“Justice at last!” That was the feeling of many of the family, friends and supporters of the children killed at the Buttskop level crossing last year, as Jacob Humphreys, the taxi driver who drove the children to their deaths, was found guilty on Monday. Judge Robert Henney found him guilty on ten charges of murder and four of attempted murder, even after Humphreys tried to maintain his innocence by pleading not guilty. After the verdict was announced, he was taken into custody and bail was denied. Humphreys enraged the community in Blackheath and surrounding areas on 25 August last year when he drove his taxi filled with children on their way to school through the level crossing while the booms were down. Defence lawyer Johann Engelbrecht tried to justify Humphreys’s actions by telling the court he suffered from retrograde amnesia. He claimed that Humphreys could not remember what had happened from when he stopped at the Buttskop level crossing, until the time he woke up in hospital. In his summation Henney found it strange that Humphreys did not collide into the vehicle in front of him if he was standing behind another vehicle. He also pointed out testimony from the surviving passengers and

other witnesses at the crossing who saw him weave around cars to drive through the lowered booms. The children who lost their lives that day were: Liesl August, 11, Cody Erasmus, 15, Jody Phillips, 13, Reece Smith, 7; Nolan February, 13, Michaelin de Koker, 11, Jason Pedro, 14, Nadine Marthinissen, 16, Jeane-Pierre Willeman, 13, and Jade Adams, 10. Four children survived the incident. Cries of euphoria were heard from family members and supporters of the victims at the High Court when the sentence was announced. Not only was this a day of justice being served for the parents of these children but also for provincial transport minister, Robin Carlisle. Carlisle hailed it as a “victory for justice and for road safety for the entire country”. “There are cases that I am personally following very closely where speeding, drunk and negligent killer drivers have run down children in the street, or smashed the vehicles of innocent drivers and passengers from behind at high speed, senselessly condemning the occupants to an agonising death. “We need these brutal, unrepentant killer drivers to be thrown behind bars for lengthy periods, or we will never have safe roads,” Carlisle said. Two long months await Humphreys as he will only be sentenced on 20 February next year.

“Jesus loves the little children, all the children of the world ... ” This is how children from the Mummy Day Care paid tribute to their classmate at his funeral on Friday. Oyama Mdashe was four months shy of four-years-old when he and his brother, Lisakhamya, six, were hit by a passing bus. The incident occurred when the brothers were crossing the road in London Way, Malibu Village. According to some residents, the boys were crossing the road from the barber shop where their father works. They had received money from the owner of the barber and decided to go to the shop. As they crossed the road, the Golden Arrow bus hit them from behind. Bronwen Dyke, spokesperson for Golden Arrow said the bus company has assisted with funeral arrangements for the Mdashe family. “The driver was suspended immediately after the incident, which is standard internal policy. This is to allow time for investigation and to ensure that the driver is given the opportunity to recover from any psychological trauma. In this case, the driver was found to

Sanral has for now, agreed to halt all work on the N1/N2 Winelands Toll Road project, while the intergovernmental dispute process takes its course. This follows after the City of Cape Town filed an interdict application against Sanral, of which the case has last week been postponed sine die (without a date), based on this agreement. According to the City’s mayoral committee member for transport, roads and stormwater, Councillor Brett Herron, the City has already appointed an advocate of the Johannesburg Bar to facilitate the dispute. An intergovernmental dispute is a dispute resolution process instituted in terms of legislation. “This is an important victory for the City as we believe that the concerns of residents and City stakeholders will now be properly considered. The agreement reached today is the undertaking that the City has sought from Sanral over the past few months and formed the basis of our interdict application,” Herron said last week. “We are satisfied that we have achieved what we sought to get from the interdict application – a commitment from Sanral that they would not continue with their tolling plans while the City engages to resolve the dispute. We are on record as expressing our concern over the socio-economic impact.”

