On some of these routes you can choose to upgrade to Club Europe from just £50 each way, with dedicated check in desk, airport lounge access with complimentary food and drink, additional baggage allowance and more leg room. And of course, all the renowned watersport activities (including waterskiing), tennis, mountain biking and childcare will be there. See pages 38-43 for full information.

And there’s more good news... Lakitira Beach Resort village accommodation has undergone a full refurbishment. And watersports kit has been upgraded. For sheer exhilaration, nothing beats being out on the water. And when it comes to watersports, we’ve got everything covered. Our qualified watersports staff are on hand to help with first class FREE tuition, and most of our Beach Resorts are RYA recognised training centres, so you can head home with a qualification as well as a tan. You will find all the latest equipment including performance dinghies, catamarans and kayaks, and if you already have some experience you can just take a stroll down to the waterfront and sail, windsurf or paddle off, confident in the knowledge our safety cover is always on hand. If you are a beginner, you can join in one of our free group lessons.

Children booked into our Junior, Kidz and Indy clubs enjoy activities out on the water alongside new friends as part of their club’s activity schedule. All of our Beach Resorts are handpicked for their conditions, suitable for a whole range of watersports. And if there’s something particular that appeals to you, it’s worth checking the individual resorts pages as some resorts are more suited to certain sports than others.

Sailing

Windsurfing

Whether you are an adult or child, a complete novice or simply need a refresher, we can help. We operate a variety of FREE sailing clinics throughout the week tailored to ability and with the aim to get you out on the water as quickly as possible. Simply come along to an informal briefing at the start of your holiday and reserve your spot.

With FREE tuition in windsurfing included at most of our resorts, there’s no excuse not to have a go. Whether you are experienced or starting out, our range of clinics, private lessons and RYA courses give you the opportunity to master the sport.

For those looking to accelerate their progress, we have a full range of RYA courses on offer which can be pre-booked in the UK, as well as private one to one tuition. We have an impressive flotilla of dinghies and plenty of craft to go round. Our qualified staff will help you choose the right craft and will rig and de-rig boats and boards for you.

We have a wide selection of boards to suit all abilities for both adults and children, from high volume teaching boards to shorter wide style and low volume free-ride boards. All are highly

regarded brands such as Tushingham and Starboard. Windsurfing conditions are usually good at all our beach resorts, lighter winds in the morning are ideal for beginners, and strengthening afternoon winds suit the more intermediate. And if you are keen to learn ‘Stand Up’ Paddle Boarding, we have Paddle Boards at most of our resorts.

Waterskiing & Wakeboarding As the first overseas tour operator to be officially recognised by the British Waterski & Wakeboard Federation, we have a wealth of experience when it comes to the sport. Whatever your level of ability, rest assured you are in expert hands. We operate waterskiing and wakeboarding at Lemnos and Levante Beach Resorts in Greece and Sea Garden Beach Resort in Turkey.

These resorts are particularly well suited for waterskiing and wakeboarding often with calm sea conditions. We offer a high quality range of skis, which include standard and wide combo skis for beginners and a good selection of mono/slalom skis, wakeboards, junior skis and kneeboards. Waterskiing and wakeboarding are provided on a ‘pay-as-you-go’ basis and are booked in resort.

Scuba Diving We have PADI dive schools at a number of our Beach Resorts. So, if you have a passion for diving or would like to learn, then let the warm, clear waters of the Mediterranean tempt you.

Please see pages 82-84 for full watersports information. 12

Whether you want a gentle knock up, a social game or feel it’s time to improve your strokes, you’ll find our facilities and resident coaching staff are outstanding. With over 30 tennis courts spread across all our Beach Resorts, there is plenty of FREE use of courts and we provide free loan of HEAD racquets and balls for coaching and casual play. If you are looking to advance your game or just starting out then we have a number of coaching options to choose from, including a Specialist Tennis Week, our signature Academy Course and group coaching tailored to ability.

We are keen to encourage the next generation too, so there’s plenty of mini tennis and junior coaching for our younger players from age 3 years upwards. Please see pages 85-86 for further information.

Get out and ride Mountain biking at our resorts is FREE of charge – whether you take a guided tour with our experienced bike team, branch out on your own or with the family. What’s more, our fleet of Specialized Hardrock bikes are all brand new and the latest models.

16

So, if you’d like to leave the comfort of your sunlounger for the day or just a few hours, our guides will take you out on a ride to suit you. Our planned routes are scenic but vary from gentle to challenging. You set the pace. The Hardrock and Rockhopper bikes are ideal whether you are tackling the slightly more challenging terrain of Corsica or the scenic coastal rides in Sardinia, Greece and Portugal.

We run Yoga and Pilates courses throughout the season at our Greek beach resorts – Lemnos, Lakitira and Levante Beach. Whatever age your children are, from four months to 17 years old, we’ve perfected the art of keeping them entertained. What’s more, childcare is pre-bookable and a half day session every day is FREE for children booked into our Toddler 2 and Mini Clubs, and full days for the Junior, Kidz and Indy Clubs. We do make a modest charge for the under two’s as our staff/child ratio is high.

It’s fun for the kids!

Our childcare staff provide an inexhaustible range of activities for younger groups from face painting to pool games and mini tennis. For the older ones, learning to sail, snorkelling, trying windsurfing and playing beach volleyball are all part of the fun time we’ll give them. With full day childcare and a FREE evening crèche available too, it’s easy to plan each day so that whole family can make the most of what’s on offer. See pages 87-89 for full information on our childcare and children’s clubs.

23

Teenagers love their families but there’s a limit to everything! That’s where the Indy Club comes in – it runs throughout the school summer holidays and again at October half term. It’s the perfect opportunity for 14-17 year olds to make new friends while having a great time and it’s included in your holiday cost.

Independence days

There’s a full programme of daytime activities and evening entertainment designed to keep teenagers amused and occupied. Supervised watersports such as sailing and kayaking are part of a typical day and ‘Indy dinner’, a team challenge and floodlit volleyball keep the atmosphere going well into the evening. Our Indy Club is very popular and places fill up fast so we strongly advise you pre-book your free place in the UK prior to departure. Just for adults Singles, couples and groups of friends enjoy our holidays just as much as families. Not least because, in some resorts, we’ve created adult beaches and set aside other areas as adult-only too. There’s an informal range of activities to enjoy from social barbecues to group dinners and sporting pursuits from sailing to fitness to try. In the evening the hotel bars are the perfect spot to recount the day.

Our Club Mark Warner weeks, introduced to give adult guests the chance to meet other fellow holidaymakers, are not surprisingly very popular. Local excursions and group nights out in good company, combined with all the usual Mark Warner activities, will make your stay memorable. Club Mark Warner Weeks Lakitira, Greece Sea Garden, Turkey

Across some weeks, we have a number of rooms available with no single supplement, and superb offers for groups of friends. Please visit our website for details.

Lemnos Beach Resort

Lemnos

A tranquil, unspoilt island in the north-eastern Aegean, Lemnos is the perfect family getaway. Its peaceful rural location, spacious crèche, short airport transfer and range of accommodation make it fantastic for families. Conditions here are excellent for water sports, mountain biking and tennis or you can relax with pampering treatments in the spa. The resort’s location near the pretty harbour town of Myrina, with its ruined Venetian castle and waterfront restaurants, offers the chance to experience traditional Greek culture.

