1 — 創刊序

序一 本刊名為《新香港》，何謂「新香港」？舊香港代表獨裁、中國嘅殖民壓迫，⽽ 香港 嘅 主權正被中國人強佔；新香港 代表自由、民主，⽽香港 嘅 主權 將會緊 握喺香港民族⼿上，族內各員嘅福祉更會得到保證。編者希望藉《新香港》令 ⼤眾理解民族存在族裔（ethnic）及公民（civ ic）兩個⾯向，從⽽探究香港民 族嘅本質。過往⼤部分關於香港民族嘅論述，主力著墨喺公民⾯向，嘗試⽤民 主、自由等價值解釋香港民族嘅出現。但單憑主觀嘅公民價值，實在難以將香 港民族完整描述出嚟。故此，本刊有必要梳理出香港民族族裔性及其意義，包 括祖地、語⾔、象徵、文化，同時借助主觀認同，包括共同價值、信仰、情感，將 新香港最重要⼀環— 香港民族嘅完整⾯貌呈現讀者眼前。 過去香港人參與各式形式嘅政治活動，不自覺已經成為香港民族主義者。參 與政治需要認識香港語⾔、歷史、文學、民俗等族裔材料，過程中整理香港民 族嘅客觀基礎；香港人亦運⽤想像創造 新嘅民族象徵，將主觀嘅認同與公民 價值呈現喺象徵之上，過程中展現嘅係族內各員之間嘅 情感連繫。過往⼀年 國歌、國旗、符號嘅出現，正係香港人豐富民族內涵嘅實例。 與此同時，有唔少香港人忽略想像嘅力量，謊⾔同恐嚇亦限制咗想像空間。亦 正因如此，本刊創刊另⼀目標係豐富⼤眾 對香港民 族嘅想像。想像係進步嘅 原始動機，想像⽽⽣嘅美好願景更引領我哋⼀步⼀步向目標實踐。事實上，偉 ⼤政治願景不外乎通 過以下路 徑實現：想像— 散 播 —實踐 — 再想像。香 港民族獨⽴建國嘅最⼤障礙並唔係中國軍隊，⽽係來自我哋思想嘅局限。

不論係民族理論入⾯嘅 族裔象徵 論（ethno-symbolist）、原⽣論（primordialist）、抑或現代論（modernist）主張者，都難以否定想像嘅 威力，正如學 者 Benedict Anderson如此形容： 最 終，正 是 這 種 友 愛 關 係 在 過 去 兩 個 世 紀 中，驅 使 數 以 百 萬 計 的 人 們 甘 願 為 民 族，這 個 有 限 的 想 像，去 屠 殺 或 從 容 赴 死。

歷史上無數人曾為民族獻身，力量之⼤⾜以改變⼀切，細至鄉村風俗，⼤至國 與國疆界版圖，民 族嘅力量⼀次又⼀次改變我哋身處嘅現實 世界。正因想像 嘅力量如斯巨⼤，我哋 創⽴本刊嘅 原委正要借助新香港嘅 願景，為讀者掃除 想像嘅障礙，鋪平通往新香港嘅道路。 德國作家歌德（Johann Wolfgang von Goethe）曾對自⼰嘅祖國有以下疑問：

Have we a fatherland? If we can find a place where we can rest with our possessions, a field to sustain us, a home to cover us, have we not there a fatherland?

香港人亦有相同疑問：究竟我哋有冇祖國？開埠至今⼀百七⼗九年，前人尋覓 多時，其實祖國⼀直喺我哋腳下。謹將本刊獻俾我哋嘅祖國— 香港，以及為 建⽴新香港歷盡苦難，仍然堅持不懈嘅兄弟姊妹。

今日編者撇開獨⽴建國嘅 主張不談，謹 此淺談 對《新香港》嘅 期望。對編者 ⽽⾔《新香港》作為⼀本以香港民族主義論述為基 礎嘅刊物，最基 本嘅方針 係：以民族嘅角度論語⾔，再以香港嘅語⾔論香港民族。文字嘅力量固然⼤， 但單係講文字嘅 力量，並不⾜以引證語⾔對 香港民 族嘅 特 殊意義，亦容易忽 略 語⾔ 本質上群 體 性。我 哋 必 須以⼀ 個民 族 為單位，去 探索民 族、語⾔、主 權三者嘅關係，實行本刊嘅宗旨— 建構對香港未來嘅 願景。 透 過 閱 讀、理 解、運 ⽤嘅循環，諸位 讀者作為 香 港民 族嘅 ⼀員，事實上亦與 本刊⼀同構建香港嘅 未來。狹義上，香港嘅民 族語⾔指嘅係香港語，基 本 與 口語溝通形式⼀致，書⾯上展現與「標準中文」截然不同嘅語法、詞彙；廣義 上，香港嘅民族語⾔可以「三文兩語」統稱，亦即香港文、英文、華文，以及口 講 嘅香港語與英語，為日常以至官方使⽤嘅語⾔形式。然則不論 狹義 廣義， 內涵價值都係不變：香港語⾔為香港主體嘅載體，鞏固香港民族 對自身歷史 文化嘅認同與自豪，亦呢種自豪感亦香港嘅民族語⾔得以傳承下去。 觀乎呢 種 互為因果嘅現 象，我哋不難發現：香港民 族與香港 嘅語⾔，係同氣 連 枝、充滿⽣機嘅有機 體，亦係香港 存在嘅 象徵。呢種現象並非編者或其他 民 族 主義 者 創作⽽成，亦 並非基 於 後 天 嘅 政 治需要 ⽽加 諸 嘅 意義 — 事實 上，香港民 族使⽤香港語⾔，理 所當然，甚至係與⽣俱來嘅 本領，只係我哋⼀

直都未有察覺。由兒時 我哋喺 紀念 冊上寄語朋友，到年少時互 通書 信，投身 社會 後偶爾觀看⼀部港產電 影，直至垂垂老矣之年，不忘以⼿機向故友留⾔ 問候，總係不乏香港語嘅身影，係香港人⽣活不可或缺嘅 部份。即使 未有經 過「正 規」嘅課程講 學，亦從 來都無官方機 構嘅 政 策支持，香港嘅語⾔卻仍 然⽣⽣不息。背後代表嘅不單係身份認同與主體意識等概 念，準確⽽⾔其實 係香港民 族交 織⽽成嘅想像與習慣，係每⼀ 位香港民 族嘅 成員，不同階層、 不論 老少，於「無意間」達 成嘅 取 態與 共 識。此 等 想像與習慣，從 意 識 形態 到實際 表現，渾然天成，無時 無刻呼應住語⾔嘅 群 體 性，毋需官方對 群眾單 向規範、束 縛、宣導，只需靠民 族 成員之間相互交集，即可不斷豐富內涵。因 此，我哋可以話：從 開端、過 程 到最 終呈現嘅 ⾯貌，香 港 嘅 語⾔與 香 港民 族 嘅羈絆，如同呼吸⼀樣自然。 ⼗八世紀普魯士政治家威廉·馮·洪堡（Wilhelm von Humboldt）於1797年 曾經咁講：

語⾔係民族精神嘅「呼」。 Language is the spiritual exhalation of the nation.

對 洪堡⽽⾔，民 族以其 語⾔展現 精神特 質，如同呼氣⼀樣，令民 族 成員以至 外 在者從其氣息感受到⽣機 — 事實上語⾔不只係民 族精神嘅呼出，其締結 滋養 猶 如⼀呼⼀吸，證 實民 族嘅存 在，亦令民 族可以不斷汲收養 份，持 續 成 長自強。香港民族亦必如此。

序三— 新香港需要違法

《新香港》乃探討香港民 族的刊物。在中國殖民者高壓 殘殺香港人、撕 破⼀ 切所 謂「自治」的假⾯具、香港 和平演化為民 族 共和國之 途已盡的時刻，希 望藉本刊讓香港人了解自⼰作為⼀個民族的各 個⾯向，並提出對香港民族的 願景。亦希望民族政體 將來誕⽣之時，香港民族共和國的制度、文化、國土、 價值等基礎皆有所依據。 說到香港的價值，「法治」過去⼀直被視為香港的核心價值，法律在香港人眼 中有著彷彿神聖的地位，連同作為法律代表的律師和法官都像是高人⼀等、 備受尊重。但如今當 楊岳橋的⼀句「法治有險可守」成 為眾 人可每日翻炒的 笑柄，我們其實也早就明白，香港的所謂「法治」和法律制度，已同是笑話。 當警察 這 類 握有公權 力之人可以不斷 違 法⽽無後 果，這 樣 的法 律 制度其實 不要也罷。因為違法已成為少數人的特權，本質上這絕不是可以靠法律解 決 的問題，取 締這種特權的方法，最 終只會是人民⼀同違 法，並使人民即使 違 法 也同樣 無法律 後 果。那如何使人民違 法 也無法律 後 果？就是 令政 權和所 謂的執法機關無法或不敢針對人民執法。 主權在民，人 民 ⼤ 於法 律，故不 被 人 民認可的法 律 無需尊重，亦無 被 遵守的

