Leaders in Bellwood, Broadview and Maywood are brainstorming ways to persuade community members to take the upcoming census and at two events that took place in Maywood and Broadview on Saturday, there was an all-hands-on-deck sense of urgency.

If those communities are undercounted, as they were in 10 years ago, critical resources, funds and even congressional representation could disappear.

The Chicago Tribune broke the news on Jan. 6 that Amazon was planning to move into the Chariot Logistics Center, the

industrial and retail development going up on the site of the old Maywood Park racetrack at 8600 W. North Ave. in Melrose Park.

In December 2018, Melrose Park annexed

Maywood Park, which closed in 2015 after going into bankruptcy. The village acquired the site from the Cook County Board of Commissioners.

Local organization gave away hundreds of toys in December On Dec. 20, during its 5th Annual Toy Giveaway Event Holiday Party, 13th Positive Foundation gave away toys to more than 500 children, said Reggie Neal, the foundation’s president.

For the last two years, the organization has partnered with the Bellwood School District 88 and the village of Bellwood in hosting the giveaway.

“There’s no better feeling than being able to put smiles of over 500 kids’ faces,” said Neal. “In the early years of planning this annual event, we wanted to do more than just give away toys to kids; we wanted to make this an enjoyable event for all.”

Lawrence Broughton, Maywood Park District leader, dies at 68

Lawrence David Broughton, a former Maywood Park District commissioner, died on Jan. 2. He was 68 years old. His death was confirmed by his wife, Dr. Cynthia Phillips Broughton, a longtime educator in Proviso Township.

Broughton served a six-year term on the park commission, where he held the offices of president and vice president. He also served as executive director of the Maywood Park District.

“Lawrence’s spiritual journey included membership at Lilydale First Baptist and then Trinity United Church of Christ,” according to an obituary his wife released this week. “Lawrence was a graduate of

Harlan High School and received both degrees from Western Illinois University.

He was a renowned educator at Hillcrest High School, North Chicago High School, and Proviso East High School. Lawrence was a proud and active member in Kappa Alpha Psi Fraternity, Inc.” Broughton was also a member of the Forest Park Historical Society Board of Directors and served on the Illinois State Amistad Commission for several years after being appointed to the commission by Illinois State Senate President Emil Jones.

Broughton’s services took place last week.

New to town from page 1 The Tribune explained that the threebuilding distribution center will total approximately 623,000 square feet (the equivalent of nearly a dozen football fields) and will be Amazon’s largest near Chicago.

Amazon plans to use the site as a last-mile delivery station that will employ “hundreds of full- and part-time” workers at the facility.

Wages will start at $15 an hour, according to an email the company sent the Tribune.

The Tribune explained that Amazon hasn’t started hiring for the facility, but there are at least four open positions on the company’s jobs site that are located in Melrose Park: HR Business Partner (listed since Nov. 1, 2019); Driver Resource Manager, Logistic; (Shift Manager, Logistics); and Area Manager, Logistics. The latter positions have all been posted since Oct. 1, 2019.

On Jan. 7, an Amazon spokesperson told the Chicago Sun-Times that the company will start operating in Melrose Park this year. As part of the company’s Delivery Station network, the center will allow Amazon to increase “its access to outside contractors to help during peak business.

Such locations, she said, ‘offer entrepreneurs the opportunity to build their own business delivering packages on behalf of Amazon,’” the Sun-Times reported.

Larry Goldwasser, executive director at Cushman & Wakefield, the Chariot Logistics Center’s leasing agent, told the Sun-Times that Amazon will lease the 623,000 square feet of warehouse space, which is located “southwest of North and First avenues.”

The buildings are expected to be completed by the end of January, the paper reports.

In addition to the Melrose Park facility, Amazon also has a million-square foot fulfillment center in Aurora and is planning to occupy similar facilities in Channahon and Skokie.

“The retailer has reported more than 11,000 workers in Illinois and in September announced plans to double the size of its technology hub in downtown Chicago, adding 400 jobs over the next three years,” the Sun-Times reported.

‘A wonder of automation, efficiency and speed’ “Delivery stations represent the last leg of our delivery network,” according to a job description Amazon posted that was included in a Dayton Business Journal article about a delivery station that was scheduled to open in Ohio in 2019.