Lemnos Beach Resort New for this year, we are delighted to introduce Lemnos Beach resort to our summer programme. This lovely resort is extremely family friendly, but with its spacious layout and excellent facilities it’s got plenty to offer if you are holidaying with friends or as a couple. The accommodation is made up of 92 rooms which offers 18 family suites, 29 twin rooms, 8 inter-connecting pairs and 29 large twins with space for a cot or child’s bed. Rising in attractive terraces up the hillside, the contemporary-style rooms all have en-suite bathrooms, air-conditioning, TVs, fridges, free WiFi, tea and coffee making facilities, hairdryers and private balconies or terraces with sea views. Dining is offered on a full board basis, with wine at lunch and dinner included. Delicious breakfast and lunch buffets are served in the hotel’s upstairs restaurant, to stunning bay views. Below is the stylish bar, great for a pre-dinner drink. Or put

your toes in the sand and enjoy a cocktail at the beach bar. Shaded by a grove of trees, it’s open all day for coffee and drinks. Dinners at Lemnos are rather special, barbecued al fresco and served on the main terrace looking out to sea. The resort’s sandy and gently shelving beach is excellent for watersports and splashing in the shallows. Calm morning seas entice waterskiers before breezes gradually build to create perfect conditions for sailing and windsurfing. Other seafront activities are kayaking, stand-up paddle boarding, beach volleyball or simply lazing on a sun-lounger. Mountain bikes are also on hand for exploring the countryside or the sights of nearby Myrina. Alternatively enjoy a game of tennis on one of the resort’s four tennis courts. Our fitness instructor runs a daily programme of exercise including aqua aerobics. After all that activity, unwind with a well-deserved treatment in the Viva salon. For children, there is a large air-conditioned crèche with outdoor play area and a children’s paddling pool which is located beside the main swimming pool. Complimentary beach towels are available for everyone.

64

Perdepera Beach Resort Perdepera Beach Resort is situated on a beautiful, white sandy beach, on the eastern coast of Sardinia just south of the village of Cardedu. The scenic drive from the airport at Cagliari takes in the beautiful mountains and red cliffs overlooking the Mediterranean Sea. Exclusively Mark Warner, the hotel is made up of 120 rooms (comprising doubles, triples and family rooms that comfortably accommodate 4). The accommodation is in attractive terraced villa-type buildings dotted around the gardens and built in traditional style with colour wash and stone rendering. The rooms all have terraces, air-conditioning, fridge, television, safe and en-suite facilities with shower. Dining is on a full board basis with breakfast, lunch and dinner taken in the typically Sardinian restaurant offering buffets, grills and local and international dishes. Wine, water and soft drinks are included at lunch and dinner.

There is a swimming pool and a separate children’s pool, but most popular is the long sandy beach with crystal clear water perfect for swimming. There are plenty of beach beds and sunshades and complimentary beach towels are provided. For the more energetic there are 2 tennis courts with our resident coach who is on hand to provide group or private tuition. Mountain bikes are available to hire free of charge, giving you the opportunity to explore this beautiful region. Protected by a headland the sailing is fantastic for learners and novices in the morning, with the wind picking up in the afternoon making for more challenging sailing. The Mark Warner watersports centre offers free sailing and windsurfing tuition throughout the week, and will be adding new, upgraded equipment for summer 2013. There is a local PADI dive centre for those who would like to scuba dive, and for those wishing to keep their feet firmly on dry land, a full aerobics and fitness programme is available and is included in your holiday cost.

San Lucianu Beach Resort

Corsica

An ever popular Mark Warner resort, San Lucianu has been welcoming our guests for 16 years. Pretty gardens run down to the secluded beach with great watersports. San Lucianu Beach Resort The ruggedly beautiful east coast of Corsica is the location for San Lucianu Beach Resort. Situated on a long stretch of sandy beach, with soaring mountains as a backdrop, it’s set amongst elegant gardens and eucalyptus groves. Close by is the picturesque old port town of Bastia, with its fine Baroque churches and elegantly crumbling houses. If you fancy exploring, there’s wonderful walking to be had in the mountains, and the nearby Domaine Vico vineyards are well worth a visit. At San Lucianu, accommodation is in the 3-storey hotel, located at the heart of the resort. Each of the cool, airy rooms is decorated with splashes of vibrant colours and almost all have spectacular sea or mountain views. There are twins, interconnecting and family rooms, and this year we have refurbished a number of the rooms which are of a deluxe or superior standard.

Dining at San Lucianu is on a half board basis with breakfast and dinner taken alfresco on the restaurant terrace. Dinner is from the à la carte menu or buffet and one evening a week we organise a barbecue with grilled fish and meat. Lunch can be taken (at a supplement) buffet-style in the Terrace Restaurant or from the snack menu at the beach bar. San Lucianu offers plenty of activities and has 2 swimming pools. The good mix of wind conditions, ensures great sailing and windsurfing for all levels, while the gently shelving sandy beach is reassuring to even the most apprehensive beginner. We offer a range of RYA courses in sailing and windsurfing or why not try the popular craze of stand up paddle boarding? There are three tennis courts from which we run a full coaching programme. This is a great resort for families, with a large air-conditioned childcare centre which is home to our baby and toddler crèches and mini club. Fully equipped, with kitchen and too many toys to mention.

Ocean Club Beach Resort The Ocean Club is situated in the village of Luz on the stunning western Algarve coast and combines all the Mark Warner first-class facilities with the benefits of being in a traditional Algarvian village. Within its cobbled streets are numerous restaurants, cafés and shops which lead down to the lovely wide sandy beach. Accommodation is in apartments, clustered in different areas around the village and all within a 10-minute walk from the Mill restaurant and bar where all meals are taken. When you want to play tennis, dine or socialise with fellow guests the ‘Mill’ offers a central country club style hub to enjoy as you please. This is where the childcare centre, family pool, reception and tennis centre are located. There are 2 additional swimming pools with bars, one of which is reserved exclusively for adults and early/ late season there is a heated indoor pool. Most apartments overlook the gardens or the pools, others have sea views and each has a balcony or terrace, fully-equipped kitchen and maid service twice a week.

We offer half board dining which includes a delicious daily buffet breakfast and a three-course à la carte dinner on 6 nights per week, leaving you free one night to try one of the many nearby local restaurants. The bay of Luz is stunning with a pretty promenade dotted with bars and cafés stretching the entire length of the seafront, a lovely place for a stroll and cocktail at sunset. If you’re a tennis player Ocean Club is perfect. Our Tennis Centre has 5 tennis courts, a full time resident professional and coaching programme. There is also some great mountain biking on offer, which is free of charge. Take off with our mountain bike guide and explore the local area and coastline which provide some outstanding rides. The Algarve is synonymous with golf and this part of the region has four nearby championship golf courses. We have negotiated discounted green fees at most courses for our guests and are happy to book a tee-time for you.

