Liverpool’s St Paul’s Square development is today claiming to be the UK’s most first-time buyer friendly development, as research reveals 92 per cent of residents chose to purchase their first property in the building. Assured shorthold tenancies are the most common form of private renting agreements in England and Wales. They were originally created under the Housing Act 1988. They only came into being if, before the tenancy commenced, the Landlord gave the tenant a statutory notice specifying the tenancy to be an assured shorthold. If the landlord did not give the tenant such a notice the tenancy would become as assured tenancy – similar words but very different as the tenant would have much more protection and the landlord would have much more difficulty in removing the tenant out of the property. This all changed in 1997 and the requirements were reversed in that if no notice was given the tenancy would automatically become an assured shorthold tenancy. This means that the tenant has no security beyond the term of the tenancy which has to be for a period of six months.

However, in order to bring the tenancy to an end the landlord has to give the tenant a notice containing specific information – a mere letter is not sufficient although a letter containing the specific information will be considered a valid notice. The notice must give the tenant at least two months and must end at the end of a rent period. This means if your rent is payable weekly on a Monday the notice must have an end date on a Sunday and if payable monthly, on say the 12th of each month, the notice must expire on the 11th of a month provided there is a gap of at least two months. This means in some cases the notice period will be almost three months. If the tenancy has gone beyond the period of the tenancy it converts to a periodic assured shorthold tenancy but the landlord still has to give the tenant at least two months’ notice to bring the tenancy to an end.

If there is no written agreement the tenancy will be considered a periodic assured shorthold tenancy and bound by the same conditions to end the tenancy. As far as the tenant is concerned unless the tenancy agreement states otherwise the tenant is liable the payment of rent for the whole of the period of the tenancy. However, to bring the tenancy to an end the tenant only has to give the landlord a week’s notice if the rent is payable weekly or a month’s notice if payable monthly. Don’t forget it is in the landlord’s interest to have a good tenant. If you like the rented property you live in, pay your rent on time, look after the property and co-operate with your landlord.