資格，相應 的 執 法 行為也 沒有正當性可⾔。19 9 7年以 來中國 殖 民 政 權的 種 種暴行早已說明，香港的法律，早已徹 底 腐化，淪為 殖民者殘害 香港人的工 具。中國無視香港⽴法程 序，直 接對 香港訂⽴ 所謂國家安全法，不過是又⼀ 例子⽽已。 但 過去香港人 針對惡法的抗爭，局限 於「公民抗命」— 違 法並 承擔 法 律 後 果，以凸 顯 相關 法 律 的不義 — 結果只是 承 認、鞏固香 港 的法 律 制度，同 樣 是為惡法 提 供認受性。事實上，當殖民政 權⼀方已表明自⼰可超然於香港現 時的法律，根本就不應再妄想香港人的出路能與這樣的法律共存，令這些法 律⾯對香港人也同樣變成⼀紙空文，是光復香港所 無可避免的⼀環，也是 終 結殖民、彰顯主權在民的必經階段。 誠然，法治乃文明世界的重要價值，香港若要從中國的殖民回歸文明世界，最 終 仍必須重建有效和正當的法律和公權力制度。然⽽，若香港不先擁有尊重 法律的主權，以及 嚴 受法律束 縛的政 府 和公權 力者，法治就不 可能實現。了 解法治取決於主權，才能知道如何為香港帶來真正的法治。 因此，我們要打破對法律的神聖幻想，認清必須先毀滅當前的法律、按主權在 民的原則為民族共和國建⽴新的法律，才是維護法治和其價值的正確方法。 《新香港》希望為香港人帶來對自身民族的正確認知，破除長年殖民思想灌 輸所 帶來的思想框限，空談法治⽽忽略說明主權、無條件地害怕「違法」，正 是其⼀。願香港人很快就會看清，只為殖民服務的法律和制度，死不⾜惜。

Preface for The New Hong Kong No man ever steps in the same river twice,

for it is not the same river, nor is he the same man.

—Heraclitus

The sweet yet bitter taste of brine permeates the air, a chorus of cicadas ebbs and flows in the distance, and there is nary a thought that goes through the mind of our fisherman, sitting there mending his net at the shores of Kowloon, save how big his next catch is going to be.

There used to be kings and lords centuries ago who claimed this part of the world as their own, but our fisherman couldn’t care less, for he is no historian. In the place of kings there has been an emperor for quite a while now, but our fisherman doesn’t really know who he is, for that is of no concern to his trade. There are stories of Jurchens and Mongolians and Manchus with their mighty horses up North, yet still those remained stories for our fisherman. For centuries now, there has been relative peace around these lands, and the most excitement anyone could get is by joining either the local bands of pirates or some merchant fleet destined for ports nearby.

But our fisherman is content: the sea provides for him sweet harvest, and for that he calls it the Fragrant Harbour, or Hong Kong in his native tongue.

I wonder if our fisherman knows the very bit of dirt he’s standing on is going to be the battlefield where Hongkongese make their desperate stand against the Northern tide, now finally crashing down. I wonder if this Fragrant Harbour of his could remain his beloved Hong Kong, or whether it’ll be polluted into Xianggang. And I wonder if our fisherman, who cares for naught but his catch, could imagine that even he contributed — as one out of many pebbles — in the grand flow of history, all to give birth to a new nation: the Hongkongese.

This publication, the New Hong Kong, comes at a time when the flow of history finally takes its dramatic turn after decades of agitated stagnation. Like the Hong Kong people it champions, this publication is but one out of many pebbles, though now their accumulation has reached a tipping point. The deformed rocks of old, out of ignorance and blind trust, have laid the broken foundations of a Chinese river, now polluted beyond repair by Chinese colonialists. Its flow may be obstructed now — some of the old pebbles have absorbed the poison into their core, and the young pebbles are trapped, caught in the torrent of endless pollution, desperately clinging on to each other. And see how the fishes so beloved by our fisherman are plundered dry! But just as the birth of the Hongkongese was unknown to our fisherman, our desperate pebbles have unknowingly built a dam out of their own bodies in defence of Hong Kong — a dam that, with the right pebble added at the right place, will let loose a torrent mightier yet, and create a new river, a new people, and a new fate.

Cry ‘havoc’, and break now the dawn.

9 — ⾹港民族及其祖地

香港民族及其祖地 顧濟時

中國殖民下，香港政治形勢越趨惡劣，故有港人提倡於海外建⽴自由、民主嘅 「新香港」，以圖能脫離中國殖民壓迫。⽽佢哋對「新香港」嘅定義亦各有不 同：例如喺不涉割裂他國主權情況下，於加拿⼤、澳洲等國家建⽴海外香港人 社區；又如籌集資金向部分國家購入島嶼建⽴主權國，但不論為上述何者，其 主張建⽴嘅「新香港」均傾向主動放棄祖地，永久遷居外地。然⽽，祖地對民 族存亡極為重要 — 本文首先解釋香港作為祖地對香港人嘅意義，其次闡明 缺乏祖地意識、割斷祖地連繫嘅移居海外主張，有害香港民族嘅原因。同時， 本文認同香港人流散 海 外 有其現實需要，如人身安全威脅，但流散 海 外只係 暫時 性，民主與自由嘅 新香港 要建 ⽴在我哋現 正身處嘅香港之上，⽽非別國 某⼀城市、某⼀偏遠島嶼。由此，本文提出香港人離港 後只有兩個選擇：歸化 成為另⼀民族，抑或自覺身為香港民族⼀員暫居外地，視重奪及回歸祖地為畢 ⽣目標，將之實踐。

民間對「新香港」嘅想像 建⽴海外「新香港」嘅概念並非新鮮事，早於⼀九八九年，當港人目擊中國政 府於北京屠殺學⽣，港人對香港主權移交中國⼀事自然極為恐懼。⽽鄭經翰、 黎智英等人曾建議由英國出⾯，向其他國家租借土地，讓香港人移民當地，首 選澳洲達爾文港 1。鄭等人嘅構思不難理解，目的係將港人遷移到⼀個氣候、 ⾯積、地理等與香港相若嘅地方，在當地複製香港既有嘅制度及文化，避過中 國接管香港後出現嘅暴政。今日香港坊間或知識分子提倡建⽴嘅「新香港」 ⼤同小異，選址 於 愛爾蘭 2、台灣 3 等地，⽽建⽴模式亦類近八⼗年代版本，喺 不涉別國主權嘅方式，租借或 購買該國土地。近日學 者沈旭暉與 其拍檔「房 地產基金老闆」高廣垣推出嘅「特設城市」計劃，就有以下描述 4： 移 民 離 開 香 港 ⼀ 段 長 時 間，等 他 日 香 港 同 ⼤ 陸 環 境 變 化 再 考 慮 回 來 … … 我 們 可 以 組 織 集 體 移 民，在 海 外 建 ⽴ 新 城 市，⼀ 起 重 新 共 建 屬 於 自⼰ 的 家 園。 5 … … 能 否 引 入 香 港 的 優 良 制 度，端 看 主 權 國 家 的 意 願。6 高 廣 垣 解 釋，此 舉 並 非 如 ⽴ 國，只 是 建 ⽴ 讓 港 人可 ⼀ 起 ⽣ 活 的 新 城 市。 7

有如過往嘅「新香港」計劃，「特設城市」並無主權訴求，自然無法主宰移居地 上嘅法制和秩序。其次，佢哋認為香港可以喺世界各地任意重建。第三，佢哋 認為香港人要有「全球化公民」嘅身份認同，⽽非民族認同。換句話講，佢哋 嘅主張 就係矮化香港民族為不帶主權訴求、無祖地、甚至係無民族嘅「城市 居民」—⽽呢個正正反映現時「新香港」論述嘅最⼤弊病。

居住地主權問題及新香港選址 香港民族嘅主權訴求係無庸置疑，由我哋 追求民主嘅⼀刻，就等同索要 香港 嘅 主權。有別於民 族、國家合⼀嘅 概 念，學 者方志恆論證出另⼀ 套香港民 族 （stateless nationalism） （Fong，2019），主張香港 主義—「無國家民族主義」 民族毋須主權，取⽽代之追求嘅係「地方自治」。喺迴避挑戰中國主權嘅框架 下，方氏折衷咁提出佢對香港民族主義嘅 願景。但當民族 並 未管有居住地嘅 主權（如帝國佔領嘅殖民地），或寄居其他國家作為少數民族，民族命運就由 他人主宰。19世紀流散歐亞各地嘅亞美尼亞人、猶太人喺居住他國嘅情況下， 被居住國嘅主體民族無情壓迫、遷徙，甚至屠殺。因此正如世上所有民族，香 港民族需要⼀處土地去聚居，更要掌握該地主權，即成⽴主權國以保護 族內 各員；否定香港民族嘅主權訴求，形同忽略香港人嘅⽣存空間，隨時重蹈猶太 人同亞美尼亞人嘅遭遇。

