Mayor’s CSU chief manhandles 2 men, 2 women in drunken fit

By Paul Libres ORMOC CITY – The chief of the city government’s civil security unit here mauled four people, including two females, in separate incidents that happened early this morning (December 13).

The CSU chief was allegedly drunk and armed and had unidentified people with him, presumably goons, when the incidents transpired.

In hot water is Gerry Seledio, handpicked by Mayor Edward Codilla to head the city’s civil security unit.

The victims of Seledio were identified as Fernando Panta, 44, a member of the CSU himself; Julieta Tacuban, 53, a “job order” of the city assigned as toilet cleaner of the city bus terminal; Landy Pamador, 28, from Kananga, Leyte and Gelma Perez, 25, a student at the Sto. Nino College here.

Gelma Perez, the student, was the first one to report to the police that she was slapped by Seledio just because he was irked by the ruckus her motorcycle was making.

SPO3 Danilo Rebato, officer-onduty, said that soon after Perez reported the incident, Seledio himself came to the station and talked to Perez. The two agreed to settle the matter in the presence of police chief Sr. Insp. Rio Tan today, Saturday.

Rebato said he did not see the need to detain Seledio, as he had already come to an agreement with Perez. Perez is a student of Sto. Niño College, an owner of which is the family of city councilor John Eulalio Nepomuceno Aparis.

However, by daybreak, three more victims of Seledio’s abuse arrived at the police station to report their woes.

Landy Pamador said that Seledio put a gun into his mouth, threatening to blow his head off. He told police he was sleeping at the city stage when Seledio woke him up and started manhandling him. Pamador said that he was in Ormoc to look for a job.

Fernando Panta and Julieta Tacuban, on the other hand, are also employees of the City Government assigned to the City Bus Terminal.

Panta, 44, is a member of the CSU unit himself. He told police that Seledio arrived at around 2:30 AM and started scolding him for “sleeping on the job.” When he retorted that he was not sleeping but just sitting down, Seledio got irked and boxed him on the torso four times.

Lawig Fest 2014 a success despite Ruby’s threat

PALOMPON, LEYTE – Last year, officials here had to shelve holding the 3rd Lawig Festival on December 2, because the town was still reeling from Yolanda. But this year, despite the threat of “Ruby” last December 2, there was no stopping the festival as contingents tried to outdo each other in interpreting their festival of thanks to their patron saint, “Sr. San Iko” or St. Francis Xavier.

This year’s festival was made more significant and richer as contingents injected how their town and its people recovered despite being struck by Yolanda. In previous years, it was more of a festival to celebrate the town’s bounties. This year, adding flavor to it was the contingents’ show of gratitude to how the world embraced their town and help it out the rut.

Palompon takes pride in being one of the coastal towns that easily bounced back from Yolanda’s wrath.

Silently, its officials led by Mayor Ramon Oñate and Vice Mayor Georgina L. Arevalo reached friends to help the town. Humanitarian agencies were in the town in no time and were helping residents rebuild their homes and their lives, and also the public infrastructure.

Mayor Oñate, on the other hand, said that the Palomponganons innate nature of being cooperative also helped in the town’s fast recovery.

By the end of 2013, they were already ready to welcome a luxury cruise ship and hundreds of visitors, as they tried to restore its tourism industry that had

began to blossom the year before.

They were not disappointed. This year, the town was cited as “Most Tourism Friendly LGU” in the whole country.

PIT takes the crown from Taberna NHS This year’s festival showdown winner for the Major Caterory consisting of high schools, colleges and institutions, was the Palompon Institute of Technology (PIT). They wrested the crown from the Taberna National High School which held it for two years straight.

PIT’s keen interpretation of how thankful the town was to the humanitarian agencies, to include a “helicopter”, apparently caught the judges’ approval.

There were no “higantes” this year to portray the Spanish conquistadores and missionaries of old who “developed” the town. Instead, the higantes were supplanted with paraphernalia to portray global compassion and response.

NPAs burn 3 dump trucks, 1 backhoe of Hanjin-Yakal ORMOC CITY – Three dump trucks and a backhoe owned by the Hanjin-Yakal consortium which is working on a P 2.2-billion contract in Eastern Samar, funded by the Millennium Challenge Corporation (MCC), were torched by members of the New People’s Army at around 9:00 in the morning of Wednesday, December 10.

Maj. Gen. Jet Velarmino, 8th Infantry Division commander, told media that the torching happened at the contractor’s quarrying site near Binalay River in Gen. MacArthur town in Eastern Samar.

Accordingly, an estimated 20 armed men swooped down on seven workers who were on site and demanded for them to leave. After which, they torched the heavy equipment.

Velarmino also slammed the NPA, saying that they have taken advantage of the situation when people were still suffering from the aftermath of Typhoon Ruby and the Army were busy helping in the relief efforts.

Soliman proposes cash shelter aid for Ruby victims TACLOBAN CITY -– The Department of Social Welf a re a n d D e v e l o p m e n t (DSWD) is seeking to grant cash assistance to families in three Samar provinces, whose houses were destroyed by typhoon “Ruby”.

DSWD Secretary Corazon J. Soliman told Tacloban reporters today that they are now drafting the proposal up for submission to the Office of the President on Monday.

“The amount is still the same – P30,000 for each families with totally damaged houses and P10,000 for those with partially damaged houses,” said Soliman, who just came from Eastern Samar to lead the distribution of relief goods.

The DSWD is now making sure that the list of beneficiaries is accurate before coming up with proposed amount for emergency shelter assistance (ESA).

The official is optimistic that President Benigno C. Aquino III will approve the proposal. Distribution of cash is targeted before the end of January.

Initial reports from the Department of Social Welfare and Development showed that 107,835 houses have been destroyed by typhoon Ruby, with 82,102 totally damaged and 25,733 partially damaged.

Of the number, 35,345 are in Eastern Samar; 41,566 in Northern Samar; 23,187 in Samar; 7,504 in Leyte; 188 in Biliran and 51 in Southern Leyte.

The International Organization on Migration and the United Nations High Commissioner for Refugee will ship tents and tarpaulins to decongest evacuation centers in Samar provinces where nearly half million people are still taking shelter.

The other side of Samar which was not badly hit by Yolanda in 2013 is in bad shape after Ruby made landfall between Dolores and Borongan City. NHA distributes around 5,000 shelter kits to 4th district of Leyte residents

The provincial government of Leyte has placed Leyte province under a state of calamity Tuesday afternoon, during the regular session of the provincial board.

Leyte Vice-Governor Carlo P. Loreto said that even if the province is still under a state of emergency due to typhoon Yolanda, the declaration is necessary to facilitate inventory of equipment and downloading of assistance to the provincial government to help affected residents.

Loreto said the declaration will allow local government units to use their calamity funds and will provide employees an access to calamity loans from the Social Security System and the Government Service Insurance System to finance the repair of damage properties.

The provincial government has enough calamity funds, but the official declined to disclose the amount.

Governor Leopoldo Dominico Petilla reported that typhoon Ruby’s impact is worse in the northeastern part of the province, particularly the towns of Barugo, San Miguel and Babatngon.

MATAG-OB, LEYTE – The National Housing Authority (NHA) distributed almost 5,000 shelter kits to various towns in the fourth district here, just days before Typhoon Ruby struck the region.

Rep. Lucy Torres-Gomez said that it was exactly one year after she knocked on the doors of NHA to help constituents rendered homeless by Yolanda last year, when the promised shelter kits are finally available.

Nonetheless, she told recipients, they should still be grateful that it has come.

She also admonished them to secure the kits well, and not work on it yet since Ruby was coming in one or two days.

Dorcas Secreto, NHA state management specialist, said the distribution was delayed because the government procurement process is long. The NHA distributed to Matag-ob 558 shelter kits on December 6.

