respondents: Mimiko, the Labour Party; the Independent National Electoral Commission; the Resident Electoral Commissioner in the State, Mr. Akin Orebiyi and the Returning Officer, Prof. Biyi Daramola. He claimed that he possesses substantial proofs that there were massive violation of the electoral act and irregularities in respect of the election which would not make CPCC to accept its outcome.

B E O K U TA — TRAGEDY struck in Onigbedu, a community in Ewekoro Local Government Area of Ogun State on Sunday when a tenant identified as Akinyemi Oguntula was stabbed to death by his Landlord’s son, Bankole Suderu over a misunderstanding. The deceased who was popularly called Pastor, was a staff of a cement company before he was allegedly killed in the early hours of last Sunday for complaining against the smoking of Indian hemp by the alleged killer and his friends. DO EKITI — Council workers in Ekiti State yesterday resumed at their duty desks in all the 16 local governments after more than two months of strike action The workers operating under the aegis of Nigeria Union of Local Government workers (NULGE) had embarked on a strike action for the past two months to press home payment of N19,300 minimum wage and the payment of special allowance for the health workers. KURE — THE Labour Party (LP) yesterday asked the Action Congress of Nigeria to prove its allegations of irregularities in the Election Petition Tribunal and stop its frivolous remarks in the media over the victory of Governor Olusegun Mimiko in last election. The ACN's Media Assistant, Mr. Idowu Ajanaku had over the weekend attempted to

rationalise the reasons the party was in court, mentioning allegations bordering on criminal practices against both the LP and the Independent National Electoral Commission (INEC) which they insisted resulted in the election victory of Dr. Olusegun Mimiko. However, the Labour Party in a statement in Akure berated the ACN, saying that once a matter is in court, it becomes prejudicial to make it a subject of media analysis

as the ACN is now doing. According to the LP’s Publicity Secretary, Mr. Femi Okunjemiruwa, “the position of the law is that once a matter is in court, nobody should comment on it in the media. “If you go to court with weighty allegations as the ones being made by the party, it behoves on you to be ready to prove these allegations rather than resorting to media rigmarole. "They ought to be aware

of the legal maxim which says he who alleges must prove.” The LP spokesperson, while stating that even from the tirades of the ACN as enunciated by its media manager, it was obvious that they were a bunch of confused people, merely out to play mischief rather than be serious at the tribunal. “While we are not going to join issues with those who are, from all intent and purposes, not ready to subject themselves to the rule of the court

considering their posturing in the last few months before, during and after the election, we would like to say that some of the issues raised were pre-election matters and not election matters."