香港人⽤以安居樂業嘅 新香港，其選址並非某⼀國際城市；正如世上眾多嘅 民族嘅棲息地，要有其歷史意義，甚至民族嘅祖地（Smith, 1999）。本文主張 香港民族必須喺 祖地上建⽴新香港 —自由同民主嘅香港 共和國，領土範圍 即南京條約、北京條約以及英中香港界址專條中訂明之土地、附屬島嶼及領 海。如何喺中國⼿上 重奪依片祖地可以視之 為 香港民 族 獨⽴ 運 動嘅 短 期目 標；長遠⽽⾔，此處更係香港民族安身⽴命、繁衍之所。

香港 — 作為祖地對香港民族嘅意義 香港作為香港民族嘅領土，具有潛藏嘅政治同文化力量；⽽香港亦同時 係香 港民族嘅祖地，對民族建構有無可取代嘅意義。祖地（homeland）又或譯成祖 居地、起源地，其意義並非僅限於「居住城市」，更有民族歷史意義嘅領土。祖 地對民族嘅重要性，早見於民族未誕⽣之時。學者史安東（Anthony Smith） 形容民 族嘅前身— 族群原型（ethnie）同祖地嘅關係，當土地同人長時間交 織，土地係點樣成為該族群嘅祖地：

對族群原型嚟講，當特定嘅地理空間同特定族群有咗聯繫，該 片地理空間係該族群嘅傳統發源地（或起源神話），或同族群 嘅歷史軌跡密切相關，如重光、定居或盛世。……特定嘅領土 同地貌亦藉此同歷史互相交織，變成族群歷史嘅重要元素，⽽ 土 地 亦 變 成 具 有 歷 史 嘅 祖 地 。 (Smith, 1999)

13 — ⾹港民族及其祖地

喺史安東對民族嘅定義，亦可以睇到祖地構成民族重要⼀環： 我建議將民族定義如下：⼀個具有名稱嘅人類共同體，佢哋喺 視作祖地嘅地方定居；全體成員均擁有共同嘅神話、共享嘅歷 史 、 獨 有 嘅 公 共 文 化 ， 以 及 共 有 嘅 法 律 同 習 慣 。 (Smith, 2010)

正因祖地有其歷史性，奪回香港呢片祖地，更要喺 依片香港人甚至其父祖輩 出⽣成長嘅土地上建⽴主權國，本文主張祖地對香港民族極為重要，即使喺 其他國家另建「新香港」亦無法取代。 香港作為祖地及領土，其對香港民族嘅意義，可分為兩方⾯：首先，從領土層 ⾯，香港 從地理上賦予香港民族嘅身份意義。領土係定義 族群身份嘅 基礎， 亦係⽤作區別「我者」同「他者」 （Penrose，2005）。我哋無辦法將香港從香港 人嘅意義割裂，因為族群身份本質上就具有明顯嘅 邊界，⽽依個邊界正 正係 依片領土⽽嚟。即使過往中國民族主義混淆香港人嘅民族認同，香港呢片領 土卻⼀直係香港人同中國人明確區分嘅根源，就算係處於殖民壓逼之下，呢種 區分亦從未改變。

其 次，從 民 族 層⾯，香港 作為 祖地 承 載住香港人⼀切文化同人 類活動，以及 最 重 要 嘅 民 族 記 憶。民 族 嘅 記 憶、神 話、符 號 需 要 依 附 祖 地 之 上（Smith, 2009），同時，人 類 天 ⽣有傾向（tendency）透 過 土地 加強與 歷史、記憶 和神 話 嘅 連繫（Penrose，2005）。民 族內涵、文化等 概 念係結合 時間同空間嘅有 機 體，⽽當我哋去敘 述香港民 族 及其文化，亦難以同祖地割裂。空間同民 族 嘅 連 繫 可見 於自然 地 貌（例 如山、海、河流等）同人 為空 間（例 如 建 築、街 道、紀念碑等）。 若果香港民族主動「流散」世界各地，⽽我哋⽤以連繫族內各員嘅空間，變成 與民族 歷史毫無交集嘅美國東岸嘅 唐人街、倫敦 街頭、墨爾本 海 邊，又或者 係香港嘅「複製品」，例如日本曾經有⼀處仿製嘅九龍城寨景點。即使我哋能 夠完全複製香港城市嘅外貌，但複製出嚟嘅將唔會係同⼀時空嘅 連 續體，內 裏嘅文化、記憶、象徵意義會隨遷移⽽喪失。海外覓地再建「新香港」除咗切 割香港依片重要祖地，同時亦將其附帶嘅經歷、記憶、神話、歷史同香港人永 遠斷絕，海外建⽴嘅「新香港」最終只會淪為民族表徵嘅標本。

15 — ⾹港民族及其祖地

不為離散而離散— 冇連繫嘅「離散」自絕民族命脈 現時海 外建⽴「新香港」嘅論述，經常提及離散（diaspora）等詞 8，但單純嘅 離開唔等同離散。為呈現祖地對離散族群嘅重要，本文引⽤學者William Safran對離散族群嘅定義： 1 . 離 散 族 群 或 其 祖 先 自 起 源 中 心 流 散 往 兩 個 或 以 上，位 處 更 邊 陲、甚 至 係 國 外 嘅 地 區。 2 . 對 祖 地 及 其 地 理 位 置、歷 史、成 就，佢 哋 對 此 保 有 集 體 記 憶、 視 角、神 話。 3 . 佢 哋 認 為 不 被 寄 居 地 嘅 社 會 完 全 接 納，部 分人 更 認 為 永 遠 唔 會 有 可 能 被 接 納，因 此 自 覺 被 隔 離 或 無 法 融 入。 4 . 佢 哋 視 祖 地 為 真 正、理 想 家 園，⽽ 當 情 況 許 可 下，佢 哋 或 其 後 裔 最 終 亦 應 要 回 歸 祖 地。 5 . 佢 哋 認 為 有 集 體 責 任 維 持 或 恢 復 祖 地 嘅 安 全 及 繁 盛。 6 . 佢 哋 親 身 或 透 過 代 理 人 繼 續 維 持 同 祖 地 嘅 連 繫。佢 哋 嘅 同 族 意 識 與 團 結 亦 圍 繞 住 依 種 連 繫 ⽽ 建 ⽴。 （ Safran, 1991）

其中第四至 六點嘅 原則，筆者認 為有助審 視「建 設 新香港」、移民問題等爭 議。香港民族主義者並非視離開香港為禁忌，筆者亦理解中國對香港民族嘅 迫害只會越趨猛烈，例如強制人口遷徙、送入集中營、政治或司法 逼害，現實 問題不得不⾯對亦令我哋思考，即使香港人不欲成為離散民族，亦終有⼀日「 被 逼」離散。離開並不等於 危害民 族認同及祖地意識，但離開卻缺乏祖地意 識、切斷同祖地嘅任何聯繫，又或者喺外地唔再從事與祖地相關嘅政治活動， 上述嘅離開與離散民族嘅本義相去甚遠。離散本質係帶有強烈嘅民族及祖地 認同，同「全球化公民」嘅身份主張互斥。以「經濟城市」出發嘅移民計劃，能 否令香港人嘅身份以「離散 族群」延續？筆者試 舉 波蘭人嘅美國移民潮例子 窺探⼀二：

自1880年起移居美國嘅波蘭人唔算係離散族群，佢哋嚟美國定 居同返工，佢哋⼤部分嘅後裔都輕易與其他族裔通婚以及同化， 唔 再 講 波 蘭 語 ， 亦 唔 再 關 心 佢 哋 父 祖 輩 祖 地 嘅 興 衰 。 (Safran, 1991)

由此可見，主動流散外地嘅新⽣活並無建構出所謂嘅「離散民族」，自身民族認 同瓦解只係時間問題。海外聚居地只會淪為香港版嘅唐人街，又或類似加拿⼤ 溫哥華嘅港人置業社區— 但Hongcouver永遠唔會成為香港。 我哋無辦法永遠綑縛流亡嘅香港人及其後代嘅民族認同，亦難以剝奪海外港人 自願歸化為其他民族嘅選擇（Shih，2007）。其次，即使香港人離散海外⽣活，作 為少數民族難敵主體民族嘅政策同化（Kymlicka，2001），族裔性將難以維持。