Ms Secreto added that despite the storm warning, she would continue with the scheduled distribution the next day which will be in Merida. There, they would give out 758 shelter kits.

There are also around 1,300 for Isabel residents and another 2,000 for Kananga residents.

Vice Mayor Michael Torrevillas, together with the town council, welcomed the shelter kits from the NHA, saying there were still some constituents that have not received any from donor agencies.

He also lauded the congresswoman for her sincere effort to help Matag-ob residents.

The congresswoman is well loved in Matag-ob, especially that she has lived to her promise to do her best to have the Matag-ob-Palompon road concreted during her incumbency. It seems that as time goes by, a lot of friends and acquaintances are going to the blue yonder, making us ask the question: when’s our turn?

THAT’S what Christ said! “Take my yoke upon you and learn from me, for I am meek and humble of heart, and you will find rest for yourselves. For my yoke is easy, and my burden light.” (Mt 11,29-30) I’m quite sure that at first reading and simply relying on our native attitudes in the raw, these words will strike us as funny. We can dismiss them, saying, “Tell it to the marines!” How in the world can things be easy and light when our immediate perception of things in general point precisely to the contrary?

Even without inputting the faith, life is already full of hardships. We have to contend with our weaknesses—physical, emotional, psychological, etc. Then the endless challenges and difficulties of life—the trials, setbacks, pressures… The world would not be enough to record all the possible problems and complications we can encounter in life.

And if we input the requirements of faith and of the spiritual and moral laws, things become even more difficult if not impossible. Christ already warned us that we need to enter by the narrow gate, we have to deny ourselves and carry the cross, we have to do some violence to enter heaven.

Christ himself, who is supposed to be our “way, truth and life,” begged the Father in his agony in the garden to let the cup pass by him, knowing what tremendous sacrifice he had to do by offering his life on the cross.

In our case, we know that in spite of our best efforts, we can still find ourselves wallowing in the mud of our own stupidities. Even those of us who consider ourselves good and holy are often afflicted with the most deceptive illness of self-righteousness, bigotry, pride.

Yes, we can do a lot of good things, we can affirm a lot of truths of our faith, we can burn with a certain holy zeal, and yet quite often, evil, in all its forms overt and mostly hidden and subtle, undermine if not nullify them.

We have to contend with the erratic impulses of our weakened flesh, the many temptations in the world, and the wiles and tricks of the devil.

We are told that we are ranged against powerful spiritual enemies. St. Paul warned us so: “Our wrestling is not against flesh and blood, but against principalities and power, against the rulers of the world of darkness, against the spirit of wickedness in the high places.” (Eph 6,12) Christ’s yoke is easy and his burden light?

Before we say, no way, let’s see if we are missing something we ought to know. Let’s review more closely the words of Christ. There we will realize that he is asking us to learn from him because he is meek and humble of heart.

That, I think, is the secret. The meekness and humility of Christ is the way for us to accept anything in this life and end up considering his yoke to be easy and his burden light. He is telling us that with his meekness and humility, we can be patient and can take on anything in this life, no matter how hard and impossible they may be, humanly speaking.

The Civil Security Unit chief of the City Government of Ormoc has apparently made a mess of himself after going around the city drunk and manhandling at least four people.

In doing so, he was also seen in a company of men (goons?) who did nothing to stop him.

Maybe he was dispensing a lesson in Goonism 101? God forbid if he starts teaching them masteral courses!

The CSU chief’s fiasco will be Mayor Edward Codilla’s acid test. Will he have the IT to kick out one of his trusted men? He must be very trusted to land the coveted post.

The chief CSU position, if I am not mistaken, has a salary of around P 1,000 a day.

That’s P 30,000.00 a month and that’s a lot of moolah. Throw in the perks of a 13th month pay, a signing bonus, and more, oh la la, that is money down the drain. That is, if the complainants will not compromise.

In this city of compromises, even policemen who kill young men in public are “forgiven.”

What really happened when FVR and Duterte met WHEN FORMER President FIDEL RAMOS and Davao Mayor RODRIGO “Digong” DUTERTE met in Davao City a month ago, the several events where they were seen together, their public body language and the reports that ensued were “combustible” enough to start a political fire. And kept political tongues wagging. Well, let me give you some “inside” story if I may to somehow clear the air. But first, a word of caution: I have not gotten the prior permission of FVR nor of Mayor Digong to somehow disclose what took place behind closed doors, but I’ll take my chance anyway, so here goes.

I got this call requesting if I could arrange a “one-on-one” between FVR and Mayor Digong during his overnight visit. This was no big deal because FVR, in the long time I knew him up close, would always seek “private time” with

hosts, especially with close friends for re-unions and informal chats. So I requested BONG GO, the mayor’s “man-friday” to arrange things. In a jiffy, I got word that it was okay and so PAUL DOMINGUEZ, a former FVR” boy” like me and I were at the 17th floor of Marco Polo Hotel that Thursday afternoon chatting with FVR ( who just met with one of his friends in the BIMP EAGA, MS SUSAN CHANG from Kota Kinabalu) when Mayor Digong walked in with a bunch of reporters trailing behind. Paul and I conducted them to the boardroom and when they both got seated, I and Paul headed for the door leaving the two behind saying: “We’re just outside.” But, oooops, FVR called out: “Where are you two guys going? I need you both here”.

Whether we like it or not, the spirit of the yuletide season obviously ushers in and fills the air. As expected, business establishments are coming up with fitting marketing strategies to pop-up their respective revenues and maintain or even improve their corresponding shares in the market pie.

The month of December has always been dubbed as the busiest month, not only for businessmen but for ordinary citizens as well.

Such highly commercialized Christmas celebration is a major factor in the rise of inflation incidence or the overflowing of money in the money stream. The law of supply and demand is highly defined in this part of the year where people tend to spend much, courtesy of highly orchestrated adverts and other marketing plums.

What the business operators are giving in the form of mandated 13th month pay and optional bonuses to their employees are siphoned back to their respective coffers as the windfall recipients are tempted to indulge in unlimited shopping sprees. Still, the last laugh goes to the business-

The feast of the Immaculate Conception 2014 WE HAVE just celebrated the Feast of the “Immaculate Conception” last 8 December.

In this connection, this corner finds it timely to quote the following pertinent narrative taken from The Five Minute Homilies of Msgr. Arthur Tonne,1979: “Hundreds of years before the Blessed Virgin was born and before Jesus was born, the enemies of the people of God laid siege to the city of Bethulla. The citizens were about to surrender when a pious young widow named Judith warned them that it was a sin not to trust in God. “God’s people listened. They prayed and did penance. Judith begged God to make her strong and brave. Then she dressed in her finest and with one of her maids went to the leader of the enemy, a fierce warrior by the name of Holofernes. He was attracted by the beauty of Judith and ordered that she could come and go as she pleased.

“On the fourth night, this general gave a dinner for his friends, and invited Judith. Holofernes drank too much wine and fell into a deep sleep. After everyone had left, Judith prayed: “Strengthen me, O Lord, that I may act according to Your will.” She took the sword hanging by the bed of Holofernes and cut off his head. She put it in a bag carried by her maid, and hurried back to the Israelite camp. Talking dog moment of her conception in the womb of her mother, St. Anne, was freed from all sin, even from original sin, by the foreseen merits of her son, Jesus. This is the truth we celebrate today, the truth God promised to Eve in the garden of Eden, “the woman (Mary) shall crush the head of the serpent, the devil.”

“But the devil is still “roaming seeking whom he may devour,” isn’t he? Definitely and that means he has to be conquered in every age and by every person . the devil is very much with us. He tries to mislead every soul in the world. He tries to lead into sin groups , like families, organizations, races, communities, even sacred communities like a parish. He leaves his horns and pitchfork down in hell and comes to us in the mask of an attractive person, an intelligent or generous person, any form that will deceive us. He tries to make us forget about Christ by making us interested in anything and everything that will crowd out Christ.