“Customer packages travel from our fulfillment centers to regional sort centers and finally end up at our local delivery stations where packages are sorted and dispatched directly to the customer via delivery service providers (couriers).”

Officials with Amazon could not be reached for comment on Jan. 8, but an evaluation of national reporting on the company’s warehouses across the country sheds some light on what prospective workers at the Melrose Park station might expect.

In an article published in the Atlantic last month, Will Evans called an Amazon warehouse in Eastvale, Cal. “a wonder of automation, efficiency, and speed,” replete with “hundreds of squat orange robots” whizzing across the floor, “carrying tall yellow racks.”

Candice Dixon was a stower whose “job was to stand in a spot on the floor” of the

warehouse filling “an unending parade of merchandise racks.

“Another worker, known as a “water spider,” would bring her boxes upon boxes of goods—jars of protein powder, inflatable unicorn pool floats, laptops, makeup, Himalayan sea salt, vibrators, plastic toy cars. She’d grab each item out of a box, scan it, lift it onto the rack, and scan its new location. She’d use a stepladder to put things on the top of the rack.

“For heavy items—she remembers the cases of pet food in particular—she’d have to squat down to hoist them in, then pop back up to grab the next item. As soon as she’d filled a rack, she’d press a button, and one robot would zip it away while another robot would bring a new one to fill.

“The moment an Amazon customer clicked “place your order,” a robot would haul one of those racks to a picker, who would grab the right item for the order and send it on a series of long conveyors to a packer, who would stuff it in one of those familiar, smiling cardboard boxes.

“The clock was always ticking on Amazon’s promised delivery time. Dixon had to scan a new item every 11 seconds to hit her quota, she said, and Amazon always knew when she didn’t.”

That warehouse in California is a robotics fulfillment center. So far, it isn’t known how prevalent robots will be in the Melrose Park last-mile delivery station.

No walk in the park Shirin Ghaffary reported in December for Vox’s Recode that “more than 30 Amazon workers at a Sacramento warehouse walked off the job this morning, demanding they receive paid time off.”

The workers, who said they lift hundreds

of packages a day, told Vox they didn’t receive any annual paid time off days and that management had ignored their requests to meet with their colleagues who were leading the fight for better conditions at the facility.

“The recent walkout is also an escalation of labor tension at Amazon’s growing network of last-mile delivery centers, which are smaller warehouses where workers prepare packages that are then sent out to customers’ doorsteps,” according to the Vox report.

“Most workers at the Sacramento site — as with those at other delivery stations across the US — are prohibited from working more than 30 hours a week. They often work up to that maximum amount allotted and sometimes more than that during peak shopping times. Workers say their shifts are physically grueling, involving lifting boxes of up to 50 pounds at a rapid pace, especially right before the holidays when they see their workload increase.

“But because they aren’t working full-time hours, most of these workers do not receive benefits such as employer-subsidized health insurance, and they can be fired for taking off more than 20 hours every quarter,” Ghaffary reported. “Amazon publicly promises its part-time employees paid time off on its own website (notably, though, the policy differs for California employees), as well as in its employee handbook, according to documents Recode reviewed.”

In a petition, the employees said that they believe Amazon intentionally gives “all class q part-time workers less benefits than regular part-time workers so that they grow the company at our expense. We’ve had enough.”

Melrose Park mayor talks Amazon

Mayor Ron Serpico answers frequently asked questions about Chariot Logistics Center, Amazon facility

During a recent interview, Village Free Press posed some frequently asked questions community members had about the new Amazon facility going up in Melrose Park to Melrose Park Mayor Ron Serpico.

The roughly 623,000-square foot Amazon distribution facility is expected to be completed by the end of January and will be a major part of the Chariot Logistics Center, the industrial/commercial and retail development going up on the site of the old Maywood Park racetrack at 8600 W. North Ave. in Melrose Park.

Was there a public hearing before the Chariot Logistics Center was developed?

Serpico said that Chariot Logistics is the developer of the site and that Amazon will lease the property. He said that the process of acquiring and developing the site has been an “ongoing four-year process,” which dates back to when the racetrack lost its operating license and went bankrupt in 2015.

In December 2018, the village annexed the property, which had been in unincorporated Cook County for years, from the Cook County Board of Commissioners.