Childcare & Childrens Clubs When you are on holiday, you want to know your children are in expert hands, being cared for in a happy and safe environment, whilst you relax. That’s why all our childcare staff are professional and hold either a DCE, NNEB, NVQ or equivalent qualification or have at least 2 years’ relevant experience. Our comprehensive facilities and level of care provide a safe and stimulating environment for children of all ages from 4 month old babies through to active 13 year olds. All our childcare clubs are free, except for our Baby and Toddler 1 Clubs, where the high ratio of childcare staff to children means we make a charge. Childcare spaces are pre-bookable in the UK for all age groups. Our English-speaking, professional childcare staff have an inexhaustible supply of fun ways to keep children happy. They organise face painting, art activities, songs, stories and games on the beach for the younger children, whilst older children learn to snorkel, try their hand at windsurfing or enjoy a light-hearted game of beach volleyball. All of this allows you to relax safe in the knowledge that your children are enjoying themselves whilst being safely supervised by our staff.

Childcare details Evening crèche service

24 hour kitchen

In all of our resorts where we have a childcare facility we offer an evening crèche service for younger children (4 months to 5 years) enabling you to have a relaxing dinner. The evening crèche service operates from 7.30pm until 11.30pm and allows you to drop off your children at our crèche where they will be entertained with films or games or they can go to sleep in a designated quiet area.

A 24-hour kitchen is provided in Lemnos, Lakitira, San Lucianu and Perdepera Beach Resorts, where you will find a fridge, kettle, microwave, sterilisers and a supply of UHT whole milk. At Levante Beach Resort we provide bottle sterilisers and UHT milk in your room on request. Please let our Reservations team know at time of booking if you require these items.

Evening entertainment For children aged 6 to 13 years, we will be running a fully supervised evening entertainment programme. We ask that you sign children in and out if they wish to join in our entertainment programme whilst you are dining.

Children with special needs We are happy to assist should your child have any special needs. We would ask that you telephone our Reservations team prior to booking your holiday to discuss arrangements, including the possibility of one-to-one care should it be required.

Children’s equipment In our resorts which offer Baby or Toddler Clubs we supply travel cots, steam sterilisers, nappy changing facilities, baby baths and potties. Nappies, processed foods and powdered milk can all be purchased locally but if your child is used to a particular brand, we suggest you bring your own supplies. Please bring a small rucksack (labelled with your child’s name) for your child’s belongings during the day containing all the items from our checklist opposite.

Children’s beds Children 2 years of age and over will automatically be allocated a bed. If you wish to have a bed side barrier for your child’s bed, please contact our After Sales team.

Children’s mealtimes We know all about children’s appetites and the need for a healthy balanced diet. With this in mind we ensure appropriate dishes are on offer to suit their taste at every meal. There is a children’s buffet dinner sitting each evening.

Babysitting Extra babysitting can be arranged in resort through the Childcare Manager at additional cost. Please note that babysitters are in high demand, and whilst every effort is made to accommodate requests, this service is subject to staff availability and cannot be guaranteed. Please give at least 24 hours’ notice if you require this service.

Safety in the sun When holidaying with children in hotter climates we would strongly advise that children always have plenty of sun lotion applied, drink lots of water and wear a UV T-shirt or rash vest and hat at all times.

Illness If your child becomes ill, you will be expected to take over his/her care in order to reduce the risk of transmitting any illness. Your child must be clear of illness before going back into the Children’s Club and re-admission will be at the discretion of the Childcare Manager.

Travel Information

Flight and transfer details As our travel arrangements are made many months in advance, the flight details shown here and on the accommodation pages are provisional flight arrangements and approximate flying and transfer times. All flight timings are provisional and may change up to the point of departure. Exact details of your flight numbers, carrier and timings will be confirmed when etickets are issued approximately 7 – 10 days before departure. We cannot accept bookings made conditional on flight timings or carriers and a change of flight timing does not entitle you to change or cancel your holiday. On busy dates it may be necessary to buy in extra seats which may be on different carriers, operating at different times and therefore supplements may be payable on these flights. As transfers for these extra seats will often be operated in conjunction with our usual flights, there may be a short waiting time at the airport.

Scheduled and regional flights In addition to our contracted flights as listed, we can request further seats, subject to availability, from many airports. Price supplements for these will be payable, please enquire at the time of booking and full details will be given to you. These flights may operate at different times to our charter schedules and separate transfers may then need to be arranged and paid for. Please note that if you miss your outbound scheduled flight, you must contact us or notify the airline directly to ensure your homeward flight is not affected. 90

Infants

Pregnancy

Please note that those under 2 years of age on the date of return travel to the UK are not allocated a seat on the aircraft or transfer coach and will need to sit on a parent’s knee. The cabin crew will be happy to heat up food you have brought with you. It may be possible on some of our charter flights on certain dates to purchase a seat for infants, for details, please ask our reservations staff. Scheduled airlines make charges for infants, we will advise you of the full infant cost at the time of booking.

Ladies who are more than 33 weeks pregnant on their return date cannot travel on our charter flights. After the 28th week of pregnancy a medical certificate of ‘Fitness to Fly’ is required, which must confirm the expected date of birth, this must be issued as close to your departure date from the UK as possible. Please check your insurance policy for restrictions on cover provided.

Travel details and e-tickets E-tickets will be sent to you approximately 7 – 10 days before the start of your holiday and we must have an up to date email address for your booking. Please check your documents carefully as flight timings and airlines can sometimes change from those published in the brochure or detailed on your confirmation invoice. Bookings made within 10 days of departure will be subject to a minimum £15 per person late booking administration fee.

Connecting flights Please note that flight timings given at the time of booking are provisional and bookings cannot be accepted conditional on timings. Guests with onward connections should allow plenty of time in the event of a schedule change or flight delay. We strongly recommend that tickets for onward connections are booked on a fully flexible basis to accommodate any unforeseen delays.

Check-in Check-in desks are opened at least two and a half hours before the scheduled departure time. As an increasing number of aircraft are missing their departure slots due to late reporting passengers, we would ask you to arrive at the check-in desk with plenty of time and we recommend not less than two hours prior to the scheduled departure time.

Airport representatives For our charter flights, our own Mark Warner representatives will be on hand at your departure airport to assist you to get away smoothly. Full details of our UK representatives will be sent with your final travel documents. When you arrive at your destination airport our representatives will be waiting to welcome you after Customs and escort you to your transfer coach.

Baggage allowance At the time of going to print, baggage allowances were as follows:-

British Airways 23kgs hold luggage which must be carried in 1 bag. Infants receive 23kgs hold luggage allowance

Monarch Airlines 20kgs hold luggage which can be carried in more than 1 bag. Infants receive 10kgs hold luggage allowance.

Jet 2 22kgs hold luggage which must be carried in 1 bag. Additional bags can be booked directly with Jet 2. Infants do not receive a luggage allowance. Full details of your baggage allowance will be printed on your e-tickets. Even if you are combining your total luggage allowance for your group, there is a weight restriction of maximum 32kgs per item of hold baggage, if you go over this limit, you may be required to split your bags at check-in. One piece of hand luggage weighing which must fit in an overhead locker may

also be taken. If you wish to pre-book and pay for excess baggage or any sporting items such as a windsurfer, waterski or golf bags, please contact our Flight Operations Department. Please note these items must usually be booked onto the aircraft in advance and there is a charge levied by all airlines.

Catering Our British Airways flights are catered with a meal appropriate to the time of the flight. Our other flights operate a “buy on board” service with a choice of hot and cold beverages, snacks and light meals for you to purchase.