From past experience, police have found that Melton Rose Station and Eerste River Station are hotspots for car theft. Another place community members should be aware of is parking lots at shopping malls. People are advised to park close to an entrance or security guard. Outrage at rape plea bargain DESIREÉ RORKE

While the State might be negotiating a plea bargain with the man who stands accused of rape and sexual assault of five minor girls, the parents of the victims are fuming at the prospect that a guilty plea might land him a lesser sentence. The man who was arrested at his home in Brackenfell on 15 May, appeared in the Blue Downs Regional Court last Wednesday, and will appear again today. He was charged on 10 counts of sexual assault and rape under its new definition. Two of the girls were his own daughters, aged 10 and 12 at the time, another three were friends of his daughters aged 12 and another a 16-year old babysitter. TygerBurger has it on good authority that the accused is considering to plead guilty, depending on the jail sentence the State offers in return. A reliable source informed the newspaper that an eight-year jail term has been discussed, but this could not be confirmed. “Should he plead guilty, the victims would not have to relive their trauma in a court of

law, but it would strengthen his chance to get a lesser sentence,” CEO of Rape Wise SA, John Buswell told TygerBurger this week. Buswell is one of the founder members of Rape Wise South Africa, an organisation made up of legal and healthcare professionals, dedicated to helping the youth. Over 35 000 educators, doctors, trauma sisters and psychologists, are trained annually by Rape Wise. Buswell also expressed his shock at the fact that a possible eight-year jail sentence has been discussed, saying that such a perpetrator might be out on good behaviour in as few as four years. According to Buswell the minimum sentence for child rape is 25 years, and the minimum sentence for rape is 15 years with a possibility of parole – in child rape the child must be under the age of 12. According to Buswell many factors are considered however when a plea is negotiated. “Factors such as the strength of the evidence and whether he is a first offender or not, are weighed up against other factors such as the issue of the girls being traumatised in court. Even in camera a clever advocate will tear a young girl’s testimony to shreds, knowing

that a girl at such a tender age, still coming to terms with her own sexuality, will probably fall apart when testifying about such intimate details. In such cases an offender often might walk free,” he says. According to Buswell the conviction rate of rape cases in South Africa is as little as one percent, adding that in many cases the criminal who perpetrates against children has more rights than his victim. Buswell is also convinced that most sexual predators, when they come out of jail, will repeat the crime. “On average the serial rapist rapes 27 times before he is arrested and once it has been established that a sexual predator has multiple victims, there is a 95 percent chance that he will commit the same offence after being released. Likewise, the parents of the victims are outraged at the possibility of a lighter sentence. “Eight years is not enough for someone like him and our legal system is not protecting us against such people. My daughter will never be the same again. That spontaneity and ease about life is gone forever,” the parent said.

CapeGate security guard was ‘the thief’ DESIREÉ RORKE

A security guard from the CapeGate shopping centre was arrested for theft last Wednesday. The arrest followed after a contractor who was working at the Lifestyle centre, spotted his stolen bore and sander at a second-hand dealer at the centre. This equipment, according to W/O Erica Crouse of the Brackenfell police, was stolen

between 29 and 30 November. After reporting it stolen, W/O Jaco van der Merwe accompanied the man to the secondhand dealer to trace the person who sold the goods to them. “At about 23:00 on the same day, a 29-yearold man from Mfuleni was arrested. “It was also determined that he worked as a guard at CapeGate, and police are currently investigating whether he is linked to other similar crimes,” Crous said.

Police are requesting anyone who has reported theft at CapeGate over the last four years for items such as jewellery and electrical equipment, to phone Van der Merwe on 083 235 5246. Anthea Oostendorf from the CapeGate shopping centre said she was aware of this incident but could not comment at this stage of the investigation. The suspect will appear in court in Kuils River on 12 January 2012.

Xmas meal for underprivileged kids CHILTON MELLEM

So many of us take a Christmas meal with family for granted, but for some, spending time with their family is not so pleasant. This is why Pieter September, an administration clerk from RR Franks Primary School, launched a feeding project for the children in the school who come from disadvantaged homes. According to September some of the children come from homes where parents are unemployed and drink. This Christmas meal coincidentally falls in the 16 Days of Activism campaign period. The initiative was started in 2007 and has been going strong for the past four years. Two children are selected by their educators in each class to attend this annual feast. “It’s always a pleasure to do this; it’s never an effort for me because I love children. I love to bring joy and happiness to the lives of chil-

dren,” September said. An arrangement was made for a guest speaker to address the children before their meal. Clive Peters, principal of Macassar Primary School gave the children sound advice to take through in life. They were firstly advised to take care over the holidays as anything could happen, especially coming from challenged homes. This tied in with his message that they should appreciate each and every day. Children were also encouraged to make something of their lives, to go further than high school and get a tertiary education. “We should appreciate each and every day we are alive because it is a gift from God. What we do with our days and lives is our gift to God,” Peters said. The school quad was seasonally decorated and children engaged in some festive activities by singing carols. After their meal, they were surprised with gift packets filled with luxuries for them to enjoy.