“As to whether or not there was a public hearing regarding the warehouses going up, no there wasn’t,” Serpico said. “We voted on the annexation at public meetings, but we didn’t have a specific [public hearing] for them. There’s never been a phone call about the warehouses being there before the deal was struck with Amazon.”

Was environmental remediation conducted on the site before development?

“Oh yeah,” Serpico said. “They wouldn’t have spent all of that money without doing [environmental remediation].

The demolition [of the racetrack] was coordinated with [a company] that does

asbestos abatement. There was a phase one environmental assessment. There’s no way a lender would have given any money if there were any issues.”

When did the village know that Amazon was going to be one of the tenants in the Chariot Logistics Center?

“When the property was up for sale, there were about eight to 10 groups interested, but one thing they had in common was that one part would be a combination of commercial and industrial. That’s the only thing that can exist in this economy and that wound up being the case.

“In terms of Amazon, about several months ago it was mentioned that [the developer] was negotiating with the company, but Amazon has all these confidentiality agreements, so quite frankly, when it came to our attention wasn’t really that long ago. Maybe 60 to 90 days ago.”

The mayor said that lots of conversations around potential developments happen between the village and outside companies,

but many times nothing comes of them.

“In this case, there were conversations and questions Amazon had with our building department, but that didn’t necessarily mean there was a deal,” he said.

Has the village thought about what impact the Amazon facility will have on local traffic?

“I gave this a lot of thought,” Serpico said. “I don’t see it being a tremendous inconvenience. I think the effect will probably be similar to the effect the UPS facility has on Franklin Park.”

Serpico pointed out that most of Amazon’s fleet will comprise Sprinter delivery vans.

Andrew Mack, a village spokesperson, pointed out that there was lots of traffic when Maywood Park Racetrack was still operational.

“When they had live racing at the racetrack, there was lots and lots of traffic, with trucks and trailers shipping in horses all the time,” Mack said. “There would be lines of cars coming out of the parking lot.

I don’t think there would even be that much traffic.”

Any other quality-of-life issues the village has thought about?

Mack and Serpico added that the new Chariot center will be an improvement for the homeowners whose houses abutted the old racetrack, which housed barnes that often smelled of horse manure.

“Those barns were literally right up to the fences of the houses,” the mayor said. “I used to think to myself how they were going to knock those down without wrecking anybody’s fences. So, besides the economic benefit, I think it’s also beneficial for the residents there, because those barnes are away from them.”

What’s the potential impact on nearby businesses?

“Melrose Park wasn’t collecting any

real estate taxes from the racetrack in the first place, no sales tax,” the mayor said.

“However, you can’t quantify the fact that, when these drivers are coming and going, they’ll go to nearby shopping places. So, there will be a collateral benefit for all of the businesses and food places along the way.

That’s more sales tax for the village and more business for them. That definitely will be a positive for the village.”

Did the village give the developer and/or Amazon any tax incentives?

Mayor Serpico said that the only incentive the developer received was a Cook County Sustainable Emergency Relief Class 6b property tax incentive, which means that the development will be taxed at 10 percent of its market value, rather than the typical 25 percent of market value, for the first 10 years. The property will be assessed at 15 percent and 20 percent in the two years after that 10-year period has passed.

Serpico said that no other forms of tax relief were given. The site does not sit in a Tax Increment Financing (TIF) district, so TIF funding was never on the table, he said.

Will Amazon hire locally?

The mayor said that the village is still waiting to get a hard estimate about how many jobs the new Amazon facility will create.

“The reason that’s key is because the whole robotics thing — you never know,” Serpico said. “I’m trying to get a handle on that from the Amazon folks.”

Serpico said that he was scheduled to meet with an Amazon official this week to talk about local jobs and other issues.

“I’ll be happy to pitch for our local folks, because it’s better for them to have local folks,” he said. “I think it’s in their interest to find local people, anyway. That will be part of my pitch.”

Comptroller to stop helping towns collect red-light debt Susana Mendoza says red-light cameras ‘less about keeping people safe and more about collecting revenue’

SPRINGFIELD — Pressure is mounting on red-light camera operators as Democratic Illinois Comptroller Susana Mendoza announced Monday that, beginning Feb. 6, her office will no longer assist municipalities in collecting fines for violations caught by the devices.