Travel delays In the event of a delay departing from your UK airport we do not provide refreshments, meals or accommodation. However, in certain circumstances the airline may provide assistance and their airport representatives will be able to advise. For delays on the return journey we endeavour to provide assistance on the following basis: for a delay of more than 3 hours, refreshments will be provided; for a delay of over 4 hours a meal will be provided and for overnight delays, hotel accommodation and meals as appropriate. The provision of these facilities cannot be guaranteed as circumstances often change and at all times our representative’s decision is final. Transfer coaches are occasionally meeting more than one flight and any delay in flights arriving can cause a delay in the coach departing from the airport. Delays of more than 12 hours on either the outward or homeward journey are normally covered by insurance policies.

Own transport For travellers making their own way to resorts we may offer a discount, depending on date and destination. This discount is only applicable to holidays sold at full brochure price and will only be given if we are advised at the time of booking that you do not require our flight or transfers. It cannot be added at a later date. Check with our office for further details.

Passports & visa requirements For holders of full British or EU passports no visas are required for visiting any of the Mediterranean countries featured in this brochure except Turkey. Citizens of other countries should consult their Embassies for any visa requirements. Visitors to Turkey please note there is a visitors visa charge levied by the authorities. For Summer 2012 this was a £10 or 15 euros charge per person payable in cash upon landing at the airport. At the time of this brochure going to press, the charge for Summer 2013 had

not been confirmed, details will be sent with your tickets. Contact our Reservations department if you have any queries. For British Citizens, adults require a full ten year passport for all the countries we operate to and children a five year passport. Any children included on their parent’s passport before 5th October 1998 will be accepted for travel, however please ensure that any children 16 years and over on the date of return travel to the UK hold their own passport. Please also check the validity of your passport, as most countries require passports to be valid for a certain length of time, usually up to 6 months, upon your return to the UK. If you are unsure, please contact the appropriate Consulate of the country you are travelling to. It is the party leader’s responsibility to ensure that all members of the party are in possession of all travel and other documents necessary for your holiday. We cannot be held responsible if guests are prevented from travelling or re-entering the UK due to the lack of valid passports or visas.

Please note that lost, stolen or new passports will usually take a minimum of one week to replace. Full details are available by either telephoning their 24 hour advice line on 0300 222 0000 or visiting their website www.passport.gov.uk There may be information from the Foreign Office regarding the country you are visiting. This can be obtained by dialling 0845 850 2829 or visiting their website at www.fco.gov.uk

Health Guests are advised to consult their own doctor before their departure to see if any inoculations are necessary. You should ensure that vaccinations or preventative measures such as malaria tablets are taken early enough (which may be a month or more prior to departure). At the time of publishing this brochure, no vaccinations were required for visiting any of the Mediterranean countries featured in this brochure. For further information, you can obtain copies of the DSS leaflet T6 (Health Advice for Travellers) from any Post Office. For holidays within

the European Economic Area you should obtain an EHIC (European Health Insurance Card) prior to departure. The EHIC may entitle you to reduced cost, sometimes free, medical treatment that becomes necessary while you’re in a European Economic Area, although restrictions apply. It must be noted however that the EHIC is not a substitute for insurance and comprehensive insurance must be taken out before departure. If you are undergoing any form of medical treatment, we recommend that you consult your GP prior to departure and ensure that you take sufficient medication and corresponding prescriptions with you where necessary. In some countries the services and drugs provided may be of a different standard to that received in the UK. Please remember to pack any vital medication in your hand luggage. Booking Conditions Applicable to sun holidays featured in this brochure and on our website departing from 1st January 2013 to 31st December 2013

Communications Between Us For bookings made directly with us online we will send our confirmation invoice and any applicable amendment or cancellation invoice to you by email. If you have booked directly with us by phone we will also send these documents by email unless you have indicated at the time of booking that you would prefer us to send these documents by post. If you contact us by email (for example with a query relating to your booking), you authorise us to reply using the email address you have used to contact us. You must accordingly check your e-mails on a regular basis. We may also contact you by post if we cannot, for whatever reason, contact you by e-mail or you have booked directly by phone and have chosen not to be contacted in this way. References in these Booking Conditions to “send” include e-mail and post, as appropriate. If you wish to and you have booked direct with us you may contact us by e-mail for any of the reasons mentioned in these Booking Conditions (for example to request an amendment or notify a cancellation) providing you do so to administration@markwarner.co.uk. NB If you have booked through one of our authorised travel agents all correspondence with us must be carried out via your travel agent. Please note that telephone calls to our reservations department may be monitored/ recorded for training and customer services purposes. Except as set out in clause 14, these Booking Conditions only apply to holiday arrangements which you book with us in the UK and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references in these Booking Conditions to “holiday”, “booking”, “contract”, or “arrangements” mean such holiday arrangements. References to “departure” mean the start date of the holiday arrangements.

1. Making a booking Your contract is with Mark Warner Limited (‘we’ or ‘us’). In all cases, these Booking Conditions together with our Travel Information and How to Book sections appearing on our website (www.markwarner. co.uk ) or on pages 96 to 97 in our brochure form the basis of your contract. References to ‘you’ and ‘the client’ mean all persons named on the booking, or any of them as applicable (including anyone who is added or substituted at a later date). Please see ‘HOW TO BOOK’ on pages 96 to 97 in our brochure or on our website (www.markwarner.co.uk) for full details. Before making a booking with us, you must ensure you have read and understood these Booking Conditions (raising any queries you may have with us). By asking us to confirm your booking, you are liable to be regarded as having had the opportunity to do so and to have actually done so before a contract between us comes into existence. When you make a booking, the first named person on the booking must pay us (if booking direct with us) or your travel agent (if you have booked through a travel agent) deposits or full payment as applicable (see “HOW TO BOOK”

92

as set out above). Please note: if booking direct with us, deposit payments (or full balances if booking within 10 weeks of the start of your holiday) must be made by either credit or debit card at the time of booking. A. Bookings made by telephone or in person A binding contract between us comes into existence when: 1) we (if you book direct with us by telephone) or your travel agent (if you book through one of our authorised travel agents) have received all appropriate payments at the time of booking (if you choose to pay by credit or debit card you must have authorised us or your travel agent to deduct the appropriate payments from your card) or 2) (for bookings made with travel agents only) you have agreed that your travel agent will receive all appropriate payments within 3 working days of your booking having been made by the travel agent with us and 3) we have verbally confirmed the booking to you or your travel agent over the telephone. In the case of option 2 above, if your travel agent does not receive all appropriate payments within 3 working days of your booking having been made by the travel agent with us at the latest, we will cancel your reservation without penalty to either us or you and we will have no further liability to you. A confirmation invoice will be dispatched to your travel agent or to the first named person on the booking if you have booked direct with us once a binding contract between us has come into existence as set out above. B. Online bookings A binding contract between us comes into existence when we have received all appropriate payments from you at the time of booking and we have e-mailed our confirmation invoice to you. Please note; all bookings are subject to availability. Full payment less any deposit pre-paid must reach us not less than ten weeks prior to departure. The first named person on the booking is liable for making full payment for all persons named on the booking (including anyone added or substituted at a later stage). If payment is not received in full by the due date, we will issue a reminder to you (if you are booking direct with us) or to your travel agent. If, within 7 days of our issuing the reminder, we have not received full payment, we are entitled to assume that you wish to cancel your booking and we will retain the deposit paid. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in clause 5 depending on the date we reasonably treat your booking as cancelled. Should you book your holiday through one of our authorised travel agents, all monies paid to the agent for a flight inclusive holiday with us will be held on behalf of and for the benefit of the Trustees of the Air Travel Trust subject to the travel agent’s obligation to pay such monies to us in accordance with our trading terms unless we fail. In the unlikely event of our financial failure, all monies then held by the travel agent or subsequently paid by you to the travel agent for your flight inclusive holiday will be held by the agent on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation on the agent to pay such monies to us. For all non flight inclusive holidays, all monies you pay to one of our authorised agents will be held by the agent on your behalf until a binding contract between us comes

