The village of Broadview is looking to take out a $6 million low-interest loan to pay for critical infrastructure repairs. The move comes after the village increased its water rates last November in order to shore up its water fund, which has been losing money for the last 10 years amid annual rate increases enacted by Chicago, which supplies water from Lake Michigan, and the Broadview-Westchester Joint Water Agency, which in turn supplies water to Broadview.

could be delayed and both sides could end up in court.

Overhauls from page 1 a position to apply for the loan from the Illinois Environmental Protection Agency (IEPA), village officials said.

During a regular board meeting on Feb. 3, Chris Baker, of Hancock Engineering, said that the loan will be used to improve the water main on 25th Avenue, between Fillmore and Roosevelt; in the alleys just north of Roosevelt Road, between 25th and 18th; and on the south side of Roosevelt Road, from 18th to 10th. Baker added that the improvements will also involve the reconstruction of alleys on the north side of Roosevelt, between 25th and 18th, along with some sidewalk replacement and street patching.

Baker said that the $6 million loan covers design and construction costs. The loan would come with roughly 2 percent interest rates and will be paid off over 20 years. The village is looking into the possibility of principal forgivingness, he said. Timothy Hicks, the village’s finance director, said that the village will pay for the loan entirely through the water fund.

The proposed loan met some pushback from several trustees, including Trustee Sherman Jones, Trustee Verina Horne and Trustee Judy Miller.

“So we passed on a water rate increase with the expectation to use those funds we expect to make off the water rate increase to pay for a loan that we don’t know we’re going to get?” Jones asked Hicks at the Feb. 3 meeting.

“That’s not true,” Hicks said, explaining that the water rate increases “had to be done to shore up the water fund … we’re talking about trying to keep pace with the past increases that were never passed on.

“So, because the village was able to do that with the water rate increase, now the water fund is in a solid position to go after a low-interest rate loan to shore up the water infrastructure for the village of Broadview, which is in desperate need [of repair],” he said.

Miller said that she was concerned because the IEPA loan proposal was not

vetted by the Water, Drainage and Health committee, which she chairs. Miller expressed a similar concern about the water rates during a regular meeting on Nov. 18, where the board voted 4-2 to implement the increased water rates. Miller and Jones both voted against the legislation.

“I realize we might have had [multiple] discussions about this during a finance committee meeting, but there is a water committee, as well that we should have addressed this at,” Miller said at the time, adding that she wanted village officials to do a comparison study of villages that were of similar size, and had similar median incomes, to Broadview.

Starting Jan. 1, water rates in Broadview increased by $0.30 — going from $6.60 a gallon to $6.90 a gallon — and are scheduled to increase by 10.47 percent on May 1, 2020; 9.48 percent on May 1, 2021; 8.66 percent on May 1, 2022; and 7.97 percent on May 1, 2023.

“At the beginning of 2023, we’d have passed on all these increases from the last four years,” said Thomas Hood at a finance committee meeting on Oct. 9.

Hood said that, despite Chicago and the Broadview-Westchester Joint Water Agency increasing water rates in eight of the last 10 years — the last time Broadview increased its water rate was in 2015. The refusal to pass rate increases in response to Chicago’s increases, he said, had “slowly eaten away” at the water fund’s balance.

The new water rate increases were accompanied by a three-tiered pricing structure that’s designed to give volume discounts for high volume customers. Hood said that the “vast majority” of Broadview residents will fall into the first tier, with large industrial and commercial customers falling into the second and third tiers.

Hicks said on Oct. 9 that the village’s new smart meters should blunt some of the expected rate increase, since the meters are designed to provide more accurate reads and

to improve efficiency. The village conducted a mandatory water meter replacement program last year at no cost to residents.

“We changed the meters to get more accurate reads from residents and what I anticipate happening is that the increases probably won’t be as great for residents, because they’ll be more efficient with their water usage and we won’t see as much water lost,” Hicks said. “That can’t be dismissed.”

During that October meeting, Mayor Katrina Thompson added that the new meters measure water usage in gallons rather than cubic feet, which would benefit local businesses.

“By us going to smart meters and changing from cubic feet to gallons, that’s a big deal for business,” Thompson said. “Every month, when they get their water bill, they have to manually convert cubic feet to gallons.”

At the October meeting, Hood explained the effect that the new meters will have on the new water rates.