“Over the years, it has become clear that these red-light cameras were less about keeping people safe and more about collecting revenue,” Mendoza said in a street-corner Chicago news conference overlooked by a red-light camera.

The cameras are automated devices that photograph vehicles if they pass through a red light without stopping, and generate a citation to the vehicle’s owner. Local governments typically split the revenue from citations with vendors that place the cameras.

“They were sold as a way to prevent motorists from racing through the intersections, but the stories have shown they are now more about charging people high fines for failing to come to a complete stop as they make a right turn on red at

intersections where right turns on red are allowed,” Mendoza said.

Mendoza said the comptroller’s office has been helping collect red-light fines since 2012 after the General Assembly allowed municipalities to use the comptroller’s offset system — which withholds state income tax refunds or other state payments — to collect traffic fines including red-light violations.

Historically, this system had been used to collect child support, overpayment of benefits and other types of debt, the comptroller’s office said.

Mendoza said her office helped collect about $11 million in revenue specific to redlight cameras last year.

The comptroller’s office said it does not collect red-light camera fines for Chicago, but a growing percentage of offset collections have involved violations from the city’s suburbs. Beginning Feb. 6, that arrangement, which Mendoza called “plain rotten,” will end.

“It exploits taxpayers and especially those who struggle to pay the fines imposed, often the working poor and communities of color,” she said.

Beyond that, red-light cameras have been a source of public corruption and FBI

scrutiny, the comptroller said.

When federal agents in September raided the Statehouse office of former Sen. Martin Sandoval, D-Chicago, they were looking for information on SafeSpeed LLC, a politicallyconnected red-light camera company based in Chicago.

The company has been named in several other news reports regarding the ongoing federal corruption probe of several Statehouse insiders and local government officials, although its CEO denied any wrongdoing from the company in an interview with the Chicago Sun-Times in October.

In a news release, Mendoza urged municipalities to “take a second look at any contracts with red-light camera companies and determine if those contracts were procured properly in light of recent news reports and criminal investigations concerning the red-light camera industry and its relationship with government officials.”

Otherwise, she said, municipalities can contract with private debt collectors.

“We can’t unilaterally end this program, but we can certainly end our participation in anything that would take money away

from people who can least afford to pay it,” Mendoza said.

Pressure on red-light camera operators continues to mount in the General Assembly as well.

State Sen. Emil Jones III, D-Chicago, advanced Senate Bill 1297 in a Senate committee during the fall veto session.

That bill calls on the Illinois Department of Transportation to study “automated traffic law enforcement systems” and report back to lawmakers “on the overall operation, usage, permit process, and regulation” of the devices.

It did not, however, receive a vote from the full chamber.

Multiple bills providing for an outright ban of the devices — including Barrington Hills Republican Rep. David Mcsweeney’s House Bill 323 and Naperville Republican Rep. Grant Wehrli’s House Bill 3909 — have gained bipartisan support. Rep. Kambium Buckner, a Chicago Democrat, sponsored House Bill 3927 which would ban the devices as well.

Those bills await assignment to a substantial committee in the Illinois House.

“That was thousands of dollars we lost, because [census data] showed we have a higher income base than Oak Park, which we know we don’t,” Jackson said.

Jackson was among roughly 200 community leaders and residents who milled about inside of the Beverly Center, [XXX], in Broadview on Saturday, moments before the start of the Census Kickoff Rally — an event hosted by Broadview Mayor Katrina Thompson and Bellwood Mayor Andre Harvey.

“This event is to get everybody aware of the 2020 census and all of the activities involved,” said Broadview Clerk Kevin McGrier, the event’s lead organizer who also heads up the village’s Complete Count Committee.

The event also served as a common space for local leaders like Jackson to share ideas on how their respective organizations plan on increasing census participation this year,

In Bellwood, Broadview and Maywood, Hispanics and African Americans “historically have been, or are at risk of being, missed in the census at disproportionately high rates,” according to the U.S. Census Bureau’s 2020 Hard to Count Map — an online tool available at censushardtocountmaps2020.us that shows past response rates by census tract, among other functions.

Jackson said her district is working to ensure that those historically undercounted populations are included in this year’s census through a variety of outreach efforts.