The Sakhumzi Creche in Mfuleni was greeted with a pleasant surprise last week when they received two familiar visitors on Tuesday. Multi-Spectrum Property Development (MSP) and the South African Sustainable Development Initiative (Sasdi) have been the angels who have taken this creche under their wing for the year. Mamma Amelia, who runs the Sakhumzi Creche was presented with a cheque of R80 000 by MSP. The money was raised during a golf day in November. Soccer day of mixed emotion CHILTON MELLEM

Saturday was filled with smiles and good cheer as local Blue Downs soccer teams received certificates, medals and trophies for their hard work.

These soccer teams were brought to formation through the initiative of ordinary community members. These residents claimed they saw the evils that happen in the area and did not want the boys to fall victim to them. By unifying them through street soccer, they are able to keep them off the street and help them to focus on more positive activities such as sport.

The children that make up these teams come from Mfuleni, Wesbank, Happy Valley, Silver Sands and High Gate. The children range from the age of 11 to 15 and include girls and boys. Each player received a medal and certificate and each team captain received a trophy at the ceremony. After all the formalities, players were treated to a meal. Despite this joyous occasion for the players, the organisers of the teams feel they have little support from government and their ward councillor. “I want to know where the councillor is. ’n Menseketting in die vorm van ’n reuse-teddiebeer is Saterdagoggend by die Tygervallei-winkelsentrum gevorm ter ondersteuning van mishandelde kinders. Teddiebere was die skakels in dié reuse-ketting wat ’n projek is van die TygerBeer-stigting en die winkelsentrum. “ ’n Mens kan nie anders nie as om te dink aan die baie kinders wat nie bevoorreg genoeg is om te deel in die liefde en vreugde van Kers-

fees,” sê Hajni Lamberti, Tygervallei-winkelsentrum se bemarkingsbestuurder. Vrywilligers het in massas opgedaag vir die vorming van die menseketting. Onder die massas was verskeie bekendes soos Steve Hofmeyr, Emo Adams, Chester Williams en Dawid Fourie. Die Stad Kaapstad se burgemeester, Patricia de Lille, was ook daar om die inisiatief te ondersteun. Meer as 200 Kersgeskenke vir die kinders is ook in die afgelope tyd ingesamel, danksy die steun van Tygervallei-ondersteuners.

Parents must be aware of festive temptations for the youth. That is the warning from a concerned community worker, who feels that too many parents let their guard down during the festive season when it comes to their children getting into alcohol and drug abuse. Dhakir Christians is a dedicated fighter against these abuses and said that his research reveals that many children got hooked to alcohol and drugs during the holidays. He found that in many cases children were also influenced by parents who regularly abused alcohol. “If you are a parent who does not drink or use drugs, chances are your children will follow your example. “Even if you just proclaim a negative attitude toward liquor and drugs, your child will think twice about using them. “However, if you are a heavy drinker, you increase your child’s chances of following your example by threefold. “It’s true, just when you thought the only things influencing your teen were friends, video games and the internet, it turns out that parents still matter.” The examples set by parents and their teachers are far more effective forms of drug education than anti-drug programmes in schools. Risk factors for teens are undiagnosed learning disabilities, bipolar disorder, childhood traumas, anxiety, depression, and feelings that they do not fit in with their peer groups. “Any teen who says that he or she loved drugs or drinking from the first try is also at greater risk,” continues Christians. “The earlier a teen starts using, the more likely he or she will be addicted. Children who are home alone after school are at more risk than supervised children. “Finally, growing up around heavy drinkers is another big risk factor. “If one parent is a heavy drinker, the child’s chances of becoming a heavy drinker increase by two or three times. Parents who use illegal drugs are more likely to hide the fact that they’re abusing drugs from their children. “Consequently, parental drug habits do not influence children as much as parental drinking and smoking habits. “However this can still have an unpleasant impact for both the parents using drugs and their children,” he said. Average Joe can impact climate While the outcome of the COP 17 negotiations has been met with mixed reactions, the world is increasingly aware of the devastating effect climate change could have on our planet. The conference resolution encompasses a series of agreements that leaders of 197 nations have reached to reduce the emission of greenhouse gases and manage the impact that climate change will inevitably have. The level of greenhouse gas emissions present in the atmosphere is higher than at any other time during the last 150 000 years. As this increases, so does the world’s temperature, which in turn has catastrophic effects on food security. Despite the technical jargon around the subject, the far reaching impact the average person can have is not to be scoffed at. What can the average person do to prevent climate change? Use less fuel by choosing a fuel-efficient car or use transport requiring less fossil fuel such as trains, subways, buses, car pools, walking and biking. Buy efficient appliances that use less electricity, reduce everyday electrical consumption. Arguably more importantly, we should all start talking about global warming, write letters to local, regional and national media to spread the message and thereby start a movement.