“This he especially tries to do as we approach the birthday of Christ. A real Christ-mas with Christ in the center makes the devil sad and mad. He tries to interest us in the tinsel and trappings of the Christmas season rather than the center of it all -- Christ on the altar.

Don’t let him fool you. With the help of our Immaculate Mother, we will crush his sneaky head. With the help Mary obtains from her divine Son, we will like her, like Judith of old, crush the enemy of God, the enemy of God’s people. God bless you.”

With this narrative, we can readily see the role that Mama Mary plays to make us see the error of our ways and make amend for our sins.

Let us make an effort to bring back to God our offending neighbors, friends, family as our gift to Jesus Christ. After all, Christmas is also His birthday! There can be no better gift than this: avoid sins.

WHEN I WAS GROWING UP, we have always had many dogs at home – not the purebreds that are popular now but the natives or azkals. Nevertheless, my close affinity with dogs has made me unafraid to approach even the most unruly.

Now for the fun part. What if your dog could greet you with more than a bark, or tell you the reason why it has to be taken for a walk?

Scandinavian scientists are working to develop a headset that could soon allow our dog to speak its mind.

The technology, called “No More Woof”, aims to distinguish canine thought patterns and then issue them as short sentences via a microphone.

According to scientists, the brainwaves differ quite a lot from different races as well as individual dogs. But it is possible to detect some common patterns and they are sure that in the future this technology will open up a vast new era of communication between dogs and humans, or animals in general and humans.

“No More Woof” is the result of combining the latest technologies in three different tech-areas - EEG (electroencephalography) sensoring, micro computing and special [braincomputer interface] software, researchers revealed.

The operating system relies on sensors in the headset which detect electric signals in the dog’s brainwaves. Technology from an in-built processing device then analyses the signal patterns and deciphers them into distinct feelings like anger, curiosity or tiredness.

Sample sentences such as “I’m hungry

but I don’t like this food!” or “I wonder who that is?” will be programmed into the device and emitted through a loudspeaker.

English translations will be available, but French and Spanish language headsets will come later, the researchers say.

How exactly scientists will attach the sensors into a dog’s brain has yet to be ironed out. Issues like this, as well as the ethical and social concerns, are the reason why there’s more research to be done before the technology becomes available.

The headsets are, however, available for prepurchase on indiegogo as part of the research funding campaign, with three different versions that range in functionality and price.

You might have to wait a while for the first prototype to arrive, but the implications are enormous, the researchers say.

And as friendship is a two-way street, it’s only fitting that the scientists are also aiming to develop a reverse headset for humans to bark their way into the hearts of their canine friends.

Other applications and accessories the researchers have in their future include a “Pavlovian training kit,” with original instructions by the physiologist Ivan Pavlov, to further the owner-pet bond through the use of play and classical conditioning.

When the first model comes out in the market, it will be very crude. But remember, the first airplane, car or even computer were ridiculously “weird” compared to the latest versions.

Fractures DURING TIMES of emergencies, some of us may sustain injuries related to falls.

This would sometimes lead to swelling of the leg, ankle, knee or arm - depending on the part involved in the fall. The worse that could happen during a fall is sustaining a fracture.

A fracture is a break in the continuity of the bone. It is usually caused by high impact force or trauma; or caused by a minimal trauma injury as a result of certain medical conditions that weaken the bones, such as osteoporosis, bone cancer or osteogenesis imperfecta, where the fracture is then properly termed a “pathologic fracture.” There are many ways to classify fractures. A fracture could be classified as closed or open, depending on the presence of a wound or just a plain swelling without a skin opening. It can also be classified as incomplete, complete or comminuted.

An incomplete fracture of the rib is the least harmful type of fracture because it may not need surgery and/or splinting because the neighboring intact ribs will serve as a splint.

A splint is any hard object that is attached or tied to a body part with a fracture to minimize movement and facilitate healing. The rib has a limited range of motion. Thus, a few incomplete rib fractures will just heal on its own. A complete fracture happens when bone fragments separate completely. Depending on the orthopedic surgeon’s and patient’s decision, such fractures could either be fixed internally (open surgery)using stainless metallic splints and screws, or externally by immobilization or casting (like some injured persons got their leg or foot cemented for a few weeks). The third type of fracture is called comminuted fracture where in the bone is broken into several pieces which makes the repair more complicated. It usually requires opening the area of the fracture to facilitate splinting and implantation of splints to facilitate healing.

The signs and symptoms of a fracture is usually swelling, pain on mobility and a limited range of motion sustained after a fall.

However, it can also mimic the symptoms of sprain. A sprain is caused by injury of an overused muscle(s) leading to a painful stretch of its ligaments (muscle attachment to the bone) or worse, it could be caused by a tear of its ligaments.

The best thing to do when sustaining such injuries is to RICE. R-rest the involved muscle(s), I - apply ice for 10-15 minutes, 3-4x a day, C - compression which involves wrapping the injured area with elastice bandage to minimize swelling and provide support. And lastly, E - elevation to minimize swelling. This first aid tip is very useful in managing sprains as it facilitates healing.

However in bone fracture, it can only decrease tissue swelling and the fracture must be assessed by an orthopedic surgeon to be able to provide the best care possible with the most successful treatment outcome.

Smokers generally have lower bone density than non-smokers, so they have a much higher risk of fractures. There is also evidence that smoking delays bone healing thus delays fracture healing. Thus smoking cessation does not only save the lungs but the bone as well.

After sustaining a painful and swollen arm or leg with limited mobility after a fall, I do not advise going to the “manghihilot” without doing an X-ray. X-rays are simple and affordable tests to detect fractures. Many would initially seek the help of the “hilot” and would often find temporary relief due to the oils applied by the “hilot”. These oils are usually hot with certain aroma. The heat that the oil brings to the skin masks the pain brought about by the broken bone and swollen muscle thus affording temporary relief.

If one goes to the “manghihilot” and has a fracture, the manipulation may add injury to the broken bone and cause more swelling to the surrounding muscles. Thus, it is best to consult your doctor first and get an X-ray.

Freshen Up the Stinky Garbage Disposal “Lemon rinds ground in the disposal will deodorize your sink’s drain 1-2-3,” says Edelman.

“And bonus, unlike vinegar, which leaves no scent, lemons provide a clean, crisp aroma.” Just slice a lemon into chubby quarters, slip them into the sink’s disposal, turn on the hot water and flip the power switch. Run the disposal until you hear the “gurglegurgle-grind-grind” sound—when that noise stops, it means the lemon is chopped and swallowed up.

Turn off the disposal.

Put a Shine on Metal When it comes to copper, brass and chrome, nix harsh chemical polishes and instead put some elbow grease behind half a lemon. “Lemons are highly acidic, which enables them to cut through and loosen mineral deposits, making them easier to wipe away,” says Edelman. For extra oomph, before scrubbing, dip the fruit half in salt—it will help exfoliate the surface for added shine.

Sanitize the Microwave The lingering smell of popcorn, pizza and whatever you might have heated up recently can overwhelm a microwave. Edelman’s advice is to cut a whole lemon into super-thin slices and put the pieces in a microwavable bowl. Fill the bowl with hot water, place in the microwave and cook on high for one minute. The citric acid’s antibacterial properties will kill bacteria while the heat works like a humidifier to loosen icky, caked-on food. Afterward, wipe the oven with a damp cloth.

Nix Soap Scum in the Shower Instead of tending to the shower tiles, doors and fixtures with an abrasive chemical treatment, use this homemade natural remedy: Juice six lemons and pour the contents into a spray bottle. “The citric acid will break down hard water deposits and dissolve filmy soap scum,” says Edelman. “Also, the antibacterial and antiseptic properties will sanitize the space.”

