’s what I will do,” Thomas said.

Court held that even though there was no valid contract in place, it would be unjust to allow the school district to retain the company’s services without paying the reasonable value for them. Thus, a contract implied in law could be enforced against the school district.”

Franzcek P.C. attorneys stated on Nov. 5 that the Illinois Supreme Court “has agreed to review the case, so it remains to be seen if the decision will stand,” adding that the state Supreme Court’s decision could affect other districts across Illinois that have “avoided

liability for work performed by construction companies under invalid contracts.”

Moreno said that “while the District respects the decision of the Illinois Appellate Court, it believes that it was wrong which is why it decided to ask the Supreme Court to review the case,” adding that the high court’s discretionary review is allowed “in less than 2% of civil cases filed in Illinois Supreme Court.”

Pritzker talks next phases of marijuana legalization Governor signs bill tightening language on conflict of interest, public use, expungement

SPRINGFIELD – One month before the scheduled rollout of legalized marijuana in Illinois, Gov. J.B. Pritzker signed a followup bill to the initial reform on Dec. 4 and took questions about the next phases of the implementation.

“It’s new territory, we’re seeing that in some of the cleanup that we’re doing in this bill,” said Sen. Heather Steans, D-Chicago, who sponsored the initial marijuana legalization measure.

Steans said the bill clarifies that public consumption of marijuana can be done in only a licensed dispensary or a retail tobacco shop. This will be allowed only if a local government authorizes it on the premises.

“They can only be in those two kinds of locations,” she said.

It also requires that individuals who have their records automatically expunged are notified when the process takes place.

Medical cannabis patients aged 18 to 21 will now have full access to cannabis products, including combustible marijuana.

The bill also clarifies a “revolving door” provision of the initial law by prohibiting future members of the General Assembly and their families from having a direct financial ownership interest in a cannabis business until two years after that lawmaker leaves public office.

She said the bill moves up to July, from September, the earliest date municipalities and county governments can begin collecting taxes resulting from marijuana sales.

Steans said while the follow-up measure, referred to as a trailer bill, was mainly about technical changes, more substantial changes could happen in the future.

“We did not want to go back and revisit policy at this point in time,” she said. “We know we may do that going forward but we

The lawmakers and stakeholders at the event emphasized that legalization is centered on racial equity and righting the wrongs of a decades-long war on drugs.

“Illinois’ historic cannabis law puts social equity above all else, and the result will be a market unlike that in any state in the nation – one that rights the wrongs of the past by offering new opportunity to communities that have been torn apart,” said Esther Franco-Payne, executive director of Cabrini Green Legal Aid, where Pritzker signed the bill in Chicago. “From ownership to jobs to expungement, disproportionally impacted communities will be revitalized when this

Thirty-two were “very supportive” of recreational marijuana sales in Broadview while three were “somewhat supportive,” two were “not supportive” and 11 said they needed more information. Fortyone respondents said they were in support of cannabis legalization, in general. Roughly half of the respondents were from Broadview.

During the Dec. 2 meeting, the village board voted on zoning measures that had already been vetted and unanimously recommended to the board by the Broadview Zoning Board on Oct. 15.

Pritzker said the state will start accepting applications for new cannabis licenses, including from social equity applicants, on Tuesday, Dec. 10, through Thursday, Jan. 2.

Pritzker said the phased rollout of cannabis legalization will provide for 75 new dispensary licenses in May, at which point more social equity applicants will have the opportunity to be part of the marijuana industry. The Broadview Board of Trustees also amended the village’s zoning ordinance map to create an overlay district that would allow for the operation of non-dispensing cannabis business establishments, such as cultivation centers. The overlay district is for the area between 25th Avenue and 17th Avenue to the east and west, and between the railroad tracks and Cermak Avenue to the north and south.

The area is currently zoned for office and industrial establishments.

Pritzker said the bill was written this way to protect the medical marijuana industry, but it also limits minority participation in the first phase.

“We want the industry to be diverse,” he said. “We want black and brown people. We want people who’ve been left out and left behind to have a real opportunity to not only benefit from this new industry, but to create new millionaires in the black community, in the Latino community. … That’s the purpose of the phased rollout.”

Toi Hutchinson, a former state senator who helped craft the initial bill and has since been named senior advisor to the governor for cannabis control, said the phase-in is also designed to “protect future market opportunities for those equity applicants to come on board.”

“We’ve gotta get this thing moving…” she said. “We’ve gotta get the fees from the licensure to fund a revolving loan program so that we can cede equity to those applicants that we care so much about. And we’ve gotta make sure that we reinvest. This is the first state to take specific dollars from the point of sale and reinvest in exactly those same communities.”

The original bill creates the Restore, Reinvest and Renew program, which aims to “address the impact of economic disinvestment, violence, and the historical overuse of the criminal justice system,” according to the governor’s office.

Hutchinson also noted the bill requires future disparity and demand studies to inform future phases of the rollout and “inform specific course corrections” as legalization moves forward.