Your kids not cared for in Greenlands Dear residents of Greenlands, I write this letter to you to voice my concern as a fellow resident, at the conduct of yourselves and your children. Greenlands is the epitome of the social ills our society faces, and we are not doing enough to combat this. Within the first few months of living in this suburb I noticed how your children are neglected, and uneducated. I’ve seen your young children (two to six years old) walking around outside after dark unsupervised. I’ve seen them looking so forlorn and lost sitting in a park after 22:00 at night. I’ve seen your children play “games” involving throwing stones at each other and chasing each other down and having a mob kick one child until he is writhing in pain, screaming for help. These incidents have taken place in front of my very own eyes and I have done my very best to speak to your kids, to encourage them to play nicely with each other. I have seen your teenagers openly smok-

ing drugs in our parks, in full view of the younger children in our area. What example are we setting for these children? Is this okay with us? How would you feel if something bad were to happen to these children? With the stories of rapes, kidnapping and murders in our newspapers and on TV every day, can we really afford to say: “This won’t happen to us?” Parents, we are approaching the festive season. I urge you to please take responsibility for yourselves and your children. Please love them and care for them. You made the choice to have them; you now have to accept your responsibility to them. To our community workers and councillors, more needs to be done to keep these children occupied during the holiday season. It was recently brought to my attention that a local radio station arranged a donation for a family in need. This family in need do occur regular monthly medical costs. This family in need also has a threebedroomed home with swimming pool in a safe, well established area, two vehicles, running water, electricity, food and toiletries in their cupboards and satellite television. Giving to people in need is our duty, but we need to re-look at what we consider “people in need”. Everybody has “needs” which is based on your standard of living. If your standard of living is above your income are you really in need? What about those that don’t earn any income? What about the children who live on the street with no home, no food, no parents? Or that pensioner that has to rely on the State for a minimal amount of money to live? Surely they are in need of physical and emotional support. It’s sad how people “in need” play on emotions especially at Christmas time to get things. I’ve learnt that those who shout the loudest do receive first and those that suffer in silence are actually the ones that really need. It’s concerning how companies give to get free advertising without even investigating the situation. Think about your situation and give to those that have less than you and it doesn’t have to be in the form of money either. Time spent chatting to a pensioner in a home, time spent baking cookies for that orphanage, time spent playing with a sick child that is bedridden or giving your neighbour who just lost their job a lift to a job interview is just as valuable. Last thought: The gift of giving should apply all year around, not only at Christmas time. MICHELLE Durbanville

The Neighbourhood Watch of Varsity Estate in Belhar invites the community to their Carols by Candlelight event on Saturday (17 December). Starting at 19:00 it will be held in the park in Azalea Crescent.

