‘Mercenary’ faces legal battle

BY CHAD VAN ESTROP A TYNONG North man planned to infiltrate West Papua to ‘‘engage in violent conflict’’ against the Indonesian government in West Papua, a Brisbane court has been told. Gerard Michael Little, 45, a disability pensioner, appeared in a Brisbane court last Wednesday, charged under laws that prevent Australians engaging in hostile acts against other countries. Federal police allege Little had received military training at a warfare school in the Ukraine. He was intercepted by police on Tuesday as he attempted to board a plane to Port Moresby, intending to make his way ‘‘undetected’’ into West Papua and work as a mercenary. He was denied bail after being deemed a flight risk. Commonwealth prosecutor Justin Williams described the case against Little as ’’overwhelming’’. Little had revealed his plans through his Facebook page. When the Weekly went to Little’s home on Wednesday, his housemates denied he intended any action in the Indonesian-occupied territory. Kevin Kelly and Michael O’Shea claimed he had hoped to create a foundation for West Papuan refugees in Port Moresby. ‘‘This is what we’re finding really hard. We can’t see ourselves where he’s done anything wrong,’’ Mr O’Shea said. ‘‘An incursion on a foreign land? He’s going to Papua, not West Papua. He’s not incurring on anyone.’’ The house, a run-down cottage on a disused tomato farm, was in disarray. Mr Kelly said police had arrived with a warrant that morning — as raids were being carried out on other addresses in Melbourne and Queensland where Little had lived — and seized items such as computer hard drives, documents and photographs, including pictures of Little dressed in military uniform. Mr Kelly also claimed that Little was a colonel in the Free Papua movement. The friends said Little, a divorced man with family in Queensland, identified as a member of the Wathaurung people, who are based

around Geelong and the Bellarine Peninsula. He does not accept Australian sovereignty. Mr O’Shea said Little, although only a small man, had worked as a bouncer in nightclubs in the Melbourne CBD. ‘‘You usually think of bouncers as being big blokes, but he was very quick and very capable.’’ He said Little had travelled to the Ukraine in August for training with the International Bodyguards Association. One of the charges he faces alleges he ‘‘allowed himself to’’ be trained there ‘‘in the use of arms or explosives . . . [and] military exercises’’ with the intention of committing an offence. He faces up to 10 years in jail on each of two charges. But defence counsel Nick Dore said Little had been invited to West Papua ’’to provide a service’’ and police still had a long investigation in front of them. ‘‘There is a big difference between someone

I am a green wedge landowner but can’t use my land for much except enjoying the views and paying the high-value rates to our council. We owners did not buy our land to develop it, but when agriculture is no longer economic with high-priced wages and water, then other ideas come to mind. But with planning restrictions needing onerous permit conditions to be met, we can’t even allow tourists to enjoy our majestic views.

I feel compelled to respond to Pam Hubbard’s superficial, and in parts, downright silly letter about Indian mynas (Weekly 3/12/2012). A proud Australian, I do voluntary work to protect Australia’s unique plants and animals. If Indian mynas are allowed to multiply, Ms Hubbard’s favourite crimson rosellas may become locally extinct, having nowhere left to shelter or raise their young. Council rejects call for debate on Islam BY CATHERINE WATSON CASEY councillors have overwhelmingly rejected deputy mayor Sam Aziz’s call for a discussion of the dangers of Islam before they decide on a planning application for a mosque in Doveton. At last Tuesday’s meeting, mayor Amanda Stapledon said such a discussion would create a poor perception in a multicultural community. Tensions between the mayor and her deputy, former close allies, were clear during a fiery debate in front of a large public gallery. The week before last, Cr Aziz offered to resign as deputy mayor. They patched things up — both explaining that it had been a matter of his other commitments — but last week’s debate revealed the real cause of the tension. When Cr Stapledon said she would be proposing an alternative motion confirming Casey’s commitment to multiculturalism, Cr Aziz described it as a ‘‘ridiculous’’ motion that insulted him. ‘‘Are you aware that I would be deeply