“Under our old water meters, we were billing in 100 cubic feet, which turns out to be 748 gallons,” he said. “Our new meters measure in 1,000 gallon increments, so our current cost for residents is $6.60, but because the new meters will have an extra 252 gallons in there, the current cost is $8.82. We want to get everybody to make that conversion in their head. The price is higher, but you’re paying for more water,

so you’ll use less units.”

Hicks said at that October meeting that village officials met with Broadview business owners earlier in 2019 to get their feedback about the proposed rate increases and the village’s water infrastructure needs.

Hicks said that when officials approached business owners about the proposed increases, they were understanding, “because they know for almost five years they’ve been receiving costs savings that the village has been subsidizing.”

Hicks and Hood added that the businesses were in favor of the tiered pricing and appreciated the village phasing out the price increases over five years, instead of instituting them at once.

“Businesses appreciated us doing it in a phased way, so they can plan and adjust their budget for [the increases],” Hood said in October. “If we were just to knock it up, they’d have been blinded.”

Hicks added that business owners also understood the extent of the village’s aging water infrastructure. Village officials estimate that it would take between $55 million and $60 million to fully repair the aging system.

“They understand that we’re not raising the rates just for the sake of raising the rates,” Hicks said of the business owners.

“They understand the increasing costs, but they also understand what we’re trying to accomplish.

“Our street projects can’t be continuously funded out of operating funds and so to be able to address the issue in a timely, costeffective manner is going to require going out and taking advantage of the IEPA lowinterest rate loan, so we can be able to address projects in mass scale, as opposed to what we’ve been doing now, which is just treating the symptoms,” he said. “Since this administration has come in, one of the mandates was trying to be more pro-active.”

During the Feb. 3 meeting, the village board unanimously agreed to table a vote on the IEPA loan to the next regular meeting on Feb. 17.

Meanwhile, Thompson defended the village’s handling of the water rate increases and the process of applying for the IEPA loan.

“We’ve been very upfront and transparent with the community, as it relates to the water rates and the history that went behind it,” she said on Feb. 3. “Many of your in the rom participated in finance committee meetings, so we don’t have a hidden agenda, as it appeared from the conversation tonight.”

New Maywood art café receives unexpected gift Women’s organization gives $1,000 to owner of Shanee Edwards’ Canvas Junk Art Café

Shanee K. Edwards, the owner of the newly opened Canvas Junk Art Café, 1115 Madison St. in Maywood, had to get to the wake for her cousin, slain Illinois state trooper Greg Rieves Sr., on Jan. 31. But en route to the service, she made a short stop at her business to meet with who she thought were prospective clients seeking to book a paint and sip.

Tanya Butler, though, had other plans.

When Edwards arrived, Butler presented her with a $1,000 check from Women Make a Difference. Turns out the whole meeting was a ruse in order to surprise the Edwards.

“I don’t know what to say!” said Edwards, who opened her business last year. She held a soft opening for the business in December.

“I’m completely flabbergasted. I thought I was running in here before my cousin’s wake and here it is I’m being blessed.”

Butler said that her organization donates to different women each year. Typically, the women live in Chicago. This year, Butler

said, they set their sights on giving to someone in Maywood.

“We pick women in need and who have families,” Butler said, moments before surprising Edwards. “She’s a single woman raising five kids. We know that’s hard.

That’s rough.”

“I live by faith every day and God makes a way,” Edwards said. “I’ve made so many sacrifices to pursue my dreams and for God to use me in this space.”

Edwards said the goal of Canvas Junk is to use artist therapy to deal with trauma and stress in a community that doesn’t have resources for treatment. The business offers regular paint and sip classes that range from $20 to $65 a person, according to its website.

Edwards said that she plans on offering a range of programming as well — from story nights to cupcake decorating and candlemaking classes.

“I really want this to be a space for us to host different events that are culturally significant and of substance,” she said, adding that area artists may also utilize the space to showcase their artwork and even lead paint and sip sessions.

Canvas Junk is one of

several new tenants that have located inside of Madison Plaza since its recent renovation, which was spearheaded by Bridgette Chatman-Lewis, the founder and president of Chatman-Lewis Flaggs Enterprises.

Other new tenants include Proviso Community Bank, a Wintrust Community Bank; and MEET, a technology and business maker space. Four tenants — VIP Wireless, Tina Hut, Johnson’s Hair Salon and Sky Nails — all renewed after the renovation, Chatman-Flags explained.