into existence. After that point, your agent will hold the monies on our behalf until they are paid to us. Please note: all payments made by credit card incur a 2% handling fee (not applicable to debit cards). If the card issuer increases its charges to us, we reserve the right to increase this handling fee. Please carefully read your confirmation invoice, tickets and all other documents we send you as soon as you receive them. Contact us (if you have booked direct) or your travel agent immediately if any information appears to be incorrect as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracy (by us) in any document within 14 days of our sending it out (5 days for tickets). We will do our best to rectify any inaccuracies notified outside these time limits. However, you will be responsible for any costs and expenses involved in doing so except where we made the mistake and there is a good reason why you didn’t contact us within the time limit. See clause 4 if you need to correct any inaccurate information you have provided us with.

2. Medical conditions and disabilities If you have any medical problem or disability which may affect your holiday, please tell us (if you are booking direct) or your travel agent before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us or your travel agent full details in writing at the time of booking. If you wish to book online you should email or telephone us with these details prior to making your booking online. You must also promptly notify us of any deterioration or adverse change in or development of any medical condition or disability which may affect your holiday which occurs after you book.

3. Prices and surcharges The holiday prices quoted in our brochure are based on exchange rates as taken from the Financial Times Guide to World Currencies published on 8th October 2012 and known costs on that date. The exchange rate is Euro 1.2357. We reserve the right to make changes to and/ or correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any change or correction of which we are aware and of the then applicable price at the time of booking. Once the price of your chosen holiday has been confirmed at the time of booking, we will only increase or decrease it in the following circumstances. Price increases or decreases after booking will be passed on by way of a surcharge or refund. A surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, in the event of changes in transportation costs (e.g. fuel, scheduled airfares and any other airline surcharges which are part of the contract between airlines (and their agents) and the tour operator) and/or in any dues, taxes or fees payable for services such as landing taxes or embarkation or disembarkation fees at ports or airports and/or where our costs increase or decrease as a result of any changes in the exchange rates which have been used to calculate the cost of your holiday. Even in the above cases, only if the increase in our costs exceeds 2% of the total cost of your

holiday (excluding any amendment charges) will we levy a surcharge. If any surcharge is greater than 10% of the cost of your holiday (excluding any amendment charges), you will be entitled to cancel your booking and receive a full refund of all monies paid to us (except for amendment charges) or alternatively purchase another holiday from us of a similar standard as originally booked if available (if the alternative offered is less expensive, you will receive a refund, but if it is more expensive, you will not be asked to pay any more). A refund will only be payable if the decrease in our costs exceeds 2% as set out above. Where a refund is due, we will pay you the full amount of the decrease in our costs. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place. You have 14 days from the issue date printed on the surcharge invoice to tell us in writing if you want to cancel or purchase another holiday where applicable. If you do not tell us that you wish to do so within this period of time, we are entitled to assume that you will pay the surcharge. Any surcharge must be paid with the balance of the cost of the holiday or within 14 days of the issue date printed on the surcharge invoice, whichever is the later. We promise not to levy a surcharge within 30 days of departure. No refund will be paid during this period either. Please note, changes and errors occasionally occur. You must check the price of your chosen holiday at the time of booking.

4. Amendments by the client All amendments to bookings must be requested by telephone to the After Sales Department on 0844 884 3806 (and confirmed in writing if requested by the After Sales Department) or by e-mail to administration@markwarner.co.uk or if you have booked through one of our authorised travel agents, through the agent. If we are able to accept the change we will charge an amendment fee of £35 per person per occasion a change is made. Amendment may result in the recalculation of the holiday price and the loss of previously applicable discounts or other special offers if the amendment means the conditions applicable to the previous calculation or a discount or other offer are no longer met (for example, because the number travelling has fallen below the minimum required) or the basis on which the price was calculated has changed (for example, because only one person is occupying a twin or double room). Changes made within 10 weeks of departure and any change of holiday dates will be treated as a cancellation of the original arrangements by you and cancellation charges will apply as shown in clause 5. However, if the change is to increase the number of persons booked (without any other change) no amendment fee or cancellation charges will apply (although you will of course have to pay any increase in the total holiday cost). Subject to your meeting the conditions set out in clause 5, no amendment fee or cancellation charges will apply for a name change where the holiday arrangements otherwise remain exactly as originally booked unless flight tickets have been issued. In this case, a £35 per person amendment fee is payable. In addition, scheduled airlines may treat any change (including a name change) made to a

scheduled flight after tickets have been issued as a cancellation of the original booking and impose 100% cancellation charges. In order to make such a change in this situation, the full cost of the flight(s) affected must be paid again, in addition to the amendment fee of £35 per person. Please also see clause 5 below.

anyone who was originally due to travel must agree to these Booking Conditions and any other requirements which apply to the holiday before the change can be finalised. If the full price should have been paid when the change is requested but hasn’t been, this must also be paid before the change can be finalised.

5. Cancellation by the client

6. Alteration/Cancellation by Mark Warner

Cancellation will take effect only when written notification from the first named person on the booking is received by us or your travel agent. In all cases of cancellation the deposit and any amendment charges will be forfeited. If the booking is cancelled 10 weeks or less before departure the following cancellation fees, expressed as a percentage of the total holiday cost excluding amendment charges, will become immediately payable to us. Cancellation charges for holidays which include scheduled flights and/or pre-bookable extras may incur additional cancellation costs. Check with our After Sales department. Details are available on request at the time of booking. Written confirmation from us of cancellation by you will be issued within 14 days of our receiving your written confirmation of your wish to cancel. Contact us or your travel agent immediately if you do not receive this. If you are unable to go for any reason or decide that you do not want to take the holiday, you may transfer the whole booking or the place on the booking of the person(s) concerned to someone else/other people suggested by you and acceptable to us providing you meet the following requirements:(a) You must provide us with full details of who cannot or does not want to go on holiday and who you would like to go instead. We must receive this information from you or your travel agent as applicable at least 14 days before the start of the holiday. (b) Please see clause 4 for details of any amendment fees and other charges/costs which may be payable. Any part of the booking not transferred and/or subsequently cancelled will be subject to cancellation charges as detailed above. (c) Everyone who goes on holiday in place of