Youth in our communities “can” help themselves, thanks to the initiative of a local canning company. The Peninsula Beverage Company (PenBev) is taking the threats that modern youth face very seriously by sponsoring the Life Talk Forums going to schools in the area. They have come on board beacause they have realised that our youth are faced with serious challenges on a daily basis. Things that are seemingly harmless such as browsing the internet, to more serious challenges such as joining gangs and drug abuse have grave consequences for our youth, who are not necessarily equipped emotionally to stand up for themselves and realise their dreams. Sue Linstrom who runs an initiative in Cape Town called Life Talk explained that in keeping with the main focus of the sponsors, life should be about what they “can” do. “Life comes in Cans, not in Can-nots is an age appropriate talk for learners about being able to stand up for themselves and reach their positive potential in light of the various challenges they face during their teens. “The learners are encouraged to question their involvement in the various challenges, such as alcohol and drug abuse, gangsterism, cyber bullying as well as sexual promiscuity to name a few, and they are asked whether getting involved in a certain challenge will bring them closer or further away from their potential. “It is vital to empower our youth to be able to say ‘no’ to drugs and alcohol, or many of the other challenges they face daily, by highlighting that they ‘can’ make a choice, they just have to decide how important it is to them. “This talk is about making them think firstly about their goal person and secondly giving them the power to stand up and say, I CAN reach it!” “PenBev sponsors these sessions and

Get skilled in computers GARY VAN DYK

Computer skills are increasing, with another batch of learners getting certificates at a recent ceremony.

On The Ball Computers is a registered and accredited computer training college which has been training students in the community of Bishop Lavis and surrounding areas as far as Eerste River, Parow, and Mitchells Plain, and is still spreading to empower all. Nigel Johannes runs the course in Bishop Lavis with support from the main college in Cape Town that is directed by Kim Palmer. Johannes is passionate about making a difference in his community, especially with youth and he feels that they must become skilled in order to fight the negative influences around them. “I come from that background of drug abuse, but by the grace of God I have survived and now

want to make a positive difference in my community,” he says. “We have a number of courses available at all levels so we are therefore able to offer these qualifications to learners who want to further their education in an information technology-related field. “Students, especially matriculants from this year, who wish to study in the computer field can still register now for next year or if they wish to know more about the courses can come visit us for more information.” The college is also running six months programmes including, Computer Literacy, Office Administration, Business Administration, Technical Support, Network Administration, Project Management, and Web Design. Cape Town to be more ‘caring’ city Cape Town is en route to becoming a more caring city. This is in sight after the City of Cape Town’s social and early childhood development directorate and the provincial department of social development recently renewed the protocol agreement initially entered into between the two parties while Cape Town executive mayor Patricia de Lille was still the Western Cape minister of social development. It was therefore fitting that De Lille signed the agreement with the current Western Cape minister of social development, Albert Fritz in her new role as mayor. The protocol agreement allows the City to undertake a range of programmes and initiatives in support of its commitment to being a caring city, which follows the functions of local government as listed in the Constitution. The agreement further allows the City the ability to undertake some of the work as-

cribed to the provincial department of social development, especially in areas where local government bodies is better placed to do so. Under such circumstances, the City would normally deliver these development interventions at its own cost and with its own resources. This agreement gives the City the opportunity to increase its capacity and its ability to focus on intervention in respect of street people, substance abuse, youth development, poverty alleviation, disability, gender, early childhood development and social crime prevention. “I am elated that we were able to renew this agreement which allows us to move forward. “It is especially helpful in terms of early childhood development and social entrepreneurship programmes,” said the City’s mayco member for social and early childhood development, Beverley Cortje-Alcock.

Nóg groot dinge kom, sê sanger LOUISA­JANE STEYL

Hy is onlangs deur Bok Radio genomineer as een van die gewildste kunstenaars in die WesKaap, maar Jacques G sê daar kom nóg groot dinge in 2012. TygerBurger-lesers mag dalk al sy treffer, “Spookstories”, op die radio gehoor het. Die liedjie was vir ses maande op Radio Houtstok se top30. Sewe van Jacques se liedjies word tans ook op Bok Radio gespeel. Nog een van Jacques se gewilde liedjies is “Vasco Boulevard”. “Dit is waar ek grootgeword het,” sê hy. Hy verduidelik dat hy dié liedjie oor sy verlede geskryf het. “Mense kan aanklank vind by die

liedjie,” sê hy. As ’n pa van drie, het Jacques effens laat in die musiekbedryf beland, maar met die hulp van radiostasies en sy aanhangers, is hy gou besig om in die plaaslike musiekbedryf naam te maak. Jacques het vier jaar terug deeltyds in kroeë begin optree, voor hy omtrent ’n jaar gelede ’n voltydse loopbaan aangepak het. Voor dit het Jacques vir ’n vervoermaatskapy gewerk en later sy eie onderneming in die boubedryf begin. “Ek het altyd van musiek gehou,” sê hy. By vleisbraaie en sulke sosiale samekomste was hy altyd die ou met die kitaar langs die vuur. Toe hy ongelukkig sy onderneming verloor het, het hy besluit om vir sy brood en botter te begin sing.