以美國離散嘅亞美尼亞人、希臘人、猶太人為例，佢哋嘅族裔性亦隨久居異地顯 著下降（Waxman, 2010；Payslian, 2010；Roudometof, 2010）。離散亦會令移 居美國嘅亞美尼亞人自願放棄早期移民嘅傳統價值，祖地嘅記憶、傳統、習俗 都被美國價值同身份認同取代（Payaslian, 2010)。筆者認為香港人流散世界各 地亦會⾯對上述民族嘅困難，例如民族意識下降、祖地影響力消彌等。筆者認為 要克服上述危機，可借助香港民族主義及其祖地主張，強化重回祖地嘅意識，海 外香港人民族意識下降嘅現象將得以緩和。⽽且，從亞美尼亞人、猶太人、希臘 人居美嘅案例，反映宗教並非維持民族性嘅唯⼀因素。甚至當宗教對民族失去 其影響力，祖地主張反⽽能鞏固族裔認同並團結族內各員（Safran, 1991），同時 釋除坊間對欠缺強烈宗教背景嘅香港民族，難以抵過離散嘅質疑。

結語 — 新香港必定喺香港 猶太人曾經⾯對相同嘅問題⽽分成多派，有派別主張喺應許之地巴勒斯坦建 ⽴猶太國，亦有主張喺烏干達、阿根廷、肯亞等地重建海外「新以色列」，⽤以 猶太人遷居當地；有派別甚至要嚴格遵從傳統教義，喺彌賽亞未再降臨嘅情況 下，反對猶太人重回祖地建國嘅主張。猶太人矢志重返祖地，最終⽴國嘅結局 俾到我哋啟示— 香港民族喺當下歷史嘅⼗字路口，應該要抱有點樣嘅主張。 香港人離開嘅原因，若果最終只為喺某國家某城市定居，然後稱佢為「新香港」 ；⽽非以海 外組 織 力量、返回依片祖地為最終目標，呢種離開只係純粹嘅 移 民，並無「海外新香港」聲稱「保留香港」嘅功能。本文引證無祖地主張嘅離開 註定徒勞無功，只係流散⽽非離散。更重要嘅係，香港人⼀旦缺乏與祖地嘅政 治聯繫及重返祖地嘅意志，民族認同亦註定隨逃亡過程中消亡。本文並無否定 離開嘅現實需要，例如人身安全受威脅、活躍於海外政治壓力團體，甚至係組 織流亡政府。筆者更希望透過重新審視祖地、離散等概念，呈現香港對民族建

構、政治及文化嘅象徵意義。若香港人離開後，卻無重返祖地嘅意志，只會將香 港主權拱⼿相讓—對中國⽽⾔，無香港人嘅香港係最為恰⽤，因為當香港人留 喺香港，必定會鞏固港人嘅民族認同及保留活躍反抗力量。 1980年代民族命運嘅歷史關口上，香港人未有竭盡全力保衛香港民族嘅祖地， 怯於與中國鬥爭。幸⽽，歷史機會再臨香港人⼿中，2019年嘅反中獨⽴運動令 香港民族重新掌握自⼰命運。香港民族只有為香港主權奮力⼀爭，不再避禍遠 走。妄圖喺外國「建⽴新香港」既會因涉及當地主權關係，聚居地政策將唔會 由香港人主宰，香港人嘅文化、習慣，甚至係⽣計亦難以維持。「移民投資計劃」 、「全球化身份」註定與貢獻香港嘅原來目標絕緣，香港人為此⽽放棄祖地及 其意識，更為中國殖民者所樂見。 若你決志為香港民族⼀員，且願為此畢⽣奮鬥，請你不論身處何地，必須堅持重 奪祖地嘅主張。新香港 —民主自由嘅香港共和國，定必建⽴喺我哋現時身處 嘅香港。

確 立 新 香 港 嘅 語 文 主 張

《新香港》創刊原委之⼀乃推動香港語入 文，令香 港民 族可以以慣 ⽤⽽值得自豪 嘅 語⾔去書寫自⼰所想。早 年香港⼤學學苑 曾 推 動「 新文學 運 動」，⽽港 語 學 亦⼀直 推 廣以香 港 語為 書 寫語⾔，可見香 港 語文 運 動近年嘅發展，加上 歷 來⼀直有不少香 港作家以香港語入文，迄今為⽌，香港社會 已注 意到香港語 嘅 重要。然則宏觀⽽⾔， ⼤ 眾 仍 然 未 能 消 除 以 所 謂「標 準 書 ⾯ 漢 語」（或「規範中文」、「標準中文」）為語 ⾔正 統嘅 誤 解，即 使 屢屢提出捍 衛「港式 中文 」，以香 港 語為次要語⾔ 嘅 謬思 並 未 得以糾正。 香港民 族要喺 香港以至世界⽴⾜，就不能 放棄以自⼰民 族嘅語⾔為正 統嘅 追求。職 是 之故，本刊主 張 香 港 共 和 國 須以「三文 兩 語」為官 方 語 文 政 策，並 以 之 為《 新 香 港》編 輯凡例。「三文」為 香 港文、英 文、 華文，⽽「兩語」則為香港語與英語。透 過 以香港文為主要 書 寫語⾔，我哋 希望 糾正 坊 間 認 為 香 港 語 係「非正 統 語⾔」、「方 ⾔」、「標準中文」嘅「變體」等謬思，認識

到香 港 嘅 語⾔絕非中文 嘅「港式 」版本， 更係 值得 香港民 族引以為 傲、自成⼀派嘅 語⾔。

香港語嘅前世今⽣—從香港語⽂政策講起 語⾔能建 構民 族身份，亦能扭曲同摧毀民 族身份，因此政 府（不論係殖民政 府抑或主權政 府）施行嘅語文政 策，皆能直接 影響民 族 成員嘅身份認同。英 屬香港最初以英文為唯⼀官方語⾔，透 過以英語為尚嘅 精英教育政 策，貶 抑 華文教育地位，以至喺早期形成語⾔霸權 （linguistic hegemony） 嘅情況 （Tsui, 2007）。直至六⼗年代，坊間不滿英政府施政，以華文為官方語⾔、要 求英政府實施「雙語政策」 （bilingual policy） 嘅訴求浮現，並於1964年首次 喺市政 局討論，及後香港⼤學學⽣又要求校方喺校務會 議中採⽤雙語，以至 ⽴法局喺六⼗年代 末亦開始討 論 實施雙語政 策，惟英政 府對 提升 華語或香 港語嘅訴求⼀直無甚表示，令民間因⽽不得不自⽴組 織、草擬方案向政府施 壓。1970年，「公事上使⽤中文問題研究委員會」 （Chinese Language Committee） 成⽴，對英政府提出四個訴求 （Tsui, 2007）： 1. 官方會議以英文與華文舉行，⽽英語並非加入政府部⾨嘅先決條件； 2. 將華文訂為法定語⾔； 3. ⽴法會議與文件提供華文與英文雙語版本，⽽翻譯現有條例及法例為華文； 4 . 政 府 與 公 眾 嘅 對 話、發 ⾔，應 以 雙 語 形 式 進 行；

當時英政府並未採納全部建議，⽽繼續以英語為加入政府部⾨嘅必要條件， 直至1974年華文先訂為法定語⾔；同年英政府喺《教育政策白⽪書：香港未來 ⼗年內之中等教育》（White Paper on Education Policy）中容許學校決定教學 語⾔（Medium of Instruction），嘗試將主動權交予教學團體及⼤眾，結果卻 令到以華語為教學語⾔嘅入學率由1958年嘅45%銳減至22% (Tsui, 2007)。 由此可見，喺英屬時期嘅英語 霸權下，不論係華語或香港語均未受到官方重 視，⽽英政府亦以殖民者嘅傳統姿態，以培養精通英語嘅 華人精英（English speaking Chinese elite）為目的去 調 整 語文 政 策（Tsui & Tollefson, 2003），

未有考慮到民間嘅語文需求。不過，縱然官方語文政 策刻意與民間語⾔存留 隔閡，香港語 作為民間主流語⾔，於廣告、招牌、標語 等⼀直隨 處可見，⽽英 政 府只係抬 舉英語地位，⽽無故 意要港人 摒棄自⼰語⾔，使香港語喺 英 屬時 期能繼續為香港身份提供養份。隨後喺英政府鞏固香港人身份嘅政策下，香 港語嘅地位更不斷提升，譬如舉 辦香港節、推廣港產片（例如與當時同為英 屬嘅新加坡夥拍電影）等，皆令香港語不局限於對內港人之間嘅交流，亦對外 體現香港嘅軟實力。 對 香港語 嘅 真正 壓 抑同威脅，乃係主權移 交以後嘅「兩文三語」（biliteracy and trilingualism）政策。主權移交之前，香港語與英語早已成為港人身份嘅 標誌 （Brewer, 1999），港人對香港語嘅 重視亦代表住對民族身份嘅自豪