Arrangements for the holidays featured on our website and in our brochure are made many months in advance. Occasionally, we have to make changes to and correct errors in website and/or brochure and other details before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. However, in no case will we cancel your confirmed holiday less than ten weeks before departure except where we are forced to do so as a result of an event or circumstances beyond our control or failure on your part to comply with any requirement of these Booking Conditions entitling us to cancel (such as paying on time). Most changes are minor. Occasionally, we have to make a significant change. A significant change is a change made before departure which, taking account of the information you give us at the time of booking and which we can reasonably be expected to know as a tour operator, we can reasonably expect will have a major effect on your holiday. A minor change is any other change. The following changes to your confirmed holiday when made before departure are examples of significant changes: • a change of your UK departure airport to one which, in our reasonable opinion, is more inconvenient for you. A change from one London airport to another will not be a significant change (London airports are Gatwick, Heathrow, Luton and Stansted), • a change of scheduled departure time by 12 hours or more (not including flight delays) or • a change of accommodation for the whole or a substantial proportion of your holiday. Please note, a change in flight time of less than 12 hours, carrier, type of aircraft (if advised), destination airport (see also clause 9 below) or resort transfer arrangements will not constitute a significant change but will be treated as a minor change except where otherwise stated in these Conditions. If we have to make a significant change or cancel, we will advise you or your travel agent as soon as we reasonably can and give you the choice of the following options if there is time to do so before departure: (a) (for significant changes) accepting the changed arrangements or (b) purchasing an alternative holiday from us, of a similar standard as originally booked if available (if the alternative offered is less expensive, you will receive a refund but if it is

more expensive, you will not be asked to pay any more) or (c) cancelling or accepting the cancellation in which case you will receive a prompt and full refund of all monies paid to us. If we have to make a significant change or cancel 100 days or less before departure, we will, if and as appropriate depending on the circumstances and when the significant change or cancellation is notified to you, as a minimum pay you the compensation set out below subject to the following exceptions. Compensation is not payable where we notify you of a change or cancellation more than 100 days prior to your scheduled departure. Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care. No compensation will be payable and the above mentioned options will not be available if we cancel as a result of your failure to comply with any requirement of these Booking Conditions entitling us to cancel (such as paying on time) or if the change made is a minor one. No compensation is payable for children aged 2 or under. Period before Minimum departure when compensation we notify you or per person your travel agent More than 100 days

Very rarely, we may be forced to change or terminate your holiday after departure but before the scheduled end of your time away as a result of ‘force majeure’ (see clause 8). In this very unusual situation, we regret we cannot make any refunds (except where these are obtained from suppliers) or pay any compensation or be responsible for any costs or expenses incurred by you as a result. If, after departure, we are unable to provide a significant proportion of the services we had agreed to provide as part of our contract with you, we will do our best to make suitable alternative arrangements in respect of those services. If we cannot do so or you refuse to accept these for good reasons, we will arrange to fly you back to your UK departure airport (if your holiday includes flights) or to transport you to the point our contracted services commenced (if elsewhere than your hotel) as soon as we reasonably can. Except as set out above, you will in addition be entitled to compensation where appropriate.

7. Denied Boarding Regulations If your flight is cancelled or delayed, your flight ticket is downgraded or boarding is denied, depending on the circumstances, the airline may be required to pay you compensation, refund the cost of your flight and/or provide you with accommodation and/or refreshments under EC Regulation 261/2004- the Denied Boarding Regulations 2004. Where applicable, you must pursue the airline for the compensation or other payment due to you. All sums you receive or are entitled to receive from the airline concerned by virtue of these Regulations represent the full amount of your entitlement to compensation or any other payment arising from such cancellation, delay, downgrading or denied boarding. This includes any disappointment, distress, inconvenience or effect on any other arrangements. The fact a delay may entitle you to cancel your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight. We have no liability to make any payment to you in relation to the Denied Boarding Regulations or in respect of any flight cancellation or delay, downgrading of any flight ticket or denial of any boarding as the full amount of your entitlement to any compensation or other payment (as dealt with above) is covered by the airline’s obligations under the Denied Boarding Regulations. If for any reason, we make any payment to you or a third party which the airline is responsible for in accordance with the Denied Boarding Regulations, you must, when requested, assign to us the rights you have or had to claim the payment in question from the airline. If your airline does not comply with these rules you may complain to the Civil Aviation Authority on 020 7453 6888 or by e-mail to passengercomplaints@caa.co.uk or see www. caa.co.uk – Referring Your Complaint to the CAA.

8. Important Note – Force Majeure Except where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. In these Booking Conditions ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are likely to include (whether actual or threatened) war, civil strife, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, closure or congestion of airports or ports, adverse

Booking conditions continued weather conditions, volcanic eruption, airport, port or airspace closures, restrictions or congestion, flight restrictions imposed by any regulatory authority or other third party and all similar events outside our control.

9. Travel In accordance with EU Directive (EC) No 2111/2005, we are required to bring to your attention the existence of a “Community list” which contains details of air carriers that are subject to an operating ban within the EU Community. The Community list is available for inspection at http://ec.europa. eu/transport/air-ban/list_en.htm We are also required to advise you of the actual carrier(s) (or, if the actual carrier(s) is not known, the likely carrier(s)) that will operate your flight(s) at the time of booking. Where we are only able to inform you of the likely carrier(s) at the time of booking, we shall inform you of the identity of the actual carrier(s) as soon as we become aware of this. Any change to the operating carrier(s) after your booking has been confirmed will be notified to you as soon as possible. If the carrier with whom you have a confirmed reservation becomes subject to an operating ban as above as a result of which we/ the carrier are unable to offer you a suitable alternative, the provisions of clause 6 (Alteration/Cancellation by Mark Warner) will apply. We are not always in a position at the time of booking to confirm the flight timings which will be used in connection with your flight. The flight timings shown in our brochure, on our website and/or detailed on your confirmation invoice are for guidance only and are subject to alteration and confirmation. Flight timings are outside our control. They are set by airlines and are subject to various factors including air traffic control restrictions, weather conditions, potential technical problems and the ability of passengers to check in on time. Specific instructions relating to departure and travel arrangements will be sent with your air or other travel tickets approximately 2 weeks before departure. You must accordingly check your tickets very carefully immediately on receipt to ensure you have the correct flight times. It is possible that flight times may be changed even after tickets have been despatched - we will contact you as soon as possible if this occurs. Any change in the identity of the carrier, flight timings, and/or aircraft type (if advised) will not entitle you to cancel or change to other arrangements without paying our normal charges except where specified in these conditions. In the unlikely event of a change to your confirmed overseas airport, we will of course arrange for you to be transported to and from the alternative airport without any additional cost to you. We cannot be held liable for any delay which is due to any of the reasons set out in clause 11 (2) of these Booking Conditions (which includes the behaviour of any passenger(s) on the flight who, for example, fails to check in or board on time). In addition, we will not be liable for any delay unless it has a significant effect on your holiday arrangements. Notwithstanding the above, Mark Warner and the carrier will make all reasonable efforts as practical to reduce the discomfort suffered by you as a result of the delay. See pages 90 to 96 in our brochure or our website (www. markwarner.co.uk) for details of what is usually provided in the event of any delay.

94

It is the responsibility of the person who makes the booking to ensure that all members of your party are in possession of all necessary travel and other documents before departure. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation. If failure to have any necessary travel or other documents results in costs, expenses, fines, surcharges or other financial penalty being imposed on or incurred by us, you will be responsible for reimbursing us accordingly.

