YOUR HOME AT TIMBERS KAUAI...IT’S THAT SIMPLE Welcome to Timbers Kaua‘i – Ocean Club & Residences. Here is an overview of how to complete your annual reservations as a Maliula Residential Interest Owner.

MALIULA RESIDENTIAL INTEREST OVERVIEW: • •

There are a total of 17 luxury residences in the Maliula Program. Maliula Residence Owners enjoy a deeded 1/12th residential ownership interest. Owners may book three Planned Vacation Weeks each Club Year. In addition, Owners may book unlimited Space Available and Short Notice Vacations based upon availability and subject to the reservation procedures. The Maliula Residences are fully furnished three-bedroom residences averaging 2,020 sq ft with an additional 380 sq ft of private lanai. The Maliula Residences are located in an intimate four-story building set within the amenity-rich resort of Timbers Kauai – Ocean Club & Residences. Bordered by the Hokuala Golf Course and azure lagoons, each residence features stunning views of the Pacific Ocean, verdant mountains and golf course.

MALIULA PLANNED VACATIONS: Your three Planned Vacation Weeks are booked as two separate reservations. Your first reservation is a consecutive Two Week Vacation Period and the second reservation is a One Week Vacation Period.

CLUB YEAR: The Club Year generally runs from the first week of November through the last week of October.

SELECTION PERIODS: May 1 June 1st July 1st August 1st

Round 1, Request your consecutive Two Week Planned Vacation Period for the upcoming Club Year. Round 1, Receive confirmation of the Two Week Planned Vacation Period. Your Reservations Team will confirm your Planned Vacations according to the Reservation Procedures using Timbers Resorts proven rotation priority system to ensure fair and equal access for all Owners through the years.

SPACE AVAILABLE AND SHORT NOTICE RESERVATIONS Space Available reservations may be requested for any available week in the Club Year. Short Notice reservations may be requested for stays within 30 days of your desired arrival. Owners may have two Space Available and one Short Notice reservation confirmed at a time, however Owners may book unlimited Space Available and Short Notice reservations throughout the Club Year.

SUBTOTAL – OPERATING EXPENSES ....................................$11,903 Each Unit’s maintenance fee assessment cannot be computed simply by multiplying its percentage common interest by the totals shown. Rather, pursuant to the Declaration, the common expenses of the Project (and, thus, each Unit’s assessments) are allocated among the Unit owners in a fair and equitable manner based on a formula or method implemented by the Managing Agent. The Association’s Board of Directors has delegated to, Timbers Hawaii Real Estate, LLC, as the Project’s current Managing Agent, the power to allocate the project’s common expenses for the purposes of determining each Unit’s annual assessment. Expenses are allocated by the Association, and implemented by the Managing Agent, based on different allocation methodologies and factors, including (a) the relative size of a Unit, (b) the type of occupancy allowed in the Unit, and (c) the number of Units in each type of occupancy. The various methodologies and factors are then applied based on the type of expenses at issue. For example, the Guest Services expenses are allocated by occupancy under the premise that the Club Units will have a higher general occupancy than the Resort Apartments. In contrast, Loss Prevention (security) is applied on a unit-mix basis, because Loss Prevention applies to the entire project, regardless of occupancy or use, and all Unit Owners share the benefit on a unit by unit basis. Allocation methodologies and factors will be evaluated periodically and, thus, are subject to change from time to time, which means that the resulting common expense allocations and annual assessments are subject to change as well.