Deodorize the Laundry It doesn’t take much to combat the odors of work, the gym and the everyday grind. Adding just one teaspoon of lemon juice to the laundry along with detergent will provide a fresh, clean scent to socks, undergarments and other clothing.

Wash the Windows Four tablespoons of lemon juice (either fresh or out of the bottle) mixed with a half-gallon of water makes an effective window cleaner—sans chemicals and streaking. The powerful citric acid dissolves dirt, grime and water stains, leaving your windows sparkling.

Sanitize a Cutting Board Spruce up that kitchen workhorse—the cutting board—by squeezing a lemon half over the top and letting the juice absorb for 10 minutes. (It soaks into wood especially well, but this also works on plastic cutting boards.) This will loosen stains. Next, kill bacteria by using the fruit to scrub the board.

Clean Hard-to-Reach Places Make a paste of lemon juice and borax. With a toothbrush, use the fresh-smelling cleanser to scrub tiles and around drains. This mixture is also ideal for all those evil nooks and crannies!

Of the 57 graduates in SMAW, 25 were Private Education Student Fund Assistance (PESFA) scholars, 13 were UNDP scholars, while 19 were from other private scholarships. For housekeeping, 23 were PESFA scholars while the other 2 were private scholars.

SMAW graduates completed 268 hours while for the Housekeeping, they finished 436 hours of training which started September this year.

They will be deployed to onthe-job-training where OSPA Training Center will help refer them to potential employers.

I am so sorry anak , I cannot bear to think how painful your ordeal was that day . I know you love water and rain but I also knew how scared you were when the howling sounds and gustiness of the winds , its deafening and shrilling sounds that you hid under the lavatory and you refused to come out . Learning this from yaya made me so guilty because I knew If I was with you that time you would have embraced me like you used to before every time you’re upset and afraid of something . When all of you were outside trying to seek shelter from our neighbor’s house you were trying to let go from your yaya’s grip because perhaps you wanted to go back home thinking we were left there . And when that piece of GI sheet cut your left ankle , I cannot imagine the terrible pain you felt during those two agonizing hours , so excruciating that you eventually sat down on one corner of our neighbor’s gate because the pain was so unbearable and that time ……… I wasn’t with you , Anak . How I wished I was with you that time perhaps I could have eased and soothed the pain . Even though you cannot talk , the fact that you sat there with a bounty of tears swelling in your eyes was more than enough telling and asking from them where mommy , daddy , ate cheska and baby Andrei were. No one has come to your rescue and comforted you during those times of agonizing pain amidst the freezing cold. All your cousins were hurt , yaya , your tita Juvy and lola Pesing was unconscious . I could not imagine that while we were in the school , you were fighting for your life .

Forgive me … I miss you… I love you …… these are the only words I could fathom . Months had passed that I was groping in the dark slowly struggling to survive the pain of loss dreaming one day , I will wake up one morning basking on the first ray of sunshine to beckon a new beginning of hope . I know that day will eventually come .

An angel now in heaven, you are my guiding star. With the good samaritans who came and helped us during troubled times ,who became our shield and refuge amidst those enormous adversities and uncertainties has made me even stronger in overcoming the challenges of judgment and persecutions from unscrupulous people and abandonment from those you relied the most . I know deep inside me you were always around , smiling .

Gleaning from how far I have come after the tragedy , I could say I am moving on and getting there .

My burning desire of holding on to the wonderful memories I had with you never fail to inspire and gave me courage to pick up the pieces of the broken dreams I once had and pursue to continue my passion and advocacy to promote awareness campaigns and projects in autism .

We have to make sure that we grow in meekness and humility which can serve as the doorway for faith, hope and charity to enter, stay and develop to maturity in our life.

Although suffering will always be suffering in whatever form it may come, somehow we are also afforded some kind of mysterious anesthetic, made up of faith and charity, that would enable us to go through that suffering without much drama, just like what happened to Christ while dying on the Cross.

Truth to tell, not anyone of us talked about any endorsement of Mayor Digong for the presidency nor did we egg him to run for president, as some quarters had been speculating. Although I must admit, a possible Duterte candidacy for the presidency was at the back of our minds.

Instead, it was a friendly chat -- stocktaking and updating each other around the table -- and reminiscing. We threw around the table a few tidbits. But Mayor Duterte, for most of the time, was only intently listening.

FVR talked about his own experience when he ran for president. He recalled how he even had no political party when he started. He even lost the presidential nomination of the administration party, the LDP to House Speaker RAMON MITRA. Then he ran -- and won -- against a phalanx of heavyweights like MONCHING MITRA, DANDING COJUANCO, MIRIAM DEFENSOR SANTIAGO & IMELDA MARCOS. He recalled how he had to doubly work harder and had to leave Mindanao in the last leg of his campaign to focus on Metro Manila as he was losing heavily there. He talked about not relying totally on politicians, although they helped deliver the votes, but generate support from private groups, NGOs, volunteers. He talked about the parable of an oil drop in a big lake. Not one drop but many drops then a thousand drops can make a difference. He talked about former Indonesian President LUCILO BAMBANG, his colleague at the West Point Academy in the US during their cadet days who called on him and sought his advice on his (Bambang’s) presidential plans.

Paul Dominguez shared what he learned about the results of a deep study where it was

established that most people or voters choose candidates on the basis of what the officials can do -- or are perceived to be able to do --to them personally or how the candidates handle things that personally matter to them ( the voters) and not on the basis of whether or not they are corrupt or are perceived to be corrupt or for other factors.

I recalled that in my recent travels ( Iligan, Butuan, Surigao, Cagayan de Oro) ordinary folks or the “masa” whom I talked with, still had not changed, thus far, on their support for Vice President Binay as their candidate for president in spite of the frequent media bashing he was getting. I recalled what one political analyst in Iligan told me his theory or estimation that “the political fates of Binay and Duterte are now closely linked and intertwined; that they are inversely proportional to the other”. Meaning, if Binay further drops in the next surveys, Duterte will have a good chance of becoming the next president; if Binay however recovers or stabilizes and arrests the fall, Duterte will have a hard time winning. It was his political calculus that smacks right into today’s realities. It remains to be validated though but it’s interesting.

Then there was a discussion on how times have greatly changed due to technological advances in cyberspace with the swiftness and almost instantaneous transmission of information to the big, wide world in a flash by a flick of a touch. Hence, even political decisions to run and campaign for public office can be communicated much later in the day and candidates who are ahead in announcing their candidacies much earlier need not necessarily enjoy a big advantage over a johnny-come lately guy. So there’s no urgency of any early announcement as yet for the 2016 Elections.

There were other intimate items that

need not be disclosed here. Of course, obviously those talking points had some cogency to Duterte’s reported run for the presidency.

SECTION 2. OBJECTIVE This ordinance aims: a. To provide a deterrent to crimes and vandalism. b. To enable clear identification of miscreants within the range of the cameras. c. To provide continuous recording of all cameras in the system. d. To be a tool in the early solution in identifying the perpetrators of crimes.

SECTION 3. DEFINITION OF TERMS The definitions and provisions contained in this section shall govern the construction, meaning and application of the following words and phrases used in this Ordinance. a. “Bank” means an establishment whose primary function is related to the custody, loan, exchange, issuance of money, extension of credit, or transmission of funds. This includes pawnshops or money transferring centers or offices, lending institutions, and cooperatives. b. “Shopping store” means Building or series of buildings containing a mix of four (4) or more commercial establishments in a single development or on a single parcel. This includes mini groceries, convenience store c. “Video Surveillance System” means a digital surveillance system including cameras, cabling, monitors, and digital video recorders (DVRs) that records in color with cameras and lens of a type, minimum resolution, number and locations approved by the Chief of Police of Palompon Police Station or his/her designee. This system must be capable of producing retrievable and identifiable images and video recordings on an approved media that can be enlarged through projection or other means, and can be made a permanent record for use in a criminal investigation. It shall also include without limitation any closed circuit video cameras (CCTV) or other cameras, video recorders, digital cameras [or], digital recorders or other technological devices used in the above manner. d. “Feeds” refer to the visual information transmitted by the CCTV Cameras. e. “Monitors” refer to the screen or other devices on which the feeds are viewed.