10. Damage by and behaviour of the client Mark Warner and its employees shall be entitled to recover from you the cost (reasonably estimated if not precisely known) of any damage or loss caused by you either during or after your holiday. If the actual cost of any damage or loss is less than the amount paid by you at the time where only an estimate could be given, the difference will be refunded. Any extra must be paid if the actual cost turns out to be more than was paid at the time. You agree to behave reasonably and not to disrupt the enjoyment of others on holiday with you or prejudice Mark Warner’s reputation with its accommodation or other suppliers. We reserve the right to immediately terminate the holiday of any client whose behaviour, in our reasonable opinion or in the reasonable opinion of any other person in authority, causes or is likely to cause distress, danger or significant annoyance to other clients, employees or to any third party or damage to property. In the event of such termination, our responsibility for the client concerned immediately ceases and we will have no further contractual obligations towards that person including return travel arrangements. We shall further be under no liability to make any refunds or meet any costs or expenses incurred by you as a result or pay any compensation.

11. Liability of Mark Warner (1) We promise to make sure that the holiday arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these Booking Conditions, we will accept responsibility if, for example, you suffer death or personal injury or your contracted holiday arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted holiday arrangements. Please note it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers). (2) We will not be responsible for any injury, illness, death, loss (for example loss of possessions or loss of enjoyment), damage, expense, cost or other sum or claim of any nature or description whatsoever which results from any of the following: the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party

not connected with the provision of your holiday and which were unforeseeable or unavoidable or ‘force majeure’ as defined in clause 8 above. (3) Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised on our website or in our brochure and we have not agreed to arrange them as part of our contract and any activity or excursion you purchase in resort. Please also see clause 14 “Website and Brochure information and outside activities”. In addition, regardless of any wording used by us on our website, in any of our brochures or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you. (4) The promises we make to you about the services we have agreed to provide or arrange as part of our contract - and the laws and regulations of the country in which your claim or complaint occurred - will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with the local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the UK which would have applied had those services been provided in the UK. The exception to this is where the claim or complaint concerns the absence of a safety feature which might lead a reasonable holidaymaker to refuse to take the holiday in question. Please note, however, our obligation is to exercise reasonable skill and care as referred to in clause 11(1). We do not make any representation or commitment that all services will comply with applicable local laws and regulations and failure to comply does not automatically mean we have not exercised reasonable skill and care. (5) Where we are found liable for loss of and/or damage to any luggage or personal possessions (including money) on any basis, the maximum amount we will have to pay you is £1000 per person. Any payment is subject to your producing appropriate proof of the contents and value of the luggage or personal possessions concerned. For all other claims which do not involve death or personal injury, if we are found liable to you on any basis the maximum amount we will have to pay you is twice the holiday price (excluding any amendment charges) paid by or on behalf of the person(s) affected in total unless a lower limitation applies to your claim under clause 11 (6) below. This maximum amount will only be payable where everything has gone wrong and you have not received any benefit at all from your holiday. (6) Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any air, sea or rail carrier to which any international convention or regulation applies, the maximum amount of compensation we will have to pay you will be limited. The most we will have to pay you for that claim or that part of a claim if we are found liable to you on any basis is the most the carrier concerned would have to pay under the international convention or regulation which applies to the travel arrangements in

question (for example, the Warsaw Convention as amended or unamended and the Montreal Convention for international travel by air and/or for airlines with an operating licence granted by an EU country, the EC Regulation on Air Carrier Liability No 889/2002 for national and international travel by air, the Athens Convention for international travel by sea and COTIF, the Convention on International Travel by Rail ). Please note: Where a carrier would not be obliged to make any payment to you under the applicable international convention or regulation in respect of a claim or part of a claim, we similarly are not obliged to make a payment to you for that claim or part of the claim. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the carrier for the complaint or claim in question. Copies of the applicable international conventions and regulations are available from us on request. (7) We cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses (including any loss of earnings incurred by any clients who are self employed).

12. Airlines and other carriers When you travel with any carrier, the conditions of carriage of that carrier will apply, some of which will limit or exclude their liability to you often in accordance with the applicable international conventions (for examples, see clause 11(6)). Copies of the conditions of carriage are available from the carrier or ourselves. Our website and brochure are our responsibility. Please note that in accordance with Air Navigation Orders, for a child not to be allocated their own seat on an aircraft they must be under 2 years of age on the date of their return flight.

13. Insurance All clients must have travel insurance which provides cover that is suitable and adequate for their specific requirements. We will not be responsible for meeting any sums which would have been covered by such travel insurance. You will further be responsible for paying to and indemnifying us for any such sums which we meet on your behalf. Please read your policy details carefully and take them on holiday with you. It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs. Please note most travel insurance policies do not cover hazardous activities such as scuba diving and certain water sports etc. If you intend to take part in any such activities, you must obtain appropriate specialist insurance cover. We do not check insurance policies. We do however act as an Introducer Appointed Representative for Citybond Suretravel who may be able to provide you with suitable travel insurance. Please see our brochure/website for further details.

14. Website and Brochure information and outside activities (a) The information contained on our website and in our brochure is correct to the best of our knowledge at the time of publication. Our website and brochure descriptions often refer to ‘other activities’ which are available outside the hotel. These activities are neither run nor controlled in any way by Mark Warner. They do not form any part of your contract with Mark Warner and are not endorsed by Mark Warner even where we suggest particular operators/ centres and/or assist you in booking such activities in any way. Accordingly, we regret Mark Warner cannot accept any liability in relation to these outside activities and clauses 6 and 11(1) of our Booking Conditions will not apply to them. We do not however exclude liability for the negligence of ourselves or our employees (providing they were at the time acting within the course of their employment with us) resulting in your death or personal injury. (b) Where we or your hotel make or take any booking for or from you in respect of any activity or excursion available outside the hotel, we or the hotel, as applicable, do so solely as booking agent. This is the case regardless of whether the activity or excursion is advertised or mentioned in our brochure, in resort, on our website or elsewhere. Your contract for any such activity or excursion will be with the supplier or operator of that activity or excursion. Mark Warner has no liability for any such activity or excursion or for any act(s) or omission(s) of the supplier or operator or for any of its/their employees or agents or any other person(s) connected with the activity or excursion. If we or the hotel are found liable in any respect for any such activity or excursion (for example in our capacity as booking agent), that liability is limited to the cost of the particular activity or excursion concerned. We do not limit or exclude our liability for death or personal injury arising from our negligence. (c) Where your hotel makes or takes a booking for or from you in respect of an activity, facility or service provided by the hotel but which is not advertised in our brochure or on our website and we have not taken any payment from you for this activity, facility or service, your contract for that activity, facility or service is directly with the hotel and not Mark Warner. This contract will be subject to the hotel’s own terms and conditions. Mark Warner has no liability for any such activity facility or service or for any act(s) or omission(s) of the hotel or for any of its employees or agents or any other person(s) connected with the activity service or facility. If however Mark Warner are found liable in any respect for any such activity, facility or service, that liability is limited to the price you paid for the particular activity, facility or service concerned. We do not limit or

exclude our liability for death or personal injury arising from our negligence. (d) We cannot guarantee accuracy at all times of information given in relation to such activities and excursions or about the resorts generally (except where this concerns the services which will form part of your contract) or that any particular excursion or activity will take place or be available as these services are not under our control. If you feel that any of the activities or excursions mentioned are vital to the enjoyment of your holiday, write to us immediately and we will tell you the latest known situation. If we become aware of any material alterations to resort information and/or such activities or excursions which can reasonably be expected to affect your decision to book a holiday with us, we will pass on this information at the time of booking.