“We’re making sure that the census is integrated into the curriculum and sending out regular information and e-blasts to the community,” Jackson said.

Bellwood District 88 Supt. Mark Holder said his district is also taking steps to make sure that residents in his school district are counted.

“We’re doing a census week that will be added to our social studies curriculum, where students will talk about the importance of the census,” he said. “We’re also doing some town house meetings at our middle school to get our kids fully aware of the importance of the census. We just need to educate our community. It’s important we get out, connect and make sure we’re providing all the knowledge and information in our communities so everyone understands that everyone counts.”

Carla Joiner-Herrod, the D92 school board president, said that employment opportunities related to the census are also opportunities for people to learn more about its importance.

“We want people to apply for jobs so they really can own it,” she said. “When you’re working for the census you really understand the intricacies of the process.”

Tonita S. LeShore, Bellwood’s HR director and the chair of the village’s Complete Count Committee, said that nearly 7,000 residents in Bellwood went uncounted in the 2010 census.

“At that point in time, we were at 79 percent participation,” she said. “This year, we at least want to get between 80 and 85 percent.”

Gwenevere Turner, a Broadview police and fire commissioner, said that more information about the census would help dispel some common misconceptions and fears shared by some residents, particularly those in historically undercounted communities.

“Right now, there’s a lack of information out there,” she said. “I think we need more information. We need to break down what happens when you get counted. A lot of people think the census is used to track them if they’re here illegally. So, a lot of people are scared. So, what the census really is needs to be explained to them.”

informational sessions and attended nearly 50 community events to spread awareness about the census.

On Saturday, while the Broadview rally was happening, the two volunteers hosted a census informational session at the Maywood Multipurpose Building, 200 S. 5th Ave. “We’ve mostly used our own funds and have done some creative things to bring people to us,” Olivier said. “We try to engage them and charge them: ‘This is your role and your responsibility to do something in your community. Besides complaining about what we don’t have, here’s something we can do to make a difference.”

Ocampo and Olivier said that they often encounter residents who haven’t heard much about the census and aren’t engaged with the process. Residents who do know, they said, are often skeptical of the census.

“There are some people who don’t even know about the census, that’s how bad it is,” Ocampo said. “There’s fear about the citizenship question. We’ve told them that there’s nothing to fear, because that question is not going to be on the census.

There are only simple questions — your name, birthday, address, race, where you live and how many people live with you.

Just simple questions.”

State Rep. Emanuel “Chris” Welch (7th) said that the stakes are high this year, explaining that each decade “since the 1940s and 1950s, Illinois has lost at least one Congressional seat, because of the numbers who have left our state. Recently, the census department said that Illinois led the nation in residents leaving in the last decade.”

Welch said that fewer people counted also translates into fewer federal dollars that flow to the states before eventually landing at the feet of communities. Welch said that he supported a $29 million line item written into the recent state budget for censusrelated outreach efforts.

“That $29 million commitment from the state is critical,” he said. “We’re also seeing it from the county and local governments.

We’re all pulling together, because everyone needs to understand how important this is.”

NEWS brief Bosch automotive division moving from Broadview to Oak Brook A major company headquartered in Germany is moving its automotive aftermarket division from Broadview to Oakbrook Terrace, according to a November Crain’s report.

Bosch, the German engineering and technology giant that manufactures everything from power tools to household appliances, is planning to move out of its property at 2800 S. 25th Ave. in Broadview to “four floors in the 31-story tower at 1 Tower Lane in Oakbrook Terrace,” by spring 2020, Crain’s reported. Bosch has put its Broadview facility up for sale.

Bosch spokesman Tim Wieland told Crain’s that the move to Oakbrook Terrace “”better suits the needs of our business and team.” Around 350 employees work in the Broadview facility, according to Crain’s.

“Bosch’s move is a big win for New Yorkbased private-equity giant Blackstone Group, which bought Oakbrook Terrace Tower in 2015 as part of a $3.3 billion portfolio acquisition from GE Capital Real Estate,” Crain’s reports. “Bosch will become the largest tenant in a building that is 83 percent

leased, according to real estate information company CoStar Group.”

Crain’s reported that Bosch’s aftermarket division “makes car parts sold in auto shops among other places.” The company has more than 1,400 employees in the Chicago area.