SECTION 4. VIDEO SURVEILLANCE SYSTEM REQUIREMENT a.) All banks, cooperatives, department stores, Philippine Port Authority, secondary schools, colleges and universities, gasoline stations, pawnshops, lending institutions, convenience stores, and similar establishments are hereby required to install a Closed Circuit Television (CCTV) or video surveillance system. b.) The Municipal, National, Provincial Government concerned and Government Owned and Controlled Corporations (GOCC) shall likewise install Closed Circuit Television (CCTV) in public buildings or places like markets, pier, entrance and exit points, public and private terminals, plazas or parks, main thoroughfares particularly in the entrance and exit points of the municipality as maybe recommended by the Chief of Police, Palompon Police Station. c.) Such establishments or government agencies, which installed surveillance system prior to the effective date of this ordinance, shall ensure they are in full compliance with this ordinance, upon issuance of compliance certificate from the Office of the Mayor. d.) The video surveillance systems shall be maintained in proper working order at all times and shall be in operation at all time of operation, or at the option of the owner, seven (7) days a week, and shall meet the minimum technological standards established in this ordinance. e.) The CCTV cameras and other video monitoring devices shall be zeroed in baggage counters, entrances or in any strategic areas of the establishments as determined by the owners/management.

SECTION 5. FEEDS, VIDEO RECORDINGS The establishments shall retain the continuous digital images recorded by the system for no less than fifteen (15) days for review and reference purposes. After 15 days, the feeds or recordings may be disposed of at the lapse of such period at the option of the owner. The feeds or digital images recorded by such system may be presented when required by a court of competent jurisdiction, the Local Police, National Bureau of Investigation (NBI), Criminal Investigation and Detection Group (CIDG), Philippine Drug Enforcement Agency (PDEA) and the Mayor as the case may be.

SECTION 6. ACCESS TO RECORDINGS If a crime occurs or an employee believes that a crime is committed, the concerned business establishment shall immediately contact the Palompon Police Station through the Chief of Police or his/her duly authorized representative and provide immediate access to the media the CCTV/video recording thereof.

SECTION 7. PROHIBITION It shall be unlawful for any person to allow the unauthorized or unofficial use or viewing of any saved video-recording and the unauthorized public identification of any person or client seen in the video. The same shall not, in any manner be used to infringe with privacy of individuals; and those found in violation shall be prosecute for laws violating the right to privacy.

SECTION 8. PROPER REQUEST FOR FEEDS The feeds may be used at any time to satisfy the written order of any court of competent jurisdiction or any authorized subpoena. The Video feeds may only be viewed by the Police, persons of authority, and or any person involved in any way with the case if crime has been committed in the establishment or nearby establishment where it is believed that the CCTV of the said establishment has recorded a significant occurrence.

SECTION 9. NO BROADCASTING Subject to section 6 above, the Feeds shall not be: 1.) Viewed by any person/s other than employees who are authorized to view the monitors; 2.) Transferred to any third party, whether for profit or not; or 3.) Recorded or otherwise stored except in accordance with this ordinance.

SECTION 10. MINIMUM TECHNOLOGICAL STANDARDS The CCTV or video surveillance system must be capable of delineating on playback of the system the activity and physical features of persons or areas within the premises and must be able to record such images on air approved form of media. For this purpose, it shall have at least met the following specifications: 1. Have one dedicated channel for each camera in operation; 2. Shall record at least 64by480 recording resolution level; 3. Shall have the capacity to record at fifteen frames per second, per camera. For example, a system with ten (10) cameras would need to have a DVR capable of recording at least 120 frames per second.

4. Shall have enough memory to retain data from all cameras for a period of fifteen (15) days.

5. Possess the ability to view and retrieve data while the system remains in operation.

6. Possess the ability to produce DVD-R copy of desired data for evidentiary purposes on a

NOTICES format playable via Windows Player to a standard DVD player.

7. Possess the ability to time stamp and “watermark ”the recorded images.

8. Shall be placed in a locked and secured location to prevent destruction of tampering.

Cameras 9. Operate with a minimum of 700 Total Vertical lines (TVL) of resolution 10. Shall have the ability to record colored images during sufficient lighting 11. Night vision capability. (ex. Infra Red) 12. Each camera shall be matched to each specific application taking into consideration: 12.1. the distance to target image 12.2. “Lux rating” or compatibility with the amount of light available to include excessive amounts of sunlight 12.3. View angle of camera in relation to area of a desired coverage 13. Each camera shall have a clear and unobstructed view of the area of desired coverage.

14. At least one (1) Camera shall be positioned to eye level to capture “Head and Shoulder” images at exits, entrance and points of sale locations.

Digital Video Recorder Monitors 15. Each system shall have a monitor that may be assessed by the Police department and other law enforcement agencies for viewing of the recorded images.

16. The monitor shall be of a Liquid Crystal Display (LCD) design with a screen no smaller than fifteen diagonal inches.

Power Supply 17. Each system shall have a dedicated power source to prevent intentional or accidental deactivation and preferably provided with uninterrupted power supply (UPS) SECTION 11. MINIMUM COVERAGE STANDARDS, SITE ASSESSMENT, SIGNAGE a. The video surveillance system shall have at a minimum four (4) separate cameras dedicated to each register/check-out stand, entrance/exit, and parking lot or area designated for customer and/ or employee parking use, and facing the street. b. The placement of cameras included in video surveillance systems required under this Ordinance shall be approved by the Palompon Police Station. c. The Chief of Police or his/her designee shall conduct an assessment of each site required to Municipal Mayor and the respective representatives install a video surveillance system prior to installation, and upon approval notice which will be placed on plain view inside the premises. This approval notice will also inform customers and employees of the existence of the video surveillance system. A separate notice of the video surveillance system, in a form acceptable to the Palompon Police, shall be placed on the parking area and entrance of the establishment facing the street.

SECTION 12. INSPECTION The video surveillance system shall be subject to random inspection by the Local Government Unit of Palompon, Leyte and the Chief of Police or their respective representatives, who is authorized to inspect at reasonable times any video surveillance system to determine if the system conforms to this Ordinance. If the video surveillance system does not so comfort, the concerned establishment must take immediate steps to bring the system back into conformance.

SECTION 13. ENFORCEMENT; CIVIL PENALTIES a. Establishments subject to the mandatory requirements of this Ordinance shall take effect upon the approval of all the operators are given one (1) year to comply the installation in accordance with the provisions of this ordinance. b. Failure of the owners/managers to install CCTV Cameras and other video monitoring devices within one (1) year after the approval of this ordinance in their establishments, shall subject them to the following penalty: b.1. First Offense – Warning, with condition that the establishment shall install CCTV within fifteen (15) days offense b.2. Second Offense – If after fifteen (15) days from the 1st offense or non-compliance with the CCTV installation, a fine of P3,000.00, and given another fifteen (15) days to install CCTV

BE IT ORDAINED by the Sangguniang Bayan of Palompon, Leyte in session assembled that: MUNICIPAL ORDINANCE NO. 387-101114 AN ORDINANCE REGULATING THE OPERATION OF INTERNET CAFÉS, COMPUTER GAMING STATIONS AND BILLIARD HALLS IN THE MUNICIPALITY OF PALOMPON, LEYTE AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF Section 1. TITLE An Ordinance Regulating the Operation of Computer Gaming Stations, Internet Cafés and Billiard Halls of the Municipality of Palompon and Providing Penalties for Violations Thereof.