She said that two other businesses, including GRND Coffee House and Maebell’s Patisserie, could move into the plaza this year. In addition, she explained, a wall mural installation is planned for this spring.

Edwards, who completed EGI’s entrepreneurship program, said that she funded her business without taking out any loans or debt.

“My family has made tremendous sacrifices for me to do this,” she said. “And God shows up every day. I feel blessed.”

FIRE AND POLICE On hold from page 1 members with her own choices “without the advice and consent” of the six trustees — a move that village attorney Michael Jurusik called “illegal” during Tuesday’s meeting.

At the meeting, Perkins replaced four members of the commission whose terms have expired — Chairman Emanuel Wilder, Gloria Clary, Readith Esther and Edward Brownlee — with retired Maywood firefighter Gene Washington, retired Maywood police officer Chris Brown, Maywood businessman James Brewer and retired Maywood police officer Wayne Welch. Perkins decided to reappointment Commissioner Roney C. Riley, whose term is also expired.

“Although I am grateful for the service given by the current commissioners serving on police and fire, I believe it is time to appoint other individuals who have a lot of experience and invite them to add to the commission, as well,” Perkins said on Feb. 4.

Perkins, who was reading from a prepared statement, said that the four new members of the commission, which is responsible for hiring, firing, disciplining and promoting the village’s firefighters and police officers, would add “decades of experience to our process, procedures and the way we go about things.”

Perkins said that she made the decision based on a memo Jurusik drafted in 2013, which references a section of the Illinois Municipal Code. According to Perkins, the memo says that state law grants her the authority to unilaterally make each appointment to the fire and police board without the trustees taking a vote.

“Based on the memo I received from our attorney, I was under the impression I could make appointments to the board of fire and police without the board’s consent,” Perkins said. “It was brought to my attention that this was not the case and this is why we are formally making these appointments this evening.”

The mayor’s decision frustrated some trustees, who insisted that she was

interpreting the attorney’s memo and the village’s ordinances incorrectly.

“When looking at the commission we have on paper and in ordinances, it says that they are to be given notice if they are going to be removed and replaced, and should have time to be given a response to the reasons why they’re being removed,” said Trustee Nathaniel George Booker.

Booker argued that if the commissioners are going to be removed, they should be given a chance to explain their accomplishments.

Booker added that the current ordinance governing the commission was written “to stagnate the replacements, so each year replace maybe one or two, but not four at a particular time. And in the board packet, for these new assignments, there are no resumes. I don’t see any resume.”

Booker also said that four commissioners shouldn’t be replaced at once without the Board of Trustees having a transition plan and without posting the vacant positions in order to allow other Maywood residents who want to apply for the positions to do so.

Booker added that, based on his reading of the village attorney’s memo, the board has a right to vote on the new commissioners.

“They do not have to be voted on,” Perkins said emphatically.

“If these items are put on the agenda for consideration and we’re not allowed to ask questions, then why are we [considering them] — if you the mayor are the sole person who can make that decision?” asked Trustee Antonio Sanchez.

“That’s not correct,” Perkins said, responding to Sanchez, before arguing that trustees are allowed to vote on appointments to other commissions that were under consideration that night, but not on the police and fire appointments, “because those are the mayor’s appointments, without the consent of the board.”

Jurusik, the memo’s author, disagreed.

“Mayor that is wrong,” Jurusik interjected. “I’m not going to be part of something that is illegal.”

“You cannot speak without permission,” Perkins said, effectively ending the dialogue between the attorney and the board. When reached by phone on Feb. 6, Jurusik declined

to comment further on the matter.

During public comments at the meeting Tuesday, Clay, who serves as secretary of the police and fire commission, requested clarity on the status of some critical tasks the commission is responsible for carrying out.

“There’s a lot of stuff coming up,” Clay said. “We have entry-level exams coming up, we have promotions, we have hiring. Where does that leave the board now? … Everything we do now is going to be null and void, so we need to find out what you’re going to do as far as these other events coming up that have to be done.”

Clay and Wilder said that they weren’t contacted by the mayor before Tuesday’s decision, which Perkins acknowledged.

“Although I made an announcement last board meeting about my intentions, as past practice, there have been no letters sent to any commissioners to notify them of their replacement,” Perkins said.