Crain’s reported that the Broadview facility “includes three freestanding buildings as well as three acres of outdoor storage space, according to CoStar Group.”

Park — was sold for $11 million to a real estate investor based in New York, RE Business reported on Jan. 2. Quantum Real Estate Advisors Inc. brokered the sale.

A Maywood woman has died a day after firefighters rescued her from a house fire that happened in a two-story building at 115 S. 9th Ave. in Maywood, at approximately 1:55 a.m. on Jan. 5.

While extinguishing the fire, firefighters discovered 54-year-old Cedric Brown lying on the first floor in the living room, Bronaugh said. The chief said that Brown’s girlfriend, 61-year-old Cathy Butler, was also found on the first floor.

Brown sustained burns to 50 percent of his body and smoke inhalation while his girlfriend sustained injuries due to smoke inhalation. Both victims were take to Loyola University Medical Center, where Brown was pronounced dead that day. Butler had been in critical condition on Jan. 5, according to ABC 7 Chicago.

Last week, Illinois Lottery officials were looking for the person who bought an $800,000 winning Lucky Day Lotto ticket at a gas station in Westchester, officials announced in a Jan. 7 release.

State panel looks for isolation room answers

‘Training, oversight, resources’ cited as necessary to counteract overuse of punitive seclusion, restraint

SPRINGFIELD – Legislators and advocates began discussions on Jan. 7 of what action the state can take to counteract the overuse of physical restraint and forced isolation of students in Illinois schools, particularly those serving students with special needs.

At a joint Illinois Senate and House committee hearing in Chicago, several of those who spoke credited revelations unearthed by a Chicago Tribune and ProPublica investigation published in November for the increased interest in the topic.

That investigation showed there were more than 20,000 documented incidents of isolation used in the state from the start of the 20172018 school year through December 2018.

Proviso Area for Exceptional Children (PAEC), 1000 Van Buren St. in Maywood, is among the schools the investigation focuses on. The newspaper even diagrammed what it said is an isolation room at the school, where 97 percent of its elementary and high school students have developmental disabilities.

The room, the investigation shows, is fivesided. The largest side is 5 feet, 6 inches while the smallest side is 4 feet, 1 inch.

“The students, most of them with disabilities, scratch the windows or tear at the padded walls. They throw their bodies against locked doors. They wet their pants.

Some children spend hours inside these

rooms, missing class time. Through it all, adults stay outside the door, writing down what happens,” according to the report.

In Illinois, it is legal to isolate students if they pose a safety threat to themselves or others, the report found, but the practice is used far more than in such situations.

“Children were sent to isolation after refusing to do classwork, for swearing, for spilling milk, for throwing Legos.

School employees use isolated timeout for convenience, out of frustration or as punishment, sometimes referring to it as ‘serving time,’” according to the report.

The report also found that while schools must document isolation instances, that documentation often goes unread, and the Illinois State Board of Education had not collected any data on the practice at the time the article was published.

The investigation prompted ISBE to initiate emergency rules banning the use of isolated seclusion in “any educational entity serving public school students in Illinois” in November. A news release at the time said ISBE would begin collecting data to “increase accountability and transparency for all instances of timeout and physical restraint.” The board proposed permanent rules in December.

At the committee hearing on Jan. 7, Amanda Elliott, co-director of legislative affairs at ISBE, said the emergency rules

allowed ISBE to collect data on the use of seclusion and restraint in prior years. She said ISBE is reviewing the data for violations which would prompt investigations and potential disciplinary action. She said nine investigations are pending as a result.

She said sanctions resulting from violations could result in licensure suspension, professional development requirements or even criminal charges for individuals. For schools, recognition status could be affected, which would impact funding, she said.

Rep. Fred Crespo, D-Hoffman Estates, however, questioned how schools are selfreporting that data and suggested it would likely be incomplete.

Advocates at the meeting urged greater oversight from ISBE, increased training requirements and opportunities for school staffs, and greater resources for providing an adequate number of staff, particularly social workers.

“We hear these devastating stories and then we come here to take action and it’s the same three things that we need, though.

We need training, we need oversight and we need resources to help our teachers,” said state Sen. Jennifer Bertino-Tarrant, a Shorewood Democrat and chair of the Senate Education Committee.