Section 2. DEFINITION OF TERMS Computer gaming station – refers to an establishment that maintains and operates computers for gaming purposes and internet cafés for fees irrespective of the number of units.

Billiard Halls – refers to an establishment that maintains and operates pool and billiard tables and equipment for gaming purposes and for fees irrespective of the number of tables.

Operator – includes the owner, manager, administrator or any person who operates and is responsible for the operation of the computer gaming station and internet café.

Educational Institution – refers to public or private centers of learning such as pre-school, elementary school, high school, college, and those that offer vocational-technical courses Students - 16 years old and below.

Minors – sixteen (16) years old and below.

SECTION 3. DECLARATION OF POLICY It is hereby declared the policy of the Municipal Government of Palompon, that henceforth all video game shops or stores, internet cafes and billiard halls operating within its jurisdiction shall be effectively closed to students and minors who are not attending school during class hours for purposes of playing or participating in any computer game. Provided, however, that students may be allowed entry therein even during class hours if the purpose is for research or of complying school or academic requirements. In the latter case, students must have the written permission of their subject teacher duly noted by the school Principal, which should be presented to the video shop or internet café owner/operator/maintainer for justification purposes or exemption from the policy declaration embraced under this Section.

SECTION 4. QUANTUM OF PROOF The mere presence of a student inside the video game shop or store, internet café and billiard hall during class hours shall constitute a prima facie proof of violation under this Ordinance, unless exemption is invoked as allowed in section 1 hereof.

SECTION 5. REGULATIONS 1. No computer gaming station and internet cafe, shall admit minors during class hours or from seven-thirty (7:30) in the morning to five (5:00) in the afternoon except on Saturdays, Sundays and holidays, unless the minors are accompanied by either parent. In no case shall betting be allowed.

2. The Computer Gaming Shops, Internet Cafés and Billiard Halls affected in this

December 8-14, 2014 b.3. Third Offense - If after one (1) month, still there is no CCTV installed, a Fine of P5,000.00 and revocation of Business Permit. c. The violation of any provision of this Ordinance by any owner or principal operator of establishments subject to this Ordinance shall result in a notice of violation from the Chief of Police or his/her designee. The Palompon Police with the cooperation of the Local Government Unit’s Civil Security Unit are authorized to investigate all alleged violations. The Civil Security Unit then will submit a report on the violators to the Palompon Chief of Police. d. In addition to the foregoing, the violation of any provision of this ordinance shall be and is hereby declared to be a public nuisance and contrary to the public interest and shall, at the discretion of the Chief of Police, create a cause of action of injunctive relief and recommend cancellation or non-renewal of business permit issued.

SECTION 14. REPEALING CLAUSE All ordinances, resolutions, rules and regulations inconsistent with this ordinance is hereby repealed or modified accordingly.

SECTION 15. SEPARABILITY CLAUSE If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court with competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.

SECTION 16. EFFECTIVITY CLAUSE This ordinance shall take effect on January 1, 2016 to give ample time to all establishments to purchase and install their CCTV. Publication in a newspaper of general circulation will be immediate after this Ordinance has been approved.

ENACTED: 10 November 2014 Xxxxxxxxxxxx I HEREBY CERTIFY to the correctness of the above-mentioned Municipal Resolution and Municipal Ordinance.

SECTION 6. DUTIES OF SCHOOLS For effective implementation of this ordinance, all education institutions in the Municipality of Palompon shall observe the following: 1. To include the date of birth on the identification cards issued to students.

2. To institute with their Parents Teachers Associations security measures that shall prevent or discourage students from cutting classes or going out of the school premises during school hours.

3. To post copies of this Ordinance on conspicuous places within the school for the information and guidance of the students and school faculty and personnel.

4. To allow teachers or school officials to do random checks on Computer Gaming Shops, Internet Cafés and Billiard Halls.

SECTION 7. IMPLEMENTING AGENCIES 1. The Philippine National Police – Palompon Station headed by the current Chief of Police shall implement this Ordinance.

2. The Civil Security Unit of this Municipality shall collaborate with the Philippine National Police – Palompon Station in executing this Ordinance.

3. Barangay Officials including Barangay Tanods of the internet cafés, computer gaming stations and billiard halls in their areas shall be responsible and has the authority to inspect internet cafés, computer gaming stations and billiard halls during class hours or if and when a teacher or school personnel requests them to do so. They are also responsible to report the internet café’s, computer gaming stations and billiard halls that have violated this Ordinance.

4. The Civil Security Unit of this Municipality, Barangay Officials, including Barangay Tanods and/or teachers or any school official shall report any violator to the Philippine National Police – Palompon Station who will then file a formal report in accordance with this Ordinance.

SECTION 8. PENALTIES 1. Owners, managers of Computer Gaming Shops, Internet Cafés and Billiard Halls, who violate any of the provision of this ordinance after due process shall be imposed the following sanctions: First Offense – Reprimand Second Offense – Fine of One Thousand Pesos (P1,000.00) per minor Third offense – Fine of Two Thousand Pesos (P2,000.00) per minor and revocation of business permit and license to operate and closure of the establishment Minors who violate this Ordinance shall have their identification cards confiscated by the Barangay Officials, Barangay Tanods, teachers, school personnel, Civil Security Unit personnel or any personnel of the Philippine National Police – Palompon Station, in which it will be given back to the school where the student attends to for proper disciplinary action. If the student or minor does not have an identification card, he or she will be turned over to school where he/ she is enrolled in for proper disciplinary action. Or, if an out of school youth, be turned over to the Municipal Social Welfare.

SECTION 9. REPEALING CLAUSE All ordinances, rules and regulations, or parts thereof, provisions of which are in conflict with, or contrary to, the provisions of this ordinance are hereby repealed, amended, or modified accordingly.

SECTION 10. EFFECTIVITY CLAUSE This Ordinance shall take effect upon this approval.

Short Title. This Ordinance shall be called and referred to as “An Ordinance Regulating The Numbering System of Residential and other Buildings of Borongan City” Section II of Ordinance No. 48, s. 2007 is amended to read as follows Section 3. POLICY. (1.) It shall be the Policy of the City to adopt a systematic regulation in numbering of residential, commercial and other buildings which shall: (a) Ensure easily visible and accurate information on the location of residential, commercial and other buildings. (b) Prescribe the implementation guidelines in the numbering system. (c) Promote complementation in various programs, projects and activities such as but not limited to, demographic surveys, periodic assessment valuation of buildings, pinpoint location for law enforcement surveillance and the like. (d) Involve all barangay councils and households through prior consultations and in the implementation of this Ordinance. (e) Provide the metal number plate free of charge as a public service and as an administrative tool of the City Government. (f) If ever there was collected by the LGU any amount of money paid for the metal number plates, the corresponding amount shall be deemed tax credit to particular persons who paid the money. (g) The City Treasurer’s Office is hereby authorized to facilitate and enter into its records credit for tax, fees or charges due the LGU for the concerned persons mentioned in paragraph (f) above, upon application thereof by the latter.

Section III of Ordinance No. 48, s. 2007 is amended to read as follows: Section 4. Implementing Guidelines. To implement the rationale, purpose and policies of this Ordinance, the following GUIDELINES are hereby prescribed, thus: (a) All house and building owners, establishment leases or operators shall strictly comply the numbering system as provided herein. (b) The design and size of the metal number plate shall be “4x6” and the color shall be white background and the number and letters shall be luminous green. (c) The Barangay Affairs Desk, Office of the City Mayor, shall cause the distribution and posting of the number plates to all houses, buildings and establishments in the City in coordination with the Barangay Councils. (d) The arrangement, sequence of numbering and posting of the number plates shall be determined by the Barangay Affairs Desk in consultation and coordination with the Office of the Association of Barangay Councils (ABC) and each particular Sangguniang Barangay. (e) The Barangay Affairs Desk, in coordination with the Association of Barangay Councils (ABC) shall continue to monitor the implementation of this Ordinance including but not limited to recommend the production of additional metal number plates as the number of target houses and buildings increases and for replacement vandalized and/ or destroyed by man or nature.