offended? That it would be suggesting I’m against multiculturalism?’’ Cr Stapledon: ‘‘I have had a week of discussions with you. The last thing I want to do is debate this with you in the council.’’ Cr Aziz: ‘‘I challenge you on a point of order. It’s not about multiculturalism, it’s about freedom of speech.’’ Cr Aziz’s original notice of motion proposed to invite Pastor Danny Nalliah, known for his strong views against Islam, to address the council ‘‘on the dangers of indoctrinated religious intolerance to the values, freedoms and stability of liberal and democratic societies’’. On Tuesday, he changed the invitee to Dr Mark Durie, an Anglican minister and author of The Third Choice: Islam, Dhimmitude and Freedom, and proposed that the council also invite a representative of the Islamic community to speak at a separate meeting. When it came to a vote, only Cr Rosalie Crestani supported him, with the other nine councillors voting against the motion. Earlier, Cr Aziz said his notice of motion was

All it does is bury things away.’’ Cr Aziz has been in the news in the past week as a vocal opponent of plans for a mosque in Doveton. He told the Weekly he would seek to impose a planning condition ‘‘not to preach hatred’’ from the pulpit.

Cr Aziz said such a debate had nothing to do with the planning application. ‘‘If the mosque is approved I’ll be happy to go down and participate in the opening because I believe in freedom of religion.’’ Cr Wayne Smith said a debate on the dangers of Islam would create a lot of controversy. ‘‘It will be the biggest general purpose meeting we’ve ever seen. It will attract the national media.’’ He said it could also be seen to influence a decision on the planning application which councillors will consider in January.

Cops are on the prowl A LOT of police about lately? You’re not imagining it, says Acting Sergeant Peter Howe of Cranbourne police. The police are out and about — and deliberately highly visible — as part of Operation Summer Stay, a two-month blitz on drink-driving and other holiday-type offences. Since the operation began on November 16, police have breathtested 13,673 drivers in Casey, 17 of whom have been charged with exceeding .05 blood-alcohol concentration and one P-plater with being over the zero limit. Acting Sergeant Howe said police were being high visibile not just to catch drivers out but to reinforce the fact that they will probably be caught if they drink and drive. ‘‘We are out not just during the night time but also during the day. Quite often people have a big night and then get up and think they’re OK to drive. They need to remember that even after five or six hours they can still be over the limit.’’ TAC road safety manager Samantha Cockfield said about a quarter of all

fatal crashes involved drivers or riders with an illegal blood alcohol content. ‘‘Your BAC and driving impairment start to increase from your first drink — even at .02 some of your driving skills are impaired.’’ The Summer Stay campaign will run across Victoria until January 9. — Catherine Watson

SEPARATE attempts to abduct two school-age girls in Pakenham have alarmed police. The incidents happened on consecutive days. In the first, a girl aged about 14, was seen running and apparently hiding from a man in a grey sedan. The following day, a 10 year old escaped after a man tried to force her into his car. Detective Inspector Paul Binyon of the sexual crimes squad said police were investigating if the two incidents were linked. ‘‘Details are scant at the moment. There is some information to suggest that there may be something happening out there and that is concerning.’’ Police said that about 8.30 am on Friday, November 30 a 10-year-old girl was riding her scooter south in Riviera Drive, Pakenham, on her way

to school when she was approached by a man. Police said the man enticed the schoolgirl to the rear of his orange or red-coloured station wagon, asking for help to remove something from the car boot. As the girl approached the car, the man grabbed her and lifted her into the vehicle. The quick-thinking victim jumped over the back seats and escaped out of the back door, hiding in a garden before raising the alarm. The man police wish to speak to is described as in his late 20s, of thin build and with an olive complexion and short dark hair. The father of the 10 year old l told 3AW he had let her ride to school to gain independence. He said it was important the suspected was apprehended quickly. ‘‘We wouldn’t want anyone else to go through what we are going through. It’s an absolutely terrible feeling.’’

Help wanted: Police have released this image of a man they wish to question regarding an attempted abduction in Pakenham last week. The previous afternoon an upset girl was seen running along Eagle Drive about 4.30pm. Police said she hid in a front yard and a witness saw a man in a grey sedan drive up the road, apparently searching for the girl. He left a short time later and the witness spoke to the girl briefly, before she ran away. Anyone with information on either incident is urged to call Crime Stoppers on 1800 333 000.