“The focus was never to get as much money as you possibly can as fast as you can,” she said. “The focus has always been to create an equitable industry that looks different than anywhere else in the country.”

Maywood considering 5% tax levy increase Board set to make final decision on levy Dec. 17

The village of Maywood is contemplating increasing the Corporate Fund portion of its annual tax levy by 5 percent over last year’s levy, or a difference of $653,139 over last year’s Corporate Fund total of $13,062,778.

The 5 percent increase in the village’s Corporate Fund would pay for various village operations, including automatic wage increases due to changes in the Consumer Price Index, machinery and equipment needs in public works, and infrastructure improvements, village officials said.

The total tax raised from the village’s Corporate, Recreation, Police Pension and Fire Pension Funds in 2018 was $20,141,579.

The estimated total for 2019 is $21,127,019.

The estimated property tax revenue brought in for servicing the village’s debt in 2019 is $2,756,400, Lanya Satchell, Maywood’s finance director, explained in a Nov. 20 memo. The debt service is a separate levy from the levy encompassing the village’s four main funds.

During a public hearing on the levy held Dec. 3, some members of the Maywood Board of Trustees seemed to acknowledge that they were faced with few options between either raising the village’s tax levy and, possibly, raising residents’ taxes, or facing an even deeper hole in the next fiscal year’s budget.

The reality, village officials conceded, is

that both of those scenarios are possible.

Even if the board votes to raise the levy by 5 percent in order to realize additional tax revenue, they’ll still be looking at a steep difference between the money that gets budgeted and what’s actually needed to meet many of the village’s needs.

“It doesn’t matter if we increase [the levy] by 1 percent or 5 percent — it’s still not enough,” Satchell told board members at the Dec. 3 meeting.

For instance, the price tag for repairing all of the alleys in the village that need attention runs to around $12 million, said Trustee Isiah Brandon, who added that he would entertain a 5 percent increase, but only if a greater amount goes toward infrastructure needs.

“A huger investment in our infrastructure is what I’m looking forward to seeing happen,” Brandon said.

The village is in deficit the tune of around $8 million, with no reserves in the case of an economic recession, officials said. Satchell said that the public works department has identified around $1 million “in both machinery and vehicles to efficiently operate the department.”

Village Manager Willie Norfleet said that despite the village’s bleak financial condition, staffers are managing well what resources they do have, adding that Maywood’s future financial outlook is

bright. He said that the village will no longer have to allocate roughly $2.7 million a year to debt service after another budget season and is poised to see “another goose egg two years from now” if the city of Chicago builds a casino, from which Maywood was promised a portion of the revenues, according to the recent state law that expanded gambling in Illinois.

But merely holding the line and hoping for more money down the road is not a good enough strategy, said Trustee Nathaniel George Booker, who said that he would like to see “what is the return on investment for

the items that have gone into raising” the levy. Booker called for more job performance analysis, more “goal-setting by each department showcasing cost reductions,” and “measurements that can be tracked on a monthly basis to make ourselves more fiscally sound.

“I do not see accountability,” he said. “I would just like to see more accountable planning.”

The board is expected to take a final vote on the 2019 tax levy on Dec. 17.

To make a payment select the blue box that says “Pay Online for Free” and enter your address or PIN. There is no fee if you make a payment from your bank account, Pappas explained, adding that her office takes partial payments.

“However, all taxes must be paid by the due date to avoid the interest charge of 1.5 percent per month mandated

by Illinois law,” the treasurer’s office explained.

Proviso East students pay homage to Fred Hampton

Students competed in art, oratory and essay contests held on 50th anniversary of Black Panther leader’s death

In the days and weeks after the assassination of Illinois Black Panther Party Chairman Fred Hampton, the racial tumult between black and white students at Proviso East High School, where Hampton graduated just three years earlier in 1966, grew to such a fever pitch that administrators canceled classes until after Christmas.

This year, which marks the 50th anniversary of Hampton’s assassination, a multiracial coalition of students at Proviso East tapped their various talents to pay homage to the civil rights leader, who wasn’t much older than they are when he was murdered in an unlawful police raid on Dec. 4, 1969.

The students competed in three different categories: oratory, essay writing and art.

Each category was sponsored by The Need to Know NFP, a local nonprofit dedicated to spreading awareness about African American history in Proviso Township.

NEWS brief Pedestrian dies in hit-and-run near Loyola, police searching for suspect The Cook County Sheriff’s police are searching for the driver responsible for a fatal hit-and-run just outside of Loyola University Medical Center in Maywood on Dec. 7.

Akin M. Jones, 22, of Westchester, died from multiple injuries after he was struck by a motor vehicle just before 10:30 p.m. on Saturday, according to the sheriff’s office.

The incident happened at the intersection of 1st Avenue and 13th Street, which is just outside one of the main entryways into Loyola. Jones was pronounced dead at 10:42 p.m., according to the Cook County Medical Examiner’s office.

According to an ABC 7 report, Jones was walking near the hospital when he was hit by a driver who fled the scene. His family “said he was walking home from work. He worked at a Subway restaurant inside the hospital. A small memorial marks the spot close to where he was hit.