During an interview on Feb. 6, Maywood Police Chief Valdimir Talley said that the conflict over the police and fire commission appointments could delay the hiring of two new police officers.

“We’re currently in the hiring process and so until the matter is resolved, we’re prevented from hiring additional entry-level officers,” Talley said. “I would love to have relief for my officers and I want to make sure we have new hires, because we desperately need them, but we just have to manage until this is resolved.

“But [other than the hiring of entry-level officers], this won’t affect us,” he said. “I know that we have a very excellent board and I know the Board of Trustees will make sure that they address whatever problems exist and how they came about. I think what I heard the attorney say is that the selection [of new commissioners] is not legally situated and that there has to be additional considerations — that’s my interpretation.

But I know the board will probably be looking at those issues and will make the appropriate decision.”

When contacted on Feb. 6, Chairman Wilder said that he and his colleagues “plan to continue doing our jobs” and are hoping to “work through this. We’re in limbo right

now,” he said, before adding that the current commissioners are “still installed.”

Wilder also said that the police and fire commission’s legal counsel told the commissioners that the mayor’s unilateral appointments are illegal. Wilder, however, said that the commission would only file a lawsuit against the village “as a last resort.”

For now, Wilder said, he’s hoping for a resolution to the dispute that doesn’t involve the courts.

During an interview on Feb. 6, Perkins said that all of five of the village’s police and fire commissioners have terms that have long been expired, but that her attempts to remove commissioners in 2013 were unsuccessful.

“All of the current people’s times are up,” Perkins said. “The average commissioner has been there 10 years. These members were asked six years ago [to get off the commission], but they refused to get off.”

When asked to respond to the possibility of a lawsuit being filed against the village, Perkins said that she is undeterred and that the new commissioners she appointed “will take over for the current ones.”

“Whatever it is, I will do whatever it takes,” she said, adding that she’ll work with Village Manager Willie Norfleet Jr. to resolve the conflict, so that the commission can carry out some critical tasks that lay in the days, weeks and months ahead, such as the hiring of two new police officers, facilitating the application process for a new firefighter, and promoting some firefighters.

The mayor did not elaborate on what that resolution might look like.

“I’m prepared to get it straightened out, because I know how to follow the rules,” she said. “Aren’t I, as mayor, entitled to put on the board who I feel deserves to be on the board? I’m not entitled to that?”

Maywood resident Lucille Redmond, who is a staple at board meetings, expressed her own views on the matter.

“The mayor is not a dictator, even though she may seem like one,” Redmond said. “She does not have the right to put people in place without your votes. So why even discuss it?

Just vote no to this nonsense … Why pay an attorney if he can’t speak?”

Restrictive covenants were more insidious than I thought

In 2018, when the great soul singer Aretha Franklin died, President Donald Trump did not miss the opportunity to tweet out that the singer “worked for me on numerous occasions.” It was more than an awkward line from a notoriously maladroit childman. That line had roots in something deeper, an ideology that has its tentacles in our very own living rooms.

It’s no secret that Maywood enforced racial segregation through pieces of paper

called restrictive covenants.

According to a 2019 article published by the Seattle Times: “Restrictive covenants on race were commonly written into deeds across the nation after 1926, the year that the U.S. Supreme Court initially found them to be lawful, said UW history professor James Gregory. A property owner who violated them risked a lawsuit from neighbors, or could have a property sale voided.”

It turns out that Washington state — the home of Amazon and Microsoft and

Starbucks — was also shaped by these racist property covenants. And that article reminded me that in many instances, despite being ruled unenforceable by the U.S. Supreme Court in 1948, those covenants are still in the deeds of homes in places across the country.

So to celebrate Black History Month, check your mortgage deed to see if it contains language restricting the property from being sold to blacks and look into whether or not you can request the county to strike that discriminatory language from

your deed, as a new law enacted last year allowed homeowners in the Seattle area to do.

But there’s a more important lesson about these racist covenants and it has to do with language. Whites who utilized these documents had sophisticated explanations for them.

7th District candidates spar in Austin

Democratic candidates running for the 7th District Congressional seat packed the second-floor auditorium at the Austin Branch Library in Chicago, on Jan. 30 for a forum that put the incumbent’s long legislative record under scrutiny.