Section 5. Appropriation of Funds.

For the effective and efficient implementation of this Ordinance, there shall be allocated funds to be included in each budget year to be determined by the Local chief Executive for the conduct of surveys, payment of enumerators, production/ acquisition of metal number plates and such other related incidental costs.

Section V of Ordinance No. 48, s. 2007 is amended to read as follows: Section 6. Prohibited Acts and Penalty Thereof. (a) It shall be unlawful for any person, natural or juridical, to deface or destroy the metal number plate and/ or any unauthorized removal, alteration or transfer of such number plate directly or indirectly or by negligence to prevent thereof or refusal to allow the numbering system. (b) Any violation prohibited in the next preceding paragraph in each case shall be meted with an administrative fine of Five Hundred (Php500.00) Pesos but not exceeding Three Thousand (Php3,000.00) Pesos and/ or one (1) day up to six (6) days of community service as may be determined and imposed by the City Mayor. (c) In case a company or corporation or any other juridical person is subject to the penalties hereof in paragraph (b) above, the highest ranking officer shall be liable for the violation of this Ordinances.

Section VI of Ordinance No. 48, s. 2007 is amended to read as follows: Section 7. Separability Clause. If any of the provisions of this Ordinance is declared not valid or unconstitutional, the other provisions not so affected shall remain in full force and effect.

Section 8. Repealing Clause. All ordinances, resolutions, rules and regulations or parts thereof inconsistent hereof are hereby repealed, amended or modified accordingly.

Section VIII of Ordinance No. 48, s. 2007 is hereby amended to read as follows: Section 9. Effectivity. This Ordinance shall take effect upon its approval.

The old existing slaughterhouse shall be relocated to the new site for improved facilities and public services.

Section 3. Standards of the National Meat Inspection Services (NMIS), Region VIII, Tacloban City.

The proposed project site meets the standards required by the Office of the National Meat Inspection Services, Region VIII, Tacloban City after site ocular inspection and empirical study by officials of the said agency.

Section 4. Clearance by the Department of Agrarian Reform Provincial Office (DARPO), Borongan City.

This Ordinance does not contravene the Comprehensive Agrarian Reform Law (R.A. 6657) as the subject agricultural land is not covered by the said law as certified by DAR Provincial Office, Borongan City nor is the land tenanted as further certified by the Punong Barangay of Barangay Pepelitan, Borongan City where the land is situated.

Section 5. Greater Economic Value.

The Sangguniang Panlungsod after due diligence and after public hearing duly called for the purpose of this Ordinance, has determined the agricultural land cited and described in Section 2 above, shall have substantially greater economic value for industrial uses such as the proposed new city slaughterhouse and other facilities and improvements.

Section 6. Reclassification of Agricultural land into Industrial Use. The parcel of agricultural land particularly described in Section 2 above, is hereby reclassified into and for industrial purposes for the greater economic value to address the increasing demand for more, bigger and better industrial projects, facilities and public services; and to relocate the obsolete existing old structures and facilities of the present slaughterhouse very near the public market; and further allow related expansion and/ or diversification of related economic activities in the new city.

Section 7. Repealing Clause. – All city ordinances rules and regulations inconsistent hereof are hereby repealed, amended or modified accordingly.

Section 8. Separability Clause. – If any of the provisions in this Ordinance is declared invalid or unconstitutional, the other provisions shall remain in full force and effect.

WHEREAS; The MOOE – Livelihood assistance program fund of the Office of the City Mayor shall be the source of fund which shall be constituted as a “trust fund”, WHEREAS: Other sources of funds and livelihood trainings/seminars may be explored and adopted to make the program sustainable and for more beneficiaries to avail hereof, WHEREAS; This ordinance shall provide a policy direction to any livelihood assistance emanating from and granted by the city government.

BE IT ORDAINED by the Sangguniang Panlungsod of the City of Borongan in session assembled that: Section 1. TITLE – This Ordinance shall be known and cited as the “CITY LIVELIHOOD ASSISTANCE AND EMPLOYMENT GENERATION PROGRAM ORDINANCE OF 2014”.

Section 2. DEFINITION OF TERMS – for the purpose of this ordinance, the following terms shall mean: Council- shall refer to the Borongan City Livelihood Council created by virtue of this Ordinance.

Livelihood assistance program – a program of the city government which provides loans in the form of items, materials or goods and technical services to prospective beneficiaries for the purpose of enhancing the latter’s economic productivity.

Managing partners – are focal persons who shall be responsible in managing the City livelihood program and shall exercise powers and perform such duties as provided under Section 7.

Marginalized family – refers to a poor and disadvantaged group of persons usually living together and related to each other either by blood, marriage, or adoption whose monthly earnings are less than Seven Thousand Eighth Hundred Twenty One (P7,821.00) Pesos. (Source: National Statistical Coordinating Board) Marginal residents – are poor and disadvantaged residents of Borongan City whose monthly earnings are less than Two Thousand (P2,000.00) Pesos.

Trust Fund – refers to a sum of money from the City Annual Budget under the MOOELivelihood Assistance Program fund of the Office of the City Mayor earnmarked for the sole purpose of providing livelihood assistance to qualified beneficiaries. The fund shall include cash or other assets convertible to cash from outside sources.

Section 3. LIVELIHOOD COUNCIL – There is hereby created a “Borongan City Livelihood Council” which shall be composed of the following:

SP Chairman of the Committee on Finance 4. ABC President 5. A representative from the Federation of accredited farmers and fisherfolks associations 6. A representative from the Federation of accredited women associations 7. A representative from the Federation of accredited Persons with Disability (PWDs) associations 8. A representative from the Federation of accredited Senior Citizens associations 9. A representative from Borongan Chamber of Commerce Section 4. POWERS AND DUTIES OF THE COUNCIL – For the smooth and successful program implementation, the council shall: 4.1) Create the “Borongan City Livelihood Trust Fund” in a duly authorized city government depository bank chosen by the Livelihood Council which shall manage the same in accordance with government accounting and auditing rules and procedures: 4.2) The trust fund shall be used for granting of loans to beneficiaries, the priorities of whom shall be the: 1) marginalized families of Borongan City who are seeking out a living in farming, fishing, or other economic/livelihood activities, 2) PWDs associations, 3) women associations, 4) out-of-school youth (OSYs) associations, 5) Borongan City tricycle driver’s associations 6) other marginal residents either individually or group who can be economically productive if provided with commensurate capital, livelihood training or know how, and guidance; 4.3) The Council shall explore, request, receive and manage the possible sources of funds and assistance to build-up the trust fund; 4.4) Solicit and receive donations, legacies, grants-in-aid and contributions, whether in cash or in property from both public and private sources, which shall accrue to the Trust Fund created for in this Ordinance; 4.5) Authorize the Council Chairman to disburse project/trust funds and act as signatory to related transactions; 4.6) Ensure that the livelihood assistance to be extended shall be as equitable as possible in order to make the program available to the poorest and most needy in all the sixty one (61) Barangays: 4.7) Conduct regular meetings and special meetings as the need arises to address immediate call of service to its clientele; 4.8) The Council through its Chairman shall execute a memorandum of agreement with the Managing Partners which shall be composed of: 1) Representative from the City Planning and Development Office and 2) Representative from the City Agriculture Office.