“Ek was half geforseer om my passie uit te leef,” sê hy. Jacques het al van sy liedjies op die album, Spookstories, opgeneem wat by sy vertonings of by Rooies se Winkel beskikbaar is. Hy skryf al sy liedjies self en sê party kom maklik en ander “kom so met tyd”. Jacques sal vroeg in 2012 met ’n groot platemaatskappy onderhandel in die hoop om gekontrakteer te word. Vir eers kan jy een van Jacques se vertonings bywoon. Op Vrydag is hy by Ge Brody’s in Brackenfell. Ons ken hom maar net as die “blou man met die hoed”, maar daar is soveel meer aan die musiek van Grant Karpakis. “Ek maak al musiek vandat ek só klein was,” sê Grant terwyl hy met sy hand beduie. Voor hy sy solo-loopbaan aangepak het, het Grant klawers en slaginstrumente vir die Corpus Christimusiekgroep gespeel. Grant het al ver gekom van die dae toe hy skaam op die verhoog verskyn het. ’n Vriend het sy oorspronklike musiek gehoor en hom aangemoedig om sy eie liedjies op te neem. Hy het toe drie liedjies by Southern Buzz Studios saam met Wimpie van der Sandt en Wynand Windpomp opgeneem en van dié liedjies speel nou op Bok Radio. “Ons is nou besig om die album op te neem,” sê Grant. Grant sê hy probeer om die style van Chris Chameleon en Bobby van Jaarsveld, die sangers wat hom inspireer, in sy musiek in te bring. “Ek wil soveel meer mense bereik om my musiek te luister en te geniet,” sê hy. “Dit gaan nie soseer oor ek wat hulle vermaak nie, maar eerder dat dit wat ek geskep het, hulle

Cricket top sport for summer fun With schools out and summer here, cricket is topping the recreational agenda for over 3 000 children from different communities, who will take part in the 21st annual Sporting Chance Calypso Cricket Festival at local Cape Town beaches. The festival started yesterday and continues until Friday 16 December. The Sporting Chance Calypso Cricket Festival was started by Brad Bing of youth sports development agency Sporting Chance in 1990. The festival, in association with Virgin Active, I&J and Supersport Let’s Play, is an annual highlight for thousands of children from various communities in the Western Cape, including Langa, Manenberg and Ocean View, to pit their cricketing skills against one another. The festival highlights Sporting Chance’s determination to encourage sport as a fixture in all children’s lives, irrespective of race, gender or social class, and to create an uplifting environment to bring together various communities, organisers said. “It is a fantastic achieve-

The organisers are doing a sterling job.” Over the weekend South Africa had a battle, falling short of sealing another win, but the support was and still is growing as the days go by. ISF President Porter commented on South Africa’s performances, saying: “South Africa has made improvements since their last JWWC four years ago, along with teams such as Russia, Puerto Rico, Brazil, Botswana, and Czech Republic. “For Puerto Rico, Brazil, South Africa, and Botswana, this has only been their second appearance, and it is fantastic to see how the sport

is growing, especially in Africa.” People’s Post also spoke to South Africa’s head coach, Lester Smith, asking about the positives he could draw from the tournament. “In a number of areas we are not far off other teams, and I can proudly say that our under-19 girls can compete against any team,” said Smith. When asked about the way forward for South Africa, Smith said: “I think for SA to be truly competitive in softball, the sport should be seen as more than just a social game. “Club and school level need to up their game and we definitely need to strengthen our pitching.”

International Softball Federation President Don Porter awarded Gert Bam, director of Sport, Recreation and Amenities, an historical Atlanta Olympic medal, as well as the ball that was used in the Beijing Olympics. He accepted on behalf of the City of Cape Town, as a token of appreciation to the City of Cape Town for supporting softball and the Junior Women’s World Champi­ onship.
