situations and for premium prices, which is great for our owners but does put a bit of pressure onto the buyers.

Top tips for the buyers out there at the moment are: • Talk to a mortgage broker and get your finances sorted so that your offer can be as clean as possible and more favourable to the owner.

• Get to know the market well, go to open homes, and find out from the sales consultants what they sell for so you are educated about price before putting an offer in.

The market truly has been buoyant over the last couple of weeks. Here are a few snippets of what’s been happening from some of our team.

• Write a cover letter, so the vendors can get a feel of who you are and why you are buying, etc.

• Don’t wait until the open home – call to make a private appointment that way you are ahead of the game.

• If you miss out on a property, ask the sales consultant (if they can disclose it) for feedback on the offer (was the other offer accepted higher, preferred settlement date, cash unconditional, etc).

Handy tips when buying your new home If you’re buying a house, whether it’s for the fi st time or the third time, this checklist will come in handy.

Set a budget

Find a solicitor

First, talk to your bank or mortgage broker regarding your finances and determine how much you can borrow and have to spend on a property.

Ask friends or colleagues to recommend a solicitor. Some solicitors have a set fee for conveyancing and some charge by the hour.

Prepare a list of needs and wants Bearing in mind your budget:

Write a property checklist When you are out looking at open homes, or viewing a property with a sales consultant, be sure to check the following:

Where do you want to live?

•

How close do you need to be to services such as supermarkets?

•

Size of living areas, bedrooms, kitchen and storage. Also check outside areas.

•

Consider which schools you are interested in – some may be zoned

•

•

What style of house would you like?

•

How many bedrooms/ bathrooms would you like?

What condition is the property in? Is it sound and is there anything that needs to be done to it? If so, what are the likely costs?

•

Do you need a big section?

Do you need any specialist reports such as a building report?

•

What is the water pressure like? Be sure to turn the taps on in the kitchen and the shower to check.

•

Is the home insulated – walls, ceiling or both?

•

Which chattels remain with the property and which will go with the vendor?

•

Will your furniture fit in the home?

Find a sales consultant Find a sales person with whom you feel comfortable and with whom you can communicate easily. It’s a good idea to work with the same sales consultant in each company, that way they know your requirements and can call you when new properties come onto the market.

Different methods used to sell a home

Special conditions

When you buy a property, there are a number of different methods used by vendors to sell their home. You’ll need to be familiar with these methods because they affect how and when you make an offer. Read our Methods of buying property on page 24 for more detailed information.

Special conditions can include:

Making an offer By law, all written offers irrespective of price must be presented to a vendor. Your Tremains sales consultant will be there to work with you offering advice and guidance throughout the offer process. You will need to sign an Agreement for Sale and Purchase of Property, a standard agreement approved by the Real Estate Institute of New Zealand and the Auckland Law Society used throughout New Zealand. Your offer is not unconditional until any special conditions have been met. Once an agreement is unconditional, neither the buyer nor the seller can change their minds.

Cash out clause – a buyer can come in with a cash offer and over-ride the existing conditional offer

Conditional upon a specialists report

Conditional upon the sale of the purchasers property

Paying the deposit The deposit is due to be paid when agreement is reached with you and the vendor unless otherwise stated in the agreement. The deposit is paid into an audited trust account and is only released when it has been legally authorised. We’ll hold the keys to the property until your solicitor advises us that settlement has taken place.

Final inspection It is your right in the standard terms and conditions of the agreement, to carry out a final inspection as close to settlement date as possible. Ensure the property is in the same condition as when you first inspected it. Your Tremains sales consultant will arrange this for you.

Settlement day Settlement day is generally moving day.

In general the vendor moves out in the morning and the new owners move in the afternoon. However, you can get the keys to the property only when you have paid the money over. Liaise with your solicitor, the vendor and your consultant.

Methods of buying a property There are many pricing methods used to sell property. This comprehensive guide details each of the options a vendor can use. Tender

Fixed Price

A tender is a method where buyers submit confidential written offers for a property by a set date. Offers can be accepted prior to the advertised close date, but this must be made clear in the advertising. There is no reserve price but there may be a price guide.

Properties can be advertised with a price. This method of sale still allows the buyer to negotiate with you on price.

Vendors have the option of accepting an offer before the tender date as long as this is clear in the marketing material

Deadline Sale •

A deadline sale is similar to a tender in that buyers submit confidential written offers for your property by a set date. Offers can be accepted prior to the advertised close date, but this must be made clear in the advertising.

Auction

Price by negotiation

Selling a property at auction is an open process where buyers bid against each other to purchase the property. The vendor sets a reserve price before the auction and once this price is reached, the highest bidder becomes the successful buyer.

Selling a property by negotiation is a good way to sell when it is difficult to estimate the price a property is likely to sell for.

•

This sales method sees a buyer make an offer based on what they believe your property is worth. Buyers have to do their own research to make this judgement and then vendors can negotiate with them on price through the sales consultant.

•

All bidders are cash buyers – there are no conditions on the offers and sold means sold

•

A vendor can still consider offers before the auction if the auction terms and conditions allow for it

•

•

A vendor will set a reserve price which is the lowest price they are willing to accept

Vendors can set the price by comparing “like” properties

•

There is no time pressure on buyers

•

Your real estate sales consultant will know how many interested parties will be in the room as buyers must register

•

The price by negotiation method can be used with no price indication

There is no ceiling on the price – no restrictions by advertising a price How the bidding process works:

•

Once the bidding passes the reserve price, the property is on the market and will be sold to the highest bidder.

•

If the bidding does not reach the reserve price, the auctioneer will pause the auction and discuss what the vendor would like to do next.

•

If bidding is close to reserve price, but not quite there, a vendor can agree to put the property on the market, in which case the highest price buys the property; or

•

The vendor can advise the auctioneer that they will not sell at that price and the property gets “passed in.” The auctioneer will let people know the auction is finished because the reserve price has not been reached.

•

At Tremains, we suggest that the vendor negotiate with the person who made the highest bid. This still gives them the opportunity to sell the property on the night – however any offers may not be unconditional.