（Sullivan et al., 2004, as cited in Tsui, 2007）。1998年香港政府將「普 通話」納入 正式 課 程，學 校由小⼀至中三皆須設普 通話 堂，隨 後亦「建 議 」 學校以普通話取 締香港語為教學語⾔（亦即所謂「普教中」）；喺官方定義下 香港語成為與共同語（「普 通話」）相對嘅「方⾔」，甚至謂香港語難 登⼤雅 之堂、非 港人母語 等。從語文 政 策 ⽽⾔，港府與 英 政 府 最明顯 嘅 分別，就係 後者雖志在抬高英語地位，卻容許甚至支持 香港語喺民間成長，前者卻係以 貶 人 揚⼰嘅 形式去取替 香港 語，引入 所 謂「規 範中文」同「普 通話/語」，強 迫香 港人 將第二語⾔當作為自⼰嘅「母語」使 ⽤，甚至 要求 放 棄香 港 語，干 預官方嘅語文慣例，亦侵略教育及日常⽣活嘅語⾔使⽤，⾜見英中兩國取 態 截然不同。

香港語既亡，香港民族亦亡 香港語既興，香港民族亦興 喺 殖民者（不論英國或中國）管治下，香港語不得 不依 賴官方嘅 語文 政 策 ⽽⽣存，⽽ 政 權嘅 取 態直 接 影 響香港語嘅發展空間：英政 府願意幫助香港 人鞏固本土身份（local identity），不單令英語成為 香港身份嘅⼀部份，香港語嘅發展亦令香港與典型 「華語族群」區別開嚟，使香港早喺英屬時期已形 成獨特（sui generis）嘅身份；反觀港府（亦即中國 政權）不僅無意發揚香港人嘅語⾔，更嘗試以外來 語⾔取⽽代之，並且 將 香港人混淆成「中華民族」 嘅 ⼀部份，目的只有⼀ 個，就係扼 殺香港人嘅 獨特 性。然則不論係英屬或中殖時期，香港語雖未被消

滅，但其作為民族語⾔卻從未得到官方重視，亦遭外來語侵害。 由此可見，喺 過去嘅時 代，香港語嘅發展全 然依附於政 權嘅取 態，其 興廢象 徵住政 權 對 香港人嘅 壓 逼與 容忍，亦反映 香港人喺 殖 民 壓 逼 之下如何維 持 自我。然則⼀直以來，香港人只能被 動 地抵抗殖民者對民 族 語⾔嘅 控制，短 期內或可以使香港語不至消失，長遠⽽⾔卻無法 令香港語得到應有嘅尊重。 連 殖 民者亦無 法 否認：香 港 語 係 香 港主體 意 識 嘅 載體，香 港 語本質上 就代 表香 港人 對 香 港 嘅 歸屬感 與連繫，殖 民者竭力貶 抑、消滅 香 港民 族 語⾔ 嘅 舉動，就係香港語 價值嘅最佳證明。 最後，從「三文兩語」嘅 主張，本刊期望釐 清：香港民 族 運 動並非為「去中國 化」⽽進行，⽽係為鞏固香港民 族 主體 及其⽣存空間⽽發⽣嘅 必然進 程，⽽ 「去中國化」只係此進 程嘅其⼀步驟。對劣質文化嘅排斥、對非我 族 類嘅鄙 夷，於香港民 族⽽⾔，「去中國化」從 來都係正當與逼切，然則香港民 族嘅 敵 我之辨，不能夠⽌步於認清敵人，更要意識到自身為何人何物，亦即係對香港 主體 嘅 認知，並要 有意 識 地去 維繫、擴 展自身嘅 優 勢。《 新香 港》謹 此倡議 香港民族 運 動應以「三文兩語」為綱領，並簡述香港嘅語文發展及香港語嘅 角色，皆旨在引導 香港民 族去認識自身與所 追求嘅 願 景，期望香港人明白： ⼀但放棄 對民 族語⾔嘅自主，任由殖民政 權決定佢嘅存亡興廢，即等同自願 斷 捨 香 港 嘅 主體，葬 送 香 港民 族 嘅 前途。捍 衛 香 港 語，就係 捍 衛 香 港 嘅 主 體，捍衛香港民族嘅⽣存空間。

縱權而審 殃民之庭 論 香 港 法 庭 五 宗 罪

在公義和主權之間，香港法庭必然堅定地站在主權⼀方。因通稱「送中條例」 的《逃犯條例修訂草案》⽽引發、自2019年6月初以來的全民抗爭運動至今已 超 過⼀年，殖民政 權⼀方至此僅在撤回草案⼀項上跪低，仍繼 續⼤肆 利⽤所 謂執法權和檢 控權打壓、迫害甚至殘殺香港公民。最明顯者莫過於包庇、縱 容所謂執法機關的香港 警隊襲擊、禁錮、侵犯公民，同時涉嫌殘殺⼤量抗爭 者再將屍體 偽裝成自殺，⽽倖存下來的受害者卻反⽽遭到刑事檢 控，隨時未 完成審判已先被法庭還柙。 2020年3月初，有因被指參與製造炸彈的香港人，在被香港 警察拘捕後 嚴重 受傷，可能因此⽽終身不良 於 行，還被 指已招認犯事。香港 警 隊成員以酷 刑 虐 待 被 捕人士，屈打成 招，可謂 證 據 確 鑿。然⽽，前述 補 捕人士卻 於 裁判法 院 提 堂 後不獲 保 釋，被 虐 待至 嚴 重 受傷然 後 慘 遭 還柙，⽽施 虐的香 港 警 隊 則安然無恙。 相信稍有常識的人，都會覺得荒謬：明明是警暴的受害者，就當他們真的犯了 法，但為何只有他們被檢控、失去人身自由，⽽明顯干犯更嚴重罪行的「執法 者」卻可逍遙法外？ 但如此荒謬之事，卻是「合法」：本身擁有調查權力的警察對公民施暴後，只 調查公民是否有違法，⽽不對自身作公平調查，亦沒有另⼀機關有權力有效

“在公 義 和主權 之間，香港法庭 必然堅定地站 在 主 權 一方。” — 施庭國

地調查警察，因此最後只有公民違法的證據，卻沒有警察施暴的證據，亦沒有 警察未能公平調查自身的證據，負責檢控的律政司亦只檢控公民，⽽法庭就此 「依法」處理送到它⾯前的檢控案件。香港的所謂「法治」，就是如此容許法 庭「依法」坐觀執法和檢控機關偏坦腐化。 2020年6月30日，中國繞過香港⽴法程序，於香港訂⽴所謂國家安全法，惟直 至此所謂法律⽣效，整個香港仍未知道條文內容。不⾜⼀日之後，更即有香港 人被指違反此所謂法律⽽被捕，亦是被捕後受傷留院，然後 未審即遭 還柙至 今。更甚者，直至目前為⽌，被指違反所謂國家安全法的，不少更是未成年的 青少年。 香港法律的荒謬程度，紀錄時刻刷新，幾無下限。可惜直至現在，仍有不少人 覺得香港是法治社會，要相信法律，相信法庭。事實是，不論是否如中國所要 求的「三權合作」，法庭就是政權體制的⼀部份。所謂「香港司法獨⽴」，與「 香港 獨⽴」的那個獨⽴不同，終究還是服 膺中國的殖民主權。是以香港的法 庭，在政權與個人之間，從來不會公正，其制度本質就是以法律之名維護、偏 坦殖民政權，針對與政權抗爭的每⼀個香港人。 本 文 將 列出 香 港 法 庭 的五 宗罪，說 明 在中國 殖 民下，香 港 的所 謂 法治 僅 屬 笑話。

第一宗罪： 面對政 權的 議 題制設權，甘當 機 器齒輪 香港刑事制度腐化的根本原因，是在無有效制衡 和制裁政權的前提下，讓政 權壟斷 刑事檢 控權，所謂私人刑事傳票，在律政司選擇性介入然後 撤 控 1下， 已形同虛設。香港法庭的罪孽，就在於對此壟斷盲目，在檢控權的不平等下， 還妄⾔法律下之平等。 終審法院首席法官馬道⽴於2020年1月時指，檢控並非由法庭控制 2。他沒有 明⾔的其實就是，法庭審理甚麼刑事案件，全由檢控控制。僅此就⾜以說明， 就刑法⽽⾔，香港的所謂法治，只是政權所壟斷的檢控權之下的玩意。當根本 沒有「違法檢控」和「違法不檢控」的概念

理由決定不檢控胡仙也沒有違法)，政權永遠是主宰刑法權力的⼀方。 以為是 維 護 公 義 的 法 庭，實 際 上只能 處 理 政 權 所交付 的 案件，僅回答 被 檢 控之人是有罪還是無罪，除此之外可⼀概不 理。⼀台審案 機器，檢 控 權下的 齒輪，竟還妄以正義女神Just it ia 為象徵，是冒瀆，也是我們的共業。