The Managing Partners shall be designated as such by their respective Department Heads as approved by the City Mayor 4.9) The Council may adopt additional guidelines as maybe deemed helpful to the success of this program; Section 5. TRUST FUND – There is hereby created a livelihood Trust Fund in the initial amount of One Million Four Hundred Thousand Pesos (P1,400,000.00) to be taken from the Annual Budget under the MOOE-Livelihood Assistance Program Fund of the Office of the City Mayor, starting in the Fiscal Year 2015 and every year thereafter.

Section 6. LOAN CONDITION – The loan shall bear no interest rate and the amount to be granted shall depend on the project proposal submitted by the proponent to the Livelihood Council, but in no case exceed the following: Individual – P 50,000.00 Family – P 100,000.00 Association/Cooperative – P 150,000.00 No loan shall be granted without undergoing a capacity building seminar/livelihood training.

The livelihood assistance shall be in the form of technical services and items, materials, or goods equivalent to the amount of loan granted and shall be released on incremental basis according to needs of the project proponent.

Section 7. DUTIES AND POWERS OF THE MANAGING PARTNERS- The Managing Partners shall manage the livelihood program by exercising/ performing the following: 7.1 Receive application of prospective project beneficiaries and ensure all documentary requirements are meet; 7.2 Conduct background investigation on the community standing of the project proponent; 7.3 Study and assess the viability of the proposed project and recommend to the Livelihood Council for approval and funding; 7.4 Conduct capacity-building seminar/livelihood training to the target project beneficiary; 7.5 Ensure that beneficiary shall execute a loan agreement; 7.6 Conduct periodic evaluation of the projects and ensure compliance with the set agreement; 7.7 Determine that the beneficiary has sufficient know-how and qualification on the livelihood; 7.8 Collect loan payments and deposit them at the authorized depository bank which shall be rolled –over to the next-in line beneficiaries; 7.9 Periodically appraise the Livelihood Council on the socio-economic impact of the program in terms of the number of direct (borrowers) and indirect (family members) beneficiaries, the amount available for the granting of more livelihood assistance, and other related information.

Section 8. IMPLEMENTING RULES AND REGULATIONS – To effectively and properly carry out the provisions and intent of this ordinance, the City Mayor shall issue the necessary implementing guidelines, rules and regulations.

Section 9. REPEALING CLAUSE – Any ordinance, resolutions, executive orders, and rules and regulations that are inconsistent herewith are hereby repealed, amended, or modified accordingly.

Section 10. SEPARABILITY – if any provision (s) of this ordinance is declared invalid or unconstitutional, other parts or provisions not affected therewith shall continue in full force and effect.

Section 11. EFFECTIVITY- This ordinance shall be operative on the 1st day of January of the ensuing fiscal year.

2. Defendants are the unknown heirs of Catalino Kaagbay. Catalino Kaagbay is likewise unknown to the Plaintiff.

3. Plaintiff is the owner of a parcel of land described as follows (the subject property): “It is an agricultural land located in Brgy.

Poblacion Almeria Biliran now covered by TD No. 01517 bounded as follows: North, (251-P)-11; South, (253)-27.; East, (250)-13; West, (252)-10; with an area of 0.073397 has (s); market value of 15,743.66 assessed at Php2,200.00” 4. The subject property was originally owned by the Plaintiff’s mother, Maria Morillo. When his mother died, Plaintiff’s siblings sold their shares in the subject property to the Plaintiff making Plaintiff the owner.

5. Plaintiff, by himself or through his representative is religiously paying the taxes due on the subject property ever since he acquired ownership of the same.

6. Sometime on September 2014 however, while Plaintiff’s attorney-in-fact was attempting to pay the taxes due on the mentioned property, she found out that the tax declaration covering the subject property is no longer under his father’s name.

7. She was shocked to find out that the property is now declared under the name Catalino Kaagbay.

8. Upon further inquiries, Plaintiff found out that on file with the Office of the Provincial Assessor are a Deed of Waiver and Affidavit of Good Faith, Waiver and Quitclaim respectively dated November 14, 2006 and February 25, 2013.

9. These waivers were purportedly executed

by Plaintiff in favor of Catalino Kaagbay and/or his heirs.

10. Catalino Kaagbay or his heirs were able to cause the registration of the subject property under the name Catalino Kaagbay because of said waivers.

11. Plaintiff however never waived or intended to waive the subject property in favor of anyone. He never signed any deed, waiving the subject property in favor of Catalino Kaagbay or any of his heirs or anyone for that matter. He does not even know who Catalino Kaagbay is. The waivers (Annexes D and E) are not genuine or authentic and therefore a nullity.

The waivers being a nullity, the Tax Declaration (Annex A) issued pursuant to the mentioned waivers is likewise invalid and should be cancelled and/or corrected.

12. In filing this case, Plaintiff hired the undersigned counsel for an agreed Attorney’s Fees of Twenty Thousand Pesos (Php20,000.00) and Appearance Fee of One Thousand Five Hundred Pesos (Php1,500.00) per hearing. In addition, Plaintiff expects to incur expenses of litigation of at least Forty Thousand Pesos Php40,000.00).

I

AM working on this special coverage of a wedding of somebody close to my heart. She is Marion Marcos, one of my two nieces with my brother Teodoro and his wife Evelyn. Though I have not seen her much, I watched Marion (still Danday to the family) blossom into one of the prettiest women of Tacloban.

I also watched, through her Facebook account, her love affair with Jason Esperancilla, son of DOST regional director Edgardo Esperancilla and better half, Guadelyn.

Through Facebook also, I noted Marion to be a favorite bridesmaid of her friends. She would be in this and that wedding … but never her own. Until early this year, I had to ask her … when is yours? Honestly, I was even a bit alarmed when I began to notice that Jason was not in her recent pictures. But she answered … “diri na maiha, Tita.” (It won’t be for long, Auntie.) I never had the heart to ask if it was still Jason, he-he.

Fast forward to two weeks before Ruby, I would get a call from her, saying she is dropping off an invitation. When I got it, I was relieved to see the guy was Jason.

I quite like the chap, the few times I met him. And I was pleasantly surprised to learn during the reception that they have been “on” for 10 years … wow, talk about a long engagement.

The wedding was to be at Movenpick Resort in Lapu-lapu, Mactan. It was for November 7, but it had to be moved to today (November 14, Sunday) because of Ruby. “Agi, Tita, grabe na akon stress,” Marion would call me on the phone to tell me of the postponement.

From her mom, during the reception, I also learned that they had been planning the wedding last year yet, also on November 14, but Yolanda postponed it

by one good year. It’s funny to look back now, but because of that wedding supposedly set for 2013, they stayed at the Leyte Oriental Hotel during Yolanda, intending to fine tune the wedding arrangements. Luckily, all of them survived, with one of her nieces Zek, holding on to a mango tree for the two hours that Yolanda was at its height.

Despite the setbacks, here we are now, enjoying one of the best garden beach wedding I’ve attended. Now Born Again Christians, my niece and Jason took their vows before Pastor Paul Valberg, who I swear delivers the most beautiful wedding homilies in the world. For Jason and Marion, Pastor Paul picked 1Peter 3:1-7 as the verse they would ponder on and be the guidepost of their union.

They say every bride is lovely … and Marion was ravishing when she walked down the garden path to take her lifetime vows with Jason. Jason, too, exuded the confidence of a man who knew who he wanted to be with, for the rest of their lives.

It was a beautiful ceremony, capped with a lovely and funny reception emceed by Rommel Pareja, one of Cebu’s “in demand” mistress (?) of ceremonies.

I love weddings. They give you a feeling of hope. Of life coming full circle. To Jason and Marion, may I repeat the wishes of one of your groomsmen, “that may you have lots of little Marions and little Jasons soon.”

Salute also to the Movenpick Resort Hotel for their effort in making the wedding reception extra special. The hotel performed a flamenco number and fire dances towards the end, which kept the guests glued to their seats until the end of the reception.