Casey takes the lead on animal cruelty BY CATHERINE WATSON CASEY Council is ‘‘setting the standard’’ for prosecutions against animal cruelty, says a former RSPCA inspector. Barrie Tapp, now an investigator with the Animal Cruelty Hotline, said Casey was the most innovative council in Victoria in bringing its own cruelty prosecutions instead of waiting for the RSPCA to act. His comments came as a Tooradin dog breeder faced 115 charges under new laws designed to stamp out puppy farming in Victoria. In the Dandenong Magistrates Court last Thursday, Derul Van Hollis and his company Demfield Pty Ltd pleaded guilty to running an unregistered breeding business and failing to comply with the code of practice for breeding and rearing establishments. The prosecution, by Casey Council, was the first brought under ‘Oscar’s Law’, named after a puppy rescued from a dog breeding factory in central Victoria in 2011. Magistrate Brian Barrow blocked a media

request for access to the brief of evidence, after counsel for the council Brett Melke argued that although the defendant had pleaded guilty, a substantial number of issues were still in dispute. Mr Melke said the council would be seeking to have Van Hollis and his company prohibited from keeping or selling dogs in future, a key feature of Oscar’s Law. The case has already been adjourned twice and counsel for Van Hollis, David Starvaggi, sought a further adjournment to February 28, when the evidence will be presented. Although the prosecution argued against the adjournment, Mr Barrow granted it, saying that although the case had a lengthy history, Van Hollis was entitled to his day in court. Representatives of the Animal Cruelty Hotline were in court to observe the case. Mr Tapp praised Casey for acting against animal cruelty. ‘‘It’s the most innovative council in Victoria in that regard. It’s their locality and they know what’s going on. ‘‘They are setting the standard. We’re trying to convince other councils to follow their lead.’’

t has been one wet winter, as far as recent memory tells anyway, and the city’s water storages are as healthy as they have been for a decade. But memory can be deceptive. It fails to remind us that those things to which we recently have become accustomed, like prolonged water restrictions and dry weather football, are at odds with normal. This year, weather and fire risk are returning to long-term established patterns, much like those that preceded the fires during the summer of 1997. The previous winter had been a soggy one, but that didn’t stop the flames roaring through 400 hectares of the Dandenong Ranges and killing three people. Fire Services Commissioner Craig Lapsley says that in hindsight, that particular fire was comparatively small ‘‘but it had a very, very direct path’’. Mr Lapsley, whose focus is on the warming summer months ahead, says that in areas like the Ranges with a dense population area and ample fuel, even smaller blazes can have dire consequences. ‘‘The thing that defines fires in those areas is that they don’t have to be very big. You can have a fire of a few hundred hectares but [it] will still have an enormous impact because of how densely we live — the fire is always going to be near homes.’’ As people prepare to go on holidays to celebrate Christmas or the new year, they’re being urged to consider what they can do to protect themselves this summer. This year marks the introduction of several initiatives in the Dandenong Ranges and surrounds suggested by the royal commission into the Black Saturday bushfires. TARA McGRATH talks to the Fire Services Commissioner to see how the season is shaping up. warnings — like sirens, text messages and community refuges — Mr Lapsley is urging residents not to be complacent. ‘‘The shared responsibility and shared obligation still has to be there. People have to take responsibility for themselves, their actions, their preparedness.’’ The Bureau of Meteorology has predicted a return to a ‘normal summer’ — like those of the late ’90s before the drought. That means aboveaverage maximum temperatures and aboveaverage minimum temperatures. In turn, this means fuels like grass don’t take on overnight moisture, so the next day they will be in a drier fuel condition. ‘‘January and February will be the peak of it, but people need to be conscious of what happens in December as well,’’ says Mr Lapsley. ‘‘We’re not saying it’s absolutely doomsday, but in the types of climates that are being forecast fires will travel — travel and do damage.’’ One of the simplest things residents can do to protect their property is look over their backyard fence if they live next to parkland. ‘‘See what’s over it — how many people dump their rubbish over the back fence, how many people put their own grass clippings over the fence — because it can be out of sight and out of mind.’’ John Schauble — manager of policy and planning for the Fire Services Commissioner and captain of the Sassafras-Ferny Creek fire brigade —