15. Complaints Should you have a problem or complaint at any time during your holiday, you must report it immediately to the hotel manager or Mark Warner representative and, if applicable, the supplier of any other services concerned who will endeavour to put things right quickly. Any complaint which is notified verbally must also be put in writing as soon as possible during your holiday. If you remain dissatisfied, please email our Customer Services department at customerservices@markwarner.co.uk Alternatively, you can write to us at: Mark Warner Ltd 20 Kensington Church Street London W8 4EP In either case, you must do so within 28 days of your return from holiday, giving your booking reference and all relevant information. Please include your e-mail address and daytime and evening telephone numbers (if you are happy for us to contact you in this way) as this will enable us to respond to you more quickly. If you are not satisfied with our response we must be informed within another 28 days from the date of our correspondence. If you fail to follow this simple complaints procedure, your right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result.

16. Special requests If you have any special requests, please inform us (if you have booked direct) or your travel agent in writing at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot promise that any request will be complied with unless we or your travel agent (as applicable) have specifically confirmed this to you. For your own protection, you should obtain confirmation in writing from ourselves or your travel agent on our

behalf that your request will be complied with (where it is possible for us to give this) if your request is important to you. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.

17. Advance Passenger Information System For security reasons, most European and many other countries now require airlines to provide information about their passengers before they fly. This is known as Advance Passenger Information or API and includes full names, dates of birth, nationality, gender and passport details of all passengers but other details may also be required. The airlines set their own deadlines for receipt of this information which may be well in advance of departure. If it is not provided when required, you may be refused boarding on your flight. In this situation, full cancellation charges will apply. Accordingly, you must provide us with all information we ask you for when we ask for it. Where you make your own flight arrangements, you are responsible for providing API to the airline, if booking direct, or to your travel agent, when requested to do so. If, as a result of failure to provide information when required or the provision of inaccurate or incomplete details, you are unable to take your holiday, cancellation charges will apply as set out in our Booking Conditions.

18 Jurisdiction We both agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (“claim”) except as set out below. We both also agree that any claim (and whether or not involving any personal injury) must be dealt with by the Courts of England and Wales only unless you live in Scotland or Northern Ireland. In this case, proceedings must either be brought in the Courts of your home country or those of England and Wales. If proceedings are brought in Scotland or Northern Ireland, you may choose to have your contract and any claim governed by the law of Scotland/Northern Ireland as applicable (but if you do not so choose, English law will apply).

19 Financial Security We hold an Air Travel Organiser’s Licence issued by the Civil Aviation Authority (ATOL number 1176). When you buy an ATOL protected flight or flight inclusive holiday* from us, you will receive an ATOL Certificate. This lists the flight, accommodation, car hire and/or other services that are financially protected, where you can get information on what this means for you and who to contact if things go wrong. We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable). *The flights and flight- inclusive holidays we arrange are ATOL protected providing they are made available in the UK. For further information visit the ATOL website at www. atol.org.uk. For any holidays which do not include flights, all monies you pay us will be paid into a trust account which is controlled by an independent trustee. These monies will not be released to us until your holiday arrangements have been completed. These arrangements mean all monies you have paid us will be refunded to you in the unlikely event of our being unable to provide your holiday due to our insolvency.

Your Contract Please read carefully our booking conditions on pages 92-95 of our brochure and on our website at www.markwarner. co.uk. By asking us to confirm your booking, you are liable to be regarded as having had the opportunity to do so. The booking conditions together with the information contained in this How To Book section and our Travel Information found on pages 90-91 of our brochure and on our website at www.markwarner. co.uk form the basis of our contract with you. A binding contract between us comes into existence when either 1) we or your travel agent have received all appropriate payments at the time of booking or 2) for offline bookings made through a travel agent only, you have agreed that your travel agent will receive all appropriate payments within 3 working days of your booking having been made and 3) we have verbally confirmed the booking to you or your travel agent over the telephone or, in the case of online bookings, we have despatched our confirmation invoice to you. In the case of option 2 above if your travel agent does not receive all appropriate payments within 3 working days of your

booking having been made at the latest, we will cancel your reservation without penalty to either us or you and we will have no further liability to you.

Prices and brochure accuracy Changes and errors Please note that holiday information and prices shown in our brochure and on our website may have changed by the time you come to book your holiday. Whilst every effort is made to ensure the accuracy of the brochure, website and prices at the time of publication, regrettably errors do occasionally occur. We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. Your chosen holiday arrangements (including the price) will be confirmed on your invoice. Please note that bookings made prior to publication of the relevant brochure may be subject to significant changes upon confirmation of the programme and publication of the brochure. Please read clause 6 of our booking conditions for more details. During the season it may be necessary on certain dates to purchase extra flights and/or coach capacity. This may result in an increase in costs as we cannot always negotiate the same favourable seasonal rates. We will, however, only pass on such increased costs to you where your booking has not been confirmed. All such extra costs will be advised to you at the time of booking. For price increases after booking, please see clause 3 of our booking conditions – Prices and surcharges.

Final payment Please send the final payment so that we receive it no later than 10 weeks before the start of your holiday. This date will be clearly indicated on your invoice and failure to pay by this date may mean that your holiday will be cancelled and cancellation charges will apply – see clause 1 of our booking conditions. Should you indicate your consent at the time of booking, your balance will automatically be debited from your credit or debit card approximately 10 weeks before the start of your holiday using the details you gave at the time you booked your holiday (all credit card transactions incur a 2% handling fee). Please note, we do not provide receipts for payments unless this is requested at the time of booking.

Altered bookings All amendments to bookings must first be requested by telephone to the After Sales Department on 0844 884 3806 (and confirmed in writing if requested by them) or by email (if you have booked direct with us) to administration@ markwarner.co.uk. or if you have booked through one of our authorised travel agents, through the agent. We will endeavour to assist if we can. Once we have issued the confirmation invoice, there will be a charge of £35 per person per occasion a change is made (if the change can be made) except as set out below. Changes made within 10 weeks of departure and any change of holiday dates will be treated as a cancellation of the original arrangements by you and cancellation charges will apply, please see clauses 4 and 5 in our booking conditions for further details (note that these cancellation charges apply to all pre-booked elements of your holiday). However, if the change is to increase the number of persons booked (without any other change), no amendment fee or cancellation charges will be payable (although you will of course have to pay any increase in the total holiday cost). Subject to meeting the conditions set out in clause 5 of our booking conditions, no amendment fee or cancellation charges will apply for a name change where the holiday arrangements otherwise remain exactly as originally booked unless flight tickets have been issued. In this case, an amendment fee of £35 per name change will be payable if on charter flights. For scheduled flights, the airline may treat any change (including a name change) made after tickets have been issued as a cancellation of the original booking and impose 100% cancellation charges. Accordingly, you may have to pay the full cost of the flight(s) in question again as well as the amendment fee of £35 per person affected.