The forum — sponsored by the Northeastern Illinois Chapter of Americans for Democratic Action and Northside Democracy for America, the primary’s three challengers — included Oak Park activist Anthony Clark, Austin activist Kina Collins and Streeterville attorney Kristine Schanbacher. Longtime incumbent Danny K. Davis was absent due to travel, according to Ira Cohen, a Davis spokesman who attended the forum in the congressman’s place.

The political event, attended by roughly 100 people, was moderated by Oak Park attorney Richard K. Means, an ADA national executive board member and chair of ADA Northeastern Illinois.

From the outset, Cohen framed Davis’ reelection bid as a continuation of his long record fighting for progressive causes and pushing progressive legislation. Cohen pointed out that Davis is a sponsor of the Green New Deal — the package of legislation

designed to resolve the problems of climate change and economic inequality — and said he’s been a pioneer in the community health movement, a predecessor to the current Medicare for All movement.

Collins and Clark pushed back against Cohen’s narrative. Collins said she was motivated to run after organizing doctors and medical students nationally in support of single payer healthcare and lambasted Davis for taking “$2.4 million in corporate money from mostly private insurers and pharmaceutical companies.” Collins added that Davis had to be lobbied by National Nurses United to join the Medicare for All Caucus.

“It shouldn’t be the fact that we didn’t hear about Medicare for All … until I was on the ground with Nurses United, because you can’t change policy until you change minds,” Clark said.

Discussing immigration, Means pointed out that last year Davis voted for a budget proposed by President Donald Trump that allocated “$9 billion to [Immigration and Customs Enforcement] and $20 billion to border protection.”

Cohen said that Davis’ staff has had “more people come into our office for aid and immigration in a month than anyone at this table has in their entire careers,” adding that there were some items in the spending

package that Davis agreed with and others he didn’t agree with.

“Nobody is going to get everything they want,” he said.

Schanbacher, a human rights attorney who said she has won asylum for a transgender Mexican immigrant, blasted the incumbent for his handling of a 2019 incident at O’Hare, where children were detained by U.S. Customs and Border Protection officials because the girls were allegedly undocumented.

While Rep. Jan Schakowsky, who voted against Trump’s budget, showed up to the airport, Davis didn’t, Schanbacher said. “[Davis] not only did not show up to the airport, he was silent,” Schanbacher said.

“After the fact, there was a letter signed by many representatives in the Chicago area regarding the deplorable conduct of ICE and Davis did not sign on to that letter. His actions have serious consequences. We need someone strong to protect our immigrants and he is not doing that.”

Clark, who said that he was at the airport, called for the abolition of federal agencies like ICE and CBP, the dismantling of the border wall and detention centers, and the decriminalization of the border.

Collins urged candidates to expand the scope of the immigration issue to include African immigrants from places like Haiti

who “get left out of the conversation of immigration in this country.”

When it came to money in elections, there was a consensus among candidates that Citizens United, the 2010 Supreme Court ruling that opened the floodgates for special interest groups to spend unlimited amounts of money in elections, should be overturned.

In an effort to demonstrate Davis’ independence from corporate funding, Cohen said that the congressman has never been a prolific fundraiser and, as far as Cohen knows, does not spend his time “dialing for dollars.” Cohen said that the little fundraising the congressman does participate in is in order to pay his dues to the Democratic Congressional Campaign Committee.

The point opened Davis up to a criticism from Collins, who said the fact that Davis is “taking corporate PAC money and then paying the DCCC is problematic, because we know the DCCC is trying to stop the emergence of insurgent candidates coming in and shaping and shifting this party.”

Collins cited the example of Rep. Dan Lipinksi, a Democratic congressman who has come out against abortion rights.

The Democratic Primary election is on March 17.

Nearly 800 former inmates may have had their voter registrations incorrectly canceled “due to a data-matching error” between the Illinois State Board of Elections and the Illinois Department of Corrections, the elections board announced Feb. 3.

ISBE said in a news release it had notified 59 local election authorities of the issue, which stemmed from an incorrect classification of the 774 former inmates as “currently incarcerated.”

Matt Dietrich, public information officer for the elections board, said it had not heard of voters being turned away because of the issue, which occurred from 2014 until it

was discovered in 2019. He said those who may be affected would have been able to cast a provisional ballot or file for same-day registration.

“So we don’t think that anyone was turned away. We don’t have any knowledge that anyone was unable to vote,” he said.