says people in the suburbs can overlook the risks around them. ‘‘People have this thing of ‘I live in the suburbs, it’s not my problem’. Well, in fact it is, particularly in newer developments around Rowville and places like that because you are exposed to parcels of bush around you.’’ Mr Schauble warned that anyone within 700 metres of a substantial bush area was at risk of a bushfire or ember attack. ‘‘Because a third of the population in the outer eastern suburbs changes every five years, it’s difficult to engage people who have only just arrived, [as] opposed to people who have been there [over the past] 1000 years — it’s a challenge.’’ The state’s emergencies bodies say they have learnt from the disasters of Black Saturday and are trying to minimise those risks. Mr Lapsley says an array of warning systems is being introduced: ‘‘The royal commission saw the warning systems as not reliable or sophisticated, so there’s been a lot of work to improve them — both reliability and options. Not everyone has a mobile phone, not everyone hears the siren, not everyone listens to the radio.’’ For the first time ever, if you’re in an area that’s been threatened by a fire or similar emergency and your mobile phone network is Telstra, you’ll receive a text message alert. Messages would previously only be sent to users whose billing address was in the affected area. Now, even if you live in Mt Waverley and you’re enjoying a

picnic in Sassafras, you’ll receive an alert. Mr Schauble called the technology enhancement ‘‘groundbreaking’’. Another ‘first’ for the Hills area is that three helicopters will be based at Healesville and Olinda this summer to fight fires from the air. But they’re dwarfed in size by the incredible Elvis helicopter, based at Essendon. Sirens at various CFA stations across the area have also been activated this year — a fiveminute continuous siren signifies an urgent emergency in the area and residents should seek further information about it. A 90-second siren means a fire unit is responding to an incident. On the ground, community fire refuges will also be trialled over this summer. Mr Lapsley says the office is hoping to learn from the initiatives in the Dandenongs. One refuge will be built in Mr Schauble’s home town of Ferny Creek — pure coincidence, he insists with a laugh — and all three locations for the refuges have been chosen based on existing infrastructure. The Ferny Creek refuge is at a primary school that was built after Black Saturday, so it already meets certain standards. When school finishes before Christmas the building will be upgraded. ‘‘You wouldn’t build a concrete bunker for 200 people because that’s all you could ever use it for,’’ Mr Schauble says. Although he says they’re unlikely to be used in 2013, the pilot refuges will become a template in further years. But as for now, Mr Schauble says the area is tracking well come bushfire season. ‘‘But come late January, if we haven’t had much rain, people will need to be prepared.’

Australia Education Union members massed outside the Pakenham office of Eastern Region MP Edward O’Donohue to continue pressuring the Baillieu government. Pay negotiations between the AEU’s Victorian branch and the government broke down late last month when the government failed to respond to a revised pay offer. The new offer — 12 per cent over three years — is significantly different to the 30 per cent rise pay the union originally sought. The government’s counter offer remains a 2.5 per cent pay rise a year plus the introduction of performance-based pay. Berwick Fields Primary School principal Stephen Wigney said it was ‘‘ridiculous’’ negotiations had dragged on more than a year. ‘‘When [school] reports start coming home with the bare minimum, parents might start to get the picture of the severity of the issue.’’ The AEU’s Berwick branch president, who wished to remain anonymous, said there had

Second ‘reluctant’ councillor elected CASEY’S marathon 2012 council elections saga is finally over. Louise Berkelmans is Casey’s 11th and last councillor, elected in Springfield Ward last week on countback. But the music teacher only reluctantly agreed to accept the gig. For almost 12 hours she looked like being the second successful candidate to baulk at the finish line. Ms Berkelmans was declared the winner in Springfield at 2pm last Monday after the countback prompted by the resignation of Jo Wass two days after the election. But within half an hour of the announcement, Ms Berkelmans told the Weekly that she had too much work to become a councillor. ‘‘I didn’t agree to be part of the countback and no one called me.’’ She said she had really only stood to gain experience for a serious tilt at the council at the next election. ‘‘I knew I wouldn’t get in. I went in very green.