“Police are looking at surveillance video for a dark-colored SUV, possibly a Chevrolet Tahoe, GMC Yukon or Cadillac Escalade.”

Third-alarm fire breaks out in Bellwood, one firefighter injured One firefighter sustained minor injuries in a major building fire that happened on Dec. 8, at around 6:30 p.m., according to multiple news reports.

The third-alarm fire happened at a building at 2513 W. St. Charles Rd. in Bellwood. The property includes a commercial tenant on the first floor and apartments on the second floor.

Irene M. Griffin, a longtime tenant in the building, said on Dec. 8 that she heard a loud explosion precede the fire.

“We’ve been there for 37 years,” Griffin said. “Usually when we here the alarm go

off, it’s a false alarm. This time, I told my husband, ‘Get your clothes on, get your clothes on!’ Five minutes later, it went, ‘Boom!’”

Griffin said that she saw a woman inside of the building, but that firemen and police were able to safely escort her out of the building. Bellwood Fire Chief Douglas Dombek told CBS 2 Chicago that a firefighter was transported to Loyola University Medical Center, where “was believed to be in good condition.”

“I suspect we’ll be on the scene chasing hot spots until tomorrow morning,” Dombek told the station, adding that the American Red Cross of Greater Chicago had been contacted for assistance.

Probable murder-suicide claims two lives on Harlem Avenue A probable murder-suicide left two people dead on the 1500 block of Harlem Avenue in Forest Park on Dec. 6 around 5:10 p.m.

Forest Park police officers were dispatched to the area with reports of two people down in the street.

Officers found a man and a woman on the ground, one in the curb lane and one partially on the sidewalk. Ambulances were there, and both people were pronounced dead on the scene. They had each suffered

gunshot wounds. Forest Park Chief of Police Tom Aftanas said that although it is early in the investigation, it is most likely a murdersuicide. It is suspected the female exited the passenger side door of a vehicle that had been traveling southbound on Harlem Avenue. The man then exited the driver side door and shot her before turning the gun on himself. A gun was recovered at the scene.

The Major Crimes Taskforce has been called in to assist with the investigation.

Neither of the deceased has yet been identified.

“This sort of thing is tragic at any time,” said Aftanas. “But around the holidays it’s especially horrible.”

He said there are no other suspects at this time.

New rules could cost 140,000 Illinoisans SNAP benefits Trump administration announces tighter work requirements for many adults

SPRINGFIELD — The Trump administration is about to impose new regulations that would tighten eligibility rules for the Supplemental Nutrition Assistance Program, also known as food stamps, in a way state officials say could cut off benefits for an estimated 140,000 Illinoisans.

The new rules apply to a category of SNAP recipients ages 18 to 59 known as “able-bodied adults without dependents,” or ABAWDs. Currently, who meet the program’s income eligibility limits are limited to three months of benefits during any 36-month period unless they work at least 20 hours a week or are enrolled in a job training program.

Those conditions were part of a 1996 welfare reform law passed during the Clinton administration. But the law also allows states to waive the work requirements if the applicant lives in an area marked by high unemployment or where there is a lack of sufficient jobs.

The new rules, which will take effect in April, will tighten the regulations governing those waivers by limiting them to counties with unemployment rates above 6 percent. It is one of several changes to SNAP eligibility being implemented or considered by the Trump administration.

The U.S. Department of Agriculture, which administers the program, said in a document on Dec. 4 that about half of all able-bodied adults receiving SNAP live in areas that have received waivers “despite low unemployment levels across the majority of the country.”

“The strong economy is creating opportunities for all,” U.S. Agriculture Secretary Sonny Perdue said during a telephone news conference on Dec. 4. “Now is the time for us to engage with this subset

of SNAP participants so that they can know the dignity of work and the lasting transformation that it provides.”

But Democratic Gov. J.B. Pritzker blasted the new rules, calling them “cruel” and suggesting they are being enacted for other political purposes.

“President Trump is now resorting to the ugliest possible tactics to distract the American people from his impeachment and gin up support from the far right – denying food to the most vulnerable people in our society,” Pritzker said in an email statement. “This is cruel and my administration has fought him at every turn.”

USDA estimates the rule change will make about 668,000 people nationwide ineligible for SNAP, resulting in an estimated $5.5 billion savings over five years.

Meghan Powers, spokeswoman for the Illinois Department of Human Services, said about 140,000 people in this state would lose eligibility, although she added the agency has been working to find other ways to extend eligibility to those individuals.

“Many SNAP participants face serious barriers to employment, such as mental illnesses, substance use disorders, justice involvement and significant physical limitations, and would not be able to immediately meet the work requirements,” she said in an email statement.

“IDHS has been working for months to appropriately exempt any individuals with these barriers so they do not need to meet the work requirements. However, we also recognize that some of our customers can and want to work. To that end, IDHS has also engaged in a robust effort to prepare for this rule change so we can help as many SNAP participants as possible find employment and training that would meet the work requirement.”