第二宗罪： 摧 毀 公民 人 ⽣ 坐觀 政 府濫權 既為檢控權下的齒輪，自是只理會被檢控者有罪與 否的相關問題，其餘⼀概漠視。因此，法庭不會問檢 控之決定是 否合 理，也不會問檢 控前的「執 法」本 身涉及多少犯罪行為，只會將 被檢 控的人當作涉嫌 犯罪者者按程序處理。 在香港 的法 律 制度 下，只有法庭能「合法」禁 錮他 人，並留下該人之官方犯罪記錄— 判處罪名成⽴， 命令將 被告收 監的權力，全在法庭。⼀旦淪為階下 囚，不但失去人身自由，即使刑滿出獄，犯罪記錄亦 將纏繞終⽣，成為職業、移民等方⾯的障礙。有罪與 否，天堂與地獄，就在法官⼀念之間。

⽽在檢控提堂與最終判案之間，被告是保釋還是還柙，決定權也在法官⼿上。 觀乎法庭對抗爭檢 控案件的處理，即使准許 保 釋，也幾乎⼀律要求交出旅 遊 證件，外加宵禁令甚至特定地方的禁⾜令，剝奪被告日常⽣活的各種自由，可 謂未審已先打五⼗⼤板。在所謂國家安全法⽣效後，被控違反該所謂法律者 更幾乎全遭還柙，政治案件⼀律未審先囚，漸成趨勢。 事實 就 是，無 論 檢 控之 最後，被告有罪 與否，受 影 響 的只有 被告。參 與「執 法」、搜證、檢 控的政 府爪牙，不論過程 如何無法無天，只要不被 檢 控，就沒 有後果，俸祿依然，即使檢控失敗須賠償訟費，也是納稅人的錢⽽已。 ⽽我們的法庭，深明卻坐觀上述⼀切，繼 續處理每⼀宗檢 控案件，「依法」只 針對 被 檢 控者作出可影 響其⼀⽣的裁決。縱容政 權檢 控執法⽽只針對 被告 的所謂「司法」，終究是獨裁政權人治的附庸。

第三宗罪： 與政權打壓抗爭、 「止暴制亂」的目標一致 法庭按法律審理控罪，法律不容許「不合法」 的抗爭方式，⽽獨裁 殖民政 權下法 律由政 權 單方⾯訂⽴，不利政權存續的抗爭自會被定為 不合法。只要⼀種政 權不欲見的行為根 據法 律屬於不合法，法庭就自然與政權站於同⼀陣 線，在打壓該種行為上目標⼀致。⽽當政權不 受人民約制，可隨意訂⽴法律，法庭就不過是 看似獨⽴公正、實質可被政權輕易操控的打壓 工具。⽽正因為看似獨⽴公正，禍害更深。

根據《公安條例》，任何集會可隨時被政府宣佈為非法，⽽非法集結、暴動等 罪名的入罪⾨檻極低。加之以法律對人民使⽤武力的禁制，以及煽惑、唆使、 串謀等延伸控罪，有效的抗爭行動皆能輕易被視為非法，可謂動輒得咎。在所 謂國家安全法下，甚至罷工堵路，或要求外國制裁香港，皆屬違法，更可被判 終身監禁。因此，政權只需利⽤檢控權，安插罪名將抗爭者送上法庭，惡法也 是法，⼀旦覺得證據⾜夠，法庭自會如政權所願，輕易將抗爭者判成罪犯。 如果你明白法律只為主權服務，那道理更簡單：歸根究柢，法庭也是政權的⼀ 部份，所謂「司法獨⽴」，只是獨⽴於行政和⽴法機關，終究不過是同⼀個主權 下的另⼀公權力載體⽽已，其本質仍然是為主權利益 服務的機關，其所維護 的公義，只會是主權認可的公義。當香港主權在樂於打壓⼀切異見的中華人 民共和國極權政府⼿中，香港法庭自然是配合「特別行政區」殖民政府，維護 殖民惡法，站於與香港人敵對的⼀方。

第四宗罪： 以個人追求公義的風險，誘迫受害人向政府妥協 所謂香港法律保障個人櫂益，在政府⾯前只是空談。先說所謂緘默權，君不見 多少被告在法庭上投訴被香港警察屈打成招？⽽法律就是，雖然在壓迫

嚇、氹) 下作出的招認可被拒絕呈堂，但到底是否曾有壓迫、又是否拒絕相關招 認呈堂，全是法官說了算。⽽即使法官確認被告曾遭壓迫，只要政府不檢控壓 迫者，壓迫者仍可逍遙法外，法庭只會繼續處審理眼前的被告是否有罪。 另⼀方⾯，任何律師都會告訴你，沒有人能百份百預測官司的結果。不論民事 刑事，法庭的最終判決很難事前預測，是故⼀旦纏上官非，就必然有敗訴的風 險。就刑事案件⽽⾔，即使被告確實清白，法庭也可以因為「警察是誠實可靠 的證人」⽽信納被告有罪。因此，⼀旦被檢控，不論清白與否，認罪以求減刑、

避免監禁，或與控方磋商改控較輕罪行、自簽守行為以換來不提證供起訴等， 往往是律師有責任告知，⽽被告亦必須慎重考慮的選項。更重要的是，香港的 法律費⽤⼀點也不低，相信法律公正，為了還自⼰清白⽽進行正式審訊，⼗萬 元也只是最低消費。(順帶⼀提，法律援助不適⽤於處理最多刑事案件的裁判 法院，裁判法院只有「當值律師」 (duty law yer)，⽽他們不會為被告提供詳 細和全⾯的法律建議。) 可悲的是，刑事案件的⼀切訴訟風險，實際只在被告身上，因為控方的法律費 ⽤由政府支付，敗訴的最壞情況只是賠被告訟費⽽已，全都是納稅人的錢。因 此，我們時常看見很多明顯是無辜的被告，也不會把官司打到底，⽽選擇以不 同程度的妥協方式解決案件。 民事案件方⾯，法庭更是開宗明義地鼓 勵與訟各方妥協，名為和解，反正原告 在民事訴訟可以獲得的，基本上也只是金錢賠償和法庭對事件對錯的公開確 認 (連律師也可能不知道，根據《官方法律程序條例》第16條，法庭不可在民 事案件中針對政府頒下禁制令)，和解可節省法庭資源。換句話說，香港法庭 處理民事案件的理念，是解決紛爭遠先於彰顯公義。況且法庭還會命令敗訴 方承擔勝訴方的訟費，在訴訟所涉及的風險 和鉅額費⽤下，人民控告政 府⽽ 把官司打到底，基本上沒有甚麼好處。是故⼤部份這類訴訟，往往都在開展後 ⼀段時間，在⼤眾不知不覺間私下和解了事。 當政府有無限資源打刑事和民事的種種官司，理性的利害衡量往往教人向政 府妥協，這就是香港的司法制度。

第五宗罪：行使權力最無法律後果，真正逍遙法外 出於為紛 爭 作出終局決定的作⽤和所謂「司法獨⽴」的考慮，挑 戰 法庭判決 的唯⼀方法，只有上訴至更高級法庭，⽽最高級法庭 所作之判決則無可挑 戰 (當然香港 殖民政府有提請中國人⼤釋法 這⼀辦法)。惟即使上訴成功，上訴 庭推翻下級法庭的判決，相關下級法庭法官亦不會因錯誤判決⽽負上任何個 人責任。 因此，即使任何法官出於政治考慮，判案偏坦政權，人民根本無從追究。況且 香港法官本來就全都是律師，慣 於爭拗法律觀 點，在判詞中以法律外 衣包括 政治理由，從來不是難事。不論結論如何荒謬，影響如何深遠，只要⽤法律語 ⾔包裝判決，法官和法庭就絕不會有法律責任。 讓 ⼀ 個 不能 被合法 制 裁 的 機 關 ⼿ 握法 律 ⼤ 權，然 後 說 這 是法治，只能 說 是 又⼀共業。

結語：法律和法庭皆主權附庸 法 庭 ⼀ 直 以 來 之 所 以 為 香 港 人 尊 重，乃 由 於 法 律 高 深、超 然、權 威 但 公 正 的 印 象，背 後 是 對 英 國 帶 來 的 制 度 的 信 任 ，或 ⼀ 廂 情 願 的 期 望。同 樣 的 普 通 法 制 度 為 何 在 英 國 行 之 有 效，涉 及 英 國 多 個 世 紀 的 歷 史、政 治 發 展 ，特 別 是 對 皇 權 之 制 約 和 非 明 文 憲 制 下 「憲制慣例」的存 在，不是本文 能充分探討的問 題。不 難理 解的是，⼀國之法律 和其實踐 乃主權 的產物，主權對 法律的態度決定了司法機關的政 治角色。 因此，即 使表⾯上是同⼀ 套 法 律 法制，從 英國重 法 的 議 會主權 來 到 慣 於以法 律作 為 打壓工具的 極權中國殖民者⼿中，早已不是同⼀回事，法庭卻 無視主權的質變⽽繼續「依法」行事，自然淪為殘 害人民的權佞。作為不公義的殖民主權下的權力 機 關，卻妄詡 為公 義的 化身和持守者，是 最不道 德的欺詐。 ⾯對殘害香港公民的中國殖民主權，我們實應放 棄 對 香 港 法 庭 和司法 制 度 的 ⼀ 切 幻 想。香 港 的 真正出路，必然包括對司法制度的徹 底清洗和革 新。願這⼀天早日來臨。

37 — The New Revolution

The New Revolution When Hongkongese stormed the Legislative Council building and left a graffiti reading “It is you who taught us peaceful marches are useless” on 1st July 2019, when the cries of “Liberate Hong Kong, Revolution of our Times” reverberated during the Siege of the Liaison Office on 21st July 2019, and when people from all walks of life stood solemnly with their heads held high in singing “Glory to Hong Kong” from mid-August onwards, we know that what is unfolding in Hong Kong is no mere social movement, nor simple protest. What we are witnessing is the culmination of various incidents into an unstoppable turn of history: the inevitable birth of the Hongkongese.