‘‘I’ve learned a hell of a lot this time.’’ But she was persuaded to change her mind and her acceptance of the role was announced on fellow councillor Wayne Smith’s Facebook page late on Monday night. Ms Berkelmans told the Weekly she had reconsidered after speaking to her husband, a couple of the councillors and Casey chief executive Mike Tyler. ‘‘At first I thought it was four years too early, but when I sat down with my husband I thought this is meant to be. I’m really excited that I’ve been given this opportunity.’’ She was sworn in before last Tuesday’s council meeting. At the meeting, deputy mayor Sam Aziz criticised ‘‘misreporting’’ of Ms Berkelmans’ reluctance to take the position. ‘‘We were told she would not be taking the position and here she is.’’ Ms Wass stood down as councillor for the ward two days after she was elected in October, citing family reasons. change of mind — has revived the debate over the widespread use of dummy candidates in the Casey election. In Parliament last Thursday, Narre Warren North Labor MP Luke Donnellan accused upper

house MP Inga Peulich of turning the council into a family affair by organising a ‘‘B list’’ of dummy candidates to support the genuine candidates. He cited Ms Wass’s resignation to clear the way for ‘‘A list’’ candidate Bob Halsall, an incumbent councillor for the ward. Ms Berkelmans said she knew Mr Halsall through her involvement in the Casey arts world but denied she was a dummy candidate.

New centre in sight for blind students CLOSE your eyes. Better still, wear a blindfold. Then sit in a crowded place — an office, a railway station or shopping centre — and try to work out what’s going on around you. That, says Maria Franca Lachman, is what it’s like for blind students in mainstream schools. ‘‘You can’t expect a blind child to sit in a classroom and learn. ‘‘That’s not equal opportunity. They often don’t understand what’s going on. They need to touch all the time. They can’t learn any other way.’’ Last week, a long journey for Ms Lachman and her husband Alan reached a milestone when Education Minister Martin Dixon turned the first sod for the Insight Education Centre — which will be Victoria’s only specialist school for blind children — in the grounds of Monash University’s Berwick campus. The first intake will include the Lachmans’ youngest daughter, Francesca, who was born blind in Italy, where they were living.

Four years ago, the Lachman family returned to Melbourne because they wanted a better future for Francesca, then aged seven. They enrolled her at the Burwood Education Centre for blind children, operated by Vision Australia and soon saw a dramatic change in their daughter. She started to read Braille and to write using a Brailler. Her communication skills and independence improved dramatically. But two months later, Vision Australia announced it was closing the centre. Francesca’s only option was to return to mainstream primary school — where she quickly went backwards. So began the Lachmans’ quest to ensure that she and other blind students could receive dedicated education, in the company of other blind children and with specialist teachers and facilities. Over the next four years, they and a team of parents battled knockbacks, red tape and wrong turns. The first breakthrough was securing a funding commitment from the Liberal Party before the 2010 state election. The second was securing

Progress on kindergarten memorial Plans to turn the Cockatoo kindergarten into an Ash Wednesday memorial may be gaining momentum — almost 30 years after fires ravaged the site. Cardinia Shire Council has allocated $200,000 for the project in its 2012-13 budget, but locals say it will not be enough. Cockatoo Township Committee president Graham Simpson said the project needed $500,000 to get started. Concept plans submitted to the council by the committee in December last year will form the basis of its funding submission to the state and federal governments. Mr Simpson said he would have liked the project completed before the 30-year anniversary of Ash Wednesday in February next year but did not want to rush it. ‘‘I’d like it done but I’d like it done right,’’ he said. However, the council is working with the local community on an appropriate commemorative event for the anniversary.

Back pay for south-east workers A Narre Warren childcare worker has been back-paid $15,000 in underpaid wages, following recent intervention by the Fair Work Ombudsman.The back pay was for underpaid amounts over five years between 2007-12, a Fair Work spokesman said. The payment was part of $104,000 recently recovered for workers in Melbourne’s south-eastern suburbs. Just over $100 million has been reimbursed to more than 56,000 unpaid or underpaid workers in Victoria between July 2009 and September this year.