The news release said ISBE has worked directly with IDOC to identify the affected individuals, whose records were among more than 126,000 shared between the two agencies between 2014 and 2019. ISBE also provided each local election authority with voter information on the affected individuals so their registrations can be reviewed for reinstatement by the start of early voting on Feb. 6.

“Anyone on this list who was incorrectly

canceled, would have the opportunity to re-register when they go in to early vote or when they go into their polling place on election day,” he said. “However, we would much prefer that the local jurisdictions be aware of this issue and be aware of exactly which voters of theirs that they may need to deal with.”

He said informing local elections authorities would allow them to reinstate people on the list or to make contingency plans if one of the people on the list shows up to vote but is not registered.

“So the important thing is to know that going forward, anyone who’s on that list… who shouldn’t have had their registration canceled, will be able to vote,” he said.

Under Illinois law, a person’s voting rights

are stripped when they are incarcerated, but upon release they can re-register to vote.

Dietrich said it is possible some of the 774 inmates on the list were removed by local election authorities for other reasons including a change of address, but ISBE would have no way of knowing if that was the case.

Dietrich said both agencies are “revising their data sharing agreement” to avoid this error in future data exchanges, and ISBE stopped sharing the data upon realizing the issue in November.

PUBLISHER’S PERSPECTIVE from page 5 to creating and maintaining these covenants, punched back against claims that these racist covenants were the result of a conspiracy by whites to keep blacks hemmed in, quarantined in inner-city ghettos and “colored neighborhoods” in suburbs like Maywood.

“It is a bald insult to depict as ‘conspirators’ the thousands of Chicagoans who have entered into purely personal legal contracts in order to preserve their homes or to protect their investments,” the Federation members said in the 1940s.

“Race restrictive covenants do not segregate negroes. They segregate whites.

These covenants do not connote prejudice,” they argued. “They have been signed by persons in industrial and professional life whose activities provide employment to thousands of negroes.”

The Federation, by the way, was “an

umbrella organization whose executive committee included representatives of the Community Protective Club of Maywood.”

I sometimes wonder whether this euphemistic explanation for the existence of racist covenants has something to do with why, for so long, I simply nodded when old timers would reflect on the halcyon days of my hometown. During those recollections, the old timers didn’t often hone in on the fact of Maywood’s racial segregation. Yes, segregation by racial covenants existed, but that did not stop blacks from flourishing, the thinking goes.

That’s true enough, but that line of thought also works to blunt the insidious nature of the racial segregation that proliferated across the country during that time and that is partially responsible for so much suffering today. And it obscures the property covenant’s blatant white supremacist foundation.

Consider the language in these documents. The following passage was pulled directly from a standard form

restrictive covenant drafted for the Chicago Real Estate Board in 1927 — language that was likely found in covenants contained within the deeds of homes in Maywood at the time (and perhaps even today).

“The restriction that no part of said premises shall in any manner be used or occupied directly or indirectly by any negro or negroes, provided that this restriction shall not prevent the occupation, during the period of their employment, of janitors’ or chauffeurs’ quarters in the basement or in a barn or garage in the rear, or of servants’ quarters by negro janitors, chauffeurs or house servants, respectively, actually employed as such for service in and about the premises by the rightful owner or occupant of said premises.

“The restriction that no part of said premises shall be sold, given, conveyed or leased to any negro or negroes, and no permission or license to use or occupy any part thereof shall be given to any negro except house servants or janitors or chauffeurs employed thereon as aforesaid.”

The very language of these racist covenants tells us what they were really about. If the covenants were merely designed to “segregate whites,” they wouldn’t exempt blacks from living with whites as janitors or chauffeurs or servants.

In other words, blacks and whites could live together, so long as blacks were kept servile and inferior to whites.

That’s what racial segregation was really about. White supremacy informed the creation of Maywood’s “colored neighborhood” — where my grandparents and great-grandparents and great-great-grandparents lived. White supremacy explains why this country can be so comfortable with routinizing black misery (from the War on Drugs to mass incarceration to community disinvestment).

And now, two decades into the 21st century, white supremacy can even explain presidential tweets.

The Village Free Press introduced and reported on this program to its readers in March 2019 and October 2019. We are forever grateful and look forward to the continued support from the Village Free Press Today, I wish to update the constituents on what has transpired during the first quarter of the year (August through December), as it pertains to Smart Routes. It has been very interesting, yet rewarding to know efforts being made are actually working and are appreciated.