At its core, the birth of the New Hong Kong is about a newfound pride. It is a pride that grew out of a long forgotten root, and Hongkongese’s collective struggle forced this root to blossom. The identity of “Hongkongese” is by no means a new one, though it has never been an identity that could confidently stand on its own. Before 1997, we were “Hongkongese under British colonial rule”, or even “British subjects”. There was no pride then, and even

Michael Tam Lee Lai-Shan’s Olympic gold medal in 1996 was greeted as a flash in the pan legend rather than an imitable inspiration for the common Hongkongese. After 1997, we changed from subjects to “Hong Kong citizens”, though it did not take long for people to realise that this citizenship actually meant “Hongkongese under Chinese colonial rule”. Depending on how effective the nationalist propaganda from China was that year, varying portions of Hongkongese would gladly accept the monikers of “Hongkongese in China”, “Chinese in Hong Kong”, or even just “Chinese”. The height of the latter options surged during the Beijing Olympics in 2008, when the extravagant opening ceremony both worried international eyes, and wooed quite a few “Hong Kong citizens” into declaring themselves as proudly “Chinese”. Even then, there was no pride, but attachment to an illusion of grandeur that China conjured. The term “Hongkongese”, in contrast, meant nothing more than a periphery to the centralised glory that is China. Hongkongese looked North, seduced by the riches and a mythological framing of a Chinese past, and dreamt a long and distant dream, forgetting their own roots. It was a nightmare, accepted by many as a dream.

All of this changed in 2019, when the unyielding embers of 2014 and 2016 merged to fan the flames of revolution.

2014’s “Umbrella” was a failed movement, a long wheezing of a pressure pot that failed to apply actual pressure on the government. This failure was largely due to Hongkongese’s political inexperience and the resulting inability to do anything more than just sit-ins when the goal is something as grand as achieving universal suffrage from an authoritarian regime. 2016’s “Fishball” was an incomplete uprising, a short burst of energy that failed to awake enough Hongkongese from our Chinese nightmare. But people never forgot the lessons, and with time the failures of the past finally bore fruit. While China was busy pushing for further infiltration, forcing their brainwashing “national education” curriculum in 2012, disqualifying localist legislature candidates in 2016, and legitimising extrajudicial murders with their extradition bill in 2019, Hongkongese were waking up to the truth — the truth that being a “Chinese” means not citizenship, nor subjugation, but the utter destruction of what it means to be a Hongkongese. Hongkongese ourselves have long forgotten our own roots, but this unrelenting series of oppression, this unending will from China to destroy the last elements of Hong Kong, has unwittingly awakened something buried deep within: Stand up as Hongkongese now, or forever perish. There is no room left for ambiguity, as even the humblest housewife is forced to make a choice: Fair, or rigged elections? Rule of law, or rule by law? Education, or brainwashing? Hong Kong Cantonese, or Putonghua? Democracy, or constant fear of arrest? Hong Kong, or China? The people chose Hong Kong, and they replied with not only words, but also action.

Were it not for China’s insistence on bringing down the boot so relentlessly, many of the people you see now partaking in the ongoing struggle would not even need to make this choice in the first place. The police working with Triads was already a thing in 2016, but in 2019 they terrorised a residential area instead of a small pocket of protesters. The riot police firing tear gas indiscriminately was already a thing in 2014, but in 2019 they mixed in bean bag shots and live rounds, all aimed at heads and even eyes. When even the elderly enjoying an afternoon nap in their retirement homes would be subject to senseless teargassing, they too were forced to put on gas masks and confront the regime on the streets with naught but a walking stick and their age. There is suffering, there is anger, and with these even the most apathetic has awakened and rediscovered our root, for the only pathetic ones are those who choose to remain apathetic in times such as this.

What, then, is this root that Hongkongese rediscovered? If you ask around “What makes a Hongkongese a Hongkongese”, or “What is it that you are fighting for”, it would seem that the answers vary, or even conflict with each other. On the subject of the judiciary, for example, some would say they are fighting so that Hong Kong’s rule of law may be preserved, yet ask another and he would say Hong Kong never had any rule of law in the first place, and the courts are merely a facade legitimising the ultimate sovereignty of China, who holds final interpretation powers over the Basic Law, our “mini-constitution”. The situation is likewise for the subject of democracy, with some saying we must mobilise our votes and win both the District Councils and the Legislative Council, and yet some other saying the medicine suitable for our Legislative Council is not our votes, but the complete abolishment of the Functional Constituencies, a systemic flaw that ensures at least 50% of the seats will go to Pro-Chinese candidates well before the actual elections even begin. Look beyond the immediate disagreements, however, and you will see a common set of goals. The person who wants to preserve our rule of law and the person who wants to get rid of the rubber-stamping courts both want the same thing: a judiciary that is free of Chinese influence, a judiciary that belongs to the Hongkongese. Likewise, the person who wants to win the majority in the elections and the person who wants to reform the whole electoral system both want the same thing: a legislature that is free of Chinese influence, a legislature that belongs to the Hongkongese. Extend the same to all other facets of the ongoing struggle, and we

arrive at a simple root: what Hongkongese want is a Hong Kong free of China’s influence, a Hong Kong that belongs to the Hongkongese. Like a master architect who found himself speechless one day when discovering a humble and perfect brick, Hongkongese woke up to the simple and perfect fact that Hong Kong is what it is because of us, and it is our duty and pride and joy to fight for it, because it is not happenchance that we are Hongkongese — fate dictates that we are not British, nor are we Chinese, but Hongkongese, and on this land do we make our stand.

Whereas the Old Hong Kong would choke and go home when facing tear gas, the New Hong Kong would don gas masks and keep advancing with arms. Whereas the Old Hong Kong would self-censor when China accuses them for harbouring separatist sentiments, the New Hong Kong would hold his head up high as he sings his national anthem, “Glory to Hong Kong”. Whereas the Old Hong Kong would flee when the Triads and the police charge them with machetes and batons, the New Hong Kong would charge back with a bamboo phalanx. For the first time did Hongkongese realise how much we can actually do for our home. For the first time did Hongkongese realise how important our home is, not just to us, but also to the rest of the world. For the first time did Hongkongese experience hands-on the tragic beauty and joyful pride of fighting for the future of your own homeland and of those who share the same fate as yours. All of this because there is finally something worth fighting for — the rebirth of the long forgotten root of Hongkongese, and from it sprang the newly forged identity of the New Hong Kong. All that clouded our past must go, all that deluded our identities must be cleansed, and all that poisoned our fates must be purged, all for a Hong Kong that is truly free of Chinese influence, all for a Hong Kong that truly belongs to the Hongkongese.

Like droplets gathering into a brook, brooks into a river, and rivers into a vast ocean, the force behind this turn in history cannot be stopped. Try as they may, all of China’s actions only hastened and strengthened this turn. They from their corrupt and illegitimate seats do not and cannot realise that the birth of the New Hong Kong is as natural and inevitable as the cherry blossoming from a buried seed, the migratory birds flocking to their kin, and the storm bringing rainfall after a long culmination of rain clouds. They cannot understand and

they cannot prevent the New Hong Kong, for China’s own rise is unnatural, illegitimate, and fated to be corrected in the long flow of history. The Revolution of our Times is upon us, and a new era and a new future awaits the Hongkongese.

Hongcongum or, On the Origin and Situation of Hoeng1 Gong2 Jan4

Hongcongum will be serialised in each issue of New Hong Kong, and will be published as a separate book after serialisation.

The following is, perhaps, the first ethnographic account of Hong Kong in the style of the ancient writers.

Modelled after Tacitus’ Germania, Hongcongum asks the question of ‘what is the Hong Kong nation’ from a foreign observer’s perspective.