Trio arrested over arson Casey CIU detectives have arrested three people in relation to a series of suspicious fires in the Berwick area between June and

August. Shaun Boxell, 18, of Mornington and John Bellette, 21,of Cranbourne have been charged with nine counts of arson and were remanded to appear at Melbourne Magistrates Court last week. A 21-year-old Narre Warren South man was also charged with four counts of arson and bailed to appear at the Dandenong Magistrates Court. The men were arrested after investigators identified a number of similarities in the fires. Parkland, primary schools and kindergartens were allegedly targeted, with one fire causing $200,000 damage to the Old Cheese Factory in Berwick .

Car-ram robbery attempt A 29-year old man was held up in Nine Mile Road, Bayles, after his car was rammed last month. Police said a man in a ute rammed the victim’s car, cutting him off, and made demands that he hand over money just after 2 am on November 24. The offender was wearing a green hat and is described as Caucasian, with black hair and of a slim build. A woman, wearing a white top and hat, also struck the victim’s car with a shovel. The offenders travelled in a silver Ford AU utility. Police are asking anyone with information to call Crime Stoppers on 1300 333 000.

For children Fill the Christmas stocking Each team needs a sock, a spoon, a bucket and some lollies. Divide the children into teams at one end of the living room and hang up the socks at the other. Place a bucket with lollies and a spoon in front of each team. A child from each team takes a lolly with the spoon, carries it to the sock and puts it inside. The child then runs back to his team and gives the spoon to the next child. The first team to put all the lollies in the sock wins. Sing the Christmas carol Each guest receives a piece of paper and a pencil. They then write down four of their favourite Christmas songs. When the songs have been written down, each is assigned a number from 1-20. To start the competition, the host calls out a random number and the guest who wrote it down has to start singing the corresponding song.

The host then calls out another number and that person starts singing. The first guest who gets to sing all his/her four songs is the winner.

For adults Can you guess the song? This game is good to play right after dessert, when everybody is still at the table. Start by choosing a word from a random Christmas song. Now, the other guests must sing a Christmas song which contains the word, and thereby guess the name of the song. If nobody can guess the name, say “I challenge you” and the challenger must sing the song to confirm that the word is in the lyrics. It is not as easy as you might think, and it’s a lot of fun.

Magpies pin down Berwick

Stars in his eyes for moments with heroes BY ROY WARD AMONG Clive Rose’s treasured childhood possessions is a picture with of him as a boy getting an autograph from cricketing legend Shane Warne. Now the 22-year-old Narre Warren South resident is playing alongside Warne in the Melbourne Stars team in the Big Bash Twenty20 competition. Rose said he was soaking up every part of the experience from playing with the Stars, especially spending time with Warne and the team mentor, West Indian great Sir Viv Richards. “I went into camp and you find yourself hanging around guys like Warne and Sir Viv,” Rose said. “When I was growing up I got a picture and an autograph with Warne and now I’m playing with him — it’s pretty special.” The Casey-South Melbourne all-rounder said he was relishing the time he got with his experienced teammates at the Stars. “Warne said the other day that he had never been around a team with such a group of talents and support, which is a pretty big thing for someone like Shane to say.”

He has already picked up some pointers from former England spinner and Stars sports psychologist Jeremy Snape and fielding coach Trent Woodhill. Rose is no certainty to get a game for the Stars, with Warne and Victorian all-rounder Glenn Maxwell in the Stars squad. But he has pledged to do everything he can to use his Stars time to earn a contract with Victoria or one of the other state teams.

New star: Clive Rose is loving life with the Melbourne Stars. “I’m definitely living the life of a pro cricketer at the moment and I’ve got a taste for doing it as a career. ‘‘I’m more hungry than ever to get a state contract and push my claims.”

NARRE Warren scored a confidenceboosting win over arch-rival Berwick in the DDCA turf 1 competition on Saturday. The Magpies had to chase the Bears’ first day total of 188 with Ateeq Javid (42) leading the way and captain Wendell Perumal (41 not out) and wicketkeeper Shaun Grabert (33 not out) steering their side to victory with just two wickets to spare on 8-190. Ash Henry (3-72), Jason Goodes (2-26) and Ryan Crawford (2-30) got the wickets for the Bears. The Magpies’ win moves them to ninth place on the ladder. The Bears are in fourth place but have Springvale South one point behind in fifth place. Dandenong West remains in top spot after beating Heinz Southern Districts by six wickets.