Illinois Federation of Teachers President Daniel Montgomery said “unless there is a real sea change” of how educators are trained,

change will be difficult to implement. He said a simple 8-hour course would be nowhere near sufficient, and he urged “systemic, sustained” training requirements.

Other stakeholders pointed out that the isolation room practices documented in the investigation were already illegal, but there were no enforcement mechanisms in place to punish school districts for using them.

Rep. Sue Scherer, a Democrat from Decatur, said the state would have to make a “firm commitment to funding of these training programs” in order to effect change. Otherwise, without training, she said, the state is “basically throwing teachers to the wolves.”

Advocates also agreed policy changes were not aimed at “support” or “de-escalation” rooms where students with sensory issues can willfully go with social workers or support staff.

Rep. Jonathan Carroll, a Northbrook Democrat, is sponsoring a bill to ban the practice of “seclusion,” which is defined as “a discipline management practice or behavior management technique in which a student is confined in an enclosed space that is designed solely to seclude a person, regardless of space or dimension, whether it is a box, a closet, a room, or any other specially designated locked or unlocked space.”

He said the matter was personal to him, as he said he was physically restrained and placed in such a room as a child.

AG seeks accelerated ratepayer refund from electric utilities Kwame Raoul asks Commerce Commission to rethink decision giving companies decades to repay $543 million owed to customers

SPRINGFIELD — Two of the state’s largest electric utilities owe their customers a combined $543 million in refunds, according to state regulators, but there is sharp disagreement over how much time the companies should have to pay it back.

At issue for Ameren Illinois and Commonwealth Edison, also known as ComEd, is money they collected to pay future tax bills before federal tax cuts which took effect in 2018 lowered those anticipated rates.

When the corporate tax rate was slashed from 35 percent to 21 percent, both companies found themselves holding onto large surpluses, known as “excess deferred income taxes,” or EDIT. For ComEd, which serves 4 million customers in Chicago and northern Illinois, the excess amounted to $385 million. For Ameren, which serves about 1.2 million customers in central Illinois and the Metro East area, it amounted to $158 million.

In a pair of rulings last year, the Illinois Commerce Commission, which regulates public utilities, said ComEd could pay off its EDIT over 38 years and Ameren could pay off its bill over 35 years. But on Monday, Illinois Attorney General Kwame Raoul announced he is asking the ICC to reconsider that decision and shorten the payout period to just five years.

“Consumers paid public utility rates to ComEd and Ameren reflecting the higher federal tax rate, and now that the federal tax rate has lowered, fairness dictates that consumers should get that money back,” Raoul said in a news release. “Allowing an unreasonable refund period of close to 40 years nearly guarantees many customers will never get their fair share of the refunds.”

The issue has to do with how utility rates are set and regulated. Essentially, companies are allowed to recover their cost of providing service and make a “reasonable” rate of return, or profit. The cost of service includes such things as the cost of building and operating power plants and transmission

lines. It also includes the cost of taxes owed to various levels of government.

When a company builds a plant, it recovers that cost over the expected useful life of the plant, typically around 40 years.

In their cases before the ICC, ComEd and Ameren acknowledged that the tax law change reduces their cost of service, but they argued that the duty to return the excess deferred tax money they collected should be spread out over the life of their facilities so that both current and future ratepayers will be treated evenly.

But it also means customers will see a reduction in their bills of only a few pennies per month instead of a few dollars, according to Jim Chilsen, spokesman for the Citizens Utility Board, a nonprofit entity established by the state to represent residential and smallbusiness customers in utility rate cases.

In testimony before the ICC, both Raoul’s office and CUB argued future customers are not entitled to the benefit of a refund because they aren’t the ones who paid the higherthan-necessary rates. They also argued the

longer payout period will mean that many customers who were charged higher rates prior to the change in tax law will never see their full refund.

CUB argued in favor of a seven-year payout schedule while Raoul’s office argued for five years.

“We completely agree that it’s only right that ComEd and Ameren consumers get their money back over a more reasonable time period,” Chilsen said in an email statement. “Making customers wait decades to get their money means that a significant number of those customers won’t be able to enjoy their full refund. That’s not right, that’s not fair.”

He also noted that many other states — including Missouri, where Ameren also operates — have adopted 10-year payout schedules.

The ICC has not said whether it will grant the request for reconsideration.