The Pilot Program started August 2019; In September 2019, we saw an increase in students walking and riding bikes to Irving Middle School; In October 2019, we held the Community Prayer Walk, with another prayer walk coming in 2020; From early October through midDecember 2019, we de-escalated three “after-school” altercations by young people and were successful in conveying one full message throughout Irving school by showing a full collaboration between District 89, Maywood Police and Smart Routes; Students feel safer and are now telling us to have a great day, as they walk home outdoors; We created monthly meetings with District 89 administrators, a Maywood Police Department liaison,

have been very helpful in creating the foundation and facilitating the needs for success; During the cold months, we have passed out gloves, hats and coats to students in need; We’ve worked with community members that vacate routes while students are either heading to or from school; We continue to receive an abundance of support from the community.

Keith Mahone, Irving’s principal, said the Smart Routes program “has been part of our school system since August 2019 and we have seen a decrease of student incidents after school since the implementation of this pilot. I believe meeting the needs of youth, both in and outside of the school, creates positive adults and we look forward to having this program again next school year!”

As we enter the second quarter of the 2019-20 school year, it is our endeavor to keep the momentum going, continue to seek independent funding resources and create the healthy environment that’s needed to allow our youth to go to and from school safely.

I was elected Trustee in 2019 with the promise of Character, Vision, Passion, and Integrity. In full transparency, there is no issue with installing new commissioners; the problem is the way it is trying to be done. Mayor Perkins is intentionally misinterpreting the law to fit her desires.

The mayor does not have the authority to install new commissioners per the State of Illinois without consent of the Board of Trustees.

According to (65 ILCS 5/10-2.1-1) (from Ch. 24, par. 10-2.1-1) (Illinois), Sec. 10-2.1-1. AppointmentTerms of office. “The president of the village or incorporated town, with the consent of the board of trustees, shall appoint a board of fire and police commissioners.

According to Illinois code 65 ILCS 5/10-2.1-2) (from Ch. 24, par. 10-2.1-2) (Illinois), Sec. 10-2.1-2.

First appointments, “Within 30 days after this Division 2.1 becomes effective in a municipality, the mayor or president, as the case may be, shall appoint the first members of the board”. This is for establishing a Police and Fire Commission not replacing current commissioners.

The mayor received this information from our village attorney and is trying to use this for an already established board, not a new one.

Also under 65 ILCS 5/10-2.1-2 it states, “One of the members shall be appointed to serve until the end of the then current municipal year, another to serve until the end of the municipal year next ensuing, and the third to serve until the end of the municipal year second next ensuing. But every member shall serve until his successor is appointed and has qualified”. This policy clearly lays out a necessity to have stagnated replacements each year vs. replacing 4 out of 5 commissioners all at once.

This is state statue that is purposely being ignored by the mayor. Even in our current village code (that needs updating) Maywood Board of

Fire and Police Commission 31.21, “For the new appointees to the Board after October 4, 2016, the first appointee shall serve a term that expires on December 31, 2017, the next 2 appointees shall serve a term that expires December 31, 2018, and the final 2 appointees shall serve a term that expires December 31, 2019.”

This ordinance for Maywood is what is in place after the Mayor and Board of Trustees voted 3 amendments in Am. Ord. CO-2016-18, passed 8-162016; Am. Ord. CO-2016-22, passed 10-5-2016 under Mayor Perkins’ time as mayor. She is violating a village ordinance that was voted on during her current term in office.

The reality is, we are currently dealing with cases, hiring, recruiting, and promoting individuals that would be put to a halt under the mayor’s desire. She claims to have a transition plan, but the Board of Trustees have not seen it, we have not heard from either candidate she is proposing, nor have we even seen a resume for either candidate she is proposing. This is not politics; this is being responsible as an elected official to ensure legal process is being followed.

Under 31.21, “A member shall only be subject to removal for cause, upon written charges, and after an opportunity to be heard within 30 calendar days in his or their own defense, before a regular meeting of the Board of Trustees. A majority vote of the Board of Trustees shall be required to remove any such member from office.” The current commission was just recertified in November of 2019. We cannot halt the progress of the police and fire departments without cause. Even with appointing new commissioners their first opportunity to get certified would not happen until May 2020.

Appointing 4 out 5 commissioners goes against current state and local municipal code.