The account goes through the constituents of a nation in detail, from the physical boundaries of the land, the geographic features thereof, to the people themselves, their physical characteristics, their way of life, their values, their religion, their marriage and funereal customs, and so on and so forth, even to such distinctions as their national drink, and their common daily routine from wake till slumber.

The latter half of Tacitus’ work is not used in Hongcongum as, unlike Germania, Hong Kong is not a vast land of many tribes, but an urban city of a homogeneous people living in close proximity with each other.

Hongcongum, I

Physical Boundaries of Hong Kong Hong Kong is separated from the Chinese by the Sham Chun River, the Sha Tau Kok River, and the Deep Bay. To the North a 30 km land boundary marks the formal separation between the two peoples between the Northernmost of the Hong Kong New Territories and the Southernmost of the Chinese Shenzhen, a boundary that is further buffered by the Frontier Closed Area.

The other parts, to the East, West, and South, with the Hong Kong Island leading a cohort of 263 islands, are surrounded by the South Sea within the greater Pacific Ocean.

To its Easternmost stands the island of Ping Chau, to its Southernmost, Tau Lo Chau, and to its Westernmost, the stack island of Peaked Hill.

The Pearl River meets its fresh water end to the west.

In recent times political strife has revealed the existence there of a national consciousness unknown before.

The Hongkongese themselves, I am inclined to think, though recent as they may be called a people, are truly natives of the land.

For in ancient times the inhabitants have come and go, under the diverse banners of first the Yue State, then under the Qin Empire, the Mongol Empire, but the Great Evacuation during the First Manchu Empire has all but left the land abandoned by any previous inhabitants.

Later immigrants come and go, but it is not until the crucial period of British rule after the First Anglo-Chinese War when the Hongkongese that we know today started to emerge from what was merely off-shoot clans from different Sinic tribes, still holding on to their previous loyalties.

It was during this time of British subjugation that, as is the way how history’s guiding hand is most generous when a people treads through their hardest times, the Hongkongese emerged and blossomed.

The British formal demarcation of physical borders combined with the local emergence of an ethos and identity separate from the Chinese, forged through a truly metropolitan process of cultural borrowing, signified the seed of what we know as Hongkongese today.

It is by this unique process, uniquely happened thus only for all the intricate historical, geopolitical, and cultural contexts surrounding this land and this people, a process that could have only happened in this place and in this time, that Hongkongese are called truly the natives of Hong Kong.

縱 然 香 港 人 到 近 代 先 得 到 正 名，但 香 港 真 正 嘅 原 住 民 其 實 就 係 香 港 人。

時 代 更 替，人 來 人 往，從 最 早 嘅 越 國 子 民，再 由 秦 帝 國、 蒙 古 帝 國，⼀ 直 都 有 人 喺 呢 片 土 地 嘗 試 定 居，喺 滿 洲 帝 國 嘅 逼 遷 下，香 港 頓 成 無 人 之 境。

其 時 有 不 少 移 民 過 客 飄 流 過 境，當 中 不 少人 依 然 以 宗 族 自 居，直 至 英 屬 時 期 先 認 清 香 港 人 嘅 身 份。

歷 史 總 係 企 喺 香 港 人 嘅 ⼀ 方 — 英 政 府 管 治 下，香 港 渡 過 咗 許 多 艱 難 時 刻，⽽ 香 港 人 身 份 亦 從 此 興 盛。

隨 著 官 方 劃 定 香 港 邊 界，與 中 國 截 然 不 同 嘅 思 想 及 身 份 成 社 會 主 流，促 使 香 港 逐 漸 蛻 變 成 文 化 薈 萃 嘅 ⼤ 都 市，亦 為 今 日人 所 共 知 嘅 香 港 民 族 埋 下 種 子。

Religion of Hong Kong, in brief

In their worship the Hongkongese practise an eclectic mix of religions.

From the Asian triptych of Buddhism, Taoism, and Confucianism, to the European denominations of Christianity, and even small pockets of Sikhism, Zoroastrianism, Islam, Judaism, and Hinduism.

The celebration of religious freedom is a virtue agreed upon by both the people and the law.

There are still those yet who do not profess any faith, but instead claim a form of agnosticism or atheism.

These, too, are celebrated as expressions of the land’s religious freedom.

香 港 民 族 內 兼 容 唔 同 嘅 宗 教 信 仰。

由 佛 教、道 教、儒 教，至 基 督 教 嘅 歐 洲 分 支，有 少 部 分人 信 仰 錫 克 教、祆 教、伊 斯 蘭 教、猶 太 教、錫 克 教 及 印 度 教。

宗 教 自 由 係 香 港 嘅 價 值，並 受 香 港 人 以 及 法 律 認 可。 唔 少 香 港 人 並 無 宗 教 信 仰，佢 哋 會 以 不 可 知 論 者 或 無 神 論 者 自 居。

Racial-physical characteristics of Hongkongese For myself, I accept the view of those who think that the peoples of Hong Kong are of a distinctive racial stock.

Whilst differences might not be as pronounced when comparing with the Shenzhenese Chinese just North of the border, clear distinctions could be made when comparing the common Hongkongese with the common Beijingese Chinese.

Hence the physical type, if one may generalise about so densely

populated a land, is characteristic of its kind — dark brown eyes set within a creased upper eyelid, black hair that bears with it a natural shine, and slender frames that were no doubt the result of their climate and sea-dependent diet.

Their faces are of the oval shape, and their nostrils generally small.

In profile, their foreheads protrude further than their eyes, and their mouths less pronounced than their noses.

Their lips are modestly sized, and their skin tone generally of the lighter of the Asiatic varieties.

They have no corresponding power to endure the cold winds of the Chinese North, and little capacity to bear the desert dryness of the Chinese West, but their climate and soil have taught them to bear humidity and heat.

As with all nations, peoples from distant lands inevitably drift in over time. The Vietnamese, Nepalese, Indian, Parsee, Indonesian, English, Scottish, Irish, and various other races have all settled in Hong Kong over her history.

Geographic features of Hong Kong The country in general, whilst richly varying in character at places, is largely hilly and mountainous with steep slopes.

It is flatter where it faces Chinese Shenzhen, where lowlands can be found, and windier where it faces the South and East, where an oceanic breeze permeates the air.

These Northern lowlands saw quick adoption by skilled farmers, who planted mainly rice, their grain crop, together with various gourds, other fruits, and vegetables suitable to the climate.

The abundance of the surround waters, however, meant that the majority of Hongkongese relied on aquaculture and trade: from farming the rudimentary salt, to catching the majestic Hong Kong grouper, and further the entrepreneurial, international logistics.

Indeed, the defining geographic nature of the Hongkongese, if a people could be characterised geographically, is that the rich unknowns of the sea has urged the people to go beyond the firmness on which they stand.

Unlike their neighbouring Chinese, who enjoyed long periods of isolationism and land-locked civil wars, the Hongkongese have always been a people opened to the world via the open sea.

Though now famed as a metropolis with distinctly high population density, the land was and still is a miracle in its abundance of nature’s gifts.

For a total territorial area of 2,754 sq km, Hong Kong boasts more than 5,600 recorded species.

The land has about 250 recorded species of butterflies as of writing, and more than 1,000 animal species in total.

The marine numbers is of particular note, with as many as 5,943 marine species found in Hong Kong, a number on par with the entire Baltic Sea. For as much as 1,650 sq km of Hong Kong’s waters, a size only 17/100000 of China’s, the number of species found here exceeds 1/4 of theirs.

The land itself is largely dominated by Mesozoic volcanic and granite rocks, making up about 85% of the total land area, with sedimentary rocks of different periods and sand deposits filling up the rest. Mother Nature has graced the Hongkongese with a surprisingly large number of minerals despite the land’s small size.

The metalliferous minerals range from the common tin, copper, and lead, through zinc, iron, tungsten, and molybdenum, to placer deposits of gold.

Non-metalliferous minerals abound, with kaolin clay, feldspar, quartz, beryl, and graphite being the ones sought after by the people for their commercial value.

Despite the abundance in both raw and commercially gained wealth, the Hongkongese of this day are usually free of the desire to wear any more than the odd decorative piece of jewellery.

Were one to own any significant amounts of gold, it is to be stored away, perhaps as insurance of mind, but never to be displayed on the body as validation of worth.

Indeed, such displays are commonly viewed as a sign of vulgarity, and has been a defining characteristic of the visiting Chinese from the North, a people who holds the opposite belief that wealth’s worth depends on its raw, golden, dazzling display.

Instead, the Hongkongese are content with an unassuming silver ring, or a necklace affixed with a singular jade.

At no times are these validations of personal worth, but are almost always a memento for an event of significance, perhaps a wedding vow, perhaps an anniversary.

擁 有 無 數 黃 金 或 者 令人 心 安，但 始 終 無 法 代 表 其 真 正 價 值。
